<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend <external-xref legal-doc="usc" parsable-cite="usc/17/114">section 114</external-xref> of title 17, United States Code, to provide for agreements for the reproduction and performance of sound recordings by webcasters.</official-title>

<section id="H422DB36AA9D043D08BD41C502B3F2EF5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Webcaster Settlement Act of 2008</short-title></quote>. </text></section> 
<section id="H5BE784B0010A4D548414FE408EB3B556"><enum>2.</enum><header>Agreements on behalf of webcasters</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/114">Section 114(f)(5)</external-xref> of title 17, United States Code, is amended—</text> 
<paragraph id="H80E40D9C31994C83A6C78068C17D8E94"><enum>(1)</enum><text> in subparagraph (A)—</text> 
<subparagraph id="HCF66AC702F444B5A8616239331A2008F"><enum>(A) </enum><text>by striking <quote>small commercial</quote> each place it appears and inserting <quote>commercial</quote>;</text></subparagraph> 
<subparagraph id="H0A1C111883E747D880375C2BC6077E1B"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>during the period beginning on October 28, 1998, and ending on December 31, 2004</quote> and inserting <quote>for a period of not more than 11 years beginning on January 1, 2005</quote>;</text></subparagraph> 
<subparagraph id="H4624C32A453E4028A0687F09BD72049F"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>a copyright arbitration royalty panel or decision by the Librarian of Congress</quote> and inserting <quote>the Copyright Royalty Judges</quote>; and</text></subparagraph> 
<subparagraph id="HC77425B59CC945EE9D50D38F008456B"><enum>(D)</enum><text>in the second sentence, by striking <quote>webcasters shall include</quote> and inserting <quote>webcasters may include</quote>;</text></subparagraph></paragraph> 
<paragraph id="H946755D17D8B4BA59FAC00BF6246F700"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>small commercial</quote> and inserting <quote>commercial</quote>;</text></paragraph> 
<paragraph id="H2234C89E955348409686BC0069010059"><enum>(3)</enum><text>in subparagraph (C)—</text> 
<subparagraph id="H0F3BA85EF38643AEA000F2F54B98F708"><enum>(A)</enum><text>by striking <quote>Librarian of Congress</quote> and inserting <quote>Copyright Royalty Judges</quote>; </text></subparagraph> 
<subparagraph id="H54EF0A9021114F7B9700D782004BBA2C"><enum>(B)</enum><text>by striking <quote>small webcasters</quote> and inserting <quote>webcasters</quote>; and</text></subparagraph> 
<subparagraph id="HC1B833535BEC4AD682DDE0387BB80029"><enum>(C)</enum><text>by adding at the end the following: <quote>This subparagraph shall not apply to the extent that the receiving agent and a webcaster that is party to an agreement entered into pursuant to subparagraph (A) expressly authorize the submission of the agreement in a proceeding under this subsection.</quote>; </text></subparagraph></paragraph> 
<paragraph id="H774220DA800B44F39900D7A1008C4D6E"><enum>(4)</enum><text>in subparagraph (D)—</text> 
<subparagraph id="HD8F567CF6D604DA59B3F940093D04125"><enum>(A)</enum><text>by striking <quote>the Small Webcasters Settlement Act of 2002</quote> and inserting <quote>the Webcaster Settlement Act of 2008</quote> ; and</text></subparagraph> 
<subparagraph id="H6850F388A6DE47DB9EBD138892139BB7"><enum>(B)</enum><text>by striking <quote>Librarian of Congress of July 8, 2002</quote> and inserting <quote>Copyright Royalty Judges of May 1, 2007</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HC668C28B507E491E913110F3FFBDA6D9"><enum>(5)</enum><text>in subparagraph (F), by striking <quote>December 15, 2002</quote> and all that follows through <quote>2003</quote> and inserting <quote>February 15, 2009</quote> . </text></paragraph></section>
