		<official-title>To amend the Help America Vote Act of 2002 to ensure that
		  individuals who reside in a jurisdiction in a residence subject to foreclosure
		  proceedings may continue to vote in elections for Federal office held in the
		  jurisdiction, and for other purposes.</official-title>

		<section id="H14E830A6C0C6455D86AFE000529EA0F4" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting Voters in Foreclosure Act of
			 2008</short-title></quote>.</text>
		</section><section id="H5277DECEE9BF4986963D51C0CDC188B8"><enum>2.</enum><header>Rights of
			 Individuals Residing in Property Subject to Foreclosure Proceedings to Continue
			 Voting in Jurisdiction</header>
			<subsection display-inline="no-display-inline" id="H8EC39D3E98654C75ABF8D7E995ED366C"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Subtitle A of title
			 III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>) is amended
			 by inserting after section 303 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H2523204DFBE5431B9DE0E8B4CB007B7C" style="OLC">
					<section id="H46DB002E5C06469D931223807614B190"><enum>303A.</enum><header>Rights of
				Individuals Residing in Property Subject to Foreclosure Proceedings to Continue
				Voting in Jurisdiction</header>
						<subsection id="HB8F33DF3F354454383AB00A4B4DD0507"><enum>(a)</enum><header>Protections for
				Individuals Affected by Foreclosure</header>
							<paragraph id="H54D9C4E6E4284960ABBEFBEB8C3EE9E7"><enum>(1)</enum><header>In
				general</header><text>With respect to any jurisdiction in which an election for
				Federal office is held, an individual who resides in a household which is
				located in the jurisdiction and which is subject to foreclosure proceedings at
				the time of election, or who resided in a household which was located in the
				jurisdiction and which was subject to such proceedings at any time during the
				3-year period ending on the date of the election, shall be considered to reside
				in the jurisdiction for purposes of determining the individual’s eligibility to
				vote in the election in the jurisdiction and shall be permitted to cast a
				nonprovisional ballot in the election.</text>
							</paragraph><paragraph id="HF5EB4BA27BF740EC8BBC40F945AAFF23"><enum>(2)</enum><header>Exception for
				individuals registered in different jurisdiction</header><text>Paragraph (1)
				does not apply with respect to an individual in a jurisdiction who is
				registered to vote in the election involved in a different jurisdiction.</text>
							</paragraph></subsection><subsection id="H4D3E822CA76F442DA9E4B2CCBE5FF109"><enum>(b)</enum><header>Period of
				Applicability</header><text>This section shall apply with respect to the
				regularly scheduled general election for Federal office held in November
				2008.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H2F6BF603FBA94C08AB8B3293DA8F300"><enum>(b)</enum><header>Conforming
			 Amendment Relating to Enforcement</header><text>Section 401 of such Act (42
			 U.S.C. 15511) is amended by striking <quote>and 303</quote> and inserting
			 <quote>303, and 303A</quote>.</text>
			</subsection><subsection id="H873A20481AD2495DA9F2051EF915B773"><enum>(c)</enum><header>Clerical
			 Amendment</header><text>The table of contents of the Help America Vote Act of
			 2002 is amended by inserting after the item relating to section 303 the
			 following new item:</text>
