		<official-title>To amend <external-xref legal-doc="usc" parsable-cite="usc/12/1821">section 1821(a)(1)</external-xref> of title 12, United States
		  Code, to raise the maximum Federal deposit insurance coverage to
		  $200,000.</official-title>

		<section id="H1D02232FE96843CB8900E565A8CE22DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Individual Depositor and Community
			 Bank Protection Act of 2008</short-title></quote>.</text>
		</section><section id="H3A3C2055E5164ACB852DB6C387F866B"><enum>2.</enum><header>Findings</header>
			<subsection id="HCD6EFC8C92F74DEDB59D339F844BFD55"><enum>(a)</enum><text display-inline="yes-display-inline">Deposit insurance is vital to depositor
			 confidence and to the stable operation of the Nation’s banking system.</text>
			</subsection><subsection id="HE760A047E02840D397FB21794DB44DC5"><enum>(b)</enum><text>The current
			 Federal deposit insurance limit of $100,000 was set in 1980.</text>
			</subsection><subsection id="HC7FD7DB618A14872BDBC91FDB783BDD8"><enum>(c)</enum><text>The 28-year period
			 since 1980 is the longest period in history without an increase in the Federal
			 deposit insurance limit.</text>
			</subsection><subsection id="H8B557F0498704A1493397217E52C1BDA"><enum>(d)</enum><text>Today’s deposit
			 insurance limit is economically inadequate as it does not reflect the steady
			 increase in the general level of income, prices, and wealth in our Nation since
			 the 1980 deposit insurance limit increase.</text>
			</subsection><subsection id="H8F9D2A3DACB94608BB7FDDF6B5CA2FEA"><enum>(e)</enum><text>In 1935, when
			 Federal deposit insurance was created, the deposit insurance coverage level was
			 ten times per capita annual income. In 2000, it was only four times per capita
			 income.</text>
			</subsection><subsection id="H2167335C88834A4C8C42E9E369D76928"><enum>(f)</enum><text>Large banks enjoy
			 funding and deposit-gathering advantages over smaller banks because they are
			 considered <quote>too big to fail</quote> and are protected from failure
			 through governmental protection that is not afforded to smaller banks.</text>
			</subsection><subsection id="H90812FDBF4EE4F8590947E3162C5F125"><enum>(g)</enum><text>Community banks
			 rely on deposit insurance to a much greater degree than large banks in ensuring
			 depositor confidence. Therefore, a diminishment in the real protection offered
			 by deposit insurance reduces vitality and competitiveness within the banking
			 industry, as community banks are left at a competitive disadvantage.</text>
			</subsection><subsection id="H4342802A9284459FA07B418F51D38019"><enum>(h)</enum><text>An increase in the
			 deposit insurance coverage limit is needed to address economic changes since
			 1980, to boost consumer confidence in the Nation’s banking system, and to
			 ensure vigorous competition in the Nation’s banking industry.</text>
			</subsection></section><section id="H04F0EADD11A549949C28EBE273BDCC62"><enum>3.</enum><header>Increase in
			 Deposit Insurance Coverage</header><text display-inline="no-display-inline">Section 11(a)(1) of the Federal Deposit
			 Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1821">12 U.S.C. 1821(a)(1)</external-xref>), is amended—</text>
			<paragraph id="id8AD5D28D4E1047C89788B4FC1EEF1565"><enum>(1)</enum><text>by striking
			 subparagraph (E) and inserting the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="id1E1FF79CAEC54F4F99115055F5AE3C3B" style="OLC">
					<subparagraph id="id55D3C91B2A814C2AA0E911620A6B2404"><enum>(E)</enum><header>Standard
				maximum deposit insurance amount defined</header><text>For purposes of this
				chapter, the term <quote>standard maximum deposit insurance amount</quote>
				means $200,000, adjusted as provided under subparagraph (F) after March 31,
				2010.</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idCC35C7DEE06841C097D3D819C2571568"><enum>(2)</enum><text>by striking
			 subclause (F)(i)(I) and inserting the following new subclause:</text>

					<subclause id="idBEB54419611148DABC902E8977920D67"><enum>(I)</enum><text>$200,000;
				and</text>
					</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id961B067F28B54182B0B0D086BA425944"><enum>4.</enum><header>Effective
			 Date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall become effective on the date of enactment of this Act.</text>
