		<section id="H79ACC3862A6947B3B7C490031E712E2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fairness and Accountability in Defense
			 Contracting Act</short-title></quote>.</text>
		</section><section id="H5A90830EC4974888AE016F863FB883C6"><enum>2.</enum><header>Requirements for
			 defense contractors relating to certain former Department of Defense
			 officials</header>
			<subsection id="HA1137B8893CC49B7AC8064D26996004C"><enum>(a)</enum><header>Requirements</header>
				<paragraph id="H5D51DDE2E9494E2495B4A541DBE69D40"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/141">Chapter 141</external-xref> of title 10, United States Code, is amended
			 by adding at the end the following new section:</text>
					<quoted-block id="H7E10D02CC8A644AEB1DFDB7857D946F7" style="USC">
						<section id="H0694EFFB6E754D8B81D9D0780004D3D7"><enum>2410r.</enum><header>Defense
				contractors: requirements concerning former Department of Defense
				officials</header>
							<subsection id="H48D78FE116D64D7D9C8D1D6581E6D1DB"><enum>(a)</enum><header>Requirement for
				written statement for bids and proposals for covered
				contracts</header><text>Each solicitation of offers by the Department of
				Defense for a covered contract shall include a requirement that the offeror
				include with the bid or proposal for the contract a written statement setting
				forth the information required by subsection (c).</text>
							</subsection><subsection id="HBCD21ECCAEC54337981326B56D32EA54"><enum>(b)</enum><header>Requirement for
				report for covered contracts</header><text>Each covered contract that is
				entered into by the Department of Defense shall include a provision under which
				the contractor agrees to submit to the Secretary of Defense, not later than
				April 1 of each year such contract is in effect, a written report setting forth
				the information required by subsection (c).</text>
							</subsection><subsection id="HC2109E0BFDB44D5080FBF0BC2580C562"><enum>(c)</enum><header>Information</header><text>A written statement by an offeror under subsection (a), and a report by a
				contractor under subsection (b), shall—</text>
								<paragraph id="H6149351B89E04198BC8736D6B85FB67C"><enum>(1)</enum><text>list the name of
				each person who—</text>
									<subparagraph id="HA6C216CCD1BC416698F5E29300EB6239"><enum>(A)</enum><text>is a former
				officer or employee of the Department of Defense or a former or retired member
				of the armed forces; and</text>
									</subparagraph><subparagraph id="HF6E7C53017774DBCAB3359CA6594D743"><enum>(B)</enum><text>during the
				preceding calendar year was provided compensation by the offeror or contractor,
				if such compensation was first provided by the offeror or contractor—</text>
										<clause id="HBAB8F43C7BE0401AB12EA3D07E1654ED"><enum>(i)</enum><text>not more than five
				years after such officer, employee, or member left service in the Department of
				Defense; and</text>
										</clause><clause id="H9B334FB962C0420895D4876D13FBC18"><enum>(ii)</enum><text>not more than five
				years before the date on which the written statement or report is required to
				be submitted; and</text>
										</clause></subparagraph></paragraph><paragraph id="H7654600D944C49DFADAFEB924CA0232C"><enum>(2)</enum><text>in the case of
				each person listed under paragraph (1)—</text>
									<subparagraph id="H21B83BB8CFDA4F06BFE96AD42AB352F"><enum>(A)</enum><text>identify the agency
				in which such person was employed or served on active duty during the last two
				years of such person’s service with the Department of Defense;</text>
									</subparagraph><subparagraph id="HECABB82DBE4047BEA6833D41CF0502BF"><enum>(B)</enum><text>state such
				person’s job title and identify each major defense system, if any, on which
				such person performed any work with the Department of Defense during the last
				two years of such person’s service with the Department; and</text>
									</subparagraph><subparagraph id="HF9C55A8B19ED48EA9B6D001262D70017"><enum>(C)</enum><text>state such
				person’s current job title with the offeror or contractor and identify each
				major defense system on which such person has performed any work on behalf of
				the offeror or contractor.</text>
									</subparagraph></paragraph></subsection><subsection id="HD366CE0BABA74A89A68C7F6DBDA2A228"><enum>(d)</enum><header>Covered
				contract</header><text display-inline="yes-display-inline">In this section, the
				term <quote>covered contract</quote> means a contract for the procurement of
				goods or services in excess of $1,000,000, other than a contract for the
				procurement of commercial items.</text>
							</subsection><subsection id="H061E4FA8BF7E494CAC90AC8035FA1B6E"><enum>(e)</enum><header>Report by
				Secretary of Defense</header><text>The Secretary of Defense shall submit an
				annual report to the congressional defense committees containing a summary of
				the written statements received by offerors pursuant to subsection (a), and the
				reports received by contractors pursuant to subsection (b), during the year
				covered by the
				report.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0E43AB4F5D094545BC0000F473B6030"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 141
			 of such title is amended by adding at the end the following new item:</text>

						<toc regeneration="no-regeneration">
							<toc-entry level="section">2410r. Defense contractors: requirements
				concerning former Department of Defense
				officials.</toc-entry>
						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9C973607F1D2404D9154B8C7CCE88CA8"><enum>(b)</enum><header>Applicability</header>
				<paragraph id="HC5FA75FBCC074917B08D8D669DEE376B"><enum>(1)</enum><header>Bids and
			 proposals</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/2410r">Section 2410r(a)</external-xref> of title 10, United States Code, as
			 added by subsection (a), shall apply with respect to bids or proposals
			 submitted on or after the date occurring 180 days after the date of the
			 enactment of this Act.</text>
				</paragraph><paragraph id="H386CFE399EBC4A73A4B73642D809488F"><enum>(2)</enum><header>
			 Contracts</header><text>Section 2410r(b) of such title, as added by subsection
			 (a), shall apply with respect to contracts in effect on, or awarded on or
			 after, the date occurring 180 days after the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section id="HCC9D514203934C7AA5BE4B6ECEBCEE47"><enum>3.</enum><header>Report of
			 Government Accountability Office</header><text display-inline="no-display-inline">Not later than 60 days after the date of the
			 enactment of this Act, the Comptroller General of the United States shall
			 prepare and submit to Congress a report on the implementation and enforcement
			 of section 27 of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423</external-xref>).</text>
