		<official-title>To require any eligible telecommunications carrier
		  receiving universal service support for the provision of services for rural,
		  insular, and high cost areas to offer automatic roaming services to any
		  technically compatible carrier upon request.</official-title>

		<section id="HA55BF28B5C46404EBCB5F9E73F21E382" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Universal Roaming Act of
			 2008</short-title></quote>.</text>
		</section><section id="H4035F2B4C2B14A609203F562FA41BB98" section-type="subsequent-section"><enum>2.</enum><header>Roaming requirements
			 for recipients of high cost universal service support</header><text display-inline="no-display-inline">Section 254 of the Communications Act of
			 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>) is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HA410AC7B41DE4B5A87D871551B69D58B" style="OLC">
				<subsection id="HD81DD3BE81384B8FB569AD6CCE419B7B"><enum>(m)</enum><header>Automatic
				roaming requirement</header>
					<paragraph id="HBDA2BFEDC62549DC8F24E9B9C9F65228"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Any eligible
				telecommunications carrier under subsection (e) that receives, on or after the
				end of the 180-day period that begins on the date of enactment of the
				<short-title>Universal Roaming Act of 2008</short-title>,
				Federal universal service support, as described in paragraph (2), and any
				affiliate of such eligible telecommunications carrier, shall be required to
				offer automatic roaming services without territorial limitation or restriction
				on just and reasonable terms, consistent with sections 201 and 202, to a
				carrier—</text>
						<subparagraph id="H184E76D9086A42DFB55E0003ED253EF5"><enum>(A)</enum><text>that requests such
				services on behalf of its subscribers; and</text>
						</subparagraph><subparagraph id="H869C6FAB180646129666FDFFAB64DD68"><enum>(B)</enum><text>that provides
				technically compatible equipment to its subscribers.</text>
						</subparagraph></paragraph><paragraph id="H7F6606E5F5E544AE8B12F187CA92B27B"><enum>(2)</enum><header>Supported
				services</header><text display-inline="yes-display-inline">The requirement in
				paragraph (1) of this subsection shall only apply to an eligible
				telecommunications carrier and such carrier’s affiliate if either such carrier
				or such affiliate receives support for the provision of services for rural,
				insular, and high cost areas supported under subsection (c)(1), as modified
				pursuant to subsection (c)(2).</text>
					</paragraph><paragraph id="HD46CB0A134DD4ED583BFAD20061F84B"><enum>(3)</enum><header>Opt-out
				procedure</header>
						<subparagraph id="HE1CBF31FB431405200DBA8F5DED02572"><enum>(A)</enum><header>Notification</header><text display-inline="yes-display-inline">An eligible telecommunications carrier
				required to offer automatic roaming under paragraph (1) may notify the
				Commission that the carrier shall cease to seek and obtain universal service
				support with regard to the provision of services for rural, insular, and high
				cost areas.</text>
						</subparagraph><subparagraph commented="no" id="HAEB34BCF1FEF44BA00F957FAE156B063"><enum>(B)</enum><header>Obligations and
				support cease</header><text>Such carrier shall not be subject to the
				requirements of paragraph (1) and shall cease to receive universal service
				support with regard to the provision of services for rural, insular, and high
				cost areas at the end of the 90-day period that begins on the date that the
				Commission receives the notification under subparagraph (A), provided that such
				carrier and all of the affiliates of such carrier cease to receive such
				universal service support.</text>
						</subparagraph></paragraph><paragraph id="HFAFCFC63EC3B47C6B0AB46D3827832B1"><enum>(4)</enum><header>Dispute
				resolution</header><text display-inline="yes-display-inline">The Commission
				shall adjudicate any dispute about terms or technical compatibility pursuant to
				existing Commission procedures implementing section 208.</text>
					</paragraph><paragraph id="H12A893C7FA2C46F19C561FCCD39318EF"><enum>(5)</enum><header>No rate
				regulation</header><text display-inline="yes-display-inline">Nothing in this
				subsection shall be construed as prescribing particular rates for the provision
				of automatic roaming services.</text>
					</paragraph><paragraph id="H0C48CF1A570A410D945F974B84870002"><enum>(6)</enum><header>Definition of
				automatic roaming</header><text>The term <quote>automatic roaming</quote> shall
				have the meaning given such term in the Commission’s
				regulations.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
