		<official-title>To amend title 28 of the United States Code to require
		  reporting on certain authoritative legal interpretations issued by the
		  Department of Justice, including the Office of Legal Counsel, and for other
		  purposes.</official-title>

		<section id="H0C8CE3DA629D4254802C352C5BB98D11" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Office of Legal Counsel Reporting Act
			 of 2008</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H8CE695E74AAF451F90DB1D39CC99FB85"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="HB8ED6B3011884E3A9113E3004BC87C53"><enum>(1)</enum><text>To fulfill the
			 constitutional duty of the executive branch to act lawfully, the President must
			 have access to a reliable source of legal advice.</text>
			</paragraph><paragraph id="H8AF5FE80A8EA415FAB0350BFF923DD4"><enum>(2)</enum><text>To
			 fulfill its legislative and oversight duties under the Constitution, Congress
			 must have access to information about how and whether the executive branch is
			 implementing the laws of the United States.</text>
			</paragraph><paragraph id="H64C913102FE3487C8C9503355BC93F61"><enum>(3)</enum><text>The Attorney
			 General has delegated to the Office of Legal Counsel in the Department of
			 Justice the function of providing legal advice to guide the actions of the
			 President and the executive branch.</text>
			</paragraph><paragraph id="HCFD4183C1B83431BB73B7EFAF0A6F4DC"><enum>(4)</enum><text>By virtue of
			 regulation and tradition, the legal interpretations made by the Office are
			 considered binding and must be followed within the executive branch.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H2704B618A619413A804FF80140BA76D3" section-type="subsequent-section"><enum>3.</enum><header>Reporting on
			 authoritative legal interpretations by the Department of Justice</header>
			<subsection id="H96B69B976D1E44BFA4E6E23D002E472C"><enum>(a)</enum><header>Inclusion of
			 authoritative legal interpretations in existing report
			 requirements</header><text display-inline="yes-display-inline">Section
			 530D(a)(1) of title 28, United States Code, is amended—</text>
				<paragraph id="HC9AA7C4B044C4374A500C3372F1778C1"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of subparagraph (B)(ii);</text>
				</paragraph><paragraph id="HD2A6B076E1444BEF94BFD0F102E82666"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the period at the end of
			 subparagraph (C)(ii)(VI) and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="H8FA9C76F1FA34F129F8C115ED9DA37A8"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7B5B9911A9F345D68D1FFF6C096552E3" style="OLC">
						<subparagraph commented="no" id="HCECF130947284016AFBE864CAFE6ADBF"><enum>(D)</enum><text>except as provided
				in paragraph (3), issues an authoritative legal interpretation (including an
				interpretation under section 511, 512, or 513 by the Attorney General or by an
				officer, employee, or agency of the Department of Justice pursuant to a
				delegation of authority under section 510) of any provision of any Federal
				statute that—</text>
							<clause commented="no" display-inline="no-display-inline" id="HD0C712FB46874690936D64A6D7E70099"><enum>(i)</enum><text>concludes that
				such provision is unconstitutional or would be unconstitutional in a particular
				application;</text>
							</clause><clause id="HA90BBA9C2A2C45D7B871C6EEFC30CF"><enum>(ii)</enum><text display-inline="yes-display-inline">that relies for its conclusion, in whole or
				in the alternative, on a determination that an interpretation of the provision
				other than the authoritative legal interpretation of the provision would raise
				constitutional concerns under Article II of the Constitution of the United
				States or separation of powers principles;</text>
							</clause><clause id="H7DFA3E177D1A4491A9C5859617C6C2FC"><enum>(iii)</enum><text>that relies for
				its conclusion, in whole or in the alternative, on a legal presumption against
				applying the provision, whether during wartime or otherwise, to—</text>
								<subclause id="H53F5DFEDB1A7466680D362C76DBF4CF6"><enum>(I)</enum><text>any department or
				agency established in the executive branch of the Federal Government, including
				but not limited to the Executive Office of the President and the military
				departments (as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(8)</external-xref> of title 10, U.S. Code); or</text>
								</subclause><subclause id="HB03A2319737943FC8BE29DC02C38B600"><enum>(II)</enum><text>any officer,
				employee, or member of any department or agency established in the executive
				branch of the Federal Government (including but not limited to the President)
				and any member of the Armed Forces; or</text>
								</subclause></clause><clause id="H4D6B55FAA1B943A6B13D7C932FC94383"><enum>(iv)</enum><text display-inline="yes-display-inline">that concludes the provision has been
				superseded or deprived of effect, in whole or in part, by a subsequently
				enacted statute where there is no express statutory language stating an intent
				to supersede the prior provision or deprive it of
				effect.’’;</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF5FDCA82F7104860B6735D04F47575CF"><enum>(b)</enum><header>Submission of
			 authoritative legal interpretations and classified
			 information</header><text>Section 530D(a) of such title is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5EB04D5489A64BBB95003428C2AADC52" style="OLC">
					<paragraph commented="no" id="H93FC07317DB843FA807EA4523F6BCEF2"><enum>(3)</enum><header>Direction
				regarding interpretation</header><text>The submission of a report to Congress
				based on the issuance of an authoritative legal interpretation described in
				paragraph (1)(D) shall be discretionary on the part of the Attorney General or
				an officer described in subsection (e) if—</text>
						<subparagraph commented="no" id="HBD94B9CB0C604057B9D100193EC11C1E"><enum>(A)</enum><text display-inline="yes-display-inline">the President or other responsible officer
				of a department or agency established in the executive branch of the Federal
				Government or a responsible member of the Armed Forces issues a directive
				stating that no action shall be taken or withheld or no policy shall be
				implemented or stayed on the basis of the authoritative legal interpretation;
				and</text>
						</subparagraph><subparagraph commented="no" id="H8FFC33708B094737BC1900085EF76845"><enum>(B)</enum><text>the directive
				described in subparagraph (A) is in effect.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H150CE5A000C147E288563361B5785700"><enum>(4)</enum><header>Classified
				information</header>
						<subparagraph commented="no" id="HA1D206AA87C54AD0AAB407FA756045"><enum>(A)</enum><header>Submission of
				report containing classified information regarding intelligence
				activities</header><text>Except as provided in subparagraph (B), if the
				Attorney General submits a report relating to an instance described in
				paragraph (1) that includes a classified annex containing information relating
				to intelligence activities, the report shall be considered to be submitted to
				Congress for the purposes of paragraph (1) if—</text>
							<clause commented="no" id="HB065BB11328E428E8EEC59B3809FB4B"><enum>(i)</enum><text>the unclassified
				portion of the report is submitted to each officer specified in paragraph (2);
				and</text>
							</clause><clause commented="no" id="H54E48B5DF7A34D98807179ED4BCA898C"><enum>(ii)</enum><text>the classified
				annex is submitted to the Select Committee on Intelligence and the Committee on
				the Judiciary of the Senate and the Permanent Select Committee on Intelligence
				and the Committee on the Judiciary of the House of Representatives.</text>
							</clause></subparagraph><subparagraph commented="no" id="H64424E2032554F5E801ED8AB9321BE15"><enum>(B)</enum><header>Submission of
				report containing certain classified information about covert actions</header>
							<clause commented="no" id="H526C8080397F449BBD05AED558C4369D"><enum>(i)</enum><header>In
				general</header><text>In a circumstance described in clause (ii), a report
				described in that clause shall be considered to be submitted to Congress for
				the purposes of paragraph (1) if—</text>
								<subclause commented="no" id="HC4C3A44CACF34E5D9089FDA0AA00D7C1"><enum>(I)</enum><text>the unclassified
				portion of the report is submitted to each officer specified in paragraph (2);
				and</text>
								</subclause><subclause commented="no" id="H82FD5BF7A40545C3A271362EB14719EE"><enum>(II)</enum><text>the classified
				annex is submitted to—</text>
									<item commented="no" id="H33618336A9EA4A67A1B2C985E3B84EB9"><enum>(aa)</enum><text>the chairman and
				ranking minority member of the Select Committee on Intelligence of the
				Senate;</text>
									</item><item commented="no" id="H729DE918AD554CBD800052452699F49C"><enum>(bb)</enum><text>the chairman and
				ranking minority member of the Committee on the Judiciary of the Senate;</text>
									</item><item commented="no" id="H6FFD5B9B64AA4B98B6C8D152004201B9"><enum>(cc)</enum><text>the chairman and
				ranking minority member of the Permanent Select Committee on Intelligence of
				the House of Representatives;</text>
									</item><item commented="no" id="HA320513E424A4A8AB1D68D942356D23D"><enum>(dd)</enum><text>the chairman and
				ranking minority member of the Committee on the Judiciary of the House of
				Representatives;</text>
									</item><item commented="no" id="HE7921ABDA4FC4FC2966377792600A732"><enum>(ee)</enum><text>the Speaker and
				the minority leader of the House of Representatives; and</text>
									</item><item commented="no" id="H068F998D9447464FBBCBF2C5398E629B"><enum>(ff)</enum><text>the majority
				leader and minority leader of the Senate.</text>
									</item></subclause></clause><clause commented="no" id="H696B2396DCDB4E3A927BB42F2DA3994"><enum>(ii)</enum><header>Circumstances</header><text>A
				circumstance described in this clause is a circumstance in which—</text>
								<subclause commented="no" id="H2CCF52F007ED46F0868645B837FD3604"><enum>(I)</enum><text>the Attorney
				General submits a report relating to an instance described in paragraph (1)
				that includes a classified annex containing information relating to a
				Presidential finding described in section 503(a) of the National Security Act
				of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413b">50 U.S.C. 413b(a)</external-xref>); and</text>
								</subclause><subclause commented="no" id="H8088C7CC23F5412D906440C6FDDE043B"><enum>(II)</enum><text>the President
				determines that it is essential to limit access to the information described in
				subclause (I) to meet extraordinary circumstances affecting vital interests of
				the United
				States.</text>
								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5C64D7972C5B4364B1D6C1A2E1D3E5C6"><enum>(c)</enum><header>Deadlines for
			 submission of report concerning certain authoritative legal
			 interpretations</header><text>Section 530D(b) of such title is amended—</text>
				<paragraph display-inline="no-display-inline" id="H3E07F84221F64A799BC2E88E00E28F9E"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2) by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H361A918FA41B4457B8EE638302EF9A2"><enum>(2)</enum><text>in
			 paragraph (3) by striking the period at the end and inserting <quote>;
			 and</quote>; and</text>
				</paragraph><paragraph id="H100E2534305D482BAB817C439293F400"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HFCE3F215D5BD408C8F0685432400447F" style="OLC">
						<paragraph commented="no" id="H783D2ED38DF34D47B0C58C70091EF3B"><enum>(4)</enum><text display-inline="yes-display-inline">under subsection (a)(1)(D)—</text>
							<subparagraph id="HBBA92C98F5F441CCA1D49300211C5618"><enum>(A)</enum><text>not later than 30
				days after the date on which the Attorney General, the Office of Legal Counsel,
				or any other officer of the Department of Justice issues the authoritative
				legal interpretation of the Federal statutory provision; or</text>
							</subparagraph><subparagraph id="HB19D5850B4AD4FB28453A294E3A7EF88"><enum>(B)</enum><text>if the President
				or other responsible officer of a department or agency established in the
				executive branch of the Federal Government or a responsible member of the Armed
				Forces issues a directive described in subsection (a)(3) and the directive is
				subsequently rescinded, not later than 30 days after the date on which the
				President, officer, or member rescinds that
				directive.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2059D2673F2D4DCDAD08ADDC958507BE"><enum>(d)</enum><header>Contents</header><text>Section
			 530D(c) of such title is amended—</text>
				<paragraph id="HA2B35D01C39541939517B6EB3C18C8F7"><enum>(1)</enum><text display-inline="yes-display-inline">In paragraph (2)(A) by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H9D1849211411417998349781B558E2DE"><enum>(2)</enum><text>In paragraph
			 (2)(B)(i) by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H2BA3D5E03F36491D942C89B05C9D6355"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (2)(B) by inserting at the end
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2779D89A9AAE4C2586EBE8321C815FB0" style="OLC">
						<clause commented="no" id="H01E62FAEDB1E4877AF93FA1E218C032"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of an authoritative legal
				interpretation described in subsection (a)(1)(D), if a copy of a legal opinion
				issued by the Office of Legal Counsel or another legal opinion setting forth
				the authoritative legal interpretation is provided;
				and</text>
						</clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="HCE57ECCF292A402E929C61ABBE81FC53"><enum>(4)</enum><text>by adding at the
			 end of such paragraph the following:</text>
					<quoted-block display-inline="no-display-inline" id="H20921060B50046F3BE2C5F308239FEB2" style="OLC">
						<subparagraph commented="no" id="H5CE86A92C6E7495BB8649645C9736BDD"><enum>(C)</enum><text>any classified
				information shall be provided in a classified annex, which shall be handled in
				accordance with the security procedures established under section 501(d) of the
				National Security Act of 1947 (50 U.S.C.
				413(d));</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HEF02ACAEF6F34686BB89A71484CF66D9"><enum>(5)</enum><text>in paragraph (3)
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H53EB3340DFAF4E939C23DA0621A9677B"><enum>(6)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB0D2D60E092442CF8703BDA8A268771E" style="OLC">
						<paragraph commented="no" id="H1376A959686D442DB696FE9B15606CCE"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to a report required under
				subparagraph (A), (B), or (D) of subsection (a)(1), specify the specific
				provision of the Federal statute, rule, regulation, program, policy, or other
				law at issue, and the subparagraph of subsection (a)(1) and the clause of such
				subparagraph that describes the action of the Attorney General or other officer
				of the Department of
				Justice.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2ACC7E9DD67F4938BCC6A9D7029B66BE"><enum>(e)</enum><header>Conforming
			 amendments</header><text>Section 530D of such title is further amended—</text>
				<paragraph commented="no" id="H8A9A4EB3291A441AA725EAD002C90025"><enum>(1)</enum><text>in subsection
			 (a)(2) by striking <quote>For the purposes</quote> and all that follows through
			 <quote>if the report</quote> and inserting <quote>Except as provided in
			 paragraph (4), a report shall be considered to be submitted to Congress for the
			 purposes of paragraph (1) if the report</quote>;</text>
				</paragraph><paragraph id="HE5C4D6EBFD094836AE50B034EE0E7B5"><enum>(2)</enum><text>in
			 subsection (c)—</text>
					<subparagraph id="H3726166C58C746CCA799DC100506105"><enum>(A)</enum><text>in paragraph (1) by
			 striking <quote>or of each approval described in subsection (a)(1)(C)</quote>
			 and inserting <quote>of each approval described in subsection (a)(1)(C), or of
			 the issuance of the authoritative legal interpretation described in subsection
			 (a)(1)(D)</quote>;</text>
					</subparagraph><subparagraph id="H0511689C729F4F69A16F9857AAB7E5F"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause commented="no" id="H9FB27A16C15246EBB1613EE708211D05"><enum>(i)</enum><text>by striking
			 <quote>reasons for the policy or determination</quote> and inserting
			 <quote>reasons for the policy, determination, or authoritative legal
			 interpretation</quote>;</text>
						</clause><clause commented="no" id="H0C80AC2DD15043EC8E78A6336CB32784"><enum>(ii)</enum><text>by striking
			 <quote>or approving such settlement or compromise</quote> and inserting
			 <quote>approving such settlement or compromise, or issuing such authoritative
			 legal interpretation</quote>; and</text>
						</clause><clause commented="no" id="HEF9B759344B4425BB6F1A68B813CD1C1"><enum>(iii)</enum><text>by striking
			 <quote>except that</quote> and inserting <quote>provided that</quote>;
			 and</text>
						</clause></subparagraph><subparagraph commented="no" id="HB1497B74BF0E4301B01577C7B9CD7178"><enum>(C)</enum><text>in paragraph
			 (2)(A)—</text>
						<clause commented="no" id="HDA7F25A9E1BF4773873E3E2D13F57B55"><enum>(i)</enum><text>by inserting
			 <quote>except for information described in paragraphs (1) or (4),</quote>
			 before <quote>such details may be omitted</quote>;</text>
						</clause><clause commented="no" id="H3AB8E8FFB1CF4D858F44E2A5B521C88C"><enum>(ii)</enum><text>by striking
			 <quote>national-security- or classified information, of any</quote>; and</text>
						</clause><clause commented="no" id="H308BC305186A4648B422A09096ED08D"><enum>(iii)</enum><text>by striking
			 <quote>or other law</quote> and inserting <quote>or other statute</quote>;
			 and</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6FEB948B42B74EE7AA6123457581E8E7"><enum>(3)</enum><text>in subsection
			 (e)—</text>
					<subparagraph commented="no" id="H052F5481FAA042B39D744928F6306726"><enum>(A)</enum><text>by striking
			 <quote>(but only with respect to the promulgation of any unclassified Executive
			 order or similar memorandum or order),</quote> and inserting
			 <quote>;</quote>;</text>
					</subparagraph><subparagraph commented="no" id="H70A669D71B1E4CA7A96200323FAC4843"><enum>(B)</enum><text>by inserting
			 <quote>, issues an interpretation described in subsection (a)(1)(D),</quote>
			 after <quote>policy described in subsection (a)(1)(A)</quote>; and</text>
					</subparagraph><subparagraph id="HA232BFA82B354CD9ADD100E5CC0EBFC"><enum>(C)</enum><text>by striking
			 <quote>,</quote> after <quote>litigation</quote> and inserting
			 <quote>;</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="HF22F0350DF9545828D68C8BB026D1D87"><enum>4.</enum><header>Written and
			 signed opinions required</header>
			<subsection id="H551E118F492240569C30AE6C027B00D8"><enum>(a)</enum><header>Written opinions
			 required</header>
				<paragraph id="HB03D3E8E1DFB49DB9F88C6295F441CEF"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 <internal-xref idref="H9655BC4894A847A1A8CDB2B7997DF108" legis-path="4.(a)(2)">paragraph (2)</internal-xref>, any qualified legal
			 opinion (as defined in section 5) issued to the President, any person or entity
			 in the executive branch, or any member of the Armed Forces shall be issued in
			 writing.</text>
				</paragraph><paragraph id="H9655BC4894A847A1A8CDB2B7997DF108"><enum>(2)</enum><header>Exception when
			 immediate action is required</header><text>A qualified legal opinion is not
			 required to be issued in writing, if—</text>
					<subparagraph id="HE46C277E8664436DB5A376C738210001"><enum>(A)</enum><text>at the time that
			 the opinion is issued—</text>
						<clause id="H944886792869475EA488DDB4BC84CFFA"><enum>(i)</enum><text>the
			 Attorney General determines that the immediate action of the United States is
			 required and that a qualified legal opinion cannot be prepared in writing as a
			 result of such requirement; and</text>
						</clause><clause id="H660D6CEB9FF344E5A0C0B9C7B1BFFC7"><enum>(ii)</enum><text>the
			 Attorney General records, in writing, the fact that a qualified legal opinion
			 was issued to the President, person or entity in the executive branch, or
			 member of the Armed Forces, as applicable; and</text>
						</clause></subparagraph><subparagraph id="H99C027ED29C54F2880DC94909411C7C5"><enum>(B)</enum><text>at the earliest
			 possible date (but in no case later than the end of the seven-day period
			 beginning on the date that the opinion is issued), the Attorney General
			 reissues the qualified legal opinion in writing.</text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HFAAA588336F44149BDDA934D8C1F359"><enum>(b)</enum><header>Signatures
			 required</header>
				<paragraph id="H3994694D4313490A8232EAAE855FBBD"><enum>(1)</enum><header>In
			 general</header><text>If a qualified legal opinion contains a statement of
			 policy that authorizes or instructs any officer or employee of the executive
			 branch or a member of the Armed Forces to disregard or not enforce a statute or
			 an executive order, an employee or officer of the executive branch or a member
			 of the Armed Forces may not require any other employee or officer of the
			 executive branch or a member of the Armed Forces to follow the policy contained
			 in such legal opinion, unless such opinion is signed—</text>
					<subparagraph id="HA8124ED573A1487C92C39D070619E67F"><enum>(A)</enum><text>by the President
			 or the Attorney General; and</text>
					</subparagraph><subparagraph id="H8DC3F8C51A7B4F329B7D6C8295A871F6"><enum>(B)</enum><text>by an officer or
			 employee of the Office of Legal Counsel in the Department of Justice.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H373C0B7067034209B5FBCE8EB8E92BC7"><enum>(2)</enum><header>Delegation
			 prohibited</header><text>In no case is a signature by an individual other than
			 the President or the Attorney General sufficient to meet the requirements of
			 <internal-xref idref="HA8124ED573A1487C92C39D070619E67F" legis-path="4.(b)(1)(A)">paragraph (1)(A)</internal-xref>, even if—</text>
					<subparagraph id="H7D8A09F6F108417CBA0098868F4E7847"><enum>(A)</enum><text>such signature is
			 made on behalf of the President or Attorney General; or</text>
					</subparagraph><subparagraph id="H9549636FDB7D4D3EB5571E96023BEBDF"><enum>(B)</enum><text>such signature
			 results from a delegation of responsibility by the President or the Attorney
			 General to another individual.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" id="HD4AC928B082F4182B9D7846994216EE9"><enum>5.</enum><header>Government
			 Accountability Office Report</header>
			<subsection commented="no" id="HA74E2C8F77504E33B157B4538728B698"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Comptroller General of the
			 United States shall submit to Congress a report containing an evaluation of
			 performance of the Office of Legal Counsel in the Department of Justice during
			 the 25-year period ending on the date of enactment of this Act.</text>
			</subsection><subsection commented="no" id="H37C0EB7EDE03480092FE74DD13688843"><enum>(b)</enum><header>Contents</header><text>The
			 report under
			 <internal-xref idref="HA74E2C8F77504E33B157B4538728B698" legis-path="5.(a)">subsection (a)</internal-xref> shall contain, at a minimum,
			 the following:</text>
				<paragraph commented="no" id="HEB0FBBF5BF1949EB95F2A11F2D84A647"><enum>(1)</enum><text display-inline="yes-display-inline">The total number of legal opinions (as
			 defined in section 5) issued by the Office of Legal Counsel.</text>
				</paragraph><paragraph id="HA23FD6D35F214BECA17B7C7CCF33F812"><enum>(2)</enum><text>The total number
			 of legal opinions issued by the Office that are disclosed, in written form, to
			 the public, and the amount of time between the date a opinion is first issued
			 by the office and the date the opinion is disclosed to the public.</text>
				</paragraph><paragraph commented="no" id="H53AE14EECFCA4F52BC342CE85CA8C49"><enum>(3)</enum><text display-inline="yes-display-inline">The number of opinions issued by the Office
			 that are classified, in part or in full, and the basis for classifying each
			 opinion.</text>
				</paragraph><paragraph id="H93E9701D699C469CB28E70B6D62D221C"><enum>(4)</enum><text display-inline="yes-display-inline">The number of opinions issued by the Office
			 that are not disclosed to the public because of deliberative-process privilege,
			 executive privilege, attorney-work-product privilege,
			 attorney-client-privilege, or another type of privilege, and the nature of each
			 such privilege.</text>
				</paragraph><paragraph commented="no" id="H3A289A0D6D8B40F9005524BFE912B966"><enum>(5)</enum><text display-inline="yes-display-inline">An analysis of the role of the Office
			 within the Federal Government, including an assessment of how, if at all, the
			 role of the Office has changed over the course of the period described in
			 subsection (a).</text>
				</paragraph><paragraph id="H27905B659CD6479CB5F5AC7668A28864"><enum>(6)</enum><text>An analysis of the
			 interaction between the Office of Legal Counsel, the Office of White House
			 Counsel, and the Office of the Counsel to the Vice President.</text>
				</paragraph><paragraph id="H15F555A011FD4DEE9FD662CCB18938C1"><enum>(7)</enum><text>A
			 description of any information which the Comptroller General could not obtain
			 which was necessary to complete this report.</text>
				</paragraph></subsection><subsection id="HBA9E9597B73E48C1AEB964A1C4E78D62"><enum>(c)</enum><header>Form of
			 report</header><text display-inline="yes-display-inline">The Comptroller
			 General of the United States shall submit the report under
			 <internal-xref idref="HA74E2C8F77504E33B157B4538728B698" legis-path="5.(a)">subsection (a)</internal-xref> in an unclassified form and
			 may include a classified annex.</text>
			</subsection></section><section id="H5B40D5D677334EE580FBF7AD26634C68"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act, the following
			 definitions apply:</text>
			<paragraph id="HC97B213D396E4EAD001B82BC18388DD9"><enum>(1)</enum><header>Legal
			 opinion</header><text>The term <term>legal opinion</term> means an opinion
			 issued by the Office of Legal Counsel in the Department of Justice—</text>
				<subparagraph id="H82B85C909E84412E8453FF554CB412FE"><enum>(A)</enum><text>under sections 511
			 through 513 of title 28, United States Code;</text>
				</subparagraph><subparagraph id="HC668264E466E43FC8202A162AA88A9E9"><enum>(B)</enum><text>through a
			 delegation of authority under section 510 of such title;</text>
				</subparagraph><subparagraph id="HD4073B7B7138478F813E6628A540FD5D"><enum>(C)</enum><text>under section 0.25
			 of title 28, Code of Federal Regulations (or any successor regulations);
			 or</text>
				</subparagraph><subparagraph id="H87C875FD74C949919C64C1BE8F9B004C"><enum>(D)</enum><text display-inline="yes-display-inline">under or through any combination of
			 provisions listed in subparagraphs (A) through (C).</text>
				</subparagraph></paragraph><paragraph id="H4FF9637E3C4649888136E735AB6406EB"><enum>(2)</enum><header>Qualified legal
			 opinion</header><text display-inline="yes-display-inline">The term
			 <term>qualified legal opinion</term> means a legal opinion that contains a
			 policy described in subparagraph (A) of <external-xref legal-doc="usc" parsable-cite="usc/28/530D">section 530D(a)(1)</external-xref> of title 28, United
			 States Code, or an authoritative legal interpretation described in subparagraph
			 (D) of such section, or both.</text>
