		<official-title>To amend the Elementary and Secondary Education Act of
		  1965 to require States to include certain students with disabilities in the
		  calculation of graduation rates, and to assess limited English proficient
		  students who have been in the United States for 5 or more consecutive
		  years.</official-title>

		<section id="H45BD132277464C39AD491DAE211246DA" section-type="section-one"><enum>1.</enum><header>Inclusion of students with
			 disabilities in calculation of graduation rates</header><text display-inline="no-display-inline">Section 1111(b)(2) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)</external-xref>) is amended by adding at
			 the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H0521A7FA9A1245C483B991B4330752FD" style="OLC">
				<subparagraph id="H7142D285D8B14D8BAFC3D95BDA398407"><enum>(L)</enum><header>Inclusion of
				students with disabilities in calculation of graduation rates</header><text display-inline="yes-display-inline">In carrying out subparagraph (C)(vi), the
				State shall treat as follows students served under the Individuals with
				Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>) who do not graduate with a
				regular diploma in the standard number of years:</text>
					<clause id="HF413769A5EC7416700EC9EDB16EBF5F6"><enum>(i)</enum><text>If
				the student graduates with a regular diploma before attaining 22 years of age,
				the student shall be considered a graduate.</text>
					</clause><clause id="HBA8533185BA64C5B84814EB5CF3DE0DE"><enum>(ii)</enum><text>If the student
				attains 22 years of age without obtaining a regular diploma, but has achieved
				the goals of the student’s individualized education program (as defined in
				section 602 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>)), the student shall be considered a
				graduate.</text>
					</clause><clause id="HF5A87BFED60D4997AE80681DE1478200"><enum>(iii)</enum><text>If the student
				attains 22 years of age, has not obtained a regular diploma, and has not
				achieved the goals of the student’s individualized education program (as
				defined in section 602 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>)), the student shall not be
				considered a
				graduate.</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H8EB688EA5BCC4EFE8BFDD4B70003044"><enum>2.</enum><header>Assessment for
			 limited English Proficient Students</header><text display-inline="no-display-inline">Section 3113(b)(3)(C) of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6823">20 U.S.C. 6823(b)(3)(C)</external-xref>) is amended by
			 striking <quote>3</quote> and inserting <quote>5</quote>.</text>
