		<section id="H145D69C159E24DF6A01DF2F05567F9FA" section-type="section-one"><enum>1.</enum><header>Short
			 <added-phrase reported-display-style="italic"></added-phrase>title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Indian Arts and Crafts Amendments Act
			 of 2008</short-title></quote>.</text>
		</section><section id="HF317A118DFD34A7591048CC5BC24A8D0"><enum>2.</enum><header>Indian arts and
			 crafts</header>
			<subsection id="H540691A7326D4A4FBB85C351BDFA9D52"><enum>(a)</enum><header>Criminal
			 proceedings; civil actions; misrepresentations</header><text>Section 5 of the
			 Act entitled <quote>An Act to promote the development of Indian arts and crafts
			 and to create a board to assist therein, and for other purposes</quote> (25
			 U.S.C. 305d) is amended to read as follows:</text>
				<quoted-block id="HF7CD6974BA344159BB5F50D45452C69E" style="OLC">
					<section id="HDAC38AFF83A4477EAE0887517B878E1E"><enum>5.</enum><header>Criminal
				proceedings; civil actions</header>
						<subsection id="H00086F3CDF9E42CCA83BD97CECF446EF"><enum>(a)</enum><header>Definition of
				Federal law enforcement officer</header><text>In this section, the term
				<term>Federal law enforcement officer</term> includes a Federal law enforcement
				officer (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/115">section 115(c)</external-xref> of title 18, United States Code).</text>
						</subsection><subsection id="H1D1F43AC61904D80A1A7B37F02277951"><enum>(b)</enum><header>Authority To
				conduct investigations</header><text>Any Federal law enforcement officer shall
				have the authority to conduct an investigation relating to an alleged violation
				of this Act occurring within the jurisdiction of the United States.</text>
						</subsection><subsection id="H1031563117E1443BA57D46E4C7865C87"><enum>(c)</enum><header>Criminal
				proceedings</header>
							<paragraph id="H65EAC56AE3CF4E93BAB2851CB8707937"><enum>(1)</enum><header>Investigation</header>
								<subparagraph id="H2311153C48984516BDD3ED29AA33C053"><enum>(A)</enum><header>In
				general</header><text>The Board may refer an alleged violation of section 1159
				of title 18, United States Code, to any Federal law enforcement officer for
				appropriate investigation.</text>
								</subparagraph><subparagraph id="HD1514DEAB8B84B0DA973E1312FCBDCB"><enum>(B)</enum><header>Referral not
				required</header><text>A Federal law enforcement officer may investigate an
				alleged violation of section 1159 of that title regardless of whether the
				Federal law enforcement officer receives a referral under subparagraph
				(A).</text>
								</subparagraph></paragraph><paragraph id="HF6C5D2C079C14B4ABA471F68B7AD4282"><enum>(2)</enum><header>Findings</header><text>The
				findings of an investigation of an alleged violation of section 1159 of title
				18, United States Code, by any Federal department or agency under paragraph
				(1)(A) shall be submitted, as appropriate, to—</text>
								<subparagraph id="HA802318EDE33456AB112BCA61D039B7B"><enum>(A)</enum><text>a Federal or State
				prosecuting authority; or</text>
								</subparagraph><subparagraph id="HF1615BA251AA4E50BF44AF2C663DB361"><enum>(B)</enum><text>the Board.</text>
								</subparagraph></paragraph><paragraph id="HDCD8BA4E83E1468900CA3CC9DE2268CF"><enum>(3)</enum><header>Recommendations</header><text>On
				receiving the findings of an investigation under paragraph (2), the Board
				may—</text>
								<subparagraph id="HE356A0011EBF4482A166A157149E8218"><enum>(A)</enum><text>recommend to the
				Attorney General that criminal proceedings be initiated under section 1159 of
				title 18, United States Code; and</text>
								</subparagraph><subparagraph id="H6CA28E01F0034E31B19E962C19B933E8"><enum>(B)</enum><text>provide such
				support to the Attorney General relating to the criminal proceedings as the
				Attorney General determines to be appropriate.</text>
								</subparagraph></paragraph></subsection><subsection id="H686238220C3141DDBAD66C960447C2C6"><enum>(d)</enum><header>Civil
				actions</header><text>In lieu of, or in addition to, any criminal proceeding
				under subsection (c), the Board may recommend that the Attorney General
				initiate a civil action under section
				6.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H37DB2E47C3BD4FFD9E4E6C38CFE7A292"><enum>(b)</enum><header>Cause of action
			 for misrepresentation</header><text>Section 6 of the Act entitled <quote>An Act
			 to promote the development of Indian arts and crafts and to create a board to
			 assist therein, and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/25/305e">25 U.S.C. 305e</external-xref>) is
			 amended—</text>
				<paragraph id="HBAAFA88729A846F88E69BA30C1853514"><enum>(1)</enum><text>by striking
			 subsection (d);</text>
				</paragraph><paragraph id="HC063D42A06FA4B08A593B80521F7536B"><enum>(2)</enum><text>by redesignating
			 subsections (a) through (c) as subsections (b) through (d),
			 respectively;</text>
				</paragraph><paragraph id="H881001BDFB134544B1AE1B1C58F56D78"><enum>(3)</enum><text>by inserting
			 before subsection (b) (as redesignated by paragraph (2)) the following:</text>
					<quoted-block id="H48513E5520244B54A6FC934118DEA8D3" style="OLC">
						<subsection id="H3810FBDBE528405AAC2E410723084D45"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="HE3670BEDB29E48B48CD4C5C7F20B9F6"><enum>(1)</enum><header>Indian</header><text>The
				term <term>Indian</term> means an individual that—</text>
								<subparagraph id="HC9E54B6AD2E64526AAA5BF6626F35D49"><enum>(A)</enum><text>is a member of an
				Indian tribe; or</text>
								</subparagraph><subparagraph id="H25F56A4E4C2D4652AB2D637C332464D7"><enum>(B)</enum><text>is certified as an
				Indian artisan by an Indian tribe.</text>
								</subparagraph></paragraph><paragraph id="HAB6A3AB8839A4608B8FA737708E9DC3"><enum>(2)</enum><header>Indian
				product</header><text>The term <term>Indian product</term> has the meaning
				given the term in any regulation promulgated by the Secretary.</text>
							</paragraph><paragraph id="HFE62F64F573447499872BE5395F05610"><enum>(3)</enum><header>Indian
				tribe</header>
								<subparagraph id="H60302B802B4F4C51BD36EB4FC138AE58"><enum>(A)</enum><header>In
				general</header><text>The term <term>Indian tribe</term> has the meaning given
				the term in section 4 of the <act-name parsable-cite="ISDA">Indian
				Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
				450b).</text>
								</subparagraph><subparagraph id="HB57B0B4B4F24471EA8006B39DA527646"><enum>(B)</enum><header>Inclusion</header><text>The
				term <term>Indian tribe</term> includes, for purposes of this section only, an
				Indian group that has been formally recognized as an Indian tribe by—</text>
									<clause id="HBD3E011ED3B044BCACF64BED57F5955"><enum>(i)</enum><text>a
				State legislature;</text>
									</clause><clause id="H77A47BDD4BAE4F9189A7F1BBC525F658"><enum>(ii)</enum><text>a
				State commission; or</text>
									</clause><clause id="HCEA76B5F403D4B6DA538A6FD62E9B77D"><enum>(iii)</enum><text>another similar
				organization vested with State legislative tribal recognition authority.</text>
									</clause></subparagraph></paragraph><paragraph id="H091DA86942C64BDA9EA17F900DA436C"><enum>(4)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of the
				Interior.</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H67B20A74CF8A4A9AB19491BCE2B6AADA"><enum>(4)</enum><text>in subsection (b)
			 (as redesignated by paragraph (2)), by striking <quote>subsection (c)</quote>
			 and inserting <quote>subsection (d)</quote>;</text>
				</paragraph><paragraph id="H3B7537A08206420B9FBB806C6FE2561"><enum>(5)</enum><text>in
			 subsection (c) (as redesignated by paragraph (2))—</text>
					<subparagraph id="HF32184C68C5E47AA924D28CE4CB6F281"><enum>(A)</enum><text>by striking
			 <quote>subsection (a)</quote> and inserting <quote>subsection (b)</quote>;
			 and</text>
					</subparagraph><subparagraph id="H1E343BC33B644E818E51AC35F652D432"><enum>(B)</enum><text>by striking
			 <quote>suit</quote> and inserting <quote>the civil action</quote>;</text>
					</subparagraph></paragraph><paragraph id="HF6FD02B57084457EA900B592D24ED241"><enum>(6)</enum><text>by striking
			 subsection (d) (as redesignated by paragraph (2)) and inserting the
			 following:</text>
					<quoted-block id="H870BE03DC60F4B008E72AF8CDB9229ED" style="OLC">
						<subsection id="H53844EAD471546B988BC38EE293E168E"><enum>(d)</enum><header>Persons that may
				initiate civil actions</header>
							<paragraph id="H5F45DF0EFC2F4971BD79D666DAFEE2A6"><enum>(1)</enum><header>In
				general</header><text>A civil action under subsection (b) may be initiated
				by—</text>
								<subparagraph id="H3C427AFC081B495B98B52DDE09B5344"><enum>(A)</enum><text>the Attorney
				General, at the request of the Secretary acting on behalf of—</text>
									<clause id="H85D589CA22B64CD497F8B6CB2CE47760"><enum>(i)</enum><text>an
				Indian tribe;</text>
									</clause><clause id="H973B2C63DC464A94AD5C5458EB724B20"><enum>(ii)</enum><text>an Indian;
				or</text>
									</clause><clause id="HDA24EADDC3CE47B795F8B2FE1D899F00"><enum>(iii)</enum><text>an Indian arts
				and crafts organization;</text>
									</clause></subparagraph><subparagraph id="HA21C1CF54DE44F39AA4B9E2623EB5F79"><enum>(B)</enum><text>an Indian tribe,
				acting on behalf of—</text>
									<clause id="H981C314D16FC4478B9D960BB2D440124"><enum>(i)</enum><text>the Indian
				tribe;</text>
									</clause><clause id="H58A389B300B44B2383E3875CB07D558B"><enum>(ii)</enum><text>a
				member of that Indian tribe; or</text>
									</clause><clause id="H25A068B057514EF3A8A5E6D401EDD754"><enum>(iii)</enum><text>an Indian arts
				and crafts organization;</text>
									</clause></subparagraph><subparagraph id="H0E481F27DF704CC59B52FDD1252861E6"><enum>(C)</enum><text>an Indian;
				or</text>
								</subparagraph><subparagraph id="HFD183190BD7C49258D362CA2D7267DE4"><enum>(D)</enum><text>an Indian arts and
				crafts organization.</text>
								</subparagraph></paragraph><paragraph id="H456DE3FB36AD453587DFCCE1E5E930F"><enum>(2)</enum><header>Disposition of
				amounts recovered</header>
								<subparagraph id="HE8ED7AEF37A549539D8D645135165BC2"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), an amount
				recovered in a civil action under this section shall be paid to the Indian
				tribe, the Indian, or the Indian arts and crafts organization on the behalf of
				which the civil action was initiated.</text>
								</subparagraph><subparagraph id="H9064AA449C644066A22255452633D767"><enum>(B)</enum><header>Exceptions</header>
									<clause id="H4245789D2EE44FDF9CF8E129B66CA9B"><enum>(i)</enum><header>Attorney
				General</header><text>In the case of a civil action initiated under paragraph
				(1)(A), the Attorney General may deduct from the amount—</text>
										<subclause id="HF043A021272B471593A3F9CC5FE4DA03"><enum>(I)</enum><text>the amount of the
				cost of the civil action and reasonable attorney’s fees awarded under
				subsection (c), to be deposited in the Treasury and credited to appropriations
				available to the Attorney General on the date on which the amount is recovered;
				and</text>
										</subclause><subclause id="H3043DB14DC794D878B6827F69CA16B64"><enum>(II)</enum><text>the amount of the
				costs of investigation awarded under subsection (c), to reimburse the Board for
				the activities of the Board relating to the civil action.</text>
										</subclause></clause><clause id="H12E780740DE54D79A4C5788CE546F07D"><enum>(ii)</enum><header>Indian
				tribe</header><text>In the case of a civil action initiated under paragraph
				(1)(B), the Indian tribe may deduct from the amount—</text>
										<subclause id="H7A5878BE3B7849D3AF5E00261DA74010"><enum>(I)</enum><text>the amount of the
				cost of the civil action; and</text>
										</subclause><subclause id="H7562F7609871427AB98B81F606E7A71"><enum>(II)</enum><text>reasonable
				attorney’s fees.</text>
										</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H170D623D10FF432800B4F2D9FBA156C8"><enum>(7)</enum><text>in subsection (e),
			 by striking <quote>(e) In the event that</quote> and inserting the
			 following:</text>
					<quoted-block id="HD6C488A89FFD4949A8988BB4157964A7" style="OLC">
						<subsection id="HC7C6BDEDF6944923BB4DB1A6E560592D"><enum>(e)</enum><header>Savings
				provision</header><text>If</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H16AF2D8AC04848D28FBC4EFBFC16F00"><enum>3.</enum><header>Misrepresentation
			 of Indian produced goods and products</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1159">Section 1159</external-xref> of title 18, United States
			 Code, is amended—</text>
			<paragraph id="H77E706B74BAD4FBFACE7095162A875EB"><enum>(1)</enum><text>by striking
			 subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD87B5B72C8DE4ACC84183BBDFEFB89FA" style="OLC">
					<subsection id="HD2DF10174DDA4039863511563CD403BD"><enum>(b)</enum><header>Penalty</header><text>Any
				person that knowingly violates subsection (a) shall—</text>
						<paragraph id="H8002805612564F8F884E26127F126774"><enum>(1)</enum><text>in the case of a
				first violation by that person—</text>
							<subparagraph id="HC571699D855F454781003E902BC58CF8"><enum>(A)</enum><text>if the applicable
				goods are offered or displayed for sale at a total price of $1,000 or more, or
				if the applicable goods are sold for a total price of $1,000 or more—</text>
								<clause id="H0D458E4A53A344CD9F8E7E2197EA22BF"><enum>(i)</enum><text>in
				the case of an individual, be fined not more than $250,000, imprisoned for not
				more than 5 years, or both; and</text>
								</clause><clause id="H4E195E369D2B44A19B851D1083EABC4F"><enum>(ii)</enum><text>in the case of a
				person other than an individual, be fined not more than $1,000,000; and</text>
								</clause></subparagraph><subparagraph id="HB53166DCB10C4BD9BA4B673664954161"><enum>(B)</enum><text>if the applicable
				goods are offered or displayed for sale at a total price of less than $1,000,
				or if the applicable goods are sold for a total price of less than
				$1,000—</text>
								<clause id="HFF56C3B062D14E4E823C716BCF30C387"><enum>(i)</enum><text>in
				the case of an individual, be fined not more than $25,000, imprisoned for not
				more than 1 year, or both; and</text>
								</clause><clause id="HBD08A1F4977E4D56A5B546A19CC0389E"><enum>(ii)</enum><text>in the case of a
				person other than an individual, be fined not more than $100,000; and</text>
								</clause></subparagraph></paragraph><paragraph id="H69C985DE63034F928C623F79B6603BB0"><enum>(2)</enum><text>in the case of a
				subsequent violation by that person, regardless of the amount for which any
				good is offered or displayed for sale or sold—</text>
							<subparagraph id="H1807D55800D741BB89CB3FF9F7D4ECE9"><enum>(A)</enum><text>in the case of an
				individual, be fined under this title, imprisoned for not more than 15 years,
				or both; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA680C6185DF74547B80739A9EBC0B8FB"><enum>(B)</enum><text>in the case of a
				person other than an individual, be fined not more than
				$5,000,000.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H216F136E99D24C4FA2FCC5584202A9D9"><enum>(2)</enum><text>in subsection (c),
			 by striking paragraph (3) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCB8F24616F3840CBB1F0702E33E7595B" style="OLC">
					<paragraph id="HD0CC2784F5BC4C6C99B1FE33369ECBA7"><enum>(3)</enum><text>the term
				<term>Indian tribe</term>—</text>
						<subparagraph id="H2DECAB8145854B36A9EC9F62508FC0C9"><enum>(A)</enum><text>has the meaning
				given the term in section 4 of the <act-name parsable-cite="ISDA">Indian
				Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>);
				and</text>
						</subparagraph><subparagraph id="HE6FF61A7C3DC4037818648FB009D5CF6"><enum>(B)</enum><text>includes, for
				purposes of this section only, an Indian group that has been formally
				recognized as an Indian tribe by—</text>
							<clause id="H9184F9B49EAB4C7AA200577C22DE6703"><enum>(i)</enum><text>a
				State legislature;</text>
							</clause><clause id="H554D2BF3D15546438F99046FE99E1EDD"><enum>(ii)</enum><text>a
				State commission; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HA72F13C074AF4936A49507C7C0C9FEDC"><enum>(iii)</enum><text>another similar
				organization vested with State legislative tribal recognition authority;
				and</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
