		<section display-inline="no-display-inline" id="HFB2956A140244662A196BFA6405786A6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Loan Shark Prevention
			 Act</short-title></quote>.</text>
		</section><section id="H267514B84E9D47E8BF466880DAE07FFC"><enum>2.</enum><header>National consumer
			 credit usury rate</header><text display-inline="no-display-inline">Section 107
			 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1606">15 U.S.C. 1606</external-xref>) is amended by adding at the end
			 thereof the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H3A2B5E72A63C48499571CA00B8648B45" style="OLC">
				<subsection id="HF11BFD2CFDD542B398C6427F4E78E860"><enum>(f)</enum><header>National
				consumer credit usury rate</header><text>The annual percentage rate applicable
				to any extension of credit may not exceed by more than 8 percentage points the
				rate established under <external-xref legal-doc="usc" parsable-cite="usc/26/6621">section 6621(a)(2)</external-xref> of the Internal Revenue Code of 1986,
				as determined by the
				Board.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H61B3120A94B44CFB8D04467986D96E13"><enum>3.</enum><header>Cap on fees
			 charged by financial institutions</header>
			<subsection id="HC668883EE7DA49FD91292D2B46B873D0"><enum>(a)</enum><header>In
			 General</header><text>Chapter 1 of the Truth in Lending Act (15 U.S.C. 1601 et
			 seq.) is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H82B0F5CB508B4747A361B0CFE7BE236" style="USC">
					<section id="H71ABAE5F6CC444F2811100ABC186F05B"><enum>115.</enum><header>Cap on
				fees</header><text display-inline="no-display-inline">The amount of any fee or
				charge that a creditor may impose, under the terms of a credit transaction, may
				not exceed
				$15.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEFD4A9EEF05942A5B03D1E6415EB3F2D"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of sections for chapter 1 of the Truth in
			 Lending Act is amended by inserting after the item relating to section 114 the
			 following new item:</text>

			</subsection></section><section display-inline="no-display-inline" id="H910114F40FA845AAB4D988B83C00215C" section-type="subsequent-section"><enum>4.</enum><header>Advanced notice
			 required before any imposition of a fee on credit card accounts</header><text display-inline="no-display-inline">Section 127 of the Truth in Lending Act (15
			 U.S.C. 1637) is amended by adding at the end the following new
			 subsection:</text>

				<subsection id="H8468B7AAABCA406AA8D5E0E13C02C095"><enum>(i)</enum><header>Advance notice
				of imposition of any fee required</header>
					<paragraph id="H4E2CD1C9EC3A43B28E80A850C9830053"><enum>(1)</enum><header>Fees</header><text display-inline="yes-display-inline">In the case of any credit card account
				under an open end consumer credit plan, no fee, including any annual fee, late
				payment fee, or over-the-limit fee, may be imposed on such account before the
				end of the 30-day period beginning on the date the obligor receives a specific
				notice of the imposition of such fee in accordance with paragraph (2).</text>
					</paragraph><paragraph id="H1687CC472D984EA89126216891B65200"><enum>(2)</enum><header>Notice
				requirements</header>
						<subparagraph id="H8F948A2928F742958F76D152D9C9449"><enum>(A)</enum><header>In
				general</header><text>Any notice required under this subsection shall be mailed
				(or e-mailed, if the consumer has requested to receive such notices
				electronically) to the obligor separately from any statement or other notice
				and without any advertising or other disclosures.</text>
						</subparagraph><subparagraph id="HA4FBF6015ADE4D9FA3CBD989B68CEE00"><enum>(B)</enum><header>Fee
				explanation</header><text>The notice shall include an explanation of how, when,
				and why a fee will be imposed and what options the obligor may have for
				addressing the imposition of the fee or any reason for such imposition,
				including the prevention of any future imposition of such
				fee.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
