		<official-title>To amend <external-xref legal-doc="usc" parsable-cite="usc/17/114">section 114</external-xref> of title 17, United States Code, to
		  provide for agreements for the reproduction and performance of sound recordings
		  by webcasters.</official-title>

		<section id="H0BF5FF7A0D7C4F4E83AA35014EFFBB7E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Webcaster Settlement Act of
			 2008</short-title></quote>.</text>
		</section><section id="H6600FA6E7A8947A0AFB79B72B3BD38AC"><enum>2.</enum><header>Agreements on
			 behalf of webcasters</header><text display-inline="no-display-inline">Section
			 114(f)(5) of title 17, United States Code, is amended—</text>
			<paragraph id="H18FB789CEDC149A69403974337EECB16"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
				<subparagraph id="HF372C5EAC9294C9E8CD1001171A26EB2"><enum>(A)</enum><text>by striking
			 <quote>small commercial</quote> each place it appears and inserting
			 <quote>commercial</quote>;</text>
				</subparagraph><subparagraph id="HE361A5E242D04B358FEC210693A46144"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>during the period
			 beginning on October 28, 1998, and ending on December 31, 2004</quote> and
			 inserting <quote>for a period of not more than 11 years beginning on January 1,
			 2005</quote>;</text>
				</subparagraph><subparagraph id="H72BF9E8B5BE8466F825E2D4142FFF0F6"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>a copyright arbitration
			 royalty panel or decision by the Librarian of Congress</quote> and inserting
			 <quote>the Copyright Royalty Judges</quote>; and</text>
				</subparagraph><subparagraph id="HC9382ED168B54DB6AD304160DD30864E"><enum>(D)</enum><text>in the second
			 sentence, by striking <quote>webcasters shall include</quote> and inserting
			 <quote>webcasters may include</quote>;</text>
				</subparagraph></paragraph><paragraph id="HE086643064E0405A882FA23DE05DF421"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>small commercial</quote> and inserting
			 <quote>commercial</quote>;</text>
			</paragraph><paragraph id="HAD36E00D346A4DF9BFBCCE42B84834"><enum>(3)</enum><text>in
			 subparagraph (C)—</text>
				<subparagraph id="H308A644D750C4059B4D2262637774DC8"><enum>(A)</enum><text>by striking
			 <quote>Librarian of Congress</quote> and inserting <quote>Copyright Royalty
			 Judges</quote>;</text>
				</subparagraph><subparagraph id="H6A317EB92C3248DBAC49C2C523AEE955"><enum>(B)</enum><text>by striking
			 <quote>small webcasters</quote> and inserting <quote>webcasters</quote>;
			 and</text>
				</subparagraph><subparagraph id="H825F9595E6B648E6BC038023D1D946AB"><enum>(C)</enum><text>by adding at the
			 end the following: <quote>This subparagraph shall not apply to the extent that
			 the receiving agent and a webcaster that is party to an agreement entered into
			 pursuant to subparagraph (A) expressly authorize the submission of the
			 agreement in a proceeding under this subsection.</quote>;</text>
				</subparagraph></paragraph><paragraph id="H2B750E4CDDB04D8391F446B7095BE15"><enum>(4)</enum><text>in
			 subparagraph (D)—</text>
				<subparagraph id="HE9B27A0798734C93824C27DFACCBEEA"><enum>(A)</enum><text>by striking
			 <quote>the Small Webcasters Settlement Act of 2002</quote> and inserting
			 <quote>the Webcaster Settlement Act of 2008</quote> ; and</text>
				</subparagraph><subparagraph id="H2B43D33B77224D1A9E9DAD3C885800A"><enum>(B)</enum><text>by striking
			 <quote>Librarian of Congress of July 8, 2002</quote> and inserting
			 <quote>Copyright Royalty Judges of May 1, 2007</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H728AA0E6633B40EC808EE973F5C24801"><enum>(5)</enum><text>in subparagraph
			 (F), by striking <quote>2002</quote> and all that follows through
			 <quote>2003</quote> and inserting <quote>2008</quote>.</text>
