		<section id="H10EA9FC9658A4E54A1C7C6DFC2259059" section-type="section-one"><enum>1.</enum><header>National Biological Data
			 Center</header>
			<subsection id="H531121DF3FCC449196C551704F2D68A8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of the
			 Interior, acting through the United States Geological Survey, shall—</text>
				<paragraph id="H3A657AF1A143478FBF3CFDAB2E5B9D2"><enum>(1)</enum><text>establish a
			 national biological data center (in this Act referred to as the
			 <quote>center</quote>) to collect nonhuman biological data and make such data
			 available for public use; and</text>
				</paragraph><paragraph id="H3E815A7316F24C9485CD38081BF05113"><enum>(2)</enum><text>seek to enter into
			 a contract with a small business for the purpose of managing the center.</text>
				</paragraph></subsection><subsection id="H145050A614924E6F93F60096E1800F1"><enum>(b)</enum><header>Contract
			 Term</header><text>The contract under
			 <internal-xref idref="H531121DF3FCC449196C551704F2D68A8" legis-path="1.(a)">subsection (a)</internal-xref> shall have a term of 10
			 years.</text>
			</subsection><subsection id="H688047753E3547748439AEFAC0DC301D"><enum>(c)</enum><header>Entity
			 selection</header>
				<paragraph id="H3E1FE37A79F64FFF9DEC3409BD57B8EA"><enum>(1)</enum><header>Competitive
			 procedures</header><text>The Secretary shall use competitive procedures (as
			 defined in section 4(5) of the Office of Federal Procurement Policy Act (41
			 U.S.C. 403(5))) to enter into the contract under
			 <internal-xref idref="H531121DF3FCC449196C551704F2D68A8" legis-path="1.(a)">subsection (a)</internal-xref>.</text>
				</paragraph><paragraph id="H7A29026FEE6D42029C72283C6F863B2C"><enum>(2)</enum><header>Qualification
			 requirements</header><text>To qualify to participate in the competitive
			 procedures under paragraph (1), a small business shall have—</text>
					<subparagraph id="HF811BBCFF4AA4128B193FD407126DF34"><enum>(A)</enum><text>no more than 500
			 employees;</text>
					</subparagraph><subparagraph id="H1F3E334B90354642ACA0D3DB62196741"><enum>(B)</enum><text>demonstrated
			 expertise in—</text>
						<clause id="H88EA13226C484013BB81B7FDDDE0CEA9"><enum>(i)</enum><text>managing
			 scientific and technical information;</text>
						</clause><clause id="HDF4ABB34A2E64762863F58E05BC19648"><enum>(ii)</enum><text>implementing
			 scientific information projects;</text>
						</clause><clause id="H3C73386BD8484005A9CCB2FB100CAB3"><enum>(iii)</enum><text>presenting
			 scientific data in an objective manner; and</text>
						</clause><clause id="HB46EDB3FE28F4430B3DAE58D83771264"><enum>(iv)</enum><text>managing
			 interagency collaborations related to scientific and technical information;</text>
						</clause></subparagraph><subparagraph id="H3F1A0191FB234D01A81CF711EF870958"><enum>(C)</enum><text>demonstrated
			 involvement with biodiversity information programs and the National Biological
			 Information Infrastructure of the United States Geological Survey (through
			 partnership or other form of collaboration); and</text>
					</subparagraph><subparagraph id="H0FCCC9B9382A4CE193F4915E00EE0067"><enum>(D)</enum><text display-inline="yes-display-inline">a demonstrated ability and willingness to
			 partner with a research university and a national laboratory with expertise in
			 biodiversity and computational sciences.</text>
					</subparagraph></paragraph></subsection><subsection id="HEFBBB9F5542B47F8835DB059AD164100"><enum>(d)</enum><header>Leadership</header><text>The
			 head of the center shall be appointed by the Secretary, in consultation with
			 the program director of the National Biological Information
			 Infrastructure.</text>
			</subsection><subsection id="H71FF932F6CBD46A3BDFA3500F162D3C"><enum>(e)</enum><header>Duties of the
			 national biological data center</header><text display-inline="yes-display-inline">The duties of the center shall be
			 determined by the Secretary and shall include, at a minimum, the following
			 activities:</text>
				<paragraph id="H98DD1ED138A1466789C92049920061C3"><enum>(1)</enum><text display-inline="yes-display-inline">Collect nonhuman biological data from
			 Federal, public, private, and nonprofit entities, including—</text>
					<subparagraph id="H39AD76364372453488BA1D0900C3F804"><enum>(A)</enum><text>the National
			 Biological Information Infrastructure; and</text>
					</subparagraph><subparagraph id="H77710F40E8504FDDA9B05CF86C11C04F"><enum>(B)</enum><text>institutions and
			 organizations that partner with the National Biological Information
			 Infrastructure.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H9CEF3B14E45A4AE397B3AF9F23D5934"><enum>(2)</enum><text display-inline="yes-display-inline">Develop partnerships with public and
			 private entities that are nationally recognized for computational capabilities
			 and computer capacity to allow the center to efficiently develop a digital
			 network for the storage and retrieval of data collected under
			 <internal-xref idref="H98DD1ED138A1466789C92049920061C3" legis-path="1.(d)(1)">paragraph (1)</internal-xref>.</text>
				</paragraph><paragraph display-inline="no-display-inline" id="H3155D280FF4140BAAAD917877035A9C6"><enum>(3)</enum><text>Develop
			 partnerships with academic and scientific institutions in the United States to
			 increase the quantity of data—</text>
					<subparagraph id="H15FB8AB115EC4D2B827D4273D3C9543D"><enum>(A)</enum><text>collected under
			 <internal-xref idref="H98DD1ED138A1466789C92049920061C3" legis-path="1.(d)(1)">paragraph (1)</internal-xref>; and</text>
					</subparagraph><subparagraph id="H44051B724EF14A4C906ECCD5DC5406C"><enum>(B)</enum><text>made available for
			 public use under
			 <internal-xref idref="H7A29026FEE6D42029C72283C6F863B2C" legis-path="1.(c)(2)">paragraph (4)</internal-xref>.</text>
					</subparagraph></paragraph><paragraph id="H5209BA1DFAB1490EB4622B2173EBCCCA"><enum>(4)</enum><text display-inline="yes-display-inline">Subject to Federal statutes and regulations
			 relating to the disclosure of information collected under
			 <internal-xref idref="H98DD1ED138A1466789C92049920061C3" legis-path="1.(d)(1)">paragraph (1)</internal-xref>, including statutes and
			 regulations related to intellectual property and <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United
			 States Code, make available for use by Federal, State, and local governments
			 and members of the public any federally funded data collected under
			 <internal-xref idref="H3E1FE37A79F64FFF9DEC3409BD57B8EA" legis-path="1.(c)(1)">paragraph (1).</internal-xref></text>
				</paragraph><paragraph id="H47F281B6D40444A793FA54DB6183EA11"><enum>(5)</enum><text display-inline="yes-display-inline">Make the data described in
			 <internal-xref idref="H5209BA1DFAB1490EB4622B2173EBCCCA" legis-path="1.(d)(4)">paragraph (4)</internal-xref> available—</text>
					<subparagraph id="H4337811AB27F4F158B52189FF011DEE8"><enum>(A)</enum><text>through a single
			 electronic search function; or</text>
					</subparagraph><subparagraph id="H9EA9ECE60F054954B6D57BBF00B7A097"><enum>(B)</enum><text>in any case in
			 which such data is not electronically maintained, at a one location.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H7EB3F2D377D2470F967D63CBDCFD200"><enum>(6)</enum><text>Organize and manage
			 data collected under
			 <internal-xref idref="H3E1FE37A79F64FFF9DEC3409BD57B8EA" legis-path="1.(c)(1)">paragraph (1)</internal-xref> in a manner that—</text>
					<subparagraph id="H3D80CDFCD72842E3B99EDE4FB1C784F1"><enum>(A)</enum><text>enables efficient
			 and effective use of the data by the public;</text>
					</subparagraph><subparagraph commented="no" id="HF8B68E0FF88F4AF1B3E430B216A1684B"><enum>(B)</enum><text>presents the data
			 in an objective manner; and</text>
					</subparagraph><subparagraph id="H59558CAF3FC94E9BAB48CC8BCC84CEA"><enum>(C)</enum><text display-inline="yes-display-inline">is consistent with efforts made by the
			 National Biological Information Infrastructure to organize and manage nonhuman
			 biological data for public use.</text>
					</subparagraph></paragraph><paragraph id="H4B12CE3048304EE4A169A6E4C3A3C542"><enum>(7)</enum><text>Prepare
			 compilations that combine data from multiple data sets to improve the ease of
			 use of such data sets by Federal, State, and local governments and by members
			 of the public.</text>
				</paragraph><paragraph id="H55FD8CC768D945168418B8CB32C4AEF"><enum>(8)</enum><text display-inline="yes-display-inline">Conduct public awareness activities that
			 promote the use of the data made available under
			 <internal-xref idref="H5209BA1DFAB1490EB4622B2173EBCCCA" legis-path="1.(d)(4)">paragraph (4)</internal-xref> for purposes of
			 encouraging—</text>
					<subparagraph display-inline="no-display-inline" id="HE1C1512114F74DFD99875EDFF400D298"><enum>(A)</enum><text>economic
			 development;</text>
					</subparagraph><subparagraph id="H3B989355CD944BF190E99B904E10C555"><enum>(B)</enum><text>the development of
			 public policy (including policy relating to land use, economic development,
			 conservation, and preservation);</text>
					</subparagraph><subparagraph id="H8D4279224A32498CB141F3FA64EE451D"><enum>(C)</enum><text>scientific
			 research; and</text>
					</subparagraph><subparagraph id="H117A0CBE47544F46A2CCEFD32BFFF779"><enum>(D)</enum><text>science,
			 technology, engineering, and mathematics education.</text>
					</subparagraph></paragraph><paragraph id="H416FDDD30B7E4E6F96719D35AADABAF"><enum>(9)</enum><text display-inline="yes-display-inline">Hold an annual conference on nonhuman
			 biological data collection for experts from Federal, State, and local
			 governments and public and private entities for the purpose of providing advice
			 to the head of the center related to improving the performance of the
			 center.</text>
				</paragraph><paragraph id="HE2901DAC2DA14B269618392DEEB523E5"><enum>(10)</enum><text>Collect fees from
			 State and local governments and members of the public for the use of—</text>
					<subparagraph id="H21CCCD542AEC4D2D9FD1C4EE3B65027"><enum>(A)</enum><text>compilations
			 prepared under
			 <internal-xref idref="H4B12CE3048304EE4A169A6E4C3A3C542" legis-path="1.(d)(7)">paragraph (7)</internal-xref>; and</text>
					</subparagraph><subparagraph commented="no" id="HC54B8EAFE8404367B2599E7347E76F56"><enum>(B)</enum><text>other products
			 produced by the center, except that the center may not collect a fee solely for
			 accessing data collected by the center from another source.</text>
					</subparagraph></paragraph></subsection><subsection id="HD7AABB00C2E04AA192264C005D2BC840"><enum>(f)</enum><header>Duties of other
			 entities</header>
				<paragraph id="HC09BA0ED700E4324A318F6C47210C3CB"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to Federal
			 statutes and regulations relating to the disclosure of information collected
			 under
			 <internal-xref idref="H98DD1ED138A1466789C92049920061C3" legis-path="1.(d)(1)">subsection (d)(1)</internal-xref>, including statutes and
			 regulations related to intellectual property and <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United
			 States Code, any entity that collects or stores federally funded data on or
			 after the end of the one-year period beginning on the date of enactment of this
			 Act shall submit or make available such data to the center, in a form and
			 manner described in standards published by the center, unless such data has
			 been submitted to the National Biological Information Infrastructure.</text>
				</paragraph><paragraph commented="no" id="H58C4EECFB6464C1784AF376155BF977F"><enum>(2)</enum><header>National
			 Biological Information Infrastructure</header><text display-inline="yes-display-inline">Subject to Federal statutes and regulations
			 relating to the disclosure of information collected under
			 <internal-xref idref="H98DD1ED138A1466789C92049920061C3" legis-path="1.(d)(1)">subsection (d)(1)</internal-xref>, including statutes and
			 regulations related to intellectual property and <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United
			 States Code, the National Biological Information Infrastructure shall submit or
			 make available to the center, in a form and manner described in standards
			 published by the center, all federally funded data that it stores or receives.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HCF7E9371A7D84582AE00C324A58C5920"><enum>(g)</enum><header>Availability of
			 fees</header><text>Subject to appropriation, fees collected under
			 <internal-xref idref="HE2901DAC2DA14B269618392DEEB523E5" legis-path="1.(d)(10)">subsection (d)(10)</internal-xref> shall remain
			 available for use by the center for activities under
			 <internal-xref idref="H71FF932F6CBD46A3BDFA3500F162D3C" legis-path="1.(d)">subsection (d)</internal-xref>.</text>
			</subsection><subsection id="H3FF8E6BB2D2D478A91649D07B69E90F9"><enum>(h)</enum><header>
			 Reports</header>
				<paragraph id="H5B138D570CD54A9BB2B5852F00B09CD1"><enum>(1)</enum><header>Annual Report to
			 Secretary</header><text>Not later than January 1 of each year following the
			 date of enactment of this Act, the head of the center shall submit to the
			 Secretary of the Interior an annual report containing—</text>
					<subparagraph id="HD36037BBB1BE4EA98C0307C792005C54"><enum>(A)</enum><text>information on the
			 activities of the center during the preceding fiscal year and the plans of the
			 center for activities in the current fiscal year; and</text>
					</subparagraph><subparagraph id="HCB46620B8125490D8F73C8C38C4D1213"><enum>(B)</enum><text>such additional
			 information as the Secretary may require.</text>
					</subparagraph></paragraph><paragraph id="H19B9713309484C1484D722622D2D6DC1"><enum>(2)</enum><header>Annual Report to
			 Congress</header><text>Not later than April 1 of each year following the date
			 of enactment of this Act, the Secretary of the Interior shall submit to
			 Congress an annual report on—</text>
					<subparagraph id="HC9910B5E22514275A0246670C0D405DA"><enum>(A)</enum><text display-inline="yes-display-inline">information on the activities of the center
			 during the preceding fiscal year and the plans of the center for activities in
			 the current fiscal year; and</text>
					</subparagraph><subparagraph id="HE5FAEE1993EB420DBCEE4E5C75B61652"><enum>(B)</enum><text>the administration
			 of the contract entered into under
			 <internal-xref idref="H531121DF3FCC449196C551704F2D68A8" legis-path="1.(a)">subsection (a).</internal-xref></text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H628FD5F9554740AE94FD30918E1DA0AD"><enum>(i)</enum><header>Federally funded
			 data defined</header><text>For purposes of this Act, the term
			 <term>federally-funded data</term> means nonhuman biological data that is
			 collected, maintained, or stored, in whole or in part, through the use of
			 Federal funds.</text>
			</subsection><subsection id="H54919A548119477DA0277DD701392F9B"><enum>(j)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $8,000,000 per fiscal year. Amounts appropriated under this
			 subsection shall remain available until expended.</text>
