		<section commented="no" id="HD3B52A3C579F4C37A62E924BB4D7D978" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>H.I.V. Education and Prevention Act of
			 2008</short-title></quote>.</text>
		</section><section id="H848CD51C39394C41B3516DC8833E1F74"><enum>2.</enum><header>Flexibility in
			 use of abstinence education funds</header>
			<subsection commented="no" id="H1F3F09AF082944A4A862F650420EB83"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 510 of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/710">42 U.S.C. 710</external-xref>) is amended—</text>
				<paragraph commented="no" id="HD967137B540341B1AEF633AB7E830072"><enum>(1)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="traditional">or other sex education</header-in-text></quote> after
			 <quote><header-in-text level="section" style="traditional">abstinence
			 education</header-in-text></quote>;</text>
				</paragraph><paragraph commented="no" id="H1987DE2E56A6481DB9639EB2366C78D0"><enum>(2)</enum><text>in subsection (b)
			 (1)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5EF4DDA00D6B46758E517F3DDDE2F619"><enum>(A)</enum><text>by inserting
			 <quote>(A)</quote> before <quote>abstinence education</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="H8125E308D0AC41A4B6C485D6D820F900"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, or (B) other sex
			 education</quote> after <quote>out-of-wedlock</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" id="H0A3ABB193E6E490594874F06A1487C1"><enum>(3)</enum><text>by adding at the
			 end of subsection (b) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H4941BD0FF73A43348BADFA568B7EBB41" style="OLC">
						<paragraph commented="no" id="HE6B4E4CB35F74658B9CD4F5F79334557"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>sex
				education</term> means education about the functional, structural, or
				behavioral aspects of human reproduction and may include education about
				abstinence or
				contraception.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H9196091B261C46BDA2BFC57638F0A6FB"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to funds
			 made available for fiscal year 2009 and each fiscal year thereafter.</text>
			</subsection></section><section id="H68B5FCE3BFF14FBB898FF88C2F005F28" section-type="subsequent-section"><enum>3.</enum><header>Pilot Program to
			 combine substance abuse treatment and prevention efforts</header><text display-inline="no-display-inline">Part D of title V of the Public Health
			 Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290dd">42 U.S.C. 290dd et seq.</external-xref>) is amended by adding at the end the
			 following new section:</text>
			<quoted-block display-inline="no-display-inline" id="H0A3F2E33C0B3443AA6BC34CE0068A128" style="OLC">
				<section id="H26093E1B79574BA88B99A36F5BAAB5CD"><enum>544.</enum><header>Pilot Program
				to combine substance abuse treatment and prevention efforts</header>
					<subsection id="H7777498B16714F64001928139287698E"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				establish a pilot program to make grants to public and nonprofit entities to
				provide the substance abuse and prevention services described in
				<internal-xref idref="HA5DC6B2ADE414CEF986979335DA03C04" legis-path="544.(b)">subsection (b)</internal-xref>.</text>
					</subsection><subsection id="HA5DC6B2ADE414CEF986979335DA03C04"><enum>(b)</enum><header>Use of
				funds</header><text>Grants provided under
				<internal-xref idref="H7777498B16714F64001928139287698E" legis-path="544.(a)">subsection (a)</internal-xref> may only be used to provide
				the following services:</text>
						<paragraph id="H1C04F9D3ED2C45B3B4F407DA8125DC75"><enum>(1)</enum><text>Substance abuse
				treatment services in the form of long-term counseling.</text>
						</paragraph><paragraph id="H6C62AD207F584C6D847CFCC2E9DB7084"><enum>(2)</enum><text>Substance abuse
				prevention services to individuals who are less than 21 years of age.</text>
						</paragraph><paragraph id="H11CF28AE61DD4832BCF36BD5ACE82C1C"><enum>(3)</enum><text>Services that
				facilitate interaction between individuals receiving treatment for substance
				abuse and individuals described in
				<internal-xref idref="H6C62AD207F584C6D847CFCC2E9DB7084" legis-path="544.(b)(2)">paragraph (2)</internal-xref> in a manner that enhances
				both the treatment services described in
				<internal-xref idref="H1C04F9D3ED2C45B3B4F407DA8125DC75" legis-path="544.(b)(1)">paragraph (1)</internal-xref> and the prevention
				services described in
				<internal-xref idref="H6C62AD207F584C6D847CFCC2E9DB7084" legis-path="544.(b)(2)">paragraph (2)</internal-xref>.</text>
						</paragraph></subsection><subsection display-inline="no-display-inline" id="H9D693D90EE67484C006774F946826B42"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">Before the Secretary may make a grant to an
				entity under
				<internal-xref idref="H7777498B16714F64001928139287698E" legis-path="544.(a)">subsection (a)</internal-xref>, the entity must submit an
				application to the Secretary at such time, in such manner, and containing such
				information as the Secretary may require.</text>
					</subsection><subsection id="H0593912150DF4D9698158340530435E1"><enum>(d)</enum><header>Federal
				share</header><text display-inline="yes-display-inline">The Federal share of
				the cost of carrying out the services described in
				<internal-xref idref="HA5DC6B2ADE414CEF986979335DA03C04" legis-path="544.(b)">subsection (b)</internal-xref> with a grant under this
				section shall not exceed 75 percent of such cost.</text>
					</subsection><subsection id="H5AF00112F79C428A99A5DEA4444A800"><enum>(e)</enum><header>Authorization of
				Appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this section $25,000,000 for fiscal
				years 2009 through
				2013.</text>
