		<legis-type>A BILL</legis-type>
		<official-title>To amend title XIX of the Social Security Act to require
		  State Medicaid plans to continue to cover non-emergency transportation to
		  medically necessary services.</official-title>

		<section id="HF3FE2459D45946D6BCD09E2C63E1E62F" section-type="section-one"><enum>1.</enum><header>Continuing requirement of
			 Medicaid coverage of non-emergency transportation to medically necessary
			 services</header>
			<subsection display-inline="no-display-inline" id="H085C3A77697C4628B27E99E81232C006"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Section 1902(a)(10) of the Social Security
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is amended—</text>
				<paragraph id="HDEBB8EC4A9BA4DA58645FF46326E6CC7"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>and (21)</quote> and inserting <quote>, (21), and
			 (28)</quote>; and</text>
				</paragraph><paragraph id="H1CE13242E44A4C54B6B83DCD07007643"><enum>(2)</enum><text>in subparagraph
			 (C)(iv), by striking <quote>and (17)</quote> and inserting <quote>, (17), and
			 (28)</quote>.</text>
				</paragraph></subsection><subsection id="H3B76C51E73294B3BB0E6AE6420BD0096"><enum>(b)</enum><header>Description of
			 services</header><text>Section 1905(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395d">42 U.S.C. 1395d(a)</external-xref>) is
			 amended—</text>
				<paragraph id="H40BD078FC2B244F589F21DF28CFDD511"><enum>(1)</enum><text>in paragraph (27),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H5C4CCAA938EE4CF7B5AD782168CE25AA"><enum>(2)</enum><text>by redesignating
			 paragraph (28) as paragraph (29) and by striking the comma at the end and
			 inserting a semicolon; and</text>
				</paragraph><paragraph id="H90869FE670DA4C7EAC3BD37C23F3FDE"><enum>(3)</enum><text>by
			 inserting after paragraph (27) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H8AC7E51246F641249F1CAD9263D4230" style="OLC">
						<paragraph id="H3D26D3AB11B3409C922B55F83950CC00"><enum>(28)</enum><text display-inline="yes-display-inline">non-emergency transportation to medically
				necessary services, consistent with the requirement of section 431.53 of title
				42, Code of Federal Regulations, as in effect as of June 1, 2008;
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0DBFFD6651CA42BBB81B72A52D3C31E9"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of the enactment of this Act and shall apply to transportation on or after
			 such date.</text>
			</subsection><subsection id="H045E199018E54EB2BE1E7622A36B3500"><enum>(d)</enum><header>Suspension of
			 implementation of change in regulation</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services
			 shall not—</text>
				<paragraph id="HFF37E1A24A2841EAB32B3B9C0435BF91"><enum>(1)</enum><text>implement section
			 440.390 of proposed subpart C of part 440 of title 42, Code of Federal
			 Regulations, contained in the proposed rule published on February 22, 2008, on
			 pages 9714 through 9727 of volume 73, Federal Register; and</text>
				</paragraph><paragraph id="H70C9B2D366A948E89D6BE6CEA2D01D97"><enum>(2)</enum><text>promulgate or
			 implement any rule or provision—</text>
					<subparagraph id="HABFF1A6FFCA444BABAC32500003354E2"><enum>(A)</enum><text>similar to such
			 section or in contravention of the amendments made by subsections (a) and (b);
			 or</text>
					</subparagraph><subparagraph id="H8B122B615BDF4EF8BDFEAEE998CA5FE8"><enum>(B)</enum><text>revising the
			 requirement, as in effect as of June 1, 2008, for non-emergency transportation
			 under the Medicaid program.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
