			 declarations</header>
			<subsection id="H48652C5181744781BF9775C8370568AC"><enum>(a)</enum><header>Undermining of
			 Democracy by Campaign Contributions From Private Sources</header><text>Congress
			 finds and declares that the current system of privately financed campaigns for
			 election to the House of Representatives has the capacity, and is often
			 perceived by the public, to undermine democracy in the United States by—</text>
				<paragraph id="H7BF3738597984EC5B3887BBE6168BBBD"><enum>(1)</enum><text>creating a
			 conflict of interest, perceived or real, by encouraging House Members to accept
			 large campaign contributions from private interests that are directly affected
			 by Federal legislation;</text>
				</paragraph><paragraph id="HA9204B989F99480387ADF7CFD0652526"><enum>(2)</enum><text>diminishing or
			 giving the appearance of diminishing a House Member’s accountability to
			 constituents by compelling legislators to be accountable to the major
			 contributors who finance their election campaigns;</text>
				</paragraph><paragraph id="H6CA386CC2AD3447A91082E452B4CCBD8"><enum>(3)</enum><text>violating the
			 democratic principle of <quote>one person, one vote</quote> and diminishing the
			 meaning of the right to vote by allowing monied interests to have a
			 disproportionate and unfair influence within the political process;</text>
				</paragraph><paragraph id="H4A9DEBA8C0B54588AAC64D76B6B5F9B5"><enum>(4)</enum><text>imposing large,
			 unwarranted costs on taxpayers through legislative and regulatory outcomes
			 shaped by unequal access to lawmakers for campaign contributors;</text>
				</paragraph><paragraph id="HC17242FECE7346C1AD29853F5DA31799"><enum>(5)</enum><text>driving up the
			 cost of election campaigns, making it difficult for qualified candidates
			 without personal wealth or access to campaign contributions from monied
			 individuals and interest groups to mount competitive House election
			 campaigns;</text>
				</paragraph><paragraph id="H492E1A6A7BA84C549C357C8451E9B3F3"><enum>(6)</enum><text>disadvantaging
			 challengers, because large campaign contributors tend to donate their money to
			 incumbent House Members, thus causing House elections to be less competitive;
			 and</text>
				</paragraph><paragraph id="HD38985321AC0419EA895376F54E6296C"><enum>(7)</enum><text>burdening
			 incumbents with a preoccupation with fundraising and thus decreasing the time
			 available to carry out their public responsibilities.</text>
				</paragraph></subsection><subsection id="H74ED39A763564DAC90A256D46C733727"><enum>(b)</enum><header>Enhancement of
			 Democracy by Providing Allocations From the House Fair Elections
			 Fund</header><text>Congress finds and declares that providing the option of the
			 replacement of private campaign contributions with allocations from the House
			 Fair Elections Fund for all primary, runoff, and general elections to the House
			 would enhance American democracy by—</text>
				<paragraph id="H3182E72B088441AD863600B4D1001000"><enum>(1)</enum><text>eliminating the
			 potentially inherent conflict of interest created by the private financing of
			 the election campaigns of public officials, thus restoring public confidence in
			 the integrity and fairness of the electoral and legislative processes;</text>
				</paragraph><paragraph id="H228640B710064938ADB4B7C60111D431"><enum>(2)</enum><text>increasing the
			 public’s confidence in the accountability of House Members to the constituents
			 who elect them;</text>
				</paragraph><paragraph id="HD6414004043B472D8142E5131D418B6F"><enum>(3)</enum><text>helping to
			 eliminate access to wealth as a determinant of a citizen’s influence within the
			 political process and to restore meaning to the principle of <quote>one person,
			 one vote</quote>;</text>
				</paragraph><paragraph id="HD0AB578D1F9C4492B782EF484BDA68D"><enum>(4)</enum><text>reversing the
			 escalating cost of elections and saving taxpayers billions of dollars that are
			 (or that are perceived to be) currently allocated based upon legislative and
			 regulatory agendas skewed by the influence of campaign contributions;</text>
				</paragraph><paragraph id="HC8B8C961DDA34B82A654AA5D374D1DFA"><enum>(5)</enum><text>creating a more
			 level playing field for incumbents and challengers by creating genuine
			 opportunities for all Americans to run for the House and by encouraging more
			 competitive elections; and</text>
				</paragraph><paragraph id="H61C1B20D72A347C0B7944F301E78876E"><enum>(6)</enum><text>freeing House
			 Members from the incessant preoccupation with raising money, and allowing them
			 more time to carry out their public responsibilities.</text>
				</paragraph></subsection></section><title id="H41E5D4EEEC0C480BBADCCED80000D877"><enum>I</enum><header>FAIR
			 ELECTIONS FINANCING OF HOUSE ELECTION CAMPAIGNS</header>
			<subtitle id="HF3F776B6F2BE4C3396CCD42526CFA283"><enum>A</enum><header>Fair Elections
			 Financing Program</header>
				<section id="H8AAEB64C2C23453D92CB8074980002CB"><enum>101.</enum><header>Eligibility
			 requirements and benefits of fair elections financing of house election
			 campaigns</header><text display-inline="no-display-inline">The Federal Election
			 Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431 et seq.</external-xref>) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HAC86937B77554B319CF3A3B04772F193" style="OLC">
						<title id="H27F97E4F047F47C4AF3EE94B5602684D"><enum>V</enum><header>FAIR ELECTIONS
				FINANCING OF HOUSE ELECTION CAMPAIGNS</header>
							<section id="HBEFF9219D585478EBA3157AC8867A43F"><enum>501.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions
				apply:</text>
								<paragraph id="H06F3230F476A4F368D981344CDCA542B"><enum>(1)</enum><header>Allocation from
				the fund</header><text>The term <term>allocation from the Fund</term> means an
				allocation of money from the House Fair Elections Fund to a participating
				candidate pursuant to sections 510 and 511.</text>
								</paragraph><paragraph id="HB19CA7E069684B318CF97448F77157D1"><enum>(2)</enum><header>Candidate for
				the House</header><text>The term, <quote>candidate for the House</quote> means
				a candidate for election for the office of Representative in, or Delegate or
				Resident Commissioner to, the Congress.</text>
								</paragraph><paragraph id="H0DB08BF61CC84CE6A7D2164452BF7C58"><enum>(3)</enum><header>Fair elections
				qualifying period</header><text>The term <term>fair elections qualifying
				period</term> means, with respect to any candidate for The House of
				Representatives, the period—</text>
									<subparagraph id="HC91E70803D4C4DF7A83E81ED839CAF05"><enum>(A)</enum><text>beginning on the
				date on which the candidate files a statement of intent under section
				503(a)(1); and</text>
									</subparagraph><subparagraph id="HFCE67DC5CB454571943100D2D79FAE7B"><enum>(B)</enum><text>ending on the date
				that is 60 days before—</text>
										<clause id="H347AA711CD2046BE988C23C2E34C3DE9"><enum>(i)</enum><text>the date of the
				primary election; or</text>
										</clause><clause id="H165673CA39EE4B54BB00D4B9402164EB"><enum>(ii)</enum><text>in the case of a
				State that does not hold a primary election, the date prescribed by State law
				as the last day to qualify for a position on the general election
				ballot.</text>
										</clause></subparagraph></paragraph><paragraph id="H0A0ADDA7BF1A43688B56A4C0CECA0643"><enum>(4)</enum><header>Fair elections
				start date</header><text>The term <term>fair elections start date</term> means,
				with respect to any candidate, the date that is 180 days before—</text>
									<subparagraph id="HF89ECBAF283E4D5EAE43BE4D31560075"><enum>(A)</enum><text>the date of the
				primary election; or</text>
									</subparagraph><subparagraph id="H5C4A933CCD1C497EB6E29943BDE9E952"><enum>(B)</enum><text>in the case of a
				State that does not hold a primary election, the date prescribed by State law
				as the last day to qualify for a position on the general election
				ballot.</text>
									</subparagraph></paragraph><paragraph id="H9DD7F6BBFBE24AF284088ECE7F8DC83D"><enum>(5)</enum><header>Fund</header><text>The
				term <term>Fund</term> means the House Fair Elections Fund established by
				section 502.</text>
								</paragraph><paragraph id="H8EA7589FED8143A980F0AA3198012E03"><enum>(6)</enum><header>Immediate
				family</header><text>The term <term>immediate family</term> means, with respect
				to any candidate—</text>
									<subparagraph id="HE9BB91F5E67A40ED82EAC006FAC4572"><enum>(A)</enum><text>the candidate’s
				spouse;</text>
									</subparagraph><subparagraph id="HCECBC835C84D4E969F2909760048B9C7"><enum>(B)</enum><text>a child,
				stepchild, parent, grandparent, brother, half-brother, sister, or half-sister
				of the candidate or the candidate’s spouse; and</text>
									</subparagraph><subparagraph id="HE34FE92C1DAF465FA15189D7BFF083"><enum>(C)</enum><text>the spouse of any
				person described in subparagraph (B).</text>
									</subparagraph></paragraph><paragraph id="H8AEDCF6BD4AF49CABC5B70BD8E89D7DA"><enum>(7)</enum><header>Independent
				candidate</header><text>The term <term>independent candidate</term> means a
				candidate for the House who is—</text>
									<subparagraph id="H4D5C82402D5A43900006242F481B6F00"><enum>(A)</enum><text>not affiliated
				with any political party; or</text>
									</subparagraph><subparagraph id="HD8CBEF58F0BA47C2A9EDB0396765B967"><enum>(B)</enum><text>affiliated with a
				political party that—</text>
										<clause id="H073DEFC2CA1340759300F1B141061E04"><enum>(i)</enum><text>in
				the case of a candidate in a State that holds a primary election for the House,
				does not hold a primary election for the House; or</text>
										</clause><clause id="HB59C92B6843045B19FCC127DA494BCFB"><enum>(ii)</enum><text>in the case of a
				candidate in a State that does not hold primary election for the House, does
				not have ballot status in such State.</text>
										</clause></subparagraph></paragraph><paragraph id="H02346328FD774691B87F2BDD9119347D"><enum>(8)</enum><header>Major party
				candidate</header>
									<subparagraph id="H8DBA0ED9DF5F4F62B460A4472094ABC8"><enum>(A)</enum><header>In
				general</header><text>The term <term>major party candidate</term> means a
				candidate for the House who is affiliated with a major political party.</text>
									</subparagraph><subparagraph id="H665801168C5943CE9F87626601B9567"><enum>(B)</enum><header>Major political
				party</header><text>The term <term>major political party</term> means, with
				respect to any State, a political party of which a candidate for the office of
				Representative, Senator, President, or Governor at any time in the preceding 5
				years, received, as a candidate of that party in such State, 25 percent or more
				of the total number of popular votes cast for such office in such State.</text>
									</subparagraph></paragraph><paragraph id="HBA55308FD4DE4E2F97B5D4F4AFCD25CC"><enum>(9)</enum><header>Minor party
				candidate</header><text>The term <term>minor party candidate</term> means a
				candidate for the House who is affiliated with a political party that—</text>
									<subparagraph id="H2F2609F455A34F80AFA6F52E645793E8"><enum>(A)</enum><text>holds a primary
				for House nominations; and</text>
									</subparagraph><subparagraph id="HA697256C0F204475810067EB99BA823C"><enum>(B)</enum><text>is not a major
				political party.</text>
									</subparagraph></paragraph><paragraph id="HD300C0A1B6F64969B8E04D3050A761D3"><enum>(10)</enum><header>Nonparticipating
				candidate</header><text>The term <term>nonparticipating candidate</term> means
				a candidate for the House who is not a participating candidate.</text>
								</paragraph><paragraph id="H72EA2311F8A448D695D64F24AAA1FDD"><enum>(11)</enum><header>Participating
				candidate</header><text>The term <term>participating candidate</term> means a
				candidate for the House who is certified under section 508 as being eligible to
				receive an allocation from the Fund.</text>
								</paragraph><paragraph id="HA197EBA6918F416BA49D1FE617235162"><enum>(12)</enum><header>Qualifying
				contribution</header><text>The term <term>qualifying contribution</term> means,
				with respect to a candidate, a contribution that—</text>
									<subparagraph id="H94CBA27D7E6E4538B79004CE82E4666F"><enum>(A)</enum><text>is in the amount
				of $5 exactly;</text>
									</subparagraph><subparagraph id="H0F369E6C2DCD40229C00EF657B5F7DC6"><enum>(B)</enum><text>is made by an
				individual who—</text>
										<clause id="H8292399A99614D5DB46DEDC0D804C1C8"><enum>(i)</enum><text>is
				a resident of the State with respect to which the candidate is seeking
				election; and</text>
										</clause><clause id="H4BED087847714190AE52E9F701EDA52"><enum>(ii)</enum><text>is
				not prohibited from making a contribution under this Act;</text>
										</clause></subparagraph><subparagraph id="H41776FA6CA604DDEBD4D3E26EE8000E6"><enum>(C)</enum><text>is made during the
				fair elections qualifying period; and</text>
									</subparagraph><subparagraph id="H285F7D52C0C548EC96DDD5D26BB46851"><enum>(D)</enum><text>meets the
				requirements of section 505(c).</text>
									</subparagraph></paragraph><paragraph id="H8CD840B54E9E408C816EE21500FB0037"><enum>(13)</enum><header>Seed money
				contribution</header><text>The term <term>seed money contribution</term> means
				a contribution or contributions by any 1 individual—</text>
									<subparagraph id="HC0F12CD1DF9546768B96A7E434D91C2"><enum>(A)</enum><text>aggregating not
				more than $100; and</text>
									</subparagraph><subparagraph id="HA1644874A03F4183BC00A4D7A046EDF5"><enum>(B)</enum><text>made to a
				candidate after the date of the most recent previous election for the office
				which the candidate is seeking and before the date the candidate has been
				certified as a participating candidate under section 508(a).</text>
									</subparagraph></paragraph><paragraph id="HF7803D617B69422180D2BB07D92E3ED6"><enum>(14)</enum><header>State</header><text>The
				term <term>State</term> includes the District of Columbia, Puerto Rico, the
				Virgin Islands, American Samoa, and Guam.</text>
								</paragraph></section><section id="H3F9A52489AB04382A54400AB2F2CC6D9"><enum>502.</enum><header>House fair
				elections fund</header>
								<subsection id="HC901EB4035B94D5482CB613B2C777C6B"><enum>(a)</enum><header>Establishment</header><text>There
				is established in the Treasury a fund to be known as the <quote>House Fair
				Elections Fund</quote>.</text>
								</subsection><subsection id="H624C320C8B034199AE964C3B67AC2BD"><enum>(b)</enum><header>Amounts held by
				fund</header><text>The Fund shall consist of the following amounts:</text>
									<paragraph id="H17158EF064BA4FE28DAD36227FC7918"><enum>(1)</enum><header>Proceeds from
				recovered spectrum</header><text>Proceeds deposited into the Fund under section
				309(j)(8)(E)(ii)(II) of the Communications Act of 1934.</text>
									</paragraph><paragraph id="H7C43EE3B08B345C78401E556521D6100"><enum>(2)</enum><header>Excess spectrum
				user fees</header><text>Amounts deposited in the Fund under section
				315A(f)(2)(B)(ii) of the Communications Act of 1934.</text>
									</paragraph><paragraph id="H92DC8CC07FA84D9480E3DAC865000095"><enum>(3)</enum><header>Voluntary
				contributions</header><text>Voluntary contributions to the fund.</text>
									</paragraph><paragraph id="H2F1C0B92E14C4BE7A56FF3D4533B21A1"><enum>(4)</enum><header>Qualifying
				contributions, penalties, and other deposits</header><text>Amounts deposited
				into the Fund under—</text>
										<subparagraph id="HB4635478509549FAA64884F5DD2F41C3"><enum>(A)</enum><text>section 504(2)
				(relating to limitation on amount of seed money);</text>
										</subparagraph><subparagraph id="HB3667F253A004F3D861806C092006353"><enum>(B)</enum><text>section 505(d)
				(relating to deposit of qualifying contributions);</text>
										</subparagraph><subparagraph id="H5648E26084BD464FACA423B1EF499B"><enum>(C)</enum><text>section 506(c)
				(relating to exceptions to contribution requirements);</text>
										</subparagraph><subparagraph id="H124B5ACD85AE456DAF93CAAB0013BBE1"><enum>(D)</enum><text>section 509(c)
				(relating to remittance of allocations from the Fund);</text>
										</subparagraph><subparagraph id="H213A6F3053B745070031BA41A1732B41"><enum>(E)</enum><text>section 513
				(relating to violations); and</text>
										</subparagraph><subparagraph id="H8205D71C8725412CB7CD9F00A575E8BE"><enum>(F)</enum><text>any other section
				of this Act.</text>
										</subparagraph></paragraph><paragraph id="HF4373F1320E7431BACC74482FEE53A4"><enum>(5)</enum><header>Investment
				returns</header><text>Interest on, and the proceeds from, the sale or
				redemption of, any obligations held by the Fund under subsection (c).</text>
									</paragraph></subsection><subsection id="H000584429E2B4E8C921BC68B475C00D5"><enum>(c)</enum><header>Investment</header><text>The
				Commission shall invest portions of the Fund in obligations of the United
				States in the same manner as provided under section 9602(b) of the Internal
				Revenue Code of 1986.</text>
								</subsection><subsection id="HEB611535A71348F6932247AB48F1FCBF"><enum>(d)</enum><header>Use of
				fund</header>
									<paragraph id="H05FB981EA7A74632A69766A6650017CE"><enum>(1)</enum><header>In
				general</header><text>The sums in the House Fair Elections Fund shall be used
				to make allocations to participating candidates in accordance with sections 510
				and 511.</text>
									</paragraph><paragraph id="H68FFC4D58C26492D91FB6C220076C94B"><enum>(2)</enum><header>Insufficient
				amounts</header><text>Under regulations established by the Commission, rules
				similar to the rules of section 9006(c) of the Internal Revenue Code shall
				apply.</text>
									</paragraph></subsection></section><section id="H1AE7177B4A9A47828FB13BFFF9482EEC"><enum>503.</enum><header>Eligibility for
				allocations from the fund</header>
								<subsection id="H4414DA0B3FC14F7F9C508D1100C7C147"><enum>(a)</enum><header>In
				general</header><text>A candidate for the House is eligible to receive an
				allocation from the Fund for any election if the candidate meets the following
				requirements:</text>
									<paragraph id="H703952CFA71544B794EDDBBDD1DAB192"><enum>(1)</enum><text>The candidate
				files with the Commission a statement of intent to seek certification as a
				participating candidate under this title during the period beginning on the
				fair elections start date and ending on the last day of the fair elections
				qualifying period.</text>
									</paragraph><paragraph id="H43FD15FA9EF249EDB672BD50C4B3E26F"><enum>(2)</enum><text>The candidate has
				complied with the seed money contribution requirements of section 504.</text>
									</paragraph><paragraph id="HCA8A66960AD94DE9A8476579FF7CC04B"><enum>(3)</enum><text>The candidate
				meets the qualifying contribution requirements of section 505.</text>
									</paragraph><paragraph id="HD6379488CB154423965E25A05352DF08"><enum>(4)</enum><text>Not later than the
				last day of the fair elections qualifying period, the candidate files with the
				Commission an affidavit signed by the candidate and the treasurer of the
				candidate’s principal campaign committee declaring that the candidate—</text>
										<subparagraph id="H6DA6A72A09DA4A3681A403B0003200C2"><enum>(A)</enum><text>has complied and,
				if certified, will comply with the contribution and expenditure requirements of
				section 506;</text>
										</subparagraph><subparagraph id="HDC0791CB371E43D785E97CB2200E63D"><enum>(B)</enum><text>if certified, will
				comply with the debate requirements of section 507;</text>
										</subparagraph><subparagraph id="H17C94D3D1EF94BDFB99CC4C2D9B5C8F2"><enum>(C)</enum><text>if certified, will
				not run as a nonparticipating candidate during such year in any election for
				the office that such candidate is seeking; and</text>
										</subparagraph><subparagraph id="HCB08F2BBA2714A9FAB4650A13C009FE3"><enum>(D)</enum><text>has either
				qualified or will take steps to qualify under State law to be on the
				ballot.</text>
										</subparagraph></paragraph></subsection><subsection id="HD166CF74DCDF48D5A3DC1CAC6B94D2DA"><enum>(b)</enum><header>General
				election</header><text>Notwithstanding subsection (a), a candidate shall not be
				eligible to receive an allocation from the Fund for a general election or a
				general runoff election unless the candidate’s party nominated the candidate to
				be placed on the ballot for the general election or the candidate qualified to
				be placed on the ballot as an independent candidate, and the candidate is
				qualified under State law to be on the ballot.</text>
								</subsection></section><section id="H07B392430ADC4981BE2B2D69D6F4816E"><enum>504.</enum><header>Seed money
				contribution requirement</header><text display-inline="no-display-inline">A
				candidate for the House meets the seed money contribution requirements of this
				section if the candidate meets the following requirements:</text>
								<paragraph id="HDDA046CD1E944748B5183BA7E36D31B4"><enum>(1)</enum><header>Separate
				accounting</header><text>The candidate maintains seed money contributions in a
				separate account.</text>
								</paragraph><paragraph id="HB0C002F6B1444D418294FC2BB600F777"><enum>(2)</enum><header>Limitation on
				amount</header><text>The candidate deposits into the House Fair Elections Fund
				or returns to donors an amount equal to the amount of any seed money
				contributions which, in the aggregate, exceed the sum of—</text>
									<subparagraph id="HBA0033D108EE49F6005E36285335B4DE"><enum>(A)</enum><text>in the case of an
				independent candidate, the amount which the candidate would be entitled to
				under section 510(c)(3); and</text>
									</subparagraph><subparagraph id="H97FBDA1237EB4C3DA236A335E879C509"><enum>(B)</enum><text>in the case of any
				other candidate, the amount which the candidate would be entitled to under
				section 510(c)(1).</text>
									</subparagraph></paragraph><paragraph id="H35E8276E1DF841C3B7BFCE9063A400A1"><enum>(3)</enum><header>Use of seed
				money</header><text>The candidate makes expenditures from seed money
				contributions only for campaign-related costs.</text>
								</paragraph><paragraph id="HF391E6A1362B43CCA4A0FF36A001069"><enum>(4)</enum><header>Records</header><text>The
				candidate maintains a record of the name and street address of any contributor
				of a seed money contribution and the amount of any such contribution.</text>
								</paragraph><paragraph id="HC933E886745E4122A2BE3B63EBADD145"><enum>(5)</enum><header>Report</header><text>Unless
				a seed money contribution or an expenditure made with a seed money contribution
				has been reported previously under section 304, the candidate files with the
				Commission a report disclosing all seed money contributions and expenditures
				not later than 48 hours after receiving notification of the determination with
				respect to the certification of the candidate under section 508.</text>
								</paragraph></section><section id="H769D1FE2747C4CF9AE9303DDE07BC3EA"><enum>505.</enum><header>Qualifying
				contribution requirement</header>
								<subsection id="HCDBAD7AB3CA549CABA1D2FDD91703E4C"><enum>(a)</enum><header>In
				general</header><text>A candidate for the House meets the requirement of this
				section if, during the fair elections qualifying period, the candidate obtains
				at least 1,500 qualifying contributions.</text>
								</subsection><subsection id="H39D4EA2A93E349388855DD1FDD721814"><enum>(b)</enum><header>Special rule for
				certain candidates</header>
									<paragraph id="HABDE8931CF9E45BEA8039C87684FC5F"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding subsection (a), in the case of a
				candidate described in paragraph (2), the requirement of this section is met
				if, during the fair elections qualifying period, the candidate obtains a number
				of qualifying contributions equal to 150 percent of the number of qualifying
				contributions that such candidate would be required to obtain without regard to
				this subsection.</text>
									</paragraph><paragraph id="H832747BC33B34100B2DFA2EB1083336"><enum>(2)</enum><header>Candidate
				described</header><text>A candidate is described in this paragraph if—</text>
										<subparagraph id="HA68A0C72ADDC496D927EDDBF749F04DF"><enum>(A)</enum><text>the candidate is a
				minor party candidate or an independent candidate; and</text>
										</subparagraph><subparagraph id="HCD99C31905EB40409229EF637EE61B27"><enum>(B)</enum><text>in the most recent
				general election involving the office of the House, President, or Governor in
				the State in which the candidate is seeking office, the candidate and all
				candidates of the same political party as such candidate received less than 5
				percent of the total number of votes cast for each such office.</text>
										</subparagraph></paragraph></subsection><subsection id="H25FD9207F136478EB3EFA8ACE892E8B"><enum>(c)</enum><header>Requirements
				relating to receipt of qualifying contribution</header><text>Each qualifying
				contribution—</text>
									<paragraph id="HF914E76100B14086A212CCEE1EA9525"><enum>(1)</enum><text>may be made by
				means of a personal check, money order, debit card, or credit card;</text>
									</paragraph><paragraph id="H37815A8F79F84BDF9DDF58A69FE7865B"><enum>(2)</enum><text>shall be payable
				to the House Fair Elections Fund;</text>
									</paragraph><paragraph id="H111E7FE77B8B4FBBB7DC9B00277518B8"><enum>(3)</enum><text>shall be
				accompanied by a signed statement containing—</text>
										<subparagraph id="H9960C9CC15AE4E7998D190AB8B18B3F4"><enum>(A)</enum><text>the contributor’s
				name and home address;</text>
										</subparagraph><subparagraph id="HD99CB3B6671D4D39BFFE7ED0B9A550C3"><enum>(B)</enum><text display-inline="yes-display-inline">an oath declaring that the
				contributor—</text>
											<clause id="H50227F0181EF4D9385575B227FD0B544"><enum>(i)</enum><text>is
				a resident of the State in which the candidate with respect to whom the
				contribution is made is running for election;</text>
											</clause><clause id="H0B79BBDA8A9645FFBBFF4536594CA0CA"><enum>(ii)</enum><text>understands that
				the purpose of the qualifying contribution is to show support for the candidate
				so that the candidate may qualify for public financing;</text>
											</clause><clause id="H428DB1518DBA4A51BCB9E93CE6FD75"><enum>(iii)</enum><text>is
				making the contribution in his or her own name and from his or her own
				funds;</text>
											</clause><clause id="H1D2E2092F5244F4E9D48DEBBDE6E719"><enum>(iv)</enum><text>has made the
				contribution willingly; and</text>
											</clause><clause id="H86E3851A954249179864FC003D41BEFE"><enum>(v)</enum><text>has not received
				any thing of value in return for the contribution; and</text>
											</clause></subparagraph></paragraph><paragraph id="HB35057EDB2374F458511FEF06294DA3F"><enum>(4)</enum><text>shall be
				acknowledged by a receipt that is sent to the contributor with a copy kept by
				the candidate for the Commission and a copy kept by the candidate for the
				election authorities in the State with respect to which the candidate is
				seeking election.</text>
									</paragraph></subsection><subsection id="H6F26095CAECD48AC83D3612BA31B6F57"><enum>(d)</enum><header>Deposit of
				qualifying contributions</header>
									<paragraph id="H6C1E9EA6774941109B30F07EBA230258"><enum>(1)</enum><header>In
				general</header><text>Not later than 21 days after obtaining a qualifying
				contribution, a candidate shall—</text>
										<subparagraph id="H9C02F5B0B5C64F26AD85E3A7C419F6E4"><enum>(A)</enum><text>deposit such
				contribution into the House Fair Elections Fund, and</text>
										</subparagraph><subparagraph id="H0D20859B62FA4C3FB1C821EE666B6484"><enum>(B)</enum><text>remit to the
				Commission a copy of the receipt for such contribution.</text>
										</subparagraph></paragraph><paragraph id="H64270FD8F36140B194DBABF187AF459D"><enum>(2)</enum><header>Deposit of
				contributions after certification</header><text>Notwithstanding paragraph (1),
				all qualifying contributions obtained by a candidate shall be deposited into
				the House Fair Elections Fund and all copies of receipts for such contributions
				shall be remitted to the Commission not later than—</text>
										<subparagraph id="HB87CE0B62B6348AE00C3F5F7DEF368F9"><enum>(A)</enum><text>in the case of a
				candidate who is denied certification under section 508, 3 days after receiving
				a notice of denial of certification under section 508(a)(2); and</text>
										</subparagraph><subparagraph id="H98E603C44CBC4131B5F6CEF3B41E964B"><enum>(B)</enum><text>in any other case,
				not later than the last day of the fair elections qualifying period.</text>
										</subparagraph></paragraph></subsection><subsection id="H5092E769DDD742AE982015DD4B818F00"><enum>(e)</enum><header>Verification of
				qualifying contributions</header><text>The Commission shall establish
				procedures for the auditing and verification of qualifying contributions to
				ensure that such contributions meet the requirements of this section. Such
				procedures may provide for verification through the means of a postcard or
				other method, as determined by the Commission.</text>
								</subsection></section><section id="H93838D7E2E354F9CB957C39DF738551"><enum>506.</enum><header>Contribution and
				expenditure requirements</header>
								<subsection id="HD3401DE519EA4AAD95E61C13E0C52B1F"><enum>(a)</enum><header>General
				rule</header><text>A candidate for the House meets the requirements of this
				section if, during the election cycle of the candidate, the candidate—</text>
									<paragraph id="H5F5EDA32709D4ACBA54DD3CF9D13968"><enum>(1)</enum><text>except as provided
				in subsection (b), accepts no contributions other than—</text>
										<subparagraph id="H35F4F1EECB9B46F78CA3DF25B16953B"><enum>(A)</enum><text>seed money
				contributions;</text>
										</subparagraph><subparagraph id="H25D815BC61CF4AF7959C7F951656E07E"><enum>(B)</enum><text>qualifying
				contributions made payable to the House Fair Elections Fund;</text>
										</subparagraph><subparagraph id="H166AB3CE210E478EAE7525F98ECEF67C"><enum>(C)</enum><text>allocations from
				the House Fair Elections Fund under sections 510 and 511; and</text>
										</subparagraph><subparagraph id="HFBF1867B5DF84B33A665DC6C794E763C"><enum>(D)</enum><text>vouchers provided
				to the candidate under section 315A of the Communications Act of 1934;</text>
										</subparagraph></paragraph><paragraph id="H2F4EE6C089834989BA9BC22220FDF0AE"><enum>(2)</enum><text>makes no
				expenditures from any amounts other than from—</text>
										<subparagraph id="HF6F276DF3ECA4EC2AA683BF349CF429"><enum>(A)</enum><text>amounts received
				from seed money contributions;</text>
										</subparagraph><subparagraph id="H5782E3F07137434DBC6700FC9500FC00"><enum>(B)</enum><text>amounts received
				from the House Fair Elections Fund; and</text>
										</subparagraph><subparagraph id="HC7746F8D08204CF7B8F58667C2788877"><enum>(C)</enum><text>vouchers provided
				to the candidate under section 315A of the Communications Act of 1934;
				and</text>
										</subparagraph></paragraph><paragraph id="H942403F912C14F1CA700CD4E6B82CC51"><enum>(3)</enum><text>makes no
				expenditures from personal funds or the funds of any immediate family member
				(other than funds received through seed money contributions).</text>
									</paragraph><continuation-text continuation-text-level="subsection">For
				purposes of this subsection, a payment made by a political party in
				coordination with a participating candidate shall not be treated as a
				contribution to or as an expenditure made by the participating
				candidate.</continuation-text></subsection><subsection id="H9A74420487954D0697B44611340743D5"><enum>(b)</enum><header>Contributions
				for leadership PACs, etc</header><text>A political committee of a participating
				candidate which is not an authorized committee of such candidate may accept
				contributions other than contributions described in subsection (a)(1) from any
				person if—</text>
									<paragraph id="H5B44CB254FEC4648A5831EE623471C22"><enum>(1)</enum><text>the aggregate
				contributions from such person for any for a calendar year do not exceed $100;
				and</text>
									</paragraph><paragraph id="H9163E563388D4AE4B3D976414B2187A9"><enum>(2)</enum><text>no portion of such
				contributions is disbursed in connection with the campaign of the participating
				candidate.</text>
									</paragraph></subsection><subsection id="H01DCB87014A942E1AFA31EA137BCF77"><enum>(c)</enum><header>Exception</header>
									<paragraph id="HA5E49E86372E4FDFA800689D9D3D2615"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding subsection (a), a candidate shall not be
				treated as having failed to meet the requirements of this section if any
				contributions accepted before the date the candidate files a statement of
				intent under section 503(a)(1) are not expended and are—</text>
										<subparagraph id="HFF400A24AE3C4164A7F78DB49E44C2E9"><enum>(A)</enum><text>returned to the
				contributor; or</text>
										</subparagraph><subparagraph id="H75E534FE86924F1EB417D538E25FAB84"><enum>(B)</enum><text>submitted to the
				Commission for deposit in the House Fair Elections Fund.</text>
										</subparagraph></paragraph><paragraph id="H26B3027E4F1040AA89536D54A3915EFA"><enum>(2)</enum><header>Special rule for
				seed money contributions and contributions for leadership
				pacs</header><text>For purposes of paragraph (1), a candidate shall not be
				required to return, donate, or submit any portion of the aggregate amount of
				contributions from any person which is $100 or less to the extent that such
				contribution—</text>
										<subparagraph id="H6C49438E2C7F4778A09B4ED5E7FD0091"><enum>(A)</enum><text>otherwise
				qualifies as a seed money contribution; or</text>
										</subparagraph><subparagraph id="HECD61DBB6AAA421AA31BCC4089E100A3"><enum>(B)</enum><text>otherwise meets
				the requirements of subsection (b).</text>
										</subparagraph></paragraph><paragraph id="H9326C93E2386472A8DFFA5C596001300"><enum>(3)</enum><header>Special rule for
				contributions before the date of enactment of this
				title</header><text>Notwithstanding subsection (a), a candidate shall not be
				treated as having failed to meet the requirements of this section if any
				contributions accepted before the date of the enactment of this title are not
				expended and are—</text>
										<subparagraph id="H30328412D97048C08F1DDC09008BC034"><enum>(A)</enum><text>returned to the
				contributor;</text>
										</subparagraph><subparagraph id="H920CC2D2A3F34EE6B5346B8CE2B59435"><enum>(B)</enum><text>donated to an
				organization described in section 170(c) of the Internal Revenue Code of
				1986;</text>
										</subparagraph><subparagraph id="HDA5E577569F14418BE451C19E2580321"><enum>(C)</enum><text>donated to a
				political party;</text>
										</subparagraph><subparagraph id="H8F02F92F987D4A968CC0C2276CD11EA"><enum>(D)</enum><text>used to retire
				campaign debt; or</text>
										</subparagraph><subparagraph id="H5DB251B503EE419C87CCC788DE5EEF7B"><enum>(E)</enum><text>submitted to the
				Federal Election Commission for deposit in the House Fair Elections
				Fund.</text>
										</subparagraph></paragraph></subsection></section><section id="HD48D2913A47143AF86941134A69363E8"><enum>507.</enum><header>Debate
				requirement</header><text display-inline="no-display-inline">A candidate for
				the House meets the requirements of this section if the candidate participates
				in at least—</text>
								<paragraph id="H2716A7173C914C9EB15D80C58FE6CC3E"><enum>(1)</enum><text>1 public debate
				before the primary election with other participating candidates and other
				willing candidates from the same party and seeking the same nomination as such
				candidate; and</text>
								</paragraph><paragraph id="HB504A15837D741DAB4CC080753838669"><enum>(2)</enum><text>2 public debates
				before the general election with other participating candidates and other
				willing candidates seeking the same office as such candidate.</text>
								</paragraph></section><section id="H64E73C8B09584419B832B3F2C44457D1"><enum>508.</enum><header>Certification
				by commission</header>
								<subsection id="HAE8D1104A6D84C19BBCBF982D3372882"><enum>(a)</enum><header>In
				general</header><text>Not later than 5 days after a candidate for the House
				files an affidavit under section 503(a)(4), the Commission shall—</text>
									<paragraph id="HBBC12FF655F74DCB00D960DA5EB3B"><enum>(1)</enum><text>certify whether or
				not the candidate is a participating candidate; and</text>
									</paragraph><paragraph id="HF547FF4A7C4F432AB557FF244E8809A6"><enum>(2)</enum><text>notify the
				candidate of the Commission’s determination.</text>
									</paragraph></subsection><subsection id="HAA352400FFC34CFDBA453B72A8169CE2"><enum>(b)</enum><header>Revocation of
				certification</header>
									<paragraph id="H4F80D64D4BBF4F698220A4E250CD15D"><enum>(1)</enum><header>In
				general</header><text>The Commission may revoke a certification under
				subsection (a) if—</text>
										<subparagraph id="H147BB39472D344ACB938A023FC77ED2"><enum>(A)</enum><text>a candidate fails
				to qualify to appear on the ballot at any time after the date of certification;
				or</text>
										</subparagraph><subparagraph id="HBBA140EDC7784123A11778071511FF55"><enum>(B)</enum><text>a candidate
				otherwise fails to comply with the requirements of this title.</text>
										</subparagraph></paragraph><paragraph id="H9769BC69C82346FBBD297F0012FF17F"><enum>(2)</enum><header>Repayment of
				benefits</header><text>If certification is revoked under paragraph (1), the
				candidate shall repay—</text>
										<subparagraph id="H5463341B83BC4D51A72DA58D6BE0C6D8"><enum>(A)</enum><text>to the House Fair
				Elections Fund an amount equal to the value of benefits received under this
				title plus interest (at a rate determined by the Commission) on any such amount
				received; and</text>
										</subparagraph><subparagraph id="H2100D82735A24D238C2988A412E02EE5"><enum>(B)</enum><text>to the Federal
				Communications Commission an amount equal to the amount of the dollar value of
				vouchers which were received from the Federal Communications Commission under
				section 315A of the Communications Act of 1934 and used by the
				candidate.</text>
										</subparagraph></paragraph></subsection></section><section id="HDB7220EEF2894792A38B8C60DDCB32BB"><enum>509.</enum><header>Benefits for
				participating candidates</header>
								<subsection id="HC8A125D223944D52BA3B00C45BC24992"><enum>(a)</enum><header>In
				general</header><text>A participating candidate shall be entitled to—</text>
									<paragraph id="H86DE8AEA584F41598B03DC94CBBAEE1"><enum>(1)</enum><text>for each election
				with respect to which a candidate is certified as a participating
				candidate—</text>
										<subparagraph id="HD3437ABBBE1C4B8A951B51131CF386CA"><enum>(A)</enum><text>an allocation from
				the Fund to make or obligate to make expenditures with respect to such
				election, as provided in section 510; and</text>
										</subparagraph><subparagraph id="H7850BFFEC9E14C828E002E80098EA400"><enum>(B)</enum><text>fair fight funds,
				as provided in section 511; and</text>
										</subparagraph></paragraph><paragraph id="H4168FD63BA7B4ADB968EDE2D35C239DA"><enum>(2)</enum><text>for the general
				election, vouchers for broadcasts of political advertisements, as provided in
				section 315A of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/315A">47 U.S.C. 315A</external-xref>).</text>
									</paragraph></subsection><subsection id="HB81794FBA5FF415398928903A2D2B9C7"><enum>(b)</enum><header>Restriction on
				uses of allocations from the fund</header><text>Allocations from the Fund
				received by a participating candidate under sections 510 and 511 may only be
				used for campaign-related costs.</text>
								</subsection><subsection id="H78EF9013D3104784A50636633F6E5FF2"><enum>(c)</enum><header>Remitting
				allocations from the fund</header><text>Not later than the date that is 45 days
				after the date of the election, a participating candidate shall remit to the
				Commission for deposit in the House Fair Elections Fund any unspent amounts
				paid to such candidate under this title for such election.</text>
								</subsection></section><section id="HC1CB67335AEE4A78A13771A4C08CCA6E"><enum>510.</enum><header>Allocations
				from the fund</header>
								<subsection id="H5AE92CA5657F42C68BB8F2FDDA18F59"><enum>(a)</enum><header>In
				general</header><text>The Commission shall make allocations from the Fund under
				section 509(a)(1)(A) to a participating candidate—</text>
									<paragraph id="HC61E399B57FF4DE38B6272A0003EBA44"><enum>(1)</enum><text>in the case of
				amounts provided under subsection (c)(1), not later than 48 hours after the
				date on which such candidate is certified as a participating candidate under
				section 508;</text>
									</paragraph><paragraph id="H09D10D3A1A1C48059300303380C1E12E"><enum>(2)</enum><text>in the case of a
				general election, not later than 48 hours after—</text>
										<subparagraph id="H705C1134A18548AEBE7115378BBC06B"><enum>(A)</enum><text>the date the
				certification of the results of the primary election or the primary runoff
				election; or</text>
										</subparagraph><subparagraph id="HB05DE027DC144E82BDBF2685F09BED2"><enum>(B)</enum><text>in any case in
				which there is no primary election, the date the candidate qualifies to be
				placed on the ballot; and</text>
										</subparagraph></paragraph><paragraph id="HD6EFBBB238B94AA78E61A6C6117FB00"><enum>(3)</enum><text>in the case of a
				primary runoff election or a general runoff election, not later than 48 hours
				after the certification of the results of the primary election or the general
				election, as the case may be.</text>
									</paragraph></subsection><subsection id="H85B8F338848B45C8946FCB45D999F16B"><enum>(b)</enum><header>Method of
				payment</header><text>The Commission shall distribute funds available to
				participating candidates under this section through the use of an electronic
				funds exchange or a debit card.</text>
								</subsection><subsection id="H1798553CB2D8440EA359662D01F79D02"><enum>(c)</enum><header>Amounts</header>
									<paragraph id="H2E69072904BC431D83A42493538D04C1"><enum>(1)</enum><header>Primary election
				allocation; initial allocation</header>
										<subparagraph id="H52FEB619E7284572BA0500853628B646"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraphs (B), the Commission
				shall make an allocation from the Fund for a primary election to a
				participating candidate in an amount equal to 40 percent of the base amount
				with respect to such participating candidate.</text>
										</subparagraph><subparagraph id="H9AD88EF26FAF4EF9A59C505583E42EA"><enum>(B)</enum><header>Independent
				candidates</header><text>In the case of a participating candidate who is an
				independent candidate, the Commission shall make an initial allocation from the
				Fund in an amount equal to 25 percent of the base amount with respect to such
				candidate.</text>
										</subparagraph><subparagraph id="H9CEBEEE5833B4D549DF3FED8C61B2254"><enum>(C)</enum><header>Reduction for
				excess seed money</header><text>An allocation from the Fund for any candidate
				under this paragraph shall be reduced by an amount equal to the aggregate
				amount of seed money contributions received by the candidate in excess of
				$75,000.</text>
										</subparagraph></paragraph><paragraph id="HA7656AADD29F4A75BFCE6BC4C8170004"><enum>(2)</enum><header>Primary runoff
				election allocation</header><text>The Commission shall make an allocation from
				the Fund for a primary runoff election to a participating candidate in an
				amount equal to 25 percent of the amount the participating candidate was
				eligible to receive under this section for the primary election.</text>
									</paragraph><paragraph id="HE367E5C66745458595816FCD71AC00AD"><enum>(3)</enum><header>General election
				allocation</header>
										<subparagraph id="HCC88F1EBE01D45D28527699F8F87C5EC"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the Commission
				shall make an allocation from the Fund for a general election to a
				participating candidate in an amount equal to 60 percent of the base
				amount.</text>
										</subparagraph><subparagraph id="HE20EB2D1ED9F40F5AEFB06B701486C52"><enum>(B)</enum><header>Uncontested
				elections</header>
											<clause id="H674AC3D4B14F438BACB120BCDDA340B"><enum>(i)</enum><header>In
				general</header><text>The Commission shall make an allocation from the Fund to
				a participating candidate for a general election that is uncontested in an
				amount equal to 40 percent of the amount otherwise provided.</text>
											</clause><clause id="HBF243ED31B524B4A89459B7489DAC41E"><enum>(ii)</enum><header>Uncontested
				elections</header><text>For purposes of this subparagraph, an election is
				uncontested if not more than 1 candidate has received contributions (including
				payments from the House Fair Elections Fund) in an amount equal to or greater
				than the lesser of—</text>
												<subclause id="H84C4860498D6425A9435EE9F5C53398B"><enum>(I)</enum><text>the amount in
				effect for a candidate in such election under paragraph (1)(C); or</text>
												</subclause><subclause id="H0448C085E01F4E07A267EA1ED9974E"><enum>(II)</enum><text>an amount equal to
				50 percent of the base amount with respect to such candidate.</text>
												</subclause></clause></subparagraph><subparagraph id="H09347FD032D1454500A7EE5BF496963F"><enum>(C)</enum><header>Reduction for
				excess seed money</header><text>The allocation from the Fund for the general
				election for any participating candidate in a State that does not hold a
				primary election shall be reduced by an amount equal to the aggregate amount of
				seed money contributions received by the candidate in excess of $75,000.</text>
										</subparagraph></paragraph><paragraph id="H45B57EEB4C0A4ED7A500F7BAC640FE2C"><enum>(4)</enum><header>General runoff
				election allocation</header><text>The Commission shall make an allocation from
				the Fund for a general runoff election to a participating candidate in an
				amount equal to 25 percent of the base amount with respect to such
				candidate.</text>
									</paragraph></subsection><subsection id="H51B8FA9C4DB2470DAD2F8F00E1D97CEF"><enum>(d)</enum><header>Base
				amount</header>
									<paragraph id="H5738CDC76DA646C68197B7649F38F910"><enum>(1)</enum><header>In
				general</header><text>Except as otherwise provided in this subsection, the base
				amount for any candidate is 80 percent of the national average spending for the
				cycle by winning candidates in the last two election cycles.</text>
									</paragraph><paragraph id="H94CE128A47CF492FAB00B3E0D9CDF658"><enum>(2)</enum><header>Minor party and
				independent candidates</header>
										<subparagraph id="H6214CE35062F4B6890F751B9F7036A"><enum>(A)</enum><header>Reduced amount for
				certain candidates</header>
											<clause id="H5055684BFDE348C8A082DA7E09C432EF"><enum>(i)</enum><header>In
				general</header><text>In the case of a minor party candidate or independent
				candidate described in clause (ii), the amount provided is an amount equal to
				the product of—</text>
												<subclause id="H42F0451C5887492DA89B71D523A7711E"><enum>(I)</enum><text>a fraction the
				numerator of which is the highest percentage of the vote received by the
				candidate or a candidate of the same political party as such candidate in the
				election described in clause (ii) and the denominator of which is 25 percent;
				and</text>
												</subclause><subclause id="HF7B0BC339F914AFE00BEDC0727644763"><enum>(II)</enum><text>the amount that
				would (but for this paragraph) be the amount provided for the candidate under
				paragraph (1).</text>
												</subclause></clause><clause id="H9B0CFCB92F0A421B895B6B071600A325"><enum>(ii)</enum><header>Candidate
				described</header><text>A candidate is described in this clause if, in the most
				recent general election involving the office of the House, Senate, President,
				or Governor in the State in which the candidate is seeking office—</text>
												<subclause id="H2B48D504E7374F789FEE5F00FD21A3E9"><enum>(I)</enum><text>such candidate, or
				any candidate of the same political party as such candidate, received 5 percent
				or more of the total number of votes cast for any such office; and</text>
												</subclause><subclause id="H4508F66B011D423DBAF4B448DBD3AE9"><enum>(II)</enum><text>such candidate and
				all candidates of the same political party as such candidate received less than
				25 percent of the total number of votes cast for such office.</text>
												</subclause></clause></subparagraph><subparagraph id="H8BB8F7DD617449898FE9F2CCD1A5187"><enum>(B)</enum><header>Exception</header><text>Subparagraph
				(A) shall not apply to any candidate if such candidate receives a number of
				qualifying contributions which is greater than 150 percent of the number of
				qualifying contributions such candidate is required to receive in order to meet
				the requirements of section 505(a).</text>
										</subparagraph></paragraph><paragraph id="H6C66C94603574445B337126FCB87F1F"><enum>(3)</enum><header>Indexing</header><text>In
				each odd-numbered year after 2010—</text>
										<subparagraph id="H3270C6D6727441F3870039009B322751"><enum>(A)</enum><text>each dollar amount
				under paragraph (1) shall be increased by the percent difference between the
				price index (as defined in section 315(c)(2)(A)) for the 12 months preceding
				the beginning of such calendar year and the price index for calendar year
				2008;</text>
										</subparagraph><subparagraph id="HD8FFB8CAE04645DE82CE1100FBF7F42"><enum>(B)</enum><text>each dollar amount
				so increased shall remain in effect for the 2-year period beginning on the
				first day following the date of the last general election in the year preceding
				the year in which the amount is increased and ending on the date of the next
				general election; and</text>
										</subparagraph><subparagraph id="HA29ACC17F1344584B647ED1DF5FB366F"><enum>(C)</enum><text>if any amount
				after adjustment under subparagraph (A) is not a multiple of $100, such amount
				shall be rounded to the nearest multiple of $100.</text>
										</subparagraph></paragraph><paragraph id="H204D9983D9434E069CA94501B5B5049D"><enum>(4)</enum><header>Adjustment by
				media market</header>
										<subparagraph id="H30EB5980ABE9437EA2D010DB42B0067D"><enum>(A)</enum><header>In
				general</header><text>The Commission, in consultation with the Federal
				Communications Commission, shall establish an index reflecting the costs of the
				media markets in each State.</text>
										</subparagraph><subparagraph id="H79ED79FCC8AA43589E8F017B8D6B5E5B"><enum>(B)</enum><header>Adjustment</header><text>At
				the beginning of each year, the Commission shall increase the amount under
				paragraph (1) (after application of paragraph (3)) based on the index
				established under subparagraph (A).</text>
										</subparagraph></paragraph></subsection></section><section id="HD67ECF175E924F85982CABE58F0032C3"><enum>511.</enum><header>Payment of fair
				fight funds</header>
								<subsection id="HD52E3B33A3734D70A22F2702DED5AD14"><enum>(a)</enum><header>Determination of
				right to payment</header>
									<paragraph id="H711FEF17B20B4B0A94E044AB57AAEE1E"><enum>(1)</enum><header>In
				general</header><text>The Commission shall, on a regular basis, make a
				determination on—</text>
										<subparagraph id="H618F6A43203545FB94F07F8E6FF4EE7E"><enum>(A)</enum><text>the amount of
				opposing funds with respect to each participating candidate, and</text>
										</subparagraph><subparagraph id="H496E5753AD4D4798BAB834D1C118674C"><enum>(B)</enum><text>the applicable
				amount with respect to each participating candidate.</text>
										</subparagraph></paragraph><paragraph id="H9356F24087114DDA983608F848A71BD6"><enum>(2)</enum><header>Basis of
				determinations</header><text>The Commission shall make determinations under
				paragraph (1) based on—</text>
										<subparagraph id="HD87FD3A103D34F81A0DECD00DCE85BA8"><enum>(A)</enum><text>reports filed by
				the relevant opposing candidate under section 304(a) with respect to amounts
				described in subsection (c)(1)(A)(i)(I);</text>
										</subparagraph><subparagraph id="HF8E8D394694E432BA6E5D69440BC4E38"><enum>(B)</enum><text>reports filed by
				political committees under section 304(a) and by other persons under section
				304(c) with respect to—</text>
											<clause id="HD23DB9D9C5EF4BAB86F29FCE63480088"><enum>(i)</enum><text>opposing funds
				described in clauses (ii)(I) and (iii)(I) of subsection (c)(1)(A); and</text>
											</clause><clause id="H9F3160BB67674FB89B63D5F95144EC7D"><enum>(ii)</enum><text>applicable
				amounts described in subparagraphs (B)(i) and (C)(i) of subsection (b)(2);
				and</text>
											</clause></subparagraph><subparagraph id="H14029574E98742E78EC0060098AEDCBC"><enum>(C)</enum><text>reports filed by
				nonparticipating candidates under section 304(j).</text>
										</subparagraph></paragraph><paragraph id="H11E942E146884E6DA77984BD4478FA37"><enum>(3)</enum><header>Requests for
				determination relating to certain electioneering communications</header>
										<subparagraph id="HF03BCD69EF49427CAA1EB52251F9B141"><enum>(A)</enum><header>In
				general</header><text>A participating candidate may request to the Commission
				to make a determination under paragraph (1) with respect to any relevant
				opposing candidate with respect to—</text>
											<clause id="H228637131D424F0A9EB323D7FA3E95C"><enum>(i)</enum><text>opposing funds
				described in clauses (ii)(II) and (iii)(II) of subsection (c)(1)(A); and</text>
											</clause><clause id="HEB0AD65D62BA4CC8BE5E293544F7D6C8"><enum>(ii)</enum><text>applicable
				amounts described in subparagraphs (B)(ii) and (C)(ii) of subsection
				(b)(2).</text>
											</clause></subparagraph><subparagraph id="HE61214F040804E47BC32384BF53499B1"><enum>(B)</enum><header>Time for making
				determination</header><text>In the case of any such request, the Commission
				shall make such determination and notify the participating candidate of such
				determination not later than—</text>
											<clause id="H3328DA8F2D974E63ACCB96ACAC6150E9"><enum>(i)</enum><text>24
				hours after receiving such request during the 3-week period ending on the date
				of the election, and</text>
											</clause><clause id="H6595129EDAC7455490E53120523C44DE"><enum>(ii)</enum><text>48 hours after
				receiving such request at any other time.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="H768DA13ADBEA4D20A6C96C4C15E54922"><enum>(b)</enum><header>Payments</header>
									<paragraph id="H2454DA98962B46DD9BDAFE0064687000"><enum>(1)</enum><header>In
				general</header><text>The Commission shall make available to the participating
				candidate fair fight funds in an amount equal to the amount of opposing funds
				that is in excess of the applicable amount—</text>
										<subparagraph id="HCFB50149EC384160A628483CEC9DC7BE"><enum>(A)</enum><text>immediately after
				making any determination under subsection (a) with respect to any participating
				candidate during the 3-week period ending on the date of the election,
				and</text>
										</subparagraph><subparagraph id="H1EC0C5B1700A4C20B77C3C31A3C4C39B"><enum>(B)</enum><text>not later than 24
				hours after making such determination at any other time.</text>
										</subparagraph></paragraph><paragraph id="HBF19BB22F7064E959F5BBFDBDB28BF16"><enum>(2)</enum><header>Applicable
				amount</header><text>For purposes of this section, the applicable amount is an
				amount equal to the sum of—</text>
										<subparagraph id="HAB4F946F04064B5B8B22A393DF0613C7"><enum>(A)</enum><text>the sum of—</text>
											<clause id="HC1F8036944CC42A88B23B49C4DC63DAF"><enum>(i)</enum><text>the amount of seed
				money contribution received by the participating candidate;</text>
											</clause><clause id="HECC6461C42234BCE91E680483183854F"><enum>(ii)</enum><text>in the case of a
				general election, the value of any vouchers received by the candidate under
				section 315A of the Communications Act of 1934; plus</text>
											</clause><clause id="H0C6207936C6B43EEB85566C8E5ACDED2"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H2A26A1ADC6A34510A33D65DAFBA9E3E7"><enum>(I)</enum><text>in the case of a
				participating candidate who is a minor party candidate running in a general
				election or an independent candidate, the allocation from the Fund which would
				have been provided to such candidate for such election if such candidate were a
				major party candidate; or</text>
												</subclause><subclause id="H0A06D0CD3A224821B5CF5E8096CB268" indent="up1"><enum>(II)</enum><text>in the case of any other participating
				candidate, an amount equal to the allocation from the Fund to such candidate
				for such election under section 510(c);</text>
												</subclause></clause></subparagraph><subparagraph id="H11F703AA9E5245AA00B7119D8FA3EC62"><enum>(B)</enum><text>the sum of—</text>
											<clause id="HA3B2E73FC006423592C51E655BA23448"><enum>(i)</enum><text>the amount of
				independent expenditures made advocating the election of the participating
				candidate; plus</text>
											</clause><clause id="H9DE058577AAC4174840049B273B9C600"><enum>(ii)</enum><text>the amount of
				disbursements for electioneering communications which promote or support such
				participating candidate;</text>
											</clause></subparagraph><subparagraph id="HB4AFDBF98B624ACD83675C3D7EC55CBB"><enum>(C)</enum><text>the sum of—</text>
											<clause id="H8B27FFF2EA9E4C8186C2656994F5135C"><enum>(i)</enum><text>the amount of
				independent expenditures made advocating the defeat of the relevant opposing
				candidate; plus</text>
											</clause><clause id="HE0AAAA88D3CD4C59A9A711EA116F814B"><enum>(ii)</enum><text>the amount of
				disbursements for electioneering communications which attack or oppose the
				relevant opposing candidate; plus</text>
											</clause></subparagraph><subparagraph id="HF4CD0BE26A8D47B0A67CF688F22777ED"><enum>(D)</enum><text>the amount of fair
				fight funds previously provided to the participating candidate under this
				subsection for the election.</text>
										</subparagraph></paragraph><paragraph id="H34A3675B96624E43B5A461CC45001D08"><enum>(3)</enum><header>Limits on amount
				of payment</header><text>The aggregate of fair fight funds that a participating
				candidate receives under this subsection for any election shall not exceed 200
				percent of the allocation from the Fund that the participating candidate
				receives for such election under section 510(c).</text>
									</paragraph></subsection><subsection id="H5B07F2324CA24FD1A2A03D74B4003850"><enum>(c)</enum><header>Definitions</header><text>For
				purposes of this section, the following definitions apply:</text>
									<paragraph id="HD28B41C63E86409EA622759517005DFA"><enum>(1)</enum><header>Opposing
				funds</header><text>The term <term>opposing funds</term> means, with respect to
				any participating candidate for any election, the sum of—</text>
										<subparagraph id="H36AFE874A39E4C2FACCD5FE4DCD0173"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H46BAFB37E1B14931A896714913A6576F"><enum>(i)</enum><text>the greater of the total
				contributions received by the relevant opposing candidate or the total
				expenditures made by such relevant opposing candidate; or</text>
											</clause><clause id="H64B832A63FBE460B85425C547002A07E" indent="up1"><enum>(ii)</enum><text>in the case of a relevant opposing
				candidate who is a participating candidate, an amount equal to the sum of the
				amount of seed money contributions received by the relevant opposing candidate,
				the value of any vouchers received by the relevant opposing candidate for the
				general election under section 315A of the Communications Act of 1934, and the
				allocation from the Fund under section 510(c) for the relevant opposing
				candidate for such election;</text>
											</clause></subparagraph><subparagraph id="H0B70247E6B604E35A9A300F6EAE6206C"><enum>(B)</enum><text>the sum of—</text>
											<clause id="H68D7A33DD9DE4A31A4CE153689844859"><enum>(i)</enum><text>the amount of
				independent expenditures made advocating the election of such relevant opposing
				candidate; plus</text>
											</clause><clause id="HA1F71F40D00D458F84D71E9BC5A266CB"><enum>(ii)</enum><text>the amount of
				disbursements for electioneering communications which promote or support such
				relevant opposing candidate; plus</text>
											</clause></subparagraph><subparagraph id="H7A32C47D90B24760BE89B22C547A209"><enum>(C)</enum><text>the sum of—</text>
											<clause id="H3EB2E6A6F92148E3BB001CAA9C232EEB"><enum>(i)</enum><text>the amount of
				independent expenditures made advocating the defeat of such participating
				candidate; plus</text>
											</clause><clause id="HC5AB6BDCD6EC494793BC5E4CCC2CD31C"><enum>(ii)</enum><text>the amount of
				disbursements for electioneering communications which attack or oppose such
				participating candidate.</text>
											</clause></subparagraph></paragraph><paragraph id="H6C70E73A58AE4B9C9FE9582C14785400"><enum>(2)</enum><header>Relevant
				opposing candidate</header><text>The term <term>relevant opposing
				candidate</term> means, with respect to any participating candidate, the
				opposing candidate of such participating candidate with respect to whom the
				amount under paragraph (1) is the greatest.</text>
									</paragraph><paragraph id="H8C1C0BBE50C04F70A906651417E798CB"><enum>(3)</enum><header>Electioneering
				communication</header><text>The term <term>electioneering communication</term>
				has the meaning given such term under section 304(f)(3),except that
				subparagraph (A)(i)(II)(aa) thereof shall be applied by substituting
				<quote>30</quote> for <quote>60</quote>.</text>
									</paragraph></subsection></section><section id="H84580D2286B64891A34F667B47919B7D"><enum>512.</enum><header>Administration
				of the house fair elections system</header>
								<subsection id="HBBFB240E29D74F8983D2C2FA290232B"><enum>(a)</enum><header>Regulations</header><text>The
				Commission shall prescribe regulations to carry out the purposes of this title,
				including regulations—</text>
									<paragraph id="HA2E1C04C94F941EF8E003E951B5F7C00"><enum>(1)</enum><text>to establish
				procedures for—</text>
										<subparagraph id="H053C091B485C431E8004B6835F297770"><enum>(A)</enum><text>verifying the
				amount of valid qualifying contributions with respect to a candidate;</text>
										</subparagraph><subparagraph id="HF20E1873E29141E18E3C2CBFF95C8E89"><enum>(B)</enum><text>effectively and
				efficiently monitoring and enforcing the limits on the use of personal funds by
				participating candidates;</text>
										</subparagraph><subparagraph id="H0C854E59E1D048B0BC3E92DC991398CB"><enum>(C)</enum><text>the expedited
				payment of fair fight funds during the 3-week period ending on the date of the
				election;</text>
										</subparagraph><subparagraph id="HD5502F0E37B247BAB98110CD029EBA5C"><enum>(D)</enum><text>monitoring the use
				of allocations from the Fund under this title through audits or other
				mechanisms; and</text>
										</subparagraph><subparagraph id="HC0BD143C64C64D1893D5778BC6ADE100"><enum>(E)</enum><text>returning unspent
				disbursements and disposing of assets purchased with allocations from the
				Fund;</text>
										</subparagraph></paragraph><paragraph id="H2FEB736FFECF49488BAEAA8EB9C21138"><enum>(2)</enum><text>providing for the
				administration of the provisions of this title with respect to special
				elections;</text>
									</paragraph><paragraph id="H4B8EADED306548D38BCB35F0EEDDA2FF"><enum>(3)</enum><text>pertaining to the
				replacement of candidates;</text>
									</paragraph><paragraph id="HFEBF7ABE8EA8467ABEF99008F0427A2"><enum>(4)</enum><text>regarding the
				conduct of debates in a manner consistent with the best practices of States
				that provide public financing for elections; and</text>
									</paragraph><paragraph id="H80FC48F4D2A944DC009096E6C38E6F88"><enum>(5)</enum><text>for attributing
				expenditures to specific elections for the purposes of calculating opposing
				funds.</text>
									</paragraph></subsection><subsection id="HB9C78A944B0A450DA485F4A17E28CED9"><enum>(b)</enum><header>Operation of
				commission</header><text>The Commission shall maintain normal business hours
				during the weekend immediately before any general election for the purposes of
				administering the provisions of this title, including the distribution of fair
				fight funds under section 511.</text>
								</subsection><subsection id="HED1511A0F38D403B85C1BF4AFE60099"><enum>(c)</enum><header>Reports</header><text>Not
				later than April 1, 2009, and every 2 years thereafter, the Commission shall
				submit to the Committee on House Administration of the House of Representatives
				a report documenting, evaluating, and making recommendations relating to the
				administrative implementation and enforcement of the provisions of this
				title.</text>
								</subsection></section><section id="HB8A34DF3A7784981AC421FE7209FEB60"><enum>513.</enum><header>Violations and
				penalties</header>
								<subsection id="HE0B5541CED77420AB76844F2CA60B905"><enum>(a)</enum><header>Civil penalty
				for violation of contribution and expenditure requirements</header><text>If a
				candidate who has been certified as a participating candidate under section
				508(a) accepts a contribution or makes an expenditure that is prohibited under
				section 506, the Commission shall assess a civil penalty against the candidate
				in an amount that is not more than 3 times the amount of the contribution or
				expenditure. Any amounts collected under this subsection shall be deposited
				into the House Fair Elections Fund.</text>
								</subsection><subsection id="HDEDF30AD4D4E4B48A716EC001D9DF00"><enum>(b)</enum><header>Repayment for
				improper use of fair elections fund</header>
									<paragraph id="HA2A8D1A1459A4CF0BF39351E670700F8"><enum>(1)</enum><header>In
				general</header><text>If the Commission determines that any benefit made
				available to a participating candidate under this title was not used as
				provided for in this title or that a participating candidate has violated any
				of the dates for remission of funds contained in this title, the Commission
				shall so notify the candidate and the candidate shall pay to the House Fair
				Elections Fund an amount equal to—</text>
										<subparagraph id="HAE82FBEA7D214D638648B2DB99867617"><enum>(A)</enum><text>the amount of
				benefits so used or not remitted, as appropriate, and</text>
										</subparagraph><subparagraph id="H9FCE637961324F8B9013C6F39C43E1A"><enum>(B)</enum><text>interest on any
				such amounts (at a rate determined by the Commission).</text>
										</subparagraph></paragraph><paragraph id="H28AB5B6ABE2E4ED2008C4E30147BFF45"><enum>(2)</enum><header>Other action not
				precluded</header><text>Any action by the Commission in accordance with this
				subsection shall not preclude enforcement proceedings by the Commission in
				accordance with section 309(a), including a referral by the Commission to the
				Attorney General in the case of an apparent knowing and willful violation of
				this
				title.</text>
									</paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H2C373FB3C6E045ADAE30F14E765C5D8"><enum>102.</enum><header>Reporting
			 requirements for nonparticipating candidates</header>
					<subsection id="H96A12551563E4EF4A3097010C28CCA22"><enum>(a)</enum><header>In
			 general</header><text>Section 304 of the Federal Election Campaign Act of 1971
			 (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434</external-xref>), as amended by section 204 of the Honest Leadership and Open
			 Government Act of 2007, is amended by adding at the end the following new
			 subsection:</text>
						<quoted-block id="H303EB5C2A55B4E7DB13309E20082AC50" style="OLC">
							<subsection id="HE978259104E64401B115058F80667EBE"><enum>(j)</enum><header>Nonparticipating
				candidates</header>
								<paragraph id="HD8B79091126E4BB6A8C6ACAA30176D2"><enum>(1)</enum><header>Initial
				report</header>
									<subparagraph id="H916E265529D3431A8B991604CBA09B64"><enum>(A)</enum><header>In
				general</header><text>Each nonparticipating candidate who is opposed to a
				participating candidate and who receives contributions or makes expenditures
				aggregating more than the threshold amount shall, within 48 hours of the date
				such aggregate contributions or expenditures exceed the threshold amount, file
				with the Commission a report stating the total amount of contributions received
				and expenditures made or obligated by such candidate.</text>
									</subparagraph><subparagraph id="HBCF0567723AA49678732E4CA3047D3C"><enum>(B)</enum><header>Threshold
				amount</header><text>For purposes of this paragraph, the term <term>threshold
				amount</term> means 75 percent of the allocation from the Fund that a
				participating candidate would be entitled to receive in such election under
				section 510 if the participating candidate were a major party candidate.</text>
									</subparagraph></paragraph><paragraph id="H6A528C456F21488E91D392DF93661DCF"><enum>(2)</enum><header>Periodic
				reports</header>
									<subparagraph id="HBD7B318B11C442CBA141A1762DFB4775"><enum>(A)</enum><header>In
				general</header><text>In addition to any reports required under subsection (a),
				each nonparticipating candidate who is required to make a report under
				paragraph (1) shall make the following reports:</text>
										<clause id="H2E0CF06ADEF44E1589EA89925C967BDD"><enum>(i)</enum><text>A
				report which shall be filed not later than 5 p.m. on the forty-second day
				before the date on which the election involving such candidate is held and
				which shall be complete through the forty-fourth day before such date.</text>
										</clause><clause id="H557B7C732B994D06AFF1EB594989D6FA"><enum>(ii)</enum><text>A
				report which shall be filed not later than 5 p.m. on the twenty-first day
				before the date on which the election involving such candidate is held and
				which shall be complete through the twenty-third day before such date.</text>
										</clause><clause id="HD12FAAF3A76E45CDAB32C1CC009CC536"><enum>(iii)</enum><text>A report which
				shall be filed not later than 5 p.m. on the twelfth day before the date on
				which the election involving such candidate is held and which shall be complete
				through the fourteenth day before such date.</text>
										</clause></subparagraph><subparagraph id="HC1620C2DFEBA4A6CB474302208C962DD"><enum>(B)</enum><header>Additional
				reporting within 2 weeks of election</header><text>Each nonparticipating
				candidate who is required to make a report under paragraph (1) and who receives
				contributions or makes expenditures aggregating more than $1,000 at any time
				after the fourteenth day before the date of the election involving such
				candidate shall make a report to the Commission not later than 24 hours after
				such contributions are received or such expenditures are made.</text>
									</subparagraph><subparagraph id="HB5A9A135292B4F9E82EE9B344284CFB"><enum>(C)</enum><header>Contents of
				report</header><text>Each report required under this paragraph shall state the
				total amount of contributions received and expenditures made or obligated to be
				made during the period covered by the report.</text>
									</subparagraph></paragraph><paragraph id="H5EC48CB05E504F299B798BDA217B0073"><enum>(3)</enum><header>Definitions</header><text>For
				purposes of this subsection and section 309(a)(13), the terms
				<term>nonparticipating candidate</term>, <term>participating candidate</term>,
				and <term>allocation from the Fund</term> have the respective meanings given to
				such terms under section
				501.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H8E05838F65194E8F001CA5D67430C6BE"><enum>(b)</enum><header>Increased
			 Penalty for Failure To File</header><text display-inline="yes-display-inline">Section 309(a) of the Federal Election
			 Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/437">2 U.S.C. 437(g)</external-xref>) is amended by adding at the end the
			 following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H3D0EF2655A2E406CB62321751967F4F0" style="OLC">
							<paragraph id="H31E3208D229540FC9B8BA92B13EF329F"><enum>(13)</enum><header>Increased civil
				penalties with respect to reporting by nonparticipating
				candidates</header><text display-inline="yes-display-inline">For purposes of
				paragraphs (5) and (6), any civil penalty with respect to a violation of
				section 304(j) shall not exceed the greater of—</text>
								<subparagraph id="H74083BECFC3147EDA81F10C41762B947"><enum>(A)</enum><text display-inline="yes-display-inline">the amount otherwise applicable without
				regard to this paragraph; or</text>
								</subparagraph><subparagraph id="H0175A39746D9489AAEDB7500044C6576"><enum>(B)</enum><text>for each day of
				the violation, 3 times the amount of the fair fight funds under section 511
				that otherwise would have been allocated to the participating candidate but for
				such
				violation.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="HE932E14EACA545BC0014011E8CBEE69D"><enum>103.</enum><header>Modification of
			 electioneering communication reporting requirements</header><text display-inline="no-display-inline">Section 304(f)(2) of the Federal Election
			 Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(f)(2)</external-xref>) is amended by adding at the end the
			 following new subparagraph:</text>
					<quoted-block id="HCE1150B150294ADF96CD1EDB492E001E" style="OLC">
						<subparagraph id="HF9E577B5657545B4AFF4281084EAD06"><enum>(G)</enum><text>In the case of a
				communication referring to any candidate in an election involving a
				participating candidate under title V, a transcript of the electioneering
				communication.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H4A68C53E12F445638BFCB2B1D876D376"><enum>104.</enum><header>Limitation on
			 coordinated expenditures by political party committees with participating
			 candidates</header><text display-inline="no-display-inline">Section 315(d)(3)
			 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(d)(3)</external-xref>) is
			 amended—</text>
					<paragraph id="HDFE6903DD283425CAB7D5F009E11FA67"><enum>(1)</enum><text>by striking
			 <quote>in the case of</quote> each place it appears in subparagraphs (A) and
			 (B) and inserting <quote>except in the case of a candidate described in
			 subparagraph (C), in the case of</quote>;</text>
					</paragraph><paragraph id="H9C54560703F5481FA57CFFC4A7B9165C"><enum>(2)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (A);</text>
					</paragraph><paragraph id="H6FB32BBE6A1C47D48FCC6F1BF75B342E"><enum>(3)</enum><text>by striking the
			 period at the end of subparagraph (B) and inserting <quote>; and</quote>;
			 and</text>
					</paragraph><paragraph id="H8BCDF47D094D40959CB8BAB1E1EB3475"><enum>(4)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block id="H856F585CDA2F4F798CEBCD00AFF8807E" style="OLC">
							<subparagraph id="HEE0E25BDA6404F6EB6310096BA88FECC"><enum>(C)</enum><text>in the case of a
				candidate who is a participating candidate under title V, the lesser of—</text>
								<clause id="H2A907A0D401B49A2BE505EEC76B6D0B5"><enum>(i)</enum><text>10
				percent of the allocation from the House Elections Fund that the participating
				candidate is eligible to receive for the general election under section
				510(c)(3); or</text>
								</clause><clause id="H715230B80E4F411A97F6BF00A048D082"><enum>(ii)</enum><text>the amount which
				would (but for this subparagraph) apply with respect to such candidate under
				subparagraph
				(B);</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="H74E403B20DA74A5AB4BAA06E2FA24F4D"><enum>105.</enum><header>Audits</header><text display-inline="no-display-inline">Section 311(b) of the Federal Election
			 Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/438">2 U.S.C. 438(b)</external-xref>) is amended—</text>
					<paragraph id="HC4FE45C3141B4AA0AE40CD1B99E55827"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> before <quote>The Commission</quote>; and</text>
					</paragraph><paragraph id="H9BE1CC0DC2CE49149ED47FAFC91EACBB"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H99C5FE3C5D174FB097AD584534FC5F2B" style="OLC">
							<paragraph id="HC3CDDBD9FC50488C8C822774008E16F6"><enum>(2)</enum><header>Audits of
				participating candidates</header>
								<subparagraph id="H63E3B27EE39D415E97E2DAAE98D0221B"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding paragraph (1), after every primary,
				general, and runoff election, the Commission shall conduct random audits and
				investigations of not less than 30 percent of the authorized committees of
				candidates who are participating candidates under title V.</text>
								</subparagraph><subparagraph id="H8AB63C86451D409B958B19BEBDFB9CBF"><enum>(B)</enum><header>Selection of
				subjects</header><text>The subjects of audits and investigations under this
				paragraph shall be selected on the basis of im-partial criteria established by
				a vote of at least 4 members of the
				Commission.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section></subtitle><subtitle id="H112AB1266F6E4150B38703A8D083F5B8"><enum>B</enum><header>House Fair
			 Elections Fund Revenues</header>
				<section id="HF59DED1C1B4B46C100D7E2817330BE6C"><enum>111.</enum><header>Deposit of
			 proceeds from recovered spectrum auctions</header><text display-inline="no-display-inline">Section 309(j)(8)(E)(ii) of the
			 Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)(E)(ii)</external-xref>) is amended—</text>
					<paragraph id="H799FBDDB171B4B398F2B91F100230845"><enum>(1)</enum><text>by striking
			 <quote>deposited in</quote> and inserting the
			 following:</text>

					</paragraph></section></subtitle><subtitle id="H07A21CD3AC534B73BEAD400948393740"><enum>C</enum><header>Fair Elections
			 Review Commission</header>
				<section id="HE08D7E178D6B4D7BAF7CDD563B96C72"><enum>121.</enum><header>Establishment of
			 commission</header>
					<subsection id="H3C96B943C43442B48924B4F858516656"><enum>(a)</enum><header>Establishment</header><text>There
			 is established a commission to be known as the <quote>Fair Elections Review
			 Commission</quote> (hereafter in this subtitle referred to as the
			 <quote>Commission</quote>).</text>
					</subsection><subsection id="H5C24B598558145B4B1EEF6E2D07595E7"><enum>(b)</enum><header>Duties</header>
						<paragraph id="HE0BF913F4ECB4FF1ACD369334ED5349C"><enum>(1)</enum><header>Review of fair
			 elections financing</header>
							<subparagraph id="H11D06596726F4F368C34A8E1F4048DB"><enum>(A)</enum><header>In
			 general</header><text>After each general election for Federal office, the
			 Commission shall conduct a comprehensive review of the House fair elections
			 financing program under title V of the Federal Election Campaign Act of 1971,
			 including—</text>
								<clause id="H604020E7E1AF4E24899F98C7B400DADF"><enum>(i)</enum><text>the
			 number and value of qualifying contributions a candidate is required to obtain
			 under section 505 of such Act to qualify for allocations from the Fund;</text>
								</clause><clause id="H89593D9D6D564B38A28F224990CABE45"><enum>(ii)</enum><text>the
			 amount of allocations from the House Fair Elections Fund that candidates may
			 receive under sections 510 and 511 of such Act;</text>
								</clause><clause id="HA9C9D033AEDC45748B3EE3006FDCAD19"><enum>(iii)</enum><text>the overall
			 satisfaction of participating candidates with the program; and</text>
								</clause><clause id="HD5E341455F524440BD4EE4C186AE4399"><enum>(iv)</enum><text>such other
			 matters relating to financing of House campaigns as the Commission determines
			 are appropriate.</text>
								</clause></subparagraph><subparagraph id="H43A69DB4FB4246D39F48DCB11B5B926B"><enum>(B)</enum><header>Criteria for
			 review</header><text>In conducting the review under subparagraph (A), the
			 Commission shall consider the following:</text>
								<clause id="H1EE83CD7C0BF426D9919FCB378139D11"><enum>(i)</enum><header>Review of
			 qualifying contribution requirements</header><text>The Commission shall
			 consider whether the number and value of qualifying contributions required
			 strikes a balance between the importance of voter choice and fiscal
			 responsibility, taking into consideration the number of primary and general
			 election participating candidates, the electoral performance of those
			 candidates, program cost, and any other information the Commission determines
			 is appropriate.</text>
								</clause><clause id="H29FA703F8C4F4E60A5A6A393BDCEEABC"><enum>(ii)</enum><header>Review of
			 program allocations</header><text>The Commission shall consider whether
			 allocations from the House Elections Fund under sections 510 and 511 of the
			 Federal Election Campaign Act of 1971 are sufficient for voters in each State
			 to learn about the candidates to cast an informed vote, taking into account the
			 historic amount of spending by winning candidates, media costs, primary
			 election dates, and any other information the Commission determines is
			 appropriate.</text>
								</clause></subparagraph></paragraph><paragraph id="HD3C2754681A84352ADF3305FE724FFAD"><enum>(2)</enum><header>Report,
			 recommendations, and proposed legislative language</header>
							<subparagraph id="H4E932797F53C470F80B864BD713F2478"><enum>(A)</enum><header>Report</header><text>Not
			 later than March 30 following each regularly scheduled general election for
			 Federal office, the Commission shall submit a report to Congress on the review
			 conducted under paragraph (1). Such report shall contain a detailed statement
			 of the findings, conclusions, and recommendations of the Commission based on
			 such review, and shall contain any proposed legislative language (as required
			 under subparagraph (C)) of the Commission.</text>
							</subparagraph><subparagraph id="H243CB77BED7F49B48C56DE97BABCB18C"><enum>(B)</enum><header>Findings,
			 conclusions, and recommendations</header><text>A finding, conclusion, or
			 recommendation of the Commission shall be included in the report under
			 subparagraph (A) only if not less than 3 members of the Commission voted for
			 such finding, conclusion, or recommendation.</text>
							</subparagraph><subparagraph id="HEAB859AF3DC64B7490FADB4108653B"><enum>(C)</enum><header>Legislative
			 language</header>
								<clause id="H027E9A1BEE10474C9E07994FF1560000"><enum>(i)</enum><header>In
			 general</header><text>The report under subparagraph (A) shall include
			 legislative language with respect to any recommendation involving—</text>
									<subclause id="H15DED9E20C35489696B1BB4C7E452656"><enum>(I)</enum><text>an increase in the
			 number or value of qualifying contributions; or</text>
									</subclause><subclause id="HF616796267CF41029BA0806521F4D185"><enum>(II)</enum><text>an increase in
			 the amount of allocations from the House Elections Fund.</text>
									</subclause></clause><clause id="H4F726F6A45EF444C97A3A44B1C656201"><enum>(ii)</enum><header>Form</header><text>The
			 legislative language shall be in the form of a proposed bill for introduction
			 in Congress and shall not include any recommendation not related to matter
			 described subclause (I) or (II) of clause (i).</text>
								</clause></subparagraph></paragraph></subsection></section><section id="HF7615D87E7784B59B9CB654F011940C8"><enum>122.</enum><header>Structure and
			 membership of the commission</header>
					<subsection id="H95D9DEC7B4824BA6993750768589E0C6"><enum>(a)</enum><header>Appointment</header>
						<paragraph id="HF498561A21B84FD29875F2E9AB05E1B4"><enum>(1)</enum><header>In
			 general</header><text>The Commission shall be composed of 5 members, of
			 whom—</text>
							<subparagraph id="HB86F7E1EF5074E8BBD07F33FCDCCF71C"><enum>(A)</enum><text>1 shall be
			 appointed by the Majority Leader of the House of Representatives;</text>
							</subparagraph><subparagraph id="HE8FC692453D8451F8461F5D28F4CA7F7"><enum>(B)</enum><text>1 shall be
			 appointed by the Minority Leader of the House of Representatives; and</text>
							</subparagraph><subparagraph id="HC4F9C6DECFB84E8EAE8010B29876B12"><enum>(C)</enum><text>3 shall be
			 appointed jointly by the members appointed under subparagraphs (A) and
			 (B).</text>
							</subparagraph></paragraph><paragraph id="H59BE0B9215A143308DB8BDAE39D9E596"><enum>(2)</enum><header>Qualifications</header>
							<subparagraph id="HF4612D456A2843A895065057E726C3CB"><enum>(A)</enum><header>In
			 general</header><text>The members shall be individuals who are nonpartisan and,
			 by reason of their education, experience, and attainments, exceptionally
			 qualified to perform the duties of members of the Commission.</text>
							</subparagraph><subparagraph id="H7E3F8EDA33EC4726A324B940F23FAB75"><enum>(B)</enum><header>Prohibition</header><text>No
			 member of the Commission may be—</text>
								<clause id="H8483BA8C9E304E779765B9C12C667EC0"><enum>(i)</enum><text>a
			 member of Congress;</text>
								</clause><clause id="H9DEE38FB72124B34BACDA391F1C1ADBB"><enum>(ii)</enum><text>an
			 employee of the Federal Government;</text>
								</clause><clause id="H819AEE74C72841A3B5A1B8E00542133"><enum>(iii)</enum><text>a
			 registered lobbyist; or</text>
								</clause><clause id="H464FB18C7615490D99591374548F9996"><enum>(iv)</enum><text>an
			 officer or employee of a political party or political campaign.</text>
								</clause></subparagraph></paragraph><paragraph id="H829CC986F6FE418E908BD3197C33E0AA"><enum>(3)</enum><header>Date</header><text>Members
			 of the Commission shall be appointed not later than 60 days after the date of
			 the enactment of this Act.</text>
						</paragraph><paragraph id="H712B82B83D4C4E5BBBCCC56C20971CE"><enum>(4)</enum><header>Terms</header><text>A
			 member of the Commission shall be appointed for a term of 5 years.</text>
						</paragraph></subsection><subsection id="H05A73A25D92B4C44A84C9CA185A7AF2"><enum>(b)</enum><header>Vacancies</header><text>A
			 vacancy on the Commission shall be filled not later than 30 calendar days after
			 the date on which the Commission is given notice of the vacancy, in the same
			 manner as the original appointment. The individual appointed to fill the
			 vacancy shall serve only for the unexpired portion of the term for which the
			 individual’s predecessor was appointed.</text>
					</subsection><subsection id="H96BE1649D3C849CF869276249E8E9C34"><enum>(c)</enum><header>Chairperson</header><text>The
			 Commission shall designate a Chairperson from among the members of the
			 Commission.</text>
					</subsection></section><section id="H9FD920B68B9C46FFB03DE1E1BD1CB700"><enum>123.</enum><header>Powers of the
			 commission</header>
					<subsection id="H2E7AF634A5D94C429392D0FE84F069E8"><enum>(a)</enum><header>Meetings and
			 Hearings</header>
						<paragraph id="H4AE8D60906DD41AD80B63D5E98003FCD"><enum>(1)</enum><header>Meetings</header><text>The
			 Commission may hold such hearings, sit and act at such times and places, take
			 such testimony, and receive such evidence as the Commission considers advisable
			 to carry out the purposes of this Act.</text>
						</paragraph><paragraph id="HF4042DC612894553A136734124F536C4"><enum>(2)</enum><header>Quorum</header><text>Four
			 members of the Commission shall constitute a quorum for purposes of voting, but
			 a quorum is not required for members to meet and hold hearings.</text>
						</paragraph></subsection><subsection id="H4CC2BEBB464D4CE2A484F162FA6F6E09"><enum>(b)</enum><header>Information From
			 Federal Agencies</header><text>The Commission may secure directly from any
			 Federal department or agency such information as the Commission considers
			 necessary to carry out the provisions of this Act. Upon request of the
			 Chairperson of the Commission, the head of such department or agency shall
			 furnish such information to the Commission.</text>
					</subsection><subsection id="HBAF491414DD34962957E1936BC47796F"><enum>(c)</enum><header>Postal
			 Services</header><text>The Commission may use the United States mails in the
			 same manner and under the same conditions as other departments and agencies of
			 the Federal Government.</text>
					</subsection><subsection id="H2622BC5BDCC7446BBC2999410793B5AB"><enum>(d)</enum><header>Gifts</header><text>The
			 Commission may accept, use, and dispose of gifts or donations of services or
			 property.</text>
					</subsection></section><section id="H4FD063F1665A4294A48E875ECC9FB045"><enum>124.</enum><header>Administration</header>
					<subsection id="HF4CCAE2490F04CD6A6A2935628283DFB"><enum>(a)</enum><header>Compensation of
			 Members</header>
						<paragraph id="HFB22D0FB414F4DCC893BFC89911400CF"><enum>(1)</enum><header>In
			 general</header>
							<subparagraph id="H8E6DD3270B93413DA8E8FB3D94525244"><enum>(A)</enum><header>In
			 general</header><text>Each member, other than the Chairperson, shall be paid at
			 a rate equal to the daily equivalent of the minimum annual rate of basic pay
			 prescribed for level IV of the Executive Schedule under section 5315 of title
			 5, United States Code, for each day (including travel time) during which such
			 member is engaged in the performance of the duties of the Commission.</text>
							</subparagraph><subparagraph id="HA4E06718018445F28777B84EABD0EC13"><enum>(B)</enum><header>Chairperson</header><text>The
			 Chairperson shall be paid at a rate equal to the daily equivalent of the
			 minimum annual rate of basic pay prescribed for level III of the Executive
			 Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5314">section 5314</external-xref> of title 5, United States Code, for each day
			 (including travel time) during which such member is engaged in the performance
			 of the duties of the Commission.</text>
							</subparagraph></paragraph><paragraph id="H0C39110494E840688B2C3042B93F79E8"><enum>(2)</enum><header>Travel
			 expenses</header><text>Members shall receive travel expenses, including per
			 diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title
			 5, United States Code, while away from their homes or regular places of
			 business in performance of services for the Commission.</text>
						</paragraph></subsection><subsection id="H590E14BB675242B09CA03C7042C3DBA4"><enum>(b)</enum><header>Personnel</header>
						<paragraph id="HAA7EF39A800849649C2953E36D02D6C9"><enum>(1)</enum><header>Director</header><text>The
			 Commission shall have a staff headed by an Executive Director. The Executive
			 Director shall be paid at a rate equivalent to a rate established for the
			 Senior Executive Service under <external-xref legal-doc="usc" parsable-cite="usc/5/5382">section 5382</external-xref> of title 5, United States
			 Code.</text>
						</paragraph><paragraph id="H90F4A88AFEC9491ABC20E9C5CA96192D"><enum>(2)</enum><header>Staff
			 appointment</header><text>With the approval of the Chairperson, the Executive
			 Director may appoint such personnel as the Executive Director and the
			 Commission determines to be appropriate.</text>
						</paragraph><paragraph id="HE618D31B0A4E428081DAA9D35F6DD696"><enum>(3)</enum><header>Experts and
			 consultants</header><text>With the approval of the Chairperson, the Executive
			 Director may procure temporary and intermittent services under section 3109(b)
			 of title 5, United States Code.</text>
						</paragraph><paragraph id="H6E9B83FFA93342B59093DF7DE66200FE"><enum>(4)</enum><header>Detail of
			 government employees</header><text>Upon the request of the Chairperson, the
			 head of any Federal agency may detail, without reimbursement, any of the
			 personnel of such agency to the Commission to assist in carrying out the duties
			 of the Commission. Any such detail shall not interrupt or otherwise affect the
			 civil service status or privileges of the Federal employee.</text>
						</paragraph><paragraph id="H336E1BF08CB64D649200A0363BB41214"><enum>(5)</enum><header>Other
			 resources</header><text>The Commission shall have reasonable access to
			 materials, resources, statistical data, and other information from the Library
			 of Congress and other agencies and elected representatives of the executive and
			 legislative branches of the Federal Government. The Chairperson of the
			 Commission shall make requests for such access in writing when
			 necessary.</text>
						</paragraph></subsection></section><section id="H588BDC8C8012406ABE1FB003585F8157"><enum>125.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out the
			 purposes of this subtitle.</text>
				</section><section id="H72D0A2436F00450DA9229BF7910781E1"><enum>126.</enum><header>Expedited
			 consideration of commission recommendations</header>
					<subsection id="H274045FB748D4D0ABBF86842A1D87E3F"><enum>(a)</enum><header>Introduction and
			 Committee Consideration in the House of Representatives</header>
						<paragraph id="HFE386E15299D47DF8706AA00BFD977"><enum>(1)</enum><header>Introduction and
			 referral</header><text display-inline="yes-display-inline">Any bill introduced
			 in the House of Representatives which consists entirely of the proposed
			 legislative language submitted by the Commission under section 121(b)(2)(C)
			 (hereafter in this section referred to as a <quote>Commission bill</quote>)
			 shall be referred to the Committee on House Administration.</text>
						</paragraph><paragraph id="H88E423C5A4A043268DB9002F353CE077"><enum>(2)</enum><header>Automatic
			 discharge after 60 days</header><text display-inline="yes-display-inline">If
			 the Committee on House Administration does not report a Commission bill without
			 amendment during the 60-calendar day period which begins on the date of its
			 introduction, the Committee shall be automatically discharged from further
			 consideration of the Commission bill and the Commission bill shall be placed on
			 the appropriate calendar.</text>
						</paragraph></subsection><subsection id="HD20FB97473544074BAF3CBF4187F7C"><enum>(b)</enum><header>Expedited
			 Procedure</header>
						<paragraph id="H6EBF104ABB7447FAAEEB85CB3048C72C"><enum>(1)</enum><header>Floor
			 consideration in the house</header>
							<subparagraph id="H5E2787E37C6A4895AD98528EA1682610"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If the House of
			 Representatives does not agree to a motion to proceed to the consideration of a
			 Commission bill during the 60-day period which begins on the date the Committee
			 on House Administration reports the bill or is discharged from further
			 consideration of the bill, it shall be in order for any member of the House to
			 move to proceed to the consideration of the bill.</text>
							</subparagraph><subparagraph id="H9215EF1FC4434275AE8877254FE2051C"><enum>(B)</enum><header>Motion to
			 proceed</header><text>A motion to proceed to the consideration of a Commission
			 bill is privileged in the House of Representatives. The motion is not debatable
			 and is not subject to a motion to postpone consideration of the Commission bill
			 or to proceed to the consideration of other business. A motion to reconsider
			 the vote by which the motion to proceed is agreed to or not agreed to shall not
			 be in order. If the motion to proceed is agreed to, the House of
			 Representatives shall immediately proceed to consideration of the Commission
			 bill without intervening motion, order, action, or other business, and the
			 Commission bill shall remain the unfinished business of the House of
			 Representatives until disposed of.</text>
							</subparagraph><subparagraph id="H3C5DAFA2FB0942978268DEFC0006B7A4"><enum>(C)</enum><header>Amendments,
			 motions, and appeals</header><text display-inline="yes-display-inline">No
			 amendment to the Commission bill shall be in order in the House of
			 Representatives, and debate on any debatable motion or appeal shall not exceed
			 5 hours to be divided equally between those favoring and those opposing the
			 motion or appeal.</text>
							</subparagraph><subparagraph id="H2BBBFEEDD8744CBA8EB32C5340AD06B8"><enum>(D)</enum><header>Limited
			 debate</header><text>Consideration in the House of Representatives of the
			 Commission bill and on all debatable motions and appeals in connection
			 therewith, shall be limited to not more than 40 hours, which shall be equally
			 divided between, and controlled by, the Majority Leader and the Minority Leader
			 of the House of Representatives or their designees. A motion further to limit
			 debate on the Commission bill is in order and is not debatable. All time used
			 for consideration of the Commission bill, including time used for quorum calls
			 (except quorum calls immediately preceding a vote), shall come from the 40
			 hours of consideration.</text>
							</subparagraph><subparagraph id="H3882AC401B6E40250031D283ECCB572C"><enum>(E)</enum><header>Vote on
			 passage</header>
								<clause id="H42F45F0BFCB64004A04EF5CAF5F028F0"><enum>(i)</enum><header>In
			 general</header><text>The vote on passage in the House of Representatives of
			 the Commission bill shall occur immediately following the conclusion of the
			 40-hour period for consideration of the Commission bill under subparagraph (D)
			 and a request to establish the presence of a quorum.</text>
								</clause><clause id="HD162FF04A6484FD68433BB7EB7C8D2B3"><enum>(ii)</enum><header>Other motions
			 not in order</header><text>A motion in the House of Representatives to postpone
			 consideration of the Commission bill, a motion to proceed to the consideration
			 of other business, or a motion to recommit the Commission bill is not in order.
			 A motion in the House of Representatives to reconsider the vote by which the
			 Commission bill is agreed to or not agreed to is not in order.</text>
								</clause></subparagraph></paragraph><paragraph id="H06858448E40545ED91098168A10100EA"><enum>(2)</enum><header>Floor
			 consideration in the senate</header>
							<subparagraph id="H51A6B62EC1C44150A7D200653E190881"><enum>(A)</enum><header>In
			 general</header><text>If a Commission bill is agreed to in the House, the
			 Majority Leader of the Senate, or the Majority Leader’s designee shall move to
			 proceed to the consideration of the Commission bill not later than 30 days
			 after the date the Senate receives notice of such agreement. It shall also be
			 in order for any member of the Senate to move to proceed to the consideration
			 of the bill at any time after the conclusion of such 30-day period.</text>
							</subparagraph><subparagraph id="H0B0D791E32304EA1AE6350E434F000CE"><enum>(B)</enum><header>Motion to
			 proceed</header><text>A motion to proceed to the consideration of a Commission
			 bill is privileged in the Senate. The motion is not debatable and is not
			 subject to a motion to postpone consideration of the Commission bill or to
			 proceed to the consideration of other business. A motion to reconsider the vote
			 by which the motion to proceed is agreed to or not agreed to shall not be in
			 order. If the motion to proceed is agreed to, the Senate shall immediately
			 proceed to consideration of the Commission bill without intervening motion,
			 order, action, or other business, and the Commission bill shall remain the
			 unfinished business of the Senate until disposed of.</text>
							</subparagraph><subparagraph id="HD707F7168FD148EB83D2F1B8979DE96"><enum>(C)</enum><header>Amendments,
			 motions, and appeals</header><text display-inline="yes-display-inline">No
			 amendment shall be in order in the senate, and debate on any debatable motion
			 or appeal shall not exceed 5 hours to be divided equally between those favoring

							</subparagraph><subparagraph id="H82AED2EDD5764235932124947F1EF35B"><enum>(E)</enum><header>Vote on

			 general</header><text>The vote on passage in the Senate of the Commission bill

								</clause></subparagraph></paragraph></subsection><subsection id="H31D327AC0B344BEAA28113CEE31453A5"><enum>(c)</enum><header>Rules of House
			 of Representatives and Senate</header><text>This section is enacted by
			 Congress—</text>
						<paragraph id="H368C7CB2962C49F094BA00F12D07E588"><enum>(1)</enum><text>as an exercise of
			 the rulemaking power of the House of Representatives and Senate, respectively,
			 and as such it is deemed a part of the rules of each House, respectively, but
			 applicable only with respect to the procedure to be followed in that House in
			 the case of a Commission bill, and it supersedes other rules only to the extent
			 that it is inconsistent with such rules, and</text>
						</paragraph><paragraph id="HDF4D01945FA5499485F5009311FCC0A4"><enum>(2)</enum><text>with full
			 recognition of the constitutional right of either House to change the rules (so
			 far as relating to the procedure of that House) at any time, in the same
			 manner, and to the same extent as in the case of any other rule of that
			 House.</text>
						</paragraph></subsection></section></subtitle></title><title id="H6469A3D7364A4B7B9E8700CA944D985"><enum>II</enum><header>VOTER
			 INFORMATION</header>
			<section id="HDF7340A7E41445DBB4C79C7B006B052C"><enum>201.</enum><header>Broadcasts
			 relating to candidates</header>
				<subsection id="HAF59EDF799244E9EB4EB7B932C26792C"><enum>(a)</enum><header>Lowest Unit
			 Charge; National Committees</header><text>Section 315(b) of the Communications
			 Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/315">47 U.S.C. 315(b)</external-xref>) is amended—</text>
					<paragraph id="H356F953E7A9B44E80080355EAE73953C"><enum>(1)</enum><text>by striking
			 <quote>to such office</quote> in paragraph (1) and inserting <quote>to such
			 office, or by a national committee of a political party on behalf of such
			 candidate in connection with such campaign,</quote>; and</text>
					</paragraph><paragraph id="H30D9287D8EC64A9FAA3C869EF4C392E7"><enum>(2)</enum><text>by inserting
			 <quote>for pre-emptible use thereof</quote> after <quote>station</quote> in
			 subparagraph (A) of paragraph (1).</text>
					</paragraph></subsection><subsection id="HF7DCBB7863624CCEA6FC59EE00FF05CA"><enum>(b)</enum><header>Broadcast
			 Rates</header><text>Section 315(b) of the Communications Act of 1934 (47 U.S.C.
			 315(b)), as amended by subsection (a), is amended—</text>
					<paragraph id="HE698C943BC564309A2DB95CAD1F2EF7"><enum>(1)</enum><text>in
			 paragraph (1)(A), by striking <quote>paragraph (2)</quote> and inserting
			 <quote>paragraphs (2) and (3)</quote>; and</text>
					</paragraph><paragraph id="H0C3F6661DC5B4E92B260F7C7812F76D"><enum>(2)</enum><text>by
			 adding at the end the following:</text>
						<quoted-block id="H5DC9143EFBD041448413B74FD61DE425" style="OLC">
							<paragraph id="H6FC72BE9FC234B2FA068072F9C8FB1DD"><enum>(3)</enum><header>Participating
				candidates</header><text>In the case of a participating candidate (as defined
				under section 501(10) of the Federal Election Campaign Act of 1971), the
				charges made for the use any broadcasting station for a television broadcast
				shall not exceed 80 percent of the lowest charge described in paragraph (1)(A)
				during—</text>
								<subparagraph id="H3222B1EE570548B897D2DC0086440089"><enum>(A)</enum><text>the 45 days
				preceding the date of a primary or primary runoff election in which the
				candidate is opposed; and</text>
								</subparagraph><subparagraph id="H1BA65BA80F504A0A952C7DEB87FAAA7B"><enum>(B)</enum><text>the 60 days
				preceding the date of a general or special election in which the candidate is
				opposed.</text>
								</subparagraph></paragraph><paragraph id="H85ED427ECB3A4A6AB569A7A53C48A4A4"><enum>(4)</enum><header>Rate
				cards</header><text>A licensee shall provide to a candidate for House a rate
				card that discloses—</text>
								<subparagraph id="H96AB76C040234CBCACF19BB2120543A1"><enum>(A)</enum><text>the rate charged
				under this subsection; and</text>
								</subparagraph><subparagraph id="H7E17996FAE8E4B408305616334FFD316"><enum>(B)</enum><text>the method that
				the licensee uses to determine the rate charged under this
				subsection.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HC9909FBCD26E40B200DD44ACBAFA150"><enum>(c)</enum><header>Preemption;
			 Audits</header><text>Section 315 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/315">47 U.S.C. 315</external-xref>) is amended—</text>
					<paragraph id="HDCBB837B66A94AF5953F64C4BC79EB6"><enum>(1)</enum><text>by
			 redesignating subsections (f) and (g) as subsections (e) and (f), respectively
			 and moving them to follow the existing subsection (e);</text>
					</paragraph><paragraph id="H5791671679014D2ABD99C4C77DEECE"><enum>(2)</enum><text>by
			 redesignating the existing subsection (e) as subsection (c); and</text>
					</paragraph><paragraph id="H745C2E89BC3F4E63891F50F3DB71BFC0"><enum>(3)</enum><text>by inserting after
			 subsection (c) (as redesignated by paragraph (2)) the following:</text>
						<quoted-block id="H23423D182F2445DC8F74FB954779ED37" style="OLC">
							<subsection id="H0F1D6276FDCA480788476008A3D4699C"><enum>(d)</enum><header>Preemption</header>
								<paragraph id="HB9C92F89317F4FC49F025EC2D3A3E767"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), and notwithstanding
				the requirements of subsection (b)(1)(A), a licensee shall not preempt the use
				of a broadcasting station by a legally qualified candidate for House who has
				purchased and paid for such use.</text>
								</paragraph><paragraph id="HD039310993A54A53B741153233EB12C8"><enum>(2)</enum><header>Circumstances
				beyond control of licensee</header><text>If a program to be broadcast by a
				broadcasting station is preempted because of circumstances beyond the control
				of the station, any candidate or party advertising spot scheduled to be
				broadcast during that program shall be treated in the same fashion as a
				comparable commercial advertising spot.</text>
								</paragraph></subsection><subsection id="H2C0DA3758C354673AE145C0406DE20F3"><enum>(e)</enum><header>Audits</header><text>During
				the 45-day period preceding a primary election and the 60-day period preceding
				a general election, the Commission shall conduct such audits as it deems
				necessary to ensure that each broadcaster to which this section applies is
				allocating television broadcast advertising time in accordance with this
				section and section
				312.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H9FD29FAFE8B24CBD8B00003BA4B7559C"><enum>(d)</enum><header>Revocation of
			 License for Failure To Permit Access</header><text>Section 312(a)(7) of the
			 Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/312">47 U.S.C. 312(a)(7)</external-xref>) is amended—</text>
					<paragraph id="H7A1E66D4863F48EE8F00C8D1878DB35B"><enum>(1)</enum><text>by striking
			 <quote>or repeated</quote>;</text>
					</paragraph><paragraph id="HF79B50B7A79E470F94E3B7CCFE9916A0"><enum>(2)</enum><text>by inserting
			 <quote>or cable system</quote> after <quote>broadcasting station</quote>;
			 and</text>
					</paragraph><paragraph id="H862574F685EE44A3B85330F6D5A8B0EF"><enum>(3)</enum><text>by striking
			 <quote>his candidacy</quote> and inserting <quote>the candidacy of the
			 candidate, under the same terms, conditions, and business practices as apply to
			 the most favored advertiser of the licensee</quote>.</text>
					</paragraph></subsection><subsection id="H9DAED0F22ACB4567A333BB7F1ED9F1F6"><enum>(e)</enum><header>Stylistic
			 Amendments</header><text>Section 315 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/315">47 U.S.C. 315</external-xref>) is
			 amended—</text>
					<paragraph id="HE8E698411FAB45F1BCA3DCF21CFDCF1B"><enum>(1)</enum><text>by striking
			 <quote>the</quote> in subsection (f)(1), as redesignated by subsection (b)(1),
			 and inserting <quote><header-in-text level="subsection" style="OLC">Broadcasting station</header-in-text></quote>;</text>
					</paragraph><paragraph id="HBBCA904756A04FB8BD41A79460E31C00"><enum>(2)</enum><text>by striking
			 <quote>the</quote> in subsection (f)(2), as redesignated by subsection (b)(1),
			 and inserting <quote><header-in-text level="paragraph" style="OLC">Licensee;

					</paragraph></subsection></section><section id="H48C208EE998348D991607B37B722FCE7"><enum>202.</enum><header>Political
			 advertisement vouchers for participating candidates</header>
				<subsection id="H0E5197524D4F4C6AA950B7BE0036E68F"><enum>(a)</enum><header>In
			 General</header><text>Title III of the Communications Act of 1934 (47 U.S.C.
			 301 et seq.) is amended by inserting after section 315 the following:</text>
					<quoted-block display-inline="no-display-inline" id="HDA5E00BDA9894911A2C55F0E722976D" style="OLC">
						<section id="H5152B3EA8AD24EE1B600154D514847FD"><enum>315A</enum><header>Political
				advertisement voucher program</header>
							<subsection id="H8B4313F5CAFA4C5C000096B04FB9BEBF"><enum>(a)</enum><header>In
				general</header><text>The Commission shall establish and administer a voucher
				program for the purchase of airtime on broadcasting stations for political
				advertisements in accordance with the provisions of this section.</text>
							</subsection><subsection id="H0F6755FEB9FF494F8CC90041E16BE80"><enum>(b)</enum><header>Candidates</header><text>The
				Commission shall only disburse vouchers under the program established under
				subsection (a) to individuals who meet the following requirements:</text>
								<paragraph id="HE25EA7CA6AD249668F949D8B77D5F153"><enum>(1)</enum><header>Qualification</header><text>The
				individual is certified by the Federal Election Commission as a participating
				candidate (as defined under section 501(10) of the Federal Election Campaign
				Act of 1971) with respect to a general election for Federal office under
				section 508 of the Federal Election Campaign Act of 1971.</text>
								</paragraph><paragraph id="H985F879085C149989B9431799FB74D8"><enum>(2)</enum><header>Agreement</header><text>The
				individual has agreed in writing—</text>
									<subparagraph id="H2013AC073364404D9EEC647C91FBDCC"><enum>(A)</enum><text>to keep and furnish
				to the Federal Election Commission such records, books, and other information
				as it may require; and</text>
									</subparagraph><subparagraph id="H5C82822AAE194DA9A676B064A92D2D59"><enum>(B)</enum><text>to repay to the
				Federal Communications Commission, if the Federal Election Commission revokes
				the certification of the individual as a participating candidate (as so
				defined), an amount equal to the dollar value of vouchers which were received
				from the Commission and used by the candidate.</text>
									</subparagraph></paragraph></subsection><subsection id="H9CE4D74EFE3648E1934454A6C24D67F3"><enum>(c)</enum><header>Amounts</header><text>The
				Commission shall disburse vouchers to each candidate certified under subsection
				(b) in the amount of $100,000.</text>
							</subsection><subsection id="H5E1CF37115CB40ECBA3F736B03BCADC"><enum>(d)</enum><header>Use</header>
								<paragraph id="H556D3E9BA6C648559874787EC36109D1"><enum>(1)</enum><header>Exclusive
				use</header><text>Vouchers disbursed by the Commission under this section may
				be used only for the purchase of broadcast airtime for political advertisements
				relating to a general election for the office of House of Representatives by
				the participating candidate to which the vouchers were disbursed, except
				that—</text>
									<subparagraph id="H9FD8CB5198F64BF28E3C8DEEB803DFAD"><enum>(A)</enum><text>a candidate may
				exchange vouchers with a political party under paragraph (2); and</text>
									</subparagraph><subparagraph id="HFAA3D9CCF4BD4E7881126357653CDF5E"><enum>(B)</enum><text>a political party
				may use vouchers only to purchase broadcast airtime for political
				advertisements for generic party advertising, to support candidates for State
				or local office in a general election, or to support participating candidates
				of the party in a general election for Federal office, but only if it discloses
				the value of the voucher used as an expenditure under section 315(d) of the
				Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441">2 U.S.C. 441(d)</external-xref>).</text>
									</subparagraph></paragraph><paragraph id="H1DA307985482458990D40152DD3CF631"><enum>(2)</enum><header>Exchange with
				political party committee</header>
									<subparagraph id="H5562A4CA63944561985D3000B89D7044"><enum>(A)</enum><header>In
				general</header><text>An individual who receives a voucher under this section
				may transfer the right to use all or a portion of the value of the voucher to a
				committee of the political party of which the individual is a candidate in
				exchange for money in an amount equal to the cash value of the voucher or
				portion exchanged.</text>
									</subparagraph><subparagraph id="HE30FEFD7B1B9459BAAABDD90A5F85898"><enum>(B)</enum><header>Continuation of
				candidate obligations</header><text>The transfer of a voucher, in whole or in
				part, to a political party committee under this paragraph does not release the
				candidate from any obligation under the agreement made under subsection (b)(2)
				or otherwise modify that agreement or its application to that candidate.</text>
									</subparagraph><subparagraph id="H5132A2A5CD8144D9A6AADE63163220F6"><enum>(C)</enum><header>Party committee
				obligations</header><text>Any political party committee to which a voucher or
				portion thereof is transferred under subparagraph (A)—</text>
										<clause id="H96D0524EEA9B4AC6AEE900D4DA1CD55"><enum>(i)</enum><text>shall account
				fully, in accordance with such requirements as the Commission may establish,
				for the receipt of the voucher; and</text>
										</clause><clause id="H52A07801394E4646AE068050B361413"><enum>(ii)</enum><text>may not use the
				transferred voucher or portion thereof for any purpose other than a purpose
				described in paragraph (1)(B).</text>
										</clause></subparagraph><subparagraph id="H6D6C11E583E044F68192001FBC7CDB1"><enum>(D)</enum><header>Voucher as a
				contribution under feca</header><text>If a candidate transfers a voucher or any
				portion thereof to a political party committee under subparagraph (A)—</text>
										<clause id="H7971D9542F6C44F7A83D13A416D5E31D"><enum>(i)</enum><text>the value of the
				voucher or portion thereof transferred shall be treated as a contribution from
				the candidate to the committee, and from the committee to the candidate, for
				purposes of sections 302 and 304 of the Federal Election Campaign Act of 1971
				(2 U.S.C. 432 and 434);</text>
										</clause><clause id="H5EADBA179B3944418BC11EDB4C4EB678"><enum>(ii)</enum><text>the committee
				may, in exchange, provide to the candidate only funds subject to the
				prohibitions, limitations, and reporting requirements of the Federal Election
				Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431 et seq.</external-xref>); and</text>
										</clause><clause id="H97A3569600A64C50A5566897133FE208"><enum>(iii)</enum><text>the amount, if
				identified as a voucher exchange, shall not be considered a contribution for
				the purposes of sections 315 or 506 of that Act.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="HB069E4F478F3471BA3F4F2B0131541D"><enum>(e)</enum><header>Value;
				acceptance; redemption</header>
								<paragraph id="H9A92379108DA4067AAA0261B25263CC6"><enum>(1)</enum><header>Voucher</header><text>Each
				voucher disbursed by the Commission under this section shall have a value in
				dollars, redeemable upon presentation to the Commission, together with such
				documentation and other information as the Commission may require, for the
				purchase of broadcast airtime for political advertisements in accordance with
				this section.</text>
								</paragraph><paragraph id="H00EAB5E95E3A4F5181543FD4296D75DB"><enum>(2)</enum><header>Acceptance</header><text>A
				broadcasting station shall accept vouchers in payment for the purchase of
				broadcast airtime for political advertisements in accordance with this
				section.</text>
								</paragraph><paragraph id="H7A175BDB9B484ACA96DEA3452509D70"><enum>(3)</enum><header>Redemption</header><text>The
				Commission shall redeem vouchers accepted by broadcasting stations under
				paragraph (2) upon presentation, subject to such documentation, verification,
				accounting, and application requirements as the Commission may impose to ensure
				the accuracy and integrity of the voucher redemption system. The Commission
				shall use amounts in the Political Advertising Voucher Account established
				under subsection (f) to redeem vouchers presented under this subsection.</text>
								</paragraph><paragraph id="H93FA40043661463596A775287C6396A9"><enum>(4)</enum><header>Expiration</header>
									<subparagraph id="HD68EB379581646BC983D124744519191"><enum>(A)</enum><header>Candidates</header><text>A
				voucher may only be used to pay for broadcast airtime for political
				advertisements to be broadcast before midnight on the day before the date of
				the Federal election in connection with which it was issued and shall be null
				and void for any other use or purpose.</text>
									</subparagraph><subparagraph id="HD6AF06380B7B4C34BC206189DB6E0010"><enum>(B)</enum><header>Exception for
				political party committees</header><text>A voucher held by a political party
				committee may be used to pay for broadcast airtime for political advertisements
				to be broadcast before midnight on December 31st of the odd-numbered year
				following the year in which the voucher was issued by the Commission.</text>
									</subparagraph></paragraph><paragraph id="HB3945E0C548448FDAE800054F34709FB"><enum>(5)</enum><header>Voucher as
				expenditure under feca</header>
									<subparagraph id="H378CDB75604F41F796DBEC6821DD6506"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), for purposes of
				the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431 et seq.</external-xref>), the use of a
				voucher to purchase broadcast airtime constitutes an expenditure as defined in
				section 301(9)(A) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431(9)(A)</external-xref>).</text>
									</subparagraph><subparagraph id="H23F28D55D0C14CD28DC6A92FE16443CD"><enum>(B)</enum><header>Participating
				candidates</header><text>The use of a voucher to purchase broadcast airtime by
				a participating candidate shall not constitute an expenditure for purposes of
				section 506 of such Act.</text>
									</subparagraph></paragraph></subsection><subsection id="HB2161AFF716546C4935E2BC17137BBD9"><enum>(f)</enum><header>Political
				advertising voucher account</header>
								<paragraph id="H4C0024A019BB4C599FBD889BAB4EF8BA"><enum>(1)</enum><header>In
				general</header><text>The Commission shall establish an account to be known as
				the Political Advertising Voucher Account, which shall be credited with
				commercial television and radio spectrum use fees assessed under this
				subsection, together with any amounts repaid or otherwise reimbursed under this
				section or section 508(b)(2)(B) of the Federal Election Campaign Act of
				1971.</text>
								</paragraph><paragraph id="H1C61316653E44ED3A1FE7F2B8365F94E"><enum>(2)</enum><header>Spectrum use
				fee</header>
									<subparagraph id="HB8D204A1E9F04F4796FE9E544909EA13"><enum>(A)</enum><header>In
				general</header><text>The Commission shall assess, and collect annually, from
				each broadcast station, a spectrum use fee in an amount equal to 2 percent of
				each broadcasting station’s gross advertising revenues for such year.</text>
									</subparagraph><subparagraph id="H83923E34863A440187C9125DDDFE6B96"><enum>(B)</enum><header>Availability</header>
										<clause id="H38DC946A5FE64295A7F6FBD4CC108B1D"><enum>(i)</enum><header>In
				general</header><text>Any amount assessed and collected under this paragraph
				shall be used by the Commission as an offsetting collection for the purposes of
				making disbursements under this section, except that—</text>
											<subclause id="H0A7FEECA1A64450EB2FC8BBA7BA5FD1"><enum>(I)</enum><text>the salaries and
				expenses account of the Commission shall be credited with such sums as are
				necessary from those amounts for the costs of developing and implementing the
				program established by this section; and</text>
											</subclause><subclause id="H78FFD9E0D9004B50AD6203457B57F133"><enum>(II)</enum><text>the Commission
				may reimburse the Federal Election Commission for any expenses incurred by the
				Commission under this section.</text>
											</subclause></clause><clause id="H0780B6094A0A45CA8EE7E53CF597A52"><enum>(ii)</enum><header>Deposit of
				excess fees into house fair elections fund</header><text>If the amount assessed
				and collected under this paragraph for years in any election period exceeds the
				amount necessary for making disbursements under this section for such election
				period, the Commission shall deposit such excess in the House Fair Elections
				Fund.</text>
										</clause></subparagraph><subparagraph id="HB6B25BA9B32E4DEFBF289EC499D78FB9"><enum>(C)</enum><header>Fee does not
				apply to public broadcasting stations</header><text>Subparagraph (A) does not
				apply to a public telecommunications entity (as defined in section 397(12) of
				this Act).</text>
									</subparagraph></paragraph><paragraph id="H8655824AD7254F49B4061B75BE13BCA0"><enum>(3)</enum><header>Administrative
				provisions</header><text>Except as otherwise provided in this subsection,
				section 9 of this Act applies to the assessment and collection of fees under
				this subsection to the same extent as if those fees were regulatory fees
				imposed under section 9.</text>
								</paragraph></subsection><subsection id="H0D44EB00632B4E6ABCCA2E63847DC301"><enum>(g)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="H553614F4019145B68555070129247446"><enum>(1)</enum><header>Broadcasting
				station</header><text>The term <term>broadcasting station</term> has the
				meaning given that term by section 315(f)(1) of this Act.</text>
								</paragraph><paragraph id="H23372DCA568841FEB8308935B105C8D"><enum>(2)</enum><header>Federal
				election</header><text>The term <term>Federal election</term> means any
				regularly scheduled, primary, runoff, or special election held to nominate or
				elect a candidate to Federal office.</text>
								</paragraph><paragraph id="HAE63B03F277B4496A3D89F485DEEB330"><enum>(3)</enum><header>Federal
				office</header><text>The term <term>Federal office</term> has the meaning given
				that term by section 301(3) of the Federal Election Campaign Act of 1971 (2
				U.S.C. 431(3)).</text>
								</paragraph><paragraph id="H12C433682C0149B8A337EDAA1E2EC496"><enum>(4)</enum><header>Political
				party</header><text>The term <term>political party</term> means a major party
				or a minor party as defined in section 9002(3) or (4) of the Internal Revenue
				Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/9002">26 U.S.C. 9002(3)</external-xref> or (4)).</text>
								</paragraph><paragraph id="H318FBF5740074F4889F6F1D157A36E72"><enum>(5)</enum><header>Other
				terms</header><text>Except as otherwise provided in this section, any term used
				in this section that is defined in section 301 or 501 of the Federal Election
				Campaign of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431</external-xref>) has the meaning given that term by either such
				section of that Act.</text>
								</paragraph></subsection><subsection id="H4F785A00C6F34579AC9D85E3E3D6D5CF"><enum>(h)</enum><header>Regulations</header><text>The
				Commission shall prescribe such regulations as may be necessary to carry out
				the provisions of this section. In developing the regulations, the Commission
				shall consult with the Federal Election
				Commission.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H0BA82975BF96431BA4CF3DA5A34999AE"><enum>203.</enum><header>FCC to
			 prescribe standardized form for reporting candidate campaign ads</header>
				<subsection id="HEB88FAF1EF6C4FDFA8473CECCB41AD93"><enum>(a)</enum><header>In
			 General</header><text>Within 90 days after the date of enactment of this Act,
			 the Federal Communications Commission shall initiate a rulemaking proceeding to
			 establish a standardized form to be used by broadcasting stations, as defined
			 in section 315(f)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/315">47 U.S.C. 315(f)(1)</external-xref>),
			 to record and report the purchase of advertising time by or on behalf of a
			 candidate for nomination for election, or for election, to Federal elective
			 office.</text>
				</subsection><subsection id="HA98B172CE99C4596A783DA7BFA20AEA"><enum>(b)</enum><header>Contents</header><text>The
			 form prescribed by the Commission under subsection (a) shall require,
			 broadcasting stations to report, at a minimum—</text>
					<paragraph id="H7630221734294605852CC60073E51DC"><enum>(1)</enum><text>the station call
			 letters and mailing address;</text>
					</paragraph><paragraph id="H319095BA04694865B1E499BE1518F590"><enum>(2)</enum><text>the name and
			 telephone number of the station’s sales manager (or individual with
			 responsibility for advertising sales);</text>
					</paragraph><paragraph id="H11C3A0C17E7441C0A65622B2FD781883"><enum>(3)</enum><text>the name of the
			 candidate who purchased the advertising time, or on whose behalf the
			 advertising time was purchased, and the Federal elective office for which he or
			 she is a candidate;</text>
					</paragraph><paragraph id="HC25E852387094E0894A7E76C5BFFDFAB"><enum>(4)</enum><text>the name, mailing
			 address, and telephone number of the person responsible for purchasing
			 broadcast political advertising for the candidate;</text>
					</paragraph><paragraph id="HD789FE1D898B4BA7AD77FD9803625B21"><enum>(5)</enum><text>notation as to
			 whether the purchase agreement for which the information is being reported is a
			 draft or final version; and</text>
					</paragraph><paragraph id="HF2C60B4E0664462986A000FAD0C14672"><enum>(6)</enum><text>the following
			 information about the advertisement:</text>
						<subparagraph id="HE2771B5CA44F4AAAA197AD325441715C"><enum>(A)</enum><text>The date and time
			 of the broadcast.</text>
						</subparagraph><subparagraph id="HE45A7E1EBB7A4F1DA2ED352B7005C55"><enum>(B)</enum><text>The program in
			 which the advertisement was broadcast.</text>
						</subparagraph><subparagraph id="H9E6CC35382854A7C9736DE31B521A074"><enum>(C)</enum><text>The length of the
			 broadcast airtime.</text>
						</subparagraph></paragraph></subsection><subsection id="H62733EF8139C4EA5912DF56C9600D0E1"><enum>(c)</enum><header>Internet
			 Access</header><text>In its rulemaking under subsection (a), the Commission
			 shall require any broadcasting station required to file a report under this
			 section that maintains an Internet Web site to make available a link to such
			 reports on that website.</text>
				</subsection></section><section id="H26BB091236534F2EA7C5F88916775524"><enum>204.</enum><header>Limit on
			 congressional use of the franking privilege</header>
				<subsection id="HA5A847A008314232003E7ED699009CD0"><enum>(a)</enum><header>In
			 General</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/3210">Section 3210(a)(6)</external-xref> of title 39, United States Code, is
			 amended by striking subparagraph (A) and inserting the following:</text>
					<quoted-block id="HFECCA45D0420415C9B93F847F560F2B" style="OLC">
						<subparagraph id="H8F7B94A86B5D43E78E5115D13721E900" indent="up2"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H6517528EB81E4B8BB4F85E252ED8900"><enum>(i)</enum><text>Except as provided in
				clause (ii), Member of Congress or a committee or subcommittee of the House of
				Representatives or Senate of which such Member is chairman or ranking minority
				member shall not mail any mass mailing as franked mail during the period which
				begins 90 days before date of the primary election and ends on the date of the
				general election with respect to any Federal office which such Member holds,
				unless the Member has made a public announcement that the Member will not be a
				candidate for reelection to such office in that year.</text>
							</clause><clause id="HB61ECA9979EB4B7184277ED85F5F6B00" indent="up1"><enum>(ii)</enum><text>A Member of Congress or a
				Congressional Committee or Subcommittee of which such Member is Chairman or
				Ranking Member may mail a mass mailing as franked mail during the period
				described in clause (i) if—</text>
								<subclause id="HBF6B2A44D7024D80BCBAB8DDD5BB3B48"><enum>(I)</enum><text>the purpose of the mailing is to
				communicate information about a public meeting; and</text>
								</subclause><subclause id="HFC2486913D70484B8924C120A9326BC7"><enum>(II)</enum><text>the content of the mailed matter
				includes only the name of the Member, Committee, or Subcommittee, as
				appropriate, and the date, time, and place of the public
				meeting.</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H2BCE5D8B2A62478AA88CF9F5357DB840"><enum>(b)</enum><header>Conforming
			 Amendments</header><paragraph commented="no" display-inline="yes-display-inline" id="H808356BA6F9E489DA8FD7E3CD4F454"><enum>(1)</enum><text>Section 3210(a)(6) of
			 title 39, United States Code, is amended by striking subparagraph (C) and by
			 redesignating subparagraphs (D) through (F) as subparagraphs (C) through
			 (E).</text>

			 appeal may be taken directly to the Supreme Court of the United States from any
			 final judgment, decree, or order issued by any court ruling on the
			 constitutionality of any provision of this Act or amendment made by this
			 Act.</text>
			</section><section id="H31AC292B63234F03BFEA66A8A6042160"><enum>402.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">Except as otherwise
			 provided for in this Act, this Act and the amendments made by this Act shall
			 apply with respect to elections occurring in 2010 or any succeeding
