		<official-title>To direct the Secretary of Transportation to establish
		  and collect a national container fee and to use amounts collected from the fee
		  to make grants for infrastructure projects at United States seaports and in
		  surrounding areas to improve the movement of goods, enhance transportation
		  security, and mitigate environmental damage caused by the movement of
		  goods.</official-title>

		<section id="H1C15973708124B259858931828766047" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Making Opportunities Via Efficient and
			 More Effective National Transportation Act of 2008</short-title></quote> or the
			 <quote><short-title>MOVEMENT Act of
			 2008</short-title></quote>.</text>
		</section><section id="H6283CA92C6AE4793AF31EB9F23976F5C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H3C77D5219DAD4D32A3F0BC1EA4AE3DD3"><enum>(1)</enum><text display-inline="yes-display-inline">The movement of goods is a form of
			 interstate commerce.</text>
			</paragraph><paragraph id="H042DFE6DD8ED4960AD4FE1634B5BBD34"><enum>(2)</enum><text>Waterborne
			 containerized shipments of imported products valued at approximately $2
			 trillion entered the United States last year.</text>
			</paragraph><paragraph id="H0F469782683343AF97FF51752AD5DC1"><enum>(3)</enum><text display-inline="yes-display-inline">The number of waterborne containerized
			 shipments of cargo into and out of the United States is expected to increase by
			 more than 350 percent by 2020.</text>
			</paragraph><paragraph id="H71E43550F1864FB785F61F262C1FB905"><enum>(4)</enum><text>In 2006, world
			 waterborne container traffic was estimated at 417 million twenty-foot
			 equivalent units (loaded and empty), 10 percent more than the 378 million
			 twenty-foot equivalent units transported in 2005.</text>
			</paragraph><paragraph id="H0BA486A36C7649409BDD37D49F4B68CF"><enum>(5)</enum><text>From 1995 to 2006,
			 world waterborne container traffic more than tripled in volume from 137 million
			 twenty-foot equivalent units to 417 million twenty-foot equivalent units,
			 growing at an average annual rate of approximately 11 percent.</text>
			</paragraph><paragraph id="H9D57FC745BCA483380DA96CCC0E20707"><enum>(6)</enum><text display-inline="yes-display-inline">The number of waterborne containerized
			 shipments of imported products into the United States increased by 33 percent
			 between fiscal years 2000 and 2006, from 23.5 million shipments to 31.3 million
			 shipments.</text>
			</paragraph><paragraph id="HF32DC49ED7E24815B9AA68E33E00E0F7"><enum>(7)</enum><text>In 2007, the 10
			 most productive containerized seaports in the United States, when measured in
			 terms of tonnage processed, handled 88 percent of all United States waterborne
			 container trade.</text>
			</paragraph><paragraph id="H8FC2BA45E6BB43C5BCDBEBD342A7CA00"><enum>(8)</enum><text display-inline="yes-display-inline">The California Air Resources Board, in its
			 2006 Emission Reduction Plan for Ports and Goods Movement, calculated that in
			 California alone there are 2,400 premature heart-related deaths related to port
			 and goods movement pollution, 62,000 cases of asthma symptoms, and more than 1
			 million respiratory-related school absences every year.</text>
			</paragraph></section><section id="H45798BB4D7FB4DF6A188AC4B6BA029D9"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph id="HE89D989D220F4D1BA1D5EC8525262150"><enum>(1)</enum><header>Beneficial cargo
			 owner</header><text display-inline="yes-display-inline">The term
			 <quote>beneficial cargo owner</quote> means the importer of record, who
			 physically takes possession of cargo at a destination and does not act as a
			 third party in the movement of such goods.</text>
			</paragraph><paragraph id="H82A0AE8987D64386B545686E936C683C"><enum>(2)</enum><header>Cargo
			 container</header><text>The term <quote>cargo container</quote> means a
			 twenty-foot equivalent unit or a forty-foot equivalent unit.</text>
			</paragraph><paragraph commented="no" id="HB875CF0B777B4EDB9D4DF6F792514F63"><enum>(3)</enum><header>Covered
			 seaport</header><text display-inline="yes-display-inline">The term
			 <quote>covered seaport</quote> means a seaport that has been designated as a
			 port of entry by the Commissioner of U.S. Customs and Border Protection.</text>
			</paragraph><paragraph id="HEF0460CF9AD44B4A91AB3FEED781C343"><enum>(4)</enum><header>Eligible
			 environmental project</header><text display-inline="yes-display-inline">The
			 term <quote>eligible environmental project</quote> means a project that
			 mitigates environmental damage to air, water, and soil caused by the movement
			 of goods.</text>
			</paragraph><paragraph commented="no" id="H5EDD8C097429430BABF2FF594B3F164E"><enum>(5)</enum><header>Eligible goods
			 movement improvement project</header><text display-inline="yes-display-inline">The term <quote>eligible goods movement
			 improvement project</quote> means a project eligible for assistance under title
			 23, United States Code, that has as its primary purpose improving the movement
			 of cargo containers in interstate commerce.</text>
			</paragraph><paragraph id="H495CD7B6BA714E0F9726825E52E7A449"><enum>(6)</enum><header>Eligible
			 homeland security project</header><text>The term <quote>eligible homeland
			 security infrastructure project</quote> means a project eligible for assistance
			 under <external-xref legal-doc="usc" parsable-cite="usc/46/70107">section 70107</external-xref> of title 46, United States Code.</text>
			</paragraph><paragraph id="H0E9F579533954073887B6C6C87277C49"><enum>(7)</enum><header>Eligible
			 project</header><text display-inline="yes-display-inline">The term
			 <quote>eligible project</quote> means any eligible goods movement improvement
			 project, eligible homeland security project, or eligible environmental
			 project.</text>
			</paragraph><paragraph id="H85290427E7EF48988127DA75ECE602D1"><enum>(8)</enum><header>Forty-foot
			 equivalent unit</header><text>The term <quote>forty-foot equivalent
			 unit</quote> means a shipping container that measures approximately 39.5 feet
			 by 7.8 feet by 7.10 feet.</text>
			</paragraph><paragraph id="H1C549FB119B14209977278F4E95D6C02"><enum>(9)</enum><header>Interstate
			 commerce</header><text display-inline="yes-display-inline">The term “interstate
			 commerce” means commerce between any place in a State and any place outside of
			 that State, or within any possession of the United States (not including the
			 Canal Zone) or the District of Columbia, and commerce between places within the
			 same State but through any place outside of that State.</text>
			</paragraph><paragraph id="H115DDE1409E7418A8FA568A93D2DF947"><enum>(10)</enum><header>National Goods
			 Movement Improvement Account</header><text>The term <quote>National Goods
			 Movement Improvement Account</quote> means the separate account established by
			 section 5.</text>
			</paragraph><paragraph id="H833C1B3D750743709719E46455A8E423"><enum>(11)</enum><header>National Goods
			 Movement Improvement Grant Program</header><text display-inline="yes-display-inline">The term <quote>National Goods Movement
			 Improvement Grant Program</quote> means the grant program authorized by section
			 6.</text>
			</paragraph><paragraph id="H0CD4BF908E8443A18D32C32F7DCF6E6E"><enum>(12)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Transportation.</text>
			</paragraph><paragraph id="HB669375FD1DB42E4932360127BECA8E8"><enum>(13)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means any of
			 the 50 States, the District of Columbia, American Samoa, Guam, the Northern
			 Mariana Islands, Puerto Rico, the Virgin Islands, and any other territory or
			 possession of the United States.</text>
			</paragraph><paragraph id="HAADBF0E3438B4CFBB6ED5DDE0020C3D7"><enum>(14)</enum><header>State
			 transportation department</header><text>The term <quote>State transportation
			 department</quote> has the meaning such term has under <external-xref legal-doc="usc" parsable-cite="usc/23/101">section 101</external-xref> of title 23,
			 United States Code.</text>
			</paragraph><paragraph id="HE7EC6C35393E4966A47D58EB62A39E01"><enum>(15)</enum><header>Twenty-foot
			 equivalent unit</header><text>The term <quote>twenty-foot equivalent
			 unit</quote> means a shipping container that measures approximately 20 feet by
			 8 feet by 8 feet.</text>
			</paragraph><paragraph id="HF391E36C5728429CA05C608356A9B0EB"><enum>(16)</enum><header>United
			 States</header><text display-inline="yes-display-inline">The term <quote>United
			 States</quote> means the 50 States, the District of Columbia, American Samoa,
			 Guam, the Northern Mariana Islands, Puerto Rico, the Virgin Islands, and any
			 other territory or possession of the United States.</text>
			</paragraph></section><section id="H8652486D2C6B4E22AF58FDB336032434"><enum>4.</enum><header>Fee
			 structure</header>
			<subsection display-inline="no-display-inline" id="HC9D02B58A0DF4A99BCA9043317655950"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall issue regulations to establish a national container fee to be collected
			 on each cargo container that is imported into the United States or exported out
			 of the United States in commerce at a covered seaport.</text>
			</subsection><subsection id="HDA3769CFDB1242AEAAB1C1E146BE1DE"><enum>(b)</enum><header>Amount</header><text>The
			 amount of the fee to be collected on a cargo container under subsection (a)
			 shall be—</text>
				<paragraph id="HD7CEA125A66A4D8D9D7287055556D01"><enum>(1)</enum><text>$25 for a
			 twenty-foot equivalent unit; and</text>
				</paragraph><paragraph id="HFD6D33BAACE2469AA98C2B20226D06E6"><enum>(2)</enum><text display-inline="yes-display-inline">$50 for a forty-foot equivalent
			 unit.</text>
				</paragraph></subsection><subsection id="HA77D7F1A64654B31A590D0543BCB00AC"><enum>(c)</enum><header>Payment</header><text display-inline="yes-display-inline">The beneficial cargo owner of merchandise
			 in a cargo container subject to the fee to be collected under subsection (a)
			 shall be responsible for payment of the fee. If there is more than one
			 beneficial cargo owner with respect to merchandise in a cargo container subject
			 to the fee to be collected under subsection (a), each beneficial cargo owner
			 shall be responsible for payment of an equal portion of the fee.</text>
			</subsection><subsection id="H459916C17CEB438FBBD03031A9FABC32"><enum>(d)</enum><header>Collection</header><text display-inline="yes-display-inline">The Secretary, in cooperation with the
			 Commissioner of U.S. Customs and Border Protection, shall provide for
			 collection of the fee under subsection (a).</text>
			</subsection><subsection commented="no" id="H73EA0EC69FF64398B751AA3700EC219"><enum>(e)</enum><header>Container
			 form</header><text>Not later than 90 days after the date of enactment of this
			 Act, the Secretary, in cooperation with the Commissioner of U.S. Customs and
			 Border Protection, shall provide for modification of shippers export
			 declaration and entry summary forms to include a listing of the number of cargo
			 containers being used by each beneficial cargo owner per shipment.</text>
			</subsection><subsection id="HFB7E24BB032049A5ABF603FB65FB673C"><enum>(f)</enum><header>Deposit</header><text display-inline="yes-display-inline">Amounts received at covered seaports by the
			 United States as a result of the fee to be collected under subsection (a) shall
			 be deposited into the National Goods Movement Improvement Account established
			 under section 5 on a quarterly basis.</text>
			</subsection><subsection id="HC879B2581AAB4312BDDEE7C555E5FBA6"><enum>(g)</enum><header>Adjustments of
			 fees</header>
				<paragraph id="H0D4AAC01680B41C500444907BA53CB8C"><enum>(1)</enum><header>In
			 general</header><text>After the last day of the 5-year period beginning on the
			 date of enactment of this Act, the Secretary may increase or decrease the
			 amount of the fee to be collected under subsection (a) based on infrastructure
			 funding needs identified under the National Goods Movement Improvement Grant
			 Program authorized by section 6.</text>
				</paragraph><paragraph id="HE0347D5DAA764201BCD6626B0051BB8C"><enum>(2)</enum><header>Congressional
			 notification</header><text>The Secretary shall provide written notice to
			 Congress of any proposed increase or decrease of the fee at least 30 days
			 before the increase or decrease takes effect.</text>
				</paragraph><paragraph id="H38F65D2C65C348BD9286E4BABDBF1E30"><enum>(3)</enum><header>Limitation</header><text>Paragraph
			 (1) shall not be construed to authorize the Secretary to eliminate the
			 fee.</text>
				</paragraph></subsection><subsection id="HB09C3B06FF3A4C53BB717DA93D3DD96"><enum>(h)</enum><header>Termination of
			 fee</header><text>The fee established pursuant to subsection (a) shall not
			 apply after September 30, 2018.</text>
			</subsection></section><section id="H2C6D1E7230BD45D188897450C400A0A7"><enum>5.</enum><header>Account</header>
			<subsection id="H46D4955BA9CB4523ACB50100B79FBC33"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury a
			 separate account to be known as the <quote>National Goods Movement Improvement
			 Account</quote>.</text>
			</subsection><subsection id="HE6592388F70B4BDEBA6D09253979B837"><enum>(b)</enum><header>Contents</header><text>The
			 account shall consist of amounts deposited into the account under this
			 Act.</text>
			</subsection><subsection id="HBB3E0851C09F4E6B8176D8CFEF30A95D"><enum>(c)</enum><header>Use</header><text>Amounts
			 in the account shall be available to the Secretary, as provided in
			 appropriations Acts, for making expenditures before October 1, 2019, to meet
			 the obligations of the United States entered into under this Act.</text>
			</subsection></section><section id="H1EF8EE7D869741F2B034FCF6E2049327"><enum>6.</enum><header>Grant
			 Program</header>
			<subsection id="HF24F4D32060E46FABDC27D3977EC3478"><enum>(a)</enum><header>General
			 authority</header><text display-inline="yes-display-inline">The Secretary shall
			 carry out a program, to be known as the <quote>National Goods Movement
			 Improvement Grant Program</quote>, to provide funding in accordance with the
			 requirements of this section for eligible projects using amounts appropriated
			 out of the National Goods Movement Improvement Account.</text>
			</subsection><subsection id="HCDB545BB84984AF2B94DBC1335780683"><enum>(b)</enum><header>Administrative
			 expenses</header><text display-inline="yes-display-inline">The Secretary may
			 set aside not to exceed one percent of the aggregate amount appropriated out of
			 the National Goods Movement Improvement Account for a fiscal year to pay the
			 administrative costs of the Secretary in carrying out this Act.</text>
			</subsection><subsection id="HA634CE962BF64AC4B492D924F9CFD8D5"><enum>(c)</enum><header>Apportionment of
			 funds</header>
				<paragraph id="H0F71EB38AB644C029EB07524BFD8D142"><enum>(1)</enum><header>In
			 general</header><text>On October 1 of a fiscal year, after setting aside funds
			 under subsection (b), the Secretary shall apportion 50 percent of the remaining
			 funds appropriated out of the National Goods Movement Improvement Account for
			 the fiscal year among the States in the form of grants in the ratio
			 that—</text>
					<subparagraph id="HDCD51828661546F19FC4C1EA66A0F59"><enum>(A)</enum><text>the amount of fees
			 collected under section 4 during the preceding fiscal year that are
			 attributable to a covered seaport located in the State; bears to</text>
					</subparagraph><subparagraph id="H5F453F8E6E8F42E400A8C4152656C63"><enum>(B)</enum><text>the aggregate
			 amount of fees collected under section 4 during the preceding fiscal
			 year.</text>
					</subparagraph></paragraph><paragraph id="H62B10414CB8945F9008F325B26826C7E"><enum>(2)</enum><header>Availability of
			 amounts to State transportation departments</header><text>Amounts apportioned
			 to a State under this subsection shall be made available its State
			 transportation department. Such amounts may not be transferred to any other
			 entity.</text>
				</paragraph><paragraph id="H379C63B4F04D45EFB3B7306057F351BA"><enum>(3)</enum><header>Eligible
			 projects</header><text>A State transportation department may obligate funds
			 apportioned to the State under this subsection only for eligible projects that
			 have been approved by the Secretary in accordance with such procedures as the
			 Secretary may require.</text>
				</paragraph><paragraph id="HD9227CF870774C0F86FE003221F62322"><enum>(4)</enum><header>Allocations of
			 apportioned funds</header><text>Of the amounts apportioned to a State under
			 this subsection for a fiscal year—</text>
					<subparagraph id="H9CD0E1127C8D4EE69193D617B740C1E3"><enum>(A)</enum><text>80 percent shall
			 be available only for eligible goods movement improvement projects;</text>
					</subparagraph><subparagraph id="HFFC60D481C064FF79B718500B27F6CA4"><enum>(B)</enum><text display-inline="yes-display-inline">10 percent shall be available only for
			 eligible homeland security projects; and</text>
					</subparagraph><subparagraph id="H93E7BB9D3EBD49A3B234AECCA6CA5073"><enum>(C)</enum><text display-inline="yes-display-inline">10 percent shall be available only for
			 eligible environmental projects.</text>
					</subparagraph></paragraph></subsection><subsection id="HAE5CB83065FB4926A9AC72803BC9D3EE"><enum>(d)</enum><header>Discretionary
			 grants</header>
				<paragraph id="HCFEBFBB609AB4F48BC55275D604600FC"><enum>(1)</enum><header>In
			 general</header><text>After setting aside funds under subsection (b) and making
			 apportionments under subsection (c), the remaining funds appropriated out of
			 the National Goods Movement Improvement Account for a fiscal year shall be
			 available to the Secretary for making discretionary grants for eligible
			 projects under this subsection.</text>
				</paragraph><paragraph id="HAEF5FA18DC884E6387A6D09E546E7BB1"><enum>(2)</enum><header>Eligible
			 recipients</header><text display-inline="yes-display-inline">A State
			 transportation department, owner or operator of a covered seaport, or owner or
			 operator of a railroad shall be eligible to receive a grant under this
			 subsection. A grant received under this subsection may not be transferred to
			 any other entity.</text>
				</paragraph><paragraph id="H09BEDC0FC56941EEBD8693789096E149"><enum>(3)</enum><header>Applications</header><text display-inline="yes-display-inline">A State transportation department, owner or
			 operator of a covered seaport, or owner or operator of a railroad seeking a
			 grant under this subsection shall submit to the Secretary an application that
			 is in such form and contains such information as the Secretary may
			 require.</text>
				</paragraph><paragraph id="HFB81A288A07446379DF902AA8077A318"><enum>(4)</enum><header>Allocation of
			 grant awards</header><text display-inline="yes-display-inline">Of the amounts
			 awarded in grants under this subsection for a fiscal year—</text>
					<subparagraph id="H0F0392E4829C4CB59319CBC317EBF7E2"><enum>(A)</enum><text>80 percent shall
			 be available only for eligible goods movement improvement projects;</text>
					</subparagraph><subparagraph id="HB75101D1EDE549498281784C02047054"><enum>(B)</enum><text>10 percent shall
			 be available only for eligible homeland security projects; and</text>
					</subparagraph><subparagraph id="H4B3480DF67AC4BE69F9CC665E2151DBC"><enum>(C)</enum><text>10 percent shall
			 be available only for eligible environmental projects.</text>
					</subparagraph></paragraph></subsection><subsection id="H4996CFA6D74C41E9A91E3616AB93DB30"><enum>(e)</enum><header>Project
			 selection guidelines</header>
				<paragraph id="HCC4DF3ED827B4DB7B2CD6769EEAF5500"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Secretary shall establish
			 guidelines for the selection of projects for grant funding under subsections
			 (c) and (d).</text>
				</paragraph><paragraph id="H81AD1D288E5D4029ABE61C19D041CF2F"><enum>(2)</enum><header>Availability of
			 guidelines</header><text>The Secretary shall make the guidelines established
			 under this subsection available to State departments of transportation, owners
			 and operators of covered seaports, and owners and operators of
			 railroads.</text>
				</paragraph><paragraph id="H0B5DDD36CAED43E0BB42B88C455B870"><enum>(3)</enum><header>Minimum
			 requirements</header><text>In establishing the guidelines under this
			 subsection, the Secretary shall ensure that the sponsor of an eligible project
			 receiving grant funding under this Act can demonstrate—</text>
					<subparagraph id="H0E528BE410BA48E28BAD367813A02027"><enum>(A)</enum><text display-inline="yes-display-inline">a financial need for the use of Federal
			 funding for the project; and</text>
					</subparagraph><subparagraph id="H1F5D282D43724CC10046AFF129D451F3"><enum>(B)</enum><text>a clear and
			 definable purpose for the project, including how the project will promote one
			 or more of the goals of—</text>
						<clause id="HFE2F98C0C7EA441BBA098733BD688F9C"><enum>(i)</enum><text>improved highway,
			 rail, and port goods movement;</text>
						</clause><clause id="HA857D9D475C44150B5C4C9CD5824700"><enum>(ii)</enum><text>greater security;
			 and</text>
						</clause><clause id="HF8EC66040F4D44DE822408C75DF57523"><enum>(iii)</enum><text>support for
			 projects that mitigate environmental damage caused by the movement of
			 goods.</text>
						</clause></subparagraph></paragraph><paragraph id="H8D37EF79FE234AD58E536257A5FD238E"><enum>(4)</enum><header>Projects
			 accomplishing multiple goals</header><text>In establishing the guidelines under
			 this subsection, the Secretary shall encourage the selection of projects that
			 accomplish multiple goals described in paragraph (3)(B).</text>
				</paragraph><paragraph id="HE3CD2F56E3B1485BBF98AA847FD0705E"><enum>(5)</enum><header>Planning
			 requirements</header><text display-inline="yes-display-inline">In establishing
			 the guidelines under this subsection, the Secretary shall ensure that eligible
			 goods movement improvement projects are selected in accordance with applicable
			 metropolitan and statewide planning processes, including sections 134 and 135
			 of title 23, United States Code.</text>
				</paragraph></subsection><subsection id="H55474F0995AE4D89930056BACFA9BFC9"><enum>(f)</enum><header>Location of
			 projects</header>
				<paragraph id="H2E20A54AE8B34744910243D83521728C"><enum>(1)</enum><header>Projects carried
			 out using apportioned funds</header><text>A project carried out using amounts
			 apportioned to a State under subsection (c) shall be physically located, in
			 whole or in part, on the site of a covered seaport located in the State or
			 within a 40-mile radius of such a site.</text>
				</paragraph><paragraph id="H70AD466489C247B69DDDE100FB2E21E5"><enum>(2)</enum><header>Projects carried
			 out using discretionary grants</header>
					<subparagraph id="HE2B1DDBF959E48218079CA04900715CD"><enum>(A)</enum><header>Projects at or
			 near a covered seaport</header><text>The Secretary shall ensure that an amount
			 equal to at least 90 percent of the funds awarded in discretionary grants under
			 subsection (d) is used to carry out projects that are physically located, in
			 whole or in part, on the site of a covered seaport or within a 40-mile radius
			 of such a site.</text>
					</subparagraph><subparagraph id="H2F5A1C8AC1AF40C9A58F16F621D800EE"><enum>(B)</enum><header>Other
			 projects</header><text display-inline="yes-display-inline">The Secretary shall
			 ensure that any project receiving funds awarded in discretionary grants under
			 subsection (d) that is not physically located, in whole or in part, on the site
			 of a covered seaport or within a 40-mile radius of such a site—</text>
						<clause id="HBDF649277725450DA897532E40D69064"><enum>(i)</enum><text>is
			 part of a goods movement chain that originates at a covered seaport;</text>
						</clause><clause id="H925CB00BFE0D402C006E6F6EFB905371"><enum>(ii)</enum><text>is
			 designed to accomplish multiple goals described in subsection (e)(3)(B);
			 and</text>
						</clause><clause id="H2CCADAF923344793AB68D4EC90AF5397"><enum>(iii)</enum><text display-inline="yes-display-inline">is physically located, in whole or in part,
			 within a 100-mile radius of a covered seaport.</text>
						</clause></subparagraph><subparagraph id="H029489908F214205A52E97F059E8C214"><enum>(C)</enum><header>Annual
			 report</header><text>The Secretary shall provide to Congress, on an annual
			 basis, a report containing a description of the projects selected under
			 subparagraph (B) in the preceding fiscal year and the reasons for selection of
			 the projects.</text>
					</subparagraph></paragraph></subsection></section><section id="H8F319F6473FB4F06B30033EDEAEDB76E"><enum>7.</enum><header>Administrative
			 provisions</header>
			<subsection id="H9E77E2837D084A179B83922CD547E4DE"><enum>(a)</enum><header>Date available
			 for obligation</header><text display-inline="yes-display-inline">Authorizations
			 from the National Goods Movement Improvement Account shall be available for
			 obligation on the date of their apportionment or allocation or on October 1 of
			 the fiscal year for which they are authorized, whichever occurs first.</text>
			</subsection><subsection id="H9A114AFE795E466BBCD921765B00918E"><enum>(b)</enum><header>Period of
			 availability</header><text>Funds apportioned or allocated to a State department
			 of transportation, owner or operator of a covered seaport, or owner or operator
			 of a railroad for a project shall remain available for obligation for such
			 purpose for a period of 2 years after the last day of the fiscal year for which
			 the funds are authorized. Any funds so apportioned or allocated that remain
			 unobligated at the end of such period shall be distributed by the Secretary in
			 discretionary grants under section 6(d) in the subsequent fiscal year.</text>
			</subsection><subsection commented="no" id="H400C83BE978A42558CEAA1AFD5216E9E"><enum>(c)</enum><header>Grants as
			 contractual obligations</header><text>A grant for a project under this Act that
			 is approved by the Secretary is a contractual obligation of the Government to
			 pay the Federal share of the cost of the project.</text>
			</subsection><subsection id="H3C29092387CE4826A6593F001063BEFB"><enum>(d)</enum><header>Construction
			 standards</header><text display-inline="yes-display-inline">A project to be
			 carried out with assistance under this Act that is for a highway that is on a
			 Federal-aid system (as such terms are defined in <external-xref legal-doc="usc" parsable-cite="usc/23/101">section 101</external-xref> of title 23,
			 United States Code) shall be constructed to the same standards that would apply
			 if such project was being carried out with assistance under chapter 1 of title
			 23, United States Code.</text>
			</subsection><subsection id="HD5F9B22A65AC49C69418588F9B5400A7"><enum>(e)</enum><header><?xm-replace_text "?>Prevailing
			 rate of wage</header><text display-inline="yes-display-inline">Section 113 of
			 title 23, United States Code, shall apply to a project being carried out with
			 assistance provided under this Act in the same manner and to the same extent as
			 such section would apply if such project was being carried out with assistance
			 provided under chapter 1 of such title.</text>
			</subsection><subsection id="HA798A75DDAEC4693003154201C02C16E"><enum>(f)</enum><header>Federal
			 share</header>
				<paragraph id="H3D9918BBEE874FACA0694646B59FA626"><enum>(1)</enum><header>In
			 general</header><text>The Federal share of the cost of a project for which a
			 grant is made under this Act shall be 75 percent.</text>
				</paragraph><paragraph id="H62B68B1386114A69B9C5B944F9AF393D"><enum>(2)</enum><header>Non-Federal
			 share</header><text>The non-Federal share of the cost of a project for which a
			 grant is made under this Act may not be provided from Federal funds made
			 available under any other law (including funds from the Highway Trust
			 Fund).</text>
				</paragraph></subsection><subsection id="H0C068E54FC874D0889FB322752E46CD5"><enum>(g)</enum><header>Prohibition</header><text>No
			 funds made available under this section may be used by grant recipients to
			 conduct a study related to a future project.</text>
			</subsection></section><section id="H65EAF6D16AA743B89FEF8812F0044D3"><enum>8.</enum><header>Reporting
			 requirement</header>
			<subsection id="HEAEA98CC960747429E8F349F7499C7EA"><enum>(a)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Not later than
			 December 31, 2010, and annually thereafter during the term of the National
			 Goods Movement Improvement Grant Program (in this section referred to as the
			 <quote>program</quote>), the Secretary shall submit to Congress a report on the
			 results of the program.</text>
			</subsection><subsection id="H627D6BA77CFD4F44B21C494492105CD6"><enum>(b)</enum><header>Contents</header><text>The
			 report to be submitted under subsection (a) shall include, at a minimum—</text>
				<paragraph id="H87DB0E942745407F9D19F6DA4BD1E929"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the impact that the
			 program has had on enhancing the efficiency of goods movement across the United
			 States, enhancing the security of the movement of goods, and supporting
			 programs that mitigate the environmental damage caused by the movement of
			 goods;</text>
				</paragraph><paragraph id="HC782C08109844ADDAA2B42F35F12A85E"><enum>(2)</enum><text display-inline="yes-display-inline">a list identifying each project selected
			 for funding under the program during the prior fiscal year and the amount of
			 funding provided under this Act for the project;</text>
				</paragraph><paragraph id="H3F918200B6E34C279200552359EB41E"><enum>(3)</enum><text>a
			 description of the impact, if any, that the program has had on the cost of
			 imported consumer goods in the United States;</text>
				</paragraph><paragraph id="H092609629DA343149273D2A48CB79311"><enum>(4)</enum><text>an assessment of
			 the current condition of the National Goods Movement Improvement
			 Account;</text>
				</paragraph><paragraph id="H97785C6A75B54352907F687CECE477F"><enum>(5)</enum><text>an
			 assessment of the level of efficiency with which the Secretary distributes
			 amounts from the National Goods Movement Improvement Account to projects
			 nationwide;</text>
				</paragraph><paragraph id="H631BDE406A774887A0548CF3A4974DC4"><enum>(6)</enum><text>recommendations
			 regarding the potential for expansion or other changes to the program,
			 including adjustments to the fee collected under section 4 to ensure that the
			 fee is producing sufficient funding for the program; and</text>
				</paragraph><paragraph id="H569004456F574D3CB2F53E3E5FDAE1CF"><enum>(7)</enum><text>recommendations
			 regarding whether the program should be reauthorized by Congress and, if so,
			 whether the fee collected under section 4 should be increased or decreased to
			 support infrastructure spending.</text>
				</paragraph></subsection><subsection id="H28A1A7F3469A43EDA85EF2CA52713286"><enum>(c)</enum><header>Consultation</header><text>In
			 developing the report to be submitted under subsection (a), the Secretary shall
			 consult with the Secretary of Commerce, the Secretary of Homeland Security, and
			 the Administrator of the Environmental Protection Agency.</text>
			</subsection></section><section id="H615601CBF5D64B4AA9324F16E2B246A9"><enum>9.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated out of the National Goods Movement Improvement
			 Account to carry out this Act for each of fiscal years 2009 through 2019 such
			 sums as were deposited in the Account during the preceding fiscal year.</text>
		</section><section id="H754D4ABCC77D4353B4EF56D7A8C46D8F"><enum>10.</enum><header>Sunset
			 provision</header><text display-inline="no-display-inline">The authority of the
			 Secretary to make grants under this Act shall continue in effect until October
			 1, 2019.</text>
