			</subsection></section><section commented="no" display-inline="no-display-inline" id="HD1E8D973509F4071B8767C24A05A538"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph commented="no" id="H962A1B27B0F04E2B921DE6679D930012"><enum>(1)</enum><text>Thousands of
			 rescue workers who responded to the areas devastated by the terrorist attacks
			 of September 11, local residents, office and area workers, and school children
			 continue to suffer significant medical problems as a result of compromised air
			 quality and the release of other toxins from the attack sites.</text>
			</paragraph><paragraph commented="no" id="H3F0F51A1E2534F5983E1324DD185F9E4"><enum>(2)</enum><text display-inline="yes-display-inline">In a September 2006 peer-reviewed study
			 conducted by the World Trade Center Medical Monitoring Program, of 9,500 World
			 Trade Center responders, almost 70 percent of World Trade Center responders had
			 a new or worsened respiratory symptom that developed during or after their time
			 working at the World Trade Center; among the responders who were asymptomatic
			 before 9/11, 61 percent developed respiratory symptoms while working at the
			 World Trade Center; close to 60 percent still had a new or worsened respiratory
			 symptom at the time of their examination; one-third had abnormal pulmonary
			 function tests; and severe respiratory conditions including pneumonia were
			 significantly more common in the 6 months after 9/11 than in the prior 6
			 months.</text>
			</paragraph><paragraph commented="no" id="H8B88EFB510CE4FD2A1FDF77B99610053"><enum>(3)</enum><text>An April 2006
			 study documented that, on average, a New York City firefighter who responded to
			 the World Trade Center has experienced a loss of 12 years of lung
			 capacity.</text>
			</paragraph><paragraph commented="no" id="HF623B1CA57DE4ED08D48D1EB2B6CA6A8"><enum>(4)</enum><text display-inline="yes-display-inline">A peer-reviewed study of residents who
			 lived near the World Trade Center titled “The World Trade Center Residents’
			 Respiratory Health Study: New Onset Respiratory Symptoms and Pulmonary
			 Function”, found that data demonstrated a three fold increase in new-onset,
			 persistent lower respiratory symptoms in residents near the former World Trade
			 Center as compared to a control population.</text>
			</paragraph><paragraph commented="no" id="HE65A13ADF9654DEBA93E2487640840E2"><enum>(5)</enum><text>Previous research
			 on the health impacts of the devastation caused by the September 11 terrorist
			 attacks has shown relationships between the air quality from Ground Zero and a
			 host of health impacts, including lower pregnancy rates, higher rates of
			 respiratory and lung disorders, and a variety of post-disaster mental health
			 conditions (including posttraumatic stress disorder) in workers and residents
			 near Ground Zero.</text>
			</paragraph><paragraph id="H443EB3DC6EBF4FCFBBFC4E96557197F"><enum>(6)</enum><text display-inline="yes-display-inline">A variety of tests conducted by independent
			 scientists have concluded that significant WTC contamination settled in indoor
			 environments surrounding the disaster site. The Environmental Protection
			 Agency’s (EPA) cleanup programs for indoor residential spaces, in 2003 and
			 2005, though limited, are an acknowledgment that indoor contamination continued
			 after the WTC attacks.</text>
			</paragraph><paragraph id="H9BD2BB6F252F4BBD00E34F7EC26B5965"><enum>(7)</enum><text display-inline="yes-display-inline">At the request of the Department of Energy,
			 the Davis DELTA Group at the University of California conducted outdoor dust
			 sampling in October 2001 at Varick and Houston Streets (approximately 1.2 miles
			 north of Ground Zero) and found that the contamination from the World Trade
			 Center <quote>outdid even the worst pollution from the Kuwait oil fields
			 fires</quote>. Further, the United States Geological Survey (USGS) reported on
			 November 27, 2001, that dust samples collected from indoor surfaces registered
			 at levels that were <quote>as caustic as liquid drain cleaners</quote>.</text>
			</paragraph><paragraph id="H0BE44E95F5B6456085DFF71BF1A6E5F0"><enum>(8)</enum><text display-inline="yes-display-inline">According to both the EPA’s own Inspector
			 General’s (EPA IG) report of August 21, 2003 and General Accountability
			 Offices’s (GAO) report of September 2007, no comprehensive program has ever
			 been conducted in order to characterize the full extent of WTC contamination,
			 and therefore the full impact of that contamination— geographic or
			 otherwise—remains unknown.</text>
			</paragraph><paragraph id="H2C878D2FF737461BA3BC7BC06FF881A7"><enum>(9)</enum><text display-inline="yes-display-inline">Such reports found that there has never
			 been a comprehensive program to remediate WTC toxins from indoor spaces. Thus,
			 area residents, workers and students may continued to be exposed to WTC
			 contamination in their homes, workplaces and schools.</text>
			</paragraph><paragraph id="HEA73EB338BC84CF68342391FA792D23F"><enum>(10)</enum><text display-inline="yes-display-inline">Because of the failure to release federally
			 appropriated funds for community care, a lack of sufficient outreach, the fact
			 that many community members are receiving care from physicians outside the
			 current City-funded World Trade Center Environmental Health Center program and
			 thus fall outside data collection efforts, and other factors, the number of
			 community members being treated at the World Trade Center Environmental Health
			 Center underrepresents the total number in the community that have been
			 affected by exposure to Ground Zero toxins.</text>
			</paragraph><paragraph id="H62E766683344407BBE545B0055DE8EE8"><enum>(11)</enum><text>Research by
			 Columbia University’s Center for Children’s Environmental Health has shown
			 negative health effects on babies born to women living within 2 miles of the
			 World Trade Center in the month following 9/11.</text>
			</paragraph><paragraph commented="no" id="HBFEE5FBA69F94255AF006068E16EDB6F"><enum>(12)</enum><text>Federal funding
			 allocated for the monitoring of rescue workers’ health is not sufficient to
			 ensure the long-term study of health impacts of September 11.</text>
			</paragraph><paragraph commented="no" id="HF7F3B5F29AE24905AC7DFBDA49445FE2"><enum>(13)</enum><text display-inline="yes-display-inline">A significant portion of those who have
			 developed health problems as result of exposures to airborne toxins or other
			 hazards resulting from the September 11, 2001, attacks on the World Trade
			 Center have no health insurance, have lost their health insurance as a result
			 of the attacks, or have inadequate health insurance.</text>
			</paragraph><paragraph commented="no" id="H1D27D2BD193D4B46AB668FB9926EA4CC"><enum>(14)</enum><text display-inline="yes-display-inline">The Federal program to provide medical
			 treatments to those who responded to the September 11 aftermath, and who
			 continue to experience health problems as a result, was finally established
			 more than five years after the attacks, but has no certain long-term
			 funding.</text>
			</paragraph><paragraph commented="no" id="H12DE052F05F946ACB1F713D700FEE94"><enum>(15)</enum><text>Rescue workers and
			 volunteers seeking workers’ compensation have reported that their applications
			 have been denied, delayed for months, or redirected, instead of receiving
			 assistance in a timely and supportive manner.</text>
			</paragraph><paragraph commented="no" id="H483D4AB88A4C4D4DBC64F7F679908755"><enum>(16)</enum><text display-inline="yes-display-inline">A February 2007 report released by the City
			 of New York estimated that approximately 410,000 people were the most heavily
			 exposed to the environmental hazards and trauma of the September 11 terrorist
			 attacks. More than 30 percent of the Fire Department of the City of New York
			 first responders were still experiencing some respiratory symptoms more than
			 five years after the attacks and according to the report, 59 percent of those
			 seen by the WTC Environmental Health Center at Bellevue Hospital (which serves
			 community members) are without insurance and 65 percent have incomes less than
			 $15,000 per year. The report also found a need to continue and expand mental
			 health services.</text>
			</paragraph><paragraph commented="no" id="H09F819D89F474DEF9D7257D78C2F9CB9"><enum>(17)</enum><text display-inline="yes-display-inline">Since the 5th anniversary of the attack
			 (September 11, 2006), hundreds of workers a month have been signing up with the
			 monitoring and treatment programs.</text>
			</paragraph><paragraph id="H100435EEE7A147A18F1835C5DDC92FE5"><enum>(18)</enum><text display-inline="yes-display-inline">In April 2008, the Department of Health and
			 Human Services reported to Congress that in fiscal year 2007 11,359 patients
			 received medical treatment in the existing WTC Responder Medical and Treatment
			 program for WTC-related health problems, and that number of responders who need
			 treatment and the severity of health problems is expected to increase.</text>
			</paragraph><paragraph id="H67B28D2AA3274861A27D337F3B58B089"><enum>(19)</enum><text>The September 11
			 Victim Compensation Fund of 2001 was established to provide compensation to
			 individuals who were physically injured or killed as a result of the
			 terrorist-related aircraft crashes of September 11, 2001.</text>
			</paragraph><paragraph commented="no" id="H4217A5C6FE334A1FA8822B8ECC176381"><enum>(20)</enum><text>The deadline for
			 filing claims for compensation under the Victim Compensation Fund was December
			 22, 2003.</text>
			</paragraph><paragraph commented="no" id="H93A277D3E6FC4791B800811D229FDA50"><enum>(21)</enum><text>Some individuals
			 did not know they were eligible to file claims for compensation for injuries or
			 did not know they had suffered physical harm as a result of the
			 terrorist-related aircraft crashes until after the December 22, 2003,
			 deadline.</text>
			</paragraph><paragraph commented="no" id="HE947019982FA4ACF98997C2F7E74D29B"><enum>(22)</enum><text>Further research
			 is needed to evaluate more comprehensively the extent of the health impacts of
			 September 11, including research for emerging health problems such as cancer,
			 which have been predicted.</text>
			</paragraph><paragraph commented="no" id="HA6A4C89B9A264B61AC8C1303AE794B00"><enum>(23)</enum><text>Research is
			 needed regarding possible treatment for the illnesses and injuries of September
			 11.</text>
			</paragraph><paragraph commented="no" id="HD3BA614C48AA4657B5BF9710FE000273"><enum>(24)</enum><text>The Federal
			 response to medical and financial issues arising from the September 11 response
			 efforts needs a comprehensive, coordinated long-term response in order to meet
			 the needs of all the individuals who were exposed to the toxins of Ground Zero
			 and are suffering health problems from the disaster.</text>
			</paragraph><paragraph id="H8C643A473E1744E8BB0004BEBAB7AC78"><enum>(25)</enum><text display-inline="yes-display-inline">The failure to extend the appointment of
			 Dr. John Howard as Director of the National Institute for Occupational Safety
			 and Health in July 2008 is not in the interests of the administration of such
			 Institute nor the continued operation of the World Trade Center Medical
			 Monitoring and Treatment Program which he has headed, and the Secretary of
			 Health and Human Services should reconsider extending such appointment.</text>

			 Center Health Program</header><text display-inline="no-display-inline">The
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> is amended
			 by adding at the end the following new title:</text>

				Program; Advisory and Steering Committees</header>
							<section id="HE0289235BE4543CB89E9B0012E92145"><enum>3001.</enum><header>Establishment
				of World Trade Center Health Program within NIOSH</header>
								<subsection id="H4C68B7F9F89A4936BC3494A9A0BF6FA"><enum>(a)</enum><header>In
				general</header><text>There is hereby established within the National Institute
				for Occupational Safety and Health a program to be known as the <quote>World
				Trade Center Health Program</quote> (in this title referred to as the
				<quote>WTC program</quote>) to provide—</text>
									<paragraph id="H960C2007183F4E6784DF99AD8BAD0093"><enum>(1)</enum><text display-inline="yes-display-inline">medical monitoring and treatment benefits
				to eligible emergency responders and recovery and clean-up workers (including
				those who are Federal employees) who responded to the September 11, 2001,
				terrorist attacks on the World Trade Center; and</text>
									</paragraph><paragraph id="H0142BCED0240487B910304136409E3D"><enum>(2)</enum><text>screening and
				treatment benefits to residents and other building occupants and area workers
				in New York City who were directly impacted and adversely affected by such
				attacks.</text>
									</paragraph></subsection><subsection id="H54391F6CA98F4572A2007D00BAC9E551"><enum>(b)</enum><header>Components of
				Program</header><text>The WTC program includes the following components:</text>
									<paragraph id="H08CB50BFF8A14C0EBA00CB87FDD46500"><enum>(1)</enum><header>Medical
				monitoring for responders</header><text>Medical monitoring under section 3011,
				including clinical examinations and long-term health monitoring and analysis
				for individuals who were likely to have been exposed to airborne toxins that
				were released, or to other hazards, as a result of the September 11, 2001,
				terrorist attacks on the World Trade Center.</text>
									</paragraph><paragraph id="HB223D27C5752463ABBFA011650A148DA"><enum>(2)</enum><header>Screening for
				community members</header><text display-inline="yes-display-inline">Screening
				under section 3021, including an evaluation to determine eligibility for
				treatment.</text>
									</paragraph><paragraph id="HC041281C644F4A5E9231D8EE5D0821"><enum>(3)</enum><header>Treatment for
				wtc-related conditions for responders and community
				members</header><text>Provision under sections 3012, 3022, and 3023 of
				treatment and payment, subject to the provisions of subsection (d), for all
				medically necessary health and mental health care expenses (including necessary
				prescription drugs) of individuals with a WTC-related health condition.</text>
									</paragraph><paragraph id="H3B2D38207CFB4D9F96A75552F25CB558"><enum>(4)</enum><header>Outreach</header><text display-inline="yes-display-inline">Establishment under section 3004 of an
				outreach program to potentially eligible individuals concerning the benefits
				under this title.</text>
									</paragraph><paragraph id="HCB65854F45FE4C2AB282693D0000BB64"><enum>(5)</enum><header>Uniform data
				collection</header><text>Collection under section 3005 of health and mental
				health data on individuals receiving monitoring or treatment benefits, using a
				uniform system of data collection.</text>
									</paragraph><paragraph id="H8F7FB54611644731BC5129FEB26E8E58"><enum>(6)</enum><header>Research on wtc
				conditions</header><text>Establishment under subtitle C of a research program
				on health conditions resulting from the September 11, 2001, terrorist attacks
				on the World Trade Center.</text>
									</paragraph></subsection><subsection id="HE7E5093B564442F898848D17EE24CED1"><enum>(c)</enum><header>No
				cost-sharing</header><text display-inline="yes-display-inline">Monitoring and
				treatment benefits and screening benefits are provided under subtitle B without
				any deductibles, copayments, or other cost-sharing to an eligible WTC responder
				or any eligible WTC community member.</text>
								</subsection><subsection id="HF6B333552A73471DB400FA6B2707F8EF"><enum>(d)</enum><header>Payor</header>
									<paragraph id="HDAD270A5E96D47598765C40090D8E04B"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraphs (2) and (3) and section
				3012(c)(4), the cost of monitoring and treatment benefits and screening
				benefits provided under subtitle B shall be paid for by the WTC program.</text>
									</paragraph><paragraph id="H2D1AF603CE7A49ADB4D444006D45501C"><enum>(2)</enum><header>Workers’
				compensation payment</header><text display-inline="yes-display-inline">Payment
				for treatment under subtitle B of a WTC-related condition in an individual that
				is work-related shall be reduced or recouped to the extent that the Secretary
				determines that payment has been made, or can reasonably be expected to be
				made, under a workers’ compensation law or plan of the United States or a
				State, or other work-related injury or illness benefit plan of the employer of
				such individual, for such treatment. The provisions of clauses (iii), (iv),
				(v), and (vi) of paragraph (2)(B) of section 1862(b) of the Social Security Act
				(<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(b)(2)</external-xref>) and paragraph (3) of such section shall apply to the
				recoupment under this paragraph of a payment to the WTC program with respect to
				a workers’ compensation law or plan, or other work-related injury or illness
				plan of the employer involved, and such individual in the same manner as such
				provisions apply to the reimbursement of a payment under section 1862(b)(2) of
				such Act to the Secretary, with respect to such a law or plan and an individual
				entitled to benefits under title XVIII of such Act.</text>
									</paragraph><paragraph id="H9D909EF2D5F64A47946348A64094E7BB"><enum>(3)</enum><header>Health insurance
				coverage</header><text display-inline="yes-display-inline">In the case of an
				individual who has a WTC-related condition that is not work-related and has
				health coverage for such condition through any public or private health plan,
				the provisions of section 1862(b) of the Social Security Act (42 U.S.C.
				1395y(b)) shall apply to such a health plan and such individual in the same
				manner as they apply to a group health plan and an individual entitled to
				benefits under title XVIII of such Act pursuant to section 226(a). Any costs
				for items and services covered under such plan that are not reimbursed by such
				health plan, due to the application of deductibles, copayments, coinsurance,
				other cost-sharing, or otherwise, are reimbursable under this title to the
				extent that they are covered under the WTC program.</text>
									</paragraph><paragraph commented="no" id="H3C3A551433D14F9DB1ACFF5D77124B91"><enum>(4)</enum><header>Work-related
				described</header><text display-inline="yes-display-inline">For the purposes of
				this subsection, a WTC-related condition shall be treated as a condition that
				is work-related if—</text>
										<subparagraph id="H82226822A93F4D388B57F98FFE60B020"><enum>(A)</enum><text display-inline="yes-display-inline">the condition is diagnosed in an eligible
				WTC responder, or in an individual who qualifies as an eligible WTC community
				member on the basis of being a rescue, recovery, or clean-up worker; or</text>
										</subparagraph><subparagraph id="H1C314E44488D4F869F73960009D16D28"><enum>(B)</enum><text>with respect to
				the condition the individual has filed and had established a workers’
				compensation claim.</text>
										</subparagraph></paragraph></subsection><subsection id="H85623808D8C743EABF0078F375D6E4D1"><enum>(e)</enum><header>Quality
				assurance and monitoring of clinical expenditures</header>
									<paragraph id="H30AD71B3A4C449B084CD6B54CD15812B"><enum>(1)</enum><header>Quality
				assurance</header><text display-inline="yes-display-inline">The WTC Program
				Administrator working with the Clinical Centers of Excellence shall develop and
				implement a quality assurance program for the medical monitoring and treatment
				delivered by such Centers of Excellence and any other participating health care
				providers. Such program shall include—</text>
										<subparagraph id="HD3ADE5055B5B45D48F6EAF21CE9C009B"><enum>(A)</enum><text>adherence to
				medical monitoring and treatment protocols;</text>
										</subparagraph><subparagraph id="H7A327599C89140DA005E7414FB3C5930"><enum>(B)</enum><text>appropriate
				diagnostic and treatment referrals for participants;</text>
										</subparagraph><subparagraph id="H02E14CB948ED41D6AFCCE0AAE0594EA"><enum>(C)</enum><text>prompt
				communication of test results to participants; and</text>
										</subparagraph><subparagraph id="H5950D46AAB0741CF813D4ED1F2E09B62"><enum>(D)</enum><text>such other
				elements as the Administrator specifies in consultation with the Clinical
				Centers of Excellence.</text>
										</subparagraph></paragraph><paragraph id="H39712587FB2541A3ACAD94F113BD3394"><enum>(2)</enum><header>Fraud
				prevention</header><text>The WTC Program Administrator shall develop and
				implement a program to review the program’s health care expenditures to detect
				fraudulent or duplicate billing and payment for inappropriate services. Such
				program shall be similar to current methods used in connection with the
				Medicare program under title XVIII of the Social Security Act. This title is a
				Federal health care program (as defined in section 1128B(f) of such Act) and is
				a health plan (as defined in section 1128C(c) of such Act) for purposes of
				applying sections 1128 through 1128E of such Act.</text>
									</paragraph></subsection><subsection id="H78222BA5F65B46B0B2483C3EFD851922"><enum>(f)</enum><header>WTC Program
				Administration</header><text display-inline="yes-display-inline">The WTC
				program shall be administered by the Director of the National Institute for
				Occupational Safety and Health, or a designee of such Director.</text>
								</subsection><subsection id="HC199289BF11A46EF82D0DEAA4B3C180"><enum>(g)</enum><header>Annual program
				report</header>
									<paragraph id="H0243229BB9CD414883FF19760808F065"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 6
				months after the end of each fiscal year in which the WTC program is in
				operation, the WTC Program Administrator shall submit an annual report to the
				Congress on the operations of this title for such fiscal year and for the
				entire period of operation of the program.</text>
									</paragraph><paragraph id="H7F8D4931335942D8A634BF1B295E096B"><enum>(2)</enum><header>Contents of
				report</header><text display-inline="yes-display-inline">Each annual report
				under paragraph (1) shall include the following:</text>
										<subparagraph id="H3EB148526DFB4C388F2843ABA6AE197D"><enum>(A)</enum><header>Eligible
				individuals</header><text display-inline="yes-display-inline">Information for
				each clinical program described in paragraph (3)—</text>
											<clause id="HBC41A05ACA704019B69D4F43524F3DA7"><enum>(i)</enum><text display-inline="yes-display-inline">on the number of individuals who applied
				for certification under subtitle B and the number of such individuals who were
				so certified;</text>
											</clause><clause id="HB5A80D702FA445FEB7062903797C23AF"><enum>(ii)</enum><text>of the
				individuals who were certified, on the number who received medical monitoring
				under the program and the number of such individuals who received medical
				treatment under the program;</text>
											</clause><clause id="H53A33467BB23450E85CDAE500BC4D6D"><enum>(iii)</enum><text>with respect to
				individuals so certified who received such treatment, on the WTC-related health
				conditions for which they were treated; and</text>
											</clause><clause id="HFA3605F94584435A0092876DE7AC004D"><enum>(iv)</enum><text display-inline="yes-display-inline">on the projected number of individuals who
				will be certified under subtitle B in the succeeding fiscal year.</text>
											</clause></subparagraph><subparagraph id="H0E1B2CAB44634BFF8EED76F8D7001EFE"><enum>(B)</enum><header>Monitoring,
				screening, and treatment costs</header><text>For each clinical program so
				described—</text>
											<clause id="H72CFE1CE9A474A298CBE9ED52DAF6B27"><enum>(i)</enum><text>information on the
				costs of monitoring and screening and the costs of treatment and on the
				estimated costs of such monitoring, screening, and treatment in the succeeding
				fiscal year; and</text>
											</clause><clause id="H71CCE725C8314737B8A135A37100FB"><enum>(ii)</enum><text>an
				estimate of the cost of medical treatment for WTC-related conditions that have
				been paid for or reimbursed by workers’ compensation, by public or private
				health plans, or by the City of New York under section 3012(c)(4).</text>
											</clause></subparagraph><subparagraph id="H71C0853CDEA941C3B2D8588D12492741"><enum>(C)</enum><header>Administrative
				costs</header><text>Information on the cost of administering the program,
				including costs of program support, data collection and analysis, and research
				conducted under the program.</text>
										</subparagraph><subparagraph id="HA019B5E08A8A4FD791C799D5B1304DE0"><enum>(D)</enum><header>Administrative
				experience</header><text>Information on the administrative performance of the
				program, including—</text>
											<clause id="H6C9879A7CBBD4171A9CDDA64903B4EB0"><enum>(i)</enum><text>the performance of
				the program in providing timely evaluation of and treatment to eligible
				individuals; and</text>
											</clause><clause id="HF32649F7FC1A4EB78EB41E5FE1DD6CC5"><enum>(ii)</enum><text>a
				list of the Clinical Centers of Excellence and other providers that are
				participating in the program.</text>
											</clause></subparagraph><subparagraph id="H9822150B7A704C86AACB25086E8683AA"><enum>(E)</enum><header>Scientific
				reports</header><text display-inline="yes-display-inline">A summary of the
				findings of any new scientific reports or studies on the health effects
				associated with WTC center exposures, including the findings of research
				conducted under section 3041(a).</text>
										</subparagraph><subparagraph id="HC7CDC66C20AC406A91664B2B88474FD8"><enum>(F)</enum><header>Advisory
				committee recommendations</header><text>A list of recommendations by the WTC
				Scientific/Technical Advisory Committee on additional WTC program eligibility
				criteria and on additional WTC-related health conditions and the action of the
				WTC Program Administrator concerning each such recommendation.</text>
										</subparagraph></paragraph><paragraph id="H8AD816B1F54F4DA4B3AFD059A8851299"><enum>(3)</enum><header>Separate
				clinical programs described</header><text>In paragraph (2), each of the
				following shall be treated as a separate clinical program of the WTC
				program:</text>
										<subparagraph id="HF0E7FCEBB3DA49C984945CF3BEF21D61"><enum>(A)</enum><header>FDNY
				responders</header><text>The benefits provided for eligible WTC responders
				described in section 3006(b)(1)(A).</text>
										</subparagraph><subparagraph id="HA1CB5A98860944AFB7F8127F58ED2C9C"><enum>(B)</enum><header>Other eligible
				WTC responders</header><text display-inline="yes-display-inline">The benefits
				provided for eligible WTC responders not described in subparagraph (A).</text>
										</subparagraph><subparagraph id="HA88E65BE00CA44A7AF1748544FC8FBF7"><enum>(C)</enum><header>Eligible WTC
				community members</header><text display-inline="yes-display-inline">The
				benefits provided for eligible WTC community members in section
				3006(b)(1)(C).</text>
										</subparagraph></paragraph></subsection><subsection id="HFE14E866D7BA428A92F260F3051C5E77"><enum>(h)</enum><header>Notification to
				Congress when reach 80 percent of eligibility numerical limits</header><text display-inline="yes-display-inline">The WTC Program Administrator shall
				promptly notify the Congress—</text>
									<paragraph id="H51708C605EAD4FD400FB68F4659000D"><enum>(1)</enum><text>when the number of
				certifications for eligible WTC responders subject to the limit established
				under section 3011(a)(5) has reached 80 percent of such limit; and</text>
									</paragraph><paragraph id="H256F545730FB41AA9079456C112CBD50"><enum>(2)</enum><text display-inline="yes-display-inline">when the number of certifications for
				eligible WTC community members subject to the limit established under section
				3021(a)(5) has reached 80 percent of such limit.</text>
									</paragraph></subsection><subsection display-inline="no-display-inline" id="HA5D9E0DCA0844D4F975FE1AFE40513B"><enum>(i)</enum><header>GAO
				report</header><text display-inline="yes-display-inline">The Comptroller
				General of the United States shall submit to the Congress a report on the costs
				of the monitoring and treatment programs provided under this title.</text>
								</subsection><subsection id="H62CA87F7857E443EBD945ED4C6C625F9"><enum>(j)</enum><header>NYC
				recommendations</header><text display-inline="yes-display-inline">The City of
				New York may make recommendations to the WTC Program Administrator on ways to
				improve the monitoring and treatment programs under this title for both
				eligible WTC responders and eligible WTC community members.</text>
								</subsection></section><section id="H929AF23491514D999B9FACEFFA49DE63"><enum>3002.</enum><header>WTC Health
				Program Scientific/Technical Advisory Committee</header>
								<subsection id="HD9AC6EB20D454EC09DE6D4D02B7DF8D2"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The WTC Program Administrator shall
				establish an advisory committee to be known as the WTC Health Program
				Scientific/Technical Advisory Committee (in this section referred to as the
				<quote>Advisory Committee</quote>) to review scientific and medical evidence
				and to make recommendations to the Administrator on additional WTC program
				eligibility criteria and on additional WTC-related health conditions.</text>
								</subsection><subsection id="H46299CC013E042B7AE9B2EF4B29429C0"><enum>(b)</enum><header>Composition</header><text display-inline="yes-display-inline">The WTC Program Administrator shall appoint
				the members of the Advisory Committee and shall include at least—</text>
									<paragraph id="HE4FFCC8225EA4450A93511932B9F13CE"><enum>(1)</enum><text>4 occupational
				physicians, at least two of whom have experience treating WTC rescue and
				recovery workers;</text>
									</paragraph><paragraph id="H6E8302A0212B4ACA8C3600CF75754F32"><enum>(2)</enum><text display-inline="yes-display-inline">2 environmental medicine or environmental
				health specialists;</text>
									</paragraph><paragraph id="HB8F0B3F316DF44899C2125C9A1A8493C"><enum>(3)</enum><text display-inline="yes-display-inline">2 representatives of eligible WTC
				responders;</text>
									</paragraph><paragraph id="HF7DDDDDF40EC4107A344DCE807A1C21D"><enum>(4)</enum><text display-inline="yes-display-inline">2 representatives of WTC community
				members;</text>
									</paragraph><paragraph id="HB904EA66DEBA4BCCB7736BC6BAEA098E"><enum>(5)</enum><text>an industrial
				hygienist;</text>
									</paragraph><paragraph id="HC18B00CEB3ED4E93BEE482ADF47B32FA"><enum>(6)</enum><text>a
				toxicologist;</text>
									</paragraph><paragraph id="H039DD92FB90B4C018EC4C600E104E411"><enum>(7)</enum><text>an epidemiologist;
				and</text>
									</paragraph><paragraph id="H307FE660BFED487982880537DBA10063"><enum>(8)</enum><text>a mental health
				professional.</text>
									</paragraph></subsection><subsection display-inline="no-display-inline" id="H8F5BAE09E80E458EB8219E15FC780014"><enum>(c)</enum><header>Meetings</header><text>The
				Advisory Committee shall meet at such frequency as may be required to carry out
				its duties.</text>
								</subsection><subsection id="HE58E5AA05BD94181A551A0BF19CEBC1"><enum>(d)</enum><header>Reports</header><text>The
				WTC Program Administrator shall provide for publication of recommendations of
				the Advisory Committee on the public website established for the WTC
				program.</text>
								</subsection><subsection id="HF522A8C61C5649F8AB47C481B0509E11"><enum>(e)</enum><header>Authorization of
				appropriations</header><text>For the purpose of carrying out this section,
				there are authorized to be appropriated such sums as may be necessary, not to
				exceed $100,000, for each fiscal year beginning with fiscal year 2009.</text>
								</subsection><subsection id="H31ED022B13A14A8A9176CC275C71DFCE"><enum>(f)</enum><header>Duration</header><text>Notwithstanding
				any other provision of law, the Advisory Committee shall continue in operation
				during the period in which the WTC program is in operation.</text>
								</subsection><subsection id="HC322D9C916924283B1AD38DC7B60AEF9"><enum>(g)</enum><header>Application of
				FACA</header><text>Except as otherwise specifically provided, the Advisory
				Committee shall be subject to the Federal Advisory Committee Act.</text>
								</subsection></section><section display-inline="no-display-inline" id="H2A56C6955E664B480032AAE984819836" section-type="subsequent-section"><enum>3003.</enum><header>WTC Health Program
				Steering Committees</header>
								<subsection id="H16116CAE58A54367A3D1F74BB08281D1"><enum>(a)</enum><header>Establishment</header><text>The
				WTC Program Administrator shall establish two steering committees (each in this
				section referred to as a <quote>Steering Committee</quote>) as follows:</text>
									<paragraph id="H097B8C8C5A3543508BB14E8C757EEA53"><enum>(1)</enum><header>WTC responders
				steering committee</header><text display-inline="yes-display-inline">One
				steering committee, to be known as the WTC Responders Steering Committee, for
				the purpose of facilitating the coordination of medical monitoring and
				treatment programs for the eligible WTC responders under part 1 of subtitle
				B.</text>
									</paragraph><paragraph id="HC460DA141B3447A0AF5BB4CE4501BC72"><enum>(2)</enum><header>WTC community
				program steering committee</header><text display-inline="yes-display-inline">One steering committee, to be known as the
				WTC Community Program Steering Committee, for the purpose of facilitating the
				coordination of screening and treatment programs for eligible WTC community
				members under part 2 of subtitle B.</text>
									</paragraph></subsection><subsection commented="no" id="H8AB755A27AA646F3888C05DB9CC3B13C"><enum>(b)</enum><header>Membership</header>
									<paragraph commented="no" id="H55749715FF844A69B87D850200D5BDC7"><enum>(1)</enum><header>Initial
				membership of WTC Responders Steering Committee</header><text display-inline="yes-display-inline">The WTC Responders Steering Committee shall
				initially be composed of members of the WTC Monitoring and Treatment Program
				Steering Committee (as in existence on the day before the date of the enactment
				of this title). In addition, the committee membership shall include—</text>
										<subparagraph id="HEBB7B113BA614B708DBB884B75FC9DAD"><enum>(A)</enum><text display-inline="yes-display-inline">a representative of the Police Commissioner
				of the City of New York;</text>
										</subparagraph><subparagraph id="H2B2072F9CD954A5100E400357B479D03"><enum>(B)</enum><text display-inline="yes-display-inline">a representative of the Department of
				Health of the City of New York;</text>
										</subparagraph><subparagraph id="H2891056A8A054B8FB743A413454BDD92"><enum>(C)</enum><text>a representative
				of another agency of the City of New York, selected by the Mayor of New York
				City, which had a large number of non-uniformed City workers who responded to
				the WTC disaster; and</text>
										</subparagraph><subparagraph id="HD21E18238B7D4E63B14B81C9E3CDEED"><enum>(D)</enum><text>three
				representatives of eligible WTC responders;</text>
										</subparagraph><continuation-text continuation-text-level="paragraph">in order
				that eligible WTC responders constitute half the members of the Steering
				Committee.</continuation-text></paragraph><paragraph id="H60084DBCA56048CF872B4F1CA5C80061"><enum>(2)</enum><header>Initial
				membership of WTC Community Program Steering Committee</header>
										<subparagraph id="H804DEB6E23D24F6D84E0070884C766C"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The WTC Community
				Program Steering Committee shall initially be composed of members of the WTC
				Environmental Health Center Community Advisory Committee (as in existence on
				the day before the date of the enactment of this title) and shall initially
				have, as voting members, the following:</text>
											<clause id="H4C65AC3129A246A0A9AE127C1E4F7BFA"><enum>(i)</enum><text display-inline="yes-display-inline">11 representatives of the affected
				populations of residents, students, area workers, and other community
				members.</text>
											</clause><clause id="HCCA4B092E53D49AC8E3F14DE8450A563"><enum>(ii)</enum><text display-inline="yes-display-inline">The Medical Director of the WTC
				Environmental Health Center.</text>
											</clause><clause id="H24808A395CB3436A855873B1FDD8E300"><enum>(iii)</enum><text display-inline="yes-display-inline">The Executive Director of the WTC
				Environmental Health Center.</text>
											</clause><clause id="HFD1C01723E8E42658FEC309710DF4200"><enum>(iv)</enum><text display-inline="yes-display-inline">Three physicians, one each representing the
				three WTC Environmental Health Center treatment sites of Bellevue Hospital
				Center, Gouverneur Healthcare Services, and Elmhurst Hospital Center.</text>
											</clause><clause id="H3088804E3DD34FFC95D1C534C2F04B18"><enum>(v)</enum><text display-inline="yes-display-inline">Five specialists with WTC related expertise
				or experience in treating non-responder WTC diseases, such as a pediatrician,
				an epidemiologist, a psychiatrist or psychologist, an
				environmental/occupational specialists or a social worker from a WTC
				Environmental Health Center treatment site, or other relevant
				specialists.</text>
											</clause><clause id="H1F8DDCA0992C4FBF8947D6B98B3C1333"><enum>(vi)</enum><text display-inline="yes-display-inline">A representative of the Department of
				Health and Mental Hygiene of the City of New York.</text>
											</clause></subparagraph><subparagraph id="H1E88C9D578F640A2A4FA17AD0030958C"><enum>(B)</enum><header>Appointments</header>
											<clause id="H7CC951D45626488AB8B952D17B4954F2"><enum>(i)</enum><header>WTC EHC
				Community Advisory Committee</header><text>The WTC Environmental Health Center
				Community Advisory Committee as in existence on the date of the enactment of
				this title shall nominate members for positions described in subparagraph
				(A)(i).</text>
											</clause><clause id="H5AA887AA595345E2BBEB37D972D0F6C"><enum>(ii)</enum><header>NYC Health and
				Hospitals Corporation</header><text>The New York City Health and Hospitals
				Corporation shall nominate members for positions described in clauses (iv) and
				(v) of subparagraph (A).</text>
											</clause><clause id="HAC72F426ACA04D9D849095FD2FF5E78E"><enum>(iii)</enum><header>Timing</header><text>Nominations
				under clauses (i) and (ii) shall be recommended to the WTC Program
				Administrator not later than 60 days after the date of the enactment of this
				title.</text>
											</clause><clause id="H44E545ED93934FE2BB72666DAC3C74A0"><enum>(iv)</enum><header>Appointment</header><text>The
				WTC Program Administrator shall appoint members of the WTC Community Program
				Steering Committee not later than 90 days after the date of the enactment of
				this title.</text>
											</clause><clause id="H1A58D4B9E7E34FDD952C8124AAA3BF83"><enum>(v)</enum><header>General
				representatives</header><text>Of the members appointed under subparagraph
				(A)(i)—</text>
												<subclause id="HA4FF895D123A4A318C1955676E94D0D0"><enum>(I)</enum><text>the representation
				shall reflect the broad and diverse WTC-affected populations and constituencies
				and the diversity of impacted neighborhoods, including residents, hard-to-reach
				populations, students, area workers, school parents, community-based
				organizations, Community Boards, WTC Environmental Health Center patients,
				labor unions, and labor advocacy organizations; and</text>
												</subclause><subclause id="HC88DA9F01B464CDFBCD0F64628BAB7FB"><enum>(II)</enum><text>no one individual
				organization can have more than one representative.</text>
												</subclause></clause></subparagraph></paragraph><paragraph commented="no" id="HEF5AEDA1934142DBB12BF9F140D73F56"><enum>(3)</enum><header>Additional
				appointments</header><text display-inline="yes-display-inline">Each Steering
				Committee may appoint, if approved by a majority of voting members of the
				Committee, additional members to the Committee.</text>
									</paragraph><paragraph commented="no" id="H3720BD153F1E4D9BAD842C9000FAD385"><enum>(4)</enum><header>Vacancies</header><text>A
				vacancy in a Steering Committee shall be filled by the Steering Committee,
				subject to the approval of the WTC Program Administrator, so long as—</text>
										<subparagraph id="H521C131094794A8CA900E1F7D19D2E4"><enum>(A)</enum><text>in the case of the
				WTC Responders Steering Committee, the composition of the Committee includes
				representatives of eligible WTC responders and representatives of each Clinical
				Center of Excellence and each Coordinating Center of Excellence that serves
				eligible WTC responders and such composition has eligible WTC responders
				constituting half of the membership of the Steering Committee; or</text>
										</subparagraph><subparagraph id="H33892D2CB4034FFDB9008780F7D09EEC"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of the WTC Community Program
				Steering Committee, the composition of the Committee includes representatives
				of eligible WTC community members and representatives of each Clinical Center
				of Excellence and each Coordinating Center of Excellence that serves eligible
				WTC community members and the nominating process is consistent with paragraph
				(2)(B).</text>
										</subparagraph></paragraph><paragraph id="H989A13D3B49540E08B6DFEC83D35BA3C"><enum>(5)</enum><header>Co-Chairs of WTC
				Community Program Steering Committee</header><text display-inline="yes-display-inline">The WTC Community Program Steering
				Committee shall have two Co-Chairs as follows:</text>
										<subparagraph id="HBC0223E834ED47068C715E369BD0F7E4"><enum>(A)</enum><header>Community/Labor
				Co-Chair</header><text>A Community/Labor Co-Chair who shall be chosen by the
				community and labor-based members of the Steering Committee.</text>
										</subparagraph><subparagraph id="H2A6309B0F5B5419CA4B32BBBF7A4E105"><enum>(B)</enum><header>Environmental
				Health Clinic Co-Chair</header><text>A WTC Environmental Health Clinic Co-Chair
				who shall be chosen by the WTC Environmental Health Center members on the
				Steering Committee.</text>
										</subparagraph></paragraph></subsection><subsection id="H36F5EA8F2B60426E896BB7AF2347500"><enum>(c)</enum><header>Relation to
				FACA</header><text display-inline="yes-display-inline">Each Steering Committee
				shall not be subject to the Federal Advisory Committee Act.</text>
								</subsection><subsection id="H17DB586EEB004834AC10F56D45985EE0"><enum>(d)</enum><header>Meetings</header><text display-inline="yes-display-inline">Each Steering Committee shall meet at such
				frequency necessary to carry out its duties, but not less than 4 times each
				calendar year and at least two such meetings each year shall be a joint meeting
				with the voting membership of the other Steering Committee for the purpose of
				exchanging information regarding the WTC program.</text>
								</subsection><subsection id="HA86C6C24EB8D4A5882F08EF8F26F577E"><enum>(e)</enum><header>Duration</header><text>Notwithstanding
				any other provision of law, each Steering Committee shall continue in operation
				during the period in which the WTC program is in operation.</text>
								</subsection></section><section id="H9DF5308251B44C7687DD7C90666755EE"><enum>3004.</enum><header>Community
				education and outreach</header>
								<subsection id="H0CF329E5D87E4AB4B54754C9E0B7F031"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The WTC Program
				Administrator shall institute a program that provides education and outreach on
				the existence and availability of services under the WTC program. The outreach
				and education program—</text>
									<paragraph id="H94E98AAECA364409A72F18D4D9706242"><enum>(1)</enum><text display-inline="yes-display-inline">shall include—</text>
										<subparagraph id="H2FCCAD1256E846448031AABA90D4FB23"><enum>(A)</enum><text>the establishment
				of a public website with information about the WTC program;</text>
										</subparagraph><subparagraph id="HE5D36DB04A96499B9524AD4C1C2960FE"><enum>(B)</enum><text>meetings with
				potentially eligible populations;</text>
										</subparagraph><subparagraph id="HF259042430AF4ADDA4EED2CBE64382E"><enum>(C)</enum><text>development and
				dissemination of outreach materials informing people about the program;
				and</text>
										</subparagraph><subparagraph id="HA2E6779F831649A29479D8EDC4CF3B08"><enum>(D)</enum><text>the establishment
				of phone information services; and</text>
										</subparagraph></paragraph><paragraph id="H39AA4BDDFAB242D185CE26A14C5E1952"><enum>(2)</enum><text>shall be conducted
				in a manner intended—</text>
										<subparagraph id="HB04D8F875AC949B8955D824F00D8B490"><enum>(A)</enum><text>to reach all
				affected populations; and</text>
										</subparagraph><subparagraph id="H71B88FFDECB547DEA5B1704D69AC1843"><enum>(B)</enum><text>to include
				materials for culturally and linguistically diverse populations.</text>
										</subparagraph></paragraph></subsection><subsection id="HC1973077C65E450F8804587C3606A6E0"><enum>(b)</enum><header>Partnerships</header><text display-inline="yes-display-inline">To the greatest extent possible, in
				carrying out this section, the WTC Program Administrator shall enter into
				partnerships with local governments and organizations with experience
				performing outreach to the affected populations, including community and
				labor-based organizations.</text>
								</subsection></section><section id="H0C7A2A910B724F74B01DE22F9D5F5638"><enum>3005.</enum><header>Uniform data
				collection</header>
								<subsection id="H67B3C5FE7033454BA34C5D6D3F6557FE"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The WTC Program
				Administrator shall provide for the uniform collection of data (and analysis of
				data and regular reports to the Administrator) on the utilization of monitoring
				and treatment benefits provided to eligible WTC responders and eligible WTC
				community members, the prevalence of WTC-related health conditions, and the
				identification of new WTC-related medical conditions. Such data shall be
				collected for all individuals provided monitoring or treatment benefits under
				subtitle B and regardless of their place of residence or Clinical Center of
				Excellence through which the benefits are provided.</text>
								</subsection><subsection commented="no" id="H0B5A1EC565584BC1BB5982BBA2D6E976"><enum>(b)</enum><header>Coordinating
				through Centers of Excellence</header><text>Each Clinical Center of Excellence
				shall collect data described in subsection (a) and report such data to the
				corresponding Coordinating Center of Excellence for analysis by such
				Coordinating Center of Excellence.</text>
								</subsection><subsection id="H9402382A27C346DD9C7478687FC7C35C"><enum>(c)</enum><header>Privacy</header><text display-inline="yes-display-inline">The data collection and analysis under this
				section shall be conducted in a manner that protects the confidentiality of
				individually identifiable health information consistent with applicable legal
				requirements.</text>
								</subsection></section><section id="H27BCE2094A7547D88D5E5532E49F00C"><enum>3006.</enum><header>Centers of
				excellence</header>
								<subsection id="HB7ECA2B6A7AA44F000C292246F89F980"><enum>(a)</enum><header>In
				general</header>
									<paragraph id="H7F1FFA0013A9410892CC7CE25C316B46"><enum>(1)</enum><header>Contracts with
				clinical centers of excellence</header><text display-inline="yes-display-inline">The WTC Program Administrator shall enter
				into contracts with Clinical Centers of Excellence specified in subsection
				(b)(1)—</text>
										<subparagraph id="HE9776C7F51954B608BE10271E4E618CB"><enum>(A)</enum><text>for the provision
				of monitoring and treatment benefits and screening benefits under subtitle
				B;</text>
										</subparagraph><subparagraph id="HE8C72C2FA0AA4032B4DA42742FF7A282"><enum>(B)</enum><text display-inline="yes-display-inline">for the provision of outreach activities to
				individuals eligible for such monitoring and treatment benefits, for screening
				benefits, and for follow-up to individuals who are enrolled in the monitoring
				program;</text>
										</subparagraph><subparagraph id="H06F5446261C1427793C6EABFC6DB64"><enum>(C)</enum><text>for the provision of
				counseling for benefits under subtitle B, with respect to WTC-related health
				conditions, for individuals eligible for such benefits; and</text>
										</subparagraph><subparagraph id="H83DF2478727E43FEA61F50FBEC8FE7EB"><enum>(D)</enum><text display-inline="yes-display-inline">for the provision of counseling for
				benefits for WTC-related health conditions that may be available under Workers’
				Compensation or other benefit programs for work-related injuries or illnesses,
				health insurance, disability insurance, or other insurance plans or through
				public or private social service agencies and assisting eligible individuals in
				applying for such benefits;</text>
										</subparagraph><subparagraph id="HA10873B4E78E4950BDFF609F22A0D9A1"><enum>(E)</enum><text display-inline="yes-display-inline">for the provision of translational and
				interpretive services as for program participants who are not English language
				proficient; and</text>
										</subparagraph><subparagraph id="H2819787206074CDEA8143F445CC7998B"><enum>(F)</enum><text>for the collection
				and reporting of data in accordance with section 3005.</text>
										</subparagraph></paragraph><paragraph id="HB99EF620DBDF4EDEB907A9BCDB573569"><enum>(2)</enum><header>Contracts with
				coordinating centers of excellence</header><text display-inline="yes-display-inline">The WTC Program Administrator shall enter
				into contracts with Coordinating Centers of Excellence specified in subsection
				(b)(2)—</text>
										<subparagraph id="H6AFACB96812D4A818D542500FF000034"><enum>(A)</enum><text>for receiving,
				analyzing, and reporting to the WTC Program Administrator on data, in
				accordance with section 3005, that has been collected and reported to such
				Coordinating Centers by the corresponding Clinical Centers of Excellence under
				subsection (d)(3);</text>
										</subparagraph><subparagraph id="HBC2C46BA790240F09228643D17A757C9"><enum>(B)</enum><text>for the
				development of medical monitoring, screening, and treatment protocols, with
				respect to WTC-related health conditions;</text>
										</subparagraph><subparagraph id="H3E880A30AC0F4C87A1F02D399FDC228"><enum>(C)</enum><text>for coordinating
				the outreach activities conducted under paragraph (1)(B) by each corresponding
				Clinical Center of Excellence;</text>
										</subparagraph><subparagraph id="HA95A56E8701044568772283BEBA7937D"><enum>(D)</enum><text>for establishing
				criteria for the credentialing of medical providers participating in the
				nationwide network under section 3031;</text>
										</subparagraph><subparagraph id="H5363B697F0E545478812534440D1EC34"><enum>(E)</enum><text display-inline="yes-display-inline">for coordinating and administrating the
				activities of the WTC Health Program Steering Committees established under
				section 3003(a); and</text>
										</subparagraph><subparagraph id="H4EC85832AC4548EF82ED8E5F70778FE2"><enum>(F)</enum><text display-inline="yes-display-inline">for meeting periodically with the
				corresponding Clinical Centers of Excellence to obtain input on the analysis
				and reporting of data collected under subparagraph (A) and on the development
				of medical monitoring, screening, and treatment protocols under subparagraph
				(B).</text>
										</subparagraph><continuation-text continuation-text-level="paragraph">The
				medical providers under subparagraph (D) shall be selected by the WTC Program
				Administrator on the basis of their experience treating or diagnosing the
				medical conditions included in the list of identified WTC-related conditions
				for responders and of identified WTC-related conditions for community
				members.</continuation-text></paragraph></subsection><subsection id="H248077054784439C84844DDE6863356"><enum>(b)</enum><header>Centers of
				Excellence Defined</header>
									<paragraph id="H489A73B12A704EE397439EE27DAF733D"><enum>(1)</enum><header>Clinical center
				of excellence</header><text>In this title, the term <term>Clinical Center of
				Excellence</term> means the following:</text>
										<subparagraph id="H8FB9297B1B634FFEAB8D08C236189546"><enum>(A)</enum><header>For fdny
				responders</header><text>With respect to an eligible WTC responder who
				responded to the 9/11 attacks as an employee of the Fire Department of the City
				of New York and who—</text>
											<clause id="H8846F3058D0542B48E12EBCD979DA5D"><enum>(i)</enum><text>is
				an active employee of such Department—</text>
												<subclause id="H95A92F93083D4CA4B8CE959EF5A9832C"><enum>(I)</enum><text>with respect to
				monitoring, such Fire Department; and</text>
												</subclause><subclause id="HCBF35A3807B64B5CAFCD1E03021FA26B"><enum>(II)</enum><text>with respect to
				treatment, such Fire Department (or such entity as has entered into a contract
				with the Fire Department for treatment of such responders) or any other
				Clinical Center of Excellence described in subparagraph (B), (C), or (D);
				or</text>
												</subclause></clause><clause id="HF1D31F7825CE4B55B35D0033BE009E52"><enum>(ii)</enum><text display-inline="yes-display-inline">is not an active employee of such
				Department, such Fire Department (or such entity as has entered into a contract
				with the Fire Department for monitoring or treatment of such responders) or any
				other or any other Clinical Center of Excellence described in subparagraph (B),
				(C), or (D).</text>
											</clause></subparagraph><subparagraph id="H7773E4E3B5494C8584074CF746E111FC"><enum>(B)</enum><header>Other eligible
				WTC responders in New York</header><text>With respect to other eligible WTC
				responders who reside in the New York Metropolitan area, the Mt. Sinai
				coordinated consortium, Queens College, State University of New York at Stony
				Brook, University of Medicine and Dentistry of New Jersey, and Bellevue
				Hospital.</text>
										</subparagraph><subparagraph id="HE593146170984A50AB7483122B233002"><enum>(C)</enum><header>WTC community
				members in New York</header><text display-inline="yes-display-inline">With
				respect to eligible WTC community members who reside in the New York
				Metropolitan area, the World Trade Center Environmental Health Center at
				Bellevue Hospital and such hospitals or other facilities, including but not
				limited to those within the New York City Health and Hospitals Corporation, as
				are identified by the WTC Program Administrator.</text>
										</subparagraph><subparagraph id="HC1D57676B3B3460380749CDDA4CF82B"><enum>(D)</enum><header>All eligible WTC
				responders and eligible WTC community members</header><text display-inline="yes-display-inline">With respect to all eligible WTC responders
				and eligible WTC community members, such other hospitals or other facilities as
				are identified by the WTC Program Administrator.</text>
										</subparagraph><continuation-text continuation-text-level="paragraph">The WTC
				Program Administrator shall limit the number of additional Centers of
				Excellence identified under subparagraph (D) to ensure that the participating
				centers have adequate experience in the treatment and diagnosis of identified
				WTC-related medical conditions.</continuation-text></paragraph><paragraph id="H486B06219DB04C338866F0EA23FCC35"><enum>(2)</enum><header>Coordinating
				center of excellence</header><text>In this title, the term <term>Coordinating
				Center of Excellence</term> means the following:</text>
										<subparagraph id="H25C0E4EC321847D885FA8BE8D195FD29"><enum>(A)</enum><header>For fdny
				responders</header><text>With respect to an eligible WTC responder who
				responded to the 9/11 attacks as an employee of the Fire Department of the City
				of New York, such Fire Department.</text>
										</subparagraph><subparagraph id="H2E6C82486BD44357AC28BD0012FBF2DF"><enum>(B)</enum><header>Other wtc
				responders</header><text>With respect to other eligible WTC responders, the Mt.
				Sinai coordinated consortium.</text>
										</subparagraph><subparagraph id="HBCEDF5A6914545CEB4D10906212011DB"><enum>(C)</enum><header>Wtc community
				members</header><text display-inline="yes-display-inline">With respect to
				eligible WTC community members, the World Trade Center Environmental Health
				Center at Bellevue Hospital.</text>
										</subparagraph></paragraph><paragraph id="HEFC67805406A4FADA9CB5E1EF0FC176"><enum>(3)</enum><header>Corresponding
				centers</header><text>In this title, a Clinical Center of Excellence and a
				Coordinating Center of Excellence shall be treated as
				<quote>corresponding</quote> to the extent that such Clinical Center and
				Coordinating Center serve the same population group.</text>
									</paragraph></subsection><subsection id="H9DEFB42931554389AF9F84517E74DD43"><enum>(c)</enum><header>Reimbursement
				for non-treatment, non-monitoring program costs</header><text>A Clinical or
				Coordinating Center of Excellence with a contract under this section shall be
				reimbursed for the costs of such Center in carrying out the activities
				described in subsection (a), other than those described in subsection
				(a)(1)(A), subject to the provisions of section 3001(d), as follows:</text>
									<paragraph id="H491865F58D494C518E1B806B3D7BDB1D"><enum>(1)</enum><header>Clinical centers
				of excellence</header><text display-inline="yes-display-inline">For carrying
				out subparagraphs (B) through (F) of subsection (a)(1)—</text>
										<subparagraph id="H2E4AB197AF9944FEBA1985C55FD366B5"><enum>(A)</enum><header>Clinical center
				for FDNY responders in New York</header><text>The Clinical Center of Excellence
				for FDNY Responders in New York specified in subsection (b)(1)(A) shall be
				reimbursed—</text>
											<clause id="H5CB1539CC06C47FC873CE8002600BC29"><enum>(i)</enum><text>in
				the first year of the contract under this section, $600 per certified eligible
				WTC responder in the medical treatment program, and $300 per certified eligible
				WTC responder in the monitoring program; and</text>
											</clause><clause id="H95366B4D806642E99736657757D4649D"><enum>(ii)</enum><text>in each
				subsequent contract year, subject to paragraph (3), at the rates specified in
				this subparagraph for the previous contract year adjusted by the WTC Program
				Administrator to reflect the rate of medical care inflation during the previous
				contract year.</text>
											</clause></subparagraph><subparagraph id="HE2FA962B7312439E8CB53C83A9992800"><enum>(B)</enum><header>Clinical centers
				serving other eligible WTC responders in New York</header><text>A Clinical
				Center of Excellence for other WTC responders in New York specified in
				subsection (b)(1)(B) shall be reimbursed the amounts specified in subparagraph
				(A).</text>
										</subparagraph><subparagraph id="HE75059FEC59E457C8E24EAAB2FA7FD41"><enum>(C)</enum><header>Clinical centers
				serving WTC community members</header><text display-inline="yes-display-inline">A Clinical Center of Excellence for
				eligible WTC community members in New York specified in subsection (b)(1)(C)
				shall be reimbursed—</text>
											<clause id="H25261C8624074457814E14CFFD9E31C2"><enum>(i)</enum><text display-inline="yes-display-inline">in the first year of the contract under
				this section, for each certified eligible WTC community member in a medical
				treatment program enrolled at a non-hospital-based facility, $600, and for each
				certified eligible WTC community member in a medical treatment program enrolled
				at a hospital-based facility, $300; and</text>
											</clause><clause id="H841A1035E96740C29D3B005B3956535C"><enum>(ii)</enum><text display-inline="yes-display-inline">in each subsequent contract year, subject
				to paragraph (3), at the rates specified in this subparagraph for the previous
				contract year adjusted by the WTC Program Administrator to reflect the rate of
				medical care inflation during the previous contract year.</text>
											</clause></subparagraph><subparagraph id="HE90F10DA28784B0AA3D9ADD9B88EA85E"><enum>(D)</enum><header>Other clinical
				centers</header><text>A Clinical Center of Excellence or other providers not
				described in a previous subparagraph shall be reimbursed at a rate set by the
				WTC Program Administrator.</text>
										</subparagraph><subparagraph id="H5E04A290C9AC4C658EA076C1A841C30"><enum>(E)</enum><header>Reimbursement
				rules</header><text>The reimbursement provided under subparagraphs (A), (B) and
				(C) shall be made for each certified eligible WTC responder and for each WTC
				community member in the WTC program per year that the member receives such
				services, regardless of the volume or cost of services required.</text>
										</subparagraph></paragraph><paragraph id="H722979D0D5BD405DB9BADB30BDEDE51"><enum>(2)</enum><header>Coordinating
				Centers of Excellence</header><text>A Coordinating Centers of Excellence
				specified in section (a)(2) shall be reimbursed for the provision of services
				set forth in this section at such levels as are established by the WTC Program
				Administrator.</text>
									</paragraph><paragraph id="H4CA31ECC2E1B46308F89DBFDFE61507B"><enum>(3)</enum><header>Review of
				rates</header>
										<subparagraph id="HE44E70B66E9C4B6B9749D048FE09235C"><enum>(A)</enum><header>Initial
				review</header><text>Before the end of the fifth contract year of the WTC
				program, the WTC Program Administrator shall conduct a review to determine
				whether the reimbursement rates set forth in this subsection provide fair and
				appropriate reimbursement for such program services. Based on such review, the
				Administrator may, by rule beginning with the sixth contract year, may modify
				such rates, taking into account a reasonable and fair rate for the services
				being provided.</text>
										</subparagraph><subparagraph id="H817D69CDCF82435BADCFA7DE82AEF44F"><enum>(B)</enum><header>Subsequent
				reviews</header><text display-inline="yes-display-inline">After the sixth
				contract year, the WTC Program Administrator shall conduct periodic reviews to
				determine whether the reimbursement rates in effect under this subsection
				provide fair and appropriate reimbursement for such program services. Based
				upon such a review, the Administrator may by rule modify such rates, taking
				into account a reasonable and fair rate for the services being provided.</text>
										</subparagraph><subparagraph id="H4D7548247E464D859284F1E998C2A007"><enum>(C)</enum><header>GAO
				review</header><text>The Comptroller General of the United States shall review
				the WTC Program Administrator’s determinations regarding fair and appropriate
				reimbursement for program services under this paragraph.</text>
										</subparagraph></paragraph></subsection><subsection id="HE7A29A149A25496B81A2CC1123823937"><enum>(d)</enum><header>Requirements</header><text>The
				WTC Program Administrator shall not enter into a contract with a Clinical
				Center of Excellence under subsection (a)(1) unless—</text>
									<paragraph id="H5478403A32BD4B43A8C81C947EDF3163"><enum>(1)</enum><text>the Center
				establishes a formal mechanism for consulting with and receiving input from
				representatives of eligible populations receiving monitoring and treatment
				benefits under subtitle B from such Center;</text>
									</paragraph><paragraph id="H8B59469837674B5E86312EEC91528CB5"><enum>(2)</enum><text>the Center
				provides for the coordination of monitoring and treatment benefits under
				subtitle B with routine medical care provided for the treatment of conditions
				other than WTC-related health conditions;</text>
									</paragraph><paragraph id="H2E41B212792046E588216320798E7640"><enum>(3)</enum><text>the Center
				collects and reports to the corresponding Coordinating Center of Excellence
				data in accordance with section 3005;</text>
									</paragraph><paragraph id="H6A12C87520404D6E8CA13429AA04945F"><enum>(4)</enum><text display-inline="yes-display-inline">the Center has in place safeguards against
				fraud that are satisfactory to the Administrator;</text>
									</paragraph><paragraph id="HA70F6818D84E46E0A5FF42E0B50062FC"><enum>(5)</enum><text>the Center agrees
				to treat or refer for treatment all individuals who are eligible WTC responders
				or eligible WTC community members with respect to such Center who present
				themselves for treatment of a WTC-related health condition;</text>
									</paragraph><paragraph id="H9D6A4886E9484C0B8F709DFA57972E83"><enum>(6)</enum><text>the Center has in
				place safeguards to ensure the confidentiality of an individual’s individually
				identifiable health information, including requiring that such information not
				be disclosed to the individual’s employer without the authorization of the
				individual;</text>
									</paragraph><paragraph id="H9AA9FCDF9C764702A62001EC207D7E7C"><enum>(7)</enum><text display-inline="yes-display-inline">the Center provides assurances that the
				amounts paid under subsection (c)(1) are used only for costs incurred in
				carrying out the activities described in subsection (a), other than those
				described in subsection (a)(1)(A); and</text>
									</paragraph><paragraph id="H817A5F247A4746B081E1A42EBB1EAF27"><enum>(8)</enum><text>the Center agrees
				to meet all the other applicable requirements of this title, including
				regulations implementing such requirements.</text>
									</paragraph></subsection></section><section id="HC6372BF6D53349F9B3E3B000083BEB54"><enum>3007.</enum><header>Entitlement
				authorities</header><text display-inline="no-display-inline">Subject to section
				3012(c)(5), subtitle B constitutes budget authority in advance of
				appropriations Acts and represents the obligation of the Federal Government to
				provide for the payment for monitoring, screening, and treatment in accordance
				with such subtitle and section 3006(c) constitutes such budget authority and
				represents the obligation of the Federal Government to provide for the payment
				described in such section.</text>
							</section><section id="H6F98C17E5CF24EF2007347221C1C6C18"><enum>3008.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
								<paragraph id="H46161ACA32B14E7E00D275372642AD5E"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>aggravating</term> means,
				with respect to a health condition, a health condition that existed on
				September 11, 2001, and that, as a result of exposure to airborne toxins, any
				other hazard, or any other adverse condition resulting from the September 11,
				2001, terrorist attacks on the World Trade Center requires medical treatment
				that is (or will be) in addition to, more frequent than, or of longer duration
				than the medical treatment that would have been required for such condition in
				the absence of such exposure.</text>
								</paragraph><paragraph id="HFE5C1F523F0B4E32AB9D4BE5A6C3A7B"><enum>(2)</enum><text display-inline="yes-display-inline">The terms <term>certified eligible WTC
				responder</term> and <term>certified eligible WTC community member</term> mean
				an individual who has been certified as an eligible WTC responder under section
				3011(a)(4) or an eligible WTC community member under section 3021(a)(4),
				respectively.</text>
								</paragraph><paragraph id="HAE8C95859884424ABBB52600CC00C3A9"><enum>(3)</enum><text>The terms
				<term>Clinical Center of Excellence</term> and <term>Coordinating Center of
				Excellence</term> have the meanings given such terms in section 3006(b).</text>
								</paragraph><paragraph id="HEF45D1700CBB42B78E665EED00F95453"><enum>(4)</enum><text>The term
				<term>current consortium arrangements</term> means the arrangements as in
				effect on the date of the enactment of this title between the National
				Institute for Occupational Safety and Health and the Mt. Sinai-coordinated
				consortium and the Fire Department of the City of New York.</text>
								</paragraph><paragraph id="HBDB6C4AEFB1945B3BF5FE3F3ABA6C808"><enum>(5)</enum><text>The terms
				<term>eligible WTC responder</term> and <term>eligible WTC community
				member</term> are defined in sections 3011(a) and 3021(a), respectively.</text>
								</paragraph><paragraph id="HAE19D9CE54D34AA89D31652DF067CD95"><enum>(6)</enum><text>The term
				<term>list of identified WTC-related health conditions</term> means—</text>
									<subparagraph id="H573B4488BE87441ABBDA8696EC7238CA"><enum>(A)</enum><text display-inline="yes-display-inline">for eligible WTC responders, the identified
				WTC-related health condition for eligible WTC responders under section
				3012(a)(3) or 3012(a)(4); or</text>
									</subparagraph><subparagraph id="H6280C7FAC9FB469AA65E8F4C06059F34"><enum>(B)</enum><text display-inline="yes-display-inline">for eligible WTC community members, the
				identified WTC-related health condition for WTC community members under section
				3022(b)(1) or 3022(b)(2).</text>
									</subparagraph></paragraph><paragraph id="HEEEA3C5B0F0F4AD6AED85974C715F75B"><enum>(7)</enum><text>The term
				<term>Mt.-Sinai-coordinated consortium</term> means the consortium coordinated
				by Mt. Sinai hospital in New York City that coordinates the monitoring and
				treatment under the current consortium arrangements for eligible WTC responders
				other than with respect to those covered under the arrangement with the Fire
				Department of the City of New York.</text>
								</paragraph><paragraph id="HBEDE2CA4A77C4D0CA63393A044EE059"><enum>(8)</enum><text>The term <term>New
				York City disaster area</term> means the area within New York City that
				is—</text>
									<subparagraph id="H72AF2A01F6444FAC90007E4863F93FEC"><enum>(A)</enum><text>the area of
				Manhattan that is south of Houston Street; and</text>
									</subparagraph><subparagraph id="H2042979B2F0A45069200423160A217F4"><enum>(B)</enum><text>any block in
				Brooklyn that is wholly or partially contained within a 1.5-mile radius of the
				former World Trade Center site.</text>
									</subparagraph></paragraph><paragraph id="H83AA17C424EA41E39CD882CED6CF7BC6"><enum>(9)</enum><text display-inline="yes-display-inline">The term <term>New York metropolitan
				area</term> means an area, specified by the WTC Program Administrator, within
				which eligible WTC responders and eligible WTC community members who reside in
				such area are reasonably able to access monitoring and treatment benefits and
				screening benefits under this title through a Clinical Centers of Excellence
				described in subparagraphs (A), (B), or (C) of section 3006(b)(1).</text>
								</paragraph><paragraph id="H7E3BBF8DDE6B4E6CA3AF186DF16F23B9"><enum>(10)</enum><text>Any reference to
				<quote>September 11, 2001</quote> shall be deemed a reference to the period on
				such date subsequent to the terrorist attacks on the World Trade Center on such
				date.</text>
								</paragraph><paragraph id="H412CC889B803489AACD35B1882BFCB51"><enum>(11)</enum><text>The term
				<term>September 11, 2001, terrorist attacks on the World Trade Center</term>
				means the terrorist attacks that occurred on September 11, 2001, in New York
				City and includes the aftermath of such attacks.</text>
								</paragraph><paragraph id="H02D3919896544DDEA93DD03D003FE705"><enum>(12)</enum><text>The term
				<term>WTC Health Program Steering Committee</term> means such a Steering
				Committee established under section 3003.</text>
								</paragraph><paragraph id="H26B81CDB2D244E338DFE8F3300F4FA2D"><enum>(13)</enum><text>The term
				<term>WTC Program Administrator</term> means the individual responsible under
				section 3001(f) for the administration of the WTC program.</text>
								</paragraph><paragraph id="HCE14046015E04D4CB7331CADC36E5368"><enum>(14)</enum><text>The term
				<term>WTC-related health condition</term> is defined in section 3012(a).</text>
								</paragraph><paragraph id="H7DD7754E7F9F435DA0A204F7B99CB38"><enum>(15)</enum><text>The term <term>WTC
				Scientific/Technical Advisory Committee</term> means such Committee established
				under section 3002.</text>
								</paragraph></section></subtitle><subtitle id="H68CEA9F2C03942FEB8B742787DC41BD3"><enum>B</enum><header>Program of
				Monitoring, Screening, and Treatment</header>
							<part id="H0124C7B064C642B2B652361F102D4B4D"><enum>1</enum><header>For
				WTC Responders </header>
								<section id="H46E524D83C3A4AF2BAA9DC01DFBD4D2"><enum>3011.</enum><header>Identification
				of eligible WTC responders and provision of WTC-related monitoring
				services</header>
									<subsection id="HFF30D983F93A471A89A6A3B600262DED"><enum>(a)</enum><header>Eligible WTC
				responder defined</header>
										<paragraph id="H9942DF9C8C7C48BFADCFCB96872BD6B3"><enum>(1)</enum><header>In
				general</header><text>For purposes of this title, the term <term>eligible WTC
				responder</term> means any of the following individuals, subject to paragraph
				(5):</text>
											<subparagraph id="H2ACA828D0A454688BE1D92B90021E51"><enum>(A)</enum><header>Currently
				identified responder</header><text>An individual who has been identified as
				eligible for medical monitoring under the current consortium arrangements (as
				defined in section 3008(4)).</text>
											</subparagraph><subparagraph id="H8DC27850423841C2B78012EF21DEA28D"><enum>(B)</enum><header>Responder who
				meets current eligibility criteria</header><text>An individual who meets the
				current eligibility criteria described in paragraph (2).</text>
											</subparagraph><subparagraph commented="no" id="H6E4C620E5FA34F40BB92DED3BA628BDC"><enum>(C)</enum><header>Responder who
				meets modified eligibility criteria</header><text>An individual who—</text>
												<clause commented="no" id="HF1F24166D7D844BE8250D3EA68D5B2DC"><enum>(i)</enum><text>performed rescue,
				recovery, demolition, debris cleanup, or other related services in the New York
				City disaster area in response to the September 11, 2001, terrorist attacks on
				the World Trade Center, regardless of whether such services were performed by a
				State or Federal employee or member of the National Guard or otherwise;
				and</text>
												</clause><clause commented="no" id="HD274C0545E0841CA862D743D00C56FDD"><enum>(ii)</enum><text>meets such
				eligibility criteria relating to exposure to airborne toxins, other hazards, or
				adverse conditions resulting from the September 11, 2001, terrorist attacks on
				the World Trade Center as the WTC Program Administrator, after consultation
				with the WTC Responders Steering Committee and the WTC Scientific/Technical
				Advisory Committee, determines appropriate.</text>
												</clause><continuation-text commented="no" continuation-text-level="subparagraph">The WTC Program Administrator
				shall not modify such eligibility criteria on or after the date that the number
				of certifications for eligible responders has reached 80 percent of the limit
				described in paragraph (5) or on or after the date that the number of
				certifications for eligible community members has reached 80 percent of the
				limit described in section 3021(a)(5).</continuation-text></subparagraph></paragraph><paragraph id="HC8872CB4624847D8B1F9C5EEEDEBC2EB"><enum>(2)</enum><header>Current
				eligibility criteria</header><text>The eligibility criteria described in this
				paragraph for an individual is that the individual is described in either of
				the following categories:</text>
											<subparagraph id="H277DA97287B44D8288D573B8F125B02B"><enum>(A)</enum><header>Fire fighters
				and related personnel</header><text>The individual—</text>
												<clause id="H828AD87C6E334BB7A5AC9CF9F11C489C"><enum>(i)</enum><text>was a member of
				the Fire Department of the City of New York (whether fire or emergency
				personnel, active or retired) who participated at least one day in the rescue
				and recovery effort at any of the former World Trade sites (including Ground
				Zero, Staten Island land fill, and the NYC Chief Medical Examiner’s office) for
				any time during the period beginning on September 11, 2001, and ending on July
				31, 2002; or</text>
												</clause><clause id="H33098787D18D4B1780A1003E1EA9B3D6"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HF0B7A8C2B2964B21966B486992613F35"><enum>(I)</enum><text display-inline="yes-display-inline">is a surviving immediate family member of
				an individual who was a member of the Fire Department of the City of New York
				(whether fire or emergency personnel, active or retired) and was killed at the
				World Trade site on September 11, 2001; and</text>
													</subclause><subclause id="HF780BE8923F645E39C5B657C33F84D00" indent="up1"><enum>(II)</enum><text>received any treatment for a WTC-related
				mental health condition described in section 3012(a)(1)(B) on or before
				September 1, 2008.</text>
													</subclause></clause></subparagraph><subparagraph id="H5466F89C472F4B8F00F894606DC2BAE9"><enum>(B)</enum><header>Law enforcement
				officers and wtc rescue, recovery, and clean-up workers</header><text>The
				individual—</text>
												<clause id="H805EC33CFC2E4E2B8EAE6B26F5E2F44"><enum>(i)</enum><text>worked or
				volunteered on-site in rescue, recovery, debris-cleanup or related support
				services in lower Manhattan (south of Canal St.), the Staten Island Landfill,
				or the barge loading piers, for at least 4 hours during the period beginning on
				September 11, 2001, and ending on September 14, 2001, for at least 24 hours
				during the period beginning on September 11, 2001, and ending on September 30,
				2001, or for at least 80 hours during the period beginning on September 11,
				2001, and ending on July 31, 2002;</text>
												</clause><clause id="H764CBBF673804892BF308F4BEB8D2100"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H55F01104F65B474FA4739556B964EF91"><enum>(I)</enum><text>was a member of the
				Police Department of the City of New York (whether active or retired) or a
				member of the Port Authority Police of the Port Authority of New York and New
				Jersey (whether active or retired) who participated on-site in rescue,
				recovery, debris clean-up, or related services in lower Manhattan (south of
				Canal St.), including Ground Zero, the Staten Island Landfill or the barge
				loading piers, for at least 4 hours during the period beginning September 11,
				2001, and ending on September 14, 2001;</text>
													</subclause><subclause id="HF671C3B16A4B458E9CBE23A490622DB1" indent="up1"><enum>(II)</enum><text>participated on-site in rescue,
				recovery, debris clean-up, or related services in at Ground Zero, the Staten
				Island Landfill or the barge loading piers, for at least one day during the
				period beginning on September 11, 2001, and ending on July 31, 2002;</text>
													</subclause><subclause id="HBDE04479CC3C4D49A227FF34D2381ED6" indent="up1"><enum>(III)</enum><text>participated on-site in rescue,
				recovery, debris clean-up, or related services in lower Manhattan (south of
				Canal St.) for at least 24 hours during the period beginning on September 11,
				2001, and ending on September 30, 2001;</text>
													</subclause><subclause id="HCE729606C54447CD8DCC276416CCCE36" indent="up1"><enum>(IV)</enum><text>participated on-site in rescue,
				recovery, debris clean-up, or related services in lower Manhattan (south of
				Canal St.) for at least 80 hours during the period beginning on September 11,
				2001, and ending on July 31, 2002;</text>
													</subclause></clause><clause id="HDBB77996361541C99B448921FE6E1110"><enum>(iii)</enum><text display-inline="yes-display-inline">was an employee of the Office of the Chief
				Medical Examiner of the City of New York involved in the examination and
				handling of human remains from the World Trade Center attacks, or other morgue
				worker who performed similar post-September 11 functions for such Office staff,
				during the period beginning on September 11, 2001 and ending on July 31,
				2002;</text>
												</clause><clause id="HD5B87D48F2CF4AF5AA6F4584FFE6FA14"><enum>(iv)</enum><text>was a worker in
				the Port Authority Trans-Hudson Corporation tunnel for at least 24 hours during
				the period beginning on February 1, 2002, and ending on July 1, 2002; or</text>
												</clause><clause id="HBC795EBD96574EFEA730BBA6AE1F8F6C"><enum>(v)</enum><text>was a
				vehicle-maintenance worker who was exposed to debris from the former World
				Trade Center while retrieving, driving, cleaning, repairing, and maintaining
				vehicles contaminated by airborne toxins from the September 11, 2001, terrorist
				attacks on the World Trade Center during a duration and period described in
				subparagraph (A).</text>
												</clause></subparagraph></paragraph><paragraph id="H553FAE5084004FB5A2D283BD0818F2BF"><enum>(3)</enum><header>Application
				process</header><text display-inline="yes-display-inline">The WTC Program
				Administrator in consultation with the Coordinating Centers of Excellence shall
				establish a process for individuals, other than eligible WTC responders
				described in paragraph (1)(A), to apply to be determined to be eligible WTC
				responders. Under such process—</text>
											<subparagraph id="HC062776B819541B800403F8CAF182756"><enum>(A)</enum><text>there shall be no
				fee charged to the applicant for making an application for such
				determination;</text>
											</subparagraph><subparagraph id="H85BECC02FF304AEB8BECB2D706457028"><enum>(B)</enum><text>the Administrator
				shall make a determination on such an application not later than 60 days after
				the date of filing the application; and</text>
											</subparagraph><subparagraph id="H94B1BF2690A94B1F96B8004ECDC0038"><enum>(C)</enum><text>an individual who
				is determined not to be an eligible WTC responder shall have an opportunity to
				appeal such determination before an administrative law judge in a manner
				established under such process.</text>
											</subparagraph></paragraph><paragraph id="HDF3B91E237834B3EB4BF4411EEB0683E"><enum>(4)</enum><header>Certification</header>
											<subparagraph id="HC5ACC6F698D74CB1A9FA2F2F23518FA8"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				individual who is described in paragraph (1)(A) or who is determined under
				paragraph (3) (consistent with paragraph (5)) to be an eligible WTC responder,
				the WTC Program Administrator shall provide an appropriate certification of
				such fact and of eligibility for monitoring and treatment benefits under this
				part. The Administrator shall make determinations of eligibility relating to an
				applicant’s compliance with this title, including the verification of
				information submitted in support of the application, and shall not deny such a
				certification to an individual unless the Administrator determines that—</text>
												<clause id="H1F9633BD9B1D475FA534005831F63377"><enum>(i)</enum><text>based on the
				application submitted, the individual does not meet the eligibility criteria;
				or</text>
												</clause><clause id="H933C2F67AAF344A1A5559CAB13CF78AF"><enum>(ii)</enum><text>the numerical
				limitation on eligible WTC responders set forth in paragraph (5) has been
				met.</text>
												</clause></subparagraph><subparagraph id="H7EF078B5DA174C82B0DE2888F6B900A"><enum>(B)</enum><header>Timing</header>
												<clause id="H71D47C8F4078408A8EA505F8C1E99B49"><enum>(i)</enum><header>Currently
				identified responders</header><text>In the case of an individual who is
				described in paragraph (1)(A), the WTC Program Administrator shall provide the
				certification under subparagraph (A) not later than 60 days after the date of
				the enactment of this title.</text>
												</clause><clause id="HA81649DEDA5A47B9B6E8FCE2E126CF06"><enum>(ii)</enum><header>Other
				responders</header><text>In the case of another individual who is determined
				under paragraph (3) and consistent with paragraph (5) to be an eligible WTC
				responder, the WTC Program Administrator shall provide the certification under
				subparagraph (A) at the time of the determination.</text>
												</clause></subparagraph></paragraph><paragraph id="H894F3A6FA0E8437DBCB7F6992DB79E34"><enum>(5)</enum><header>Numerical
				limitation on eligible WTC responders</header>
											<subparagraph id="HF6CCC2B1FB574FE2BD90B06A18B3797"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The total number of
				individuals not described in subparagraph (C) who may qualify as eligible WTC
				responders for purposes of this title, and be certified as eligible WTC
				responders under paragraph (4), shall not exceed 15,000, subject to adjustment
				under paragraph (6), of which no more than 2,500 may be individuals certified
				based on modified eligibility criteria established under paragraph (1)(C). In
				applying the previous sentence, any individual who at any time so qualifies as
				an eligible WTC responder shall be counted against such numerical
				limitation.</text>
											</subparagraph><subparagraph id="H7ED4802887D748FCABDF900A61255B"><enum>(B)</enum><header>Process</header><text>In
				implementing subparagraph (A), the WTC Program Administrator shall—</text>
												<clause id="HE7192999C0554E83ABFB67CE65F197AA"><enum>(i)</enum><text>limit the number
				of certifications provided under paragraph (4) in accordance with such
				subparagraph; and</text>
												</clause><clause id="H4A8165BA7CDE4198A985276D9966F083"><enum>(ii)</enum><text display-inline="yes-display-inline">provide priority in such certifications in
				the order in which individuals apply for a determination under paragraph
				(3).</text>
												</clause></subparagraph><subparagraph id="H1A4FD2E1C2FD41D5ADBAC19CF98CEA17"><enum>(C)</enum><header>Currently
				identified responders not counted</header><text>Individuals described in this
				subparagraph are individuals who are described in paragraph (1)(A).</text>
											</subparagraph></paragraph><paragraph id="H65640AB152B4409BBF7DDC1C66253F18"><enum>(6)</enum><header>Potential
				adjustment in numerical limitations dependent upon actual spending relative to
				estimated spending</header>
											<subparagraph id="H9D2B819722D54B19A0EF658411A5E2D"><enum>(A)</enum><header>Initial
				calculation for fiscal years 2009 through 2011</header><text display-inline="yes-display-inline">If the WTC Program Administrator determines
				as of December 1, 2011, that the WTC expenditure-to-CBO-estimate percentage (as
				defined in subparagraph (D)(iii)) for fiscal years 2009 through 2011 does not
				exceed 90 percent, then, effective January 1, 2012, the WTC Program
				Administrator may increase the numerical limitation under paragraph (5)(A), the
				numerical limitation under section 3021(a)(5), or both, by a number of
				percentage points not to exceed the number of percentage points specified in
				subparagraph (C) for such period of fiscal years.</text>
											</subparagraph><subparagraph id="H40CEF67E646C4C5500DA44DC22B4875"><enum>(B)</enum><header>Subsequent
				calculation for fiscal years 2009 through 2015</header><text display-inline="yes-display-inline">If the Secretary determines as of December
				1, 2015, that the WTC expenditure-to-CBO-estimate percentages for fiscal years
				2009 through 2015 and for fiscal years 2012 through 2015 do not exceed 90
				percent, then, effective January 1, 2015, the WTC Program Administrator may
				increase the numerical limitation under paragraph (5)(A), the numerical
				limitation under section 3021(a)(5), or both, as in effect after the
				application of subparagraph (A), by a number of percentage points not to exceed
				twice the lesser of—</text>
												<clause id="H2DE3CD69257B4DC5B467841D4F8917A0"><enum>(i)</enum><text>the number of
				percentage points specified in subparagraph (C) for fiscal years 2009 through
				2012, or</text>
												</clause><clause id="HA049B083DB4F4B4EA869B23DF900058E"><enum>(ii)</enum><text>the number of
				percentage points specified in subparagraph (C) for fiscal years 2012 through
				2015.</text>
												</clause></subparagraph><subparagraph id="HE9929A83035045E6992E335900F8F1B0"><enum>(C)</enum><header>Maximum
				percentage increase in numerical limitations for period of fiscal
				years</header><text>The number of percentage points specified in this clause
				for a period of fiscal years is—</text>
												<clause id="H030FF4C7C5D3467CAED165C64CDEEAD"><enum>(i)</enum><text>100
				percentage points, multiplied by</text>
												</clause><clause id="HAAFAE75A79ED43C1B6A22810EC8880D5"><enum>(ii)</enum><text>one minus a
				fraction the numerator of which is the net Federal WTC spending for such
				period, and the denominator of which is the CBO WTC spending estimate for such
				period.</text>
												</clause></subparagraph><subparagraph id="H6C4624EBC44F4708A4198D04CC90D5E"><enum>(D)</enum><header>Definitions</header><text>For
				purposes of this paragraph:</text>
												<clause id="H5ADFD0D64B014289B7C18686220000F5"><enum>(i)</enum><header>Net Federal
				spending</header><text>The term <term>net Federal WTC spending</term> means,
				with respect to a period of fiscal years, the net Federal spending under this
				title for such fiscal years.</text>
												</clause><clause id="H209559EFA28B4370853CD5FABD4FC002"><enum>(ii)</enum><header>CBO WTC
				spending estimate</header><text>The term <term>CBO WTC spending estimate</term>
				means, with respect to—</text>
													<subclause id="H772621B66CB94B1998EC00EF65265FEA"><enum>(I)</enum><text>fiscal years 2009
				through 2011, $900,000,000;</text>
													</subclause><subclause id="HF9448F3C960C48BEA70679FC87824B39"><enum>(II)</enum><text>fiscal years 2012
				through 2015, $1,890,000,000; and</text>
													</subclause><subclause id="H3F505917299848089472418844F4E8F6"><enum>(III)</enum><text>fiscal years
				2009 through 2015, the sum of the amounts specified in subclauses (I) and
				(II).</text>
													</subclause></clause><clause id="HAAFD7EC1751241C286F2BF7494AAF28F"><enum>(iii)</enum><header>WTC
				expenditure-to-CBO-estimate percentage</header><text>The term <term>WTC
				expenditure-to-estimate percentage</term> means, with respect to a period of
				fiscal years, the ratio (expressed as a percentage) of—</text>
													<subclause id="H288D287D691C43088934321CD8AC6896"><enum>(I)</enum><text>the net Federal
				WTC spending for such period, to</text>
													</subclause><subclause id="HEF8025619104402EB7770283B580C4D"><enum>(II)</enum><text>the CBO WTC
				spending estimate for such period.</text>
													</subclause></clause></subparagraph></paragraph></subsection><subsection id="HBF089047F7C149238B23E10027F2F8D"><enum>(b)</enum><header>Monitoring
				Benefits</header>
										<paragraph id="HE25739649F4E4AD5A5481CFF981CE411"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				eligible WTC responder under section 3011(a)(4) (other than one described in
				subsection (a)(2)(A)(ii)), the WTC program shall provide for monitoring
				benefits that include medical monitoring consistent with protocols approved by
				the WTC Program Administrator and including clinical examinations and long-term
				health monitoring and analysis. In the case of an eligible WTC responder who is
				an active member of the Fire Department of the City of New York, the responder
				shall receive such benefits as part of the individual’s periodic company
				medical exams.</text>
										</paragraph><paragraph id="HB6A1FD175E414DCAA1D085B833FA0048"><enum>(2)</enum><header>Provision of
				monitoring benefits</header><text display-inline="yes-display-inline">The
				monitoring benefits under paragraph (1) shall be provided through the Clinical
				Center of Excellence for the type of individual involved or, in the case of an
				individual residing outside the New York metropolitan area, under an
				arrangement under section 3031.</text>
										</paragraph></subsection></section><section id="HE95BE3FBCE6A482FB51464F73F46F3B0"><enum>3012.</enum><header>Treatment of
				certified eligible WTC responders for WTC-related health conditions</header>
									<subsection id="HB1E40CCFDD564A48B7B55D7B12002CF6"><enum>(a)</enum><header>WTC–Related
				Health Condition Defined</header>
										<paragraph id="H78378C50179A42F0BC8F962839C813E"><enum>(1)</enum><header>In
				general</header><text>For purposes of this title, the term <term>WTC-related
				health condition</term> means—</text>
											<subparagraph id="HA596424E80704E2891661473D8E0EA44"><enum>(A)</enum><text>an illness or
				health condition for which exposure to airborne toxins, any other hazard, or
				any other adverse condition resulting from the September 11, 2001, terrorist
				attacks on the World Trade Center, based on an examination by a medical
				professional with experience in treating or diagnosing the medical conditions
				included in the applicable list of identified WTC-related conditions, is
				substantially likely to be a significant factor in aggravating, contributing
				to, or causing the illness or health condition, as determined under paragraph
				(2); or</text>
											</subparagraph><subparagraph id="HBB87184EEA734B00BBEE172CAF5F1819"><enum>(B)</enum><text display-inline="yes-display-inline">a mental health condition for which such
				attacks, based on an examination by a medical professional with experience in
				treating or diagnosing the medical conditions included in the applicable list
				of identified WTC-related conditions, is substantially likely be a significant
				factor in aggravating, contributing to, or causing the condition, as determined
				under paragraph (2).</text>
											</subparagraph><continuation-text continuation-text-level="paragraph">In the
				case of an eligible WTC responder described in section 3011(a)(2)(A)(ii), such
				term only includes the mental health condition described in subparagraph
				(B).</continuation-text></paragraph><paragraph id="H0133A0ADFCAD4A54B701648F5B97069E"><enum>(2)</enum><header>Determination</header><text>The
				determination of whether the September 11, 2001, terrorist attacks on the World
				Trade Center were substantially likely to be a significant factor in
				aggravating, contributing to, or causing an individual’s illness or health
				condition shall be made based on an assessment of the following:</text>
											<subparagraph id="H59E4E280FE8346B8A49DD25593815EE8"><enum>(A)</enum><text>The individual’s
				exposure to airborne toxins, any other hazard, or any other adverse condition
				resulting from the terrorist attacks. Such exposure shall be—</text>
												<clause id="H6028AA7CE0664B53A710845D18D982A8"><enum>(i)</enum><text>evaluated and
				characterized through the use of a standardized, population appropriate
				questionnaire approved by the Director of the National Institute for
				Occupational Safety and Health; and</text>
												</clause><clause id="H74A197F51A6F470C80FABCB5D6F42591"><enum>(ii)</enum><text>assessed and
				documented by a medical professional with experience in treating or diagnosing
				medical conditions included on the list of identified WTC-related
				conditions.</text>
												</clause></subparagraph><subparagraph id="H5B86608A62AE48DD9FE71369A42962EE"><enum>(B)</enum><text>The type of
				symptoms and temporal sequence of symptoms. Such symptoms shall be—</text>
												<clause id="HA868087FA309440EA12FF9DBE8DBE24"><enum>(i)</enum><text display-inline="yes-display-inline">assessed through the use of a standardized,
				population appropriate medical questionnaire approved by Director of the
				National Institute for Occupational Safety and Health and a medical
				examination; and</text>
												</clause><clause id="H3E24F72A1A7C45AB969591A6EE32C17"><enum>(ii)</enum><text>diagnosed and
				documented by a medical professional described in subparagraph (A)(ii).</text>
												</clause></subparagraph></paragraph><paragraph id="H180D20FD72E8475A864DA88F8B077028"><enum>(3)</enum><header>List of
				identified wtc-related health conditions for certified eligible WTC
				responders</header><text>For purposes of this title, the term <term>identified
				WTC-related health condition for eligible WTC responders</term> means any of
				the following health conditions:</text>
											<subparagraph id="HEB5A1F467D0A4A32B3759D4531BD8C44"><enum>(A)</enum><header>Aerodigestive
				disorders</header>
												<clause id="H3372FAE3E3BD4FAFAF53ED457D1ED1AF"><enum>(i)</enum><text>Interstitial lung
				diseases.</text>
												</clause><clause id="H67B5A87D2A694CBF87912C78736ECF51"><enum>(ii)</enum><text>Chronic
				respiratory disorder-fumes/vapors.</text>
												</clause><clause id="HD0A5CFF633774942B474B800E05B7233"><enum>(iii)</enum><text>Asthma.</text>
												</clause><clause id="HF2E9F6EE09DB4FBC8E56D77610BAEA1D"><enum>(iv)</enum><text>Reactive airways
				dysfunction syndrome (RADS).</text>
												</clause><clause id="H50171D5754444D7FADC585D7AC8D6BFA"><enum>(v)</enum><text>WTC-exacerbated
				chronic obstructive pulmonary disease (COPD).</text>
												</clause><clause id="H14A7699361604574BC8449A649A9DDC9"><enum>(vi)</enum><text>Chronic cough
				syndrome.</text>
												</clause><clause id="HCA5BB10D78BE4952AE7700A28CD17506"><enum>(vii)</enum><text>Upper airway
				hyperreactivity.</text>
												</clause><clause id="HBBE7020ECBA2450D8DCF6500871D741F"><enum>(viii)</enum><text>Chronic
				rhinosinusitis.</text>
												</clause><clause id="H51D1DF95B58B4B5997B4F0F55C00A9BE"><enum>(ix)</enum><text>Chronic
				nasopharyngitis.</text>
												</clause><clause id="HCC04E66A4BF64E09BE7E295EA3C690D0"><enum>(x)</enum><text>Chronic
				laryngitis.</text>
												</clause><clause id="H6F574952B0B24F258D874F2EE8AEA03B"><enum>(xi)</enum><text>Gastro-esophageal
				reflux disorder (GERD).</text>
												</clause><clause id="H1F10C80012D447D0B664A773A591C24B"><enum>(xii)</enum><text>Sleep apnea
				exacerbated by or related to a condition described in a previous clause.</text>
												</clause></subparagraph><subparagraph id="H033784B1903941DBAE15C441ED272E5B"><enum>(B)</enum><header>Mental health
				conditions</header>
												<clause id="H551EC8451940439C825366B1B991D5C8"><enum>(i)</enum><text>Post traumatic
				stress disorder (PTSD).</text>
												</clause><clause id="H0823345947B3482081CA90238EB656EB"><enum>(ii)</enum><text>Major depressive
				disorder.</text>
												</clause><clause id="H661314A565134E37A443761C3D5EEF4B"><enum>(iii)</enum><text>Panic
				disorder.</text>
												</clause><clause id="H0060721092E74C7992A201E481EFEC1F"><enum>(iv)</enum><text>Generalized
				anxiety disorder.</text>

				disorder.</text>

				disorder.</text>
												</clause><clause id="H4F07E1C0B5344BCF8057D739ABB7BF6D"><enum>(ix)</enum><text>Adjustment
				disorder.</text>
												</clause><clause id="H93C24965229748638418BADFFF42B29"><enum>(x)</enum><text>Substance
				abuse.</text>
												</clause><clause id="H7BD02E3D917B4A8A9729D99E03006D89"><enum>(xi)</enum><text>V
				codes (treatments not specifically related to psychiatric disorders, such as
				marital problems, parenting problems etc.), secondary to another identified
				WTC-related health condition for WTC eligible responders.</text>
												</clause></subparagraph><subparagraph id="H81BEB1DD58A64E0AB03C79DB00A623FC"><enum>(C)</enum><header>Musculoskeletal
				disorders</header>
												<clause id="HBCBA99D21442487C9FF3D93003B02EBA"><enum>(i)</enum><text>Low back
				pain.</text>
												</clause><clause commented="no" id="HB9A2B00A8B4540288EC671AC4DC33195"><enum>(ii)</enum><text>Carpal tunnel
				syndrome (CTS).</text>
												</clause><clause id="H26D6D02E063D49369CDC89A55100F0A6"><enum>(iii)</enum><text>Other
				musculoskeletal disorders.</text>
												</clause></subparagraph></paragraph><paragraph id="HFFDA934574A44A4A8E4159BC5544FD1D"><enum>(4)</enum><header>Application for
				recommendation to Congress of additional identified wtc-related health
				conditions for eligible WTC responders</header>
											<subparagraph id="H64907F3DE8624D0AA81EB556E000CF60"><enum>(A)</enum><header>Application</header><text>Any
				individual or organization can apply to the WTC Program Administrator for an
				illness or health condition not described in paragraph (3) to be added to the
				list of identified WTC-related conditions for eligible WTC responders.</text>
											</subparagraph><subparagraph id="H91FD737D34F741C6A3EB9DE646001500"><enum>(B)</enum><header>Review</header><text>The
				WTC Program Administrator shall establish a public process for receiving public
				input and comments on any application under subparagraph (A).</text>
											</subparagraph><subparagraph id="H379F55BDE0B94FFEABB1FDA0018672F"><enum>(C)</enum><header>Considerations</header><text>In
				making determinations on such applications, the WTC Program Administrator shall
				take into account the findings and recommendations of Clinical Centers of
				Excellence published in peer reviewed journals in the determination of whether
				an additional illness or health condition, such as cancer, should be added to
				the list of identified WTC-related health conditions for eligible WTC
				responders.</text>
											</subparagraph><subparagraph id="H4D5DA5E4BBE148838737483936CF49AA"><enum>(D)</enum><header>Consultation</header><text>The
				WTC Program Administrator shall consult with the WTC Responders Steering
				Committee and the WTC Scientific/Technical Advisory Committee in making a
				determination on whether an additional health condition should be added to the
				list of identified WTC-related conditions for eligible WTC responders.</text>
											</subparagraph><subparagraph id="H6E5B3803142041C4B9958C54B6429284"><enum>(E)</enum><header>Recommendation
				to Congress</header><text>The WTC Program Administrator shall recommend to
				Congress the addition of an illness or health condition to the list of
				identified WTC-related health conditions for eligible WTC responders if, based
				on a review of the evidence and consultations conducted under subparagraphs
				(B), (C), and (D), the Administrator determines that exposure to airborne
				toxins, other hazards, or other adverse conditions resulting from the September
				11, 2001, terrorist attacks on the World Trade Center is substantially likely
				to be a significant factor in aggravating, contributing to, or causing the
				illness or health condition.</text>
											</subparagraph></paragraph></subsection><subsection id="H45ACD0B58A9E4B53AC9D3E00C814E89"><enum>(b)</enum><header>Coverage of
				Treatment for WTC-Related Health Conditions</header>
										<paragraph id="HD57273AF4A0441599E2C4DECA27FBE9F"><enum>(1)</enum><header>Determination
				based on an identified WTC-related health condition for certified eligible WTC
				responders</header>
											<subparagraph id="HAAE86C77A6824ABBB23E704BA4A403FA"><enum>(A)</enum><header>In
				general</header><text>If a physician at a Clinical Center of Excellence that is
				providing monitoring benefits under section 3011 for a certified eligible WTC
				responder determines that the responder has an identified WTC-related health
				condition, and the physician makes a clinical determination that exposure to
				airborne toxins, other hazards, or adverse conditions resulting from the 9/11
				terrorist attacks is substantially likely to be a significant factor in
				aggravating, contributing to, or causing the condition—</text>
												<clause id="H2085BEE0DFDD4A7F9B13A774ABC9BDAA"><enum>(i)</enum><text>the physician
				shall promptly transmit such determination to the WTC Program Administrator and
				provide the Administrator with the medical facts supporting such determination;
				and</text>
												</clause><clause id="HDD829B1973064644A163DEF96E0074AD"><enum>(ii)</enum><text display-inline="yes-display-inline">on and after the date of such transmittal
				and subject to subparagraph (B), the WTC program shall provide for payment
				under subsection (c) for medically necessary treatment for such
				condition.</text>
												</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H11A9E7ED925541978C80FCEC909500CE"><enum>(B)</enum><header>Review;
				certification; appeals</header>
												<clause id="H2360E0FFB2F74685B0669CF9B6DDEF7E"><enum>(i)</enum><header>Review</header><text>A
				Federal employee designated by the WTC Program Administrator shall review
				determinations made under subparagraph (A) of a WTC-related health
				condition.</text>
												</clause><clause id="H16DE4C169D2040BB86F6DD37FB50E827"><enum>(ii)</enum><header>Certification</header><text>The
				Administrator shall provide a certification of such condition based upon
				reviews conducted under clause (i). Such a certification shall be provided
				unless the Administrator determines that the responder’s condition is not an
				identified WTC-related health condition or that exposure to airborne toxins,
				other hazards, or adverse conditions resulting from the 9/11 terrorist attacks
				is not substantially likely to be a significant factor in significantly
				aggravating, contributing to, or causing the condition.</text>
												</clause><clause id="H651C9701BCDF416CABB5F5BA843B9313"><enum>(iii)</enum><header>Appeal
				process</header><text>The Administrator shall provide a process for the appeal
				of determinations under clause (ii) before an administrative law judge.</text>
												</clause></subparagraph></paragraph><paragraph id="H09D84EBEE6114FC5877234AE32AC91B"><enum>(2)</enum><header>Determination
				based on other wtc-related health condition</header>
											<subparagraph id="H7526924B28934FD58D05E776A95D63DA"><enum>(A)</enum><header>In
				general</header><text>If a physician at a Clinical Center of Excellence
				determines pursuant to subsection (a) that the certified eligible WTC responder
				has a WTC-related health condition that is not an identified WTC-related health
				condition for eligible WTC responders—</text>
												<clause id="H7C5E7E8824C94944B500E7020837F589"><enum>(i)</enum><text>the physician
				shall promptly transmit such determination to the WTC Program Administrator and
				provide the Administrator with the facts supporting such determination;
				and</text>
												</clause><clause id="H1C42360670474B3D930051FBED5CC66"><enum>(ii)</enum><text>on
				and after the date of such transmittal and pending a determination by the
				Administrator under subparagraph (B), and subject to paragraph (6), the WTC
				program shall provide for payment under subsection (c) for medically necessary
				treatment for such condition.</text>
												</clause></subparagraph><subparagraph id="H1C6453BF77224D56BC431CFC3D8FD44"><enum>(B)</enum><header>Review;
				certification</header>
												<clause id="H58FBB22B094F48CFB9081CA16DF035AC"><enum>(i)</enum><header>Use of physician
				panel</header><text>The WTC Program Administrator shall provide for the review
				of each determination made under subparagraph (A)(i) of a WTC-related health
				condition to be made by a physician panel with appropriate expertise appointed
				by the WTC Program Administrator. Such a panel shall make recommendations to
				the Administrator on the evidence supporting such determination.</text>
												</clause><clause id="HBFCC9C935C6E46BCB558CA3455952D99"><enum>(ii)</enum><header>Review of
				recommendations of panel; certification</header><text>The Administrator, based
				on such recommendations shall determine whether or not the condition is a
				WTC-related health condition and, if it is, provide for a certification under
				paragraph (1)(B)(ii) of coverage of such condition. The Administrator shall
				provide a process for the appeal of determinations that the responder’s
				condition is not a WTC-related health condition before an administrative law
				judge.</text>
												</clause></subparagraph></paragraph><paragraph id="H9A644C99974F48259C8ED67C3BEAE52"><enum>(3)</enum><header>Requirement of
				medical necessity</header>
											<subparagraph id="H6D9EFD23693F4D7484FCE0B735E61BA7"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In providing
				treatment for a WTC-health condition, a physician shall provide treatment that
				is medically necessary and in accordance with medical protocols established
				under subsection (d).</text>
											</subparagraph><subparagraph id="HE154097B0392403488CE8983DBCE535"><enum>(B)</enum><header>Medically
				necessary standard</header><text>For the purpose of this title, health care
				services shall be treated as medically necessary for an individual if a
				physician, exercising prudent clinical judgment, would consider the services to
				be medically necessary for the individual for the purpose of evaluating,
				diagnosing, or treating an illness, injury, disease or its symptoms, and that
				are—</text>
												<clause id="H08FF59415B0743DFA6006EEA5914839F"><enum>(i)</enum><text>in
				accordance with the generally accepted standards of medical practice;</text>
												</clause><clause id="H086616CFA8674377B3277934861D8850"><enum>(ii)</enum><text>clinically
				appropriate, in terms of type, frequency, extent, site, and duration, and
				considered effective for the individual’s illness, injury, or disease;
				and</text>
												</clause><clause id="H3A1C0EC3FB0D4BA6A95D350000C377CD"><enum>(iii)</enum><text>not primarily
				for the convenience of the patient or physician, or another physician, and not
				more costly than an alternative service or sequence of services at least as
				likely to produce equivalent therapeutic or diagnostic results as to the
				diagnosis or treatment of the individual’s illness, injury, or disease.</text>
												</clause></subparagraph><subparagraph id="HE408C364BCA04F12809747D81B916819"><enum>(C)</enum><header>Determination of
				medical necessity</header>
												<clause id="H4E306DB8F006489C0031A402BB57DA7C"><enum>(i)</enum><header>Review of
				medical necessity</header><text display-inline="yes-display-inline">As part of
				the reimbursement payment process under subsection (c), the WTC Program
				Administrator shall review claims for reimbursement for the provision of
				medical treatment to determine if such treatment is medically necessary.</text>
												</clause><clause id="H3564BD7F143E4249ABE558E1C28E815B"><enum>(ii)</enum><header>Withholding of
				payment for medically unnecessary treatment</header><text>The Administrator may
				withhold such payment for treatment that the Administrator determines is not
				medically necessary.</text>
												</clause><clause id="H3B162CCA012A411D90037C77397CF3ED"><enum>(iii)</enum><header>Review of
				determinations of medical necessity</header><text>The Administrator shall
				provide a process for providers to appeal a determination under clause (ii)
				that medical treatment is not medically necessary. Such appeals shall be
				reviewed through the use of a physician panel with appropriate
				expertise.</text>
												</clause></subparagraph></paragraph><paragraph id="H15E9E38296604D94AED61863E1F6EF3C"><enum>(4)</enum><header>Scope of
				treatment covered</header>
											<subparagraph id="HAA23EBB4FA9E41A59749A99BABCB58A5"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The scope of
				treatment covered under such paragraphs includes services of physicians and
				other health care providers, diagnostic and laboratory tests, prescription
				drugs, inpatient and outpatient hospital services, and other medically
				necessary treatment.</text>
											</subparagraph><subparagraph id="H56E8B811F4204B3EA900FE70F064828"><enum>(B)</enum><header>Pharmaceutical
				coverage</header><text>With respect to ensuring coverage of medically necessary
				outpatient prescription drugs, such drugs shall be provided, under arrangements
				made by the WTC Program Administrator, directly through participating Clinical
				Centers of Excellence or through one or more outside vendors.</text>
											</subparagraph></paragraph><paragraph id="H0147135E186744C9BD3B3996C38767BA"><enum>(5)</enum><header>Provision of
				treatment pending certification</header><text display-inline="yes-display-inline">In the case of a certified eligible WTC
				responder who has been determined by an examining physician under subsection
				(b)(1) to have an identified WTC-related health condition, but for whom a
				certification of the determination has not yet been made by the WTC Program
				Administrator, medical treatment may be provided under this subsection, subject
				to paragraph (6), until the Administrator makes a decision on such
				certification. Medical treatment provided under this paragraph shall be
				considered to be medical treatment for which payment may be made under
				subsection (c).</text>
										</paragraph><paragraph id="H6EDA6404E13F4D6E92C0BF5804D100BD"><enum>(6)</enum><header>Prior approval
				process for non-certified non-emergency inpatient hospital
				services</header><text display-inline="yes-display-inline">Non-emergency
				inpatient hospital services for a WTC-related health condition identified by an
				examining physician under paragraph (b)(1) that is not certified under
				paragraph (1)(B)(ii) is not covered unless the services have been determined to
				be medically necessary and approved through a process established by the WTC
				Program Administrator. Such process shall provide for a decision on a request
				for such services within 15 days of the date of receipt of the request. The WTC
				Administrator shall provide a process for the appeal of a decision that the
				services are not medically necessary.</text>
										</paragraph></subsection><subsection id="H5CE869E5CF4B4F6D9EFF6885E6241BDF"><enum>(c)</enum><header>Payment for
				Medical Monitoring, Screening, and Treatment of WTC-Related Health
				Conditions</header>
										<paragraph id="H55C848D8C2A74F2D8DC2B894E96FE712"><enum>(1)</enum><header>Medical
				treatment</header>
											<subparagraph id="HA64595CC6A3F4D7A9E976363E2280649"><enum>(A)</enum><header>Use of FECA
				payment rates</header><text display-inline="yes-display-inline">Subject to
				subparagraph (B), the WTC Program Administrator shall reimburse costs for
				medically necessary treatment under this title for WTC-related health
				conditions according to the payment rates that would apply to the provision of
				such treatment and services by the facility under the Federal Employees
				Compensation Act.</text>
											</subparagraph><subparagraph commented="no" id="H886925B7BB6349640065200362AA3BE"><enum>(B)</enum><header>Pharmaceuticals</header>
												<clause id="HB3CDB4131F7F4B9284E5F0D671583924"><enum>(i)</enum><header>In
				general</header><text>The WTC Program Administrator shall establish a program
				for paying for the medically necessary outpatient prescription pharmaceuticals
				prescribed under this title for WTC-related conditions through one or more
				contracts with outside vendors.</text>
												</clause><clause id="HADC007FB371C40B691CE1CE5C51F3CF0"><enum>(ii)</enum><header>Competitive
				bidding</header><text>Under such program the Administrator shall—</text>
													<subclause id="H6C6543D1FA22442DA971933E872015B1"><enum>(I)</enum><text>select one or more
				appropriate vendors through a Federal competitive bid process; and</text>
													</subclause><subclause id="H9E36D2C0EB034ABBACF16666004488EF"><enum>(II)</enum><text>select the lowest
				bidder (or bidders) meeting the requirements for providing pharmaceutical
				benefits for participants in the WTC program.</text>
													</subclause></clause><clause id="HE24106259C4D47B7BFB68783FCCE3975"><enum>(iii)</enum><header>Treatment of
				FDNY participants</header><text>Under such program the Administrator may enter
				select a separate vendor to provide pharmaceutical benefits to certified
				eligible WTC responders for whom the Clinical Center of Excellence is described
				in section 3006(b)(1)(A) if such an arrangement is deemed necessary and
				beneficial to the program by the WTC Program Administrator.</text>
												</clause></subparagraph><subparagraph id="HDED3E65AE55B4DDE9E3012BE09943CAD"><enum>(C)</enum><header>Other
				treatment</header><text>For treatment not covered under a preceding
				subparagraph, the WTC Program Administrator shall designate a reimbursement
				rate for each such service.</text>
											</subparagraph></paragraph><paragraph id="H54BC12DFD4DF429298435B2098BF6C45"><enum>(2)</enum><header>Medical
				monitoring and screening</header><text>The WTC Program Administrator shall
				reimburse the costs of medical monitoring and the costs of screening provided
				under this title at a rate set by the Administrator.</text>
										</paragraph><paragraph id="H9E6A7CB5DED6428D84A8EEFEC211E09C"><enum>(3)</enum><header>Administrative
				arrangement authority</header><text>The WTC Program Administrator may enter
				into arrangements with other government agencies, insurance companies, or other
				third-party administrators to provide for timely and accurate processing of
				claims under this section.</text>
										</paragraph><paragraph id="HAD6827A99F8F4CD9B52283A120966CD5"><enum>(4)</enum><header>Participation by
				New York City in monitoring and treatment program and costs</header>
											<subparagraph id="H750EFDDB76424A37008CD355B350FF43"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In order for New York
				City, any agency or Department thereof, or the New York City Health and
				Hospitals Corporation to qualify for a contract for the provision of monitoring
				and treatment benefits and other services under section 3006, New York City is
				required to contribute a matching amount of 10 percent of the amount of the
				covered monitoring and treatment payment (as defined in subparagraph (B)). Such
				matching amount shall be reduced by any payment made by New York City, its
				agencies or departments under a workers’ compensation plan or other
				work-related injury of illness benefit plan for covered treatment benefits as
				provided for in section 3001(d)(2).</text>
											</subparagraph><subparagraph id="HAE749A5D9B9D46E8B4627161317DA100"><enum>(B)</enum><header>Covered
				Monitoring and Treatment Payment Defined</header><text display-inline="yes-display-inline">For the purposes of this paragraph, the
				term <term>covered monitoring and treatment payment</term> means payment under
				paragraphs (1) and (2), including under such paragraph as applied under section
				3021(b), 3022(a), and 3023, and reimbursement under 3006(c) for items and
				services furnished by a Clinical Center of Excellence or Coordinating Center of
				Excellence, and providers designated by the WTC Program under Section 3031,
				after the application of paragraphs (2) and (3) of section 3001 (d).</text>
											</subparagraph><subparagraph id="H308F4BFE9B2643FBA4623DB089F58151"><enum>(C)</enum><header>Payment of New
				York City share of monitoring and treatment costs</header><text>The WTC Program
				Administrator shall bill the amount specified in subparagraph (A) directly to
				New York City.</text>
											</subparagraph><subparagraph id="H5E4E5BF5B6314E2187267FD07BD22EAD"><enum>(D)</enum><header>Enforcement of
				New York City Share of Monitoring and Treatment Costs</header><text display-inline="yes-display-inline">To the extent that New York City fails to
				pay its share of the monitoring and treatment costs on a timely basis, the
				Administrator shall reduce the reimbursement for all screening, monitoring,
				treatment, and administration in a proportional amount, that when applied will
				make up for the shortfall in payment by New York City.</text>
											</subparagraph></paragraph><paragraph id="H98EC760714404753B80700FAF29CCDE0"><enum>(5)</enum><header>Claims
				processing subject to appropriations</header><text>The payment by the WTC
				Program Administrator for the processing of claims under this title is limited
				to the amounts provided in advance in appropriations Acts.</text>
										</paragraph></subsection><subsection id="HCE013FF47E5A45DCB069CFE52F0033CA"><enum>(d)</enum><header>Medical
				Treatment Protocols</header>
										<paragraph id="H87DB6F5A27EE4C8B9BAE93DF5B1000DD"><enum>(1)</enum><header>Development</header><text display-inline="yes-display-inline">The Coordinating Centers of Excellence
				shall develop medical treatment protocols for the treatment of certified
				eligible WTC responders and certified eligible WTC community members for
				identified WTC-related health conditions.</text>
										</paragraph><paragraph id="H527E8250CAA94FA8ABD5831CB379CFA"><enum>(2)</enum><header>Approval</header><text>The
				WTC Program Administrator shall approve the medical treatment protocols, in
				consultation with the WTC Health Program Steering Committees.</text>
										</paragraph></subsection></section></part><part id="HDE5F2783187340A8A249C587BD32CA1"><enum>2</enum><header>Community
				Program</header>
								<section id="HF2880DB40D894DD5AED61E620468E231"><enum>3021.</enum><header>Identification
				and screening of eligible WTC community members</header>
									<subsection id="HAD7F73403C7447319DF690D036728FC"><enum>(a)</enum><header>Eligible WTC
				community member defined</header>
										<paragraph id="H56906B31DDA540CBAF5DD5204FAD0410"><enum>(1)</enum><header>In
				general</header><text>In this title, the term <term>eligible WTC community
				member</term> means, subject to paragraph (3), an individual who is not an
				eligible WTC responder and is described in any of the following
				subparagraphs:</text>
											<subparagraph id="H32055570EBBA42249C755BBBEAEBE49"><enum>(A)</enum><text>A person who was
				present in the New York City disaster area in the dust or dust cloud on
				September 11, 2001.</text>
											</subparagraph><subparagraph id="H4B0AF8183F394123A500B73747243E5F"><enum>(B)</enum><text>A person who
				worked, resided or attended school, child care or adult day care in the New
				York City disaster area for—</text>
												<clause id="H4673C98FDF684DCAAEA0EAD371AB64AE"><enum>(i)</enum><text>at
				least four days during the 4-month period beginning on September 11, 2001, and
				ending on January 10, 2002; or</text>
												</clause><clause id="H3D3C1076B1E34E74BE669F44DE1E6EB4"><enum>(ii)</enum><text>at least 30 days
				during the period beginning on September 11, 2001, and ending on July 31,
				2002.</text>
												</clause></subparagraph><subparagraph id="H75EE75ABD345474C9538CE00CC48ECF0"><enum>(C)</enum><text>Any person who
				worked as a clean-up worker or performed maintenance work in the New York City
				disaster area during the 4-month period described in subparagraph (B)(i) and
				had extensive exposure to WTC dust as a result of such work.</text>
											</subparagraph><subparagraph id="HC8A28AE463EA452DA13F9F71275325D4"><enum>(D)</enum><text>A person who was
				deemed eligible to receive a grant from the Lower Manhattan Development
				Corporation Residential Grant Program, who possessed a lease for a residence or
				purchased a residence in the New York City disaster area, and who resided in
				such residence during the period beginning on September 11, 2001, and ending on
				May 31, 2003.</text>
											</subparagraph><subparagraph id="H22D41723FA204EF9B3E26324CE624CBA"><enum>(E)</enum><text>A person whose
				place of employment—</text>
												<clause id="HD433BC1D369F45499D61FA22892F08F0"><enum>(i)</enum><text>at
				any time during the period beginning on September 11, 2001, and ending on May
				31, 2003, was in the New York City disaster area; and</text>
												</clause><clause id="HAF89F696F9FA4B469288FA610073A202"><enum>(ii)</enum><text>was deemed
				eligible to receive a grant from the Lower Manhattan Development Corporation
				WTC Small Firms Attraction and Retention Act program or other government
				incentive program designed to revitalize the Lower Manhattan economy after the
				September 11, 2001, terrorist attacks on the World Trade Center.</text>
												</clause></subparagraph><subparagraph id="H0BA8983FAFAC4E33B9E2E158338C3C00"><enum>(F)</enum><text>A person who was
				receiving treatment as of the date of the enactment of this title at the World
				Trade Center Environmental Health Center operated by the New York City Health
				and Hospitals Corporation.</text>
											</subparagraph></paragraph><paragraph id="HC76A1D92F9FB4447B400A4505A145DB"><enum>(2)</enum><header>Eligibility
				criteria</header><text>In establishing eligibility criteria for purposes of
				subparagraphs (A) through (F) of paragraph (1) and for purposes of section
				3011(a)(1)(C)(ii), the WTC Program Administrator shall—</text>
											<subparagraph id="HDE62D2C7868E4FEC92F16334DE015C4E"><enum>(A)</enum><text>take into account
				the period, and, to the extent feasible, intensity, of exposure to airborne
				toxins, other hazard, or other adverse condition;</text>
											</subparagraph><subparagraph id="H140F6B0DE5E84E999C369300B76CE2D2"><enum>(B)</enum><text>base such criteria
				on best available evidence of exposure and related adverse health effects;
				and</text>
											</subparagraph><subparagraph id="H79B9F8F3FE96436B88FC87944E1394DC"><enum>(C)</enum><text>consult with the
				WTC Community Program Steering Committee, Coordinating Centers of Excellence
				described in section 3006(b)(1)(C), and affected populations.</text>
											</subparagraph><continuation-text continuation-text-level="paragraph">The
				Administrator shall first establish such criteria not later than 90 days after
				the date of the enactment of this title. The Administrator shall not modify
				such criteria on or after the date that the number of certifications for
				eligible community members has reached 80 percent of the limit described in
				paragraph (5) or on or after the date that the number of certifications for
				eligible responders has reached 80 percent of the limit described in section
				3021(a)(5).</continuation-text></paragraph><paragraph display-inline="no-display-inline" id="HC8A3FC3E4A604FDDA373AB571500248B"><enum>(3)</enum><header>Application
				process</header><text display-inline="yes-display-inline">The WTC Program
				Administrator in consultation with the Coordinating Centers of Excellence shall
				establish a process for individuals to be determined eligible WTC community
				member. Under such process—</text>
											<subparagraph id="HAB431710C2854D8EA2348DFCD385FAD"><enum>(A)</enum><text>there shall be no
				fee charged to the applicant for making an application for such
				determination;</text>
											</subparagraph><subparagraph id="H97BB10FD4BAD44998EFA4CAC15397517"><enum>(B)</enum><text display-inline="yes-display-inline">the Administrator shall make a
				determination on such an application not later than 60 days after the date of
				filing the application; and</text>
											</subparagraph><subparagraph id="H497B6F0181254F6C8995B7C258F78412"><enum>(C)</enum><text display-inline="yes-display-inline">an individual who is determined not to be
				an eligible WTC community member shall have an opportunity to appeal such
				determination before an administrative law judge in a manner established under
				such process.</text>
											</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H2312D330CA7F465CAB1BB45D26A8DA9E"><enum>(4)</enum><header>Certification</header>
											<subparagraph id="H8A14E15A6C9F4ECEAC09B13AD9EE182"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				individual who is determined under paragraph (3) and consistent with paragraph
				(5) to be an eligible WTC community member, the WTC Program Administrator shall
				provide an appropriate certification of such fact and of eligibility for
				treatment benefits under this part. The Administrator shall make determinations
				of eligibility relating to an applicant’s compliance with this title, including
				the verification of information submitted in support of the application and
				shall not deny such a certification to an individual unless the Administrator
				determines that—</text>
												<clause id="HD3139529C27747409BFEEDDF7EF0C9F4"><enum>(i)</enum><text>based on the
				application submitted, the individual does not meet the eligibility criteria;
				or</text>
												</clause><clause id="H27584CD9F91D4A6A84081787887CA272"><enum>(ii)</enum><text display-inline="yes-display-inline">the numerical limitation on eligible WTC
				community members set forth in paragraph (5) has been met.</text>
												</clause></subparagraph><subparagraph id="HA7D8968D1DF1491F8FF6CFCEF3CEDFC0"><enum>(B)</enum><header>Timing</header>
												<clause id="H5AF864A69C63453BABE8725ED2EC812"><enum>(i)</enum><header>Currently
				identified community members</header><text>In the case of an individual who is
				described in paragraph (1)(F), the WTC Program Administrator shall provide the
				certification under subparagraph (A) not later than 60 days after the date of
				the enactment of this title.</text>
												</clause><clause id="H05301DC6CF414CBFAF304D00796F76A"><enum>(ii)</enum><header>Other
				members</header><text>In the case of another individual who is determined under
				paragraph (3) and consistent with paragraph (5) to be an eligible WTC community
				member, the WTC Program Administrator shall provide the certification under
				subparagraph (A) at the time of such determination.</text>
												</clause></subparagraph></paragraph><paragraph id="H3FA8546C05364A8FB140E81311009ECE"><enum>(5)</enum><header>Numerical
				limitation on eligible WTC community members</header>
											<subparagraph id="H437AA0E0A67E4D7A80D6E1C922A61D1C"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The total number of
				individuals not described in subparagraph (C) who may qualify as eligible WTC
				community members for purposes of this title, and be certified as eligible WTC
				community members under paragraph (4), shall not exceed 15,000. In applying the
				previous sentence, any individual who at any time so qualifies as an eligible
				WTC community member shall be counted against such numerical limitation.</text>
											</subparagraph><subparagraph id="H97CFDE1F5E754BE5B8C1AA01502CFF32"><enum>(B)</enum><header>Process</header><text>In
				implementing subparagraph (A), the WTC Program Administrator shall—</text>
												<clause id="H5F03BE819217493780003673EE533BD2"><enum>(i)</enum><text>limit the number
				of certifications provided under paragraph (4) in accordance with such
				subparagraph; and</text>
												</clause><clause id="HBBA3AB6D51204D818B38AD9B84BDD305"><enum>(ii)</enum><text>provide priority
				in such certifications in the order in which individuals apply for a
				determination under paragraph (3).</text>
												</clause></subparagraph><subparagraph id="H8942EBD6C57A473B001B972BFAA0DB14"><enum>(C)</enum><header>Individuals
				currently receiving treatment not counted</header><text display-inline="yes-display-inline">Individuals described in this subparagraph
				are individuals who, before the date of the enactment of this title, have
				received treatment for an identified WTC-related condition for eligible WTC
				community members at the World Trade Center Environmental Health Center at
				Bellevue Hospital Center, Gouverneur Health Care Services, or Elmhurst Hospital
				Center.</text>
											</subparagraph><subparagraph id="H124D2D072B9146D0ABE69C35C133546D"><enum>(D)</enum><header>Report to
				Congress if numerical limitation to be reached</header><text>If the WTC Program
				Administrator determines that the number of individuals subject to the
				numerical limitation of subparagraph (A) is likely to exceed such numerical
				limitation, the Administrator shall submit to Congress a report on such
				determination. Such report shall include an estimate of the number of such
				individuals in excess of such numerical limitation and of the additional
				expenditures that would result under this title if such numerical limitation
				were removed.</text>
											</subparagraph></paragraph></subsection><subsection id="H398DD944C9BE4794B34D00AB2576289"><enum>(b)</enum><header>Screening To
				determine eligibility for treatment</header>
										<paragraph id="H8A8E0292594D4CC692D430F7FB3DA92B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of a
				certified eligible WTC community member, the WTC program shall provide for
				screening to determine if the member has a WTC-related health condition and are
				eligible for treatment under the WTC program. Screening protocols shall be
				approved by the WTC Program Administrator, in consultation with the World Trade
				Center Environmental Health Center at Bellevue Hospital and the WTC Community
				Program Steering Committee.</text>
										</paragraph><paragraph id="HBCD063D82E484AC0959EC30800E58211"><enum>(2)</enum><header>Screening
				providers</header><text display-inline="yes-display-inline">The screening
				described in paragraph (1) shall be provided through a Clinical Center of
				Excellence with respect to the individual involved.</text>
										</paragraph><paragraph id="H29F28C452415449985950027CA83B4C4"><enum>(3)</enum><header>Limitation on
				screening benefits</header><text display-inline="yes-display-inline">Benefits
				for screening under this part for an eligible WTC community member shall
				consist only of a single medical screening consistent with screening protocols
				described in paragraph (1). Nothing in this paragraph shall be construed as
				preventing such an individual from seeking additional medical screening at the
				expense of the individual.</text>
										</paragraph></subsection></section><section id="H343BBF9E37DE4F19816ED35EEE83EFB"><enum>3022.</enum><header>Treatment of
				certified eligible WTC community members for WTC-related health
				conditions</header>
									<subsection id="HC3BEA2E97EF6404A86FD7814F7C81F3D"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to subsection
				(b), the provisions of section 3012 shall apply to the treatment of WTC-related
				health conditions for certified eligible WTC community members in the same
				manner as such provisions apply to the treatment of identified WTC-related
				health conditions for certified eligible WTC responders.</text>
									</subsection><subsection id="H8CD01453543D4025A8C063DB67D9DE5"><enum>(b)</enum><header>List of
				identified WTC-related health conditions for WTC community members</header>
										<paragraph id="H6D2A5968655241EE8DE4C75BE107C22"><enum>(1)</enum><header>Identified
				wtc-related health conditions for wtc community members</header><text display-inline="yes-display-inline">For purposes of this title, the term
				<term>identified WTC-related health conditions for WTC community members</term>
				means any of the following health conditions:</text>
											<subparagraph id="H042F6E3A3FCD4EC7AA73A7514D2B3348"><enum>(A)</enum><header>Aerodigestive
				disorders</header>
												<clause id="H718B683780A545B494AA3099001966E6"><enum>(i)</enum><text>Interstitial lung
				diseases.</text>
												</clause><clause id="H0DCE9638BA5A455EAC4442D0199E46A7"><enum>(ii)</enum><text>Chronic
				respiratory disorder—fumes/vapors.</text>
												</clause><clause id="H4B32762D9BD54C3F9EBA007B96C12C72"><enum>(iii)</enum><text>Asthma.</text>
												</clause><clause id="HEEF6D2222EB641BBBFFB3DD3E3C98F78"><enum>(iv)</enum><text>Reactive airways
				dysfunction syndrome (RADS).</text>
												</clause><clause id="H1BE1FD5FEF81465EB6581B9054254542"><enum>(v)</enum><text>WTC-exacerbated
				chronic obstructive pulmonary disease (COPD).</text>
												</clause><clause id="H54DF9BB7C7E749ABB000DE7EA8F56FB"><enum>(vi)</enum><text>Chronic cough
				syndrome.</text>
												</clause><clause id="H27D2C1AD881B4814BDACAD63727FF9D4"><enum>(vii)</enum><text>Upper airway
				hyperreactivity.</text>
												</clause><clause id="HDE61FB2B2D394F398BA300075D22ADC0"><enum>(viii)</enum><text>Chronic
				rhinosinusitis.</text>

				related to psychiatric disorders, such as marital problems, parenting problems
				etc.), secondary to another identified WTC-related health condition for WTC
				community members.</text>
												</clause></subparagraph></paragraph><paragraph id="H74CFD62BCAA34EE0AD36EE2290009C66"><enum>(2)</enum><header>Application for
				recommendation to Congress of additional identified wtc-related health
				conditions for wtc community members</header><text display-inline="yes-display-inline">The provisions of paragraph (4) of section
				3012(a) shall apply with respect to a recommendation to Congress of an addition
				to the list of identified WTC-related conditions for eligible WTC community
				members under paragraph (1) in the same manner as such provisions apply to a
				recommendation to Congress of the addition to the list of identified
				WTC-related conditions for eligible WTC responders under section
				3012(a)(3).</text>
										</paragraph></subsection></section><section id="HEE0BA1B11CD84E82003E83D7D5DB2456"><enum>3023.</enum><header>Treatment of
				other individuals with WTC-related health conditions</header>
									<subsection id="H62113DEE3DB4403881635E3CCE86B6BF"><enum>(a)</enum><header>In
				General</header><text display-inline="yes-display-inline">Subject to subsection
				(c), the provisions of section 3022 shall apply to the treatment of WTC-related
				health conditions for eligible WTC community members in the case of individuals
				described in subsection (b) in the same manner as such provisions apply to the
				treatment of WTC-related health conditions for WTC community members.</text>
									</subsection><subsection id="H096B961CB9AA4E63A1714775FEE05B8"><enum>(b)</enum><header>Individuals
				described</header><text>An individual described in this subsection is an
				individual who, regardless of location of residence—</text>
										<paragraph id="HA392035431A24D2ABB3FDD5FFB5BB107"><enum>(1)</enum><text display-inline="yes-display-inline">is not a eligible WTC responder or an
				eligible WTC community member; and</text>
										</paragraph><paragraph id="H70AD8F37C97445FAA9000010EC05CE81"><enum>(2)</enum><text display-inline="yes-display-inline">is diagnosed at a Clinical Center of
				Excellence (with respect to an eligible WTC community member) with an
				identified WTC-related health condition for WTC community members.</text>
										</paragraph></subsection><subsection id="H07DAF83127A24350B3B488924244537F"><enum>(c)</enum><header>Limitation</header>
										<paragraph id="H7D1F7AC3171E4748BD4907B1F1B62900"><enum>(1)</enum><header>In
				general</header><text>The WTC Program Administrator shall limit benefits for
				any fiscal year under subsection (a) in a manner so that payments under this
				section for such fiscal year do not exceed the amount specified in paragraph
				(2) for such fiscal year.</text>
										</paragraph><paragraph id="H36B6EE0F476D425E85F373006EDC9591"><enum>(2)</enum><header>Limitation</header><text>The
				amount specified in this paragraph for—</text>
											<subparagraph id="H0AFA143CD8474120A95638D6E333C995"><enum>(A)</enum><text>fiscal year 2009
				is $20,000,000; or</text>
											</subparagraph><subparagraph id="H5914EA22D5A644B9AABFEACFAEEE8DFA"><enum>(B)</enum><text display-inline="yes-display-inline">a succeeding fiscal year is the amount
				specified in this paragraph for the previous fiscal year increased by the
				annual percentage increase in the medical care component of the consumer price
				index for all urban consumers.</text>
											</subparagraph></paragraph></subsection></section></part><part id="H95E71B0D3C8F4619911B11C07FD0B9"><enum>3</enum><header>National Arrangement
				for Benefits for Eligible Individuals Outside New York</header>
								<section id="H49BD6841B6344A418F1BD7E57B5E2FC"><enum>3031.</enum><header>National
				arrangement for benefits for eligible individuals outside New York</header>
									<subsection id="H415B49C0982D4F86B536056F4DFB43B5"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">In order to ensure
				reasonable access to benefits under this subtitle for individuals who are
				eligible WTC responders or eligible WTC community members and who reside in any
				State, as defined in section 2(f), outside the New York metropolitan area, the
				WTC Program Administrator shall establish a nationwide network of health care
				providers to provide monitoring and treatment benefits and screening near such
				individuals’ areas of residence in such States. Nothing in this subsection
				shall be construed as preventing such individuals from being provided such
				monitoring and treatment benefits or screening through a Clinical Center of
				Excellence.</text>
									</subsection><subsection commented="no" id="H6BAC1340581D44349416FEC0693F114F"><enum>(b)</enum><header>Network
				requirements</header><text>Any health care provider participating in the
				network under subsection (a) shall—</text>
										<paragraph commented="no" id="H1004C1B5F5BD4FB8AF677C5285C0AA3F"><enum>(1)</enum><text>meet criteria for
				credentialing established by the Coordinating Centers of Excellence;</text>
										</paragraph><paragraph commented="no" id="HD2841AD312354FCE9639FB51DE82F96"><enum>(2)</enum><text>follow the
				monitoring, screening, and treatment protocols developed under section
				3006(a)(2)(B);</text>
										</paragraph><paragraph commented="no" id="H2B7A821F857A4D9F96951D21B5D82055"><enum>(3)</enum><text>collect and report
				data in accordance with section 3005; and</text>
										</paragraph><paragraph id="H00AC86163FBB42D282E8000080EFA9E7"><enum>(4)</enum><text>meet such fraud,
				quality assurance, and other requirements as the WTC Program Administrator
				establishes.</text>
										</paragraph></subsection></section></part></subtitle><subtitle id="H07E3558796534620A95CE80500953611"><enum>C</enum><header>Research into
				Conditions</header>
							<section id="HD5C44FD1F2E24714BBA188DB841EDD7"><enum>3041.</enum><header>Research
				regarding certain health conditions related to September 11 terrorist attacks
				in New York City</header>
								<subsection id="HD766300876E74062ADA0C400885526C"><enum>(a)</enum><header>In
				General</header><text display-inline="yes-display-inline">With respect to
				individuals, including eligible WTC responders and eligible WTC community
				members, receiving monitoring or treatment under subtitle B, the WTC Program
				Administrator shall conduct or support—</text>
									<paragraph id="H6D87EC4013A84A9480E759044D9D6DE2"><enum>(1)</enum><text>research on
				physical and mental health conditions that may be related to the September 11,
				2001, terrorist attacks;</text>
									</paragraph><paragraph id="H818A8C33E6C64128AC3F3C5FC82DACB4"><enum>(2)</enum><text>research on
				diagnosing WTC-related health conditions of such individuals, in the case of
				conditions for which there has been diagnostic uncertainty; and</text>
									</paragraph><paragraph id="H7CAC86D063104424A538AAB1B5C7ABB9"><enum>(3)</enum><text>research on
				treating WTC-related health conditions of such individuals, in the case of
				conditions for which there has been treatment uncertainty.</text>
									</paragraph><continuation-text continuation-text-level="subsection">The
				Administrator may provide such support through continuation and expansion of
				research that was initiated before the date of the enactment of this title and
				through the World Trade Center Health Registry (referred to in section 3051),
				through a Clinical Center of Excellence, or through a Coordinating Center of
				Excellence.</continuation-text></subsection><subsection id="H1497D17BD49D4D59AEBE5609C68D1816"><enum>(b)</enum><header>Types of
				research</header><text display-inline="yes-display-inline">The research under
				subsection (a)(1) shall include epidemiologic and other research studies on
				WTC-related conditions or emerging conditions—</text>
									<paragraph id="HC3ED2537D59D4834B42562A9E513B56"><enum>(1)</enum><text>among WTC
				responders and community members under treatment; and</text>
									</paragraph><paragraph id="H8CE2C5EEB68E4B0382E4DCA97B538ED7"><enum>(2)</enum><text>in sampled
				populations outside the New York City disaster area in Manhattan as far north
				as 14th Street and in Brooklyn, along with control populations, to identify
				potential for long-term adverse health effects in less exposed
				populations.</text>
									</paragraph></subsection><subsection id="H010BEA6744DF4D5DA01CD635BEF9811"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">The WTC Program Administrator shall carry
				out this section in consultation with the WTC Health Program Steering
				Committees and the WTC Scientific/Technical Advisory Committee.</text>
								</subsection><subsection id="HBFCE8CCB2FF145D4B9CA6B4346D033A7"><enum>(d)</enum><header>Application of
				Privacy and Human Subject Protections</header><text>The privacy and human
				subject protections applicable to research conducted under this section shall
				not be less than such protections applicable to research otherwise conducted by
				the National Institutes of Health.</text>
								</subsection><subsection id="HD3249686428A4276A73DD300CB7EEAAC"><enum>(e)</enum><header>Authorization of
				Appropriations</header><text>For the purpose of carrying out this section,
				there are authorized to be appropriated $15,000,000 for each fiscal year, in
				addition to any other authorizations of appropriations that are available for
				such purpose.</text>
								</subsection></section></subtitle><subtitle id="HEA2EC2297AD34354ACEF9ECD3A6FDDA"><enum>D</enum><header>Programs of the New
				York City Department of Health and Mental Hygiene</header>
							<section id="H17F4F4BFDFD24ECBB4E390ED0057E284"><enum>3051.</enum><header>World Trade
				Center Health Registry</header>
								<subsection id="H979FDBCB9ED747EEB9FC7C3CCE5568B2"><enum>(a)</enum><header>Program
				Extension</header><text>For the purpose of ensuring on-going data collection
				for victims of the September 11, 2001, terrorist attacks on the World Trade
				Center, the WTC Program Administrator, shall extend and expand the arrangements
				in effect as of January 1, 2008, with the New York City Department of Health
				and Mental Hygiene that provide for the World Trade Center Health
				Registry.</text>
								</subsection><subsection id="H69932F0182874FBC9226227DF0FFF3B4"><enum>(b)</enum><header>Authorization of
				Appropriations</header><text>There are authorized to be appropriated $7,000,000
				for each fiscal year to carry out this section.</text>
								</subsection></section><section id="HF6A88A83E3474505982E922B3DFBB9AA"><enum>3052.</enum><header>Mental health
				services</header>
								<subsection id="HEE69DEF68BCD4F5EA664C3CC427DB05"><enum>(a)</enum><header>In
				general</header><text>The WTC Program Administrator may make grants to the New
				York City Department of Health and Mental Hygiene to provide mental health
				services to address mental health needs relating to the September 11, 2001,
				terrorist attacks on the World Trade Center.</text>
								</subsection><subsection id="HBB15FFAEDF7C4DBFB208A2F84FECC143"><enum>(b)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated $8,500,000 for each fiscal year to carry out this
				section.</text>
								</subsection></section></subtitle></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="H59C6CAE55B4F44BDA25572CF5178531"><enum>II</enum><header>September 11th
			 Victim Compensation Fund of 2001</header>
			<section id="H9951E0987DE64D1DABF7180089773CD7"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 402 of the Air Transportation Safety
			 and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended—</text>
				<paragraph id="H4603965E60F041408BB07534B5ADD53C"><enum>(1)</enum><text>in paragraph (6)
			 by inserting <quote>, or debris removal, including under the World Trade Center
			 Health Program established under section 3001 of the Public Health Service
			 Act,</quote> after <quote>September 11, 2001</quote>;</text>
				</paragraph><paragraph id="H56735882C0964F2D872C846671EA14DD"><enum>(2)</enum><text>by inserting after
			 paragraph (6) the following new paragraphs and redesignating subsequent
			 paragraphs accordingly:</text>
					<quoted-block display-inline="no-display-inline" id="H6CA3681CADD842E5B3E804D6553C1160" style="OLC">
						<paragraph id="H1E2089D0B7EA4A8AACC6B059E0EED413"><enum>(7)</enum><header>Contractor and
				subcontractor</header><text display-inline="yes-display-inline">The term
				<term>contractor and subcontractor</term> means any contractor or subcontractor
				(at any tier of a subcontracting relationship), including any general
				contractor, construction manager, prime contractor, consultant, or any parent,
				subsidiary, associated or allied company, affiliated company, corporation,
				firm, organization, or joint venture thereof that participated in debris
				removal at any 9/11 crash site. Such term shall not include any entity,
				including the Port Authority of New York and New Jersey, with a property
				interest in the World Trade Center, on September 11, 2001, whether fee simple,
				leasehold or easement, direct or indirect.</text>
						</paragraph><paragraph id="H8C3E2B0D05F6412F964FF21919E23292"><enum>(8)</enum><header>Debris
				removal</header><text display-inline="yes-display-inline">The term <term>debris
				removal</term> means rescue and recovery efforts, removal of debris, cleanup,
				remediation, and response during the immediate aftermath of the
				terrorist-related aircraft crashes of September 11, 2001, with respect to a
				9/11 crash
				site.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H2533B28306864AA5B4D1E76398B37FF"><enum>(3)</enum><text>by
			 inserting after paragraph (10), as so redesignated, the following new paragraph
			 and redesignating the subsequent paragraphs accordingly:</text>
					<quoted-block display-inline="no-display-inline" id="H4122337C79024F3895A6FB424B44E18F" style="OLC">
						<paragraph id="H50A1A848F7BE474A90480451A56D4200"><enum>(11)</enum><header>Immediate
				aftermath</header><text display-inline="yes-display-inline">The term
				<term>immediate aftermath</term> means any period beginning with the
				terrorist-related aircraft crashes of September 11, 2001, and ending on August
				30, 2002.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HCB97BC78CE1D4A4782DAE42234F64E8B"><enum>(4)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H782011CC5B5D47A1A378AD04BDDD502D" style="OLC">
						<paragraph id="H594286AB6AE14CF9AAA6B0F347F51D2"><enum>(14)</enum><header>9/11 crash
				site</header><text display-inline="yes-display-inline">The term <term>9/11
				crash site</term> means—</text>
							<subparagraph id="H724E0908799A4A3D00F818D9B6A07BE"><enum>(A)</enum><text display-inline="yes-display-inline">the World Trade Center site, Pentagon site,
				and Shanksville, Pennsylvania site;</text>
							</subparagraph><subparagraph id="H26C3D0454124426586CD3FC9A990AEDC"><enum>(B)</enum><text>the buildings or
				portions of buildings that were destroyed as a result of the terrorist-related
				aircraft crashes of September 11, 2001;</text>
							</subparagraph><subparagraph id="H9B86A53A7919418B8B891471FF2112D4"><enum>(C)</enum><text>any area
				contiguous to a site of such crashes that the Special Master determines was
				sufficiently close to the site that there was a demonstrable risk of physical
				harm resulting from the impact of the aircraft or any subsequent fire,
				explosions, or building collapses (including the immediate area in which the
				impact occurred, fire occurred, portions of buildings fell, or debris fell upon
				and injured individuals); and</text>
							</subparagraph><subparagraph id="H8842EA58014741ABB1945DA9965BEC42"><enum>(D)</enum><text display-inline="yes-display-inline">any area related to, or along, routes of
				debris removal, such as barges and Fresh
				Kills.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H1092A3E424D04C40A6A1AD527801B92B"><enum>202.</enum><header>Extended and
			 expanded eligibility for compensation</header>
				<subsection id="H6E5D55EEA5A045018FCFDDD288A4D086"><enum>(a)</enum><header>Information on
			 losses resulting from debris removal included in contents of claim
			 form</header><text display-inline="yes-display-inline">Section 405(a)(2)(B) of
			 the Air Transportation Safety and System Stabilization Act (49 U.S.C. 40101
			 note) is amended—</text>

					</paragraph></subsection><subsection id="HB40A25B581FC4EEAA958BAD6F8DCD24"><enum>(b)</enum><header>Extension of
			 deadline for claims under September 11th Victim Compensation Fund of
			 2001</header><text display-inline="yes-display-inline">Section 405(a)(3) of
			 such Act is amended to read as follows:</text>

				in accordance with subsection (c)(3)(A)(i), by an individual (or by a personal
				representative on behalf of a deceased individual) during the period beginning
				on the date on which the regulations are updated under section 407(b) and
				ending on December 22,
				2031.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H793C2D617AA34D57AA2310949F44F615"><enum>(c)</enum><header>Requirements for
			 filing claims during extended filing period</header><text>Section 405(c)(3) of
			 such Act is amended—</text>

			 subparagraphs (A) and (B) as subparagraphs (B) and (C), respectively;

			 before subparagraph (B), as so redesignated, the following new
			 subparagraph:</text>

				the Special Master determines the individual knew (or reasonably should have
				known) before the date specified in clause (iii) that the individual suffered a
				physical harm at a 9/11 crash site as a result of the terrorist-related
				aircraft crashes of September 11, 2001, or as a result of debris removal, and
				that the individual knew (or should have known) before such specified date that
				the individual was eligible to file a claim under this title, the individual
				may file a claim not later than the date that is 2 years after such specified
				date.</text>
									</subclause><subclause id="H9AFB3756BBDA43AA80D0801BC46D77CE"><enum>(II)</enum><text>In the case that
				the Special Master determines the individual first knew (or reasonably should
				have known) on or after the date specified in clause (iii) that the individual
				suffered such a physical harm or that the individual first knew (or should have
				known) on or after such specified date that the individual was eligible to file
				a claim under this title, the individual may file a claim not later than the
				last day of the 2-year period beginning on the date the Special Master
				determines the individual first knew (or should have known) that the individual
				both suffered from such harm and was eligible to file a claim under this
				title.</text>
									</subclause></clause><clause id="HEA9143B7C7034E4B8E5DDFC5993F5B15"><enum>(ii)</enum><header>Other
				eligibility requirements for filing claims</header><text>An individual may file
				a claim during the period described in subsection (a)(3)(B) only if—</text>
									<subclause id="HE1AB1FF2AF904C08B2009F97E13EBDBD"><enum>(I)</enum><text>the individual was
				treated by a medical professional for suffering from a physical harm described
				in clause (i)(I) within a reasonable time from the date of discovering such
				harm; and</text>
									</subclause><subclause id="H23F64A746439423FADA3E90978357239"><enum>(II)</enum><text>the individual’s
				physical harm is verified by contemporaneous medical records created by or at
				the direction of the medical professional who provided the medical care.</text>
									</subclause></clause><clause id="H406BE99ABE904544A3D05755C742FFF0"><enum>(iii)</enum><header>Date
				specified</header><text>The date specified in this clause is the date on which
				the regulations are updated under section
				407(a).</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H95A8CD03FF694BEBA8C8D5F14471B250"><enum>(d)</enum><header>Clarifying
			 applicability to all 9/11 crash sites</header><text>Section 405(c)(2)(A)(i) of
			 such Act is amended by striking <quote>or the site of the aircraft crash at
			 Shanksville, Pennsylvania</quote> and inserting <quote>the site of the aircraft
			 crash at Shanksville, Pennsylvania, or any other 9/11 crash
			 site</quote>.</text>
				</subsection><subsection id="H503D6DC4B7B4482DA3FCBCBF181E5F08"><enum>(e)</enum><header>Inclusion of
			 physical harm resulting from debris removal</header><text display-inline="yes-display-inline">Section 405(c) of such Act is amended in
			 paragraph (2)(A)(ii), by inserting <quote>or debris removal</quote> after
			 <quote>air crash</quote>.</text>
				</subsection><subsection id="HA1DBD47899AD4718895EFA25F1FEB79"><enum>(f)</enum><header>Limitations on
			 civil actions</header>
					<paragraph id="HB77E2D05176244CCACCA004CA560A900"><enum>(1)</enum><header>Application to
			 damages related to debris removal</header><text>Clause (i) of section
			 405(c)(3)(C) of such Act, as redesignated by subsection (c), is amended by
			 inserting <quote>, or for damages arising from or related to debris
			 removal</quote> after <quote>September 11, 2001</quote>.</text>
					</paragraph><paragraph id="H17AE2DA2FC2F4A85B5E5D639E603BBDE"><enum>(2)</enum><header>Pending
			 actions</header><text>Clause (ii) of such section, as so redesignated, is
			 amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H152C40422CE04D01B4D589321A6CC6D" style="OLC">

				described in subsection (a)(3)(A) unless such individual withdraws from such
				action by the date that is 90 days after the date on which regulations are

				described in subsection (a)(3)(B) unless such individual withdraws from such
				action by the date that is 90 days after the date on which the regulations are
				updated under section
				407(b).</text>

					</paragraph><paragraph id="H957E7AC869DB477BA900865437C50000"><enum>(3)</enum><header>Authority to
			 reinstitute certain lawsuits</header><text>Such section, as so redesignated, is

				Compensation Act of 2008, the Special Master shall update the regulations
				promulgated under subsection (a) to the extent necessary to comply with the
				provisions of title II of such
				Act.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H1A1D4BFC7BC14FD395962FBC401912C0"><enum>204.</enum><header>Limited
			 liability for certain claims</header><text display-inline="no-display-inline">Section 408(a) of the Air Transportation
			 Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended by adding
			 at the end the following new paragraphs:</text>
				<quoted-block display-inline="no-display-inline" id="HCDA9238608914CC7B2967F63208B793C" style="OLC">
					<paragraph id="HA509DF5F095B45C78D00A9AE0994E472"><enum>(4)</enum><header>Liability for
				certain claims</header>
						<subparagraph id="HF185682EE90649E5A6A4056E67D0D891"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, subject to
				subparagraph (B), liability for all claims and actions (including claims or
				actions that have been previously resolved, that are currently pending, and
				that may be filed through December 22, 2031) for compensatory damages,
				contribution or indemnity, or any other form or type of relief, arising from or
				related to debris removal, against the City of New York, any entity (including
				the Port Authority of New York and New Jersey) with a property interest in the
				World Trade Center on September 11, 2001 (whether fee simple, leasehold or
				easement, or direct or indirect) and any contractors and subcontractors
				thereof, shall not be in an amount that exceeds the sum of the
				following:</text>
							<clause id="HC40B7517729E438CAC466F708F067CFA"><enum>(i)</enum><text>The amount of
				funds of the WTC Captive Insurance Company, including the cumulative
				interest.</text>
							</clause><clause id="H0D28EF5E50724824A91840D27ACCAA"><enum>(ii)</enum><text>The
				amount of all available insurance identified in schedule 2 of the WTC Captive
				Insurance Company insurance policy.</text>
							</clause><clause id="H86BDC409057E40FAA79E2048175D4D11"><enum>(iii)</enum><text>The amount that
				is the greater of the City of New York’s insurance coverage or $350,000,000. In
				determining the amount of the City’s insurance coverage for purposes of the
				previous sentence, any amount described in clauses (i) and (ii) shall not be
				included.</text>
							</clause><clause id="H0C1F5461E2BA44078B002349A4559C60"><enum>(iv)</enum><text>The amount of all
				available liability insurance coverage maintained by any entity, including the
				Port Authority of New York and New Jersey, with a property interest in the
				World Trade Center, on September 11, 2001, whether fee simple, leasehold or
				easement, or direct or indirect.</text>
							</clause><clause id="H624C427515D948998D6CC18F2D900F8"><enum>(v)</enum><text display-inline="yes-display-inline">The amount of all available liability
				insurance coverage maintained by contractors and subcontractors.</text>
							</clause></subparagraph><subparagraph id="HE2E3671F67A9480690F7912AD586C00"><enum>(B)</enum><header>Exception</header><text>Subparagraph
				(A) shall not apply to claims or actions based upon conduct held to be
				intentionally tortious in nature or to acts of gross negligence or other such
				acts to the extent to which punitive damages are awarded as a result of such
				conduct or acts.</text>
						</subparagraph></paragraph><paragraph id="H31F8A81115E142CCB3A56F4805766000"><enum>(5)</enum><header>Priority of
				claims payments</header><text display-inline="yes-display-inline">Payments to
				plaintiffs who obtain a settlement or judgment with respect to a claim or
				action to which paragraph (4)(A) applies, shall be paid solely from the
				following funds in the following order:</text>
						<subparagraph id="H21E81B632BDB4AA6837560C233E415CD"><enum>(A)</enum><text>The funds
				described in clause (i) or (ii) of paragraph (4)(A).</text>
						</subparagraph><subparagraph id="HA36BDACDBF1B4E47A63FD6CCB8DED174"><enum>(B)</enum><text>If there are no
				funds available as described in clause (i) or (ii) of paragraph (4)(A), the
				funds described in clause (iii) of such paragraph.</text>
						</subparagraph><subparagraph id="HEDDBB72F740841DAAE504C71956FAD20"><enum>(C)</enum><text display-inline="yes-display-inline">If there are no funds available as
				described in clause (i), (ii), or (iii) of paragraph (4)(A), the funds
				described in clause (iv) of such paragraph.</text>
						</subparagraph><subparagraph id="H34CA1127AFEB4F8B878BF28D40BE6CDB"><enum>(D)</enum><text display-inline="yes-display-inline">If there are no funds available as
				described in clause (i),(ii), (iii), or (iv) of paragraph (4)(A), the funds
				described in clause (v) of such paragraph.</text>
						</subparagraph></paragraph><paragraph id="HC0579C0D67E2469CB6419D5984AB8090"><enum>(6)</enum><header>Declaratory
				judgment actions and direct action</header><text display-inline="yes-display-inline">Any party to a claim or action to which
				paragraph (4)(A) applies may, with respect to such claim or action, either file
				an action for a declaratory judgment for insurance coverage or bring a direct
				action against the insurance company
				involved.</text>

				<section display-inline="no-display-inline" id="HE29BF48539CA40739303751359E73300" section-type="subsequent-section"><enum>301.</enum><header>Codification of
			 economic substance doctrine</header>
					<subsection commented="no" display-inline="no-display-inline" id="H0ACB5A6412CE48FCBC1554858CC61400"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 7701 of the
			 Internal Revenue Code of 1986 is amended by redesignating subsection (p) as
			 subsection (q) and by inserting after subsection (o) the following new
			 subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H98A584CB5EB046A3BF584B7300A1003B" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="HF0DC7D57B1AB46A890E3DF1C3D81562E"><enum>(p)</enum><header display-inline="yes-display-inline">Clarification of economic substance
				doctrine</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H142E8289756A444482F0809C89FC7B79"><enum>(1)</enum><header display-inline="yes-display-inline">Application of doctrine</header><text>In
				the case of any transaction to which the economic substance doctrine is
				relevant, such transaction shall be treated as having economic substance only
				if—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HD7C4452FA59442528BE137D08B62519"><enum>(A)</enum><text display-inline="yes-display-inline">the transaction changes in a meaningful way
				(apart from Federal income tax effects) the taxpayer’s economic position,
				and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3FF65E5F504F46A28436CF7738119297"><enum>(B)</enum><text display-inline="yes-display-inline">the taxpayer has a substantial purpose
				(apart from Federal income tax effects) for entering into such
				transaction.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF38F4A0546D34A50889460509B9CF8E"><enum>(2)</enum><header display-inline="yes-display-inline">Special rule where taxpayer relies on
				profit potential</header>
									<subparagraph id="H9946CFA8BD614ABE8D8C859CA9CD74CA"><enum>(A)</enum><header>In
				general</header><text>The potential for profit of a transaction shall be taken
				into account in determining whether the requirements of subparagraphs (A) and
				(B) of paragraph (1) are met with respect to the transaction only if the
				present value of the reasonably expected pre-tax profit from the transaction is
				substantial in relation to the present value of the expected net tax benefits
				that would be allowed if the transaction were respected.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD97717A64D2C4453A13633008D291C00"><enum>(B)</enum><header display-inline="yes-display-inline">Treatment of fees and foreign
				taxes</header><text display-inline="yes-display-inline">Fees and other
				transaction expenses and foreign taxes shall be taken into account as expenses
				in determining pre-tax profit under subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="H193BA0B3D0234411B54950D1CF68C27D"><enum>(3)</enum><header>State and local
				tax benefits</header><text>For purposes of paragraph (1), any State or local
				income tax effect which is related to a Federal income tax effect shall be
				treated in the same manner as a Federal income tax effect.</text>
								</paragraph><paragraph id="HAEA77C20651E4DD18FD88967647CB5C3"><enum>(4)</enum><header>Financial
				accounting benefits</header><text>For purposes of paragraph (1)(B), achieving a
				financial accounting benefit shall not be taken into account as a purpose for
				entering into a transaction if such transaction results in a Federal income tax
				benefit.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E61C2BED6C04B4DA04D1E982288C303"><enum>(5)</enum><header display-inline="yes-display-inline">Definitions and special rules</header><text display-inline="yes-display-inline">For purposes of this subsection—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HA7BBDBEDA2E1489D886D5B5D53A38738"><enum>(A)</enum><header display-inline="yes-display-inline">Economic substance doctrine</header><text display-inline="yes-display-inline">The term <term>economic substance
				doctrine</term> means the common law doctrine under which tax benefits under
				subtitle A with respect to a transaction are not allowable if the transaction
				does not have economic substance or lacks a business purpose.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF217BA22EE134C52BA6362BBC4DC7EBC"><enum>(B)</enum><header display-inline="yes-display-inline">Exception for personal transactions of
				individuals</header><text display-inline="yes-display-inline">In the case of an
				individual, paragraph (1) shall apply only to transactions entered into in
				connection with a trade or business or an activity engaged in for the
				production of income.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDA25541370234F82ACC588483BFC2C5E"><enum>(C)</enum><header display-inline="yes-display-inline">Other common law doctrines not
				affected</header><text display-inline="yes-display-inline">Except as
				specifically provided in this subsection, the provisions of this subsection
				shall not be construed as altering or supplanting any other rule of law, and
				the requirements of this subsection shall be construed as being in addition to
				any such other rule of law.</text>
									</subparagraph><subparagraph id="HB1433F8ECC6D471D9EF623430126CA5B"><enum>(D)</enum><header>Determination of
				application of doctrine not affected</header><text display-inline="yes-display-inline">The determination of whether the economic
				substance doctrine is relevant to a transaction shall be made in the same
				manner as if this subsection had never been enacted.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7798A742BD1D49D4A301059860B7F710"><enum>(6)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe such
				regulations as may be necessary or appropriate to carry out the purposes of
				this subsection. Such regulations may include exemptions from the application
				of this
				subsection.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H6CF51115EAE0471192C241EF60DF982B"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 Date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to transactions entered into after the date of the
			 enactment of this Act.</text>
					</subsection></section><section display-inline="no-display-inline" id="H86366E07EB0E421D8DC74171948CBD52" section-type="subsequent-section"><enum>302.</enum><header>Penalties for
			 underpayments</header>
					<subsection commented="no" display-inline="no-display-inline" id="HCF6DAFF3C6D6425689D62329F0A14DC3"><enum>(a)</enum><header display-inline="yes-display-inline">Penalty for underpayments attributable to
			 transactions lacking economic substance</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H939872CFD05D4D14AD00F096F3E6F19"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subsection (b) of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/6662">section 6662</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after
			 paragraph (5) the following new paragraph:</text>
							<quoted-block display-inline="no-display-inline" id="H17086337B34C43B491705052F028088C" style="OLC">
								<paragraph id="H41D2B94EF57D4017BBEA71D57147EE53"><enum>(6)</enum><text>Any disallowance
				of claimed tax benefits by reason of a transaction lacking economic substance
				(within the meaning of section 7701(p)) or failing to meet the requirements of
				any similar rule of
				law.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="H4543206A0CC44DF5AC1CA528206E4E73"><enum>(2)</enum><header>Increased
			 penalty for nondisclosed transactions</header><text>Section 6662 of such Code
			 is amended by adding at the end the following new subsection:</text>
							<quoted-block display-inline="no-display-inline" id="H9C8384AB7665482BAFA2A7A021A07A5" style="OLC">
								<subsection id="H27CBF3352FDB41DCB001D5FA7EFD466F"><enum>(i)</enum><header>Increase in
				penalty in case of nondisclosed noneconomic substance transactions</header>
									<paragraph id="H1A539E3EDA674316879CDC006E11C368"><enum>(1)</enum><header>In
				general</header><text>To the extent that a portion of the underpayment to which
				this section applies is attributable to one or more nondisclosed noneconomic
				substance transactions, subsection (a) shall be applied with respect to such
				portion by substituting <quote>40 percent</quote> for <quote>20
				percent</quote>.</text>
									</paragraph><paragraph display-inline="no-display-inline" id="H2D751744DDFE42118D9DDFE86F335874"><enum>(2)</enum><header>Nondisclosed
				noneconomic substance transactions</header><text>For purposes of this
				subsection, the term <term>nondisclosed noneconomic substance
				transaction</term> means any portion of a transaction described in subsection
				(b)(6) with respect to which the relevant facts affecting the tax treatment are
				not adequately disclosed in the return nor in a statement attached to the
				return.</text>
									</paragraph><paragraph id="H9588FFB9BDFC48CF89933C09DE83016C"><enum>(3)</enum><header>Special rule for
				amended returns</header><text display-inline="yes-display-inline">Except as
				provided in regulations, in no event shall any amendment or supplement to a
				return of tax be taken into account for purposes of this subsection if the
				amendment or supplement is filed after the earlier of the date the taxpayer is
				first contacted by the Secretary regarding the examination of the return or
				such other date as is specified by the
				Secretary.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="H0390806108114496887B427CF013E495"><enum>(3)</enum><header>Conforming
			 amendment</header><text>Subparagraph (B) of section 6662A(e)(2) of such Code is
			 amended—</text>
							<subparagraph id="HB6682BE3B40941CA8F09972777A94765"><enum>(A)</enum><text>by striking
			 <quote>section 6662(h)</quote> and inserting <quote>subsection (h) or (i) of
			 section 6662</quote>, and</text>
							</subparagraph><subparagraph id="HB887FF56B0A142479EE7F94E80DDC23D"><enum>(B)</enum><text>by striking
			 <quote><header-in-text level="subparagraph" style="OLC">gross valuation
			 misstatement penalty</header-in-text></quote> in the heading and inserting
			 <quote><header-in-text level="subparagraph" style="OLC">certain increased
			 underpayment penalties</header-in-text></quote>.</text>
							</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H0E7CD7795DEE42E4AE82E571600F85F"><enum>(b)</enum><header>Reasonable cause
			 exception not applicable to noneconomic substance transactions, tax shelters,
			 and certain large corporations</header><text display-inline="yes-display-inline">Subsection (c) of section 6664 of such Code
			 is amended—</text>
						<paragraph id="H247AD67089CC47EBBDE0A2A8C90048AA"><enum>(1)</enum><text>by redesignating
			 paragraphs (2) and (3) as paragraphs (3) and (4), respectively,</text>
						</paragraph><paragraph id="H5809454A19E14501A600022144F9DBFA"><enum>(2)</enum><text>by striking
			 <quote>paragraph (2)</quote> in paragraph (4), as so redesignated, and
			 inserting <quote>paragraph (3)</quote>, and</text>
						</paragraph><paragraph id="H0FCA8D0D6D0D4A40A8242785E09DCFC7"><enum>(3)</enum><text>by inserting after
			 paragraph (1) the following new paragraph:</text>
							<quoted-block display-inline="no-display-inline" id="H9C2DEF65BAAE406ABF8C6CC22FB8F53" style="OLC">
								<paragraph id="H43BB02A87D9D4353B7FCCCAAF497D91D"><enum>(2)</enum><header>Exception for
				noneconomic substance transactions, tax shelters, and certain large
				corporations</header><text>Paragraph (1) shall not apply—</text>
									<subparagraph id="H4430381FB64A4FD0AEF520E3ED8944DD"><enum>(A)</enum><text>to any portion of
				an underpayment which is attributable to one or more tax shelters (as defined
				in section 6662(d)(2)(C)) or transactions described in section 6662(b)(6),
				and</text>
									</subparagraph><subparagraph id="H7D7F4367227C42818892C39F47811B93"><enum>(B)</enum><text>to any taxpayer if
				such taxpayer is a specified large corporation (as defined in section
				6662(d)(2)(D)(ii)).</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H889B38EA717847AF94685F496BD90661"><enum>(c)</enum><header>Application of
			 penalty for erroneous claim for refund or credit to noneconomic substance
			 transactions</header><text display-inline="yes-display-inline">Section 6676 of
			 such Code is amended by redesignating subsection (c) as subsection (d) and
			 inserting after subsection (b) the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H159ECC6E3DC24EC2B6D4D907C1167B1D" style="OLC">
							<subsection id="H5D4EF95B525748BE911BC607E7007700"><enum>(c)</enum><header>Noneconomic
				substance transactions treated as lacking reasonable basis</header><text display-inline="yes-display-inline">For purposes of this section, any excessive
				amount which is attributable to any transaction described in section 6662(b)(6)
				shall not be treated as having a reasonable
				basis.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H3F64FC72E3744B6981B82BF9892F1DC"><enum>(d)</enum><header>Special
			 understatement reduction rule for certain large corporations</header>
						<paragraph id="HA405CA8166E54098B71C5D4CA43DD133"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (2) of
			 section 6662(d) of such Code is amended by adding at the end the following new
			 subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="HD03A18B2152A425AB4494578B89925DE" style="OLC">
								<subparagraph id="H5C7BACEBA3244D969C9EA5BD5F2D6C51"><enum>(D)</enum><header>Special
				reduction rule for certain large corporations</header>
									<clause id="HB2AEB8CF77144A2985198CCD2413F469"><enum>(i)</enum><header>In
				general</header><text>In the case of any specified large corporation—</text>
										<subclause id="H7C639A75B45345278174CD240500905E"><enum>(I)</enum><text>subparagraph (B)
				shall not apply, and</text>
										</subclause><subclause id="H9FCEB60978284BCFAD1C4E7F67CB3B25"><enum>(II)</enum><text>the amount of the
				understatement under subparagraph (A) shall be reduced by that portion of the
				understatement which is attributable to any item with respect to which the
				taxpayer has a reasonable belief that the tax treatment of such item by the
				taxpayer is more likely than not the proper tax treatment of such item.</text>
										</subclause></clause><clause id="H5CC100DB199240E2B650EF713EE1D6E"><enum>(ii)</enum><header>Specified large
				corporation</header>
										<subclause id="HF97643742A2B4521B7E36EDECE64AC13"><enum>(I)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of this
				subparagraph, the term <term>specified large corporation</term> means any
				corporation with gross receipts in excess of $100,000,000 for the taxable year
				involved.</text>
										</subclause><subclause id="HECEA41DBCCF54A5F95B75600D904AC2C"><enum>(II)</enum><header>Aggregation
				rule</header><text display-inline="yes-display-inline">All persons treated as a
				single employer under section 52(a) shall be treated as one person for purposes
				of subclause
				(I).</text>
										</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="H23ED903D561F443E819104C1F955E180"><enum>(2)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Subparagraph (C) of
			 section 6662(d)(2) of such Code is amended by striking <quote>Subparagraph
			 (B)</quote> and inserting <quote>Subparagraphs (B) and
			 (D)(i)(II)</quote>.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H635A5EACC28549C3AE94A9745E3790D"><enum>(e)</enum><header display-inline="yes-display-inline">Effective
			 Date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to taxable years beginning after the date of the
			 enactment of this Act.</text>
					</subsection></section></subtitle><subtitle id="HF4E254C62A6248C19E622D285738CEEB"><enum>B</enum><header>Prevention of tax
			 treaty exploitation to evade United States taxation</header>
				<section display-inline="no-display-inline" id="H43415304B1864667A9738F5DEB929511" section-type="subsequent-section"><enum>311.</enum><header>Limitation on treaty
			 benefits for certain deductible payments</header>
					<subsection id="H40F391D664184C3989EB7C1C3ECE7D96"><enum>(a)</enum><header>In
			 general</header><text>Section 894 (relating to income affected by treaty) is
			 amended by adding at the end the following new subsection:</text>
						<quoted-block id="H9F68892854B54826B72D265CC6A97CB2">
							<subsection id="HDF7F11DC98D64113A1E4CC355140FF08"><enum>(d)</enum><header>Limitation on
				treaty benefits for certain deductible payments</header>
								<paragraph id="H474896E1CB5244E5A587AA408CC65CF6"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of any
				deductible related-party payment, any withholding tax imposed under chapter 3
				(and any tax imposed under subpart A or B of this part) with respect to such
				payment may not be reduced under any treaty of the United States unless any
				such withholding tax would be reduced under a treaty of the United States if
				such payment were made directly to the foreign parent corporation.</text>
								</paragraph><paragraph id="H0D81785ED011475DBB6E82F95EB37741"><enum>(2)</enum><header>Deductible
				related-party payment</header><text>For purposes of this subsection, the term
				<term>deductible related-party payment</term> means any payment made, directly
				or indirectly, by any person to any other person if the payment is allowable as
				a deduction under this chapter and both persons are members of the same foreign
				controlled group of entities.</text>
								</paragraph><paragraph id="H8B12352BA0C64CA692F53934BAAFAA4D"><enum>(3)</enum><header>Foreign
				controlled group of entities</header><text display-inline="yes-display-inline">For purposes of this subsection—</text>
									<subparagraph id="H11FE9AECB7974403ADAA87D29EB7FB00"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>foreign controlled group of entities</term> means a controlled group of
				entities the common parent of which is a foreign corporation.</text>
									</subparagraph><subparagraph id="HEBDF632508584025B11D1C7D9EF32061"><enum>(B)</enum><header>Controlled group
				of entities</header><text display-inline="yes-display-inline">The term
				<term>controlled group of entities</term> means a controlled group of
				corporations as defined in section 1563(a)(1), except that—</text>
										<clause id="HD3CA209F4EE64434B4EBDCB56793ECAF"><enum>(i)</enum><text><quote>more than
				50 percent</quote> shall be substituted for <quote>at least 80 percent</quote>
				each place it appears therein, and</text>
										</clause><clause id="HEDA9B03B6C9D4A3086F75FED651485C7"><enum>(ii)</enum><text>the determination
				shall be made without regard to subsections (a)(4) and (b)(2) of section
				1563.</text>
										</clause><continuation-text continuation-text-level="subparagraph">A
				partnership or any other entity (other than a corporation) shall be treated as
				a member of a controlled group of entities if such entity is controlled (within
				the meaning of section 954(d)(3)) by members of such group (including any
				entity treated as a member of such group by reason of this sentence).</continuation-text></subparagraph></paragraph><paragraph id="H2AAF9104CCB44D19A7903222E42456E1"><enum>(4)</enum><header>Foreign parent
				corporation</header><text>For purposes of this subsection, the term
				<term>foreign parent corporation</term> means, with respect to any deductible
				related-party payment, the common parent of the foreign controlled group of
				entities referred to in paragraph (3)(A).</text>
								</paragraph><paragraph id="H2B75A09879CC4B2D86391B51612427F9"><enum>(5)</enum><header>Regulations</header><text>The
				Secretary may prescribe such regulations or other guidance as are necessary or
				appropriate to carry out the purposes of this subsection, including regulations
				or other guidance which provide for—</text>
									<subparagraph id="H423C14AC050F4EB7BCD46C3C9D5ECE96"><enum>(A)</enum><text>the treatment of
				two or more persons as members of a foreign controlled group of entities if
				such persons would be the common parent of such group if treated as one
				corporation, and</text>
									</subparagraph><subparagraph id="H45FF785DE3FC4B97ABCAC121C8C185C"><enum>(B)</enum><text>the treatment of
				any member of a foreign controlled group of entities as the common parent of
				such group if such treatment is appropriate taking into account the economic
				relationships among such
				entities.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H35E22BF4BC274D43972D4275B72112BD"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to payments
			 made after the date of the enactment of this Act.</text>
					</subsection></section></subtitle><subtitle id="H3D2911F136CD400C88F59500293E3117"><enum>C</enum><header>Corporate
			 estimated taxes</header>
				<section id="H0E16526306BA4455B4CDF6658F1313C5"><enum>321.</enum><header>Time for
			 payment of corporate estimated taxes</header><text display-inline="no-display-inline">The percentage under subparagraph (C) of
			 section 401(1) of the Tax Increase Prevention and Reconciliation Act of 2005 in
			 effect on the date of the enactment of this Act is increased by 5 percentage
			 points.</text>
