			</subsection></section><section display-inline="no-display-inline" id="H6F37ADAF9BB545FFB8F7FB648BF44E4" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="HB7B949AF0E2A4D928E70AA3FC6943000"><enum>(1)</enum><text>It is the policy
			 of the United States to provide statistics to the public and to the Government
			 that are accurate, timely, relevant to public purposes, and credible in that
			 they are collected impartially and are available to all.</text>
			</paragraph><paragraph id="H89E879D00C264E488312BAC477362714"><enum>(2)</enum><text>Pursuant to
			 section 2 of article I of the Constitution, it is the obligation of the United
			 States to conduct a census of population every 10 years, such census being
			 necessary to the basic workings of our representative democracy.</text>
			</paragraph><paragraph id="H2E3BC38A817F4B6CA707B8B0B1B652FB"><enum>(3)</enum><text>Knowledge of who
			 we are as a people is basic to informed policymaking, public edification, and
			 scientific research, and, therefore, there should be regularly conducted a
			 census of the economy and the collection of other relevant information on the
			 population and economy of the United States at appropriate intervals between
			 censuses.</text>
			</paragraph><paragraph id="H7AE87303533C4A138113401531764256"><enum>(4)</enum><text>In all of the data
			 collections envisioned in title 13, United States Code, it is fundamentally
			 important that data be collected in an impartial manner, using modern
			 statistical, computational, and operational methods to the fullest extent
			 possible, consonant with applicable law.</text>
			</paragraph><paragraph id="H1D3A16C5857C4C908B8D137E96221774"><enum>(5)</enum><text>The credibility
			 and impartiality of data from a Federal statistical agency depends critically
			 on whether the agency operates from a strong position of independence;
			 therefore, the authority for conducting the decennial census of population and
			 any economic or other censuses or surveys should be vested in an agency with a
			 clear and well-defined position of independence.</text>
			</paragraph><paragraph id="H1A7C040DED7D4483B600B3BD9D7EDCB"><enum>(6)</enum><text>In
			 addition to a formal, strong position of independence, the operating principles
			 of the agency (as described in paragraph (5)) should include—</text>
				<subparagraph id="HA21A01F33FF94ACFBEBA479600F3F396"><enum>(A)</enum><text>openness about the
			 sources and limitations of the data provided;</text>
				</subparagraph><subparagraph id="H68928A00405F453F9E45F93C600830A2"><enum>(B)</enum><text>dissemination of
			 data as widely as possible, according to published schedules for release of key
			 statistics;</text>
				</subparagraph><subparagraph id="HAED57936A44240848159A93AE7632B"><enum>(C)</enum><text>continual search for
			 the development of more useful data, in terms of cost-effectiveness, accuracy,
			 timeliness, and relevance to public purposes;</text>
				</subparagraph><subparagraph id="H1B460196CF3E4892B9C86D7F68126500"><enum>(D)</enum><text>regular evaluation
			 of major data collection programs to identify ways to improve their
			 cost-effectiveness, accuracy, timeliness, and relevance;</text>
				</subparagraph><subparagraph id="H6D59BC1401034665802DAD633D29ACA0"><enum>(E)</enum><text>commitment to
			 quality and professional standards of practice as a statistical agency;</text>
				</subparagraph><subparagraph id="H2562A81659E6480194808DAAA202851F"><enum>(F)</enum><text>fair treatment of
			 data providers, including individuals and organizations, with respect for
			 privacy and the protection of confidential information;</text>
				</subparagraph><subparagraph id="H4A21D8979B734CB600D1CCF60F6C719"><enum>(G)</enum><text>maintenance of an
			 active research program, not only in methodology and operations, but also in
			 using data for reporting of conditions and trends; and</text>
				</subparagraph><subparagraph id="H135A248EC06845418BE4E329005E939F"><enum>(H)</enum><text>cooperation and
			 coordination with other statistical agencies.</text>
				</subparagraph></paragraph></section><section id="H086A6919F8B045B3862F61D1F5F858BF"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text>
			<paragraph id="H81214D86B0A04022B6E6D560382C206B"><enum>(1)</enum><text>the term
			 <term>Census Bureau</term> means the United States Census Bureau;</text>
			</paragraph><paragraph id="HB46620658E7541CEA5C00DDE6F8FB0"><enum>(2)</enum><text>the
			 term <term>Director</term> means the Director of the United States Census
			 Bureau;</text>
			</paragraph><paragraph id="H90E2E3D4AE7F4792008CB2AD20F51989"><enum>(3)</enum><text>the term
			 <term>Deputy Director</term> means the Deputy Director of the United States
			 Census Bureau; and</text>
			</paragraph><paragraph id="H2E8AA03D063E47D5AC21C45728DB3803"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>function</term> includes any
			 duty, obligation, power, authority, responsibility, right, privilege, activity,
			 or program.</text>
			</paragraph></section><section id="H047A26FDC9AC46B996B4549584E568B9"><enum>4.</enum><header>United States
			 Census Bureau</header><text display-inline="no-display-inline">Effective
			 January 1, 2012, there is established, as an independent establishment in the
			 executive branch of the Government, the United States Census Bureau.</text>
		</section><section id="H4DE3DE83601545EBA51F75EBC82F007D"><enum>5.</enum><header>Director</header>
			<subsection id="HF29AEA08C532452FABD48214571F30AF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There shall be at the
			 head of the Census Bureau a Director of the United States Census Bureau, who
			 shall be appointed by the President, by and with the advice and consent of the
			 Senate. The Director shall be appointed without regard to political affiliation
			 and solely on the basis of the professional qualifications required to perform
			 the duties and responsibilities of the office of Director.</text>
			</subsection><subsection id="H00EE51E451114C1589A1C41E9E88F23"><enum>(b)</enum><header>Term of
			 office</header><text>The term of office of any individual appointed as Director
			 shall be 5 years. In any case in which a successor does not take office at the
			 end of a Director’s term, such Director may continue in office until the entry
			 upon office of such a successor, except that such Director may not continue to
			 serve for more than 1 year after the date on which the term of the Director
			 would otherwise expire, unless reappointed. A Director appointed to a term of
			 office after the commencement of such term may serve under such appointment
			 only for the remainder of such term. An individual serving in the office of
			 Director may be removed from office only pursuant to a finding by the President
			 of neglect of duty or malfeasance in office. The President shall communicate
			 the reasons for any such removal to each House of the Congress.</text>
			</subsection><subsection id="H5EAE5D057E974A8BB318CB63C0341E3D"><enum>(c)</enum><header>Functions</header><text>The
			 Director shall be responsible for the exercise of all powers and the discharge
			 of all duties of the Census Bureau, and shall have authority and control over
			 all personnel and activities thereof.</text>
			</subsection><subsection id="HCDFF22816E124EBC9E66025CD6B02302"><enum>(d)</enum><header>Organization</header><text>The
			 Director may establish, alter, consolidate, or discontinue such organizational
			 units or components within the Census Bureau as the Director considers
			 necessary or appropriate, except that this subsection shall not apply with
			 respect to any unit or component provided for by law.</text>
			</subsection><subsection id="H3CA6B464947F478FAE05C1C8951732C"><enum>(e)</enum><header>Advisory
			 committees</header><text>The Director may establish advisory committees to
			 provide advice with respect to any function of the Director. Members of any
			 such committee shall serve without compensation, but shall be entitled to
			 transportation expenses and per diem in lieu of subsistence in accordance with
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United States Code.</text>
			</subsection><subsection id="H3E38F2C831E1462B8DEB008DFCD092AA"><enum>(f)</enum><header>Regulations</header><text>The
			 Director may prescribe such rules and regulations as the Director considers
			 necessary or appropriate to carry out the functions of the Director.</text>
			</subsection><subsection id="H18C3D7BAE54D4900838C576FFB2EC1C"><enum>(g)</enum><header>Delegations
			 etc</header><text>The Director may assign duties, and delegate, or authorize
			 successive redelegations of, authority to act and to render decisions, to such
			 officers and employees of the Census Bureau as the Director may find necessary.
			 Within the limitations of such assignments, delegations, or redelegations, all
			 official acts and decisions of such officers and employees shall have the same
			 force and effect as though performed or rendered by the Director. An
			 assignment, delegation, or redelegation under this subsection may not take
			 effect before the date on which notice of such assignment, delegation, or
			 redelegation (as the case may be) is published in the Federal Register.</text>
			</subsection><subsection id="H2ADA437B28034DA1A23B9E1F03FF92CA"><enum>(h)</enum><header>Other
			 authorities</header>
				<paragraph id="H76AFF71C79E84881A63FB500101EAADC"><enum>(1)</enum><header>Personnel</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Director, in carrying out the functions of the Director or the Census
			 Bureau, may use the services of officers and other personnel in other Federal
			 agencies, including personnel of the armed forces, with the consent of the head
			 of the agency concerned.</text>
				</paragraph><paragraph id="H5071EDEDC9964A6384BA82F95CEA60A9"><enum>(2)</enum><header>Voluntary
			 services</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1342">section 1342</external-xref> of title 31, United States
			 Code, or any other provision of law, the Director may accept and use voluntary
			 and uncompensated services.</text>
				</paragraph></subsection><subsection id="H627E9ABACD544C78A2E928EE1E110215"><enum>(i)</enum><header>Compensation</header><text>Level
			 IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code,
			 applies with respect to the office of Director.</text>
			</subsection></section><section id="HAFA3C3BF34B1403D8C5281AC446F2FC3"><enum>6.</enum><header>Deputy
			 Director</header>
			<subsection id="H0A6650127E0042229C6175A6E341EC80"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There shall be in the
			 Census Bureau a Deputy Director of the United States Census Bureau, who shall
			 be appointed by and serve at the pleasure of the Director. The position of
			 Deputy Director shall be a career reserved position within the meaning of
			 <external-xref legal-doc="usc" parsable-cite="usc/5/3132">section 3132(a)(8)</external-xref> of title 5, United States Code.</text>
			</subsection><subsection id="HB4D44481F199427CA4E4A1CDECCAA7BD"><enum>(b)</enum><header>Functions</header><text>The
			 Deputy Director shall perform such functions as the Director shall designate.
			 During any absence or disability of the Director, the Deputy Director shall act
			 as Director. In the event of a vacancy in the office of Director, the Deputy
			 Director shall act as Director until a Director is appointed.</text>
			</subsection></section><section id="H1B64D3D5796D44148C4857D566437DB7"><enum>7.</enum><header>Transfers</header>
			<subsection id="H0F4083A12D744D4191FB71D9DB3BD600"><enum>(a)</enum><header>Functions</header><text display-inline="yes-display-inline">There shall be transferred to and vested in
			 the Director all functions that, as of December 31, 2011, were—</text>
				<paragraph id="H5783D908CAA14A90BC4CD8ADA49119DA"><enum>(1)</enum><text>vested in the
			 Secretary of Commerce by title 13, United States Code, Executive order, or any
			 other provision of law; and</text>
				</paragraph><paragraph id="H11BC139EDA1A44C5B085D22445693C04"><enum>(2)</enum><text>delegated to the
			 Director of the Census within the Department of Commerce.</text>
				</paragraph></subsection><subsection id="H292C4C6779F04972B606A7A5E22BADE1"><enum>(b)</enum><header>Personnel,
			 assets, etc</header>
				<paragraph id="H0311BAE716DE4089B5C2FA8318080090"><enum>(1)</enum><header>In
			 general</header><text>There shall be transferred from the Department of
			 Commerce to the Census Bureau, for appropriate allocation by the
			 Director—</text>
					<subparagraph id="HB044575A43E442418F698B8D92C01E50"><enum>(A)</enum><text>the personnel
			 employed in connection with the functions transferred by subsection (a);
			 and</text>
					</subparagraph><subparagraph id="HC513F10C544E4B6C86DDA379EDCD068C"><enum>(B)</enum><text>the assets,
			 liabilities, contracts, property, records, and unexpended balance of
			 appropriations, authorizations, allocations, and other funds employed, held, or
			 used in connection with such functions, arising from such functions, or
			 available, or to be made available, in connection with such functions.</text>
					</subparagraph></paragraph><paragraph id="HA6538A4F96DA4B1680B6989B0642923C"><enum>(2)</enum><header>Unexpended
			 funds</header><text>Unexpended funds transferred pursuant to this subsection
			 shall be used only for the purposes for which the funds were originally
			 appropriated.</text>
				</paragraph><paragraph id="H2FD10E96DD5C4813802BF4B93530727D"><enum>(3)</enum><header>Employment
			 protections</header><text>During the 1-year period beginning on January 1,
			 2012—</text>
					<subparagraph id="H48C00DF582EB4E5299EBAD6539B1C570"><enum>(A)</enum><text>the transfer
			 pursuant to this section of any full-time personnel (except special Government
			 employees) and part-time personnel holding permanent positions shall not cause
			 any such personnel to be separated or reduced in grade or compensation solely
			 as a result of such transfer; and</text>
					</subparagraph><subparagraph id="HB89B3BD4E8634602B623001894D67847"><enum>(B)</enum><text>any such personnel
			 who were not employed in the Bureau of the Census in the Department of Commerce
			 as of December 31, 2011, shall not be subject to directed reassignment to a
			 duty station outside their commuting area.</text>
					</subparagraph></paragraph></subsection><subsection id="HCE9A139D44EA4D52ACCF52259325B79B"><enum>(c)</enum><header>Effective
			 date</header><text>This section shall take effect on January 1, 2012.</text>
			</subsection></section><section id="H64089DD273C64D3691D6127FE0206C00"><enum>8.</enum><header>Transition
			 rules</header>
			<subsection id="HA61336CB78EB4BC4A2341FA49D00155C"><enum>(a)</enum><header>Relating to
			 officers</header>
				<paragraph id="H9C81C90305E64E0CBFCCB5872BC89184"><enum>(1)</enum><header>Appointment of
			 initial Director</header><text display-inline="yes-display-inline">The initial
			 Director of the United States Census Bureau shall be appointed in accordance
			 with the provisions of section 5(a).</text>
				</paragraph><paragraph id="HF8D2B68D49E143C19C1CF5D91B874AD"><enum>(2)</enum><header>Interim role of
			 current Director of the Census after effective date of new Census
			 Bureau</header><text>If, as of January 1, 2012, the initial Director of the
			 United States Census Bureau has not taken office, the officer serving on
			 December 31, 2011, as Director of the Census (or Acting Director of the Census,
			 if applicable) in the Department of Commerce shall serve as the Director of the
			 United States Census Bureau, and shall assume the powers and duties of such
			 Director, until the initial Director has taken office.</text>
				</paragraph></subsection><subsection id="H71C62E164EA54549B2869DF3F6E98B90"><enum>(b)</enum><header>Continuation of
			 orders, determinations, rules, regulations, etc</header><text>All orders,
			 determinations, rules, regulations, permits, contracts, collective bargaining
			 agreements (and ongoing negotiations relating to such collective bargaining
			 agreements), recognitions of labor organizations, certificates, licenses, and
			 privileges—</text>
				<paragraph id="HA03D348A15B34A67B6C4AEAE15D46157"><enum>(1)</enum><text>which have been
			 issued, made, promulgated, granted, or allowed to become effective, in the
			 exercise of functions</text><subparagraph commented="no" display-inline="yes-display-inline" id="HDFC4EAE350684EE0B385C47490B56670"><enum>(A)</enum><text>which were exercised by
			 the Secretary of Commerce (or delegate thereof), and</text><clause commented="no" display-inline="yes-display-inline" id="H266783728E9F433088C1A300220087A0"><enum>(B)</enum><text>which relate to
			 functions which, by reason of this Act are vested in the Director of the United
			 States Census Bureau, and</text>
						</clause></subparagraph></paragraph><paragraph id="H4DB89739224F4A87A77D890073D30032"><enum>(2)</enum><text>which are in
			 effect as of December 31, 2011,</text>
				</paragraph><continuation-text continuation-text-level="subsection">shall
			 continue in effect according to their terms until modified, terminated,
			 suspended, set aside, or repealed by the Director of the United States Census
			 Bureau, except that any collective bargaining agreement shall remain in effect
			 until the date of termination in accordance with such agreement.</continuation-text></subsection><subsection id="HE2ADDACDB732426AB0E2176F6C24DA8F"><enum>(c)</enum><header>Continuation of
			 proceedings</header><text>The provisions of this Act shall not affect any
			 proceeding pending before the Secretary of Commerce (or delegate thereof) as of
			 December 31, 2011, with respect to functions which (by reason of this Act) are
			 vested in the Director of the United States Census Bureau, except that such
			 proceedings, to the extent that such proceedings relate to such functions,
			 shall continue before such Director. Orders shall be issued under any such
			 proceeding, appeals taken therefrom, and payments shall be made pursuant to
			 such orders, in like manner as if this Act had not been enacted, and orders
			 issued in any such proceeding shall continue in effect until modified,
			 terminated, superseded, or repealed by such Director, by a court of competent
			 jurisdiction, or by operation of law.</text>
			</subsection><subsection id="H64AE2FFBF56A42C49563B6C5472B9D5B"><enum>(d)</enum><header>Continuation of
			 suits</header><text>Except as provided in this subsection—</text>
				<paragraph id="H92B45893518A49F0B3DFDD4477CCC147"><enum>(1)</enum><text>the provisions of
			 this Act shall not affect suits commenced before January 1, 2012; and</text>
				</paragraph><paragraph id="HFD98801952024665ABBDF2228D5C3500"><enum>(2)</enum><text>in all such suits,
			 proceedings shall be had, appeals taken, and judgments rendered, in the same
			 manner and effect as if this Act had not been enacted.</text>
				</paragraph><continuation-text continuation-text-level="subsection">No cause of
			 action, and no suit, action, or other proceeding commenced by or against any
			 officer in such officer’s official capacity as an officer of the Department of
			 Commerce, shall abate by reason of the enactment of this Act. In any suit,
			 action, or other proceeding pending as of December 31, 2011, the court or
			 hearing officer may at any time, on the motion of the court or hearing officer
			 or that of a party, enter an order which will give effect to the provisions of
			 this subsection (including, where appropriate, an order for substitution of
			 parties).</continuation-text></subsection><subsection display-inline="no-display-inline" id="HAF0F5B5D9311460A9BE6F035EE98981"><enum>(e)</enum><header>Continuation of
			 penalties</header><text>This Act shall not have the effect of releasing or
			 extinguishing any civil or criminal prosecution, penalty, forfeiture, or
			 liability incurred as a result of any function which (by reason of this Act) is
			 vested in the Director of the United States Census Bureau.</text>
			</subsection><subsection id="H53ADB3FD91644250A027F518A9E76CB6"><enum>(f)</enum><header>Judicial
			 review</header><text>Orders and actions of the Director of the United States
			 Census Bureau in the exercise of functions vested in such Director by reason of
			 this Act shall be subject to judicial review to the same extent and in the same
			 manner as if such orders had been made and such actions had been taken by the
			 Secretary of Commerce in the exercise of such functions immediately before the
			 transfer described in section 7(a). Any statutory requirements relating to
			 notice, hearings, action upon the record, or administrative review that apply
			 to any function so vested in such Director shall continue to apply to the
			 exercise of such function by such Director.</text>
			</subsection><subsection id="H401C5AA98BB14272B636953E67232623"><enum>(g)</enum><header>Exercise of
			 functions</header><text>In the exercise of the functions vested in the Director
			 of the United States Census Bureau under this Act, such Director shall have the
			 same authority as that vested in the Secretary of Commerce with respect to the
			 exercise of such functions immediately preceding the vesting of such functions
			 in such Director, and actions of such Director shall have the same force and
			 effect as if exercised by such Secretary.</text>
			</subsection></section><section id="H622F7E9964B3477C92ADE1B7EA78106"><enum>9.</enum><header>Inspector
			 General</header>
			<subsection id="H16BD4DA4C8014404B174D42728FA3C88"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 11 of the
			 Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text>
				<paragraph id="H2999D0110EC745BAAD71316D41B9A0F1"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>or the Federal Cochairpersons of the Commissions established
			 under <external-xref legal-doc="usc" parsable-cite="usc/40/15301">section 15301</external-xref> of title 40, United States Code;</quote> and inserting
			 <quote>the Federal Cochairpersons of the Commissions established under section
			 15301 of title 40, United States Code; or the Director of the United States
			 Census Bureau;</quote>; and</text>
				</paragraph><paragraph id="H1484C8CD88BD4C9CA0007E9285E9D60"><enum>(2)</enum><text>in
			 paragraph (2), by striking <quote>or the Commissions established under section
			 15301 of title 40, United States Code,</quote> and inserting <quote>the
			 Commissions established under <external-xref legal-doc="usc" parsable-cite="usc/40/15301">section 15301</external-xref> of title 40, United States Code, or
			 the United States Census Bureau,</quote>.</text>
				</paragraph></subsection><subsection id="H261E3B2BACC847CBA5190003B48BD5A0"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall take effect on
			 January 1, 2012.</text>
			</subsection></section><section id="HC465421695DE4F34AE98EFBD8E5497CD"><enum>10.</enum><header>Technical and
			 conforming amendments</header><text display-inline="no-display-inline">Not
			 later than January 1, 2011, the Director of the Census shall submit to each
			 House of the Congress draft legislation containing any technical and conforming
			 amendments to title 13, United States Code, and any other provisions which may
			 be necessary to carry out the purposes of this Act.</text>
