		<section display-inline="no-display-inline" id="HAB8BE6DD806D4192AB08420794DCFF54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medical Waste Management Act of
			 2008</short-title></quote>.</text>
		</section><section id="H1FD18FD7794140B08D9B1689DC2D8EFB"><enum>2.</enum><header>Tracking and
			 disposal of medical waste</header>
			<subsection display-inline="no-display-inline" id="HA78F47BD05FB45B48863D1CED5D3B056"><enum>(a)</enum><header>Definition of
			 medical waste</header><text>Section 1004 of the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6903">42 U.S.C. 6903</external-xref>) is
			 amended by striking paragraph (40) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2F087521B37745FEB0A7C393BCE3248E" style="OLC">
					<paragraph id="H986CC24DECF34C37B6A8871BC5BD7100"><enum>(40)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HFC9A429D4CEE42898C852B63E8BCA6D5"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in
				<internal-xref idref="H744B3AB31D4F4272B48F6869C3B73C7D" legis-path="(40)(C)">subparagraph (C)</internal-xref>, the term <term>medical
				waste</term> means any solid waste which is generated in the diagnosis,
				treatment, or immunization of human beings or animals, in research pertaining
				thereto, or in the production or testing of biologicals.</text>
						</subparagraph><subparagraph id="H2D59BE19C1E949D496A3DC9B700A9B3" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Such term includes each of the following
				types of solid waste:</text>
							<clause display-inline="no-display-inline" id="HF4E2E5D9C4B14DFC8B33008508FF54A9"><enum>(i)</enum><text>Cultures and stocks of infectious
				agents and associated biologicals, including cultures from medical and
				pathological laboratories, cultures and stocks of infectious agents from
				research and industrial laboratories, wastes from the production of
				biologicals, discarded live and attenuated vaccines, and culture dishes and
				devices used to transfer, inoculate, and mix cultures.</text>
							</clause><clause id="H473311AF1A1F4840BBDA06CC6C65B76"><enum>(ii)</enum><text>Pathological wastes, including
				tissues, organs, and body parts that are removed during surgery or
				autopsy.</text>
							</clause><clause id="H13600CA77D464113B900906618B114EC"><enum>(iii)</enum><text>Waste human blood and products of
				blood, including serum, plasma, and other blood components.</text>
							</clause><clause id="H89118FFE89B6405C893C44913EF5E842"><enum>(iv)</enum><text>Sharps (as such term is defined by
				the Secretary) that have been used in patient care or in medical, research, or
				industrial laboratories, including hypodermic needles, syringes, pasteur
				pipettes, broken glass, and scalpel blades.</text>
							</clause><clause id="H289B21961D0147F39671FBEFEAE713D"><enum>(v)</enum><text>Contaminated carcasses, body parts,
				and bedding of animals that have been exposed to infectious agents during
				research, production of biologicals, or testing of pharmaceuticals.</text>
							</clause><clause id="HFC21E8CF9562462200B0904C00CFC2F"><enum>(vi)</enum><text>Wastes from surgery or autopsy
				that have been in contact with infectious agents, including soiled dressings,
				sponges, drapes, lavage tubes, drainage sets, underpads, and surgical
				gloves.</text>
							</clause><clause id="H21F4DDEEB70B4FB99F32E7673C60322C"><enum>(vii)</enum><text>Laboratory wastes from medical,
				pathological, pharmaceutical, or other research, commercial, or industrial
				laboratories that have been in contact with infectious agents, including slides
				and cover slips, disposable gloves, laboratory coats, and aprons.</text>
							</clause><clause id="H211B2F40C24340DBB8D584524265775"><enum>(viii)</enum><text>Dialysis wastes that have been
				in contact with the blood of patients undergoing hemodialysis, including
				contaminated disposable equipment and supplies such as tubing, filters,
				disposable sheets, towels, gloves, aprons, and laboratory coats.</text>
							</clause><clause id="H1613DA8E279D4635B223BDDA92E2B5A3"><enum>(ix)</enum><text>Discarded medical equipment and
				parts that have been in contact with infectious agents.</text>
							</clause><clause id="HC106898CA5AE4A89A1772CAD679EA7FC"><enum>(x)</enum><text display-inline="yes-display-inline">Solid wastes that are likely to be
				contaminated with infectious agents because the wastes have been in contact
				with humans or animals that are quarantined to protect other humans or animals
				from communicable disease.”</text>
							</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H744B3AB31D4F4272B48F6869C3B73C7D" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Such term does not include any hazardous
				waste identified or listed under subtitle C or any household waste as defined
				in regulations under subtitle C.</text>
						</subparagraph><subparagraph id="H4F898DDB81CE4F59B026CDB9C813A2D6" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">Not later than the last day of the two-year
				period beginning on the date of enactment of the Medical Waste Management Act
				of 2008, the Administrator shall promulgate regulations listing types of
				medical
				waste.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H836FFC60091246BD81E65876B51533D5"><enum>(b)</enum><header>Amendment of
			 <act-name parsable-cite="SWDA">Solid Waste Disposal
			 Act</act-name></header><text display-inline="yes-display-inline">The
			 <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> is amended
			 by striking subtitle J (<external-xref legal-doc="usc" parsable-cite="usc/42/6992">42 U.S.C. 6992 et seq.</external-xref>) and inserting the
			 following:</text>
				<quoted-block act-name="Solid Waste Disposal Act" id="HA2BC3EA750A24A0AADB8ED2441EE6600" style="OLC">
					<subtitle id="H81BB75BE186743B39E77CFE289919BBE"><enum>J</enum><header>Medical Waste
				Management Program</header>
						<section id="HD84C0A72D6EE48CD99E654566397C6C4"><enum>11001.</enum><header>Medical waste
				management program</header>
							<subsection id="HF2D438A948AD44919941BA73D4B08B5C"><enum>(a)</enum><header>In
				general</header><text>The Administrator shall conduct a medical waste
				management program for the purpose of protecting human health and the
				environment from medical waste.</text>
							</subsection><subsection id="H6BA2E5EA443E46F39DE1434EBA243428"><enum>(b)</enum><header>Components of
				program</header><text>The program under
				<internal-xref idref="HF2D438A948AD44919941BA73D4B08B5C" legis-path="11001.(a)">subsection (a)</internal-xref> shall provide for the
				following:</text>
								<paragraph id="H36DCB92CD18C44378E7E02522D24B16B"><enum>(1)</enum><text>Tracking medical
				waste from any generator of such waste to any disposal facility that disposes
				of such waste, including a record keeping system for generators who dispose of
				medical waste at the same facility where the waste is generated.</text>
								</paragraph><paragraph id="H4BD35D2736AE4769838EC1531F5D221C"><enum>(2)</enum><text>A uniform manifest
				form prepared by the generator of any medical waste that accompanies the waste
				as it is being transported from a generator to a disposal facility.</text>
								</paragraph><paragraph id="HC6B28716AADB411794A5297D088587B4"><enum>(3)</enum><text>Labeling and
				packaging requirements that—</text>
									<subparagraph id="H9C71E130791041B182FFBFBE1C6CE7B7"><enum>(A)</enum><text>foster safe
				handling of the waste;</text>
									</subparagraph><subparagraph id="H0D41A5D9F23B462DAEF15DD0057F5D5"><enum>(B)</enum><text>protect the public
				from exposure to infectious disease; and</text>
									</subparagraph><subparagraph id="H058EF9FE98DF4703AAA3B9CB2C4503A4"><enum>(C)</enum><text>provide for the
				identification of the generator of the waste.</text>
									</subparagraph></paragraph><paragraph id="HB269B7A65A2E45D6922EE31B8EC90248"><enum>(4)</enum><text>Storage
				requirements, including a requirement for segregation of the waste at the point
				of generation and during transportation.</text>
								</paragraph><paragraph id="H421CE66C43184DCCB73699EF84F81DB8"><enum>(5)</enum><text>Proper disposal of
				medical waste through appropriate methods of disposal that—</text>
									<subparagraph id="H1BBA8943C1284BC4ABAD4C28FE140910"><enum>(A)</enum><text>are approved by
				the Administrator; and</text>
									</subparagraph><subparagraph id="H737761D115DC47E39396755C607F6504"><enum>(B)</enum><text>provide adequate
				protection for the environment and human health.</text>
									</subparagraph></paragraph><paragraph id="H2DB718FA3DD947C98FF4853B7108F7FC"><enum>(6)</enum><text>Monitoring of
				generators and transporters of medical waste and disposal facilities that
				dispose of medical waste for compliance with the program under this
				section.</text>
								</paragraph><paragraph id="HB8CCCAA700A741E698E4C4A34D867D55"><enum>(7)</enum><text>A requirement that
				such generators, transporters, and disposal facilities provide adequate
				training to individuals who handle medical waste to ensure compliance with the
				program under this section.</text>
								</paragraph><paragraph id="HDA881C27F03B4F899BDA68D8B1C2F6D7"><enum>(8)</enum><text>A national plan
				for managing medical waste generated in States with a shortage of disposal
				facilities.</text>
								</paragraph></subsection><subsection commented="no" id="H8C393D2F0E5F474EABB587920357D664"><enum>(c)</enum><header>Exemptions</header>
								<paragraph commented="no" id="H8D29C813ECAD4FAF84A2E2326249CE74"><enum>(1)</enum><header>Properly treated
				waste</header>
									<subparagraph commented="no" id="H9BF5DB7258BB47028423F48CCE14BAC4"><enum>(A)</enum><header>In
				general</header><text>Subject to
				<internal-xref idref="H2D82A6FD589A40D3850656F7B6D92D0" legis-path="11001.(c)(4)">paragraph (4)</internal-xref>, the Administrator may
				make an exemption from some or all of the requirements of the program under
				<internal-xref idref="HF2D438A948AD44919941BA73D4B08B5C" legis-path="11001.(a)">subsection (a)</internal-xref> for medical waste treated
				in a method described under
				<internal-xref idref="H4D71E61001DD44FFAFC88800FD905FA" legis-path="11002.(d)(1)(B)">subparagraph (B)</internal-xref>.</text>
									</subparagraph><subparagraph commented="no" id="H9392145FA40C452C9700767811241BF7"><enum>(B)</enum><header>Methods of
				treatment</header><text>For purposes of this paragraph, the Administrator shall
				promulgate regulations establishing minimum standards for methods of treating
				medical waste that significantly reduce the potential harm of such waste to the
				environment and to human health.</text>
									</subparagraph></paragraph><paragraph id="HFD4D7655D48D4DEEB7BDEF00DF0763FD"><enum>(2)</enum><header>Storage
				requirements</header><text display-inline="yes-display-inline">Subject to
				<internal-xref idref="H2D82A6FD589A40D3850656F7B6D92D0" legis-path="11001.(c)(4)">paragraph (4)</internal-xref>, the Administrator may
				make an exemption to the requirement under
				<internal-xref idref="HB269B7A65A2E45D6922EE31B8EC90248" legis-path="11001.(b)(4)">subsection (b)(4)</internal-xref> that medical waste
				be segregated from other waste upon receipt of a petition for such an exemption
				from a generator, transporter, or disposal facility.</text>
								</paragraph><paragraph commented="no" id="H231AE8EFEC074DA097FE596D676BE892"><enum>(3)</enum><header>Individuals</header>
									<subparagraph id="H98ADCEEAA5C34995B79FB923398D6DB7"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				<internal-xref idref="H35DFCC71223D44939DACF592635EF5E7" legis-path="11001.(c)(3)(B)">subparagraph (B)</internal-xref> and
				<internal-xref idref="H2D82A6FD589A40D3850656F7B6D92D0" legis-path="11001.(c)(4)">paragraph (4)</internal-xref>, the Administrator
				shall make an exemption from the program under
				<internal-xref idref="HF2D438A948AD44919941BA73D4B08B5C" legis-path="11001.(a)">subsection (a)</internal-xref> for individuals who
				generate medical waste through personal use of medical or non-medical products
				outside of a medical facility, so long as the Administrator ensures that such
				exemption does not endanger the environment or human health.</text>
									</subparagraph><subparagraph id="H35DFCC71223D44939DACF592635EF5E7"><enum>(B)</enum><header>No exemption for
				large volumes of waste</header><text>The Administrator may not make an
				exemption under
				<internal-xref idref="H98ADCEEAA5C34995B79FB923398D6DB7" legis-path="11001.(c)(3)(A)">subparagraph (A)</internal-xref> for an individual
				who generates 50 pounds or more of medical waste in any calendar month.</text>
									</subparagraph></paragraph><paragraph id="H2D82A6FD589A40D3850656F7B6D92D0"><enum>(4)</enum><header>Protection of the
				environment and human health</header><text>The Administrator may not make an
				exemption under this subsection unless the environment and human health can be
				adequately protected, as determined by the Administrator.</text>
								</paragraph></subsection><subsection display-inline="no-display-inline" id="H642798E76D9C43C190835B61FF6149D"><enum>(d)</enum><header>Regulations</header>
								<paragraph id="HBF89995EA9DA4D16AD6E0929106B48E4"><enum>(1)</enum><header>In
				general</header><text>Tor purposes of the program under this section, not later
				than the last day of the 12-month period beginning on the date of enactment of
				the Medical Waste Management Act of 2008, the Administrator shall promulgate
				regulations on tracking, labeling, packaging, storing, handling, monitoring,
				and disposing of medical waste.</text>
								</paragraph><paragraph id="H3B8C2CF228AB44C68911F05FBB573F00"><enum>(2)</enum><header>Variation in
				rules</header><text>The regulations under paragraph (1) may include different
				rules for different types of medical waste and for different types of medical
				waste generators.</text>
								</paragraph></subsection></section><section id="H5533BF7EFC0B455AB60300747C2BFED4"><enum>11002.</enum><header>Specific
				requirements for generators, transporters, and disposal facilities</header>
							<subsection id="H09A3F4DCCAF24C74814DC4B4076B3733"><enum>(a)</enum><header>Specific
				requirements for generators</header><text>A generator of medical waste
				shall—</text>
								<paragraph id="H95DD58A6C5DF4B90A0188F01A1E8A295"><enum>(1)</enum><text>provide any
				transporter that is transporting medical waste from the generator to a disposal
				facility—</text>
									<subparagraph id="H21B683365CF74CB9A547BC83C91995EE"><enum>(A)</enum><text>with a written
				assurance that the generator has complied with all labeling, packaging, and
				storage requirements under
				<internal-xref idref="H10118DBF6B61479089FAEB94CAD3EFE9" legis-path="11002.(b)">section 11001</internal-xref> with respect to such
				medical waste; and</text>
									</subparagraph><subparagraph id="H1E710ADC044944F580DCF1ADD0DD2F88"><enum>(B)</enum><text>with a properly
				completed manifest form for transporting such waste under
				<internal-xref idref="H4BD35D2736AE4769838EC1531F5D221C" legis-path="11001.(b)(2)">section 11001(b)(2)</internal-xref>;</text>
									</subparagraph></paragraph><paragraph id="H03914D9254EA4E41823C8BB7A281FCF9"><enum>(2)</enum><text>register with the
				Administrator; and</text>
								</paragraph><paragraph id="H2EA2F2A2F6544534AC917C01D47E905C"><enum>(3)</enum><text>provide the
				Administrator with the name of all transporters used by the generator to
				transport medical waste.</text>
								</paragraph></subsection><subsection id="H10118DBF6B61479089FAEB94CAD3EFE9"><enum>(b)</enum><header>Specific
				requirements for transporters</header><text>A transporter of medical waste
				shall—</text>
								<paragraph id="H3F17F071108E4BB9837D14DD5300C0BF"><enum>(1)</enum><text display-inline="yes-display-inline">not accept medical waste from a generator
				without receiving a written assurance, with regard to such waste, that is
				described in
				<internal-xref idref="H21B683365CF74CB9A547BC83C91995EE" legis-path="11002.(a)(1)(A)">subsection (a)(1)(A)</internal-xref>;</text>
								</paragraph><paragraph id="H0F658131FE2547CA9D6DEA7B259D6682"><enum>(2)</enum><text>register with the
				Administrator; and</text>
								</paragraph><paragraph id="H2A35CC03A6E54763BE9DF040B598D29"><enum>(3)</enum><text>disclose to the
				Administrator the number and type of vehicles used by the transporter to
				transport medical waste and the equipment and methods used to ensure
				segregation and handling of such waste in accordance with this subtitle.</text>
								</paragraph></subsection><subsection id="HECBFCF2F9B1346C9865300D092509D27"><enum>(c)</enum><header>Specific
				requirements for disposal facilities</header><text display-inline="yes-display-inline">An owner or operator of a disposal facility
				shall—</text>
								<paragraph id="H2CA7648060DD43849D1EEE932E814400"><enum>(1)</enum><text>provide notice of
				the disposal of medical waste to the generator of that medical waste;
				and</text>
								</paragraph><paragraph id="H8458949E1B76413098DF372733145E33"><enum>(2)</enum><text>register with the
				Administrator.</text>
								</paragraph></subsection><subsection id="H4D71E61001DD44FFAFC88800FD905FA"><enum>(d)</enum><header>Registration</header><text>The
				Administrator may set appropriate requirements for registration under this
				section and may collect reasonable registration fees from generators,
				transporters, and disposal facilities.</text>
							</subsection><subsection id="HB61DAB9ABB864D619DD88D742B89C246"><enum>(e)</enum><header>Availability of
				fees</header><text display-inline="yes-display-inline">Subject to
				appropriations, fees collected under this section shall remain available for
				use by the Administrator for purposes of the medical waste management program
				under this subtitle.</text>
							</subsection></section><section id="HCDC6829EC66E42ADBE22CDE800DCAEF8"><enum>11003.</enum><header>Inspections</header>
							<subsection id="HECB8F0A8A3D94750AA6E58004830DA4"><enum>(a)</enum><header>Requirements for
				Access</header>
								<paragraph id="H4474A60E30204CE4BC001E02D11452E5"><enum>(1)</enum><header>In
				general</header><text>Upon request of any officer, employee, or representative
				of the Environmental Protection Agency duly designated by the Administrator,
				for purposes of developing or assisting in the development of any regulation or
				report under this subtitle or enforcing any provision of this subtitle, any
				person who generates, stores, treats, transports, disposes of, or otherwise
				handles medical waste shall furnish information relating to such waste
				(including any manifest forms required under section 11001), conduct monitoring
				or testing, and permit such officer, employee, or representative at all
				reasonable times to have access to, and to copy, all records relating to such
				waste.</text>
								</paragraph><paragraph id="H9D251DA5E19048EDA3A2B74CF28686F"><enum>(2)</enum><header>Specific
				activities authorized</header><text display-inline="yes-display-inline">To
				carry out inspections for purposes of the program under section 11001,
				officers, employees, or representatives described under
				<internal-xref idref="H4474A60E30204CE4BC001E02D11452E5" legis-path="11003.(a)(1)">paragraph (1)</internal-xref> are authorized
				to—</text>
									<subparagraph id="H61028B88D64A49628357FE6D6282F27D"><enum>(A)</enum><text>enter at
				reasonable times any building, vehicle, equipment, container, or other item or
				place where medical waste is generated, stored, treated, disposed of, or
				transported;</text>
									</subparagraph><subparagraph id="H8CF7A01D1B014D45AF48D4179DFDE289"><enum>(B)</enum><text>conduct monitoring
				or testing relating to such waste;</text>
									</subparagraph><subparagraph id="HB2D4B98758BB4E618B4B96F891737892"><enum>(C)</enum><text>inspect any such
				waste and any containers, labels, and documents relating to such waste;
				and</text>
									</subparagraph><subparagraph id="HB823E77183274BE29DDA2500D0BA65D8"><enum>(D)</enum><text>obtain from any
				person—</text>
										<clause id="HEEFC8840D51E455B9287AD2325627625"><enum>(i)</enum><text>samples of such
				waste; and</text>
										</clause><clause id="H6C880EEEFCB94BE4A1BA6B56C723B100"><enum>(ii)</enum><text>samples or copies
				of such containers, labels, and documents.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H3F8A5E092FDA417B87BEA228A2F02055"><enum>(b)</enum><header>Procedures</header>
								<paragraph id="HBD7FF87967A946CDAD1F29845D7E4F7D"><enum>(1)</enum><header>Prompt
				inspections</header><text>Each inspection under this section shall be commenced
				and completed with reasonable promptness.</text>
								</paragraph><paragraph id="HF395C1B599F34C23B2FB05A45EB79DB8"><enum>(2)</enum><header>Samples</header>
									<subparagraph id="H571C01AE2A714D6A83739DE7E270D137"><enum>(A)</enum><header>In
				general</header><text>If an officer, employee, or representative described
				under
				<internal-xref idref="H4474A60E30204CE4BC001E02D11452E5" legis-path="11003.(a)(1)">subsection (a)(1)</internal-xref> obtains any samples
				under
				<internal-xref idref="HB2D4B98758BB4E618B4B96F891737892" legis-path="11003.(a)(2)(C)">subsection (a)(2)(C)</internal-xref>, prior to
				leaving the site of inspection the officer, employee, or representative shall
				give to the owner, operator, or agent in charge a receipt describing each
				sample obtained.</text>
									</subparagraph><subparagraph id="HE21D7669A0A8406FB437302BEC8906E"><enum>(B)</enum><header>Analysis</header><text>If
				any analysis is made of such samples, a copy of the results of such analysis
				shall be furnished promptly to the owner, operator, or agent in charge of the
				site from which such sample was taken.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" id="HDD8E5A985D4E4E87B88E8D9DED92FEF8"><enum>(c)</enum><header>Availability to
				public</header><text>The provisions of section 3007(b) of this Act shall apply
				to records, reports, and information obtained under this section in the same
				manner and to the same extent as such provisions apply to records, reports, and
				information obtained under section 3007.</text>
							</subsection></section><section id="HF87EC5F3F2444F8FB05683361456A625"><enum>11004.</enum><header>Enforcement</header>
							<subsection id="H0426F6CA72F74F42AE24109CC1D5FDF1"><enum>(a)</enum><header>Compliance
				Orders</header>
								<paragraph id="H8E55189D0048437C9D039487E7146165"><enum>(1)</enum><header>Violations</header><text>Whenever,
				on the basis of any information, the Administrator determines that any person
				has violated, or is in violation of, any provision of this subtitle (including
				any regulations promulgated to carry out this subtitle)—</text>
									<subparagraph id="H46C34F0BEC8E49078712E4CF2958F640"><enum>(A)</enum><text>the Administrator
				may issue an order—</text>
										<clause id="HED9DEA9E74414CBA95EE14C4E72039A8"><enum>(i)</enum><text>assessing a civil
				penalty for such violation;</text>
										</clause><clause id="H47E8338BFE2B4C9894E63D061931B33B"><enum>(ii)</enum><text>requiring
				compliance with the provision being violated immediately or within a specified
				time; or</text>
										</clause><clause id="H21D6CF111C8C45BF895FE90016727178"><enum>(iii)</enum><text>both; or</text>
										</clause></subparagraph><subparagraph id="H6D8A7F50FDFB447C91EE7491AC880682"><enum>(B)</enum><text>the Administrator
				may commence a civil action in the United States district court in the district
				in which the violation occurred for appropriate relief, including a temporary
				or permanent injunction.</text>
									</subparagraph></paragraph><paragraph id="HCD7128907AB743CCB60092F8B67EB7CA"><enum>(2)</enum><header>Orders assessing
				penalties</header>
									<subparagraph id="HF156DE1769AB43D1847D40C0403D3EFE"><enum>(A)</enum><header>Amount</header><text>Any
				penalty assessed in an order under this subsection shall not exceed $50,000 per
				day of noncompliance for each violation of a requirement or prohibition in
				effect under this subtitle.</text>
									</subparagraph><subparagraph id="HD8F3D0783A9B4664BE1516F45568C458"><enum>(B)</enum><header>Considerations
				for assessment of penalty</header><text>In assessing such a penalty, the
				Administrator shall take into account the seriousness of the violation and any
				good faith efforts by the violator to comply with applicable
				requirements.</text>
									</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HB9A1065610A04B68AEA100DEE9E645F6"><enum>(3)</enum><header>Specificity of
				orders</header><text>Any order issued pursuant to this subsection shall state
				with reasonable specificity the nature of the violation.</text>
								</paragraph><paragraph id="H826E8F3E1C30470BA4C534557EADC967"><enum>(4)</enum><header>Finality of
				order</header><text>Any order issued under this subsection shall become final
				unless, not later than 30 days after issuance of the order, the persons named
				therein request a public hearing.</text>
								</paragraph><paragraph id="H22EC67841CED4A7B84C92E826D5F6B3B"><enum>(5)</enum><header>Public
				Hearing</header><text display-inline="yes-display-inline">Upon request for a
				public hearing under
				<internal-xref idref="H826E8F3E1C30470BA4C534557EADC967" legis-path="11004.(a)(4)">paragraph (4)</internal-xref>, the Administrator
				shall promptly conduct the public hearing.</text>
								</paragraph><paragraph id="H6039020B941A463FA55902AF51000357"><enum>(6)</enum><header>Violation of
				Compliance orders</header><text>In the case of an order under this subsection
				requiring compliance with any provision of or regulation promulgated to carry
				out this subtitle, if a violator fails to take corrective action within the
				time specified in the order, the Administrator may access a civil penalty of
				not more than $50,000 for each day of continued noncompliance with the
				order.</text>
								</paragraph></subsection><subsection id="H476751703E334B4FA3C1E244C9434123"><enum>(b)</enum><header>Criminal
				Penalties</header>
								<paragraph id="H4B43615BC6C940A4844235EA8B316737"><enum>(1)</enum><header>In
				general</header><text>Whoever—</text>
									<subparagraph id="H6727E05B587147978CC4CEB9C1CD31CA"><enum>(A)</enum><text>knowingly
				violates—</text>
										<clause id="HBF8F89DC981544539DA2FB4D92092366"><enum>(i)</enum><text>any provision of
				this subtitle; or</text>
										</clause><clause id="H656C7A5C632F42D2BB4C60F395E76C90"><enum>(ii)</enum><text>regulations
				promulgated to carry out this subtitle;</text>
										</clause></subparagraph><subparagraph id="H6A386F661D844C9F9839EB54B35397B3"><enum>(B)</enum><text>knowingly omits
				material information or makes any false material statement or representation in
				any label, record, report, or other document filed, maintained, or used for
				purposes of compliance with this subtitle or regulations thereunder; or</text>
									</subparagraph><subparagraph id="H2783D24DBFCB46778D17B98F69D8414F"><enum>(C)</enum><text>knowingly
				generates, stores, treats, transports, disposes of, or otherwise handles any
				medical waste and who knowingly destroys, alters, conceals, or fails to file
				any record, report, or other document required to be maintained or filed for
				purposes of compliance with this subtitle or regulations thereunder;</text>
									</subparagraph><continuation-text continuation-text-level="paragraph">shall be
				fined under title XVIII, United States Code, or imprisoned for a maximum of
				four years (ten years in the case of a violation of
				<internal-xref idref="H6727E05B587147978CC4CEB9C1CD31CA" legis-path="11004.(b)(1)(A)">subparagraph (A)</internal-xref>), or both. Each
				day of a violation under this paragraph is a separate offense.</continuation-text></paragraph><paragraph id="HC83A045F9B8A46B481BF979244B7ECFD"><enum>(2)</enum><header>Knowing
				Endangerment</header>
									<subparagraph id="HB1943DADEC12450385D8C40088621CF0"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Any person who
				knowingly violates any provision of
				<internal-xref idref="H4B43615BC6C940A4844235EA8B316737" legis-path="11004.(b)(1)">paragraph (1)</internal-xref> and who knows at the
				time of such violation that, through such violation, another person is placed
				in imminent danger of death or serious bodily injury, shall be fined $350,000,
				or imprisoned for a maximum of 15 years, or both.</text>
									</subparagraph><subparagraph id="H01B19E5FF4764962B3B9573BDB8B14AA"><enum>(B)</enum><header>Special
				rules</header><text>The provisions of section 3008(f) of this Act shall apply
				to this subsection.</text>
									</subparagraph></paragraph></subsection><subsection id="H006CC28650224CFAB0F6F573D9C648D"><enum>(c)</enum><header>Civil
				Penalties</header>
								<paragraph id="H96E630B1A05A4C9A9F00D0D7C97EAB51"><enum>(1)</enum><header>In
				general</header><text>Any person who violates any provision of this subtitle or
				regulation promulgated to carry out this subtitle shall be liable to the United
				States for a civil penalty in an amount not to exceed $50,000 for each such
				violation.</text>
								</paragraph><paragraph id="HF8F841335AA445009B078E69EB83E4A3"><enum>(2)</enum><header>Repeat
				violations</header><text>For purposes of this subsection, each day of such
				violation shall constitute a separate violation.</text>
								</paragraph><paragraph commented="no" id="H728DC15D2C45458FA3C8CAC6EC794F5"><enum>(3)</enum><header>Policy</header><text>Civil
				penalties assessed by the United States or by the States under this subtitle
				shall be assessed in accordance with the Administrator’s <quote>RCRA Civil
				Penalty Policy</quote>, as such policy may be amended from time to time.</text>
								</paragraph></subsection><subsection display-inline="no-display-inline" id="H801B5774B14647D99E9265555046F51E"><enum>(d)</enum><header>Subpoenas</header><text>In
				connection with any proceeding under this section, the Administrator may issue
				subpoenas for the production of relevant papers, books, and documents, and may
				promulgate rules for discovery procedures.</text>
							</subsection></section><section id="HF918F65455D54AC99138D5B71B669F00"><enum>11005.</enum><header>Relationship
				to State law</header>
							<subsection id="H231BD403E136403E86D0B3E63425A872"><enum>(a)</enum><header>State
				Inspections and Enforcement</header><text>A State may conduct inspections under
				section 11003 and take enforcement actions under section 11004 against any
				person, including any person who has imported medical waste into a State in
				violation of the requirements of, or regulations under, this subtitle, to the
				same extent as the Administrator.</text>
							</subsection><subsection id="H23B5CE3284A144D3AB443D52D18C2D26"><enum>(b)</enum><header>Notification</header><text>At
				the time a State initiates an enforcement action under section 11004 against
				any person, the State shall notify the Administrator in writing.</text>
							</subsection><subsection commented="no" id="H4450E8BBD6CF4156AD24E5B5258927A5"><enum>(c)</enum><header>Preemption</header><text>This
				subtitle preempts the law of any State to the extent such laws are inconsistent
				with this subtitle, except that this subtitle shall not preempt any State law
				that provides additional protections for human health and the environment, as
				determined by the Administrator.</text>
							</subsection><subsection display-inline="no-display-inline" id="HEB9458CFDCDC42B48894F402391F3643"><enum>(d)</enum><header>State
				Forms</header><text>Any State or local law which requires submission of a
				tracking form from any person subject to this subtitle shall require that the
				form be identical in content and format to the manifest form required under
				section 11001, except that a State may require the submission of other tracking
				information which is supplemental to the information required on such manifest
				form through additional sheets or such other means as the State deems
				appropriate.</text>
							</subsection><subsection commented="no" id="H49128BBD88F24D30BF1061C17508B224"><enum>(e)</enum><header>Retention of
				State Authority</header><text>Except as provided in subsections (c) and (d),
				nothing in this subtitle shall affect any State or local law or the authority
				of any State or local government to adopt or enforce any State or local
				law.</text>
							</subsection></section><section id="H1EAF473279DE47CEA1006EB1AFE61543"><enum>11006.</enum><header>Syringe
				Disposal Program</header>
							<subsection id="H01458243B74B4EF2BE37724E22337561"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Administrator
				shall establish a program on syringe disposal to—</text>
								<paragraph id="H3C0B1910480147C9BEC7B7F10164905B"><enum>(1)</enum><text display-inline="yes-display-inline">educate the public about acceptable methods
				for disposal of used syringes generated by individuals through personal use of
				such syringes outside of medical facilities, including through household use;
				and</text>
								</paragraph><paragraph id="H1F3D6117E2FB488BBF13FC624E1F009F"><enum>(2)</enum><text>provide grants to
				State and local governments and nonprofit and private entities—</text>
									<subparagraph id="H05CF3A7589BA41D182A4D2056F214FBD"><enum>(A)</enum><text>to educate the
				public about such methods; and</text>
									</subparagraph><subparagraph commented="no" id="H04BA38706C1C4D7DB5DDE425ADB4189E"><enum>(B)</enum><text>to increase access
				to such disposal methods.</text>
									</subparagraph></paragraph></subsection><subsection id="HC620F801456C42B7B229D87D5B3B1F4E"><enum>(b)</enum><header>Acceptable
				disposal methods</header><text display-inline="yes-display-inline">For purposes
				of this section, acceptable methods of disposal of used syringes shall be
				determined by the Administrator and may include community drop-off programs,
				hazardous waste facilities that accept household waste, mail-back programs,
				syringe exchange programs, and needle destruction devices. Disposal in
				household garbage is not an acceptable disposal method.</text>
							</subsection></section><section id="HC4E83FD64BD14BCA90D0A1F923AB6671"><enum>11007.</enum><header>Reports to
				Congress</header>
							<subsection id="H0DD063E8EDC54D0296343358FDB85868"><enum>(a)</enum><header>Annual
				Report</header>
								<paragraph id="H4236053C2B6B4D6C80D45D62087FAA26"><enum>(1)</enum><header>In
				general</header><text>Not later than one year after the date of enactment of
				the Medical Waste Management Act of 2008 and annually thereafter, the
				Administrator shall report to Congress on the following:</text>
									<subparagraph id="H5EB56F7843C5441C98932D22402B721C"><enum>(A)</enum><text>The types, number,
				and size of generators of medical waste in the United States.</text>
									</subparagraph><subparagraph id="H75EED42599F546AFA3BE759E00216F92"><enum>(B)</enum><text>The types and
				amounts of medical waste generated in the United States.</text>
									</subparagraph><subparagraph id="H314A053074834036A6BC2014417CC257"><enum>(C)</enum><text>The methods
				currently used to handle, store, transport, treat, and dispose of the medical
				waste, including the extent to which such waste is disposed of in sewer
				systems.</text>
									</subparagraph><subparagraph id="H7C7A8946EEFE4477AE5D50E85BCB64DA"><enum>(D)</enum><text>The present and
				potential costs—</text>
										<clause id="H22E0F3FB725F4D90A057B1E0FE22C71D"><enum>(i)</enum><text>to
				local economies, persons, and the environment from the improper handling,
				storage, transportation, treatment, or disposal of medical waste; and</text>
										</clause><clause id="HD6E70E3B94F24EF78ECDD5406711F100"><enum>(ii)</enum><text>to generators,
				transporters, and treatment, storage, and disposal facilities from regulations
				establishing requirements related to tracking, handling, storing, transporting,
				treating, and disposing of medical waste.</text>
										</clause></subparagraph><subparagraph id="HC49150919AC243F997B833B5E33645B1"><enum>(E)</enum><text>Available and
				potentially available methods for handling, storing, transporting, and
				disposing of medical waste and their advantages and disadvantages.</text>
									</subparagraph><subparagraph id="H2050EE71EC374550A7FCA5F84083B3B1"><enum>(F)</enum><text>Available and
				potentially available methods for treating medical waste, including methods of
				sterilization, chemical treatment, and grinding.</text>
									</subparagraph><subparagraph id="H9F6C79A390A54CA7A0B9B1CB436167C8"><enum>(G)</enum><text>The advantages and
				disadvantages of such treatment methods, including the extent to which such
				methods—</text>
										<clause id="H15A9B40BD48F4412960283BC49209546"><enum>(i)</enum><text>render medical
				waste noninfectious or less infectious;</text>
										</clause><clause id="H11C06029D8334F0AA112D11B61400068"><enum>(ii)</enum><text>make medical
				waste unrecognizable; and</text>
										</clause><clause id="H5F22466CCA9946BFA8DBEB72520821C"><enum>(iii)</enum><text>protect human
				health and the environment.</text>
										</clause></subparagraph><subparagraph id="H79DB9C91E9A545DEBA39CFC37BEF3C15"><enum>(H)</enum><text>Factors impacting
				the effectiveness of the treatment methods identified in
				<internal-xref idref="H2050EE71EC374550A7FCA5F84083B3B1" legis-path="11008.(a)(1)(F)">subparagraph (F)</internal-xref>, including
				quality control and quality assurance procedures, maintenance procedures, and
				operator training.</text>
									</subparagraph><subparagraph display-inline="no-display-inline" id="HF24AD28907EC4F6A00A070907F002C00"><enum>(I)</enum><text>Available and
				potentially available methods for the reuse or reduction of the volume of
				medical waste generated.</text>
									</subparagraph><subparagraph id="HCDF5D4D63635446F99F58F9427E80090"><enum>(J)</enum><text>The
				appropriateness of the penalties provided in section 11004 for insuring
				compliance with the requirements of this subtitle, including a review of the
				level of penalties imposed under this subtitle.</text>
									</subparagraph></paragraph></subsection><subsection id="H759BDE7B43234E91ADA313986554B5DE"><enum>(b)</enum><header>Study and report
				on individual generators</header>
								<paragraph id="H0C1A467343F34E289EF96100EB8D29"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Administrator shall conduct a study
				on—</text>
									<subparagraph id="HA49801DCCE924EF4B3220385DB0199C3"><enum>(A)</enum><text>the type of
				medical waste (including used syringes) generated by individuals through
				personal use of medical products outside of medical facilities;</text>
									</subparagraph><subparagraph id="HC4490A7211914A3E9FB9CEB800D03160"><enum>(B)</enum><text>the volume of such
				waste;</text>
									</subparagraph><subparagraph id="H69E2D9C72CE24DCA82D5B11EA380B88F"><enum>(C)</enum><text>the availability
				and cost of disposal and treatment of such waste;</text>
									</subparagraph><subparagraph id="H4C2EBFE0FBE348B3BB12D49F2525BCDC"><enum>(D)</enum><text>the impact on the
				environment and human health of excluding such waste from the medical waste
				management program under section 11001; and</text>
									</subparagraph><subparagraph id="H8958AF7AE28446EFA00008DCE5FE7DC"><enum>(E)</enum><text>the extent to which
				individuals are aware of and use available disposal and treatment options for
				such waste.</text>
									</subparagraph></paragraph><paragraph id="HCB2D68CD554147D7B9131FFAFBB45BA9"><enum>(2)</enum><header>Report</header><text>Not
				later than the last day of the one-year period beginning on the date of
				enactment of the Medical Waste Management Act of 2008, the Administrator shall
				submit a report to Congress containing—</text>
									<subparagraph id="H08A28CAC944C44CBA25CD055B4A28CD5"><enum>(A)</enum><text>the results of the
				study under
				<internal-xref idref="H0C1A467343F34E289EF96100EB8D29" legis-path="11008.(b)(1)">paragraph (1)</internal-xref>;</text>
									</subparagraph><subparagraph id="H54EA8CC2C0B64F69B408AD4119525946"><enum>(B)</enum><text>recommended
				standards for the handling, storage, treatment, and disposal of such waste;
				and</text>
									</subparagraph><subparagraph id="H7AC25C478DA2491B957CBA451BAF5F9E"><enum>(C)</enum><text>recommendations
				for educating the public about such standards.</text>
									</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H0104DDA04BF74299A12D2F05802000BE"><enum>(c)</enum><header>Consultation</header><text>In
				preparing the reports under this section, the Administrator shall consult with
				appropriate State and local agencies.</text>
							</subsection></section><section id="HCD0BC773D43C46CFBA2F190776C88233"><enum>11008.</enum><header>General
				provisions</header>
							<subsection id="H1517BDEDCC1C427A89F6F4A8C71BC718"><enum>(a)</enum><header>Consultation</header><paragraph commented="no" display-inline="yes-display-inline" id="H95A4E31BEFE646A1B90678AF6C81D058"><enum>(1)</enum><text>In promulgating
				regulations under this subtitle, the Administrator shall consult with the
				States and may consult with other interested parties.</text>
								</paragraph><paragraph id="H5D1C3B2E2BEA42358D47CC90920325E8" indent="up1"><enum>(2)</enum><text>The Administrator shall also consult
				with the International Joint Commission (as established by the Boundary Waters
				Treaty of 1909 between Canada and the United States) to determine how to track
				medical waste entering the United States from Canada.</text>
								</paragraph></subsection><subsection commented="no" id="H2FE4FE713CE44F41ACF73E9515ACA43C"><enum>(b)</enum><header>Public
				Comment</header><text display-inline="yes-display-inline">In the case of the
				regulations required by this subtitle to be promulgated within nine months
				after the date of enactment of the Medical Waste Management Act of 2008, the
				Administrator may promulgate such regulations in interim final form without
				prior opportunity for public comment, but the Administrator shall provide an
				opportunity for public comment on the interim final rule.</text>
							</subsection><subsection id="H3ACF888F54D147F0A2F8860083FFDC31"><enum>(c)</enum><header>Paperwork
				Reduction Act</header><text>The promulgation of such regulations shall not be
				subject to the Paperwork Reduction Act of 1980.</text>
							</subsection><subsection id="H78B1E547A7FD409A93AC7CB9A867EC50"><enum>(d)</enum><header>Relationship to
				Subtitle <enum-in-header>C</enum-in-header></header><text>Nothing in this
				subtitle shall affect the authority of the Administrator to regulate medical
				waste under subtitle C of this Act.</text>
							</subsection></section><section commented="no" id="H45C724E03C4643B68200A30F6264FB3"><enum>11009.</enum><header>Effective date
				of regulations</header><text display-inline="no-display-inline">The regulations
				promulgated under this subtitle shall take effect on the last day of the 90-day
				period beginning on the date such regulations are
				promulgated.</text>
