<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend the National Organ Transplant Act to provide that criminal penalties do not apply to human organ paired donation, and for other purposes.</official-title>

<section id="H476D5A2430F249CB859FC0E5EDFDB3CF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Charlie W. Norwood Living Organ Donation Act</short-title></quote>.</text></section>
<section id="HC8EB86814E224E9F9942E7D3051F3362"><enum>2.</enum><header>Amendments to the National Organ Transplant Act</header><text display-inline="no-display-inline">Section 301 of the National Organ Transplant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274e">42 U.S.C. 274e</external-xref>) is amended—</text> 
<paragraph id="HDDBD07BABBCC4E2EACCFA2D22C80B4A"><enum>(1)</enum><text>in subsection (a), by adding at the end the following: <quote>The preceding sentence does not apply with respect to human organ paired donation.</quote>; and</text></paragraph>
<paragraph id="H932844E2DE9E4F6EA29CC521E650FA32"><enum>(2)</enum><text>in subsection (c), by adding at the end the following:</text>

<paragraph id="H59606363678E41D8897226B537411500"><enum>(4)</enum><text>The term <term>human organ paired donation</term> means the donation and receipt of human organs under the following circumstances:</text> 
<subparagraph id="H3B7157C2D82248EEBF1962FDE427D15F"><enum>(A)</enum><text>An individual (referred to in this paragraph as the <quote>first donor</quote>) desires to make a living donation of a human organ specifically to a particular patient (referred to in this paragraph as the <quote>first patient</quote>), but such donor is biologically incompatible as a donor for such patient.</text></subparagraph> 
<subparagraph id="H194E4642EEDE47D3BA167CF29B5794A1"><enum>(B)</enum><text>A second individual (referred to in this paragraph as the <quote>second donor</quote>) desires to make a living donation of a human organ specifically to a second particular patient (referred to in this paragraph as the <quote>second patient</quote>), but such donor is biologically incompatible as a donor for such patient.</text></subparagraph> 
<subparagraph id="H0F08E7401B644497A3665DF29F70B7B"><enum>(C)</enum><text>Subject to subparagraph (D), the first donor is biologically compatible as a donor of a human organ for the second patient, and the second donor is biologically compatible as a donor of a human organ for the first patient.</text></subparagraph> 
<subparagraph id="H413E3C787C614A508563CC36193C07BB"><enum>(D)</enum><text>If there is any additional donor-patient pair as described in subparagraph (A) or (B), each donor in the group of donor-patient pairs is biologically compatible as a donor of a human organ for a patient in such group.</text></subparagraph> 
<subparagraph id="HCBD9BB6EA51D4D81BE341EEE1B5C9280"><enum>(E)</enum><text>All donors and patients in the group of donor-patient pairs (whether 2 pairs or more than 2 pairs) enter into a single agreement to donate and receive such human organs, respectively, according to such biological compatibility in the group.</text></subparagraph> 
<subparagraph id="H5F36E74DBEF8457091A97B08F987F665"><enum>(F)</enum><text>Other than as described in subparagraph (E), no valuable consideration is knowingly acquired, received, or otherwise transferred with respect to the human organs referred to in such subparagraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H643D3743F2C84982AD1E1DD4F5D7D1C1"><enum>3.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary of Health and Human Services shall submit to the appropriate committees of Congress a report that details the progress made towards understanding the long-term health effects of living organ donation.</text></section>
<section id="H3ACA93A16D9E444293441ED61200CF14"><enum>4.</enum><header>No impact on Social Security Trust Fund</header><text display-inline="no-display-inline">Nothing in this Act (or an amendment made by this Act) shall be construed to alter or amend the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/301">42 U.S.C. 301 et seq.</external-xref>) (or any regulation promulgated under that Act).</text></section>
