		<section commented="no" display-inline="no-display-inline" id="H376FD85F884B4F14A6CE4814C8B0C800" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bruce Vento Ban Asbestos and Prevent
			 Mesothelioma Act of 2008</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H7E4D8CEAFF994EE3A75D4FD5F29D3323" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Asbestos-containing products</header>
			<subsection commented="no" display-inline="no-display-inline" id="H3F06A15AD17A492891FD275AD00D586"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Toxic Substances Control Act (15 U.S.C.
			 2601 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBC61A16F861F4E37AEB215CF60AEBD29" style="OLC">
					<title commented="no" id="HFEF9C1A850284387ACC5134CF00849B4" level-type="subsequent" style="OLC"><enum>VI</enum><header display-inline="yes-display-inline">Asbestos-Containing Products</header>
						<section commented="no" display-inline="no-display-inline" id="H936936BC499A41CE94A16761F0878875" section-type="subsequent-section"><enum>601.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>
							<paragraph id="H67C8D658C12D40488045B46DCFAA746C"><enum>(1)</enum><header>Asbestos</header><text>The
				term <quote>asbestos</quote> has the meaning given that term in section
				202(3).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE050890BF24E47669CB6AFA9FBA36334"><enum>(2)</enum><header display-inline="yes-display-inline">Asbestos-containing product</header><text display-inline="yes-display-inline">The term <term>asbestos-containing
				product</term> means any product (including any part) to which asbestos is
				deliberately added, or used, or in which asbestos is otherwise present in any
				concentration, except concentrations present solely from contamination
				from—</text>
								<subparagraph id="HB11A45D4D38944699E56CD4E15C91639"><enum>(A)</enum><text>ambient air;
				or</text>
								</subparagraph><subparagraph id="H0576670C54414024989BD2768714FF64"><enum>(B)</enum><text display-inline="yes-display-inline">water that complies with the Safe Drinking
				Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>) and the regulations issued under that
				Act.</text>
								</subparagraph></paragraph><paragraph id="H57EC0B09BB3A4EB9930000577B2191BC"><enum>(3)</enum><header>Cosmetic</header><text display-inline="yes-display-inline">The term <quote>cosmetic</quote> has the
				meaning given that term in section 201 of the Federal Food, Drug and Cosmetic
				Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5595861AA0F442E893EB82C5D4205F58"><enum>(4)</enum><header display-inline="yes-display-inline">Distribute in commerce</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="HFCAF2DFF34704181B4CF7FD59B29AB8E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>distribute in
				commerce</term> has the meaning given the term in section 3.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF8E9CB06C8394ACCACE134FB02D134F9"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusions</header><text display-inline="yes-display-inline">The term <term>distribute in
				commerce</term> does not include—</text>
									<clause commented="no" display-inline="no-display-inline" id="HED2076B68B4F436DAF2B3F3D1DB066EE"><enum>(i)</enum><text display-inline="yes-display-inline">the sale, introduction or delivery for
				introduction into commerce, or holding of an asbestos-containing product, or an
				interest in real property (and improvements thereon), by a person that is an
				end user;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H94ED7E5805754F699EB4FE49739B3110"><enum>(ii)</enum><text display-inline="yes-display-inline">the sale, introduction or delivery for
				introduction into commerce, or holding of an asbestos-containing product by a
				person solely for the purpose of disposal of the asbestos-containing product in
				compliance with applicable Federal, State, and local requirements; or</text>
									</clause><clause id="HE8DD6547E6AF4FCDBA81595E728C5D2D"><enum>(iii)</enum><text display-inline="yes-display-inline">the sale, introduction or delivery for
				introduction into commerce, or holding of a motor vehicle that was manufactured
				and sold before the date of enactment of this title and that has an
				asbestos-containing product installed in or on the motor vehicle.</text>
									</clause></subparagraph></paragraph><paragraph id="HCC613BA100794594AAD0D28B00753B76"><enum>(5)</enum><header>Drug</header><text display-inline="yes-display-inline">The term <quote>drug</quote> has the
				meaning given that term in section 201 of the Federal Food, Drug and Cosmetic
				Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text>
							</paragraph><paragraph id="HD56AF9F4AAC14D39A0A7207228B5F8BA"><enum>(6)</enum><header>Motor
				vehicle</header><text>The term <quote>motor vehicle</quote> has the meaning
				given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/30102">section 30102(a)(6)</external-xref> of title 49, United States Code.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2EBAA624539F4E10A15C81BCC52F7155"><enum>(7)</enum><header display-inline="yes-display-inline">Person</header><text display-inline="yes-display-inline">The term <term>person</term> means—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H0706AD844A744266AEE25EAB027949C"><enum>(A)</enum><text display-inline="yes-display-inline">any individual;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1C53C4DA3D6846EB94C9C21229ECB76E"><enum>(B)</enum><text display-inline="yes-display-inline">any trust, corporation (including a
				government corporation), company, association, firm, partnership, joint
				venture, sole proprietorship, or other for-profit or nonprofit business entity
				(including any manufacturer, importer, distributor, or processor);</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0A4FEA3120F44EEEAE29B603E302A733"><enum>(C)</enum><text display-inline="yes-display-inline">any Federal, State, or local department,
				agency, or instrumentality; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE816AEE42CF94412A36259B78E82B834"><enum>(D)</enum><text display-inline="yes-display-inline">any interstate body.</text>
								</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="HB860F5B220254056B54595E09D44E9D5" section-type="subsequent-section"><enum>602.</enum><header display-inline="yes-display-inline">Public education program</header>
							<subsection commented="no" display-inline="no-display-inline" id="HF4BE7687229046969CC9B031D93C600"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this title, the Administrator, in consultation with the Chairman
				of the Consumer Product Safety Commission, the Director of the Centers for
				Disease Control and Prevention, the Secretary of Labor, and other appropriate
				Federal agencies, shall establish a plan and initiate a program—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H4564FEF0CB6643E2AEE846580895E600"><enum>(1)</enum><text display-inline="yes-display-inline">to increase awareness of the dangers posed
				by—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HBE61B0E24B714AD497EFBF5A0FA32F6"><enum>(A)</enum><text display-inline="yes-display-inline">asbestos-containing products in homes and
				workplaces; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H904495959CAD467285F8819400978C4C"><enum>(B)</enum><text display-inline="yes-display-inline">asbestos-related diseases;</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H055007902692487A89804E1904E88FF1"><enum>(2)</enum><text display-inline="yes-display-inline">to provide current and comprehensive
				information to asbestos-related disease patients, family members of patients,
				and front-line health care providers on—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HB6C2B38AC32B496D8C983623486916C8"><enum>(A)</enum><text display-inline="yes-display-inline">the dangers of asbestos exposure;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H437D17990719411E90EB188200D38618"><enum>(B)</enum><text display-inline="yes-display-inline">asbestos-related labeling
				information;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE07CCC394E624852AE52063606F5553F"><enum>(C)</enum><text display-inline="yes-display-inline">health effects of exposure to
				asbestos;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA2B3FC3317DC4D210063B988661C954F"><enum>(D)</enum><text display-inline="yes-display-inline">symptoms of asbestos exposure; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCEE9D26E461A477200F4F638F86FB8D3"><enum>(E)</enum><text display-inline="yes-display-inline">available and developing treatments for
				asbestos-related diseases, including clinical trials;</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H71A2036325E449D083A222712C1DC922"><enum>(3)</enum><text display-inline="yes-display-inline">to encourage asbestos-related disease
				patients, family members of patients, and front-line health care providers to
				participate in research and treatment endeavors relating to asbestos;
				and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E94706CA13747F788E98689F0F674C4"><enum>(4)</enum><text display-inline="yes-display-inline">to encourage health care providers and
				researchers to provide to asbestos-related disease patients and family members
				of patients information relating to research, diagnostic, and clinical
				treatments relating to asbestos.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H12C87C561D0D4163A0AB89122DEC86ED"><enum>(b)</enum><header display-inline="yes-display-inline">Greatest
				risks</header><text display-inline="yes-display-inline">In establishing the
				program, the Administrator shall give priority to asbestos-containing products
				used by consumers and workers that present or will present the greatest risk of
				injury to human health.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H519452F78A134B8E9B506D9932B8E1D"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated such sums as are necessary to carry out this
				section.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="H988DC7E9766E4C3092EC004B1B969806" section-type="subsequent-section"><enum>603.</enum><header display-inline="yes-display-inline">Prohibition on asbestos-containing
				products</header>
							<subsection commented="no" display-inline="no-display-inline" id="H0176185F3EA74C21A0389879D850D163"><enum>(a)</enum><header display-inline="yes-display-inline">Prohibition</header>
								<paragraph id="H194CB4747E89404B8B0133ABD7376BA2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to subsection
				(b), no person shall import, manufacture, process, or distribute in commerce
				asbestos-containing products.</text>
								</paragraph><paragraph id="HA5D1BF7BD0DB4C3AAA8B77291F485F78"><enum>(2)</enum><header>Effective
				date</header><text display-inline="yes-display-inline">The prohibition under
				paragraph (1) shall take effect 2 years after the date of enactment of this
				title.</text>
								</paragraph></subsection><subsection id="HD17CC56F9046443ABDB8EEF7E0438C2F"><enum>(b)</enum><header>Exemptions</header>
								<paragraph id="H59F161BE3B1A4EC2BF59F039198F2CF7"><enum>(1)</enum><header>In
				general</header>
									<subparagraph id="H77CAF4BC06734E3500F820F5D9C6D7BB"><enum>(A)</enum><header>Petition</header><text display-inline="yes-display-inline">Any person may petition the Administrator
				for an exemption from the requirements of subsection (a) for an
				asbestos-containing product and the Administrator may grant, by rule, such an
				exemption if the Administrator finds that—</text>
										<clause id="H4EA79B655F4F4D2D89AD7DAC58B2C4F7"><enum>(i)</enum><text>the use of the
				asbestos-containing product will not present an unreasonable risk of injury to
				health or the environment;</text>
										</clause><clause id="H905CE79A6BB64113AED0526BE0A9FB50"><enum>(ii)</enum><text>there is no
				alternative to the asbestos-containing product that is the subject of the
				petition; and</text>
										</clause><clause id="H8F35B033316B45D5A5C4CED8B3AA29B9"><enum>(iii)</enum><text>the use of the
				asbestos-containing product is in compliance with all Federal and State laws
				and regulations.</text>
										</clause></subparagraph><subparagraph id="H2227A0BE1F954682975FF159C203277E"><enum>(B)</enum><header>Terms and
				conditions</header><text>An exemption granted under this paragraph shall be in
				effect for such period (not to exceed a total of 3 years) and subject to such
				terms and conditions as the Administrator may prescribe.</text>
									</subparagraph><subparagraph id="H25DE601E27C345DC8BA2AD05BF4ECD53"><enum>(C)</enum><header>Information on
				users</header><text>Any person seeking an exemption under this paragraph from
				the requirements of subsection (a) for an asbestos-containing product shall
				include in the petition to the Administrator the names of any manufacturer,
				importer, distributor, or processor of the asbestos-containing product known to
				the person seeking the exemption at the time of submission of the
				petition.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB0EAF6054FC144A2895332B43CFA990"><enum>(2)</enum><header display-inline="yes-display-inline">Governmental use</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="HB6B6FCD24E3F4EE4BA2FFDADD3FE0048"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An exemption from the requirements of
				subsection (a) shall apply, only to the extent necessary for the critical
				functions described in a certification provided under clause (i) or (ii), if
				the exemption is—</text>
										<clause commented="no" display-inline="no-display-inline" id="H37E72A5C43094A4CACF336839CEF30A2"><enum>(i)</enum><text display-inline="yes-display-inline">sought by the Secretary of Defense, and the
				Secretary provides a copy of a certification to the Administrator and Congress
				that—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H7DD5BCB6EBC94D38958476988D00FE00"><enum>(I)</enum><text display-inline="yes-display-inline">describes the scope of each use of the
				asbestos-containing product, and certifies that each use is necessary to the
				critical functions of the Department of Defense;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H105FB700F48B45B3ACD7E434E2190053"><enum>(II)</enum><text display-inline="yes-display-inline">certifies that no reasonable alternatives
				to the asbestos-containing product exist for the intended uses;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HAE0138C37A6947F9BFB2FE7DC60055E3"><enum>(III)</enum><text display-inline="yes-display-inline">certifies that use of the
				asbestos-containing product will not present an unreasonable risk of injury to
				health or the environment; and</text>
											</subclause><subclause id="H3AEEEA9FCE6A4DF3A46821A11B3214C9"><enum>(IV)</enum><text>certifies that
				the use of the asbestos-containing product is in compliance with all Federal
				laws and regulations; or</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC9EF60513C6D44C5ACEF9364C28CEAFB"><enum>(ii)</enum><text display-inline="yes-display-inline">sought by the Administrator of the National
				Aeronautics and Space Administration, and the Administrator of the National
				Aeronautics and Space Administration provides a copy of a certification to the
				Administrator and Congress that—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H36E1114119964696B9BE267CEF77EB7"><enum>(I)</enum><text display-inline="yes-display-inline">certifies that the asbestos-containing
				product is necessary to the critical functions of the National Aeronautics and
				Space Administration;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H675561FDAFF74180BDA008C4C5156D92"><enum>(II)</enum><text display-inline="yes-display-inline">certifies that no reasonable alternatives
				to the asbestos-containing product exist for the intended use;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HBD226EFBB35F423AA1461BC9A1F64742"><enum>(III)</enum><text display-inline="yes-display-inline">certifies that the use of the
				asbestos-containing product will not present an unreasonable risk of injury to
				health or the environment; and</text>
											</subclause><subclause id="HC85201EAC6F0420FAD56CCA520E7EEA2"><enum>(IV)</enum><text display-inline="yes-display-inline">certifies that the use of the
				asbestos-containing product is in compliance with all Federal laws and
				regulations.</text>
											</subclause></clause></subparagraph><subparagraph id="H7D42819319DB4F7885529E007EAF4999"><enum>(B)</enum><header>Contents</header><text>A
				certification required under subparagraph (A) shall include a description of
				the critical functions, and shall identify any authorized manufacturer,
				importer, distributer, or contract-authorized user of the exemption on behalf
				of the Department of Defense or the National Aeronautics and Space
				Administration.</text>
									</subparagraph><subparagraph id="H1F7A0218F3084E6DAFF149A64C4672C"><enum>(C)</enum><header>Limitation</header><text display-inline="yes-display-inline">A certification under this paragraph shall
				not be effective for more than 5 years, unless the Secretary of Defense or the
				Administrator of the National Aeronautics and Space Administration recertifies
				within 5 years after a prior certification.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H432E07402E9D48B9B2A09DD9F69765E3"><enum>(3)</enum><header display-inline="yes-display-inline">Diaphragms for existing chlor-alkali
				electrolysis installations</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="H1F2F889B8B744DD584B89626EA291CAB"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The requirements of subsection (a) shall
				not apply to any chlor-alkali electrolysis installation in existence and using
				asbestos diaphragms as of the date of enactment of this title, or to caustic
				soda produced at such an installation that contains asbestos in an amount less
				than .01 percent.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5FE2C7D23D1D49E5897169823522BAD7"><enum>(B)</enum><header display-inline="yes-display-inline">Review</header>
										<clause commented="no" display-inline="no-display-inline" id="H661162F28DCE4092A5003E7DC69FA957"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, and every 6 years thereafter, the Administrator shall
				review the exemption provided under subparagraph (A) to determine the
				appropriateness of the exemption.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HF0A3EAA5A3A64522BA546930ADF10937"><enum>(ii)</enum><header display-inline="yes-display-inline">Scope</header><text display-inline="yes-display-inline">In conducting the review of the exemption
				provided under subparagraph (A), the Administrator shall examine whether the
				chlor-alkali electrolysis installation presents or will present an unreasonable
				risk of injury to health or the environment, including the risk of injury to an
				individual relating to the operation by the individual of each chlor-alkali
				electrolysis installation described in subparagraph (A).</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H8CA03FE2337847D8B2CD004000D54DEE"><enum>(iii)</enum><header display-inline="yes-display-inline">Public participation</header><text display-inline="yes-display-inline">In conducting the review of the exemption
				provided under subparagraph (A), the Administrator shall provide public notice
				and a 30-day period of public comment.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC0567C845053459E9FA3C32C8C54072C"><enum>(C)</enum><header display-inline="yes-display-inline">Decision relating to extension of
				exemption</header><text display-inline="yes-display-inline">Upon completion of
				a review of a chlor-alkali electrolysis installation under subparagraph (B)(i),
				if the Administrator determines that the chlor-alkali electrolysis installation
				presents or will present an unreasonable risk of injury to health or the
				environment, the Administrator shall terminate the exemption provided to the
				electrolysis installation under subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="H18383D6AD10D4FAB00808CA1A9F0372C"><enum>(4)</enum><header>Aggregate
				products</header>
									<subparagraph id="HDE2EB1EBF211401EA7B9607F19E2DE59"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subsection (a)(1)
				shall not apply to aggregate products (extracted from stone, sand, or gravel
				operations) that—</text>
										<clause id="H2CFF35E45DED438BB6D26F68053B52BE"><enum>(i)</enum><text>are imported,
				manufactured, processed, or distributed in commerce for the uses described in
				subparagraph (D) of this paragraph; and</text>
										</clause><clause id="HE33A5DF209624AFF9500162C82AD6EC"><enum>(ii)</enum><text>have been tested
				using a test method established under subparagraph (B) and determined to have
				an asbestos content that is less than—</text>
											<subclause id="H60C3C8E9A7C04E98BED9CEA73CDE0A6"><enum>(I)</enum><text>0.25 percent;
				or</text>
											</subclause><subclause id="H24D0CAD84C424C1B91608019BD438028"><enum>(II)</enum><text>if a lower
				asbestos content level has been established by the Administrator under
				subparagraph (C), such level.</text>
											</subclause></clause></subparagraph><subparagraph id="H3F1C7656B1D640A4885E7DB446547DD9"><enum>(B)</enum><header>Asbestos test
				method</header><clause commented="no" display-inline="yes-display-inline" id="H69FA517D304347AC8F31183FAA52FB42"><enum>(i)</enum><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this title, the Administrator shall issue guidance establishing
				the test method, including the sampling frequency, for purposes of compliance
				with this paragraph. In developing the test method under this clause, the
				Administrator shall evaluate and take into account—</text>
											<subclause id="HA1FE231307E544F9848C4ECEF72C5846" indent="up1"><enum>(I)</enum><text>the most accurate and precise test
				methods for sampling and analysis of asbestos-containing aggregate products;</text>
											</subclause><subclause id="H260E240FF72E4AEB8C21FF1212412113" indent="up1"><enum>(II)</enum><text>actual and potential human exposures to
				asbestos-containing aggregate products; and</text>
											</subclause><subclause id="HD341564173C1412C8812A2267E269BFB" indent="up1"><enum>(III)</enum><text>activity-based monitoring of
				asbestos-containing aggregate products.</text>
											</subclause></clause><clause id="H5F1C013B0E02424C0011CA244F81C68" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this title, and at least every 3 years thereafter, the
				Administrator shall promulgate final regulations establishing the test method,
				including the sampling frequency, for purposes of compliance with this
				paragraph. In establishing the test method under this clause, the Administrator
				shall evaluate and take into account the factors described in clause (i)(I)
				through (III).</text>
										</clause><clause id="HCC6FB3C9D8454864B9FD01AC41C9CD3E" indent="up1"><enum>(iii)</enum><text>No person shall import or
				distribute in commerce any aggregate product (extracted from stone, sand, or
				gravel operations) unless a test has been performed on the product using the
				test method established under this subparagraph.</text>
										</clause></subparagraph><subparagraph id="H4B94FACC446C45C993AEF4614C4B689"><enum>(C)</enum><header>Review and
				revision of content level</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this title, and at least
				every 3 years thereafter, the Administrator shall review the currently
				effective asbestos content level under subparagraph (A)(i)(I) or (II) and
				determine whether the level for aggregate products results in asbestos
				exposures that are not protective of human health and the environment. If the
				Administrator determines that the asbestos content level results in exposures
				that are not protective of human health and the environment, the Administrator
				shall promulgate regulations establishing a lower asbestos content level within
				3 years of the Administrator’s determination.</text>
									</subparagraph><subparagraph id="H70CCBF85A3ED4B2088F84798C7566B9B"><enum>(D)</enum><header>Uses for
				exempted aggregate products</header><text display-inline="yes-display-inline">Aggregate products are exempted under
				subparagraph (A) only to the extent that they are imported, manufactured,
				processed, or distributed in commerce for use—</text>
										<clause id="H3302CC37569F4F45AAAD77E448192289"><enum>(i)</enum><text>as
				an integral part of asphalt concrete;</text>
										</clause><clause id="H00C9B12436284E6EA53F8415F559733E"><enum>(ii)</enum><text>as an integral
				part of Portland cement concrete; or</text>
										</clause><clause id="HFEDDC0D353DC4D40838E275DEFCC7C5D"><enum>(iii)</enum><text>as an integral
				part of other similarly cemented materials.</text>
										</clause></subparagraph><subparagraph id="H19F752D435194F8DBC626BABFA00B75E"><enum>(E)</enum><header>Receipt to
				recipient</header><text>Any person who imports, manufactures, processes, or
				distributes in commerce aggregate products exempted pursuant to this paragraph
				shall provide to each recipient of such products a written receipt that
				includes the following information:</text>
										<clause id="H346B769C869243B98DF8D69F4E98FDC0"><enum>(i)</enum><text>The amount of such
				products provided to the recipient.</text>
										</clause><clause id="HB94FA64A72CD490388F6349C755D7B08"><enum>(ii)</enum><text display-inline="yes-display-inline">The date the products were provided to the
				recipient.</text>
										</clause><clause id="HE6574FC2149D477D836CCE39CC198EF1"><enum>(iii)</enum><text display-inline="yes-display-inline">A certification that the products have been
				tested pursuant to this paragraph and determined to have an asbestos content of
				less than the currently effective asbestos content level under subparagraph
				(A)(i)(II) or (II).</text>
										</clause></subparagraph></paragraph><paragraph id="H94407D8DBB4E4BA6B000CB5B00CA9D9C"><enum>(5)</enum><header>Calcium
				Carbonate, Olivine, Talc, Vermiculite, and Wollastonite</header>
									<subparagraph id="H16957C3D347C4AD1B2751FF43500C0DC"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subparagraph (D), subsection (a)(1) shall not apply to calcium carbonate,
				olivine, talc, vermiculite, and wollastonite, including any product containing
				calcium carbonate, olivine, talc, vermiculite, or wollastonite, that has been
				tested using a test method established under subparagraph (B) and determined to
				have an asbestos content that is less than—</text>
										<clause id="H2E53504A4B21448D851E23379464BEDC"><enum>(i)</enum><text>0.001 percent; or</text>
										</clause><clause id="HDEF88270FBD64F45A6FFE4876CAF003D"><enum>(ii)</enum><text>if a lower
				asbestos content level has been established by the Administrator under
				subparagraph (C), such level.</text>
										</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H6EF8A1CDF22D4E949ED916BEDA334498"><enum>(B)</enum><header>Asbestos test
				method</header><clause commented="no" display-inline="yes-display-inline" id="H627DF0F6B328447DB171D1FE904BA385"><enum>(i)</enum><text>Not
				later than 1 year after the date of enactment of this title, the Administrator
				shall issue guidance establishing the test method, including the sampling
				frequency, for purposes of compliance with this paragraph. In developing the
				test method under this clause, the Administrator shall evaluate and take into
				account—</text>
											<subclause id="H4C98C61923DF4983BAA700BCE32FB7F0" indent="up1"><enum>(I)</enum><text>the most accurate and precise test
				methods for sampling and analysis of asbestos-containing calcium carbonate,
				olivine, talc, vermiculite, and wollastonite;</text>
											</subclause><subclause id="H202EDF96DD5546929CB6575EC7313648" indent="up1"><enum>(II)</enum><text>actual and potential human exposures to
				asbestos-containing calcium carbonate, olivine, talc, vermiculite, and
				wollastonite; and</text>
											</subclause><subclause id="H93169E7756F0406C92279802CC7BA28D" indent="up1"><enum>(III)</enum><text>activity-based monitoring of
				asbestos-containing calcium carbonate, olivine, talc, vermiculite, and
				wollastonite.</text>
											</subclause></clause><clause id="HB4EBD459D7D248EF949F0057217C3977" indent="up1"><enum>(ii)</enum><text>Not later than 3 years after the
				date of enactment of this title, the Administrator shall promulgate final
				regulations establishing the test method, including the sampling frequency, for
				purposes of compliance with this paragraph. In establishing the test method
				under this clause, the Administrator shall evaluate and take into account the
				factors described in clause (i)(I) through (III).</text>
										</clause><clause id="H95260953345C47DFBFD6D39221F05C3" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">Not later than 3 years after the date of
				promulgation of final regulations under clause (ii), and at least every 3 years
				thereafter, the Administrator shall evaluate the currently effective test
				method established under those regulations to determine whether the test method
				should be revised, taking into account the factors described in clause (i)(I)
				through (III). If the Administrator determines that the test method should be
				revised, the Administrator shall promulgate regulations establishing a new test
				method for purposes of compliance with this paragraph.</text>
										</clause><clause id="HD0ECD37E2EC844C18E6F83CB32F9DCEB" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">No person shall import or distribute in
				commerce any calcium carbonate, olivine, talc, vermiculite, or wollastonite
				unless it has been tested using the test method established under this
				subparagraph.</text>
										</clause></subparagraph><subparagraph id="HCED2C879F9C94DC1BE4CB907506CF0C"><enum>(C)</enum><header>Review and
				revision of content level</header><text display-inline="yes-display-inline">Not
				later than 3 years after the date of enactment of this title, and at least
				every 3 years thereafter, the Administrator shall review the asbestos content
				level under subparagraph (A)(i) or (ii) for calcium carbonate, olivine, talc,
				vermiculite, and wollastonite and determine whether the level is protective of
				human health and the environment. If the Administrator determines that the
				asbestos content level is not protective of human health and the environment,
				the Administrator shall promulgate regulations establishing a lower asbestos
				content level.</text>
									</subparagraph><subparagraph id="H4C8079962EA14371BC3F45E9BB686617"><enum>(D)</enum><header>Prohibited
				uses</header><text display-inline="yes-display-inline">Notwithstanding
				subparagraph (A) and any other provision of this Act, subsection (a)(1) shall
				apply to asbestos-containing calcium carbonate, olivine, talc, vermiculite, and
				wollastonite imported, manufactured, processed, or distributed in commerce for
				use in, or for processing—</text>
										<clause id="H49BE55BFC368458E008D004223934EB1"><enum>(i)</enum><text>food that is
				intended for human consumption;</text>
										</clause><clause id="H026E2D2508214221B6F9346E000765AB"><enum>(ii)</enum><text display-inline="yes-display-inline">products used by individuals for personal
				health or cosmetic reasons, including soaps and shampoos;</text>
										</clause><clause id="H3585B67541A54E3D8D49B7CD00E3EC37"><enum>(iii)</enum><text>drugs for use
				with respect to humans;</text>
										</clause><clause id="HCAD8B845A9AF4785B48126181E969210"><enum>(iv)</enum><text>consumer garden
				products;</text>
										</clause><clause id="HE2F88E6C6B6E43028B92FDB63368F2EE"><enum>(v)</enum><text>cosmetics;</text>
										</clause><clause id="H78E8321C258A4A8C8F80196668D76EB6"><enum>(vi)</enum><text>products designed
				or intended primarily for use by children 12 years of age or younger; or</text>
										</clause><clause id="H97F7F0B141B44F78981B17BB66C7252E"><enum>(vii)</enum><text display-inline="yes-display-inline">any other product with respect to which the
				Administrator has determined the presence of asbestos-containing calcium
				carbonate, olivine, talc, vermiculite, or wollastonite endangers human health
				or the environment.</text>
										</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H0F7C2BBA49144B25AAC6D9E7B1C49974"><enum>(E)</enum><header>Receipt to
				recipient</header><text>Any person who imports, manufactures, processes, or
				distributes in commerce calcium carbonate, olivine, talc, vermiculite, or
				wollastonite exempted pursuant to this paragraph shall provide to each
				recipient of such mineral products a written receipt that includes the
				following information:</text>
										<clause id="H4785F262FB044030BEA276924E459C3E"><enum>(i)</enum><text>The amount of such
				mineral products provided to the recipient.</text>
										</clause><clause id="H06C6770489EA49ECB2ABC0AF45571CF7"><enum>(ii)</enum><text>The date the
				mineral products were provided to the recipient.</text>
										</clause><clause id="H02CE24B4426F44DAAF6C920000CB1368"><enum>(iii)</enum><text>A certification
				that the mineral products have been tested pursuant to this paragraph and
				determined to have an asbestos content of less than the currently effective
				asbestos content level under subparagraph (A)(i) or (ii), which shall include a
				statement indicating the asbestos content level found through such
				tests.</text>
										</clause></subparagraph><subparagraph id="H11E0A3B0EE5A4FC4802931B53487C508"><enum>(F)</enum><header>Additional
				minerals</header><text display-inline="yes-display-inline">The Administrator
				may, by rule, add an additional mineral to the list of minerals subject to this
				paragraph if the Administrator determines that any mined deposit of the mineral
				is associated with asbestos.</text>
									</subparagraph></paragraph><paragraph id="H77BA3B34003D4A23A52BB45E878FA147"><enum>(6)</enum><header>Taconite
				pellets</header><text>Subsection (a)(1) shall not apply to taconite pellets or
				iron ore that will be used to produce taconite pellets. The exemption under
				this paragraph shall not apply to tailings, waste material, or other byproducts
				of iron ore extraction.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDD26B66BFE314DB0A3EF637FB490E53C"><enum>(c)</enum><header display-inline="yes-display-inline">Disposal</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H965DFE378D8A4069BCA6CE9ABB9D2D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not
				later than 3 years after the date of enactment of this title, each person that
				is subject to the prohibition established under this section that possesses an
				asbestos-containing product shall dispose of the asbestos-containing product,
				by a means that is in compliance with applicable Federal, State, and local
				requirements.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H56A236CF2C5E402DA2268DB5606BFF33"><enum>(2)</enum><header display-inline="yes-display-inline">Exemption</header><text display-inline="yes-display-inline">Nothing in paragraph (1) requires that an
				asbestos-containing product be removed or replaced.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8E0EBF354A5B455AA5D1F5FC48DD9308"><enum>(d)</enum><header display-inline="yes-display-inline">Compliance testing</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H1ADE2463A6CD420A90A473951075854E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with paragraph (2), not later
				than 1 year after the date on which the prohibition takes effect under
				subsection (a), and annually thereafter, to ensure compliance with this
				section, the Administrator shall carry out tests on an appropriate quantity of
				products, as determined by the Administrator, to determine if the products are
				asbestos-containing products.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H58A216CE78334F1F91F4D100109929D"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate test
				methodologies</header><text display-inline="yes-display-inline">In carrying out
				the compliance testing under paragraph (1), the Administrator shall use the
				appropriate test methodology for each product that is the subject of the
				compliance testing.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7901DBCFE767400EA7B454FA13473534"><enum>(3)</enum><header display-inline="yes-display-inline">Annual report</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="H3459E24F59F040CFA71DB99DB520C1C5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Upon completion of each annual testing
				period described in paragraph (1), the Administrator shall prepare a report for
				the annual testing period covered by the report, describing those products that
				are asbestos-containing products.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H07675552EE7342BFA3AB97CE9303AE9B"><enum>(B)</enum><header display-inline="yes-display-inline">Public availability</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				completion of each annual testing period described in paragraph (1), the
				Administrator shall make the report for the annual testing period covered by
				the report available to the public.</text>
									</subparagraph></paragraph></subsection><subsection id="H68130FF72A6E4FC3A133B92D03F9886"><enum>(e)</enum><header>Savings
				clause</header><text>Except as specifically provided in this title, nothing in
				this title shall be construed to override, change, or otherwise affect the
				obligations of any person, including a Federal agency, to comply with the
				regulations contained in part 763 of title 40 of the Code of Federal
				Regulations.</text>
							</subsection></section><section id="H300B78B7BF8E4F1799CF4857EC8A1E4"><enum>604.</enum><header>Criminal
				penalty</header><text display-inline="no-display-inline">Notwithstanding
				section 16(b), any person who knowingly or willfully violates any provision of
				this title shall, in addition to or in lieu of any civil penalty which may be
				imposed under section 16(a) for such violation, be subject, upon conviction, to
				a fine of not more than $25,000 for each day of violation, or to imprisonment
				for not more than 5 years, or both.</text>
						</section><section id="HD053A5C0274743B7007613EFF6DDB35B"><enum>605.</enum><header>Citizen
				petitions</header>
							<subsection id="H3118BAE77E6C452DBCA24FA15C9BD4AC"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Any person may
				petition the Administrator to initiate a proceeding for the issuance,
				amendment, or repeal of a rule or order under this title.</text>
							</subsection><subsection id="HA739828AF4C24D6CB7BB813BA038EE7B"><enum>(b)</enum><header>Filing and
				contact</header><text display-inline="yes-display-inline">Such petition shall
				be filed in the principal office of the Administrator and shall set forth the
				facts which it is claimed establish that it is necessary to issue, amend, or
				repeal a rule or order under this title.</text>
							</subsection><subsection id="H59743FBED1054EDDA8C8E11FC26BD8"><enum>(c)</enum><header>Hearing or
				investigation</header><text>The Administrator may hold a public hearing or may
				conduct such investigation or proceeding as the Administrator deems appropriate
				in order to determine whether or not such petition should be granted.</text>
							</subsection><subsection id="H6B21DC9D86254535BFF60099CEE7E600"><enum>(d)</enum><header>Granting or
				denial</header><text display-inline="yes-display-inline">Within 90 days after
				filing of a petition described in subsection (a), the Administrator shall
				either grant or deny the petition. If the Administrator grants such petition,
				the Administrator shall promptly commence an appropriate proceeding in
				accordance with this title. If the Administrator denies such petition, the
				Administrator shall publish in the Federal Register the Administrator's reasons
				for such denial. The granting or denial of a petition under this subsection
				shall not affect any deadline or other requirement of this title.</text>
							</subsection></section><section id="H30605777513649FC93722670F9AAF4F8"><enum>606.</enum><header>State and
				Federal law</header>
							<subsection id="HBD823BF66E4B4D4992FF1E00C048B3E0"><enum>(a)</enum><header>No
				preemption</header><text display-inline="yes-display-inline">Nothing in this
				title or any regulation issued under this title shall be construed,
				interpreted, or applied to—</text>
								<paragraph id="H63801E23B63F44609298B782FE00A16D"><enum>(1)</enum><text>preempt, displace,
				or supplant any other State or Federal law, whether statutory or common, or any
				action based on such a law; or</text>
								</paragraph><paragraph id="H2C7870C664E34E14B9B6C812DED1AE6E"><enum>(2)</enum><text>preempt a State
				from establishing any additional liability or more stringent requirements with
				respect to asbestos within such State.</text>
								</paragraph></subsection><subsection id="H14B45903E7DF45DDA4E7EE75907CE58C"><enum>(b)</enum><header>No Federal Cause
				of Action</header><text display-inline="yes-display-inline">Nothing in this
				title creates a cause of action, or in any other way increases or diminishes
				the liability of any person, under any other law.</text>
							</subsection><subsection id="H3CC15718FEBD4F0A9795BEBD5AEB3BF"><enum>(c)</enum><header>Intent of
				Congress</header><text display-inline="yes-display-inline">It is not the intent
				of Congress that this title or rules, regulations, or orders issued pursuant to
				this title be interpreted as influencing, in either the plaintiff's or
				defendant's favor, the disposition of any civil action for damages relating to
				asbestos.</text>
							</subsection><subsection id="H0477FDF8856B40F2AEB966825CE2B7DE"><enum>(d)</enum><header>Drinking
				water</header><text>Nothing in this title shall be construed, interpreted, or
				applied to prohibit the importation, manufacture, processing, or distribution
				in commerce of drinking water in a manner that complies with the requirements
				of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>) and regulations issued
				under that
				Act.</text>
							</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H89408D41BC65427292EBFBF5E92ECF88"><enum>(b)</enum><header>Definition
			 amendments</header><text display-inline="yes-display-inline">Section 202(3) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2642">15 U.S.C. 2642(3)</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HE887A3E784194483901D26CD6497A9CC"><enum>(1)</enum><text display-inline="yes-display-inline">in each of subparagraphs (A) through (D),
			 by striking the commas at the end of the subparagraphs and inserting
			 semicolons;</text>

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA9AD16DB56434F60AC0405BE1F4783D8"><enum>(c)</enum><header display-inline="yes-display-inline">Conforming amendments</header><paragraph commented="no" display-inline="yes-display-inline" id="H9297B3937DAE4228ADDF92724930F090"><enum>(1)</enum><text display-inline="yes-display-inline">The table of contents in sections 1 of the
			 Toxic Substances Control Act (15 U.S.C. prec. 2601) is amended by adding at the
			 end the following:</text>
