<official-title>To require rail carriers to develop positive rail control system plans for improving railroad safety and to increase the civil penalties for railroad safety violations.</official-title>

<section id="HB6F4986AD22149C3993C00E2667D5B6E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rail Collision Prevention Act</short-title></quote>.</text></section> 
<section id="HAA217DB75ECC4B2C85FE2141D3105013" section-type="subsequent-section"><enum>2.</enum><header>Positive train control systems</header> 
<subsection id="H6A80765DD734430EA80883A3AF4FD616"><enum>(a)</enum><header>Submission of plan</header> 
<paragraph id="HB7DD9914398D40F9A28950F19EFE009F"><enum>(1)</enum><header>In general</header><text>Not later than 12 months after the date of the enactment of this Act, each rail carrier that is a Class I railroad, a rail carrier that has inadequate safety performance (as determined by the Secretary), or a rail carrier that provides intercity passenger or commuter rail passenger transportation shall develop and submit to the Secretary a plan for implementing a positive train control system by December 31, 2014.</text></paragraph> 
<paragraph id="H177CBA9415944DAEBCF9AEA138FA565F"><enum>(2)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance and guidance to railroad carriers in developing the plans required under this subsection.</text></paragraph></subsection> 
<subsection id="H5AE10E22D6534A7A964C8584A907CD53"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HB9F3A11A7CE94F3EAE4E8CC91100E026"><enum>(1)</enum><header>Positive train control system</header><text>The term <term>positive train control system</term> means a system designed to prevent train-to-train collisions, overspeed derailments, incursions into roadway worker work limits, and movement of a train through a switch left in the wrong position.</text></paragraph> 
<paragraph id="H6A4327EDFDB3482381D2FC9136E3F36"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection> 
<subsection id="HC29ECA8479514582B300F08839A3C354"><enum>(c)</enum><header>Contents of plan</header><text>The plans submitted under paragraph (1) shall include—</text> 
<paragraph id="H0206E2824DD24D60B5F170586EE1C99D"><enum>(1)</enum><text>measurable goals, including a strategy and time line for implementation of such systems;</text></paragraph> 
<paragraph id="H8FF1CAD8A2024C63B6177EA7CF30249D"><enum>(2)</enum><text>a prioritization of how the systems will be implemented, with particular emphasis on high-risk corridors such as those that have significant movements of hazardous materials or where commuter and intercity passenger railroads operate;</text></paragraph> 
<paragraph id="HFDA5899C1C7B4AFB808BB94F5EDC781B"><enum>(3)</enum><text>identification of detailed steps the carriers will take to implement the systems; and</text></paragraph> 
<paragraph id="HD9614A03C17349858EFD3BB832E1C223"><enum>(4)</enum><text>any other element the Secretary considers appropriate.</text></paragraph></subsection> 
<subsection id="HB358590381DE4813BD4FE9E6917FD718"><enum>(d)</enum><header>Review and approval</header> 
<paragraph id="H12880223D44A493890666433F26F0545"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the Secretary receives a plan from a rail carrier under this section, the Secretary shall—</text> 
<subparagraph id="HCE17103D0C084821B1E6ACC9BB542E7"><enum>(A)</enum><text>review the plan;</text></subparagraph> 
<subparagraph id="HD9D3F7ACE53C4389913944BA726800A6"><enum>(B)</enum><text>notify the rail carrier that the plan has been approved; or</text></subparagraph> 
<subparagraph id="H3D6316AD593644C9BC725DC618DB4100"><enum>(C)</enum><text>notify the affected railroad carrier of the specific points in which the proposed plan is deficient.</text></subparagraph></paragraph> 
<paragraph id="HEF76E4FEAC324E0CB4FED8F67C02273"><enum>(2)</enum><header>Correction of deficiencies</header><text>A railroad carrier shall correct all deficiencies of a plan submitted under this section not later than 30 days after receiving written notice from the Secretary of such deficiencies.</text></paragraph> 
<paragraph id="HA5F086E53C9747AB991B097866DDC65C"><enum>(3)</enum><header>Compliance with plan</header><text>Upon receiving notification from the Secretary that a plan submitted under this section has been approved, the rail carrier that submitted such plan shall comply with goals, strategy, and time line contained in such plan.</text></paragraph> 
<paragraph id="H35DA296E9B4746228FABA121AE3D604D"><enum>(4)</enum><header>Annual review</header><text>The Secretary shall conduct an annual review to ensure that each rail carrier is complying with the plan submitted by such rail carrier under this section.</text></paragraph></subsection> 
<subsection id="H08E831AF79E04E579BC761E9A59EACA8"><enum>(e)</enum><header>Report</header><text>Not later than December 31, 2011, the Secretary shall submit a report that describes the progress made by rail carriers in implementing positive train control systems to—</text> 
<paragraph id="H39746F271F764D7A95007F1453FFC73F"><enum>(1)</enum><text>the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>; and</text></paragraph> 
<paragraph id="HA204055237524E0AB6417438E92F6206"><enum>(2)</enum><text>the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>.</text></paragraph></subsection> 
<subsection id="H5C9C26D38D6D4AF6A6A0B113D8F5444"><enum>(f)</enum><text>Positive train control systems shall be implemented no later than December 31, 2012 in those areas determined by the Secretary of Transportation to have the highest safety risk due to shared track between commuter and freight rail.</text></subsection> 
<subsection id="H49171791A28F446593CA08F76E4F6F13"><enum>(g)</enum><header>Enforcement</header><text>The Secretary is authorized to assess civil penalties pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/213">chapter 213</external-xref> of title 49, United States Code, for a violation of this section, including the failure to submit, certify, or comply with a plan for implementing a positive train control system.</text></subsection></section> 
<section id="H8446417E9B8F4BAEBDF93042E003E3CA"><enum>3.</enum><header>Civil penalty increases</header> 
<subsection id="H2A563408168F48BF00FB7F705166F9F"><enum>(a)</enum><header>General violations of chapter 201</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/21301">Section 21301(a)(2)</external-xref> of title 49, United States Code, is amended—</text> 
<paragraph id="H4DCBDB3A5EF044458C9096CCF9B01500"><enum>(1)</enum><text>by striking <quote>$10,000</quote> and inserting <quote>$25,000</quote>; and</text></paragraph> 
<paragraph id="H64114AD6B03443D1964CD154EAAF25C3"><enum>(2)</enum><text>by striking <quote>$20,000</quote> and inserting <quote>$100,000</quote>.</text></paragraph></subsection> 
<subsection id="H580C7A3CFE6B4D4C9C7D7870DFA02F83"><enum>(b)</enum><header>Accident and incident violations of chapter 201; violations of chapters 203 through 209</header><text>Section 21302(a)(2) of such title is amended—</text> 
<paragraph id="H88F96E343C014741B958FE8CE41B0090"><enum>(1)</enum><text>by striking <quote>$10,000</quote> and inserting <quote>$25,000</quote>; and</text></paragraph> 
<paragraph id="H33BA887427B64457B1DDCB2B92CF08A7"><enum>(2)</enum><text>by striking <quote>$20,000</quote> and inserting <quote>$100,000</quote>.</text></paragraph></subsection> 
<subsection id="HA6E5631AE6C244D393F717BF00318B41"><enum>(c)</enum><header>Violations of chapter 211</header><text>Section 21303(a)(2) of such title is amended—</text> 
<paragraph id="H86DC6F5A9D774E6CAF31765689CA15A"><enum>(1)</enum><text>by striking <quote>$10,000</quote> and inserting <quote>$25,000</quote>; and</text></paragraph> 
<paragraph id="H4935EA979BA34A7E9833CF8C57F4846B"><enum>(2)</enum><text>by striking <quote>$20,000</quote> and inserting <quote>$100,000</quote>.</text></paragraph></subsection></section>
