		<legis-type>A BILL</legis-type>
		<official-title>To require, as a condition of participation in the
		  programs under title IV of the Higher Education Act of 1965, public
		  institutions of higher education to charge dependent children of members of the
		  Armed Forces a rate of tuition equal to the rate of tuition charged to in-State
		  residents.</official-title>

		<section id="HFB3F224CB3FE4C38A3352DD76C3EB0A6" section-type="section-one"><enum>1.</enum><header>In-State tuition rate for
			 dependent children of members of the Armed Forces</header>
			<subsection id="HD953CE9B187E4BDA879295001D2B4700"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 487(a) of the Higher Education Act
			 of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HBD0D483109A24108B900F270C271A201" style="OLC">
					<paragraph id="HEB08F1F360C0499CA9D1B67E46CCE8F"><enum>(30)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC74B76F1D19A41FAA287FEB34574B856"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of a public institution of
				higher education, the institution will charge a dependent military child
				tuition at the same rate as the rate of tuition that the institution charges to
				residents of the State in which the institution is located.</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="H7D597B8D78C645A88962E613BC7EC9D3" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For the purposes of this paragraph—</text>
							<clause id="HA29B0E2EE3AC4BE98B21C8163020EAE"><enum>(i)</enum><text>the term <term>dependent military
				child</term> means an individual who—</text>
								<subclause id="H67B67FBFCDDF460AA08500E761A004B0"><enum>(I)</enum><text>is an unmarried child of a member of the
				Armed Forces (including an unmarried dependent stepchild or adopted child);
				and</text>
								</subclause><subclause id="H0AFC879595014CC1B5475C80F9DB7336"><enum>(II)</enum><text>is under 26 years of age at the
				beginning of the first academic year for which the individual is charged
				tuition in accordance with this paragraph; and</text>
								</subclause></clause><clause id="HB7929A5FA4EB4DA8A0DA00713E7E006D"><enum>(ii)</enum><text>the term <term>member of the Armed
				Forces</term>—</text>
								<subclause id="H709D28FEB2BB406EB83B824300F237A2"><enum>(I)</enum><text display-inline="yes-display-inline">includes a member of a reserve component of
				the Armed Forces named in <external-xref legal-doc="usc" parsable-cite="usc/10/10101">section 10101</external-xref> of title 10, United States Code;
				and</text>
								</subclause><subclause id="HCFAD2BDC25AF46F0A00031BEF562E65"><enum>(II)</enum><text display-inline="yes-display-inline">does
				not include a former member of the Armed Forces.</text>
								</subclause></clause></subparagraph><subparagraph id="HAA7B7D9366CF46949077CF45EF443EB6" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Notwithstanding
				<internal-xref idref="HCFAD2BDC25AF46F0A00031BEF562E65" legis-path="(30)(B)(ii)(II)">subparagraph (B)(ii)(II)</internal-xref>, any
				individual who—</text>
							<clause id="H74960FEAD41E4BD6BB72695024AE646C"><enum>(i)</enum><text display-inline="yes-display-inline">is charged tuition as a dependent military
				child in accordance with this paragraph for an academic year; and</text>
							</clause><clause id="H3C357CBA5D9349D3A8E2062DE529C58D"><enum>(ii)</enum><text>in the subsequent year fails to
				meet the requirements of
				<internal-xref idref="HA29B0E2EE3AC4BE98B21C8163020EAE" legis-path="(30)(B)(i)">subparagraph (B)(i)</internal-xref> because the
				individual’s parent who was a member of the Armed Forces has become a former
				member of the Armed Forces,</text>
							</clause><continuation-text continuation-text-level="subparagraph">shall
				continue to be charged tuition as a dependent military child in accordance with
				this paragraph for the period required to complete the program of study in
				which the individual is enrolled (as determined by the institution at which the
				individual is
				enrolled).</continuation-text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA35193DD4A874E559B52DD4C001997BE"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 <internal-xref idref="HD953CE9B187E4BDA879295001D2B4700" legis-path="1.(a)">subsection (a)</internal-xref> shall be effective for
			 academic years beginning after the date of the enactment of this Act.</text>
