<title id="H6E0E4995028E4E12993D551FF2B4C9B0"><enum>I</enum><header>Integrated Deepwater Program</header> 
<section id="H432CC37C94BF449DB7227F40E65C2147" section-type="subsequent-section"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Integrated Deepwater Program Reform Act of 2008</short-title></quote>.</text> </section> 
<section id="HAC85BB083A9346ACA5F2EFF4F8EFDC89"><enum>102.</enum><header>Procurement structure</header> 
<subsection id="HB903FF4FF9C74487A149FBCCFFDAC35B"><enum>(a)</enum><header>In general</header> 
<paragraph id="HB9FFF76E868C4B68A882AAF4BE10AEA2"><enum>(1)</enum><header>Use of lead systems integrator</header><text>Except as provided in subsection (b), the Secretary may not use a private sector entity as a lead systems integrator for acquisitions under, or in support of, the Integrated Deepwater Program after the end of the 180-day period beginning on the date of enactment of this Act.</text> </paragraph> 
<paragraph id="H7CC42F4C8F454943002F007F31523299"><enum>(2)</enum><header>Full and open competition</header><text>The Secretary and the lead systems integrator for the Integrated Deepwater Program shall utilize full and open competition for any acquisition for which an outside contractor is used under, or in support of, the Integrated Deepwater Program after the date of enactment of this Act, unless otherwise excepted in accordance with the Competition in Contracting Act of 1984 and the Federal Acquisition Regulation.</text></paragraph>
<paragraph id="HA1FBE70BB2644A2F83C01D9913DFDF96"><enum>(3)</enum><header>No effect on Small Business Act</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to supersede or otherwise affect the authorities provided by and under the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>).</text> </paragraph></subsection> 
<subsection id="H3D1F17627A6749C993D4C123872961C6"><enum>(b)</enum><header>Exceptions</header> 
<paragraph id="H051A676AA4E24BAC86DB0745CA31E34"><enum>(1)</enum><header>Completion of acquisitions by lead systems integrator</header><text>Notwithstanding subsection (a), the Secretary may use a private sector entity as a lead systems integrator for the Coast Guard—</text> 
<subparagraph id="HD71793B0EC844B5B81F1FD4B2CB7EF63"><enum>(A)</enum><text>to complete any delivery order or task order that was issued to the lead systems integrator on or before the date that is 180 days after the date of enactment of this Act without any change in the quantity of assets or the specific type of assets covered by the order;</text> </subparagraph> 
<subparagraph id="H87489302CAF745280055DBBF5D9900C2"><enum>(B)</enum><text>for acquisitions after the date that is 180 days after the date of enactment of this Act of, or in support of, the HC–130J aircraft, the HH–65 aircraft, and the C4ISR system if the requirements of subsection (c) are met with respect to such acquisitions;</text> </subparagraph> 
<subparagraph id="H67B77846C2CB408FB63E37F1A3158B00"><enum>(C)</enum><text display-inline="yes-display-inline">for acquisitions after the date that is 180 days after the date of enactment of this Act of, or in support of, National Security Cutters or Maritime Patrol Aircraft under contract or order for construction as of the date that is 180 days after the date of enactment of this Act, if the requirements of subsection (c) are met with respect to such acquisitions; and</text> </subparagraph> 
<subparagraph id="H8F409633C6BF4CCEB1FDD61F3820035"><enum>(D)</enum><text display-inline="yes-display-inline">for the acquisition, or in support, of additional National Security Cutters or Maritime Patrol Aircraft if the Secretary determines that—</text> 
<clause id="HA7179FD35F05426A9E00ABEF04E39C3D"><enum>(i)</enum><text>the acquisition is in accordance with the Competition in Contracting Act of 1984 and the Federal Acquisition Regulation;</text> </clause> 
<clause id="HDD70AFE5B3654EBE9FF6AE9806D09183"><enum>(ii)</enum><text display-inline="yes-display-inline">the acquisition and the use of a private sector entity as a lead systems integrator for the acquisition is in the best interest of the Federal Government; and</text> </clause> 
<clause id="H466B7157BA304E37B4A745E59FABE74"><enum>(iii)</enum><text>the requirements of subsection (c) are met with respect to such acquisition.</text> </clause></subparagraph></paragraph> 
<paragraph id="H99A3CAC1471F4241AC5D6727A16160D4"><enum>(2)</enum><header>Awards to Tier 1 subcontractors</header><text>The Secretary may award to any Tier 1 subcontractor or subcontractor below the Tier 1 level any acquisition that the Secretary could award to a lead systems integrator under paragraph (1).</text> </paragraph> 
<paragraph id="H7268FC3840F24FE6BD00A67555CBD5FA"><enum>(3)</enum><header>Report on decision-making process</header><text>If the Secretary determines under paragraph (1)(B), (1)(C), or (1)(D) that the Coast Guard will use a private sector lead systems integrator for an acquisition, the Secretary shall notify in writing the appropriate congressional committees of the Secretary’s determination and shall provide a detailed rationale for the determination, at least 30 days before the award of a contract, delivery order, or task order using a private sector lead systems integrator, including a comparison of the cost of the acquisition through the private sector lead systems integrator with the expected cost if the acquisition were awarded directly to the manufacturer or shipyard.</text> </paragraph></subsection> 
<subsection id="H61DC58F34C0F41EA886842F8ABC2374D"><enum>(c)</enum><header>Limitation on lead systems integrators</header><text>Neither an entity performing lead systems integrator functions for an acquisition under, or in support of, the Integrated Deepwater Program, nor a Tier 1 subcontractor, for any acquisition described in subsection (b)(1)(B), (b)(1)(C), or (b)(1)(D) may have a financial interest in a subcontractor below the tier 1 subcontractor level unless—</text> 
<paragraph id="HD0DA496DFE6F4EF4B581EB9D257F5D7"><enum>(1)</enum><text>the subcontractor was selected by the Secretary through full and open competition for such procurement;</text> </paragraph> 
<paragraph id="H4FF83E7DA7F5487BB801D63437F28EDD"><enum>(2)</enum><text>the procurement was awarded by the lead systems integrator or a subcontractor through full and open competition;</text> </paragraph> 
<paragraph id="HAE0E03CB0AB94002A91FCB42AEB50215"><enum>(3)</enum><text>the procurement was awarded by a subcontractor through a process over which the lead systems integrator or a Tier 1 subcontractor exercised no control; or</text> </paragraph> 
<paragraph id="H308D9118ABDB4A8A86D88B563B006693"><enum>(4)</enum><text>the Secretary has determined that the procurement was awarded in a manner consistent with the Competition in Contracting Act of 1984 and the Federal Acquisition Regulation.</text> </paragraph></subsection> 
<subsection id="H2B2A7613369D49418E338DD091E39C09"><enum>(d)</enum><header>Rule of construction</header><text>The limitation in subsection (b)(1)(A) on the quantity and specific type of assets to which subsection (b) applies shall not be construed to apply to the modification of the number or type of any subsystems or other components of a vessel or aircraft described in subsection (b)(1)(B), (C), or (D).</text> </subsection> 
<subsection id="HB2FE85DACD134AEEB6114670A2413396"><enum>(e)</enum><header>Termination date for exceptions</header><text>Notwithstanding subsection (b), the Secretary may not use a private sector entity as a lead systems integrator for acquisitions under, or in support of, the Integrated Deepwater Program after the earlier of—</text> 
<paragraph id="HB9F11F25187D4C89A14E8E83E26D764C"><enum>(1)</enum><text>September 30, 2011; or</text> </paragraph> 
<paragraph id="H818265AD8C954C7092F27881DC78AB82"><enum>(2)</enum><text display-inline="yes-display-inline">the date on which the Secretary certifies in writing to the appropriate congressional committees that the Coast Guard has available and can retain sufficient contracting personnel and expertise within the Coast Guard, through an arrangement with other Federal agencies, or through contracts or other arrangements with private sector entities, to perform the functions and responsibilities of the lead system integrator in an efficient and cost-effective manner.</text> </paragraph></subsection></section> 
<section display-inline="no-display-inline" id="H9649AF385DFD4DCFA4FBF1F23BEE58A7" section-type="subsequent-section"><enum>103.</enum><header>Required contract terms</header> 
<subsection id="H6AC9476DB4D64BC2A4C342D532E9B1BF"><enum>(a)</enum><header>In general</header><text>The Secretary shall ensure that any contract, delivery order, or task order for an acquisition under, or in support of, the Integrated Deepwater Program executed by the Secretary after the date of enactment of this Act—</text> 
<paragraph id="HB86BFC8BBD3B435EAD5552E00189D15"><enum>(1)</enum><text>provides that all certifications for Integrated Deepwater Program procurements will be conducted by the Secretary or an independent third party, and that self-certification by the contractor or subcontractor is not allowed;</text> </paragraph> 
<paragraph id="H816325FE74674EF4880789D54374B770"><enum>(2)</enum><text>provides that the Commandant shall conduct a technical review of all proposed designs, design changes, and engineering changes and requires that the contractor address all design and engineering concerns identified in the technical reviews;</text> </paragraph> 
<paragraph id="H5AAE06AB1E2741779D45E8EDF6DBCFF7"><enum>(3)</enum><text>requires that the Commandant shall maintain the authority to establish, approve, and maintain technical requirements;</text> </paragraph> 
<paragraph id="H14E4F90791F84171AA1BB35285BDD43C"><enum>(4)</enum><text>requires that any measurement of contractor and subcontractor performance be based on the status of all work performed, including the extent to which the work performed met all cost, schedule, and mission performance requirements;</text> </paragraph> 
<paragraph id="HF70396B5E55D4A1481D19692319E45DA"><enum>(5)</enum><text>specifies that, for the acquisition or upgrade of air, surface, or shore assets for which compliance with TEMPEST certification is a requirement, the standard for determining such compliance will be the air, surface, or shore asset standard then used by the Department of the Navy for that type of asset; and</text> </paragraph> 
<paragraph id="HA6AFC545BF5C421F813ECF47CBA5E8F"><enum>(6)</enum><text>for any contract issued to acquire an Offshore Patrol Cutter, includes provisions specifying the service life, fatigue life, and days underway in general Atlantic and North Pacific Sea conditions, maximum range, and maximum speed the cutter will be built to achieve.</text> </paragraph></subsection> 
<subsection id="H6EA3DF73DF9E4BBCA4558022FABCF088"><enum>(b)</enum><header>Prohibited contract provisions</header><text>The Secretary shall ensure that any contract, delivery order, or task order for acquisition under, or in support of, the Integrated Deepwater Program executed by the Secretary after the date of enactment of this Act does not include—</text> 
<paragraph id="H5F847DE7C6074D6EB3C1F0B6D5ECD8C2"><enum>(1)</enum><text>provisions that commit the Secretary without express written approval by the Secretary; or</text> </paragraph> 
<paragraph id="H65DD62BD780D4C92BC3E9D42AE409E2E"><enum>(2)</enum><text>any provision allowing for equitable adjustment that differs from the Federal Acquisition Regulation.</text> </paragraph></subsection> 
<subsection id="H974BE077DFBF484890346CFB6363052C"><enum>(c)</enum><header>Extension of program</header><text>Any contract, contract modification, or award term extending the existing Integrated Deepwater Program contract term, as signed in May 2006 and modified in June 2007—</text> 
<paragraph id="H69CD09511957405BB6A329001CB91B21"><enum>(1)</enum><text>shall not include any minimum requirements for the purchase of a given or determinable number of specific assets; and</text> </paragraph> 
<paragraph id="H15CFC1031901495B8C00E4225C634775"><enum>(2)</enum><text display-inline="yes-display-inline">shall be reviewed by the Under Secretary of Defense for Acquisition, Technology, and Logistics through the Defense Acquisition University and the results of that review shall be submitted to the appropriate congressional committees at least 60 days prior to the award of the contract, contract modification, or award term.</text> </paragraph></subsection></section> 
<section display-inline="no-display-inline" id="HD00055E9C0294A0D8693030965E9B36" section-type="subsequent-section"><enum>104.</enum><header>Testing and certification</header> 
<subsection id="H1A9A528056034398B7C4F6ECC641D72"><enum>(a)</enum><header>Early operational assessment</header> 
<paragraph id="H2466C36B3B2C44F7863C8923E0929081"><enum>(1)</enum><text>For any major asset type acquired for the Coast Guard after the date of enactment of this Act other than the National Security Cutter and the Maritime Patrol Aircraft, the Secretary shall cause an early operational assessment to be completed on the design for that asset type.</text> </paragraph> 
<paragraph id="H10D00FBD3FB3412CA4582F7BF89DFB00"><enum>(2)</enum><text>The early operational assessment shall be conducted by an independent third party with relevant expertise in conducting early operational assessments on the asset type for which the assessment is being performed or by the Coast Guard acting in collaboration with an independent third party with relevant expertise in conducting early operational assessments on the asset type for which the assessment is being performed.</text> </paragraph> 
<paragraph id="H39484DF3D4504F48B31EFB91D4FF3DA8"><enum>(3)</enum><text>The result of this assessment shall be submitted to the appropriate congressional committees at least 90 days prior to the initiation of any construction activity utilizing the proposed design.</text> </paragraph> 
<paragraph id="H66BEF780441648269292B8F8749090AC"><enum>(4)</enum><text>The Secretary shall also submit a report describing the steps taken to mitigate the risks identified by the early operational assessment conducted under this section in the design on which construction is to begin at least 30 days prior to the initiation of any construction utilizing the proposed design.</text> </paragraph></subsection> 
<subsection id="H406BA2E9AAB74AD68CFD267874225051"><enum>(b)</enum><header>Assessment of operational capability</header> 
<paragraph id="HCB0A6F201F77419EA2702DFF3BBAF28"><enum>(1)</enum><text>The Secretary shall cause the first in class of a major asset acquisition of a cutter or an aircraft by the Coast Guard to be subjected to an assessment of operational capability conducted by an independent third party with relevant expertise in the asset type or by the Coast Guard in collaboration with an independent third party with relevant expertise in the asset type.</text> </paragraph> 
<paragraph id="HD0334C9640E74A2B88A245FBB48503E8"><enum>(2)</enum><text>The result of the assessment conducted under this subsection shall be submitted to the appropriate congressional committees at least 45 days prior to acceptance of the asset.</text> </paragraph></subsection> 
<subsection id="H56CD02E67681404BBAC8029348895EC5"><enum>(c)</enum><header>Cutter classification</header><text>The Secretary shall cause each cutter, other than a National Security Cutter, acquired by the Coast Guard and delivered after the date of enactment of this Act to be classed by the American Bureau of Shipping, before acceptance of delivery.</text> </subsection> 
<subsection id="H5C7261E6FD4B4DFDBE15DA198E16400"><enum>(d)</enum><header>Tempest testing</header><text>The Secretary shall cause all electronics on all aircraft, surface, and shore assets that require TEMPEST certification and that are delivered after the date of enactment of this Act to be tested in accordance with TEMPEST standards and communication security (COMSEC) standards by an independent third party that is authorized by the Federal Government to perform such testing and certify that the asset meets all applicable TEMPEST requirements.</text> </subsection> 
<subsection id="H057F3828E9C0463D9447E6C100A795E7"><enum>(e)</enum><header>National security cutter</header><text>The Secretary shall cause the design and construction of each National Security Cutter, other than National Security Cutter 1 and 2, to be certified by an independent third party with expertise in vessel design and construction certification.</text> </subsection> 
<subsection id="HE8EE7894EA3B4022000141026640C675"><enum>(f)</enum><header>Aircraft airworthiness</header><text>The Secretary shall cause all aircraft and aircraft engines acquired by the Coast Guard and delivered after the date of enactment of this Act to be certified for airworthiness by an independent third party with expertise in aircraft and aircraft engine certification, before acceptance of delivery.</text> </subsection> 
<subsection id="H57B06C23AC3D4D8196B20045348B4100"><enum>(g)</enum><header>Certifications</header> 
<paragraph id="HC6F2DBFE3BDC4E36A2593EBB616BB3DD"><enum>(1)</enum><text>After the date of enactment of this Act, a contract, delivery order, or task order exceeding $10,000,000 for an acquisition under, or in support of, the Coast Guard’s Integrated Deepwater Program may not be executed by the Coast Guard until the Secretary certifies that—</text> 
<subparagraph id="H323E7976B38040A1A0234E31F0B97BBB"><enum>(A)</enum><text>appropriate market research has been conducted prior to technology development to reduce duplication of existing technology and products;</text> </subparagraph> 
<subparagraph id="H7A007ACF4CBE4F3D845770008ED45448"><enum>(B)</enum><text>the technology has been demonstrated to the maximum extent practicable in a relevant environment;</text> </subparagraph> 
<subparagraph id="H1CF00C37BE974C6FA800919223BC1FEF"><enum>(C)</enum><text>the technology demonstrates a high likelihood of accomplishing its intended mission;</text> </subparagraph> 
<subparagraph id="HC7015E52244840C500D3C669F862E24B"><enum>(D)</enum><text>funding is available to execute the contract, delivery order, or task order; and</text> </subparagraph> 
<subparagraph id="H4DEFCF3727C44D78961965ECEF2BCB00"><enum>(E)</enum><text>the technology complies with all relevant policies, regulations, and directives of the Coast Guard.</text> </subparagraph></paragraph> 
<paragraph id="H49AC9F5D1876471F8683C504F0C0007F"><enum>(2)</enum><text>The Secretary shall transmit a copy of each certification required under subsection (g) to the appropriate congressional committees within 30 days after the completion of the certification.</text> </paragraph></subsection> 
<subsection id="HE302E2B3126C462C9107C010C357057"><enum>(h)</enum><header>Limitation</header><text>Nothing in this section shall prevent the Secretary from executing contracts or issuing delivery orders or task orders for research and development or technology demonstrations under, or in support of, the Integrated Deepwater Program.</text> </subsection></section> 
<section display-inline="no-display-inline" id="H898C593EDD21491A98D6F3F917D01554" section-type="subsequent-section"><enum>105.</enum><header>National Security Cutter</header><text display-inline="no-display-inline">Not later than 90 days before the Coast Guard signs any contract, delivery order, or task order to strengthen the hull of either of National Security Cutter 1 or 2 to resolve the structural design and performance issues identified in the Department of Homeland Security Inspector General’s report OIG–07–23 dated January 2007, the Secretary shall submit to the appropriate congressional committees all results of an assessment of the proposed hull strengthening design conducted by the Coast Guard, in conjunction with the Naval Surface Warfare Center, Carderock Division, including—</text> 
<paragraph id="H40AB25C0509B41958CBBEFDD59D5A21B"><enum>(1)</enum><text>a description in detail of the extent to which the hull strengthening measures to be implemented on those cutters will enable the cutters to meet contract and performance requirements;</text> </paragraph> 
<paragraph id="H22CDE849DA954FD888436069043DB97F"><enum>(2)</enum><text>a cost benefit analysis of the proposed hull strengthening measures for National Security Cutters 1 and 2; and</text> </paragraph> 
<paragraph id="H1036CF5B47D34BAB93E322A0E4BBF26E"><enum>(3)</enum><text>a description of any operational restrictions that would have to be applied to either National Security Cutters 1 or 2 if the proposed hull strengthening measures were not implemented on either cutter.</text> </paragraph></section> 
<section display-inline="no-display-inline" id="H18ECF71E97B444549C00A728059B6F83" section-type="subsequent-section"><enum>106.</enum><header>Improvements in Coast Guard management</header> 
<subsection id="H60828C5C834243BF97D52F99DC732E38"><enum>(a)</enum><header>Integrated product teams</header><text>Integrated product teams, and all teams that oversee integrated product teams, shall be chaired by officers, members, or employees of the Coast Guard.</text> </subsection> 
<subsection commented="no" id="H659F7E8D1E974654BF1EF523ABDD0747"><enum>(b)</enum><header>Deepwater technical authority</header><text display-inline="yes-display-inline">The Commandant shall maintain or designate the technical authority to establish, approve, and maintain technical requirements for the Integrated Deepwater Program. Any such designation shall be given in writing and may not be delegated to the authority of the Chief Acquisition Officer established by <external-xref legal-doc="usc" parsable-cite="usc/14/55">section 55</external-xref> of title 14, United States Code.</text> </subsection> 
<subsection id="H9E65243EFB304C2FADCC511D9FA6FB62"><enum>(c)</enum><header>Ensuring adequate personnel</header><text>The Secretary shall ensure that sufficient contracting officers, contracting specialists, and technical and financial management specialists (including earned value experts) are available to execute each contract issued under the Integrated Deepwater Program.</text> </subsection> 
<subsection id="H41F790AFA285416B961582DA378E409E"><enum>(d)</enum><header>Acquisitions workforce policy</header><text display-inline="yes-display-inline">The Secretary shall review all policies established for the Coast Guard’s acquisitions workforce to ensure that they are designed to provide for the selection of the best qualified individual for a position, consistent with other applicable law, and promote the establishment and maintenance of a balanced workforce in which women and members of racial and ethnic minority groups are appropriately represented in Government service.</text> </subsection> 
<subsection id="HB0171B8631FB4CE69B577E3E42EBC300"><enum>(e)</enum><header>Career paths</header><text>The Secretary shall ensure that appropriate career paths for civilian and military personnel who wish to pursue careers in acquisitions are identified in terms of the education, training, experience, and assignments necessary for career progression of civilians and members of the Coast Guard to the most senior acquisitions positions. The Secretary shall make available published information on such career paths.</text> </subsection> 
<subsection id="H0A4CD085EBB743A4B3777BA35B8C42B3"><enum>(f)</enum><header>Balanced workforce policy</header><text>In the development of acquisition workforce policies with respect to any civilian employees or applicants for employment, the Secretary shall, consistent with the merit system principles set out in paragraphs (1) and (2) of <external-xref legal-doc="usc" parsable-cite="usc/5/2301">section 2301(b)</external-xref> of title 5, United States Code, promote a balanced workforce in which women and members of racial and ethnic minority groups are appropriately represented in Government service.</text> </subsection> 
<subsection id="H9BF4949DAE5E4B91A75DEC1763BB173B"><enum>(g)</enum><header>Guidance on tenure and accountability of program managers</header> 
<paragraph id="HCBEEDDDC11064F62B692564242BA5C00"><enum>(1)</enum><header>Issuance of guidance</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall issue guidance for major systems acquisition programs to address the qualifications, resources, responsibilities, tenure, and accountability of program managers for the management of major systems acquisitions. The guidance issued pursuant to this subsection shall address, at a minimum—</text> 
<subparagraph id="H5B776D5725954243819B37C579E19D02"><enum>(A)</enum><text>the qualifications that shall be required of program managers, including the number of years of acquisitions experience and the professional training levels to be required of those appointed to program management positions;</text> </subparagraph> 
<subparagraph id="H55E09CE558A048BD8366C908038859E"><enum>(B)</enum><text>authorities available to the program manager, including, to the extent appropriate, the authority to object to the addition of new program requirements that would be inconsistent with the parameters established for an acquisitions program; and</text> </subparagraph> 
<subparagraph id="H25560A0296154F69B9DDD4E4992F3B88"><enum>(C)</enum><text>the extent to which a program manager who initiates a new program will continue in management of that program without interruption until the delivery of the first production units of the program.</text> </subparagraph></paragraph> 
<paragraph id="H47DC8905C7154BEB8C002940E1FBDCDF"><enum>(2)</enum><header>Strategy</header> 
<subparagraph id="HF472F603026F44669C10B26B22E8F228"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall develop a comprehensive strategy for enhancing the role of Coast Guard program managers in developing and carrying out acquisition programs.</text> </subparagraph> 
<subparagraph id="H65CA0BA56EC34BD08F41462CEBE67857"><enum>(B)</enum><header>Matters to be addressed</header><text>The strategy required by this section shall address, at a minimum—</text> 
<clause id="HE29DB66C0D3740158FFAD5E79DD7CE00"><enum>(i)</enum><text>the creation of a specific career path and career opportunities for program managers, including the rotational assignments that will be provided to program managers;</text> </clause> 
<clause id="HCAA87ECC082A424A9083EA004F3E37F"><enum>(ii)</enum><text>the provision of enhanced training and educational opportunities for program managers;</text> </clause> 
<clause id="H7291690039B64EA2B89F07E9D501002F"><enum>(iii)</enum><text>the provision of mentoring support to current and future program managers by experienced senior executives and program managers within the Coast Guard, including through rotational assignments to the Department of Defense;</text> </clause> 
<clause id="HB1929DFA5BC9476F00F33817C16C3B92"><enum>(iv)</enum><text>the methods by which the Coast Guard will collect and disseminate best practices and lessons learned on systems acquisitions to enhance program management throughout the Coast Guard;</text> </clause> 
<clause id="H8DC20DF60AB844529F2B11E84F94A9D9"><enum>(v)</enum><text>the templates and tools that will be used to support improved data gathering and analysis for program management and oversight purposes, including the metrics that will be utilized to assess the effectiveness of Coast Guard program managers in managing systems acquisitions efforts;</text> </clause> 
<clause id="H9A34D219BE824D308989AC93FE3792DA"><enum>(vi)</enum><text display-inline="yes-display-inline">a description in detail of how the Coast Guard will promote a balanced workforce in which women and members of racial and ethnic minority groups are appropriately represented in Government service; and</text> </clause> 
<clause id="HB056270A495D4BC9AE3C1D4B23CA2913"><enum>(vii)</enum><text>the methods by which the accountability of program managers for the results of acquisition programs will be increased.</text> </clause></subparagraph></paragraph> 
<paragraph id="HCD995ED15DD54D33BA257108C3AC9160"><enum>(3)</enum><header>Report by comptroller general</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General shall submit to the appropriate congressional committees a report on the actions taken by the Secretary to implement the requirements of this subsection, including the strategies that are required to be developed by this subsection.</text> </paragraph></subsection></section> 
<section display-inline="no-display-inline" id="H900E2A922052419794B6DEDA59FABBF1" section-type="subsequent-section"><enum>107.</enum><header>Chief Acquisition Officer</header> 
<subsection id="HEC768DC77B7D409584EFFDD5E00E145"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/3">Chapter 3</external-xref> of title 14, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H536546331A68420F9358D44FD674F4E" style="USC"> 
<section id="H587F1EF329524F5300534D019D634379"><enum>55.</enum><header>Chief Acquisition Officer</header> 
<subsection id="H869647F325404220B63C467FF38E19F9"><enum>(a)</enum><header>Establishment of agency chief acquisition officer</header><text>There shall be in the Coast Guard a Chief Acquisitions Officer selected by the Commandant who shall be a Rear Admiral or civilian from the Senior Executive Service (career reserved) and who meets the qualifications set forth under subsection (b). The Chief Acquisitions Officer shall serve at the Assistant Commandant level and have acquisition management as that individual’s primary duty.</text> </subsection> 
<subsection id="H3685BA94325A45C898E38C3FD4ECCB7D"><enum>(b)</enum><header>Qualifications</header><text>The Chief Acquisition Officer shall be a certified acquisition professional with a program manager level III certification and must have at least 10 years experience in an acquisition position.</text> </subsection> 
<subsection id="HEB7FBB2E987148E700A38C38AD7F88B5"><enum>(c)</enum><header>Authority and functions of the Chief Acquisition Officer</header><text>The functions of the Chief Acquisition Officer shall include—</text> 
<paragraph id="HE606EB0A95F9434CBFC0003F9626B573"><enum>(1)</enum><text>monitoring the performance of programs on the basis of applicable performance measurements and advising the Commandant, through the Vice Commandant of the Coast Guard, regarding the appropriate business strategy to achieve the missions of the Coast Guard;</text> </paragraph> 
<paragraph id="H9D72FC66BB7C41D7B6E3C99B1384B78"><enum>(2)</enum><text>increasing the use of full and open competition in the acquisition of property and services by the Coast Guard by establishing policies, procedures, and practices that ensure that the Coast Guard receives a sufficient number of sealed bids or competitive proposals from responsible sources to fulfill the Government’s requirements, including performance and delivery schedules, at the lowest cost or best value considering the nature of the property or service procured;</text> </paragraph> 
<paragraph id="HA0CEF584B90E4C6ABC830013E0A7217B"><enum>(3)</enum><text>making acquisition decisions in concurrence with the technical authority of the Coast Guard, as designated by the Commandant, and consistent with all other applicable laws and decisions establishing procedures within the Coast Guard;</text> </paragraph> 
<paragraph id="H96DCEDB8B2CE432393222CACC73BDBE7"><enum>(4)</enum><text>ensuring the use of detailed performance specifications in instances in which performance based contracting is used;</text> </paragraph> 
<paragraph id="H7764F10E2DFE449E978473A31B214C8D"><enum>(5)</enum><text>making acquisition decisions consistent with all applicable laws and decision making procedures within the Coast Guard;</text> </paragraph> 
<paragraph id="H145CCAA746A84827BD8D88151B474DE"><enum>(6)</enum><text>managing the direction of acquisition policy for the Coast Guard, including implementation of the unique acquisition policies, regulations, and standards of the Coast Guard;</text> </paragraph> 
<paragraph id="HC7109FFDEFE541D2AD087FD50095BF46"><enum>(7)</enum><text>developing and maintaining an acquisition career management program in the Coast Guard to ensure that there is an adequate professional work force; and</text> </paragraph> 
<paragraph id="HB6E00975B1544CFB00F3B123E448CBFC"><enum>(8)</enum><text>as part of the strategic planning and performance evaluation process required under <external-xref legal-doc="usc" parsable-cite="usc/5/306">section 306</external-xref> of title 5 and sections 1105(a)(28), 1115, 1116, 10 and 9703 of title 31—</text> 
<subparagraph id="H9A588E679ED748B68B00AE1417A9A3D6"><enum>(A)</enum><text>assessing the requirements established for Coast Guard personnel regarding knowledge and skill in acquisition resources and management and the adequacy of such requirements for facilitating the achievement of the performance goals established for acquisition management;</text> </subparagraph> 
<subparagraph id="H3CC9A7A4977045848024DA5B47A8DCF"><enum>(B)</enum><text>in order to rectify any deficiency in meeting such requirements, developing strategies and specific plans for hiring, training, and professional development; and</text> </subparagraph> 
<subparagraph id="HAF974A9149584534B9FE1077C66B3410"><enum>(C)</enum><text>reporting to the Commandant, through the Vice Commandant, on the progress made in improving acquisition management capability.</text> </subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H9248086C65EC4D2DABDE217E7EF8C36"><enum>(b)</enum><header>Application of qualification requirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/55">Section 55(b)</external-xref> of title 46, United States Code, as amended by this section, shall apply beginning October 1, 2011.</text> </subsection>

<paragraph id="HBA74417A23024FA58D690029083E0052"><enum>(2)</enum><header>Subject to appropriations</header><text>The requirement under paragraph (1) is subject to the availability of appropriations.</text> </paragraph></subsection></section> 
<section display-inline="no-display-inline" id="H555CCAEF65C44E2DA6CB3B77BC56A92C" section-type="subsequent-section"><enum>108.</enum><header>Integrated deepwater program plans</header> 
<subsection id="H682297B66040448F912060AEC64292D"><enum>(a)</enum><header>In general</header> 
<paragraph id="H109E52B0E8C64E2FB2DA00D830427BD4"><enum>(1)</enum><header>Revised Integrated Deepwater Program Plans and Acquisition Program</header><text>The Secretary shall—</text> 
<subparagraph id="HB2227C3F7E284AF8AAD33200A4B34C05"><enum>(A)</enum><text>revise and update the Integrated Deepwater Program’s project management plan within 180 days after the date of enactment of this Act, in accordance with the requirements of subsection (d);</text> </subparagraph> 
<subparagraph id="H1DEF4D864A7A4D46A57C883D5274C5C3"><enum>(B)</enum><text>issue new or updated acquisition plans and acquisition program baselines for each asset class under the Integrated Deepwater Program, in accordance with the requirements of subsection (e); and</text> </subparagraph> 
<subparagraph id="H2DAE577C6A5C408E87A7D7D0793804E"><enum>(C)</enum><text>transmit copies thereof to the appropriate congressional committees.</text> </subparagraph></paragraph> 
<paragraph id="H68DB7EA4EA8B4E7BB4CEC81B5C9EA4B4"><enum>(2)</enum><header>Use of alternatives analysis</header><text>The Secretary shall base the revisions and plans on the February 2008 Integrated Deepwater System Alternatives Analysis prepared for the United States Coast Guard by an independent consulting organization.</text> </paragraph></subsection> 
<subsection id="HB67263049D7A4B1398610059CDEB00C4"><enum>(b)</enum><header>Alternatives analyses</header> 
<paragraph id="HF68ECF8DAE3E48299799740100292129"><enum>(1)</enum><header>In general</header><text>No acquisition of an experimental, technically immature, or first-in-class major asset may be made under the Integrated Deepwater Program unless an alternatives analysis was conducted for such asset during the concept and technology development phase. Such analyses shall be conducted by a federally funded research and development center, a qualified entity of the Department of Defense, or a similar independent third party entity that has appropriate acquisition expertise. Such alternatives analyses shall include—</text> 
<subparagraph id="HBC5A4CC89FF64549B668A2C508CE98F3"><enum>(A)</enum><text>an examination of capability, interoperability, and other advantages and disadvantages;</text> </subparagraph> 
<subparagraph id="H5D514848B9CF4E8F005B217971062C65"><enum>(B)</enum><text>an evaluation of whether different quantities of specific assets could meet the Coast Guard’s overall performance needs;</text> </subparagraph> 
<subparagraph id="H47FBD1ACA1A5459B924700936CF47556"><enum>(C)</enum><text>a discussion of key assumptions and variables, and sensitivity to changes in such assumptions and variables;</text> </subparagraph> 
<subparagraph id="HE844EAD6D01E409EAB38FC1520C8F5BE"><enum>(D)</enum><text>an assessment of technology risk and maturity;</text> </subparagraph> 
<subparagraph id="H71D96642FF914952A3FC5139CD6F17C9"><enum>(E)</enum><text>an evaluation of relevant safety and performance records;</text> </subparagraph> 
<subparagraph id="H7FBA56E716D643EEB719924695A29D54"><enum>(F)</enum><text>a calculation of costs, including life cycle costs;</text> </subparagraph> 
<subparagraph id="H9C41F1B4273B40538B219FE0A74EA13"><enum>(G)</enum><text>a business case of viable alternatives;</text> </subparagraph> 
<subparagraph id="H7C28188D61134589BA56096FCDB7B9B2"><enum>(H)</enum><text>an examination of likely research and development costs and the levels of uncertainty associated with such estimated costs;</text> </subparagraph> 
<subparagraph id="HD2E08888F04A41009539A6941E90D2DD"><enum>(I)</enum><text>an examination of likely production and deployment costs and the levels of uncertainty associated with such estimated costs;</text> </subparagraph> 
<subparagraph id="H0BD77FDA375E4E49B5EEA583E580AC7F"><enum>(J)</enum><text>an examination of likely operating and support costs and the levels of uncertainty associated with such estimated costs;</text> </subparagraph> 
<subparagraph id="HE886385FA90743298C57BF14BE15F6AB"><enum>(K)</enum><text>if they are likely to be significant, an examination of likely disposal costs and the levels of uncertainty associated with such estimated costs;</text> </subparagraph> 
<subparagraph id="H3A59DA05DD2A43AB91E544401057C0F4"><enum>(L)</enum><text>an analysis of the risks to production cost, schedule, and life-cycle cost resulting from the experimental, technically immature nature of the systems under consideration; and</text> </subparagraph> 
<subparagraph id="HFC10D79D87484BB1B462E6FE005ED93E"><enum>(M)</enum><text>such additional measures the Secretary determines to be necessary for appropriate evaluation of the asset.</text> </subparagraph></paragraph></subsection> 
<subsection id="H05691C484707452C94D37C9EECCA51F6"><enum>(c)</enum><header>Future revisions</header><text>The Secretary shall—</text> 
<paragraph id="HC6AADE3797A542EF8E1B254BA9B2280"><enum>(1)</enum><text>notify each of the appropriate congressional committees whenever an alternatives analysis or revision of an alternatives analysis under the Integrated Deepwater Program are initiated under this title;</text> </paragraph> 
<paragraph id="H88C250BD47C5437D967E9CBE6BCB2691"><enum>(2)</enum><text>transmit a copy of the Integrated Deepwater Program’s project management plan, acquisition plans, or acquisition program baselines to each of the appropriate congressional committees whenever any such document is created or revised; and</text> </paragraph> 
<paragraph id="H2DA926727ECA4C0F839FC9135201CA85"><enum>(3)</enum><text>maintain a historical file containing, and make available to each of the appropriate congressional committees, upon request, copies of each version of those documents as they are revised.</text> </paragraph></subsection> 
<subsection id="H4E8EF48F9D244A64B648B6FD8CA260C9"><enum>(d)</enum><header>Project management plan</header><text>The revised project management plan required by subsection (a)(1) shall include the following:</text> 
<paragraph id="H25AC628EB3314B33ABF9FAC78DC2C2C"><enum>(1)</enum><text>An analysis and risk assessment of the technology risks and level of maturity for major technologies used on all classes of asset acquisitions under the Integrated Deepwater Program, including the National Security Cutter, fast response cutter, offshore patrol cutter, the vertical unmanned aerial vehicle, maritime patrol aircraft, HC–130J aircraft, and C4ISR systems.</text> </paragraph> 
<paragraph id="H8BB6FC0819724282962C303300B177B8"><enum>(2)</enum><text>A description of how the Coast Guard plans to utilize arrangements with the Department of Defense for support in contracting and management of acquisitions under the Integrated Deepwater Program and to seek opportunities to leverage off of Department of Defense contracts, and contracts of other appropriate agencies, to obtain the best possible price for Integrated Deepwater Program assets.</text> </paragraph> 
<paragraph id="HA89F06A3BC5C429C96A61813D8E4A399"><enum>(3)</enum><text>A life-cycle cost estimate for the Integrated Deepwater Program which shall include asset acquisition and logistics support decisions and planned operational tempo and locations.</text> </paragraph> 
<paragraph id="H769F3C7923C14700A433943986D34D2"><enum>(4)</enum><text>Any other information the Secretary deems necessary.</text> </paragraph></subsection> 
<subsection id="H944770B5281A4086BB99025EA9E0C4FB"><enum>(e)</enum><header>Acquisition program baseline</header> 
<paragraph id="H7D697F22204244B4B180DB2542BDD864"><enum>(1)</enum><header>In general</header><text>The new acquisition program baselines required by subsection (a)(1) shall include—</text> 
<subparagraph id="H662A2490DACB418FAF5B5362B769F961"><enum>(A)</enum><text>a plan for the acquisition, and the schedule and costs for delivery of such acquisitions;</text> </subparagraph> 
<subparagraph id="HDBB05A3400FF470596E4102066ED25DF"><enum>(B)</enum><text>a lifecycle cost estimate that includes asset acquisition and logistics support decisions and planned operational tempo and locations; and</text> </subparagraph> 
<subparagraph id="HCE1BB42EA2874744BE6F30ABF291F9B"><enum>(C)</enum><text>such other information as the Secretary deems necessary.</text> </subparagraph></paragraph> 
<paragraph id="H4377B72CF1F94ADBB7488B9D403D48C2"><enum>(2)</enum><header>Offshore patrol cutter</header><text>When an acquisition program baseline is completed for the offshore patrol cutter following an alternatives analysis for that asset class, the acquisition program baseline shall include a detailed statement of the service life, fatigue life, maximum range, maximum speed, and number of days underway under general Atlantic and North Pacific Sea conditions the cutter will be built to achieve. The offshore patrol cutter’s acquisition program baseline shall be completed and transmitted to each of the appropriate congressional committees not less than 90 days before the Secretary issues a request for proposals for construction of an offshore patrol cutter.</text> </paragraph></subsection></section> 
<section display-inline="no-display-inline" id="HB4A1836B00FE4BE1B972AA0F3E5CB4" section-type="subsequent-section"><enum>109.</enum><header>Reports</header> 
<subsection id="H2925E2E0329546F8917BBFFA89B75FA0"><enum>(a)</enum><header>Annual report</header> 
<paragraph id="H66154DE6F35E4AC99240E2ADC64893BF"><enum>(1)</enum><header>In general</header><text>Within 45 days after the end of each fiscal year, the Secretary shall submit a comprehensive annual report on the progress of the Integrated Deepwater Program to the appropriate congressional committees.</text> </paragraph> 
<paragraph id="H551BE96A1B8A4F09A83BBD00004CBFFE"><enum>(2)</enum><header>Scope</header><text>At a minimum, the report shall include—</text> 
<subparagraph id="H1D75E26C9C524658AE2B38EBF9AA09EC"><enum>(A)</enum><text>an outline and description of all changes to the Integrated Deepwater Program’s project management plan during the previous fiscal year;</text> </subparagraph> 
<subparagraph id="H7A4AF70F2639423DB4CE4FC9269D248F"><enum>(B)</enum><text>an outline and description of all changes to acquisition plans and acquisition program baselines for all Integrated Deepwater Program asset acquisitions during the previous fiscal year, including all updates to life cycle cost estimates, acquisition cost estimates, schedule changes, and changes in asset performance requirements;</text> </subparagraph> 
<subparagraph id="H22BEBCE05BED4E02A973E162BDA622EB"><enum>(C)</enum><text>a summary of findings of all alternatives analyses completed or revised during the previous fiscal year under the Integrated Deepwater Program;</text> </subparagraph> 
<subparagraph id="H87273AC7701646E3BA3F44E2B39CC75B"><enum>(D)</enum><text>an updated development schedule for each asset and asset class, including estimated annual costs until development is completed;</text> </subparagraph> 
<subparagraph id="H067F4A6812504912A716B5B894B6ABED"><enum>(E)</enum><text>an updated acquisition schedule for each asset and asset class, including estimated annual costs and units to be procured until acquisition is completed;</text> </subparagraph> 
<subparagraph id="HE368373A12D34060BBAB10F513B5DABF"><enum>(F)</enum><text>an updated projection of the remaining operational lifespan of each legacy asset and projected costs for sustaining such assets;</text> </subparagraph> 
<subparagraph id="H6DF435381AE74EBF85F48E2406033100"><enum>(G)</enum><text display-inline="yes-display-inline">a breakdown of the percentage of the total amount of funds expended on acquisitions under the Integrated Deepwater Program during the previous fiscal year that has been paid to each of small businesses, socially and economically disadvantaged small business concerns eligible for assistance under section 8(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)</external-xref>), minority-owned businesses, women-owned businesses, and service disabled veteran-owned businesses;</text> </subparagraph> 
<subparagraph id="H7DCDEB01A3604C25BEC314FDEDE83A4"><enum>(H)</enum><text>information on the status of agreements and progress of other arrangements with the Department of Defense for support in contracting and management of acquisitions under the Integrated Deepwater Program required by section 110 of this Act and the updated project management plan as required by section 108(a) of this Act;</text> </subparagraph> 
<subparagraph id="H51884D1FBF484E35ABD3909D3BC37D4"><enum>(I)</enum><text>an update on the Secretary’s progress in meeting goals for the development of the acquisition program described in the Blueprint for Acquisition Reform, and required by this title, including staffing levels and professional development;</text> </subparagraph> 
<subparagraph commented="no" id="H970CB12E5D6D45799407F811A1F44942"><enum>(J)</enum><text>a financial accounting of the Integrated Deepwater Program as of the end of the fiscal year, which shall include a balance sheet, statement of net cost, statement of changes in net position, and statement of budgetary resources of the Program;</text> </subparagraph> 
<subparagraph id="HAD62CCDC47CC459B8EAB0137CB9F1803"><enum>(K)</enum><text display-inline="yes-display-inline">an update on the status of efforts to enhance the role of Coast Guard program managers in developing and carrying out acquisitions programs and efforts to promote a balanced workforce in which women and members of racial and ethnic minority groups are appropriately represented in Government service; and</text> </subparagraph> 
<subparagraph id="HBF13E44540144F5DAE80B2CD042197EC"><enum>(L)</enum><text>such additional information as the Secretary deems necessary for updating Congress on the progress of the Integrated Deepwater Program.</text> </subparagraph></paragraph></subsection> 
<subsection id="H45FBB3000D60416E91975936AFFB6256"><enum>(b)</enum><header>Cost overruns and delays</header> 
<paragraph id="H1EB49AD57F4641279CA55FF81B83B869"><enum>(1)</enum><header>In general</header><text>The Secretary shall submit a report to the appropriate congressional committees as soon as possible, but not later than 30 days, after the Deepwater Program Executive Officer becomes aware of the breach of an acquisition program baseline under the Integrated Deepwater Program by—</text> 
<subparagraph id="H97D0AB4D853444748E41ADE1C5ADB4C"><enum>(A)</enum><text>a likely cost overrun greater than 8 percent of the acquisition program baseline total acquisition cost for that individual asset or a class of assets;</text> </subparagraph> 
<subparagraph id="H8639A4272B204126A6481B965209EB39"><enum>(B)</enum><text>a likely delay of more than 180 days in the delivery schedule for any individual asset or class of assets; or</text> </subparagraph> 
<subparagraph id="HF567A0660B7B4C54AE7443CC1BD74013"><enum>(C)</enum><text>an anticipated failure for any individual asset or class of assets to satisfy any key performance threshold or parameter under the Integrated Deepwater Program acquisition program baseline.</text> </subparagraph></paragraph> 
<paragraph id="HBB799B6B93FA42F1B1926B3F1DD4D0ED"><enum>(2)</enum><header>Content</header><text>The report submitted under paragraph (1) shall include</text> 
<subparagraph id="H911B3FBDBC814A17B43DB422492D5D76"><enum>(A)</enum><text>a detailed description of the breach and an explanation of its cause;</text> </subparagraph> 
<subparagraph id="HAA622A1C7C6443918508149100C747F7"><enum>(B)</enum><text>the projected impact to cost, schedule and performance;</text> </subparagraph> 
<subparagraph id="HDCBC49BD1B7E45F3AAB53780AB40A35F"><enum>(C)</enum><text>an updated total acquisition cost and the complete history of changes to the original cost estimate described in the plan submitted under section 108(e);</text> </subparagraph> 
<subparagraph id="H40170934E2C34E5897A5784DB1A13BDE"><enum>(D)</enum><text>the updated acquisition schedule and the complete history of changes to the original schedule described in the plan submitted under section 108(e);</text> </subparagraph> 
<subparagraph id="H0F0ED38ECE834386A1A7001B8F9F5127"><enum>(E)</enum><text>a full life-cycle cost analysis for the asset or class of assets;</text> </subparagraph> 
<subparagraph id="H7324653811704FB791CA099B588ED893"><enum>(F)</enum><text>a remediation plan identifying corrective actions and any resulting issues or risks; and</text> </subparagraph> 
<subparagraph id="HEE3B22874231432185F5F89D6C73CD9B"><enum>(G)</enum><text>a description of how progress in the remediation plan will be measured and monitored.</text> </subparagraph></paragraph> 
<paragraph id="HC379B3E734F2430981CBF7DD015DC436"><enum>(3)</enum><header>Substantial variances in costs or schedule</header><text>If a likely cost overrun is greater than 20 percent or a likely delay is greater than 12 months from the schedule and costs described in the acquisition program baseline total acquisition cost for that individual asset or class of assets, the Secretary shall include in the report a written certification, with a supporting explanation, that—</text> 
<subparagraph id="H7AEDE73360854942AED8EECEF6C58895"><enum>(A)</enum><text>the asset or asset class is essential to the accomplishment of Coast Guard missions;</text> </subparagraph> 
<subparagraph id="H767D925297A6428B95CF000348B5FA1"><enum>(B)</enum><text>there are no alternatives to such asset or asset class which will provide equal or greater capability in both a more cost-effective and timely manner;</text> </subparagraph> 
<subparagraph id="H6E9F53BBC3DC478581ED9718E8C20000"><enum>(C)</enum><text>the new acquisition schedule and estimates for total acquisition cost are reasonable; and</text> </subparagraph> 
<subparagraph id="H52482711808C49E0BA0662B5B4FE1FE0"><enum>(D)</enum><text>the management structure for the acquisition program is adequate to manage and control costs, schedule, and performance.</text> </subparagraph></paragraph> 
<paragraph id="H4D408D3F6753462584F4C592F568F60"><enum>(4)</enum><header>Certified assets and asset classes</header><text>If the Secretary certifies an asset or asset class under paragraph (3), the requirements of this sub-section shall be met based on the new estimates of cost and schedule contained in that certification.</text> </paragraph></subsection> 
<subsection id="H7BDC182E0C04411D97DCA1C6ECFC01FB"><enum>(c)</enum><header>Report on Integrated Deepwater Program C4ISR</header> 
<paragraph id="H28130ECA62424EA79F933C4CD30BAC"><enum>(1)</enum><header>Independent assessment</header><text>Not later than 3 months after the date of enactment of this Act, the Secretary shall enter into an arrangement with the National Research Council of the National Academy of Sciences to conduct a study to assess the Coast Guard’s Integrated Deepwater Program C4ISR systems and acquisition plans. This study shall include an examination of—</text> 
<subparagraph id="H186615C104B54C6E8BCB4B539291586D"><enum>(A)</enum><text>the Coast Guard’s current and planned Integrated Deepwater Program C4ISR capabilities and architecture;</text> </subparagraph> 
<subparagraph id="H85DAD730FB03401189A181128F74C5C7"><enum>(B)</enum><text>the adequacy of the Integrated Deepwater Program C4ISR acquisition’s Information Technology requirements;</text> </subparagraph> 
<subparagraph id="HF3D1442D1A584F16882B979F16E560EB"><enum>(C)</enum><text>whether the planned Integrated Deepwater Program C4ISR systems are sufficiently adaptable to meet the needs of the Coast Guard’s mission requirements;</text> </subparagraph> 
<subparagraph id="H85EF1A161DDC459FA637CDB409069616"><enum>(D)</enum><text>whether the planned Integrated Deepwater Program C4ISR systems facilitate future upgrades as C4ISR technology advances; and</text> </subparagraph> 
<subparagraph id="HE018B6018D854E9AA9C4E921D1629B3B"><enum>(E)</enum><text>the adequacy of the Coast Guard’s organizational, personnel, and training systems for acquiring, utilizing, and sustaining Integrated Deepwater Program C4ISR systems.</text> </subparagraph></paragraph></subsection> 
<subsection id="HC48BFD0D083F451387A793D7D535D18D"><enum>(d)</enum><header>Patrol boat report</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary shall submit to the appropriate congressional committees a report on how the Coast Guard plans to manage the annual readiness gap of lost time for 110-foot patrol boats from fiscal year 2009 through fiscal year 2015. The report shall include—</text> 
<paragraph id="H756D560623F84821BD12468510AE957B"><enum>(1)</enum><text>a description of the mission performance gap detailing the geographic regions and Coast Guard capabilities affected;</text> </paragraph> 
<paragraph id="HBF6250B9B9DF4C57A5BD6518A76B77F0"><enum>(2)</enum><text>a summary of the patrol hours that will be lost due to delays in replacing the 110-foot cutters and lost capabilities of the 110-foot cutters that have been converted;</text> </paragraph> 
<paragraph id="H547728F99C2D4116A4FF53FED540A831"><enum>(3)</enum><text>an analysis of factors affecting the mission performance gap that are unrelated to the Integrated Deepwater Program, including deployment of Coast Guard assets overseas and continuous vessel shortages;</text> </paragraph> 
<paragraph id="HCFA8437B0BD248D6B0FF96B1A6B960E2"><enum>(4)</enum><text>an identification of assets that are being used or may be used to alleviate the annual readiness gap of lost time for such patrol boats, including any acquisition or lease considered and the reasons they were not pursued;</text> </paragraph> 
<paragraph id="H07DFFB04F76F49DDB5B2E5700AA8459"><enum>(5)</enum><text>in cases where Coast Guard assets are used more heavily to alleviate the readiness gap, an assessment of the estimated additional maintenance costs incurred and asset lifespan lost due to the increased use of such assets;</text> </paragraph> 
<paragraph id="HE909510511A140858EFFD14C7C6C672E"><enum>(6)</enum><text>a projection of the remaining operational lifespan of the 110-foot patrol boat fleet;</text> </paragraph> 
<paragraph id="H6213EA7647E64C788DE6A7AC59F0DFC0"><enum>(7)</enum><text>a description of how extending through fiscal year 2015 the transfer agreement between the Coast Guard and the United States Navy for 3 Cyclone class 179-foot patrol coastal ships would affect the annual readiness gap of lost time for 110-foot patrol boats; and</text> </paragraph> 
<paragraph id="H62269048CE3C4E35898C915DB5E7FEEB"><enum>(8)</enum><text>an estimate of the cost to extend the operational lifespan of the 110-foot patrol boat fleet for each of fiscal years 2008 through 2015.</text> </paragraph></subsection> 
<subsection id="HF31BD2CF90AE4173924875020003497B"><enum>(e)</enum><header>Acquisitions workforce report</header><text display-inline="yes-display-inline">Within 4 months after the date of enactment of this Act, the Secretary shall report on the development of the acquisitions office within the Coast Guard, describing the specific staffing structure for that directorate, including—</text> 
<paragraph id="H2B3F148B04FA422A9B9044108DB196D6"><enum>(1)</enum><text>identification of all acquisitions positions proposed as part of the office, the functions that each managerial position will fill, and the number of employees each manager will supervise; and</text> </paragraph> 
<paragraph id="H428DB27890D8484FBFE49A81784BDFC"><enum>(2)</enum><text>a formal organizational chart and identification of when managerial positions are to be filled.</text> </paragraph></subsection> 
<subsection id="H4F19492FD55D492BA2D05C473FCD9B00"><enum>(f)</enum><header>Elevation of disputes to the chief acquisition officer</header><text>Within 30 days after the elevation to the Chief Acquisition Officer of any design or other dispute regarding the Integrated Deepwater Program contract or an item to be acquired under that contract, the Secretary shall provide to the appropriate congressional committees a detailed description of the issue and the rationale underlying the decision taken by the Chief Acquisition Officer to resolve the issue.</text> </subsection> 
<subsection id="HEE4C92C276A44463BC834F004CFAE0C7"><enum>(g)</enum><header>Amendment of 2006 Act</header><text>Section 408(a) of the Coast Guard and Maritime Transportation Act of 2006 is amended—</text> 
<paragraph id="H7AA4941FF93C4D81915D815C00D52BCB"><enum>(1)</enum><text>by striking paragraphs (1) and (3); and</text> </paragraph> 
<paragraph id="H2622198CBFC04CA6BEFDCE23AA08582D"><enum>(2)</enum><text>by redesignating paragraphs (2) and (4) through (8) as paragraphs (1) through (6), respectively.</text> </paragraph></subsection></section> 
<section display-inline="no-display-inline" id="H4D72E0FA074A403D9032DC99700E546" section-type="subsequent-section"><enum>110.</enum><header>Department of Defense consultation</header> 
<subsection id="H3EE7D9A3BC3E483F0018ADF5B78F07C7"><enum>(a)</enum><header>In general</header><text>The Secretary shall make arrangements as appropriate with the Secretary of Defense for support in contracting and management of acquisitions under the Integrated Deepwater Program. The Coast Guard shall also seek opportunities to leverage off of Department of Defense contracts, and contracts of other appropriate agencies, to obtain the best possible price for Integrated Deepwater Program assets.</text> </subsection> 
<subsection id="H46CD6FFE4AAF4955A7D9DC0000D6A7D7"><enum>(b)</enum><header>Inter-Service Technical Assistance</header><text>The Secretary may enter into a memorandum of understanding or a memorandum of agreement with the Secretary of the Navy to obtain the assistance of the Office of the Assistant Secretary of the Navy for Research, Development, and Acquisition, including the Navy Systems Commands, with the oversight of Coast Guard major acquisition programs. Such memorandum of understanding or memorandum of agreement shall, at a minimum, provide for—</text> 
<paragraph id="H9E8090A64AE640538B854CACDBBFCDEF"><enum>(1)</enum><text>the exchange of technical assistance and support that the Coast Guard Chief Acquisition Officer, Coast Guard Chief Engineer, and the Coast Guard Chief Information Officer may identify;</text> </paragraph> 
<paragraph id="H3B87E242FC754C2EA7C16C2B8CF8A4B"><enum>(2)</enum><text>the use, as appropriate, of Navy technical expertise; and</text> </paragraph> 
<paragraph id="HEFC31343CD1F43BCAFE891F8E7800EE"><enum>(3)</enum><text>the temporary assignment or exchange of personnel between the Coast Guard and the Office of the Assistant Secretary of the Navy for Research, Development, and Acquisition, including Naval Systems Commands, to facilitate the development of organic capabilities in the Coast Guard.</text> </paragraph></subsection> 
<subsection commented="no" id="HF205E461D0B345CA84517C54D389B748"><enum>(c)</enum><header>Technical authorities</header><text>The technical authority established under section 106(b) shall adopt, to the extent practicable, procedures that are similar to those used by the Navy Senior Acquisition Official to approve all technical requirements.</text> </subsection> 
<subsection id="H7652A44C343149F88E5CCEB80A3D112"><enum>(d)</enum><header>Assessment</header><text>Within 180 days after the date of enactment of this Act, the Comptroller General shall transmit a report to the appropriate congressional committees that—</text> 
<paragraph id="HE0D097EB87B14B848961F567EEC8F15B"><enum>(1)</enum><text>contains an assessment of current Coast Guard acquisition and management capabilities to manage acquisitions under or in support of the Integrated Deepwater Program;</text> </paragraph> 
<paragraph id="HB18F9EE26CA541FD0030342CC284497F"><enum>(2)</enum><text>includes recommendations as to how the Coast Guard can improve its acquisition management, either through internal reforms or by seeking acquisition expertise from the Department of Defense; and</text> </paragraph> 
<paragraph id="H914C566FE2E74C49A06199E4C91C4303"><enum>(3)</enum><text>addresses specifically the question of whether the Coast Guard can better leverage Department of Defense or other agencies’ contracts that would meet the needs of the Integrated Deepwater Program in order to obtain the best possible price.</text> </paragraph></subsection></section> 
<section id="HDE6459C44B674EBDA2DD1020FA6F76A"><enum>111.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions apply:</text> 
<paragraph id="H045E8AAB1C164DB09F76FD26E07C30FC"><enum>(1)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <quote>appropriate congressional committees</quote> means the Committees on Transportation and Infrastructure and Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text> </paragraph> 
<paragraph id="H9A272C5126794FD987BBE53528FC69E9"><enum>(2)</enum><header>Integrated Deepwater Program</header><text>The term <quote>Integrated Deepwater Program</quote> means the Integrated Deepwater Systems Program described by the Coast Guard in its Report to Congress on Revised Deepwater Implementation Plan, dated March 25, 2005, including any subsequent modifications, revisions, or restatements of the Program. The Integrated Deepwater Program includes the procurement, development, production, sustainment, modification, conversion, and missionization of C4ISR and of cutter and aviation assets that operate more than 50 miles offshore.</text> </paragraph> 
<paragraph id="H91813AF879B14A3CA98D9336172EF301"><enum>(3)</enum><header>Life-cycle cost</header><text>The term <quote>life-cycle cost</quote> means all costs for development, procurement, construction, and operations and support for a particular asset, without regard to funding source or management control.</text> </paragraph> 
<paragraph id="H8287819F3C444F6D8B3C21CF9F7E2987"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the department in which the Coast Guard is operating.</text> </paragraph></section> 
<section id="H0D9AD476399547E4BC5E1958A46B22C3" section-type="subsequent-section"><enum>112.</enum><header>Eligible employees in the recreational marine industry</header><text display-inline="no-display-inline">Section 2(3)(F) of the Longshore and Harbor Workers’ Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/902">33 U.S.C. 902(3)(F)</external-xref>) is amended—</text> 
<paragraph id="HA282A6B1FAFE4D4FBCD2D89EE95046CA"><enum>(1)</enum><text>by striking <quote>, repair or dismantle</quote>; and </text></paragraph> 
<paragraph id="HB8758786140F4069BE006DAC1FF640F"><enum>(2)</enum><text>by striking the semicolon and inserting <quote>, or individuals employed to repair any recreational vessel, or to dismantle any part of a recreational vessel in connection with the repair of such vessel;</quote>.</text></paragraph></section></title> 
<title id="HC22D374F3D944081BD085F60373BFAA5"><enum>II</enum><header>Submersible Vessels and Semi-Submersible Vessels</header> 
<section section-type="subsequent-section" id="H2FFAFDC5752F4DA0B673616C01F7BAAF"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Drug Trafficking Vessel Interdiction Act of 2008</quote>.</text></section> 
<subtitle id="HE2B8C4ECE2D34B97884EAB99F1D228EC"><enum>A</enum><header>Criminal prohibition</header> 
<section id="H37470D5D4C6E4C81B392BE95E6491823"><enum>211.</enum><header>Findings and declarations</header><text display-inline="no-display-inline">Congress finds and declares that operating or embarking in a submersible vessel or semi-submersible vessel without nationality and on an international voyage is a serious international problem, facilitates transnational crime, including drug trafficking, and terrorism, and presents a specific threat to the safety of maritime navigation and the security of the United States.</text></section> 
<section id="H7F34790824734761BF44C7969255B053"><enum>212.</enum><header>Operation of submersible vessel or semi-submersible vessel without nationality</header> 
<subsection id="H6647E25D618847C59727EB2991594E61"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/111">Chapter 111</external-xref> of title 18, United States Code, is amended by adding at the end the following new section:</text> 
<quoted-block style="USC" id="HD3DD648F3F2A47D5BE83C6D139AF94D0"> 
<section id="HD5A2586912724FE1B0EE426204000320"><enum>2285.</enum><header>Operation of submersible vessel or semi-submersible vessel without nationality</header> 
<subsection id="H7758DDE987F843BB9C1300E79F4B7FD7"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever knowingly operates, or attempts or conspires to operate, by any means, or embarks in any submersible vessel or semi-submersible vessel that is without nationality and that is navigating or has navigated into, through, or from waters beyond the outer limit of the territorial sea of a single country or a lateral limit of that country’s territorial sea with an adjacent country, with the intent to evade detection, shall be fined under this title, imprisoned not more than 15 years, or both.</text></subsection> 
<subsection id="H73357637C4954340861140CBDEA8BA73"><enum>(b)</enum><header>Evidence of Intent to Evade Detection</header><text>For purposes of subsection (a), the presence of any of the indicia described in paragraph (1)(A), (E), (F), or (G), or in paragraph (4), (5), or (6), of <external-xref legal-doc="usc" parsable-cite="usc/46/70507">section 70507(b)</external-xref> of title 46 may be considered, in the totality of the circumstances, to be prima facie evidence of intent to evade detection.</text></subsection> 
<subsection id="H7AF011CFB48943288E107927B4416FAA"><enum>(c)</enum><header>Extraterritorial Jurisdiction</header><text>There is extraterritorial Federal jurisdiction over an offense under this section, including an attempt or conspiracy to commit such an offense.</text></subsection> 
<subsection id="H88E7833C77AA4702BCD9828F7FA7419E"><enum>(d)</enum><header>Claim of Nationality or Registry</header><text>A claim of nationality or registry under this section includes only—</text> 
<paragraph id="H6183D14058C3496C8F00C0944845AD28"><enum>(1)</enum><text>possession on board the vessel and production of documents evidencing the vessel’s nationality as provided in article 5 of the 1958 Convention on the High Seas;</text></paragraph> 
<paragraph id="H550C7EB65C9C443B0040BD42AC16DDFD"><enum>(2)</enum><text>flying its nation’s ensign or flag; or</text></paragraph> 
<paragraph id="HC2F9F3A391FC40129D2588188E95CDD5"><enum>(3)</enum><text>a verbal claim of nationality or registry by the master or individual in charge of the vessel.</text></paragraph></subsection> 
<subsection id="H322E31F4095B4A17AA61C02FC545E8A9"><enum>(e)</enum><header>Affirmative Defenses</header> 
<paragraph id="H907CCB82774444EAA689BFBF9D8461E8"><enum>(1)</enum><header>In general</header><text>It is an affirmative defense to a prosecution for a violation of subsection (a), which the defendant has the burden to prove by a preponderance of the evidence, that the submersible vessel or semi-submersible vessel involved was, at the time of the offense—</text> 
<subparagraph id="HF2F655B76D8645FBBAF47594AD135800"><enum>(A)</enum><text>a vessel of the United States or lawfully registered in a foreign nation as claimed by the master or individual in charge of the vessel when requested to make a claim by an officer of the United States authorized to enforce applicable provisions of United States law;</text></subparagraph> 
<subparagraph id="H27CA672FC85F4018B15FD7EACB174951"><enum>(B)</enum><text>classed by and designed in accordance with the rules of a classification society;</text></subparagraph> 
<subparagraph id="H24DC8B965BEF4A95B5DF7800959D664C"><enum>(C)</enum><text>lawfully operated in government-regulated or licensed activity, including commerce, research, or exploration; or</text></subparagraph> 
<subparagraph id="HED75FF41727B475C8C7B67059F22AA6C"><enum>(D)</enum><text>equipped with and using an operable automatic identification system, vessel monitoring system, or long range identification and tracking system.</text></subparagraph></paragraph> 
<paragraph id="H210CB602E922400D83837C6EC1753369"><enum>(2)</enum><header>Production of documents</header><text>The affirmative defenses provided by this subsection are proved conclusively by the production of—</text> 
<subparagraph id="HFFDC1F58C84441719DAD29C9097BEA43"><enum>(A)</enum><text>government documents evidencing the vessel’s nationality at the time of the offense, as provided in article 5 of the 1958 Convention on the High Seas;</text></subparagraph> 
<subparagraph id="H99193BC46A0C4472884147337C710053"><enum>(B)</enum><text>a certificate of classification issued by the vessel’s classification society upon completion of relevant classification surveys and valid at the time of the offense; or</text></subparagraph> 
<subparagraph id="H8B1EBBAF3C2449188D3CEA30BBE7614"><enum>(C)</enum><text>government documents evidencing licensure, regulation, or registration for commerce, research, or exploration.</text></subparagraph></paragraph></subsection> 
<subsection id="H95A97FFACE2D4481B4D239002FC83653"><enum>(f)</enum><header>Federal Activities Excepted</header><text>Nothing in this section applies to lawfully authorized activities carried out by or at the direction of the United States Government.</text></subsection> 
<subsection id="HDE9C7ED536594EB78BDD35EED3653D75"><enum>(g)</enum><header>Applicability of Other Provisions</header><text>Sections <external-xref legal-doc="usc" parsable-cite="usc/46/70504">70504</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/46/70505">70505</external-xref> of title 46 apply to offenses under this section in the same manner as they apply to offenses under section 70503 of such title.</text></subsection> 
<subsection id="HC8B4D6B0B4984C84A757E46B18947878"><enum>(h)</enum><header>Definitions</header><text>In this section, the terms <term>submersible vessel</term>, <term>semi-submersible vessel</term>, <term>vessel of the United States</term>, and <term>vessel without nationality</term> have the meaning given those terms in <external-xref legal-doc="usc" parsable-cite="usc/46/70502">section 70502</external-xref> of title 46.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0128DE89C316437A9580A8F78DB842B"><enum>(b)</enum><header>Clerical Amendment</header><text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/111">chapter 111</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/2284">section 2284</external-xref> the following:</text>

<section id="HFD8F8CD318CB4CA4B9F328DB2B027224"><enum>213.</enum><header>Sentencing guidelines</header> 
<subsection id="HE6FA35392489484EBED4C250C400B5C"><enum>(a)</enum><header>In General</header><text>Pursuant to its authority under <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994(p)</external-xref> of title 28, United States Code, and in accordance with this section, the United States Sentencing Commission shall promulgate sentencing guidelines (including policy statements) or amend existing sentencing guidelines (including policy statements) to provide adequate penalties for persons convicted of knowingly operating by any means or embarking in any submersible vessel or semi-submersible vessel in violation of <external-xref legal-doc="usc" parsable-cite="usc/18/2285">section 2285</external-xref> of title 18, United States Code.</text></subsection> 
<subsection id="H6A56470D901A4866A94FBF7927BCF002"><enum>(b)</enum><header>Requirements</header><text>In carrying out this section, the United States Sentencing Commission shall—</text> 
<paragraph id="HF7CFBC5FBC4F45D28600F2A2566834C2"><enum>(1)</enum><text>ensure that the sentencing guidelines and policy statements reflect the serious nature of the offense described in <external-xref legal-doc="usc" parsable-cite="usc/18/2285">section 2285</external-xref> of title 18, United States Code, and the need for deterrence to prevent such offenses;</text></paragraph> 
<paragraph id="H6854DAE3B95146239DBA34EB4CD862E0"><enum>(2)</enum><text>account for any aggravating or mitigating circumstances that might justify exceptions, including—</text> 
<subparagraph id="HF3469194981F4FB09616554EB33E52B"><enum>(A)</enum><text>the use of a submersible vessels or semi-submersible vessels described in <external-xref legal-doc="usc" parsable-cite="usc/18/2285">section 2285</external-xref> of title 18, United States Code, to facilitate other felonies;</text></subparagraph> 
<subparagraph id="H23B116AE9DC04D558F06E818E886764"><enum>(B)</enum><text>the repeated use of a submersible vessel or semi-submersible vessel described in <external-xref legal-doc="usc" parsable-cite="usc/18/2285">section 2285</external-xref> of title 18, United States Code, to facilitate other felonies, including whether such use is part of an ongoing criminal organization or enterprise;</text></subparagraph> 
<subparagraph id="H0F22B7C05B0640B5B8B5DC79EB9CF691"><enum>(C)</enum><text>whether the use of such a vessel involves a pattern of continued and flagrant violations of <external-xref legal-doc="usc" parsable-cite="usc/18/2285">section 2285</external-xref> of title 18, United States Code;</text></subparagraph> 
<subparagraph id="H3490CD07B9BD48979BAB3012B20E980"><enum>(D)</enum><text>whether the persons operating or embarking in a submersible vessel or semi-submersible vessel willfully caused, attempted to cause, or permitted the destruction or damage of such vessel or failed to heave to when directed by law enforcement officers; and</text></subparagraph> 
<subparagraph id="H95556A6026DA468091B57B77A8C68F26"><enum>(E)</enum><text>circumstances for which the sentencing guidelines (and policy statements) provide sentencing enhancements;</text></subparagraph></paragraph> 
<paragraph id="HFBC829C3D46D4322AF988F943E9154F"><enum>(3)</enum><text>ensure reasonable consistency with other relevant directives, other sentencing guidelines and policy statements, and statutory provisions;</text></paragraph> 
<paragraph id="H11616DA7A1F04977AAA0B736FB57DA90"><enum>(4)</enum><text>make any necessary and conforming changes to the sentencing guidelines and policy statements; and</text></paragraph> 
<paragraph id="H9232308C07AE48A39CD2846E4549184C"><enum>(5)</enum><text>ensure that the sentencing guidelines and policy statements adequately meet the purposes of sentencing set forth in <external-xref legal-doc="usc" parsable-cite="usc/18/3553">section 3553(a)(2)</external-xref> of title 18, United States Code.</text></paragraph></subsection></section></subtitle> 
<subtitle id="H6CADBAA6C7684A688474DA61E3EBBEB0"><enum>B</enum><header>Civil Prohibition</header> 
<section id="H9E21EDA444E3431B00B0F14C9908F6B5"><enum>221.</enum><header>Operation of submersible vessel or semi-submersible vessel without nationality</header> 
<subsection id="H8755ED879834484D8CBDB78FC3C7374B"><enum>(a)</enum><header>Finding and declaration</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/70501">Section 70501</external-xref> of title 46, United States Code, is amended—</text> 
<paragraph id="H805FE90C8749408BA886416F55CF64B"><enum>(1)</enum><text>by inserting <quote>(1)</quote> after <quote>that</quote>; and</text></paragraph> 
<paragraph id="H7792D9F3397D4C9E9DDDD402BDC83CEB"><enum>(2)</enum><text>by striking <quote>States.</quote> and inserting <quote>States and (2) operating or embarking in a submersible vessel or semi-submersible vessel without nationality and on an international voyage is a serious international problem, facilitates transnational crime, including drug trafficking, and terrorism, and presents a specific threat to the safety of maritime navigation and the security of the United States.</quote>.</text></paragraph></subsection></section> 
<section id="H6B2E97064CBF4141A3B9DB665BF612FA"><enum>222.</enum><header>Operation prohibited</header> 
<subsection id="H7890F8ECA9EC49B5B81327677F28C647"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/705">Chapter 705</external-xref> of title 46, United States Code, is amended by adding at the end thereof the following:</text>

<section id="H366C60580B4742B39B519FDE003FA55C"><enum>70508.</enum><header>Operation of submersible vessel or semi-submersible vessel without nationality</header> 
<subsection id="H4A463EFD040F4E1090B01328EEF748EA"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">An individual may not operate by any means or embark in any submersible vessel or semi-submersible vessel that is without nationality and that is navigating or has navigated into, through, or from waters beyond the outer limit of the territorial sea of a single country or a lateral limit of that country’s territorial sea with an adjacent country, with the intent to evade detection.</text></subsection> 
<subsection id="HBDD4978D7CEC4B6B90CC6627AD4400B6"><enum>(b)</enum><header>Evidence of Intent to Evade Detection</header><text>In any civil enforcement proceeding for a violation of subsection (a), the presence of any of the indicia described in paragraph (1)(A), (E), (F), or (G), or in paragraph (4), (5), or (6), of section 70507(b) may be considered, in the totality of the circumstances, to be prima facie evidence of intent to evade detection.</text></subsection> 
<subsection id="H4A4C8C905CFE41EE9E124C00863D1F58"><enum>(c)</enum><header>Defenses</header> 
<paragraph id="HFBE511B976ED4E20AAB4DE796F272D93"><enum>(1)</enum><header>In general</header><text>It is a defense in any civil enforcement proceeding for a violation of subsection (a) that the submersible vessel or semi-submersible vessel involved was, at the time of the violation—</text> 
<subparagraph id="H562AA2F867DC4C20802220036866B394"><enum>(A)</enum><text>a vessel of the United States or lawfully registered in a foreign nation as claimed by the master or individual in charge of the vessel when requested to make a claim by an officer of the United States authorized to enforce applicable provisions of United States law;</text></subparagraph> 
<subparagraph id="H7B376B16D8D744E2AFA72913C12E2232"><enum>(B)</enum><text>classed by and designed in accordance with the rules of a classification society;</text></subparagraph> 
<subparagraph id="HFEA700E0708943AC9391746D00DA47E1"><enum>(C)</enum><text>lawfully operated in government-regulated or licensed activity, including commerce, research, or exploration; or</text></subparagraph> 
<subparagraph id="HDB7FB7923E3E4F77816D5041629E4836"><enum>(D)</enum><text>equipped with and using an operable automatic identification system, vessel monitoring system, or long range identification and tracking system.</text></subparagraph></paragraph> 
<paragraph id="HD8EEB0E168C640F6B37322DDA7C29DB9"><enum>(2)</enum><header>Production of documents</header><text>The defenses provided by this subsection are proved conclusively by the production of—</text> 
<subparagraph id="H756904C5C37A4D9B9BE1706C00F684EC"><enum>(A)</enum><text>government documents evidencing the vessel’s nationality at the time of the offense, as provided in article 5 of the 1958 Convention on the High Seas;</text></subparagraph> 
<subparagraph id="HE9B95D2452D147AEA12B611CFE7FAD48"><enum>(B)</enum><text>a certificate of classification issued by the vessel’s classification society upon completion of relevant classification surveys and valid at the time of the offense; or</text></subparagraph> 
<subparagraph id="HD5D154EDD20348D88313AF8C999D8859"><enum>(C)</enum><text>government documents evidencing licensure, regulation, or registration for research or exploration.</text></subparagraph></paragraph></subsection> 
<subsection id="H5E7C12B59BAB4D4196E176EF2814954E"><enum>(d)</enum><header>Civil Penalty</header><text>A person violating this section shall be liable to the United States for a civil penalty of not more than $1,000,000.</text></subsection></section><after-quoted-block></after-quoted-block></quoted-block></subsection> 
<subsection id="HF1373A46472E42CE8F00E4FFB200781B"><enum>(b)</enum><header>Conforming Amendments</header> 
<paragraph id="H2878D787ADDA420FAEDE992956DED5D"><enum>(1)</enum><text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/705">chapter 705</external-xref> of title 46, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/46/70507">section 70507</external-xref> the following:</text>

<paragraph id="HC5DEB0695ADC4D15934895FD192EA7"><enum>(1)</enum><header>Semi-submersible vessel</header><text>The term <term>semi-submersible vessel</term> means any watercraft constructed or adapted to be capable of operating with most of its hull and bulk under the surface of the water, including both manned and unmanned watercraft.</text></paragraph>
