		<official-title>To ensure that a private for-profit nursing home affected
		  by a major disaster receives the same reimbursement as a public nursing home
		  affected by a major disaster.</official-title>

		<section id="H7682F5EE81984BA880C9BB95DEF0E6C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Nursing Home Emergency Assistance
			 Act</short-title></quote>.</text>
		</section><section id="HC486180A1D684518BFEBFC5F82A02CFE"><enum>2.</enum><header>Federal
			 assistance to private for-profit nursing homes</header><text display-inline="no-display-inline">Title IV of the Robert T. Stafford Disaster
			 Relief and Emergency Assistance Act is amended by inserting after section 408
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170 et seq.</external-xref>) the following:</text>

				<section id="HC33A515342E84531A5E0BF6DC7C69649"><enum>409.</enum><header>Federal
				assistance to private for-profit nursing homes</header>
					<subsection id="HB0CAF87342A241A0B9C8586273572DDF"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this Act, the President may provide, from funds made
				available to carry out this Act, reimbursement to a private for-profit nursing
				home, for damage to, or an expense incurred by, such nursing home during a
				major disaster or emergency declared under this Act, in accordance with this
				section.</text>
					</subsection><subsection id="H8F9898EAE13D483497B1558C76063EC6"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A private for-profit nursing home shall be
				eligible to receive reimbursement under subsection (a) if, as determined by the
				President, in consultation with the Governor of a State—</text>
						<paragraph id="HD136951EF5404568A8C474049D1453CF"><enum>(1)</enum><text display-inline="yes-display-inline">the damage to, or expense incurred by, the
				nursing home was the result of a declared major disaster or emergency;</text>
						</paragraph><paragraph id="HEEB28773871749D3979BB1FA2F1A874"><enum>(2)</enum><text>the nursing home is
				located within 30 miles of the declared major disaster or emergency area; and</text>
						</paragraph><paragraph id="H2316F5EB38DC4D64A3BC68D5F4402BE"><enum>(3)</enum><text>during the declared
				major disaster or emergency, the nursing home acted in accordance with any
				relevant requirement that would apply to a private nonprofit nursing home
				seeking, and eligible for, reimbursement under this Act.</text>
						</paragraph></subsection><subsection id="HF31ED6F309354BD08BF9471E243FA21"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">The amount of reimbursement provided to a
				private for-profit nursing home under this section shall not be greater than
				the amount of reimbursement available under this Act for a public or private
				nonprofit nursing home for similar damage or incurred expenses after a declared
				major disaster or emergency.</text>
					</subsection><subsection id="H3882D1188F2041C50052905EAF675826"><enum>(d)</enum><header>Definition</header><text>For
				purposes of this section, the term <quote>nursing home</quote> means an
				establishment with 3 or more beds that provides nursing or personal care
				services to the older population, infirm, or chronically
				ill.</text>
