			 guardianship assistance payments for children</header>
				<subsection id="H8ACA6BD1B7434FDCB598C2F480AE79C4"><enum>(a)</enum><header>State plan
			 option</header><text>Section 471(a) of the Social Security Act (42 U.S.C.
			 671(a)) is amended—</text>
					<paragraph id="H19B1527685EE4981839D7101DA91C646"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (26);</text>
					</paragraph><paragraph id="H92B6779E633846BCA46C24A797C73B00"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (27) and inserting <quote>; and</quote>;
			 and</text>
					</paragraph><paragraph id="HF130BF42F6D24842A3E0BB37F9761839"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H763DF4F2CC6C48D083B0D0E32CC5BDD3" style="OLC">
							<paragraph id="H6FB0B5B4FCE5406596E430E8D9EBFBC8"><enum>(28)</enum><text>at the option of
				the State, provides for the State to enter into kinship guardianship assistance
				agreements to provide kinship guardianship assistance payments on behalf of
				children to grandparents and other relatives who have assumed legal
				guardianship of the children for whom they have cared as foster parents and for
				whom they have committed to care on a permanent basis, as provided in section
				473(d).</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H5018490C04444A5389CB51B0ECC2486"><enum>(b)</enum><header>In
			 general</header><text>Section 473 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673</external-xref>) is amended by
			 adding at the end the following:</text>
					<quoted-block id="HAAFF9B670D4C4CE1852126CA74950095" style="OLC">
						<subsection id="H623F15B46E4F43CDB5E63C1551D71E46"><enum>(d)</enum><header>Kinship
				guardianship assistance payments for children</header>
							<paragraph id="H38F7F25FED3743AC96F42C5C9DAF71C4"><enum>(1)</enum><header>Kinship
				guardianship assistance agreement</header>
								<subparagraph id="H720C68246388415EAB8754019C6BC19E"><enum>(A)</enum><header>In
				general</header><text>In order to receive payments under section 474(a)(5), a
				State shall—</text>
									<clause id="H91ADA78937AD4C0600FEFC0042E9337B"><enum>(i)</enum><text>negotiate and
				enter into a written, binding kinship guardianship assistance agreement with
				the prospective relative guardian of a child who meets the requirements of this
				paragraph; and</text>
									</clause><clause id="HE77D4375436C4AD0B3996554EE24CCCC"><enum>(ii)</enum><text>provide the
				prospective relative guardian with a copy of the agreement.</text>
									</clause></subparagraph><subparagraph id="H607DD08D9DD447178168EE9B251941F9"><enum>(B)</enum><header>Minimum
				requirements</header><text>The agreement shall specify, at a minimum—</text>
									<clause id="H047D6F1892C7437DA238F080F842399D"><enum>(i)</enum><text>the amount of, and
				manner in which, each kinship guardianship assistance payment will be provided
				under the agreement, and the manner in which the payment may be adjusted
				periodically, in consultation with the relative guardian, based on the
				circumstances of the relative guardian and the needs of the child;</text>
									</clause><clause id="H545647BAF170439CB6B41DD6D289F656"><enum>(ii)</enum><text>the additional
				services and assistance that the child and relative guardian will be eligible
				for under the agreement;</text>
									</clause><clause id="H15643A4AFDE1467995BC82D6F090E547"><enum>(iii)</enum><text>the procedure by
				which the relative guardian may apply for additional services as needed;
				and</text>
									</clause><clause id="H3016224E642F47C8BED9CBEDCBCA23EE"><enum>(iv)</enum><text>subject to
				subparagraph (D), that the State will pay the total cost of nonrecurring
				expenses associated with obtaining legal guardianship of the child, to the
				extent the total cost does not exceed $2,000.</text>
									</clause></subparagraph><subparagraph id="H8CF06153C1BD49519BF4CCF030367DFF"><enum>(C)</enum><header>Interstate
				applicability</header><text>The agreement shall provide that the agreement
				shall remain in effect without regard to the State residency of the relative
				guardian.</text>
								</subparagraph><subparagraph id="H95881F4C795749A08E58A400D1193915"><enum>(D)</enum><header>No effect on
				federal reimbursement</header><text>Nothing in subparagraph (B)(iv) shall be
				construed as affecting the ability of the State to obtain reimbursement from
				the Federal Government for costs described in that subparagraph.</text>
								</subparagraph></paragraph><paragraph id="H92365763B4364D2697F1759B74D64F4"><enum>(2)</enum><header>Limitations on
				amount of kinship guardianship assistance payment</header><text>A kinship
				guardianship assistance payment on behalf of a child shall not exceed the
				foster care maintenance payment which would have been paid on behalf of the
				child if the child had remained in a foster family home.</text>
							</paragraph><paragraph id="HA3F8CD649D7D454786B699221BB619DE"><enum>(3)</enum><header>Child’s
				eligibility for a kinship guardianship assistance payment</header>
								<subparagraph id="HA58A675A435D4C0A9368AF53EABB1BD6"><enum>(A)</enum><header>In
				general</header><text>A child is eligible for a kinship guardianship assistance
				payment under this subsection if the State agency determines the
				following:</text>
									<clause id="HD4A4C7197D974686A36D1724F3E5121E"><enum>(i)</enum><text>The child has
				been—</text>
										<subclause id="H6C7034BCCDAE4D1D9C176E026D38BB8E"><enum>(I)</enum><text>removed from his
				or her home pursuant to a voluntary placement agreement or as a result of a
				judicial determination to the effect that continuation in the home would be
				contrary to the welfare of the child; and</text>
										</subclause><subclause id="H116453CAFA1946B590E0C0E7CE888E95"><enum>(II)</enum><text>eligible for
				foster care maintenance payments under section 472 while residing for at least
				6 consecutive months in the home of the prospective relative guardian.</text>
										</subclause></clause><clause id="H08C6FEE0900644AE8CB9ED0B5F9C4A3"><enum>(ii)</enum><text>Being returned
				home or adopted are not appropriate permanency options for the child.</text>
									</clause><clause id="H84FE92BEA33C4C60975186527867A3A9"><enum>(iii)</enum><text>The child
				demonstrates a strong attachment to the prospective relative guardian and the
				relative guardian has a strong commitment to caring permanently for the
				child.</text>
									</clause><clause id="H9D148A083E3A4B1200BE04F4308ED195"><enum>(iv)</enum><text>With respect to a
				child who has attained 14 years of age, the child has been consulted regarding
				the kinship guardianship arrangement.</text>
									</clause></subparagraph><subparagraph id="HA7A4957F705945BC9E65CCF9B8E9D1FD"><enum>(B)</enum><header>Treatment of
				siblings</header><text>With respect to a child described in subparagraph (A)
				whose sibling or siblings are not so described—</text>
									<clause id="H7B64F20FACC944BCB8A6CB0E67CA796"><enum>(i)</enum><text>the
				child and any sibling of the child may be placed in the same kinship
				guardianship arrangement, in accordance with section 471(a)(31), if the State
				agency and the relative agree on the appropriateness of the arrangement for the
				siblings; and</text>
									</clause><clause id="H587CAABBD2DA4CB5BE8C8829DFB0974"><enum>(ii)</enum><text>kinship
				guardianship assistance payments may be paid on behalf of each sibling so
				placed.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H340C750B011A412FB1F28939E3AA4EE1"><enum>(c)</enum><header>Conforming
			 amendments</header>
					<paragraph id="H2D13C3A9C4D44457A62E8110F7D40000"><enum>(1)</enum><header>Eligibility for
			 adoption assistance payments</header><text>Section 473(a)(2) of such Act (42
			 U.S.C. 673(a)(2)) is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H9C90563B2D9547A1B367F4E85E34B132" style="OLC">
							<subparagraph id="H740601584BE143C18600C6A18B1522AA" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">In
				determining the eligibility for adoption assistance payments of a child in a
				legal guardianship arrangement described in section 471(a)(28), the placement
				of the child with the relative guardian involved and any kinship guardianship
				assistance payments made on behalf of the child shall be considered never to
				have been
				made.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H7B8B145498494EE5B2FD8CC14400EE57"><enum>(2)</enum><header>State plan
			 requirement</header>
						<subparagraph id="H2E0B1CB2BCB445A59EA5A800B9069319"><enum>(A)</enum><header>In
			 general</header><text>Section 471(a)(20) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(20)</external-xref>) is
			 amended—</text>
							<clause id="H93526B18C8724B82A14FA517ADE8E6C5"><enum>(i)</enum><text>by
			 adding <quote>and</quote> at the end of subparagraph (C); and</text>
							</clause><clause id="H76DA5FC29CFB4E398E69FA5E4F756B78"><enum>(ii)</enum><text>by
			 adding at the end the following:</text>
								<quoted-block id="HD440FB910B354C0AA5813275097B007B" style="OLC">
									<subparagraph id="H28816E190AD74364BA82BD17642844B2"><enum>(D)</enum><text display-inline="yes-display-inline">provides procedures for criminal records
				checks, including fingerprint-based checks of national crime information
				databases (as defined in <external-xref legal-doc="usc" parsable-cite="usc/28/534">section 534(e)(3)(A)</external-xref> of title 28, United States Code),
				on any relative guardian, and for checks described in subparagraph (C) of this
				paragraph on any relative guardian and any other adult living in the home of
				any relative guardian, before the relative guardian may receive kinship
				guardianship assistance payments on behalf of the child under the State plan
				under this
				part;</text>
									</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</clause></subparagraph><subparagraph id="H7C1512D219A841F1AAFD32D88066F411"><enum>(B)</enum><header>Redesignation of
			 new provision after amendment made by prior law takes effect</header>
							<clause id="HB3C7CAA811AC431F8B9C3DC5D3D08027"><enum>(i)</enum><header>In
			 general</header><text>Section 471(a)(20) of the Social Security Act (42 U.S.C.
			 671(a)(20)) is amended—</text>
								<subclause id="HC2EAD278669049629877008B63DFB46F"><enum>(I)</enum><text>in subparagraph
			 (D), by striking <quote>(C)</quote> and inserting <quote>(B)</quote>;
			 and</text>
								</subclause><subclause id="HE8E0BA6702024A40A03985109DB2CEE"><enum>(II)</enum><text>by redesignating
			 subparagraph (D) as subparagraph (C).</text>
								</subclause></clause><clause id="HAFC0BB2BC2F744AB8D9F754BB7D36948"><enum>(ii)</enum><header>Effective
			 date</header><text>The amendments made by clause (i) shall take effect
			 immediately after the amendments made by section 152 of <external-xref legal-doc="public-law" parsable-cite="pl/109/248">Public Law 109–248</external-xref> take
			 effect.</text>
							</clause></subparagraph></paragraph><paragraph id="H210531148591472B88DCC0AF002256A"><enum>(3)</enum><header>Payments to
			 states</header><text>Section 474(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)</external-xref>) is
			 amended—</text>
						<subparagraph id="H906E8805B9FE4E03B890ABB9061D9BDB"><enum>(A)</enum><text>by striking the
			 period at the end and inserting <quote>; plus</quote>; and</text>
						</subparagraph><subparagraph id="H1E089C9782AF418E8FEE294CA18DB093"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block id="H0E4CADC8F0E143AEB69B50001C695535" style="OLC">
								<paragraph id="HB8E1708AE10947D2B500807B1C082311"><enum>(5)</enum><text>an amount equal to
				the percentage by which the expenditures referred to in paragraph (2) of this
				subsection are reimbursed of the total amount expended during such quarter as
				kinship guardianship assistance payments under section 473(d) pursuant to
				kinship guardianship assistance
				agreements.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="HB8BBDF779C2C45ADA2384DFFC37B75BF"><enum>(4)</enum><header>Case plan
			 requirements</header><text>Section 475(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(1)</external-xref>) is
			 amended by adding at the end the following:</text>
						<quoted-block id="HEB8653D92DA94432AB6477D4C6AF11D0" style="OLC">
							<subparagraph id="HD007C869EAF54587A202D9CBA6BFB116"><enum>(F)</enum><text>In the case of a
				child with respect to whom the permanency plan is placement with a relative and
				receipt of kinship guardianship assistance payments under section 473(d), a
				description of—</text>
								<clause id="H97BDABB9D6044CF6B1C510503C611094"><enum>(i)</enum><text>the steps that the
				agency has taken to determine that it is not appropriate for the child to be
				returned home or adopted;</text>
								</clause><clause id="H706B17E3416B4794A5D0698D23BC7321"><enum>(ii)</enum><text>the reasons for
				any separation of siblings during placement;</text>
								</clause><clause id="HD7289C5DDC1E42048CC3A81EA7AFD785"><enum>(iii)</enum><text>the reasons why
				a permanent placement with a fit and willing relative through a kinship
				guardianship assistance arrangement is in the child’s best interests;</text>
								</clause><clause id="HD35D25E1A66D4632936ED25E4248BEB8"><enum>(iv)</enum><text>the ways in which
				the child meets the eligibility requirements for a kinship guardianship
				assistance payment;</text>
								</clause><clause id="HD4C6BF12B8EF473F9BF56E3907EDA04F"><enum>(v)</enum><text>the efforts the
				agency has made to discuss adoption by the child’s relative foster parent as a
				more permanent alternative to legal guardianship and, in the case of a relative
				foster parent who has chosen not to pursue adoption, documentation of the
				reasons therefor; and</text>
								</clause><clause id="H32933F7E18A74251AD3303EFD361A709"><enum>(vi)</enum><text>the efforts made
				by the State agency to discuss with the child’s parent or parents the kinship
				guardianship assistance arrangement, or the reasons why the efforts were not
				made.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H129CE4F430824FCEB28652AF7CC32EC6"><enum>(5)</enum><header>Section heading
			 amendment</header><text>The section heading for section 473 of such Act (42
			 U.S.C. 673) is amended by inserting <quote><header-in-text level="section" style="traditional">and guardianship</header-in-text></quote> after
			 <quote><header-in-text level="section" style="traditional">adoption</header-in-text></quote>.</text>
					</paragraph></subsection><subsection id="H2FC48794D8274205A5009916656EAF65"><enum>(d)</enum><header>Continued
			 services under waiver</header><text>Section 474 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674</external-xref>) is
			 amended by adding at the end the following:</text>
					<quoted-block id="H070034E5EF5C42AE9EFD10C415F2CAA" style="OLC">
						<subsection id="H93B2027AA44642A4AE00A3DEEE5C041"><enum>(g)</enum><text display-inline="yes-display-inline">For purposes of this part, after the
				termination of a demonstration project relating to guardianship conducted by a
				State under section 1130, the expenditures of the State for the provision, to
				children who, as of September 30, 2008, were receiving assistance or services
				under the project, of the same assistance and services under the same terms and
				conditions that applied during the conduct of the project, are deemed to be
				expenditures under the State plan approved under this
				part.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection display-inline="no-display-inline" id="HAEC94810FDF74478B3BD12B016E2E27D"><enum>(e)</enum><header>Eligibility for
			 independent living services and education and training vouchers for children
			 who exit foster care for relative guardianship or adoption after age
			 16</header>
					<paragraph id="H8DC176DA2A0E471ABDA64BCF75B1CFDC"><enum>(1)</enum><header>Independent
			 living services</header><text>Section 477(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(a)</external-xref>) is
			 amended—</text>
						<subparagraph id="HBCFD03E0B3CD46E6B4128167A4733690"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (5);</text>
						</subparagraph><subparagraph id="HD3387978694E4C56AD8BBD93FEBBB9C6"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (6) and inserting <quote>; and</quote>;

			 eligibility for medicaid</header><text>Section 473(b)(3) of such Act (42 U.S.C.
			 673(b)(3)) is amended—</text>

			 (A)(ii), by striking <quote>or</quote> at the end;</text>

			 grants</header>
				<subsection id="HC9847212735B4DD7A4AA0068F3986F9E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part B of title IV of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/620">42 U.S.C. 620–629i</external-xref>) is amended by inserting after
			 section 426 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H77BB438070ED4C1085D6527B5D309796" style="OLC">
						<section id="H0CDED8633AD84D43ACCDA81CAFF6E37F"><enum>427.</enum><header>Family
				connection grants</header>
							<subsection id="HDA4E8C8C1D8844B09B6F05E4FF4F79A3"><enum>(a)</enum><header>In
				general</header><text>The Secretary of Health and Human Services may make
				matching grants to State, local, or tribal child welfare agencies, and private
				nonprofit organizations that have experience in working with foster children or
				children in kinship care arrangements, for the purpose of helping children who
				are in, or at risk of entering, foster care reconnect with family members
				through the implementation of—</text>
								<paragraph id="HC111C79FCEDD43050006F5D2FE2E001B"><enum>(1)</enum><text>a kinship
				navigator program to assist kinship caregivers in learning about, finding, and
				using programs and services to meet the needs of the children they are raising
				and their own needs, and to promote effective partnerships among public and
				private agencies to ensure kinship caregiver families are served, which
				program—</text>
									<subparagraph id="H6EC56AE8F77C4F709472869F20506759"><enum>(A)</enum><text>shall be
				coordinated with other State or local agencies that promote service
				coordination or provide information and referral services, including the
				entities that provide 2–1–1 or 3–1–1 information systems where available, to
				avoid duplication or fragmentation of services to kinship care families;</text>
									</subparagraph><subparagraph id="H550A38FCD3A748B1A5776F5C00779C9D"><enum>(B)</enum><text>shall be planned
				and operated in consultation with kinship caregivers and organizations
				representing them, youth raised by kinship caregivers, relevant government
				agencies, and relevant community-based or faith-based organizations;</text>
									</subparagraph><subparagraph id="HE172E10E4AE44A02920080B4DB664D18"><enum>(C)</enum><text>shall establish
				information and referral systems that link (via toll-free access) kinship
				caregivers, kinship support group facilitators, and kinship service providers
				to—</text>
										<clause id="H468F9886334C4A6197E41550A2A0D454"><enum>(i)</enum><text>each other;</text>
										</clause><clause id="HD29CEAD6CB484A6791B628BCBAECD2F"><enum>(ii)</enum><text>eligibility and
				enrollment information for Federal, State, and local benefits;</text>
										</clause><clause id="H092E57BD41BF42EBAAE5B5BB3FDA00A4"><enum>(iii)</enum><text>relevant
				training to assist kinship caregivers in caregiving and in obtaining benefits
				and services; and</text>
										</clause><clause id="HCEEFB702A8404D958600BA01D47955A7"><enum>(iv)</enum><text>relevant legal
				assistance and help in obtaining legal services;</text>
										</clause></subparagraph><subparagraph id="H9AB9D72465E44D76B7B5DD9B09002429"><enum>(D)</enum><text display-inline="yes-display-inline">shall provide outreach to kinship care
				families, including by establishing, distributing, and updating a kinship care
				website, or other relevant guides or outreach materials;</text>
									</subparagraph><subparagraph id="H8E1C3A88AFF3430BBBCFB405A4FD6D30"><enum>(E)</enum><text>shall promote
				partnerships between public and private agencies, including schools, community
				based or faith-based organizations, and relevant government agencies, to
				increase their knowledge of the needs of kinship care families to promote
				better services for those families;</text>
									</subparagraph><subparagraph id="HEC13290A026B4B05A178AEC500429BBB"><enum>(F)</enum><text display-inline="yes-display-inline">may establish and support a kinship care
				ombudsman with authority to intervene and help kinship caregivers access
				services; and</text>
									</subparagraph><subparagraph id="HAD1C84502A364A44A7DED5BB811CD8C7"><enum>(G)</enum><text>may support any
				other activities designed to assist kinship caregivers in obtaining benefits
				and services to improve their caregiving;</text>
									</subparagraph></paragraph><paragraph id="HE5A3141E1B9F41F682AA06589E96F3EB"><enum>(2)</enum><text>intensive
				family-finding efforts that utilize search technology to find biological family
				members for children in the child welfare system, and once identified, work to
				reestablish relationships and explore ways to find a permanent family placement
				for the children;</text>
								</paragraph><paragraph id="H353515BF4D9A477B009CB0CF9F37395C"><enum>(3)</enum><text>family group
				decision-making meetings for children in the child welfare system, that—</text>
									<subparagraph id="HAD06A01C01474B3EA5C2981D427DF200"><enum>(A)</enum><text>enable families to
				make decisions and develop plans that nurture children and protect them from
				abuse and neglect, and</text>
									</subparagraph><subparagraph id="HB96522654A784646B401112DBB18D1D0"><enum>(B)</enum><text>when appropriate,
				shall address domestic violence issues in a safe manner and facilitate
				connecting children exposed to domestic violence to appropriate services,
				including reconnection with the abused parent when appropriate; or</text>
									</subparagraph></paragraph><paragraph id="H84CE998F0C2C4254BCA5003BA187D06E"><enum>(4)</enum><text>residential family
				treatment programs that—</text>
									<subparagraph id="HFA2C67A4E5D14721A0A6EE97243847BE"><enum>(A)</enum><text>enable parents and
				their children to live in a safe environment for a period of not less than 6
				months; and</text>
									</subparagraph><subparagraph id="HBC4D7015919A42E0BDEEF539CAD7B113"><enum>(B)</enum><text>provide, on-site
				or by referral, substance abuse treatment services, children’s early
				intervention services, family counseling, medical, and mental health services,
				nursery and pre-school, and other services that are designed to provide
				comprehensive treatment that supports the family.</text>
									</subparagraph></paragraph></subsection><subsection id="H046B854C8CA24CD4BBF9673BD9BD8437"><enum>(b)</enum><header>Applications</header><text>An
				entity desiring to receive a matching grant under this section shall submit to
				the Secretary an application, at such time, in such manner, and containing such
				information as the Secretary may require, including—</text>
								<paragraph id="HB1A3CD5BC3794BBE85C00987ADDCB700"><enum>(1)</enum><text>a description of
				how the grant will be used to implement 1 or more of the activities described
				in subsection (a);</text>
								</paragraph><paragraph id="H0992067C645940799927A2995026F163"><enum>(2)</enum><text>a description of
				the types of children and families to be served, including how the children and
				families will be identified and recruited, and an initial projection of the
				number of children and families to be served;</text>
								</paragraph><paragraph id="H180F7724A4F0406A9906106DBF1D9036"><enum>(3)</enum><text>if the entity is a
				private organization—</text>
									<subparagraph id="H9EECEF7EA9B9476C9902AB392FEA9EF"><enum>(A)</enum><text>documentation of
				support from the relevant local or State child welfare agency; or</text>
									</subparagraph><subparagraph id="HFDB5714D3901439CB8BB18B1EC767391"><enum>(B)</enum><text>a description of
				how the organization plans to coordinate its services and activities with those
				offered by the relevant local or State child welfare agency; and</text>
									</subparagraph></paragraph><paragraph id="HC6BE68E387D8403BB3EED97EC01103BA"><enum>(4)</enum><text>an assurance that
				the entity will cooperate fully with any evaluation provided for by the
				Secretary under this section.</text>
								</paragraph></subsection><subsection id="HAD3697DC4A2040BAB67111EE0003FE00"><enum>(c)</enum><header>Limitations</header>
								<paragraph id="H789AA8C836C54BADA500D66799BA559"><enum>(1)</enum><header>Grant
				duration</header><text>The Secretary may award a grant under this section for a
				period of not less than 1 year and not more than 3 years.</text>
								</paragraph><paragraph id="HB6DED179829C4412BC31FDCFF3AFFABB"><enum>(2)</enum><header>Number of new
				grantees per year</header><text>The Secretary may not award a grant under this
				section to more than 30 new grantees each fiscal year.</text>
								</paragraph></subsection><subsection id="HCDEA9734BD1748BD9959A50DA9C00EA"><enum>(d)</enum><header>Federal
				contribution</header><text>The amount of a grant payment to be made to a
				grantee under this section during each year in the grant period shall be the
				following percentage of the total expenditures proposed to be made by the
				grantee in the application approved by the Secretary under this section:</text>
								<paragraph id="H5CFEC1D90F384309ABF79D11BC432009"><enum>(1)</enum><text>75 percent, if the
				payment is for the 1st or 2nd year of the grant period.</text>
								</paragraph><paragraph id="H02AEBEDE630B4301B342159BD55C0061"><enum>(2)</enum><text>50 percent, if the
				payment is for the 3rd year of the grant period.</text>
								</paragraph></subsection><subsection id="HA5594ADFE7224200929133E2111D0581"><enum>(e)</enum><header>Form of grantee
				contribution</header><text>A grantee under this section may provide not more
				than 50 percent of the amount which the grantee is required to expend to carry
				out the activities for which a grant is awarded under this section in kind,
				fairly evaluated, including plant, equipment, or services.</text>
							</subsection><subsection id="H643EBB5F4EBE433DAB158F8BE3C09689"><enum>(f)</enum><header>Use of
				grant</header><text>A grantee under this section shall use the grant in
				accordance with the approved application for the grant.</text>
							</subsection><subsection id="HED725DCAD32740C78783D2718822DB18"><enum>(g)</enum><header>Reservations of
				funds</header>
								<paragraph id="HE969448C02B04A539C0000047988568F"><enum>(1)</enum><header>Kinship
				navigator programs</header><text display-inline="yes-display-inline">The
				Secretary shall reserve $5,000,000 of the funds made available under subsection
				(h) for each fiscal year for grants to implement kinship navigator programs
				described in subsection (a)(1).</text>
								</paragraph><paragraph id="H46E64501990846FB9F6514E800D6D5FD"><enum>(2)</enum><header>Evaluation</header><text>The
				Secretary shall reserve 3 percent of the funds made available under subsection
				(h) for each fiscal year for the conduct of a rigorous evaluation of the
				activities funded with grants under this section.</text>
								</paragraph><paragraph id="H0425B4C37D4946458BE1B3FA145F6716"><enum>(3)</enum><header>Technical
				assistance</header><text>The Secretary may reserve 2 percent of the funds made
				available under subsection (h) for each fiscal year to provide technical
				assistance to recipients of grants under this section.</text>
								</paragraph></subsection><subsection id="H5659F392F70A4F6F88BA94005BB171B9"><enum>(h)</enum><header>Appropriation</header><text>Out
				of any money in the Treasury of the United States not otherwise appropriated,
				there are appropriated to the Secretary for purposes of making grants under
				this section $15,000,000 for each of fiscal years 2009 through
				2013.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H1734B64588A1412F9208DABB38B3DD14"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 425 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/625">42 U.S.C. 625</external-xref>) is amended by
			 inserting <quote>(other than sections 426, 427, and 429)</quote> after
			 <quote>this subpart</quote>.</text>

				domestic violence, that—</text>
							<subparagraph id="H432E371D217B4861A58EF9233E6CFB88"><enum>(A)</enum><text>specifies that the
				child has been or is being removed from the custody of the parent or parents of
				the child;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4F5B4182E8B34BD4007F812894F2833E"><enum>(B)</enum><text>explains the
				options the relative has under Federal, State, and local law to participate in
				the care and placement of the child, including any options that may be lost by
				failing to respond to the notice;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFECCB6D78DF14B9D9170CD1CD0F0D1C"><enum>(C)</enum><text>describes the
				requirements under paragraph (10) of this subsection to become a foster family
				home and the additional services and supports that are available for children
				placed in such a home; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H20361E45380445C49133130648997F41"><enum>(D)</enum><text>if the State has
				elected the option to make kinship guardianship assistance payments under
				paragraph (28) of this subsection, describes how the relative guardian of the

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section display-inline="no-display-inline" id="H156F324D01C642CC97734E87922731EF" section-type="subsequent-section"><enum>104.</enum><header>Licensing standards
			 for relatives</header>
				<subsection id="HF8536A72F8404E6A89356F854C439BD8"><enum>(a)</enum><header>State plan
			 amendment</header><text>Section 471(a)(10) of the Social Security Act (42
			 U.S.C. 671(a)(10)) is amended—</text>
					<paragraph id="H0154F57CE4774550ADA7055DCE73C0D9"><enum>(1)</enum><text>by striking
			 <quote>and provides</quote> and inserting <quote>provides</quote>; and</text>
					</paragraph><paragraph id="H000534CC7EB54910A367C600D2807D9C"><enum>(2)</enum><text>by inserting
			 before the semicolon the following: <quote>, and provides that a waiver of any
			 such standard may be made only on a case-by-case basis for non-safety standards
			 (as determined by the State) in relative foster family homes for specific
			 children in care</quote>.</text>
					</paragraph></subsection><subsection id="H51E7F87FFC014771A862C779CC76B9B3"><enum>(b)</enum><header>Report</header><text>Not
			 later than 2 years after the date of enactment of this Act, the Secretary of
			 Health and Human Services shall submit to the Committee on Ways and Means of
			 the House of Representatives and the Committee on Finance of the Senate a
			 report that includes the following:</text>
					<paragraph id="H77168582BA02415CBE64CB63F597D0B2"><enum>(1)</enum><text>Nationally and for
			 each State, the number and percentage of children in foster care placed in
			 licensed relative foster family homes and the number and percentage of such
			 children placed in unlicensed relative foster family homes.</text>
					</paragraph><paragraph id="H4A55A75CB7574540874400870021C8B0"><enum>(2)</enum><text>The frequency with
			 which States grant case-by-case waivers of non-safety licensing standards for
			 relative foster family homes.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="HB128D05B6F6F49639C94ECAD3C5B4F0"><enum>(3)</enum><text>The types of
			 non-safety licensing standards waived.</text>
					</paragraph><paragraph id="HEEC2A824F2CB4652B402ABFAFA50E1F1"><enum>(4)</enum><text>An assessment of
			 how such case-by-case waivers of non-safety licensing standards have affected
			 children in foster care, including their safety, permanency, and
			 well-being.</text>
					</paragraph><paragraph id="H24FBF2BDA2A043A9A0C2E4C196DF85B1"><enum>(5)</enum><text>A
			 review of any reasons why relative foster family homes may not be able to be
			 licensed, despite State authority to grant such case-by-case waivers of
			 non-safety licensing standards.</text>
					</paragraph><paragraph id="H91069EB4591643F791B8C75EDC04CBEE"><enum>(6)</enum><text>Recommendations
			 for administrative or legislative actions that may increase the percentage of
			 relative foster family homes that are licensed while ensuring the safety of
			 children in foster care and improving their permanence and well-being.</text>
					</paragraph></subsection></section><section id="H36C760AEBE3F492A93CDAD40A928836D"><enum>105.</enum><header>Authority for
			 comparisons and disclosures of information in the Federal Parent Locator
			 Service for child welfare, foster care, and adoption assistance program
			 purposes</header><text display-inline="no-display-inline">Section 453(j)(3) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(j)</external-xref>) is amended, in the matter preceding
			 subparagraph (A), by inserting <quote>, part B, or part E</quote> after
			 <quote>this part</quote>.</text>

			 outcomes for children in foster care</header>
			<section display-inline="no-display-inline" id="HE98077CCBCB24AA08EC603FC6E25ACF8" section-type="subsequent-section"><enum>201.</enum><header>State option for
			 children in foster care, and certain children in an adoptive or guardianship
			 placement, after attaining age 18</header>
				<subsection id="H6E7EDDF8B75A4A158C28F94078E12E3D"><enum>(a)</enum><header>Definition of
			 child</header><text>Section 475 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is
			 amended by adding at the end the following:</text>
					<quoted-block id="H48E8276323DB42048941396248FAB92E" style="OLC">
						<paragraph id="H93FF67ADBF084BA2984DE1E3E44E52AD"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H3F9C427E60BF45738EBEA791893A43F"><enum>(A)</enum><text>Subject to subparagraph
				(B), the term <term>child</term> means an individual who has not attained 18
				years of age.</text>
							</subparagraph><subparagraph id="HE051A3A33D6E4F68B51F6DFF063E69DB" indent="up1"><enum>(B)</enum><text>At the option of a State, the term
				shall include an individual—</text>
								<clause id="HFBCDCCA5CE084024A2FB271235204653"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H3AF79028C505443B9897A5BA5DCC50E3"><enum>(I)</enum><text>who is in foster care
				under the responsibility of the State;</text>
									</subclause><subclause id="H74D70CD7F59345AC9E86FAEE2B71FA00" indent="up1"><enum>(II)</enum><text>with respect to whom an adoption
				assistance agreement is in effect under section 473 if the child had attained
				16 years of age before the agreement became effective; or</text>
									</subclause><subclause id="HDF121415CDCA45189E7C73C695B1D00" indent="up1"><enum>(III)</enum><text>with respect to whom a kinship
				guardianship assistance agreement is in effect under section 473(d) if the
				child had attained 16 years of age before the agreement became
				effective;</text>
									</subclause></clause><clause id="HEFC75FAED5B548539049DC3E6D94B83C"><enum>(ii)</enum><text>who has attained 18 years of
				age;</text>
								</clause><clause id="HFF26F53337FB4DCD9360F2B4FBAD4331"><enum>(iii)</enum><text>who has not attained 19, 20, or
				21 years of age, as the State may elect; and</text>
								</clause><clause id="H81B427A58C3C4859AA00CFAB7DEDA81"><enum>(iv)</enum><text>who is—</text>
									<subclause id="H9D600CFC826449B4AD755CB6F5AE6A4"><enum>(I)</enum><text>completing secondary education or a
				program leading to an equivalent credential;</text>
									</subclause><subclause id="HAE6DC72FA7034B7C92A5B4CFCACE9523"><enum>(II)</enum><text>enrolled in an institution which
				provides post-secondary or vocational education;</text>
									</subclause><subclause id="H0A31D10E3D364DED985F7560EBAA05B3"><enum>(III)</enum><text>participating in a program or activity
				designed to promote, or remove barriers to, employment;</text>
									</subclause><subclause id="HA3F4EB3B66D04573AFDF23CF6C20848"><enum>(IV)</enum><text>employed for at least 80 hours per
				month; or</text>
									</subclause><subclause id="H75D01D62051841D000FAB0D7B0FF80F9"><enum>(V)</enum><text display-inline="yes-display-inline">incapable of doing any of the activities
				described in subclauses (I) through (IV) due to a medical condition, which
				incapability is supported by regularly updated information in the case plan of
				the
				child.</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HE217B9615C2848D18686DA71F1B8D983"><enum>(b)</enum><header>Conforming
			 amendment to definition of child-care institution</header><text>Section
			 472(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/672">42 U.S.C. 672(c)(2)</external-xref>) is amended by inserting
			 <quote>except, in the case of a child who has attained 18 years of age, the
			 term shall include a supervised setting in which the individual is living
			 independently, in accordance with such conditions as the Secretary shall
			 establish in regulations,</quote> before <quote>but</quote>.</text>
				</subsection><subsection id="HD8F386D303F54B2F80FE00003216A9AD"><enum>(c)</enum><header>Conforming
			 amendments to age limits applicable to children eligible for adoption
			 assistance or kinship guardianship assistance</header><text>Section 473(a)(4)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(a)(4)</external-xref>) is amended to read as follows:</text>
					<quoted-block id="H7E1C7D0242674E8894D8AFCA5CD0CDC1" style="OLC">
						<paragraph id="HAA76B5359E17440100F2424C0090AA8D" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HCE31F92613384093B0D289E32DDB5BF"><enum>(A)</enum><text>Notwithstanding any other
				provision of this section, a payment may not be made pursuant to this section
				to parents or relative guardians with respect to a child—</text>
								<clause id="H7B16E4D867354180B0216400208371B5" indent="up1"><enum>(i)</enum><text>who has attained—</text>
									<subclause id="H6089BBF31A3B4C61A37B439B674895C8"><enum>(I)</enum><text>18 years of age, or such greater
				age as the State may elect under section 475(8)(B)(iii); or</text>
									</subclause><subclause id="HBF8FE5154F584005AC0046EE5D6178D6"><enum>(II)</enum><text>21 years of age, if the State
				determines that the child has a mental or physical handicap which warrants the
				continuation of assistance;</text>
									</subclause></clause><clause id="HD69BD2FF5C724937B933D22B55C5FCE" indent="up1"><enum>(ii)</enum><text>who has not attained 18 years of age,
				if the State determines that the parents or relative guardians, as the case may
				be, are no longer legally responsible for the support of the child; or</text>
								</clause><clause id="H29AA0B84AEA44CB29C94C3D1BA71C99F" indent="up1"><enum>(iii)</enum><text>if the State determines that the
				child is no longer receiving any support from the parents or relative
				guardians, as the case may be.</text>
								</clause></subparagraph><subparagraph id="H581694B2A3C54E5CA9DA52568B3442BB" indent="up1"><enum>(B)</enum><text>Parents or relative guardians who
				have been receiving adoption assistance payments or kinship guardianship
				assistance payments under this section shall keep the State or local agency
				administering the program under this section informed of circumstances which
				would, pursuant to this subsection, make them ineligible for the payments, or
				eligible for the payments in a different
				amount.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H8A6547BBE35B4505B32245952D9BB800"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 October 1, 2010.</text>
				</subsection></section><section display-inline="no-display-inline" id="H2C09825363464EB983FC00AB827C9D6C" section-type="subsequent-section"><enum>202.</enum><header>Transition plan for
			 children aging out of foster care</header><text display-inline="no-display-inline">Section 475(5) of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is amended—</text>
				<paragraph id="H3F2F0F03C66C49FE974B4B8F5FD20000"><enum>(1)</enum><text>in subparagraph
			 (F)(ii), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H36BCD516FA9B4007BA32F0A2C556FBE"><enum>(2)</enum><text>in
			 subparagraph (G), by striking the period at the end and inserting <quote>;
			 and</quote>; and</text>
				</paragraph><paragraph id="H00F2A564F1EC4C268BFEC9767D9D345B"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC50512F383C54AC69075FFDD6FBFE07C" style="OLC">
						<subparagraph id="HCC445DC49AD14E84889DC32DA225C849"><enum>(H)</enum><text>during the 90-day
				period immediately prior to the date on which the child will attain 18 years of
				age, or such greater age as the State may elect under paragraph (8)(B)(iii),
				whether during that period foster care maintenance payments are being made on
				the child's behalf or the child is receiving benefits or services under section
				477, a caseworker on the staff of the State agency, and, as appropriate, other
				representatives of the child provide the child with assistance and support in
				developing a transition plan that is personalized at the direction of the
				child, includes specific options on housing, health insurance, education, local
				opportunities for mentors and continuing support services, and work force
				supports and employment services, and is as detailed as the child may
				elect.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section display-inline="no-display-inline" id="H7871DB1ADE8A44A2AB02D58030743448" section-type="subsequent-section"><enum>203.</enum><header>Short-term training
			 for child welfare agencies, relative guardians, and court personnel</header>
				<subsection id="H8203BEA82E6B458983C43614F916A0CA"><enum>(a)</enum><header>In
			 general</header><text>Section 474(a)(3)(B) of the Social Security Act (42
			 U.S.C. 674(a)(3)(B)) is amended—</text>
					<paragraph id="HF4F621930D074E7F99B3A4E775917EE0"><enum>(1)</enum><text>by inserting
			 <quote>or relative guardians</quote> after <quote>adoptive
			 parents</quote>;</text>
					</paragraph><paragraph id="H0B8868449BFA43B6B747B9D990376686"><enum>(2)</enum><text>by striking
			 <quote>and the members</quote> and inserting <quote>, the
			 members</quote>;</text>
					</paragraph><paragraph id="H63805905BE3145ECBF3B784DC500F75B"><enum>(3)</enum><text>by inserting
			 <quote>, or State-licensed or State-approved child welfare agencies providing
			 services,</quote> after <quote>providing care</quote>;</text>
					</paragraph><paragraph id="HD0FC7CD81E7541C7A6515766004380AD"><enum>(4)</enum><text>by striking
			 <quote>foster and adopted</quote> the 1st place it appears;</text>
					</paragraph><paragraph id="HBB75292BEF864D3CB5676BA202CE0018"><enum>(5)</enum><text>by inserting
			 <quote>and members of the staff of abuse and neglect courts, agency attorneys,
			 attorneys representing children or parents, guardians ad litem, or other
			 court-appointed special advocates representing children in proceedings of such
			 courts,</quote> after <quote>part,</quote>;</text>
					</paragraph><paragraph id="H0E5F9F2091774E468E51052605AF21CE"><enum>(6)</enum><text>by inserting
			 <quote>guardians,</quote> before <quote>staff members,</quote>;</text>
					</paragraph><paragraph id="HD991CD4C56014C5D970712FB24CD718E"><enum>(7)</enum><text>by striking
			 <quote>and institutions</quote> and inserting <quote>institutions, attorneys,
			 and advocates</quote>; and</text>
					</paragraph><paragraph id="H776A29E1CDE6479F8B2D2FCD55E7CFA3"><enum>(8)</enum><text>by inserting
			 <quote>and children living with relative guardians</quote> after <quote>foster
			 and adopted children</quote> the 2nd place it appears.</text>
					</paragraph></subsection><subsection id="H4DDF0049055440B188CE5C716E1E00C7"><enum>(b)</enum><header>Phase-In</header><text display-inline="yes-display-inline">With respect to an expenditure described in
			 section 474(a)(3)(B) of the Social Security Act by reason of an amendment made
			 by subsection (a) of this section, in lieu of the percentage set forth in such
			 section 474(a)(3)(B), the percentage that shall apply is—</text>
					<paragraph id="HB3EA3CEDCEBA4CA68DD7F4F52FD67067"><enum>(1)</enum><text>55 percent, if the
			 expenditure is made in fiscal year 2009;</text>
					</paragraph><paragraph id="H809760FD50C242DD98E3F3C3D24B007D"><enum>(2)</enum><text>60 percent, if the
			 expenditure is made in fiscal year 2010;</text>
					</paragraph><paragraph id="HBE8CAAC86F1947EEB929588900C5EF01"><enum>(3)</enum><text display-inline="yes-display-inline">65 percent, if the expenditure is made in
			 fiscal year 2011; or</text>
					</paragraph><paragraph id="HB6D062AD4CE2489280ACE034B3BCE3D"><enum>(4)</enum><text display-inline="yes-display-inline">70 percent, if the expenditure is made in
			 fiscal year 2012.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H92A8842DCBD2429EA2FB01A0BCA98B78"><enum>204.</enum><header>Educational
			 stability</header>
				<subsection id="H3B675AD736C348A29CC5F5F9F6EBF19"><enum>(a)</enum><header>In
			 general</header><text>Section 475 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>),
			 as amended by section 101(c)(4) of this Act, is amended—</text>
					<paragraph id="H7F8E839C02314921B0CC31B2418F7229"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
						<subparagraph id="HAB011935C446425DA8400282F5E977D5"><enum>(A)</enum><text>in subparagraph
			 (C), by striking clause (iv) and redesignating clauses (v) through (viii) as
			 clauses (iv) through (vii), respectively; and</text>
						</subparagraph><subparagraph id="H0D37385CEF7248D0B0B37768273957F"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block id="H6E08785324A5422CA76ECE3D8F149E5" style="OLC">
								<subparagraph id="HC27780F1FEC748C6842233BD9BB0390"><enum>(G)</enum><text>A plan for ensuring
				the educational stability of the child while in foster care, including—</text>
									<clause id="HDB89E06CEB664F48BCA75BD9B6226753"><enum>(i)</enum><text>assurances that
				the placement of the child in foster care takes into account the
				appropriateness of the current educational setting and the proximity to the
				school in which the child is enrolled at the time of placement; and</text>
									</clause><clause id="H779E5B6AEDF447DA92CA77DCF753FC00"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HAF02FDCD5FFE4C208CEA43576FC46403"><enum>(I)</enum><text>an assurance that the
				State agency has coordinated with appropriate local educational agencies (as
				defined under section 9101 of the Elementary and Secondary Education Act of
				1965) to ensure that the child remains in the school in which the child is
				enrolled at the time of placement; or</text>
										</subclause><subclause id="H265281B8E4234F65A1FEB9DF5DBB4973" indent="up1"><enum>(II)</enum><text>if remaining in such school is not in
				the best interests of the child, assurances by the State agency and the local
				educational agencies to provide immediate and appropriate enrollment in a new
				school, with all of the educational records of the child provided to the
				school.</text>
										</subclause></clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="HAA896B480A3A4DC3A9B6939004171E18"><enum>(2)</enum><text>in the 1st
			 sentence of paragraph (4)(A)—</text>
						<subparagraph id="H812F8EC3C8504D59BC6015C5379C85E6"><enum>(A)</enum><text>by striking
			 <quote>and reasonable</quote> and inserting <quote>reasonable</quote>;
			 and</text>
						</subparagraph><subparagraph id="H7903536F84424884A6A2A1B4F5C94F89"><enum>(B)</enum><text>by inserting
			 <quote>, and reasonable travel for the child to remain in the school in which
			 the child is enrolled at the time of placement</quote> before the
			 period.</text>
						</subparagraph></paragraph></subsection><subsection id="H86D5B234CD8E459400227726F176FC32"><enum>(b)</enum><header>Educational
			 attendance requirement</header><text>Section 471(a) of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>), as amended by sections 101(a) and 103 of this Act, is
			 amended—</text>
					<paragraph id="H38DD3FC520D940B9BDFB0844878BB924"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (28);</text>
					</paragraph><paragraph id="H1E3B70C09F764C97A01025E57F498E09"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (29) and inserting <quote>; and</quote>;
			 and</text>
					</paragraph><paragraph id="HE279E122959A4068B77B4B77A7F73047"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H36DBF8464D74419298C463DD16C324B4" style="OLC">
							<paragraph id="H5E2DD5BFDDB54166B6714BC1F0D00864"><enum>(30)</enum><text>provides
				assurances that each child who has attained the minimum age for compulsory
				school attendance under State law and with respect to whom there is eligibility
				for a payment under the State plan is a full-time elementary or secondary
				school student or has completed secondary school, and for purposes of this
				paragraph, the term <term>elementary or secondary school student</term> means,
				with respect to a child, that the child is—</text>
								<subparagraph id="H4F4667CAF9E04642BB933C18E6B2B15F"><enum>(A)</enum><text>enrolled (or in
				the process of enrolling) in an institution which provides elementary or
				secondary education, as determined under the law of the State or other
				jurisdiction in which the institution is located;</text>
								</subparagraph><subparagraph id="H7A9EB67CB17C48DC004CFB4792AC63D"><enum>(B)</enum><text>instructed in
				elementary or secondary education at home in accordance with a home school law
				of the State or other jurisdiction in which the home is located;</text>
								</subparagraph><subparagraph id="HAC97B670F545451395F11CC501A53791"><enum>(C)</enum><text>in an independent
				study elementary or secondary education program in accordance with the law of
				the State or other jurisdiction in which the program is located, which is
				administered by the local school or school district; or</text>
								</subparagraph><subparagraph id="H3D99AA62AFF04158B31EAE0082DE897"><enum>(D)</enum><text>incapable of
				attending school on a full-time basis due to the medical condition of the
				child, which incapability is supported by regularly updated information in the
				case plan of the
				child.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H364AE99AFFF744CDA487A9CA38AC095C"><enum>205.</enum><header>Health
			 oversight and coordination plan</header><text display-inline="no-display-inline">Section 422(b)(15) of the Social Security
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/622">42 U.S.C. 622(b)(15)</external-xref>) is amended to read as follows:</text>
				<quoted-block id="HF7A1D30FDD6043B9A3951FF241FCEE7" style="OLC">
					<paragraph id="HAE7CC4DB209A48A5BB9700A045B17BE"><enum>(15)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HEAEB2200E6AE49E1B5A66C1C23DCCFF"><enum>(A)</enum><text>provides that the State
				will develop, in coordination and collaboration with the State agency referred
				to in paragraph (1) and the State agency responsible for administering the
				State plan approved under title XIX, and in consultation with pediatricians,
				other experts in health care, and experts in and recipients of child welfare
				services, a plan for the ongoing oversight and coordination of health care
				services for any child in a foster care placement, which shall ensure a
				coordinated strategy to identify and respond to the health care needs of
				children in foster care placements, including mental health and dental health
				needs, and shall include an outline of—</text>
							<clause id="H786DE7274F014698A5F2901C37DCE836" indent="up1"><enum>(i)</enum><text>a schedule for initial and
				follow-up health screenings that meet reasonable standards of medical
				practice;</text>
							</clause><clause id="HF71714E09F1E400AA6EB474E02AFD7AA" indent="up1"><enum>(ii)</enum><text>how health needs identified
				through screenings will be monitored and treated;</text>
							</clause><clause id="H1CEB0AEDA9C04A3FA8779D1F1FF20379" indent="up1"><enum>(iii)</enum><text>how medical information for
				children in care will be updated and appropriately shared, which may include
				the development and implementation of an electronic health record;</text>
							</clause><clause id="H21C1DCAA535340E79328DEB8D1EA614D" indent="up1"><enum>(iv)</enum><text>steps to ensure continuity of
				health care services, which may include the establishment of a medical home for
				every child in care;</text>
							</clause><clause id="H25EA73783E87406D00F95965E7F6B3E1" indent="up1"><enum>(v)</enum><text>the oversight of prescription
				medicines; and</text>
							</clause><clause id="H7049BC4161CB46CD85577D7509EA42F3" indent="up1"><enum>(vi)</enum><text>how the State actively consults
				with and involves physicians or other appropriate medical or non-medical
				professionals in assessing the health and well-being of children in foster care
				and in determining appropriate medical treatment for the children; and</text>
							</clause></subparagraph><subparagraph id="H6D285D55582E4DAA8114FBBB6406D93" indent="up1"><enum>(B)</enum><text>subparagraph (A) shall not be
				construed to reduce or limit the responsibility of the State agency responsible
				for administering the State plan approved under title XIX to administer and
				provide care and services for children with respect to whom services are
				provided under the State plan developed pursuant to this
				subpart;</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HD553D66E668E486887E788E4877A1D9"><enum>206.</enum><header>Sibling
			 placement</header><text display-inline="no-display-inline">Section 471(a) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>), as amended by sections 101(a), 103,
			 and 204(b) of this Act, is amended—</text>
				<paragraph id="HBFF163A3A13E4B6EB4005D6DDFA29756"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (29);</text>
				</paragraph><paragraph id="H65645E804B39493FAD29D25ECEDA2FE1"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (30) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H62A4148AB3DB4D29BC52985128A9E69D"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H374AAE361603463C90133251B9A8D4E4" style="OLC">
						<paragraph id="H9880077DCB24445DA87F04D446BF47B1"><enum>(31)</enum><text>provides that
				reasonable efforts shall be made—</text>
							<subparagraph id="HE19190624E374D4C888514EE00DB22C3"><enum>(A)</enum><text>to place siblings
				removed from their home in the same foster care, kinship guardianship, or
				adoptive placement, unless the State documents that such a joint placement
				would be contrary to the safety or well-being of any of the siblings;
				and</text>
							</subparagraph><subparagraph id="HD5CB81F37E6E40659167665CF002AF47"><enum>(B)</enum><text>in the case of
				siblings removed from their home who are not so jointly placed, to provide for
				frequent visitation or other ongoing interaction between the siblings, unless
				that State documents that frequent visitation or other ongoing interaction
				would be contrary to the safety or well-being of any of the
				siblings.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H5E4D888E37A94B4899DA4805A2A6C8C2"><enum>III</enum><header>Tribal foster
			 care and adoption access</header>
			<section commented="no" display-inline="no-display-inline" id="H511C80A35FB94CD7A0B7E51E11D114B3" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Equitable access for foster care and
			 adoption services for Indian children in tribal areas</header>
				<subsection commented="no" display-inline="no-display-inline" id="HC243EA5EE1844281A8E0C4E77E125C00"><enum>(a)</enum><header display-inline="yes-display-inline">Authority for direct payment of Federal
			 Title IV–E funds for programs operated by Indian Tribal organizations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H61075856975546CD9F68091FB3F39EB4"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part E of title IV of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670 et seq.</external-xref>) is amended by adding at the end
			 the following:</text>
						<quoted-block display-inline="no-display-inline" id="HC7966DD11B884D76836F03D2B459AB7" style="OLC">
							<section commented="no" display-inline="no-display-inline" id="HFBE84DB00BF642E5B2585DE6D9F4D5B3" section-type="subsequent-section"><enum>479B.</enum><header display-inline="yes-display-inline">Programs operated by Indian tribal
				organizations</header>
								<subsection id="H8EC63878BCF3485488F68028B40035A2"><enum>(a)</enum><header>Definitions of
				indian tribe; tribal organizations</header><text>In this section, the terms
				<term>Indian tribe</term> and <term>tribal organization</term> have the
				meanings given those terms in section 4 of the Indian Self-Determination and
				Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="H5FCCA87FEAA4489081F3F0E0D35024AC"><enum>(b)</enum><header display-inline="yes-display-inline">Authority</header><text>Except as otherwise
				provided in this section, this part shall apply in the same manner as this part
				applies to a State to an Indian tribe, tribal organization, or tribal
				consortium that elects to operate a program under this part and has a plan
				approved by the Secretary under section 471 in accordance with this
				section.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="H29661B7559E14854A3813BEE009CC3BA"><enum>(c)</enum><header>Plan
				requirements</header>
									<paragraph commented="no" display-inline="no-display-inline" id="HE0E6F14435A6428BB99C38AF29383011"><enum>(1)</enum><header>In
				general</header><text>An Indian tribe, tribal organization, or tribal
				consortium that elects to operate a program under this part shall include with
				its plan submitted under section 471 the following:</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="HBCFDD24137AB4C83B96FB038DAD85988"><enum>(A)</enum><header>Financial
				management</header><text>Evidence demonstrating that the tribe, organization,
				or consortium has not had any uncorrected significant or material audit
				exceptions under Federal grants or contracts that directly relate to the
				administration of social services for the 3-year period prior to the date on
				which the plan is submitted.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEDFDFC2F77D44246A879F1193EEB964"><enum>(B)</enum><header>Service areas and
				populations</header><text display-inline="yes-display-inline">For purposes of
				complying with section 471(a)(3), a description of the service area or areas
				and populations to be served under the plan and an assurance that the plan
				shall be in effect in all service area or areas and for all populations served
				by the tribe, organization, or consortium.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H29E2BA44355545CC98AB009604A008E"><enum>(C)</enum><header>Eligibility</header>
											<clause commented="no" display-inline="no-display-inline" id="H04FA604E696B4F1FBD30ED14A01C2CE"><enum>(i)</enum><header>In
				general</header><text>Subject to clause (ii) of this subparagraph, an assurance
				that the plan will provide—</text>
												<subclause commented="no" display-inline="no-display-inline" id="H6B6B3CE4303F4B1495D1D922889310F8"><enum>(I)</enum><text>foster care
				maintenance payments under section 472 only on behalf of children who satisfy
				the eligibility requirements of section 472(a);</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H57B93A5505504CFB982CB63362E0169E"><enum>(II)</enum><text>adoption
				assistance payments under section 473 pursuant to adoption assistance
				agreements only on behalf of children who satisfy the eligibility requirements
				for such payments under that section; and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="HD0CDD8A114B749EFBEA5864DA100E2D0"><enum>(III)</enum><text>at the option of
				the tribe, organization, or consortium, kinship guardianship assistance
				payments in accordance with section 473(d) only on behalf of children who meet
				the requirements of section 473(d)(3).</text>
												</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H007C9D19E13B434F93D7A1A931DD118F"><enum>(ii)</enum><header>Satisfaction of
				foster care eligibility requirements</header><text>For purposes of determining
				whether a child whose placement and care are the responsibility of an Indian
				tribe, tribal organization, or tribal consortium with a plan approved under
				section 471 in accordance with this section satisfies the requirements of
				section 472(a), the following shall apply:</text>
												<subclause commented="no" display-inline="no-display-inline" id="H24D3835B277142C48920B5EF12AB437C"><enum>(I)</enum><header display-inline="yes-display-inline">Use of affidavits, etc</header><text display-inline="yes-display-inline">Only with respect to the first 12 months
				for which such plan is in effect, the requirement in paragraph (1) of section
				472(a) shall not be interpreted so as to prohibit the use of affidavits or nunc
				pro tunc orders as verification documents in support of the reasonable efforts
				and contrary to the welfare of the child judicial determinations required under
				that paragraph.</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H1C9636954CF94ECCB535ADF4DEDB6B5"><enum>(II)</enum><header>AFDC eligibility
				requirement</header><text>The State plan approved under section 402 (as in
				effect on July 16, 1996) of the State in which the child resides at the time of
				removal from the home shall apply to the determination of whether the child
				satisfies section 472(a)(3).</text>
												</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H43470081E5C14461A6959F67EEAFACDE"><enum>(D)</enum><header>Option to claim
				in-kind expenditures from third-party sources for non-federal share of
				administrative and training costs during initial implementation
				period</header><text>Only for fiscal year quarters beginning after September
				30, 2009, and before October 1, 2014, a list of the in-kind expenditures (which
				shall be fairly evaluated, and may include plants, equipment, administration,
				or services) and the third-party sources of such expenditures that the tribe,
				organization, or consortium may claim as part of the non-Federal share of
				administrative or training expenditures attributable to such quarters for
				purposes of receiving payments under section 474(a)(3). The Secretary shall
				permit a tribe, organization, or consortium to claim in-kind expenditures from
				third party sources for such purposes during such quarters subject to the
				following:</text>
											<clause commented="no" display-inline="no-display-inline" id="H55C2EED459DF4CB9833EBC16216F2147"><enum>(i)</enum><header>No effect on
				authority for tribes, organizations, or consortia to claim expenditures or
				indirect costs to the same extent as States</header><text>Nothing in this
				subparagraph shall be construed as preventing a tribe, organization, or
				consortium from claiming any expenditures or indirect costs for purposes of
				receiving payments under section 474(a) that a State with a plan approved under
				section 471(a) could claim for such purposes.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H5B9557BD949442F28319675F8E2CB791"><enum>(ii)</enum><header>Fiscal year
				2010 or 2011</header>
												<subclause commented="no" display-inline="no-display-inline" id="HD897CCB89C274005A0484E385F9C807E"><enum>(I)</enum><header>Expenditures
				other than for training</header><text>With respect to amounts expended during a
				fiscal year quarter beginning after September 30, 2009, and before October 1,
				2011, for which the tribe, organization, or consortium is eligible for payments
				under subparagraph (C), (D), or (E) of section 474(a)(3), not more than 25
				percent of such amounts may consist of in-kind expenditures from third-party
				sources specified in the list required under this subparagraph to be submitted
				with the plan.</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H691863293F9D4D689B00A0FA44B3000"><enum>(II)</enum><header>Training
				expenditures</header><text>With respect to amounts expended during a fiscal
				year quarter beginning after September 30, 2009, and before October 1, 2011,
				for which the tribe, organization, or consortium is eligible for payments under
				subparagraph (A) or (B) of section 474(a)(3), not more than 12 percent of such
				amounts may consist of in-kind expenditures from third-party sources that are
				specified in such list and described in subclause (III).</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H64239C2E1E354658B7FCB255CF39E0BF"><enum>(III)</enum><header>Sources
				described</header><text>For purposes of subclause (II), the sources described
				in this subclause are the following:</text>
													<item commented="no" display-inline="no-display-inline" id="HA9655D116B1E4DE18668E7AC41A38F12"><enum>(aa)</enum><text>A State or local
				government.</text>
													</item><item commented="no" display-inline="no-display-inline" id="H3792C00D856448B99C3368819EC63652"><enum>(bb)</enum><text>An Indian tribe,
				tribal organization, or tribal consortium other than the tribe, organization,
				or consortium submitting the plan.</text>
													</item><item commented="no" display-inline="no-display-inline" id="H173D16E8D4F844F3869060136E1756FC"><enum>(cc)</enum><text>A public
				institution of higher education.</text>
													</item><item commented="no" display-inline="no-display-inline" id="H8F1F1F3BA5F2410D9D3416717EC04316"><enum>(dd)</enum><text>A Tribal College
				or University (as defined in section 316 of the Higher Education Act of 1965
				(<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>)).</text>
													</item><item commented="no" display-inline="no-display-inline" id="H711BFE4EEEDB41FD8E86B751005DB09E"><enum>(ee)</enum><text>A private
				charitable organization.</text>
													</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H8DABE12041C344DBB618AD446E6E0048"><enum>(iii)</enum><header>Fiscal year
				2012, 2013, or 2014</header>
												<subclause commented="no" display-inline="no-display-inline" id="H9E413231889B42F8A08516D907DA0F3"><enum>(I)</enum><header>In
				general</header><text>Except as provided in subclause (II) of this clause and
				clause (v) of this subparagraph, with respect to amounts expended during any
				fiscal year quarter beginning after September 30, 2011, and before October 1,
				2014, for which the tribe, organization, or consortium is eligible for payments
				under any subparagraph of section 474(a)(3) of this Act, the only in-kind
				expenditures from third-party sources that may be claimed by the tribe,
				organization, or consortium for purposes of determining the non-Federal share
				of such expenditures (without regard to whether the expenditures are specified
				on the list required under this subparagraph to be submitted with the plan) are
				in-kind expenditures that are specified in regulations promulgated by the
				Secretary under section 301(e)(2) of the Fostering Connections to Success and
				Increasing Adoptions Act of 2008 and are from an applicable third-party source
				specified in such regulations, and do not exceed the applicable percentage for
				claiming such in-kind expenditures specified in the regulations.</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="HCE10F636AF6C456DAC009B1754D27479"><enum>(II)</enum><header>Transition
				period for early approved tribes, organizations, or
				consortia</header><text>Subject to clause (v), if the tribe, organization, or
				consortium is an early approved tribe, organization, or consortium (as defined
				in subclause (III) of this clause), the Secretary shall not require the tribe,
				organization, or consortium to comply with such regulations before October 1,
				2013. Until the earlier of the date such tribe, organization, or consortium
				comes into compliance with such regulations or October 1, 2013, the limitations
				on the claiming of in-kind expenditures from third-party sources under clause
				(ii) shall continue to apply to such tribe, organization, or consortium
				(without regard to fiscal limitation) for purposes of determining the
				non-Federal share of amounts expended by the tribe, organization, or consortium
				during any fiscal year quarter that begins after September 30, 2011, and before
				such date of compliance or October 1, 2013, whichever is earlier.</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H6ADAFAD3E5F24824A0E031DB2EAEDE5"><enum>(III)</enum><header>Definition of
				early approved tribe, organization, or consortium</header><text>For purposes of
				subclause (II) of this clause, the term <term>early approved tribe,
				organization, or consortium</term> means an Indian tribe, tribal organization,
				or tribal consortium that had a plan approved under section 471 in accordance
				with this section for any quarter of fiscal year 2010 or 2011.</text>
												</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H6DBBD68CA58F4B958C4F54C8BC9BC3B8"><enum>(iv)</enum><header>Fiscal year
				2015 and thereafter</header><text>Subject to clause (v) of this subparagraph,
				with respect to amounts expended during any fiscal year quarter beginning after
				September 30, 2014, for which the tribe, organization, or consortium is
				eligible for payments under any subparagraph of section 474(a)(3) of this Act,
				in-kind expenditures from third-party sources may be claimed for purposes of
				determining the non-Federal share of expenditures under any subparagraph of
				such section 474(a)(3) only in accordance with the regulations promulgated by
				the Secretary under section 301(e)(2) of the Fostering Connections to Success
				and Increasing Adoptions Act of 2008.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H42F4C54998CC422ABA51A2A6E98097FA"><enum>(v)</enum><header>Contingency
				rule</header><text>If, at the time expenditures are made for a fiscal year
				quarter beginning after September 30, 2011, and before October 1, 2014, for
				which a tribe, organization, or consortium may receive payments for under
				section 474(a)(3) of this Act, no regulations required to be promulgated under
				section 301(e)(2) of the Fostering Connections to Success and Increasing
				Adoptions Act of 2008 are in effect, and no legislation has been enacted
				specifying otherwise—</text>
												<subclause commented="no" display-inline="no-display-inline" id="H1D87307D5DED421B99B27E52EC4FED62"><enum>(I)</enum><text>in the case of any
				quarter of fiscal year 2012, 2013, or 2014, the limitations on claiming in-kind
				expenditures from third-party sources under clause (ii) of this subparagraph
				shall apply (without regard to fiscal limitation) for purposes of determining
				the non-Federal share of such expenditures; and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H654AB44DF1C64C0E9CDF5D53022B74B5"><enum>(II)</enum><text>in the case of
				any quarter of fiscal year 2015 or any fiscal year thereafter, no tribe,
				organization, or consortium may claim in-kind expenditures from third-party
				sources for purposes of determining the non-Federal share of such expenditures
				if a State with a plan approved under section 471(a) of this Act could not
				claim in-kind expenditures from third-party sources for such purposes.</text>
												</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H531EB3972C7C45859221B63E8003A5D"><enum>(2)</enum><header>Clarification of
				tribal authority to establish standards for tribal foster family homes and
				tribal child care institutions</header><text>For purposes of complying with
				section 471(a)(10), an Indian tribe, tribal organization, or tribal consortium
				shall establish and maintain a tribal authority or authorities which shall be
				responsible for establishing and maintaining tribal standards for tribal foster
				family homes and tribal child care institutions.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H489E44C69EA942F8BE3FCAFA01F5C100"><enum>(3)</enum><header display-inline="yes-display-inline">Consortium</header><text display-inline="yes-display-inline">The participating Indian tribes or tribal
				organizations of a tribal consortium may develop and submit a single plan under
				section 471 that meets the requirements of this section.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC427489020C34245B972BC8FA993E50"><enum>(d)</enum><header display-inline="yes-display-inline">Determination of Federal medical assistance
				percentage for foster care maintenance and adoption assistance
				payments</header>
									<paragraph commented="no" display-inline="no-display-inline" id="HA06F266B85B342E6A562868B492B72B9"><enum>(1)</enum><header display-inline="yes-display-inline">Per capita income</header><text display-inline="yes-display-inline">For purposes of determining the Federal
				medical assistance percentage applicable to an Indian tribe, a tribal
				organization, or a tribal consortium under paragraphs (1), (2), and (5) of
				section 474(a), the calculation of the per capita income of the Indian tribe,
				tribal organization, or tribal consortium shall be based upon the service
				population of the Indian tribe, tribal organization, or tribal consortium,
				except that in no case shall an Indian tribe, a tribal organization, or a
				tribal consortium receive less than the Federal medical assistance percentage
				for any State in which the tribe, organization, or consortium is
				located.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB4A644EAA2F64635BE7B6E5FE3689B58"><enum>(2)</enum><header display-inline="yes-display-inline">Consideration of other
				information</header><text display-inline="yes-display-inline">Before making a
				calculation under paragraph (1), the Secretary shall consider any information
				submitted by an Indian tribe, a tribal organization, or a tribal consortium
				that the Indian tribe, tribal organization, or tribal consortium considers
				relevant to making the calculation of the per capita income of the Indian
				tribe, tribal organization, or tribal consortium.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8D781EE0DE604045BA899C765E3889DB"><enum>(e)</enum><header display-inline="yes-display-inline">Nonapplication to cooperative agreements
				and contracts</header><text>Any cooperative agreement or contract entered into
				between an Indian tribe, a tribal organization, or a tribal consortium and a
				State for the administration or payment of funds under this part that is in
				effect as of the date of enactment of this section shall remain in full force
				and effect, subject to the right of either party to the agreement or contract
				to revoke or modify the agreement or contract pursuant to the terms of the
				agreement or contract. Nothing in this section shall be construed as affecting
				the authority for an Indian tribe, a tribal organization, or a tribal
				consortium and a State to enter into a cooperative agreement or contract for
				the administration or payment of funds under this part.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="HBE7CFD415138498FA8007FE9D4C8DCE1"><enum>(f)</enum><header display-inline="yes-display-inline">John H. Chafee Foster Care Independence
				Program</header><text display-inline="yes-display-inline">Except as provided in
				section 477(j), subsection (b) of this section shall not apply with respect to
				the John H. Chafee Foster Care Independence Program established under section
				477 (or with respect to payments made under section 474(a)(4) or grants made
				under section 474(e)).</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="H2044A9C692FD46EFA2FC6CD12E962100"><enum>(g)</enum><header>Rule of
				construction</header><text display-inline="yes-display-inline">Nothing in this
				section shall be construed as affecting the application of section 472(h) to a
				child on whose behalf payments are paid under section 472, or the application
				of section 473(b) to a child on whose behalf payments are made under section
				473 pursuant to an adoption assistance agreement or a kinship guardianship
				assistance agreement, by an Indian tribe, tribal organization, or tribal
				consortium that elects to operate a foster care and adoption assistance program
				in accordance with this
				section.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40E560E4519842A6867F87D7A85521F"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Section 472(a)(2)(B) of such Act (42 U.S.C.
			 672(a)(2)(B)) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H2700CC543DE54CF39D17D2005D1981A4"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking
			 <quote>or</quote> at the end;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBFC8579B049B4A48BF1B8EE9D6406CE"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii), by striking
			 <quote>and</quote> at the end and inserting <quote>or</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H507DAF0C54FD4F13B239D0CF3CA7CF74"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H66DBC3119CE94036B782EF432B06E761" style="OLC">
								<clause commented="no" display-inline="no-display-inline" id="HE0DE98D398BD45DBA233C866E9B871A0"><enum>(iii)</enum><text display-inline="yes-display-inline">an Indian tribe or a tribal organization
				(as defined in section 479B(a)) or a tribal consortium that has a plan approved
				under section 471 in accordance with section 479B;
				and</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE6C5067B7F704740AB8015B89075FAE7"><enum>(b)</enum><header display-inline="yes-display-inline">Authority To receive portion of State
			 allotment as part of an agreement to operate the John H. Chafee Foster Care
			 Independence Program</header><text display-inline="yes-display-inline">Section
			 477 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H883107186D4C47AB823095A8E9854CFD" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="HBD6E8D730F74494BB1F69DBD4F00D150"><enum>(j)</enum><header display-inline="yes-display-inline">Authority for an Indian tribe, tribal
				organization, or tribal consortium To receive an allotment</header>
							<paragraph commented="no" display-inline="no-display-inline" id="HFA942EB18B9F4616804767B26F39619C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An Indian tribe, tribal organization, or
				tribal consortium with a plan approved under section 479B, or which is
				receiving funding to provide foster care under this part pursuant to a
				cooperative agreement or contract with a State, may apply for an allotment out
				of any funds authorized by paragraph (1) or (2) (or both) of subsection (h) of
				this section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H250B4A52A86E4F25B3CC469CF8975688"><enum>(2)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">A tribe, organization, or consortium
				desiring an allotment under paragraph (1) of this subsection shall submit an
				application to the Secretary to directly receive such allotment that includes a
				plan which—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H152858DE3EDA493EA9084D609DEAEB25"><enum>(A)</enum><text display-inline="yes-display-inline">satisfies such requirements of paragraphs
				(2) and (3) of subsection (b) as the Secretary determines are
				appropriate;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0E39C3C82BC445E99EF7C2CF5E7B35C6"><enum>(B)</enum><text display-inline="yes-display-inline">contains a description of the tribe's,
				organization's, or consortium's consultation process regarding the programs to
				be carried out under the plan with each State for which a portion of an
				allotment under subsection (c) would be redirected to the tribe, organization,
				or consortium; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFE7BF545A2A44FB1BC5D05DD1E5B3D19"><enum>(C)</enum><text>contains an
				explanation of the results of such consultation, particularly with respect
				to—</text>
									<clause commented="no" display-inline="no-display-inline" id="H37CDDBF07D124EC1B23409F730FC47AB"><enum>(i)</enum><text>determining the
				eligibility for benefits and services of Indian children to be served under the
				programs to be carried out under the plan; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HD3E351EE002B485DAC093E5B8BA9DABD"><enum>(ii)</enum><text>the process for
				consulting with the State in order to ensure the continuity of benefits and
				services for such children who will transition from receiving benefits and
				services under programs carried out under a State plan under subsection (b)(2)
				to receiving benefits and services under programs carried out under a plan
				under this subsection.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H13272B93D95749EE9CEA4BF41DC1C69F"><enum>(3)</enum><header display-inline="yes-display-inline">Payments</header><text display-inline="yes-display-inline">The Secretary shall pay an Indian tribe,
				tribal organization, or tribal consortium with an application and plan approved
				under this subsection from the allotment determined for the tribe,
				organization, or consortium under paragraph (4) of this subsection in the same
				manner as is provided in section 474(a)(4) (and, where requested, and if funds
				are appropriated, section 474(e)) with respect to a State, or in such other
				manner as is determined appropriate by the Secretary, except that in no case
				shall an Indian tribe, a tribal organization, or a tribal consortium receive a
				lesser proportion of such funds than a State is authorized to receive under
				those sections.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8FA656536C264B2BBD711C4CAFDF74E1"><enum>(4)</enum><header display-inline="yes-display-inline">Allotment</header><text display-inline="yes-display-inline">From the amounts allotted to a State under
				subsection (c) of this section for a fiscal year, the Secretary shall allot to
				each Indian tribe, tribal organization, or tribal consortium with an
				application and plan approved under this subsection for that fiscal year an
				amount equal to the tribal foster care ratio determined under paragraph (5) of
				this subsection for the tribe, organization, or consortium multiplied by the
				allotment amount of the State within which the tribe, organization, or
				consortium is located. The allotment determined under this paragraph is deemed
				to be a part of the allotment determined under section 477(c) for the State in
				which the Indian tribe, tribal organization, or tribal consortium is
				located.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA818437F546E49878FB44E8B27EA6C7F"><enum>(5)</enum><header display-inline="yes-display-inline">Tribal foster care ratio</header><text display-inline="yes-display-inline">For purposes of paragraph (4), the tribal
				foster care ratio means, with respect to an Indian tribe, tribal organization,
				or tribal consortium, the ratio of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H6ABD5F23E6B7431A9E53F4EDFDE0DE10"><enum>(A)</enum><text display-inline="yes-display-inline">the number of children in foster care under
				the responsibility of the Indian tribe, tribal organization, or tribal
				consortium (either directly or under supervision of the State), in the most
				recent fiscal year for which the information is available; to</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1D8F4B0E1B6C43E9BDB9009D49CB26C6"><enum>(B)</enum><text display-inline="yes-display-inline">the sum of—</text>
									<clause commented="no" display-inline="no-display-inline" id="H64A5A5511A7544A5860062EE72129DF6"><enum>(i)</enum><text display-inline="yes-display-inline">the total number of children in foster care
				under the responsibility of the State within which the Indian tribe, tribal
				organization, or tribal consortium is located; and</text>
									</clause><clause id="H337C43BF50A741F7A17DC8A9E0551E3D"><enum>(ii)</enum><text>the total number
				of children in foster care under the responsibility of all Indian tribes,
				tribal organizations, or tribal consortia in the State (either directly or
				under supervision of the State) that have a plan approved under this
				subsection.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HB3CC8F2A46C6497BAAE6B2F33430115B"><enum>(c)</enum><header>State and tribal
			 cooperation</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H8CFBD2E2D3C44934BA9316C85200E8C0"><enum>(1)</enum><header>State plan
			 requirement to negotiate in good faith</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="HC31D22AE045E4019BCD442E637245206"><enum>(A)</enum><header>In
			 general</header><text>Section 471(a) of the Social Security Act (42 U.S.C.
			 671(a)), as amended by sections 101(a), 103, 204(b), and 206 of this Act, is
			 amended—</text>
							<clause id="H506BD983EFF74C6F96D044EBCA3C3402"><enum>(i)</enum><text>by
			 striking <quote>and</quote> at the end of paragraph (30);</text>
							</clause><clause id="HFA67D1D404E9451EBF02AF788F71EEE0"><enum>(ii)</enum><text>by
			 striking the period at the end of paragraph (31) and inserting <quote>;
			 and</quote>; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H3C749A30E10145E681DD9239042D6039"><enum>(iii)</enum><text>by adding at the
			 end the following:</text>
								<quoted-block display-inline="no-display-inline" id="H814BBBFB83E7495BA13338BA45A55F93" style="OLC">
									<paragraph commented="no" display-inline="no-display-inline" id="HB0AB8DF6A615478FA01E8CD580FCA36D"><enum>(32)</enum><text>provides that the
				State will negotiate in good faith with any Indian tribe, tribal organization
				or tribal consortium in the State that requests to develop an agreement with
				the State to administer all or part of the program under this part on behalf of
				Indian children who are under the authority of the tribe, organization, or
				consortium, including foster care maintenance payments on behalf of children
				who are placed in State or tribally licensed foster family homes, adoption
				assistance payments, and, if the State has elected to provide such payments,
				kinship guardianship assistance payments under section 473(d), and tribal
				access to resources for administration, training, and data collection under
				this
				part.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBB577B2ED8C84196B1D8CACBEEF3947"><enum>(B)</enum><header display-inline="yes-display-inline">Chafee program conforming
			 amendment</header><text display-inline="yes-display-inline">Section
			 477(b)(3)(G) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677(b)(3)(G)</external-xref>) is amended—</text>
							<clause commented="no" display-inline="no-display-inline" id="H5A3049293D464F98A03343D61F4C00BE"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>and that</quote> and
			 inserting <quote>that</quote>; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H5B88524657954F73ACC75F1690483BF8"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking the period at the end and
			 inserting <quote>; and that the State will negotiate in good faith with any
			 Indian tribe, tribal organization, or tribal consortium in the State that does
			 not receive an allotment under subsection (j)(4) for a fiscal year and that
			 requests to develop an agreement with the State to administer, supervise, or
			 oversee the programs to be carried out under the plan with respect to the
			 Indian children who are eligible for such programs and who are under the
			 authority of the tribe, organization, or consortium and to receive from the
			 State an appropriate portion of the State allotment under subsection (c) for
			 the cost of such administration, supervision, or oversight.</quote>.</text>
							</clause></subparagraph></paragraph><paragraph id="H2F06E96AC8CA48FA95F700CB6D8993F0"><enum>(2)</enum><header>Application of
			 tribal Federal matching rate to cooperative agreements or contracts between
			 State or tribes</header><text>Paragraphs (1) and (2) of section 474(a) of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)</external-xref>) are each amended by inserting <quote>(or, with respect
			 to such payments made during such quarter under a cooperative agreement or
			 contract entered into by the State and an Indian tribe, tribal organization, or
			 tribal consortium for the administration or payment of funds under this part,
			 an amount equal to the Federal medical assistance percentage that would apply
			 under section 479B(d) (in this paragraph referred to as the <quote>tribal
			 FMAP</quote>) if such Indian tribe, tribal organization, or tribal consortium
			 made such payments under a program operated under that section, unless the
			 tribal FMAP is less than the Federal medical assistance percentage that applies
			 to the State)</quote> before the semicolon.</text>
					</paragraph></subsection><subsection id="HC537291697E9460B883EDF20A25671F2"><enum>(d)</enum><header>Rules of
			 construction</header><text>Nothing in the amendments made by this section shall
			 be construed as—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H87C6841171C94A31A87E5F23AF8D9796"><enum>(1)</enum><text display-inline="yes-display-inline">authorization to terminate funding on
			 behalf of any Indian child receiving foster care maintenance payments or
			 adoption assistance payments on the date of enactment of this Act and for which
			 the State receives Federal matching payments under paragraph (1) or (2) of
			 section 474(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)</external-xref>), regardless of
			 whether a cooperative agreement or contract between the State and an Indian
			 tribe, tribal organization, or tribal consortium is in effect on such date or
			 an Indian tribe, tribal organization, or tribal consortium elects subsequent to
			 such date to operate a program under section 479B of such Act (as added by
			 subsection (a) of this section); or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8FACCED643BC4339BC7C00E4120CDAA"><enum>(2)</enum><text>affecting the
			 responsibility of a State—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H2402CCB352FC4C229DFAA8758FD89B09"><enum>(A)</enum><text>as part of the
			 plan approved under section 471 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671</external-xref>), to
			 provide foster care maintenance payments, adoption assistance payments, and if
			 the State elects, kinship guardianship assistance payments, for Indian children
			 who are eligible for such payments and who are not otherwise being served by an
			 Indian tribe, tribal organization, or tribal consortium pursuant to a program
			 under such section 479B of such Act or a cooperative agreement or contract
			 entered into between an Indian tribe, a tribal organization, or a tribal
			 consortium and a State for the administration or payment of funds under part E
			 of title IV of such Act; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF8D5B64655A145C4AE3DB1DDE8E74CA9"><enum>(B)</enum><text display-inline="yes-display-inline">as part of the plan approved under section
			 477 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) to administer, supervise, or oversee programs
			 carried out under that plan on behalf of Indian children who are eligible for
			 such programs if such children are not otherwise being served by an Indian
			 tribe, tribal organization, or tribal consortium pursuant to an approved plan
			 under section 477(j) of such Act or a cooperative agreement or contract entered
			 into under section 477(b)(3)(G) of such Act.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF7F62D65AE204F7980F37F41F5A0A5E6"><enum>(e)</enum><header display-inline="yes-display-inline">Regulations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H34C2E6991B6342ABB5EEC0A9E751C74B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (2) of this subsection, not later than 1 year after the date of
			 enactment of this section, the Secretary of Health and Human Services, in
			 consultation with Indian tribes, tribal organizations, tribal consortia, and
			 affected States, shall promulgate interim final regulations to carry out this
			 section and the amendments made by this section. Such regulations shall include
			 procedures to ensure that a transfer of responsibility for the placement and
			 care of a child under a State plan approved under section 471 of the Social
			 Security Act to a tribal plan approved under section 471 of such Act in
			 accordance with section 479B of such Act (as added by subsection (a)(1) of this
			 section) or to an Indian tribe, a tribal organization, or a tribal consortium
			 that has entered into a cooperative agreement or contract with a State for the
			 administration or payment of funds under part E of title IV of such Act does
			 not affect the eligibility of, provision of services for, or the making of
			 payments on behalf of, such children under part E of title IV of such Act, or
			 the eligibility of such children for medical assistance under title XIX of such
			 Act.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H56319760A89E436FB5A303709498AFE5"><enum>(2)</enum><header>In-kind
			 expenditures from third-party sources for purposes of determining non-federal
			 share of administrative and training expenditures</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H34C7B87773DF4DF79398034964D4C34C"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B) of this paragraph, not later
			 than September 30, 2011, the Secretary of Health and Human Services, in
			 consultation with Indian tribes, tribal organizations, and tribal consortia,
			 shall promulgate interim final regulations specifying the types of in-kind
			 expenditures, including plants, equipment, administration, and services, and
			 the third-party sources for such in-kind expenditures which may be claimed by
			 tribes, organizations, and consortia with plans approved under section 471 of
			 the Social Security Act in accordance with section 479B of such Act, up to such
			 percentages as the Secretary, in such consultation shall specify in such
			 regulations, for purposes of determining the non-Federal share of
			 administrative and training expenditures for which the tribes, organizations,
			 and consortia may receive payments for under any subparagraph of section
			 474(a)(3) of such Act.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1A40CB1551F944C691E2913DFA0726DC"><enum>(B)</enum><header>Effective
			 date</header><text>In no event shall the regulations required to be promulgated
			 under subparagraph (A) take effect prior to October 1, 2011.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H706E6C161DA44A8CB55FB0003D555BCB"><enum>(C)</enum><header>Sense of the
			 Congress</header><text>It is the sense of the Congress that if the Secretary of
			 Health and Human Services fails to publish in the Federal Register the
			 regulations required under subparagraph (A) of this paragraph, the Congress
			 should enact legislation specifying the types of in-kind expenditures and the
			 third-party sources for such in-kind expenditures which may be claimed by
			 tribes, organizations, and consortia with plans approved under section 471 of
			 the Social Security Act in accordance with section 479B of such Act, up to
			 specific percentages, for purposes of determining the non-Federal share of
			 administrative and training expenditures for which the tribes, organizations,
			 and consortia may receive payments for under any subparagraph of section
			 474(a)(3) of such Act.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3361971AF18C48F3B83543F1D8E9186"><enum>(f)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsections (a), (b), and (c) shall take effect on October 1, 2009, without
			 regard to whether the regulations required under subsection (e)(1) have been
			 promulgated by such date.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HE06E87F515EB4A719595A2E8301CE442" section-type="subsequent-section"><enum>302.</enum><header>Technical assistance
			 and implementation</header><text display-inline="no-display-inline">Section 476
			 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/676">42 U.S.C. 676</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H380BA567CFB646D99324007320787144" style="OLC">
					<subsection id="HBFBE955CEA104CA999B2E76CC68E0014"><enum>(c)</enum><header>Technical
				assistance and implementation services for tribal programs</header>
						<paragraph id="H0CEE59B1992E418A9B8C51D74FB9CDBB"><enum>(1)</enum><header>Authority</header><text>The
				Secretary shall provide technical assistance and implementation services that
				are dedicated to improving services and permanency outcomes for Indian children
				and their families through the provision of assistance described in paragraph
				(2).</text>
						</paragraph><paragraph id="H4EE3E4FECAA84160A682AB8C92802F00"><enum>(2)</enum><header>Assistance
				provided</header>
							<subparagraph id="HB9345D75E66245F596A324BC479071D6"><enum>(A)</enum><header>In
				general</header><text>The technical assistance and implementation services
				shall be to—</text>
								<clause id="H2F22ED0A942B44EBB200EECEC119BDBF"><enum>(i)</enum><text>provide
				information, advice, educational materials, and technical assistance to Indian
				tribes and tribal organizations with respect to the types of services,
				administrative functions, data collection, program management, and reporting
				that are required under State plans under part B and this part;</text>
								</clause><clause id="H4A8E3A4CA2484065A6EB3EE5653142D5"><enum>(ii)</enum><text>assist and
				provide technical assistance to—</text>
									<subclause id="H730837037EFF41B9A803A2CD908E8000"><enum>(I)</enum><text>Indian tribes,
				tribal organizations, and tribal consortia seeking to operate a program under
				part B or under this part through direct application to the Secretary under
				section 479B; and</text>
									</subclause><subclause id="HE18E41D76ED8441ABCADA35102217864"><enum>(II)</enum><text>Indian tribes,
				tribal organizations, tribal consortia, and States seeking to develop
				cooperative agreements to provide for payments under this part or satisfy the
				requirements of section 422(b)(9), 471(a)(32), or 477(b)(3)(G); and</text>
									</subclause></clause><clause id="H5140F4D0D84646CA927710465F7DE723"><enum>(iii)</enum><text>subject to
				subparagraph (B), make one-time grants, to tribes, tribal organizations, or
				tribal consortia that are seeking to develop, and intend, not later than 24
				months after receiving such a grant to submit to the Secretary a plan under
				section 471 to implement a program under this part as authorized by section
				479B, that shall—</text>
									<subclause id="H261748D8B9D840E69C7F4D11DB2D288C"><enum>(I)</enum><text>not exceed
				$300,000; and</text>
									</subclause><subclause id="H4CAE445FE3324F27A166A2B8609E907B"><enum>(II)</enum><text>be used for the
				cost of developing a plan under section 471 to carry out a program under
				section 479B, including costs related to development of necessary data
				collection systems, a cost allocation plan, agency and tribal court procedures
				necessary to meet the case review system requirements under section 475(5), or
				any other costs attributable to meeting any other requirement necessary for
				approval of such a plan under this part.</text>
									</subclause></clause></subparagraph><subparagraph id="H5B4209D800F342D7B20095C095F7D9AE"><enum>(B)</enum><header>Grant
				condition</header>
								<clause id="HDED849A5ED3E4808B825305B2352A8C8"><enum>(i)</enum><header>In
				general</header><text>As a condition of being paid a grant under subparagraph
				(A)(iii), a tribe, tribal organization, or tribal consortium shall agree to
				repay the total amount of the grant awarded if the tribe, tribal organization,
				or tribal consortium fails to submit to the Secretary a plan under section 471
				to carry out a program under section 479B by the end of the 24-month period
				described in that subparagraph.</text>
								</clause><clause id="H1003EED8FE7E4ADEB5B4E39BBF7DFE44"><enum>(ii)</enum><header>Exception</header><text>The
				Secretary shall waive the requirement to repay a grant imposed by clause (i) if
				the Secretary determines that a tribe's, tribal organization's, or tribal
				consortium's failure to submit a plan within such period was the result of
				circumstances beyond the control of the tribe, tribal organization, or tribal
				consortium.</text>
								</clause></subparagraph><subparagraph id="H0529D1D1B46945A5BA51D55005B4F51"><enum>(C)</enum><header>Implementation
				authority</header><text>The Secretary may provide the technical assistance and
				implementation services described in subparagraph (A) either directly or
				through a grant or contract with public or private organizations knowledgeable
				and experienced in the field of Indian tribal affairs and child welfare.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A38169C93454F0684782BE872FBD1D0"><enum>(3)</enum><header display-inline="yes-display-inline">Appropriation</header><text display-inline="yes-display-inline">There is appropriated to the Secretary, out
				of any money in the Treasury of the United States not otherwise appropriated,
				$3,000,000 for fiscal year 2009 and each fiscal year thereafter to carry out
				this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="HB56658EE57974D3CB94FEAD8AFE1206E"><enum>IV</enum><header>Improvement of
			 incentives for adoption</header>
			<section display-inline="no-display-inline" id="HD6E73969723D4FEA00556500C131E9C6" section-type="subsequent-section"><enum>401.</enum><header>Adoption incentives
			 program</header>
				<subsection id="HC1C2A9C3AAB54AA79269004333F4706F"><enum>(a)</enum><header>5-year
			 extension</header><text>Section 473A of the Social Security Act (42 U.S.C.
			 673b) is amended—</text>
					<paragraph id="H9D76258BD1144BFFA4E298B5F9D068E4"><enum>(1)</enum><text>in subsection
			 (b)(4), by striking <quote>in the case of fiscal years 2001 through
			 2007,</quote>;</text>
					</paragraph><paragraph id="HBE565234A36941F5AD0097102F4D7BCA"><enum>(2)</enum><text>in subsection
			 (b)(5), by striking <quote>1998 through 2007</quote> and inserting <quote>2008
			 through 2012</quote>;</text>
					</paragraph><paragraph id="H0E40EE2201D24B24B09026FBFFBED970"><enum>(3)</enum><text>in subsection
			 (c)(2), by striking <quote>each of fiscal years 2002 through 2007</quote> and
			 inserting <quote>a fiscal year</quote>; and</text>
					</paragraph><paragraph id="HB7E0C4D85DB14C81A64BC0C8545D2E98"><enum>(4)</enum><text>in each of
			 subsections (h)(1)(D), and (h)(2), by striking <quote>2008</quote> and
			 inserting <quote>2013</quote>.</text>
					</paragraph></subsection><subsection id="H2C84210057C14A26A6F9DAB9C42CD419"><enum>(b)</enum><header>Updating of
			 fiscal year used in determining base numbers of adoptions</header><text>Section
			 473A(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(g)</external-xref>) is amended—</text>
					<paragraph id="H13B7C5F240A0428FAD6F07D8ACA468CC"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>means</quote> and all that follows and inserting
			 <quote>means, with respect to any fiscal year, the number of foster child
			 adoptions in the State in fiscal year 2007.</quote>;</text>
					</paragraph><paragraph id="H4915A4D0BA6046A1BEA2492F3D48624E"><enum>(2)</enum><text>in paragraph
			 (4)—</text>
						<subparagraph id="HD3F221FE344743C5806BFEC8CD23A616"><enum>(A)</enum><text>by inserting
			 <quote>that are not older child adoptions</quote> before <quote>for a
			 State</quote>; and</text>
						</subparagraph><subparagraph id="HB161560964364B529E897054D818B53B"><enum>(B)</enum><text>by striking
			 <quote>means</quote> and all that follows and inserting <quote>means, with
			 respect to any fiscal year, the number of special needs adoptions that are not
			 older child adoptions in the State in fiscal year 2007.</quote>; and</text>
						</subparagraph></paragraph><paragraph id="HFDD5FCE54403485AAE70AFAB783EB74C"><enum>(3)</enum><text>in paragraph (5),
			 by striking <quote>means</quote> and all that follows and inserting
			 <quote>means, with respect to any fiscal year, the number of older child
			 adoptions in the State in fiscal year 2007.</quote>.</text>
					</paragraph></subsection><subsection id="HBA93262B2B234DA19256D37C00425829"><enum>(c)</enum><header>Increase in
			 incentive payments for special needs adoptions and older child
			 adoptions</header><text>Section 473A(d)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(d)(1)</external-xref>)
			 is amended—</text>
					<paragraph id="H2C5643ABB4FF4E9A00E6735C55E14FB5"><enum>(1)</enum><text>in subparagraph
			 (B), by striking <quote>$2,000</quote> and inserting <quote>$4,000</quote>;
			 and</text>
					</paragraph><paragraph id="HDC87B6F7D7684FEAA12CF1CE0460C13D"><enum>(2)</enum><text>in subparagraph
			 (C), by striking <quote>$4,000</quote> and inserting
			 <quote>$8,000</quote>.</text>
					</paragraph></subsection><subsection id="HCC1628E3E47E445890912CF3BDC7E3E9"><enum>(d)</enum><header>24-month
			 availability of payments to States</header><text>Section 473A(e) of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(e)</external-xref>) is amended—</text>
					<paragraph id="H44292D4659CD42F4A0CA4005707BB89C"><enum>(1)</enum><text>in the heading, by
			 striking <quote><header-in-text level="subsection" style="OLC">2-year</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">24-month</header-in-text></quote>; and</text>
					</paragraph><paragraph id="H62344E66432A4997A3BB00D511009FE3"><enum>(2)</enum><text>by striking
			 <quote>through the end of the succeeding fiscal year</quote> and inserting
			 <quote>for the 24-month period beginning with the month in which the payments
			 are made</quote>.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H3C934CA734EB41B8B91DEFF21B8E9DFC"><enum>(e)</enum><header>Additional
			 incentive payment for exceeding the highest ever foster child adoption
			 rate</header>
					<paragraph id="HE67906CB6EFF458CACC044D1691325B9"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 473A(d) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(d)</external-xref>) is amended—</text>
						<subparagraph id="H892A496157F5422FBA009F48213DDB21"><enum>(A)</enum><text>in paragraph (1),
			 in the matter preceding subparagraph (A), by striking <quote>paragraph
			 (2)</quote> and inserting <quote>paragraphs (2) and (3)</quote>;</text>

										<clause id="H755797AA5E4E4091820048163566D4EC"><enum>(i)</enum><text>for fiscal year
				2009 or any fiscal year thereafter the total amount of adoption incentive
				payments payable under paragraph (1) of this subsection are less than the
				amount appropriated under subsection (h) for the fiscal year; and</text>
										</clause><clause id="HD83D584355A34368821FAFC7805218D8"><enum>(ii)</enum><text>a
				State's foster child adoption rate for that fiscal year exceeds the highest
				ever foster child adoption rate determined for the State,</text>
										</clause><continuation-text continuation-text-level="subparagraph">then
				the adoption incentive payment otherwise determined under paragraph (1) of this
				subsection for the State shall be increased, subject to subparagraph (C) of
				this paragraph, by the amount determined for the State under subparagraph (B)
				of this paragraph.</continuation-text></subparagraph><subparagraph id="H09F230A277C94569A2BD3119301E2786"><enum>(B)</enum><header>Amount of
				increase</header><text>For purposes of subparagraph (A), the amount determined
				under this subparagraph with respect to a State and a fiscal year is the amount
				equal to the product of—</text>
										<clause id="HF9B65292A99443980000A1689201510"><enum>(i)</enum><text>$1,000; and</text>
										</clause><clause id="HBB136CC189FB4D819CF0700736706A7"><enum>(ii)</enum><text>the excess
				of—</text>
											<subclause id="H16495941E2174D2CA9042B5D82A6836"><enum>(I)</enum><text>the number of
				foster child adoptions in the State in the fiscal year; over</text>

				number of children in foster care under the supervision of the State on the
				last day of the preceding fiscal year.</text>
												</item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3F64FA93FD044081B0EB4532E0CC8D15"><enum>(C)</enum><header>Pro rata
				adjustment if insufficient funds available</header><text>For any fiscal year,
				if the total amount of increases in adoption incentive payments otherwise
				payable under this paragraph for a fiscal year exceeds the amount available for
				such increases for the fiscal year, the amount of the increase payable to each
				State under this paragraph for the fiscal year shall be—</text>
										<clause commented="no" display-inline="no-display-inline" id="HE71924C0F4B44F27BC6FF66E9283F1A3"><enum>(i)</enum><text>the amount of the
				increase that would otherwise be payable to the State under this paragraph for
				the fiscal year; multiplied by</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H270F8306B83442F087ECB2FFB7AD7004"><enum>(ii)</enum><text>the percentage
				represented by the amount so available for the fiscal year, divided by the
				total amount of increases otherwise payable under this paragraph for the fiscal
				year.</text>

						</subparagraph></paragraph><paragraph id="H144D79A08E87418A8C51C6C93279F1F4"><enum>(2)</enum><header>Definitions</header><text>Section
			 473A(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(g)</external-xref>) is amended by adding at the end the
			 following:</text>

							<paragraph id="H741E1A853BB44BC7B3BD97DB37F82D7E"><enum>(7)</enum><header>Highest ever
				foster child adoption rate</header><text>The term <term>highest ever foster
				child adoption rate</term> means, with respect to any fiscal year, the highest
				foster child adoption rate determined for any fiscal year in the period that
				begins with fiscal year 2002 and ends with the preceding fiscal year.</text>
							</paragraph><paragraph id="HC1A952B7F05D44E8A63B00C120215DB7"><enum>(8)</enum><header>Foster child
				adoption rate</header><text>The term <term>foster child adoption rate</term>
				means, with respect to a State and a fiscal year, the percentage determined by
				dividing—</text>
								<subparagraph id="H32166BB75F084900A654E65FCFA8323D"><enum>(A)</enum><text>the number of
				foster child adoptions finalized in the State during the fiscal year; by</text>
								</subparagraph><subparagraph id="HE1F45B80EFF94FCBBB159D1ED8772EEF"><enum>(B)</enum><text>the number of
				children in foster care under the supervision of the State on the last day of
				the preceding fiscal
				year.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

												<subitem commented="no" display-inline="no-display-inline" id="H49C3669755BB4EAA8F3BBFFCB26F00B1" indent="up1"><enum>(AA)</enum><text display-inline="yes-display-inline">an involuntary removal of the child from
				the home in accordance with a judicial determination to the effect that
				continuation in the home would be contrary to the welfare of the child;
				or</text>
												</subitem><subitem commented="no" display-inline="no-display-inline" id="H5276393CD5AD4D42B3C96ED4E8B6A4BC" indent="up1"><enum>(BB)</enum><text>a
				voluntary placement agreement or voluntary relinquishment;</text>
												</subitem></item><item commented="no" display-inline="no-display-inline" id="H9ACDD8A0615248AE87DF7B89A700C37B" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">meets all medical or disability
				requirements of title XVI with respect to eligibility for supplemental security
				income benefits; or</text>
											</item><item commented="no" display-inline="no-display-inline" id="H72491B01ECAE45B9B446A02EB6DC224" indent="up1"><enum>(cc)</enum><text display-inline="yes-display-inline">was residing in a foster family home or
				child care institution with the child’s minor parent, and the child's minor
				parent was in such foster family home or child care institution pursuant
				to—</text>
												<subitem commented="no" display-inline="no-display-inline" id="HB605C84F6F6C4DD69E8D42F3A65042D0"><enum>(AA)</enum><text display-inline="yes-display-inline">an involuntary removal of the child from
				the home in accordance with a judicial determination to the effect that
				continuation in the home would be contrary to the welfare of the child;
				or</text>
												</subitem><subitem commented="no" display-inline="no-display-inline" id="H5DD43E11F5FC4FFBB22BA680055CC200"><enum>(BB)</enum><text>a
				voluntary placement agreement or voluntary relinquishment; and</text>
												</subitem></item></subclause><subclause commented="no" display-inline="no-display-inline" id="HB5345B48317141E9A9465B244FD2B57"><enum>(II)</enum><text display-inline="yes-display-inline">has been determined by the State, pursuant
				to subsection (c)(2), to be a child with special
				needs.</text>
										</subclause></clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HFE9CE45A5A444FA4BE7642D974F2457C"><enum>(ii)</enum><text>in subparagraph
			 (C)—</text>
							<subclause commented="no" display-inline="no-display-inline" id="H3D9E539620A642678EC9AFC384CF9FCC"><enum>(I)</enum><text>by redesignating
			 subclauses (I) and (II) of clause (iii) as items (aa) and (bb),
			 respectively;</text>

				assistance payments under this part with respect to a prior adoption (or who
				would have been determined eligible for such payments had the Adoption and Safe
				Families Act of 1997 been in effect at the time that such determination would
				have been made), and is available for adoption because the prior adoption has
				been dissolved and the parental rights of the adoptive parents have been
				terminated or because the child’s adoptive parents have
				died.</text>
									</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEF7C4C8D1FEB4BA68435B5734623C09D"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H84573650478440D60002AC6DF2B62278" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="H74096402416045398E8DB35E3D30929" indent="up1"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H930F0517EB1A49DA86A79CB2C821738"><enum>(A)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				subsection, no payment may be made to parents with respect to any applicable
				child for a fiscal year that—</text>
									<clause commented="no" display-inline="no-display-inline" id="H9CDB861F829B4C5FA85761287474662D" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">would be considered a child with special
				needs under subsection (c)(2);</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H6315E9B89E904DE5B390056DD0734E8F" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">is not a citizen or resident of the United
				States; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HFD75029BB90B4EAF00C7C216172E4090" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">was adopted outside of the United States or
				was brought into the United States for the purpose of being adopted.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEE30AB26BFD74BBDAFCE50BA5F29FFCE" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Subparagraph (A) shall not be construed as
				prohibiting payments under this part for an applicable child described in
				subparagraph (A) that is placed in foster care subsequent to the failure, as
				determined by the State, of the initial adoption of the child by the parents
				described in subparagraph (A).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H98C6AE175826436BB8FED652A14ED846" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">A
				State shall spend an amount equal to the amount of savings (if any) in State
				expenditures under this part resulting from the application of paragraph
				(2)(A)(ii) to all applicable children for a fiscal year to provide to children
				or families any service (including post-adoption services) that may be provided
				under this part or part
				B.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA77A1B225A0C4BFDBCEA3054B166C113"><enum>(2)</enum><text>in subsection
			 (c)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H3ED4160AE8204A4DA957C7F2A4CCC000"><enum>(A)</enum><text>by redesignating
			 paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and
			 realigning the margins accordingly;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H65A260E88FBC42EE8847C701D4D94BFD"><enum>(B)</enum><text>by striking
			 <quote>this section, a child shall not be considered a child with special needs
			 unless</quote> and inserting “this section—</text>
						<quoted-block display-inline="no-display-inline" id="H4AADAFB2B126463D911C1482007545EF" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="HE9966B952092458A90A7B1A9442CA3F3"><enum>(1)</enum><text>in the case of a
				child who is not an applicable child for a fiscal year, the child shall not be
				considered a child with special needs
				unless</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H166B06398EC94BCE878DE6C2009F07A9"><enum>(C)</enum><text>in paragraph
			 (1)(B), as so redesignated, by striking the period at the end and inserting
			 <quote>; or</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3DBDF606A554446D929DE1D79E3B0559"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H4AA8B095F0AF4024B300E2AF97D3FE84" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="H0C5E057E81324AAF8F00A559091E8374"><enum>(2)</enum><text>in the case of a
				child who is an applicable child for a fiscal year, the child shall not be
				considered a child with special needs unless—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H245441CC378B47A7B83C5D173DA16D27"><enum>(A)</enum><text display-inline="yes-display-inline">the State has determined, pursuant to a
				criterion or criteria established by the State, that the child cannot or should
				not be returned to the home of his parents;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H28E5FE55BB8E4A358B4E7279BF35E9D8"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H9A9DCBC3564A418885C3E13980988E5B"><enum>(i)</enum><text display-inline="yes-display-inline">the State has determined that there exists
				with respect to the child a specific factor or condition (such as ethnic
				background, age, or membership in a minority or sibling group, or the presence
				of factors such as medical conditions or physical, mental, or emotional
				handicaps) because of which it is reasonable to conclude that the child cannot
				be placed with adoptive parents without providing adoption assistance under
				this section and medical assistance under title XIX; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HB7543471099D49C78D32DD6EB2E60034" indent="up1"><enum>(ii)</enum><text>the child meets all medical or
				disability requirements of title XVI with respect to eligibility for
				supplemental security income benefits; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H018B5D79DF71428DA76560878F5DDD6"><enum>(C)</enum><text display-inline="yes-display-inline">the State has determined that, except where
				it would be against the best interests of the child because of such factors as
				the existence of significant emotional ties with prospective adoptive parents
				while in the care of the parents as a foster child, a reasonable, but
				unsuccessful, effort has been made to place the child with appropriate adoptive
				parents without providing adoption assistance under this section or medical
				assistance under title XIX.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H506E387E01E9478DAB5239AC105C29C0"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE79B37697CDE48AFBD20F644E800A1D4" style="OLC">
						<subsection id="H99E661EE0B764071B07DE8201CDD57FC"><enum>(e)</enum><header>Applicable child
				defined</header>
							<paragraph id="HC301506C2929407E96E810A127C8384"><enum>(1)</enum><header>On the basis of
				age</header>
								<subparagraph id="HF18C7DABDEFC45EF81EAACA3FC36AFF0"><enum>(A)</enum><header>In
				general</header><text>Subject to paragraphs (2) and (3), in this section, the
				term <term>applicable child</term> means a child for whom an adoption
				assistance agreement is entered into under this section during any fiscal year
				described in subparagraph (B) if the child attained the applicable age for that
				fiscal year before the end of that fiscal year.</text>
								</subparagraph><subparagraph id="HFC2E97C80F964BA38FE31441F584E26C"><enum>(B)</enum><header>Applicable
				age</header><text>For purposes of subparagraph (A), the applicable age for a
				fiscal year is as follows:</text>

				duration in care</header><text>Notwithstanding paragraph (1) of this
				subsection, beginning with fiscal year 2010, such term shall include a child of
				any age on the date on which an adoption assistance agreement is entered into
				on behalf of the child under this section if the child—</text>
								<subparagraph id="H666AFCED34204CF1A4C09134C692009B"><enum>(A)</enum><text>has been in foster
				care under the responsibility of the State for at least 60 consecutive months;
				and</text>
								</subparagraph><subparagraph commented="no" id="H71C2C9C848CD4CBDB89DCED3DDB2A89"><enum>(B)</enum><text>meets the
				requirements of subsection (a)(2)(A)(ii).</text>
								</subparagraph></paragraph><paragraph id="HEACD7484334A4D63BF3126DD00C78F38"><enum>(3)</enum><header>Exception for
				member of a sibling group</header><text>Notwithstanding paragraphs (1) and (2)
				of this subsection, beginning with fiscal year 2010, such term shall include a
				child of any age on the date on which an adoption assistance agreement is
				entered into on behalf of the child under this section without regard to
				whether the child is described in paragraph (2)(A) of this subsection if the
				child—</text>
								<subparagraph id="H3EF2CC83A73644A188F6B37E3C91C600"><enum>(A)</enum><text>is a sibling of a
				child who is an applicable child for the fiscal year under paragraph (1) or (2)
				of this subsection;</text>
								</subparagraph><subparagraph id="HA864BAA3B3D143FF9005B99679255B30"><enum>(B)</enum><text>is to be placed in
				the same adoption placement as an applicable child for the fiscal year who is
				their sibling; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H40F4E4F24CDA43D4873857022E0000C0"><enum>(C)</enum><text display-inline="yes-display-inline">meets the requirements of subsection
				(a)(2)(A)(ii).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H1544E9E0DD7F484D9B24A9A314FE8426"><enum>403.</enum><header>Information on
			 adoption tax credit</header><text display-inline="no-display-inline">Section
			 471(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>), as amended by sections
			 101(a), 103, 204(b), 206, and 301(c)(1)(A) of this Act, is amended—</text>
				<paragraph id="H227FF840C888425E00DCE64055C558F3"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (31);</text>
				</paragraph><paragraph id="H82EF3B9F2AE14C19A6FC2B6C14713F91"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (32) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H68A1FE0CA09C49AE9C000200C4FC009E"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H8579A4705C8A43AFBBFA8865E06D83D3" style="OLC">
						<paragraph id="H1DA262D89CA54EA4BF9EC946E8C16F6C"><enum>(33)</enum><text>provides that the
				State will inform any individual who is adopting, or whom the State is made
				aware is considering adopting, a child who is in foster care under the
				responsibility of the State of the potential eligibility of the individual for
				a Federal tax credit under section 23 of the Internal Revenue Code of
				1986.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="HA8544CCAAB4F44CA90FF7074CFE92487"><enum>V</enum><header>Clarification of
			 uniform definition of child and other provisions</header>
			<section display-inline="no-display-inline" id="H6B4413A12FC44B6181F09B08C19935B"><enum>501.</enum><header>Clarification of
			 uniform definition of child</header>
				<subsection id="HDC54B800D9D843EC80BADBEF83E3373D"><enum>(a)</enum><header>Child must be
			 younger than claimant</header><text>Section 152(c)(3)(A) of the Internal
			 Revenue Code of 1986 is amended by inserting <quote>is younger than the
			 taxpayer claiming such individual as a qualifying child and</quote> after
			 <quote>such individual</quote>.</text>
				</subsection><subsection id="H117AD89BC32342F38600BF92B57CA5E0"><enum>(b)</enum><header>Child must be
			 unmarried</header><text>Section 152(c)(1) of such Code is amended by striking
			 <quote>and</quote> at the end of subparagraph (C), by striking the period at
			 the end of subparagraph (D) and inserting <quote>, and</quote>, and by adding
			 at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H48C55108A88A497A88DE05CA23472DC0" style="OLC">
						<subparagraph id="H1A64BB48DC654174B76C44AF3752DE78"><enum>(E)</enum><text>who has not filed
				a joint return (other than only for a claim of refund) with the individual's
				spouse under section 6013 for the taxable year beginning in the calendar year
				in which the taxable year of the taxpayer
				begins.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H75CCA861D9B8412EB832ACCA8285776D"><enum>(c)</enum><header>Restrict
			 qualifying child tax benefits to child's parent</header>
					<paragraph id="H5659AFF8C2784B83B65E0040705B00FD"><enum>(1)</enum><header>Child tax
			 credit</header><text>Section 24(a) of such Code is amended by inserting
			 <quote>for which the taxpayer is allowed a deduction under section 151</quote>
			 after <quote>of the taxpayer</quote>.</text>
					</paragraph><paragraph id="H04A487089DE4483A9420ECF58E5D002F"><enum>(2)</enum><header>Persons other
			 than parents claiming qualifying child</header>
						<subparagraph id="H6403D5D5285D493A98AB2649F7196089"><enum>(A)</enum><header>In
			 general</header><text>Section 152(c)(4) of such Code is amended by adding at
			 the end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="HC7EC803FCB664D5DA28DE180148723A7" style="OLC">
								<subparagraph id="HC8D420E7986D4EA387AFA3C4CA711E02"><enum>(C)</enum><header>No parent
				claiming qualifying child</header><text>If the parents of an individual may
				claim such individual as a qualifying child but no parent so claims the
				individual, such individual may be claimed as the qualifying child of another
				taxpayer but only if the adjusted gross income of such taxpayer is higher than
				the highest adjusted gross income of any parent of the
				individual.</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="H3054F4B938D84C9989DB8CC2BEB6B31"><enum>(B)</enum><header>Conforming
			 amendments</header>
							<clause id="HFF28123ED5B149358FD67DD3E3BE9990"><enum>(i)</enum><text>Section
			 152(c)(4)(A) of such Code is amended by striking <quote>Except</quote> through
			 <quote>2 or more taxpayers</quote> and inserting <quote>Except as provided in
			 subparagraphs (B) and (C), if (but for this paragraph) an individual may be
			 claimed as a qualifying child by 2 or more taxpayers</quote>.</text>
							</clause><clause id="H3A2E31CF129F4FB9A02EB16ED0D2AEA3"><enum>(ii)</enum><text>The
			 heading for section 152(c)(4) of such Code is amended by striking
			 <quote><header-in-text level="paragraph" style="OLC">claiming</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">who can claim the
			 same</header-in-text></quote>.</text>
							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H64A194167AE4456FA1143B208672E583"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2008.</text>
				</subsection></section><section display-inline="no-display-inline" id="H747A791A12D440AE8F6C706B963EAE82" section-type="subsequent-section"><enum>502.</enum><header>Investment of
			 operating cash</header><text display-inline="no-display-inline">Section 323 of
			 title 31, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H935DC06B68D74734BF809100D126EF28" style="USC">
					<section id="HD63B741973344EF2A7618525A44F4560"><enum>323.</enum><header>Investment of
				operating cash</header>
						<subsection id="HD6A2B1051E2648B29D1B00C77652C606"><enum>(a)</enum><text>To manage United
				States cash, the Secretary of the Treasury may invest any part of the operating
				cash of the Treasury for not more than 90 days. The Secretary may invest the
				operating cash of the Treasury in—</text>
							<paragraph id="H54EEE3E14DD944F186A7CE55D4005D82"><enum>(1)</enum><text>obligations of
				depositories maintaining Treasury tax and loan accounts secured by pledged
				collateral acceptable to the Secretary;</text>
							</paragraph><paragraph id="HDD57E25A6A07490CB27D61DE5395A79E"><enum>(2)</enum><text>obligations of the
				United States Government; and</text>
							</paragraph><paragraph id="H2BA2C355CE184814B3ADACA5B7A44D82"><enum>(3)</enum><text>repurchase
				agreements with parties acceptable to the Secretary.</text>
							</paragraph></subsection><subsection id="H3108F6EDC0AE4AE490E98F8CD0DE46C8"><enum>(b)</enum><text>Subsection (a) of
				this section does not require the Secretary to invest a cash balance held in a
				particular account.</text>
						</subsection><subsection id="HF17CEF93CB8E4D0883641783FC66F8FD"><enum>(c)</enum><text>The Secretary
				shall consider the prevailing market in prescribing rates of interest for
				investments under subsection (a)(1) of this section.</text>
						</subsection><subsection id="H7124763C4D6040A9B58939CA7DE8E63C"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H772A2E6F93304A9294D942C64318AE03"><enum>(1)</enum><text>The Secretary of the
				Treasury shall submit each fiscal year to the appropriate committees a report
				detailing the investment of operating cash under subsection (a) for the
				preceding fiscal year. The report shall describe the Secretary's consideration
				of risks associated with investments and the actions taken to manage such
				risks.</text>
							</paragraph><paragraph id="HFF248ACC7D2946689386DF00C5A86A1" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the
				term <term>appropriate committees</term> means the Committee on Ways and Means
				of the House of Representatives and the Committee on Finance of the
				Senate.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H52C1BFD7483647DEAC5277E7CBF1DCD"><enum>503.</enum><header>No Federal
			 funding to unlawfully present individuals</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to
			 alter prohibitions on Federal payments to individuals who are unlawfully
			 present in the United States.</text>
			</section></title><title id="H359E790FF9E24089B7004EC3D9AB17AF"><enum>VI</enum><header>Effective
			 date</header>
			<section id="H27C6EE89F99942A299ECD964741511FD"><enum>601.</enum><header>Effective
			 date</header>
				<subsection id="H40B0244C3CAE42508C442492E1CD5554"><enum>(a)</enum><header>In
			 general</header><text>Except as otherwise provided in this Act, each amendment
			 made by this Act to part B or E of title IV of the Social Security Act shall
			 take effect on the date of the enactment of this Act, and shall apply to
			 payments under the part amended for quarters beginning on or after the
			 effective date of the amendment.</text>
				</subsection><subsection id="HFFCF625727174878AF529322E7E88673"><enum>(b)</enum><header>Delay permitted
			 if State legislation required</header><text>In the case of a State plan
			 approved under part B or E of title IV of the Social Security Act which the
			 Secretary of Health and Human Services determines requires State legislation
			 (other than legislation appropriating funds) in order for the plan to meet the
			 additional requirements imposed by this Act, the State plan shall not be
			 regarded as failing to comply with the requirements of such part solely on the
			 basis of the failure of the plan to meet such additional requirements before
			 the 1st day of the 1st calendar quarter beginning after the close of the 1st
			 regular session of the State legislature that ends after the 1-year period
			 beginning with the date of the enactment of this Act. For purposes of the
			 preceding sentence, in the case of a State that has a 2-year legislative
			 session, each year of the session is deemed to be a separate regular session of
			 the State legislature.</text>
