		<section id="H991E25FF79D045F2ACF634E364A21282" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Juvenile Justice Reform Act of
			 2008</short-title></quote> .</text>
		</section><section id="H894BAF7E50B3492ABFB6C710A171F3AF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 103 of the Juvenile Justice and
			 Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5603">42 U.S.C. 5603</external-xref>) is amended—</text>
			<paragraph id="H414CE7AAB8C844ECA3F01CE748A6DFF2"><enum>(1)</enum><text>by amending
			 paragraph (25) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H83CE79B35A0B468D80BAA3B769802FA4" style="traditional">
					<paragraph id="HF6BFBE39C33C4DAD926CB8587617A008"><enum>(25)</enum><text display-inline="yes-display-inline">the term <quote>contact</quote> means any
				sight or sound interaction between a juvenile in a secure custody status with
				an adult inmate;</text>
					</paragraph><after-quoted-block>,</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H55823BF045384E9997C00B1D5004BA"><enum>(2)</enum><text>in
			 paragraph (28) by striking <quote>and</quote> at the end,</text>
			</paragraph><paragraph id="HD30240CFBCEA4100AB589EFFEF3789A6"><enum>(3)</enum><text>in paragraph (29)
			 by adding <quote>and</quote> at the end, and</text>
			</paragraph><paragraph id="H90C04B72C4A646B593746DD459F01684"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H70358461B00440CE93E8B17ECE33C561" style="OLC">
					<paragraph id="HA4D9FD4351214BD98F6D6D794938415B"><enum>(30)</enum><text>the term
				<quote>juvenile justice stakeholders</quote> means individuals and
				representatives of agencies, institutions, and organizations with interest in
				the activities and outcomes of the juvenile justice system, including—</text>
						<subparagraph id="HF1D0495BE9924F7A9D18C168B03E46D7"><enum>(A)</enum><text>youth and family
				members of youth who have had contact with the juvenile justice system;</text>
						</subparagraph><subparagraph id="HD729AAF2D84045DDAF1F7808A0DD9000"><enum>(B)</enum><text>youth and families
				of color;</text>
						</subparagraph><subparagraph id="HA039FF81DD7742C282853EA906006D8"><enum>(C)</enum><text>defense attorneys
				for youth, prosecutors for the juvenile court, and juvenile court judges;
				and</text>
						</subparagraph><subparagraph id="H4026AF9E658A4FE382A1984EE8FF5C89"><enum>(D)</enum><text>representatives of
				school systems, law enforcement agencies, juvenile detention and corrections,
				juvenile probation departments, and community-based providers of
				gender-specific services and services to youth of color and juvenile
				justice-involved
				youth.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section display-inline="no-display-inline" id="H82AD3A26326F47E49606288912093287"><enum>3.</enum><header>Annual
			 report</header><text display-inline="no-display-inline">Section 207(1) of the
			 Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5617">42 U.S.C. 5617(1)</external-xref>) is
			 amended—</text>
			<paragraph id="HA62D75AF196246C4A2D90A63CE1E414"><enum>(1)</enum><text>in
			 subparagraph (B) by inserting <quote>, ethnicity,</quote> after
			 <quote>race</quote>,</text>
			</paragraph><paragraph id="H3E3FB7FA91CF4CDBBAC4D8373C43D43B"><enum>(2)</enum><text>in subparagraph
			 (E) by striking <quote>and</quote> at the end,</text>
			</paragraph><paragraph id="HDA6609993BBD4AE285ACBEA700CE009E"><enum>(3)</enum><text>in subparagraph
			 (F) by striking the period at the end and inserting <quote>; and</quote>,
			 and</text>
			</paragraph><paragraph id="H1F4F655612834D99A0DE31F259661109"><enum>(4)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HFA5443E2A69D440FBAC57D63DD5074D" style="traditional">
					<subparagraph id="HD368E3450E834184BC68B22EE546F735"><enum>(G)</enum><text display-inline="yes-display-inline">how State plans are meeting the requirement
				under section
				223(a)(7)(B)(i).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H911A0A625B844FCCBA53DA97E3898E"><enum>4.</enum><header>State
			 plans</header><text display-inline="no-display-inline">Section 223(a) of the
			 Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5633">42 U.S.C. 5633(a)</external-xref>) is
			 amended—</text>
			<paragraph id="HFD056CBF25474BD2B9DFD8A100BC69AB"><enum>(1)</enum><text>in paragraph
			 (3)(A)(ii)—</text>
				<subparagraph id="H11320492BE8242C8BD3D7539E3E54302"><enum>(A)</enum><text display-inline="yes-display-inline">in subclause (VII) by striking
			 <quote>and</quote> at the end,</text>
				</subparagraph><subparagraph id="HDBFA594182EA464A87EF9E21B8DCBF22"><enum>(B)</enum><text display-inline="yes-display-inline">in subclause (VIII) by adding
			 <quote>and</quote> at the end, and</text>
				</subparagraph><subparagraph id="H2E520243509C43EC9EEE4E4192068D2"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

						<subclause id="H5432D9ECCBE745B3B16607BA00E12385"><enum>(IX)</enum><text display-inline="yes-display-inline">individuals with special experience or
				competence in addressing the needs of girls or implementing gender responsive
				services;</text>
						</subclause><after-quoted-block>,</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H68C110E2B0CF49AD976D297D06AE919B"><enum>(2)</enum><text>in paragraph
			 (7)(B)—</text>
				<subparagraph id="H3834CB92CE3C4BBF90FB94A640D90069"><enum>(A)</enum><text>in clause (iii) by
			 striking <quote>and</quote> at the end,</text>
				</subparagraph><subparagraph id="H700E5AD804EF460DAC11C71D2BA28C00"><enum>(B)</enum><text>in clause (iv) by
			 adding <quote>and</quote> at the end, and</text>

				community-based and operated, culturally and linguistically appropriate
				services to youth at-risk or in contact with the juvenile justice
				system;</text>
						</clause><after-quoted-block>,</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H9C64AE14041C48DFA826009CE173CB00"><enum>(3)</enum><text>in paragraph
			 (11)—</text>
				<subparagraph id="H0E0405ED8CF94CB5918D28BD317BCBD9"><enum>(A)</enum><text>by striking
			 <quote>shall,</quote>,</text>
				</subparagraph><subparagraph id="H062D1ED699D64C8389AAD0A9BB14F48E"><enum>(B)</enum><text>in subparagraph
			 (A)—</text>
					<clause id="H45AE7CCB84CB4596BA00B180975DEC6"><enum>(i)</enum><text>in
			 clause (i) by striking the semicolon at the end,</text>
					</clause><clause id="HECFC0E0D5E094F61BB70C7CA16BA4EE4"><enum>(ii)</enum><text>by
			 striking <quote>excluding—</quote> and all that follows through
			 <quote>(i)</quote> and inserting <quote>excluding</quote>,</text>

			 striking clauses (ii) and (iii), and</text>
					</clause><clause id="H2E785CAE7DEA4078B1A256A753C555CC"><enum>(iv)</enum><text>by
			 striking <quote>and</quote> at the end, and</text>
					</clause></subparagraph><subparagraph id="H02CD296DD7414DE4009C6D501442EBE"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5723B4232577484BA0DB08742818CB36" style="OLC">
						<subparagraph id="HC006238DBDF14A948B4FC31FD2ECC2A2"><enum>(C)</enum><text>not later than 3
				years after the effective date of this subparagraph, or sooner if possible, no
				exceptions to this paragraph shall be permissible in relation to—</text>
							<clause id="H50CBE7198C1549B78F0473F3D9ACD624"><enum>(i)</enum><text>juveniles who are
				charged with or who have committed a violation of a valid court order;
				and</text>
							</clause><clause id="H54F938AEA17E4D00B0819BC7B7E93783"><enum>(ii)</enum><text>juveniles who are
				held in accordance with the Interstate Compact on Juveniles as enacted by the
				State; and</text>
							</clause></subparagraph><subparagraph id="H9435EEECABD04E738E215B89B928F01"><enum>(D)</enum><text>efforts shall be
				made to care safely for juveniles described in subparagraphs (A) and (B) by
				utilizing staff-secure and other community-based alternatives to secure
				detention, including the Runaway and Homeless Youth Act programs administered
				by the Family and Youth Services Bureau of the Administration for Children and
				Families of the Department of Health and Human
				Services;</text>
						</subparagraph><after-quoted-block>,</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HA41EDCFED17846CC9CEC033C21F87D03"><enum>(4)</enum><text>in paragraph
			 (12)—</text>
				<subparagraph id="HDBE3300434CB4F14BBE0AE954316C8F5"><enum>(A)</enum><text>in subparagraph
			 (A) by striking <quote>and</quote> at the end,</text>
				</subparagraph><subparagraph id="H742300E111694F658075D5E723D17EDB"><enum>(B)</enum><text>in subparagraph
			 (B) by adding <quote>and</quote> at the end, and</text>
				</subparagraph><subparagraph id="HA11FD2E2FDD146BA8C90C8A05BF72D9F"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HDA1ED72E33EE491C84E13100A983B200" style="OLC">
						<subparagraph id="H021AC8BB3B6944F48DEBA405745C856D"><enum>(C)</enum><text>not later than 3
				years after the effective date of this provision, or sooner if possible,
				juveniles awaiting trial or any other legal process and who are treated as
				adults for purposes of prosecution in criminal court shall not have contact
				with adult inmates when held in the custody of the criminal
				court;</text>
						</subparagraph><after-quoted-block>,</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H3DEB4352B6C4441B8F49DA007C8CB101"><enum>(5)</enum><text>in paragraph
			 (13)—</text>
				<subparagraph id="H259675DFA9DC48EEAC39AAFD93E1C056"><enum>(A)</enum><text>by inserting after
			 <quote>adults</quote> the 1st place it appears the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE7579DC46FB944AB8C95562D5DE34BF8" style="OLC">
						<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">, and
				provide that not later than 3 years after the effective date of this bill, or
				sooner if possible, juveniles treated as adults for purposes of prosecution in
				criminal court and juveniles prosecuted as adults in criminal court may not be
				held in any jail or lockup for adults while awaiting trial on a criminal
				charge,</quoted-block-continuation-text><after-quoted-block>,
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H61DEE1C6367040648E1C60B047F0DFF1"><enum>(B)</enum><text>in subparagraph
			 (A) by adding <quote>and</quote> at the end,</text>
				</subparagraph></paragraph><paragraph id="HA9FCAA29FA43410E9D3781D93CE75B6B"><enum>(6)</enum><text>in paragraph (15)
			 by inserting <quote>ethnicity,</quote> after <quote>race,</quote>,</text>
			</paragraph><paragraph id="H1AD928E3FE3140F99CF105B2BDC5FFEA"><enum>(7)</enum><text>by striking
			 paragraphs (22) and (23),</text>
			</paragraph><paragraph id="H03713210C1B64DA9AAC4CD5E2B614602"><enum>(8)</enum><text>by redesignating
			 paragraphs (14) through (28) as paragraphs (15) through (27), respectively,
			 and</text>
			</paragraph><paragraph id="H8681C6D4D1F348789F7432B3CD098F66"><enum>(9)</enum><text>by after paragraph
			 (13) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H72293B15F2544A11B0DC05F7839D56FF" style="OLC">
					<paragraph id="H224C7ADF216845F8855402C5F84B18A8"><enum>(14)</enum><text>implement policy,
				practice, and system improvement strategies at the State, territorial, local,
				and tribal levels to identify and reduce racial and ethnic disparities among
				youth who come into contact with the juvenile justice system by—</text>
						<subparagraph id="HD1F0264D942A43958031FAC362D6103F"><enum>(A)</enum><text>establishing
				coordinating bodies to oversee and monitor State, territorial, local, or tribal
				efforts to reduce racial and ethnic disparities, composed of juvenile justice
				stakeholders at the State, territorial, local, or tribal levels, including
				community leaders and service providers from communities in which youth of
				color are disproportionately represented in the juvenile justice system;</text>
						</subparagraph><subparagraph id="HC02ED35F2CF947E0825EE450CE5E03FC"><enum>(B)</enum><text>identifying and
				analyzing key decision points, and the criteria used to make those decisions,
				in State, territorial, local, or tribal juvenile justice systems, to determine
				which points create racial and ethnic disparities among juveniles who come into
				contact with the juvenile justice system and the causes of those
				disparities;</text>
						</subparagraph><subparagraph id="H792CAB1CB28D4AB69D486D03F347A6CC"><enum>(C)</enum><text>developing and
				implementing State, territorial, local, or tribal data collection and analysis
				systems to identify where racial and ethnic disparities exist in the juvenile
				justice system and to track and analyze such disparities using descriptors
				disaggregated, as appropriate, by factors including race, ethnicity, sex,
				geography, offense, delinquency history, and age;</text>
						</subparagraph><subparagraph id="HEE773AA162C941449B2EA39B26ACACB3"><enum>(D)</enum><text>developing and
				implementing a work plan that includes measurable objectives for policy
				changes, practice changes or other system changes, based on the needs
				identified in the data collection and analysis under subparagraph (B) and
				designed to reduce any forms of bias, differential treatment of youth of color
				or disparities found to be associated with race and ethnicity, including
				provision of culturally and linguistically competent services; and</text>
						</subparagraph><subparagraph id="HA7F3C3471DF3466EBF101296215C67E2"><enum>(E)</enum><text>tracking and
				publicly reporting, on an annual basis, the efforts and progress made in
				accordance with subparagraphs (B), (C), and
				(D).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HBC995266AE36427B9EE1D18F320048FF"><enum>5.</enum><header>Research and
			 evaluation</header><text display-inline="no-display-inline">Section 251 of the
			 Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5661">42 U.S.C. 5661</external-xref>) is
			 amended—</text>
			<paragraph id="HA792C70ED19F42ECB3BD41A96001963"><enum>(1)</enum><text>in
			 subsection (a)(1)(B) by—</text>
				<subparagraph id="HB02F4877BF8E4D26BC9D676B76E7B18"><enum>(A)</enum><text>in clause (x) by
			 striking <quote>and</quote> at the end,</text>
				</subparagraph><subparagraph id="HA57E0C23D75C44F4BBADA9CAEDF6235"><enum>(B)</enum><text>in clause (xi) by
			 striking the period at the end and inserting <quote>; and</quote>, and</text>
				</subparagraph><subparagraph id="HB9C2F098B3134F0DBA51954FD888A479"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2A66EB787E6840D6B2189400CDEE3C42" style="traditional">
						<clause id="H66353E588D664F3D9BCB177D71B67E61" indent="up1"><enum>(xii)</enum><text display-inline="yes-display-inline">juveniles treated as adults for purposes of
				prosecution in criminal court.</text>
						</clause><after-quoted-block>,
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H36C5D766827441B09D10EEA3C5D8B4DF"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H180AD4138BC9413E82B0F3442158F7B1" style="OLC">
					<subsection id="H5B02745B2F34414291B45CE302733303"><enum>(f)</enum><header>Assessment of
				treating juveniles as adults</header><text>The Administrator shall—</text>
						<paragraph id="HB3A142EAF923490BB14C6C2484820055"><enum>(1)</enum><text>not later than 3
				years after the effective date this subsection, assess the effectiveness of the
				practice of treating juveniles as adults for purposes of prosecution in
				criminal court; and</text>
						</paragraph><paragraph id="H836BDBE6FEA342A49177435CC7C42157"><enum>(2)</enum><text>not later than 6
				months after making the assessment required by paragraph (1)—</text>
							<subparagraph id="H050E758FA3674CBE8EB439B400E14000"><enum>(A)</enum><text>submit to the
				Speaker of the House of Representatives, the Speaker pro tempore of the Senate,
				and the President a report containing the findings, conclusions, and any
				recommended changes in law identified as a result of such assessment;
				and</text>
							</subparagraph><subparagraph id="H076D2E7FF7594AE9AB6D333B001136F7"><enum>(B)</enum><text>make such report
				available to the
				public.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H0898C68C71744F7892F3DD47B4E703A4"><enum>6.</enum><header>Incentive grants
			 for local delinquency preventions programs</header><text display-inline="no-display-inline">Section 504(a) of the Incentive Grants for
			 Local Delinquency Prevention Programs Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/5784">42 U.S.C. 5784(a)</external-xref>) is
			 amended—</text>
			<paragraph id="H6877F93E00044B34A00021151B6F7667"><enum>(1)</enum><text>in paragraph (7)
			 by striking <quote>and</quote> at the end,</text>
			</paragraph><paragraph id="HFE3FBA7775ED4EF5000026189FA3682B"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (8) as paragraph
			 (9), and</text>
			</paragraph><paragraph id="HB12BA49965904154B5D58FB244FF463E"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting the following after paragraph
			 (7) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCDA7A8C916FD482C9BC4C648344F2520" style="traditional">
					<paragraph id="H14371685F32D400586B32D5DAE0C8AF"><enum>(8)</enum><text display-inline="yes-display-inline">gender specific services that address the
				above purpose areas;
				and</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H0F2DCB79CDEE4A14A6A31D3F5CE9126"><enum>7.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall take effect on the 1st day of the 1st fiscal
			 year that begins after the date of the enactment of this Act.</text>
