		<section id="H3320C24359344F4CA620B72E6562BDE9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Alcohol Franchise Contract Arbitration
			 Fairness Act of 2008</short-title></quote>.</text>
		</section><section id="HBA7CCC7B53404305B73D79FB00E0B4BC"><enum>2.</enum><header>Voluntary
			 arbitration of alcoholic beverage franchise disputes</header>
			<subsection id="HC95E397499C748FB9E731EE87B4E9C38"><enum>(a)</enum><header>Election of
			 arbitration</header>
				<paragraph id="H08A136501267493B957537F137DB682F"><enum>(1)</enum><header>Definitions</header><text>For
			 purposes of this subsection—</text>
					<subparagraph id="HDFAD7E51E5C344968E8C152265977777"><enum>(A)</enum><text>the term
			 <quote>alcoholic beverage</quote> has the meaning given such term in section
			 203 of the Federal Alcohol Administration Act (<external-xref legal-doc="usc" parsable-cite="usc/27/214">27 U.S.C. 214</external-xref>); and</text>
					</subparagraph><subparagraph id="HB1D0D84C7C684DBAAFFCEE26008BD666"><enum>(B)</enum><text>the term
			 <quote>alcoholic beverage franchise contract</quote> means a contract under
			 which an alcoholic beverage manufacturer, importer, or distributor sells
			 alcoholic beverages to any other person for resale to an ultimate
			 purchaser.</text>
					</subparagraph></paragraph><paragraph id="H52C97793AA3B445BBDE49C3EFB8F8463"><enum>(2)</enum><header>Consent
			 required</header><text>Notwithstanding any other provision of law, whenever an
			 alcoholic beverage franchise contract provides for the use of arbitration to
			 resolve a controversy arising out of or relating to such contract, arbitration
			 may be used to settle such controversy only if after such controversy arises
			 all parties to such controversy consent in writing to use arbitration to settle
			 such controversy.</text>
				</paragraph><paragraph id="H5ACCA445E51D4272B640084CDFAB3694"><enum>(3)</enum><header>Explanation
			 required</header><text>Notwithstanding any other provision of law, whenever
			 arbitration is elected to settle a dispute under an alcoholic beverage
			 franchise contract, the arbitrator shall be bound to follow the applicable law
			 and provide the parties to such contract with a written explanation of the
			 factual and legal basis for the award.</text>
				</paragraph></subsection><subsection id="HA5D1A51976B94A33B2136D75588C8C53"><enum>(b)</enum><header>Application</header><text>Subsection
			 (a) shall apply to contracts entered into, amended, altered, modified, renewed,
			 or extended after October 1, 2008.</text>
