		<official-title>To provide for accelerated approval by the Nuclear
		  Regulatory Commission of certain licenses for nuclear power plants, and for
		  other purposes.</official-title>

		<section id="H9B35B9AA17C9482CA3C3109734C82D06" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fast Track Nulcear Act of
			 2008</short-title></quote>.</text>
		</section><section id="H92E2A66EBE7D428500B8739F49286369" section-type="subsequent-section"><enum>2.</enum><header>Accelerated approval
			 procedures</header><text display-inline="no-display-inline">The Nuclear
			 Regulatory Commission shall approve or deny an application for a license under
			 section 103 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref>) not later than 1
			 year after receipt of the application if—</text>
			<paragraph id="H47D465FDF0214BDA8BD2E6DA658B0658"><enum>(1)</enum><text>the application
			 incorporates a facility design that has been approved by the Commission;</text>
			</paragraph><paragraph id="H9413918CD59C44999E1000E94995A3D4"><enum>(2)</enum><text display-inline="yes-display-inline">the facility will be built by a company
			 with a proven history of building safe and efficient power plant facilities;
			 and</text>
			</paragraph><paragraph id="HB423BF17FE3E4C7A8483B4D7B9B12B0"><enum>(3)</enum><text>an
			 appropriate authority from the local jurisdiction within which the facility is
			 proposed to operate has transmitted to the Commission a request for approval of
			 the license application.</text>
			</paragraph></section><section id="HAFB1DDB12664411E8B4BB84DA0FE0000"><enum>3.</enum><header>Effect of
			 approval</header><text display-inline="no-display-inline">The construction and
			 operation of a facility pursuant to a license approved under section 2 shall
			 not be subject to challenge or delay under the Endangered Species Act, the
			 National Environmental Policy Act of 1969, or any other Federal or State
			 environmental law.</text>
		</section><section id="HF4AE6E5C68624DBEA4001017B3F5E65C"><enum>4.</enum><header>Innovative design
			 research</header><text display-inline="no-display-inline">There are authorized
			 to be appropriated to the Secretary of Energy such sums as may be necessary for
			 research, to be carried out through the Los Alamos and Sandia National
			 Laboratories, on new and innovative designs for nuclear facilities that—</text>
			<paragraph id="H1B2CA5E1AB464FC092FDD8699DA260AC"><enum>(1)</enum><text display-inline="yes-display-inline">produce more energy than current
			 designs;</text>
			</paragraph><paragraph id="H22A428A61000433394A9E2A469CC8916"><enum>(2)</enum><text>reduce output
			 nuclear waste; and</text>
			</paragraph><paragraph id="HBC04E132F614480B82BA480327A8622"><enum>(3)</enum><text>increase safety
			 features.</text>
