			 BUTTE NATIONAL CONSERVATION AREA</header>
			<section id="H2387F5EA36B943A6A28C00DA5C03C246"><enum>101.</enum><header>Establishment
			 of Gold Butte National Conservation Area</header>
				<subsection id="H779372A2FA1D4A7CA23C2BF7B9E3D1DC"><enum>(a)</enum><header>Establishment</header><text>There
			 is established the Gold Butte National Conservation Area in the State of Nevada
			 (in this title referred to as the <quote>conservation area</quote>).</text>
				</subsection><subsection id="H33D267A45174464D8D2CA523EAA71CC"><enum>(b)</enum><header>Area
			 included</header><text display-inline="yes-display-inline">The conservation
			 area shall consist of approximately 362,177 acres of public land administered
			 by the Bureau of Land Management in Clark County, Nevada, as generally depicted
			 on the map entitled <quote>Gold Butte National Conservation Area</quote> and
			 dated September 26, 2008.</text>
				</subsection><subsection display-inline="no-display-inline" id="H4CAD2839335A40E7B2C3393CFB189F4F"><enum>(c)</enum><header>National
			 landscape conservation system</header><text>The conservation area shall be
			 administered as a component of the National Landscape Conservation
			 System.</text>
				</subsection><subsection id="HB5B16EC0D33A49D792403FA9AFE837FC"><enum>(d)</enum><header>Map and legal
			 description</header>
					<paragraph id="H2629B5AD8FF04F6D0089261E9ECC5579"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of enactment of this Act, the Secretary of the
			 Interior shall file a map and legal description of the conservation area with
			 the Committee on Natural Resources of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate..</text>
					</paragraph><paragraph id="H2393D035FB494CDEAA62C0D7241148E0"><enum>(2)</enum><header>Effect</header><text>The
			 map and legal description prepared under paragraph (1) shall have the same
			 force and effect as if included in this title, except that the Secretary may
			 correct minor errors in the map or legal description.</text>
					</paragraph><paragraph id="H4607F708AF034CF3AFA9B2F15FF43214"><enum>(3)</enum><header>Public
			 availability</header><text>A copy of the map and legal description shall be on
			 file and available for public inspection in the appropriate office of the
			 Bureau of Land Management.</text>
					</paragraph></subsection></section><section id="H217056793DC440A3B82F2000B1B713C8"><enum>102.</enum><header>Management of
			 conservation area</header>
				<subsection id="HA641462296F84397B535C30202BA4764"><enum>(a)</enum><header>General
			 management purposes</header><text display-inline="yes-display-inline">In
			 accordance with this title, the Federal Land Policy and Management Act of 1976
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>), and other applicable laws, the Secretary of the
			 Interior shall manage the conservation area in a manner that conserves,
			 protects, and enhances the resources of the conservation area.</text>
				</subsection><subsection id="H9FC48C87CC8149E9BC52FF5DFF87BF53"><enum>(b)</enum><header>Management
			 plan</header>
					<paragraph id="H05D59AF78C93475EB461AF06E6A2D184"><enum>(1)</enum><header>Plan
			 required</header><text>Not later than three years after the date of the
			 enactment of this Act, the Secretary of the Interior shall develop a management
			 plan for the long-term protection and management of the conservation
			 area.</text>
					</paragraph><paragraph id="H038A9727ADC14E1F9F7D4F271EF39225"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary shall prepare the management
			 plan in consultation with the State of Nevada, local and tribal government
			 entities, and the public.</text>
					</paragraph><paragraph id="H35B0DB75E6924CCF8949F7D53917217C"><enum>(3)</enum><header>Requirements</header><text>The
			 management plan shall describe the appropriate uses and management of the
			 conservation area and include a recommendation on interpretive and educational
			 materials regarding the cultural and biological resources of the region within
			 which the conservation area is located.</text>
					</paragraph></subsection><subsection id="H3AF4BC754E1A479B88F9F600182D09D9"><enum>(c)</enum><header>Uses</header><text display-inline="yes-display-inline">The Secretary of the Interior shall allow
			 only such uses of the conservation area that the Secretary determines will
			 further the purpose of the conservation area described in subsection
			 (a).</text>
				</subsection><subsection id="H5F3743DAC3674D7EB426D699B345CBF3"><enum>(d)</enum><header>Incorporation of
			 acquired lands and interests</header><text>Any land or interests in land
			 located within the boundary of the conservation area that is acquired by the
			 United States after the date of the enactment of this Act shall become part of
			 the conservation area and be managed as provided in subsection (a).</text>
				</subsection><subsection id="HCF27785B4A3F4825B3DFA67F4D23CE0"><enum>(e)</enum><header>Motorized
			 vehicles</header>
					<paragraph id="H144B15D7FB3045A788D0347E104B37A7"><enum>(1)</enum><header>Use pending
			 management plan</header><text display-inline="yes-display-inline">Before the
			 effective date of the management plan required by subsection (b), the use of
			 motorized vehicles in the conservation area shall be consistent with the Route
			 Designations for Selected Areas of Critical Environmental Concern Located in
			 the Northeast Portion of the Las Vegas BLM District Environmental Assessment,
			 NV–052–2006–433.</text>
					</paragraph><paragraph id="HEFA65C6CAE654169BEE3CCAEAF4D2EC3"><enum>(2)</enum><header>Use under
			 management plan</header>
						<subparagraph id="HFAEC85D946CB42509315602F6BBBD2"><enum>(A)</enum><header>Authorized
			 uses</header><text display-inline="yes-display-inline">On and after the
			 effective date of the management plan under subsection (b), the use of
			 motorized vehicles in the conservation area shall be allowed only—</text>
							<clause id="H7F8B1F0BA8304724BA2102FC7ED6B2DC"><enum>(i)</enum><text>on
			 roads and trails designated for use of motor vehicles in the management plan;
			 and</text>
							</clause><clause id="HDA6CFF5313C6424BA35057DF19195E62"><enum>(ii)</enum><text display-inline="yes-display-inline">for installing, repairing, maintaining, and
			 reconstructing water development projects, including guzzlers, that would
			 enhance the conservation area by promoting healthy, viable, and more naturally
			 distributed wildlife populations, subject to limitations specified in the
			 management plan that are not more restrictive than the limitations on such uses
			 authorized in wilderness areas designated under title II.</text>
							</clause></subparagraph><subparagraph id="H820803DF36B742D5B67EFA83C767D006"><enum>(B)</enum><header>Minimizing
			 visual impacts</header><text>The management plan shall include or provide
			 recommendations on ways of minimizing the visual impacts of activities
			 authorized pursuant to subparagraph (A)(ii) on the conservation area.</text>
						</subparagraph></paragraph><paragraph id="H3763696C5AEA45009C8346B9B704DA8D"><enum>(3)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Notwithstanding paragraphs (1) and (2), the
			 Secretary may authorize the use of motorized vehicles in the conservation area
			 for administrative purposes or to respond to an emergency.</text>
					</paragraph></subsection><subsection id="HE81FEE26C292420A9300A02F24B6C612"><enum>(f)</enum><header>Roads</header><text>New
			 roads shall not be built within the conservation area unless the roads are
			 needed for public safety or natural resource protection.</text>
				</subsection><subsection id="HEDD71A48F9D246CE997F373ED1B9FA32"><enum>(g)</enum><header>Hunting,
			 fishing, and trapping</header>
					<paragraph id="H02EA1960EBA04DB6B93FDB0048EF98C7"><enum>(1)</enum><header>State
			 jurisdiction</header><text>Nothing in this title affects the jurisdiction of
			 the State of Nevada with respect to fish and wildlife, including hunting,
			 fishing, and trapping in the conservation area.</text>
					</paragraph><paragraph id="H8D12862DB1BA41E30093A0CB7D774694"><enum>(2)</enum><header>Limitations</header>
						<subparagraph id="H24D320CFE7D94BB3A4423698DADBD927"><enum>(A)</enum><header>Regulations</header><text>The
			 Secretary of the Interior may designate, by regulation, areas in which, and
			 establish periods during which, for reasons of public safety, administration,
			 or compliance with applicable laws, no hunting, fishing, or trapping will be
			 permitted in the conservation area.</text>
						</subparagraph><subparagraph id="H114D758067AC451C8E13BB28972993E6"><enum>(B)</enum><header>Consultation</header><text>Except
			 in emergencies, the Secretary shall consult with the appropriate State agency
			 before promulgating regulations under subparagraph (A) that close a portion of
			 the conservation area to hunting, fishing, or trapping.</text>
						</subparagraph></paragraph></subsection></section><section id="H95A292DD35FF4145A5FAEB64E1ADE8D"><enum>103.</enum><header>General
			 provisions</header>
				<subsection id="H9054A70E9AFA4AABBE04F1C8533CFA29"><enum>(a)</enum><header>No buffer
			 zones</header>
					<paragraph id="HF9F580C797B542D685BBF871A7EFB2B9"><enum>(1)</enum><header>In
			 general</header><text>The establishment of the conservation area shall not
			 create an express or implied protective perimeter or buffer zone around the
			 conservation area.</text>
					</paragraph><paragraph id="HE1101CC7403E4616B7A82D6155ED00A3"><enum>(2)</enum><header>Private
			 land</header><text>If the use of, or conduct of an activity on, private land
			 that shares a boundary with the conservation area is consistent with applicable
			 law, nothing in this title concerning the establishment of the conservation
			 area prohibits or limits the use or conduct of the activity.</text>
					</paragraph></subsection><subsection id="H7681026055C24437B1A1E986AFB62B2B"><enum>(b)</enum><header>Withdrawals</header><text>Subject
			 to valid existing rights, all public land within the conservation area,
			 including any land or interest in land that is acquired by the United States
			 within the conservation area after the date of the enactment of this Act, are
			 withdrawn from—</text>
					<paragraph id="H2FC7EDE4442C471EA7C51EEEC6018D7D"><enum>(1)</enum><text>entry,
			 appropriation or disposal under the public land laws;</text>
					</paragraph><paragraph id="HD3E5197949CE400B8FF702F1D012460"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</paragraph><paragraph id="H72CBD5192D784BAF888678E043553FDB"><enum>(3)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
					</paragraph></subsection><subsection id="H7A274421B1DC4440A7F73544FA2FEFCF"><enum>(c)</enum><header>Special
			 management areas</header>
					<paragraph id="H8C6A5302956E48018092F6FE5D901B8"><enum>(1)</enum><header>In
			 general</header><text>The establishment of the conservation area shall not
			 change the management status of any area within the boundary of the
			 conservation area that is protected under the Clark County Multi-Species
			 Habitat Conservation Plan.</text>
					</paragraph><paragraph id="H72913756609C49A89300D5B0AB09DB92"><enum>(2)</enum><header>Effect of
			 conflict</header><text>If there is a conflict between the laws applicable to
			 the areas described in paragraph (1) and this title, the more restrictive
			 provision shall control.</text>
					</paragraph></subsection></section><section id="HAFD4AFF1283D4CE99B967476BD38239"><enum>104.</enum><header>Gold Butte
			 National Conservation Area Advisory Council</header>
				<subsection id="H58932369FCA342BA9F947F59CF5CEF2B"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary of
			 the Interior shall establish an advisory council, to be known as the
			 <quote>Gold Butte National Conservation Area Advisory Council</quote>.</text>
				</subsection><subsection id="HC81BC6ED4486428091235ED1FD35FC58"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The Council shall advise the Secretary with
			 respect to the preparation and implementation of the management plan for the
			 long-term protection and management of the conservation area required by
			 section 102(b).</text>
				</subsection><subsection id="HB99B87E00A1B4556A07D406F47E0D606"><enum>(c)</enum><header>Applicable
			 law</header><text>The Council shall be subject to—</text>
					<paragraph id="H7BD24A97008E4191B679E83420EC6E8D"><enum>(1)</enum><text>the Federal
			 Advisory Committee Act (5 U.S.C. App.); and</text>
					</paragraph><paragraph id="HDA3019D65A004DECA017EB00B0DFBD74"><enum>(2)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>).</text>
					</paragraph></subsection><subsection id="HC4A63B7C07474B6A848DCA2C3E000434"><enum>(d)</enum><header>Members</header>
					<paragraph id="H75832F6EA74748BBA7EBD7C23FA7E42"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Council shall
			 include 10 members to be appointed by the Secretary, of whom, to the extent
			 practicable—</text>
						<subparagraph id="H005BE6FF825B44388F82E9ED403ED2BF"><enum>(A)</enum><text>one member shall
			 be appointed after considering the recommendations of the Mesquite, Nevada,
			 City Council;</text>
						</subparagraph><subparagraph id="HEBE6AF9B8518408FA83825B2EF88C0EF"><enum>(B)</enum><text display-inline="yes-display-inline">one member shall be appointed after
			 considering the recommendations of the Bunkerville, Nevada, Town Advisory
			 Board;</text>
						</subparagraph><subparagraph id="HDDC1431EF5764E3F8E03799516BF46F4"><enum>(C)</enum><text display-inline="yes-display-inline">one member shall be appointed after
			 considering the recommendations of the Moapa, Nevada, Town Advisory
			 Board;</text>
						</subparagraph><subparagraph id="H568D6145BC904E57992406B92C8D3EB8"><enum>(D)</enum><text display-inline="yes-display-inline">one member shall be appointed after
			 considering the recommendations of the Logandale, Nevada, Town Advisory
			 Board;</text>
						</subparagraph><subparagraph id="H478071642B9146FA00E8A57500463933"><enum>(E)</enum><text display-inline="yes-display-inline">one member shall be appointed after
			 considering the recommendations of the Overton, Nevada, Town Advisory
			 Board;</text>
						</subparagraph><subparagraph id="HCF3A10D5CB4F4181A11296F643CEBD04"><enum>(F)</enum><text display-inline="yes-display-inline">one member shall be appointed after
			 considering the recommendations of the Moapa Band of Paiutes Tribal Council;
			 and</text>
						</subparagraph><subparagraph id="H93426B2906DB4DCEADF4F0D37D00DC5B"><enum>(G)</enum><text>four
			 at-large members from Clark County, Nevada, shall be appointed after
			 considering the recommendations of the County Commission for Clark
			 County.</text>
						</subparagraph></paragraph><paragraph id="HE9C8CCDBA2EB4C45A10028D916A146B9"><enum>(2)</enum><header>Special
			 appointment considerations</header><text>The at-large members appointed under
			 paragraph (1)(G) must have backgrounds that reflect—</text>
						<subparagraph id="H3AC651976686489CADD14900B86228FC"><enum>(A)</enum><text>the purposes for
			 which the conservation area was established; and</text>
						</subparagraph><subparagraph id="HFA10C5DC65F4408F86E2412F1C8D81"><enum>(B)</enum><text>the interests of
			 persons affected by the planning and management of the conservation
			 area.</text>
						</subparagraph></paragraph><paragraph id="HC8E7A4CBDC6347E1A4B5D388096F5583"><enum>(3)</enum><header>Representation</header><text>The
			 Secretary shall ensure that the membership of the Council is fairly balanced in
			 terms of the points of view represented and the functions to be performed by
			 the Council.</text>
					</paragraph></subsection><subsection id="H5376B2F848424096B5BA51A99D725D8D"><enum>(e)</enum><header>Termination</header><text>The
			 Council shall terminate not later than one year after the date on which the
			 management plan for the conservation area is adopted by the Secretary of the
			 Interior.</text>
				</subsection></section></title><title id="H6CE66E182BBD47CBA129C7618EC321D8"><enum>II</enum><header>DESIGNATION OF
			 WILDERNESS AREAS IN CLARK COUNTY, NEVADA</header>
			<section id="HD9D6B90263F341F1AAF219EE8EE9D8AA"><enum>201.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that certain public land
			 administered by the Bureau of Land Management in Clark County, Nevada, contains
			 unique and spectacular natural, cultural, and archeological resources,
			 including—</text>
				<paragraph id="HE8A5A727637045C08D846215E9AF5587"><enum>(1)</enum><text>priceless habitat
			 for numerous species of plants and wildlife;</text>
				</paragraph><paragraph id="H5B50B3A0857A4E4D874058D8A846B774"><enum>(2)</enum><text>thousands of acres
			 of pristine land that remain in a natural state; and</text>
				</paragraph><paragraph id="HA082C200E9F541A3AA67872DED2720E7"><enum>(3)</enum><text>numerous sites
			 containing significant archeological artifacts.</text>
				</paragraph></section><section id="HC4B6FC9F5D634AEB926E9785E3CC826"><enum>202.</enum><header>Additions to
			 National Wilderness Preservation System</header>
				<subsection id="H8CC5BF8BA7144A0CAF00A8CD923B9B34"><enum>(a)</enum><header>Designation of
			 wilderness</header><text display-inline="yes-display-inline">In furtherance of
			 the purposes of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the following
			 public lands administered by the National Park Service or the Bureau of Land
			 Management in Clark County, Nevada, are designated as wilderness and as either
			 a new component of the National Wilderness Preservation System or, in the case
			 of the designation made by paragraph (13), an addition to an existing component
			 of the National Wilderness Preservation System:</text>
					<paragraph id="H69DBFD5216DF4472A1D8B925F7D14657"><enum>(1)</enum><header>Virgin Peak
			 wilderness</header><text display-inline="yes-display-inline">Certain Federal
			 land managed by the Bureau of Land Management, comprising approximately 21,681
			 acres, as generally depicted on the map entitled <quote>Gold Butte National
			 Conservation Area</quote> and dated September 26, 2008, which shall be known as
			 the <quote>Virgin Peak Wilderness</quote>.</text>
					</paragraph><paragraph id="H39C8596035FA44C6B949169186AC105D"><enum>(2)</enum><header>Black Ridge
			 wilderness</header><text display-inline="yes-display-inline">Certain Federal
			 land managed by the Bureau of Land Management, comprising approximately 17,303

					</paragraph><paragraph id="H6ACD64CDB6D9451200A15E69003B6397"><enum>(3)</enum><header>Bitter Ridge
			 North wilderness</header><text display-inline="yes-display-inline">Certain
			 Federal land managed by the Bureau of Land Management comprising approximately
			 15,016 acres, as generally depicted on the map entitled <quote>Gold Butte
			 National Conservation Area</quote> and dated September 26, 2008, which shall be
			 known as the <quote>Bitter Ridge North Wilderness</quote>.</text>
					</paragraph><paragraph id="H15321C252EB4426897E6AB8CA0213FE6"><enum>(4)</enum><header>Bitter Ridge
			 South wilderness</header><text display-inline="yes-display-inline">Certain
			 Federal land managed by the Bureau of Land Management, comprising approximately
			 10,202 acres, as generally depicted on the map entitled <quote>Gold Butte
			 National Conservation Area</quote> and dated September 26, 2008, which shall be
			 known as the <quote>Bitter Ridge Wilderness</quote>.</text>
					</paragraph><paragraph id="HD374211A7EF9409C83F2A29757FE81D"><enum>(5)</enum><header>Billy Goat Peak
			 wilderness</header><text display-inline="yes-display-inline">Certain Federal
			 land managed by the Bureau of Land Management, comprising approximately 29,949
			 acres, as generally depicted on the map entitled <quote>Gold Butte National
			 Conservation Area</quote> and dated September 26, 2008, which shall be known as
			 the <quote>Billy Goat Peak Wilderness</quote>.</text>
					</paragraph><paragraph id="HA433AEA6803B400FBB4582B6C0FD9D16"><enum>(6)</enum><header>Million Hills
			 wilderness</header><text display-inline="yes-display-inline">Certain Federal
			 land managed by the Bureau of Land Management, comprising approximately 24,840
			 acres, as generally depicted on the map entitled <quote>Gold Butte National
			 Conservation Area</quote> and dated September 26, 2008, which shall be known as
			 the <quote>Million Hills Wilderness</quote>.</text>
					</paragraph><paragraph id="H367E0B463DB2430AAAA6B04617E4AAD4"><enum>(7)</enum><header>Overton
			 wilderness</header><text display-inline="yes-display-inline">Certain Federal
			 land within the Lake Mead National Recreation Area, comprising approximately
			 23,227 acres, as generally depicted on the map entitled <quote>Gold Butte
			 National Conservation Area</quote> and dated September 26, 2008, which shall be
			 known as the <quote>Overton Wilderness</quote>.</text>
					</paragraph><paragraph id="H9EB32E78C358492EAEDC9D60BE9C6967"><enum>(8)</enum><header>Twin Springs
			 wilderness</header><text display-inline="yes-display-inline">Certain Federal
			 land within the Lake Mead National Recreation Area, comprising approximately
			 9,684 acres, as generally depicted on the map entitled <quote>Gold Butte
			 National Conservation Area</quote> and dated September 26, 2008, which shall be
			 known as the <quote>Twin Springs Wilderness</quote>.</text>
					</paragraph><paragraph id="H789F3FB85B294A1F881E45BE9DD41C8B"><enum>(9)</enum><header>Scanlon Wash
			 wilderness</header><text display-inline="yes-display-inline">Certain Federal
			 land within the Lake Mead National Recreation Area, comprising approximately
			 22,826 acres, as generally depicted on the map entitled <quote>Gold Butte
			 National Conservation Area</quote> and dated September 26, 2008, and which
			 shall be known as the <quote>Scanlon Wash Wilderness</quote>.</text>
					</paragraph><paragraph id="H8519328A80484451AC26E3B7ADEE985C"><enum>(10)</enum><header>Hiller
			 Mountains wilderness</header><text display-inline="yes-display-inline">Certain
			 Federal land within the Lake Mead National Recreation Area, comprising
			 approximately 14,832 acres, as generally depicted on the map entitled
			 <quote>Gold Butte National Conservation Area</quote> and dated September 26,
			 2008, which shall be known as the <quote>Hiller Mountains
			 Wilderness</quote>.</text>
					</paragraph><paragraph id="H0E43B34343284BC0B8A1CB18FB40C8"><enum>(11)</enum><header>Hell’s Kitchen
			 wilderness</header><text display-inline="yes-display-inline">Certain Federal
			 land within the Lake Mead National Recreation Area, comprising approximately
			 12,439 acres, as generally depicted on the map entitled <quote>Gold Butte
			 National Conservation Area</quote> and dated September 26, 2008, which shall be
			 known as the <quote>Hell’s Kitchen Wilderness</quote>.</text>
					</paragraph><paragraph id="HA86E14D13970408A9485F96EE42E6EBE"><enum>(12)</enum><header>Indian hills
			 wilderness</header><text display-inline="yes-display-inline">Certain Federal
			 land within the Lake Mead National Recreation Area, comprising approximately
			 8,955 acres, as generally depicted on the map entitled <quote>Gold Butte
			 National Conservation Area</quote> and dated September 26, 2008, which shall be
			 known as the <quote>Indian Hills Wilderness</quote>.</text>
					</paragraph><paragraph id="HA16B6D2E024A4110AFAD09F189B3CC46"><enum>(13)</enum><header>Lime Canyon
			 wilderness additions</header><text display-inline="yes-display-inline">Certain
			 Federal land managed by the Bureau of Land Management, comprising approximately
			 9,382 acres, as generally depicted on the map entitled <quote>Gold Butte
			 National Conservation Area</quote> and dated September 26, 2008, is
			 incorporated in, and shall be managed as part of the <quote>Lime Canyon
			 Wilderness</quote>.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H614FAFF31D1B4C7690023013CCB9C5CA"><enum>(b)</enum><header>National
			 landscape conservation system</header><text>The wilderness areas administered
			 by the Bureau of Land Management and designated or expanded by subsection (a)
			 shall be administered as components of the National Landscape Conservation
			 System.</text>
				</subsection><subsection id="HE2BDF712007A4238B2E72D3DAD951190"><enum>(c)</enum><header>Road
			 offset</header><text>The boundary of any portion of a wilderness area
			 designated by subsection (a) that is bordered by a road shall be at least 100
			 feet away from the edge of the road so as not to interfere with public
			 access.</text>
				</subsection><subsection id="H434530EE1C2C4B8BADE17C2C66A4A67D"><enum>(d)</enum><header>Lake
			 offset</header><text>The boundary of any portion of a wilderness area
			 designated by subsection (a) that is bordered by Lake Mead or the Colorado
			 River shall be 300 feet inland from the high water line.</text>
				</subsection><subsection id="HEA51919C2DE749FAABB6E8AE33F44000"><enum>(e)</enum><header>Map and legal
			 description</header>
					<paragraph id="H4BF2483EDBB945B4A0AB3336D6E3231"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of the enactment of this Act, the Secretary of the
			 Interior shall file a map and legal description of each wilderness area
			 designated or expanded by subsection (a) with the Committee on Natural
			 Resources of the House of Representatives and the Committee on Energy and
			 Natural Resources of the Senate.</text>
					</paragraph><paragraph id="H11AD3389A1374A83BD2C88B4126F5452"><enum>(2)</enum><header>Effect</header><text>Each
			 map and legal description shall have the same force and effect as if included
			 in this title, except that the Secretary may correct clerical and typographical
			 errors in the map or legal description.</text>
					</paragraph><paragraph id="H1BDF71724F16408BB9B4C459B447ECF9"><enum>(3)</enum><header>Availability</header><text>Each
			 map and legal description shall be on file and available for public inspection
			 in the appropriate offices of the Bureau of Land Management and the National
			 Park Service.</text>
					</paragraph></subsection></section><section id="H7D04DBBF05C349178F8DEDE7003D6F8E"><enum>203.</enum><header>Administration</header>
				<subsection id="H7704CFC75FC74026B4CB76A38D09AF74"><enum>(a)</enum><header>Management</header><text display-inline="yes-display-inline">Subject to valid existing rights, the land
			 designated as wilderness by this title shall be administered by the Secretary
			 of the Interior in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>),
			 except that—</text>
					<paragraph id="HA363EFE5DABF416FA7605E167E56FADC"><enum>(1)</enum><text>any reference in
			 that Act to the effective date of that Act shall be considered to be a
			 reference to the date of the enactment of this Act; and</text>
					</paragraph><paragraph id="HC03FC29EE9814A1B8BEFCC7D84D164C5"><enum>(2)</enum><text>any reference in
			 that Act to the Secretary of Agriculture shall be considered to be a reference
			 to the Secretary of the Interior.</text>
					</paragraph></subsection><subsection id="H2B6911B8F3BF45948608934D99E9C55"><enum>(b)</enum><header>Incorporation of
			 acquired lands and interests</header><text>Any land or interest in land within
			 the boundaries of the land designated as wilderness by this title that is
			 acquired by the United States after the date of the enactment of this Act shall
			 be added to and administered as part of the wilderness area within which the
			 acquired land or interest is located.</text>
				</subsection><subsection id="H3EC188DF0D9948C197CEF4C18E6EAFB0"><enum>(c)</enum><header>Water
			 rights</header>
					<paragraph id="H9E62B320C3D04BC4B23C325DDA82EBB4"><enum>(1)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
						<subparagraph id="H06A646283DC649DB0054BED2264909CC"><enum>(A)</enum><text>The lands
			 designated as wilderness by this title are within the Mojave Desert, are arid
			 in nature, and include ephemeral streams.</text>
						</subparagraph><subparagraph id="H3EF183FEB9D94E72BE6DB05B983E9E6F"><enum>(B)</enum><text>The hydrology of
			 the lands designated as wilderness by this title is locally characterized by
			 complex flow patterns and alluvial fans with impermanent channels.</text>
						</subparagraph><subparagraph id="H882BF68C8E2940C09FD1CA21DD9C3C63"><enum>(C)</enum><text display-inline="yes-display-inline">The subsurface hydrogeology of the region
			 within which the lands designated as wilderness by this title are located is
			 characterized by ground water subject to local and regional flow gradients and
			 artesian aquifers.</text>
						</subparagraph><subparagraph id="H021B57B356AF4DC9AC5FD5C100D075D4"><enum>(D)</enum><text>The lands
			 designated as wilderness by this title are generally not suitable for use or
			 development of new water resource facilities, and there are no actual or
			 proposed water resource facilities and no opportunities for diversion, storage,
			 or other uses of water occurring outside such lands that would adversely affect
			 the wilderness or other values of such lands.</text>
						</subparagraph><subparagraph id="HED246637A2824674A7A6D23046F6C7D0"><enum>(E)</enum><text>Because of the
			 unique nature and hydrology of these desert lands designated as wilderness by
			 this title and the existence of the Clark County Multi-Species Habitat
			 Conservation Plan, it is possible to provide for proper management and
			 protection of the wilderness, perennial springs, and other values of such lands
			 in ways different from the methods used in other laws.</text>
						</subparagraph></paragraph><paragraph id="H9CC5063CBB91477CA9C7A592D9331E10"><enum>(2)</enum><header>Statutory
			 construction</header>
						<subparagraph id="HA63E7FBC61074E82A1C7F877E57E410"><enum>(A)</enum><header>No
			 reservation</header><text>Nothing in this title shall constitute or be
			 construed to constitute either an express or implied reservation by the United
			 States of any water or water rights with respect to the lands designated as
			 wilderness by this title.</text>
						</subparagraph><subparagraph id="H06AD2789F08149C2AB4822FF44E2E300"><enum>(B)</enum><header>State
			 rights</header><text>Nothing in this title shall affect any water rights in the
			 State of Nevada existing on the date of the enactment of this Act, including
			 any water rights held by the United States.</text>
						</subparagraph><subparagraph id="HCD58E0366AE44CF6B24970462B88424D"><enum>(C)</enum><header>No
			 precedent</header><text>Nothing in this subsection shall be construed as
			 establishing a precedent with regard to any future wilderness
			 designations.</text>
						</subparagraph><subparagraph id="H99B8AC8A1C8547DCA4CA7F9F041CC94C"><enum>(D)</enum><header>No effect on
			 compacts</header><text>Nothing in this title shall be construed as limiting,
			 altering, modifying, or amending any of the interstate compacts or equitable
			 apportionment decrees that apportion water among and between the State of
			 Nevada and other States.</text>
						</subparagraph></paragraph><paragraph id="HF2048B1CD31E496DA538CC53E3761B5C"><enum>(3)</enum><header>Nevada water
			 law</header><text>The Secretary of the Interior shall follow the procedural and
			 substantive requirements of the law of the State of Nevada in order to obtain
			 and hold any water rights not in existence on the date of enactment of this Act
			 with respect to the lands designated as wilderness by this title.</text>
					</paragraph><paragraph id="H00771876DE2E41E9BB1162A205DBBC70"><enum>(4)</enum><header>New
			 projects</header>
						<subparagraph id="H6ED160B56CA84ABBA021CEB97427E1C2"><enum>(A)</enum><header>Definition</header><text>In
			 this paragraph, the term <quote>water resource facility</quote> means
			 irrigation and pumping facilities, reservoirs, water conservation works,
			 aqueducts, canals, ditches, pipelines, wells, hydropower projects, and
			 transmission and other ancillary facilities, and other water diversion,
			 storage, and carriage structures. The term does not include wildlife
			 guzzlers.</text>
						</subparagraph><subparagraph id="HA38247D6E0004FAD93FD76392948AB18"><enum>(B)</enum><header>No licenses or
			 permits</header><text>Except as otherwise provided in this title, on and after
			 the date of the enactment of this Act, neither the President nor any other
			 officer, employee, or agent of the United States shall fund, assist, authorize,
			 or issue a license or permit for the development of any new water resource
			 facility within the lands designated as wilderness by this title.</text>
						</subparagraph></paragraph></subsection><subsection id="HE3798F3C107C401A9B7B5BFB17B0F43F"><enum>(d)</enum><header>Withdrawals</header><text>Subject
			 to valid existing rights, all Federal lands within the wilderness areas
			 designated or expanded by this title, including any land or interest in land
			 within the areas that is acquired by the United States after the date of
			 enactment of this Act, are withdrawn from—</text>
					<paragraph id="HC1F0C04FCE774EDFAC28F1C164C600C9"><enum>(1)</enum><text>entry,
			 appropriation or disposal under the public land laws;</text>
					</paragraph><paragraph id="H759F2D9366834D3CACF7B0756C4339BE"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</paragraph><paragraph id="HAA6ABAD5D97C49B591A38823C2ADE8DF"><enum>(3)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
					</paragraph></subsection></section><section id="H0501D6BFA78A419FB7BF229F2C008DF7"><enum>204.</enum><header>Adjacent
			 management</header>
				<subsection id="HB96C01FF3B114DC2BF5CA7DA5F7FC411"><enum>(a)</enum><header>No buffer
			 zones</header><text>Congress does not intend for the designation of land as
			 wilderness by this title to lead to the creation of protective perimeters or
			 buffer zones around any wilderness area designated or expanded by this
			 title.</text>
				</subsection><subsection id="HBA7F44E1907145278506F39E05CE9776"><enum>(b)</enum><header>Nonwilderness
			 activities</header><text>The fact that nonwilderness activities or uses can be
			 seen or heard from areas within a wilderness area designated or expanded by
			 this title shall not preclude the conduct of those activities or uses outside
			 the boundary of the wilderness area.</text>
				</subsection></section><section id="H6587633932CE4B7E9BEAE2F77B9112D7"><enum>205.</enum><header>Native American
			 cultural and religious uses</header><text display-inline="no-display-inline">Nothing in this title shall be construed to
			 diminish the rights of any Indian tribe. Nothing in this title shall be
			 construed to diminish tribal rights regarding access to Federal lands for
			 tribal activities, including spiritual, cultural, and traditional
			 food-gathering activities.</text>
			</section><section id="H6F08C3EE476B4CC1AD45B7A88B7918B8"><enum>206.</enum><header>Wildlife
			 management</header>
				<subsection id="H1DE17CC109AC49B4BA2F107B9469FE1C"><enum>(a)</enum><header>State
			 jurisdiction</header><text>In accordance with section 4(d)(7) of the Wilderness
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this title affects or diminishes the
			 jurisdiction of the State of Nevada with respect to fish and wildlife
			 management, including the regulation of hunting, fishing, and trapping, in the
			 wilderness areas designated or expanded by this title.</text>
				</subsection><subsection id="H1C0A5C0787FF46C19FDB97245FD3A2A3"><enum>(b)</enum><header>Management
			 activities</header><text>In furtherance of the purposes and principles of the
			 Wilderness Act, management activities to maintain or restore fish and wildlife
			 populations and the habitats to support such populations may be carried out
			 within wilderness areas designated or expanded by this title where consistent
			 with relevant wilderness management plans, in accordance with appropriate
			 policies such as those set forth in Appendix B of House Report 101–405,
			 including the occasional and temporary use of motorized vehicles, if such use,
			 as determined by the Secretary of the Interior, would promote healthy, viable,
			 and more naturally distributed wildlife populations that would enhance
			 wilderness values and accomplish those purposes with the minimum impact
			 necessary to reasonably accomplish the task.</text>
				</subsection><subsection id="H54FB174C0C0747FA85CD7C8CA6828568"><enum>(c)</enum><header>Existing
			 activities</header><text>Consistent with section 4(d)(1) of the Wilderness Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)</external-xref>) and in accordance with appropriate policies such as those
			 set forth in Appendix B of House Report 101–405, the State of Nevada may
			 continue to use aircraft, including helicopters, to survey, capture,
			 transplant, monitor, and provide water for wildlife populations, including
			 bighorn sheep, and feral stock, horses, and burros.</text>
				</subsection><subsection id="HA9E4959DD21C4354A535C351009B05F3"><enum>(d)</enum><header>Wildlife water
			 development projects</header><text>Subject to subsection (f), the Secretary of
			 the Interior shall authorize structures and facilities, including existing
			 structures and facilities, for wildlife water development projects, including
			 guzzlers, in the wilderness areas designated or expanded by this title
			 if—</text>
					<paragraph id="H51F97677228844B2B96FD51362CAAEC1"><enum>(1)</enum><text>the structures and
			 facilities will, as determined by the Secretary, enhance wilderness values by
			 promoting healthy, viable and more naturally distributed wildlife populations;
			 and</text>
					</paragraph><paragraph id="HC348F50DDC844FB0A0F9007B3776C17"><enum>(2)</enum><text>the visual impacts
			 of the structures and facilities on the wilderness areas can reasonably be
			 minimized.</text>
					</paragraph></subsection><subsection id="H84CC7AC72A3942DE9C07F5C800ACFCF5"><enum>(e)</enum><header>Hunting,
			 fishing, and trapping</header><text display-inline="yes-display-inline">The
			 Secretary of the Interior may designate, by regulation, areas in which, and
			 establish periods during which, for reasons of public safety, administration,
			 or compliance with applicable laws, no hunting, fishing, or trapping will be
			 permitted in the wilderness areas designated or expanded by this title. Except
			 in the case of an emergency, the Secretary shall make such designations in
			 consultation with the appropriate agency of the State of Nevada.</text>
				</subsection><subsection id="H3CE61F4C83FA4084BDB4ABAE9326EF32"><enum>(f)</enum><header>Cooperative
			 agreement</header><text display-inline="yes-display-inline">The State of
			 Nevada, including a designee of the State, may conduct wildlife management
			 activities in the wilderness areas designated or expanded by this title—</text>
					<paragraph id="H3CC60AD8415F4265BE00A793A822D412"><enum>(1)</enum><text>in accordance with
			 the terms and conditions specified in the cooperative agreement between the
			 Secretary of the Interior and the State entitled <quote>Memorandum of
			 Understanding between the Bureau of Land Management and the Nevada Department
			 of Wildlife Supplement No. 9</quote> and signed November and December 2003,
			 including any amendments to the cooperative agreement agreed to by the
			 Secretary and the State; and</text>
					</paragraph><paragraph id="HECCB0422BA4A41C3B938A01393897CD3"><enum>(2)</enum><text>subject to all
			 applicable laws and regulations.</text>
					</paragraph></subsection></section><section id="H9075FFE2294141AA9FC462E355BAE62"><enum>207.</enum><header>Wildfire
			 management</header><text display-inline="no-display-inline">Consistent with
			 section 4 of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133</external-xref>), nothing in this title
			 precludes a Federal, State, or local agency from conducting wildfire management
			 operations (including operations using aircraft or mechanized equipment) to
			 manage wildfires in the wilderness areas designated or expanded by this
			 title.</text>
			</section><section id="H65FF8A5FBB6B421A8E4470B7D632DA4B"><enum>208.</enum><header>Climatological
			 data collection</header><text display-inline="no-display-inline">Subject to
			 such terms and conditions as the Secretary of the Interior may prescribe,
			 nothing in this title precludes the installation and maintenance of hydrologic,
			 meteorologic, or climatological collection devices in the wilderness areas
			 designated or expanded by this title if the facilities and access to the
			 facilities are essential to flood warning, flood control, and water reservoir
			 operation activities.</text>
			</section><section id="HD281BD83434A4178844E7D1D018EA77B"><enum>209.</enum><header>National Park
			 System lands</header><text display-inline="no-display-inline">To the extent any
			 of the provisions of this title are in conflict with laws, regulations, or
			 management policies applicable to Federal land within the Lake Mead National
			 Recreation Area designated as wilderness by this title, those laws,
			 regulations, or policies shall control.</text>
			</section></title><title id="H6CCC4C3AAE8C41568BAA9B71A86D51EF"><enum>III</enum><header>General
			 Provisions</header>
			<section id="H766AE4675A8C4AE299212C9DEFFEFF96"><enum>301.</enum><header>Relationship to
			 Clark County Multi-Species Habitat Conservation Plan</header><text display-inline="no-display-inline">Nothing in this Act shall be construed as
			 limiting, altering, modifying, or amending the Clark County Multi-Species
			 Habitat Conservation Plan with respect to the Gold Butte National Conservation
			 Area established by title I and the lands designated as wilderness by title II,
			 including the specific management actions contained in the Clark County
			 Multi-Species Habitat Conservation Plan for the conservation of perennial
			 springs. However, with respect to the Gold Butte National Conservation Area and
			 the lands designated as wilderness, the Secretary of the Interior shall credit
			 the conservation area and the lands as Conservation Management Areas, as may be
			 required by the Clark County Multi-Species Habitat Conservation Plan or future
			 amendments thereto.</text>
