		<official-title display="yes">To amend the Small Business Act to provide
		  low-interest loans to small business concerns providing transportation services
		  to assist them in dealing with high motor fuel prices.</official-title>

		<section id="H7CC02B2275F9482AB82232CA414FE80" section-type="section-one"><enum>1.</enum><header>Assistance to small
			 businesses engaged in providing transportation
			 services<editorial></editorial></header>
			<subsection id="H0823B3A7A2364C20AEC49ADE00D5C5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 7(b) of the
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended by inserting after paragraph
			 (9) the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HD4025F06CE5F45CA82CD1BD02D9052B2" style="OLC">
					<paragraph id="H67BC9FFF7E2F422B9EAC764BB1CAD454"><enum>(10)</enum><header>Fuel cost
				assistance for concerns engaged in providing transportation services</header>
						<subparagraph id="H0A50FC7E159D40F68CAA84EA891FF96C"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Administration
				may make disaster loans under this subsection (either directly or in
				cooperation with banks or other lending institutions through agreements to
				participate on an immediate or deferred basis) to assist an eligible small
				business concern that has suffered or that is likely to suffer substantial
				economic injury as the result of increases in the price of gasoline or diesel
				fuel.</text>
						</subparagraph><subparagraph id="H9222FD4497BF423197DDCB57633C6700"><enum>(B)</enum><header>Eligible small
				business concern</header><text>For purposes of this paragraph, the term
				<term>eligible small business concern</term> means any small business concern
				engaged in the transportation of persons or property for hire.</text>
						</subparagraph><subparagraph id="H1B448F30F4DC40699BA9DC65007D99AE"><enum>(C)</enum><header>Interest
				rate</header><text display-inline="yes-display-inline">Any loan or guarantee
				extended pursuant to this paragraph shall be made—</text>
							<clause id="HC8BEB3437979432F869BD5985FD1902"><enum>(i)</enum><text>without regard to
				whether the applicant is able to obtain credit elsewhere, and</text>
							</clause><clause id="H42FE937C92CE4EAEA5AE9E48A07C8B86"><enum>(ii)</enum><text>at the same
				interest rate as economic injury loans under paragraph (2).</text>
							</clause></subparagraph><subparagraph id="H7EE83D00AAA04F169788CC981F714722"><enum>(D)</enum><header>Maximum
				assistance</header><text>No loan may be made under this paragraph, either
				directly or in cooperation with banks or other lending institutions through
				agreements to participate on an immediate or deferred basis, if the total
				amount outstanding and committed to the borrower under this paragraph would
				exceed $250,000, unless such applicant constitutes, or have become due to
				changed economic circumstances, a major source of employment in its surrounding
				area, as determined by the Administration, in which case the Administration, in
				its discretion, may waive the $250,000 limitation.</text>
						</subparagraph><subparagraph id="HB4065F55799945D6A089F2F7D1009EC4"><enum>(E)</enum><header>No disaster
				declaration required</header><text>For purposes of assistance under this
				paragraph, no declaration of a disaster area shall be required.</text>
						</subparagraph><subparagraph id="H50964AD297B843CEA7E4E109D46BABD7"><enum>(F)</enum><header>Period loans are
				available</header><text>This paragraph shall apply to loans made during the
				2-year period beginning on the date of the enactment of this
				paragraph.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H52500F36C1B04E748692851418090090"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 4(c) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/633">15 U.S.C. 633(c)</external-xref>) is amended—</text>
				<paragraph id="HFFB0B093A7AD4945924B0798E9EE24E4"><enum>(1)</enum><text>by inserting
			 <quote>7(b)(10),</quote> after <quote>7(b)(4),</quote> in paragraph (1),
			 and</text>
				</paragraph><paragraph id="HA54A9203F202454984BA647567AC862B"><enum>(2)</enum><text>by inserting
			 <quote>7(b)(10),</quote> after <quote>7(b)(8),</quote> in paragraph (2).</text>
