		  grants for Presidential Centers of Historical Excellence.</official-title>

		<section id="H5BDEBEEBBF9B4553ACC2AE24F6653440" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Presidential Historical Records
			 Preservation Act of 2008</short-title></quote>.</text>
		</section><section id="H581855E3FDCB4A3A935858F783F8C273"><enum>2.</enum><header>Grant
			 program</header><text display-inline="no-display-inline">Section 2504 of title
			 44, United States Code, is amended by—</text>
			<paragraph id="H7DEEAC75DB0348CABF4B6230722FE43F"><enum>(1)</enum><text>redesignating
			 subsection (f) as subsection (g);</text>
			</paragraph><paragraph id="HE4B84700036646858ECE86025E34F5FB"><enum>(2)</enum><text>amending
			 subsection (g)(1) (as so redesignated by paragraph (1))—</text>
				<subparagraph id="H8BB75339D8D84E019900F39207E7A8C"><enum>(A)</enum><text>in subparagraph
			 (R), by striking <quote>and</quote>;</text>
				</subparagraph><subparagraph id="HD7C54450B92A4EAD9F6B7E973D9EC432"><enum>(B)</enum><text>in subparagraph
			 (S), by striking the period and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph id="H56F9B176F541433DB5D5F63CF84D05EA"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5A2D3165A0B84C489EF5007555FBB023" style="OLC">
						<subparagraph id="HCEFD096769914DE3BB49F81DDDCACB44"><enum>(T)</enum><text>$15,000,000 for
				fiscal year 2010.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HA52032A79E8949229B54E000E6E3232F"><enum>(3)</enum><text>inserting after
			 subsection (e), the following:</text>
				<quoted-block display-inline="no-display-inline" id="H68B8B069D3364EE994389B8432879FD" style="OLC">
					<subsection id="HD2BCBF4087F64881926003AED575E07E"><enum>(f)</enum><header>Grants for
				Presidential Centers of Historical Excellence</header>
						<paragraph id="H81F7E3BF666E442ABDF10070C1001F00"><enum>(1)</enum><header>In
				general</header><text>The Commission shall make grants, on a competitive basis
				and in accordance with this subsection, to eligible entities to promote the
				historical preservation of, and public access to, historical records and
				documents relating to any President who does not have a Presidential archival
				depository currently managed and maintained by the Federal Government pursuant
				to section 2112 (commonly known as the <quote>Presidential Libraries Act of
				1955</quote>).</text>
						</paragraph><paragraph id="H30332147C91A48C0A0CCEE6C12A3926C"><enum>(2)</enum><header>Eligible
				entity</header><text>For purposes of this subsection, an eligible entity
				is—</text>
							<subparagraph id="H98DC618326B0427C005273D84FB5727F"><enum>(A)</enum><text>an organization
				described under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and
				exempt from taxation under section 501(a) of that Code; or</text>
							</subparagraph><subparagraph id="H7B76F1298C1C4F6AB78EEB019C54E300"><enum>(B)</enum><text>a State or local
				government of the United States.</text>
							</subparagraph></paragraph><paragraph id="H39A3D9A40A904A7384BAC8B5A1CF196D"><enum>(3)</enum><header>Use of
				funds</header><text>Amounts received by an eligible entity under paragraph (1)
				shall be used to promote the historical preservation of, and public access to,
				historical records or historical documents relating to any President covered
				under paragraph (1).</text>
						</paragraph><paragraph id="H8EDAD44F20554C609348ED1B9EC8A41F"><enum>(4)</enum><header>Prohibition on
				use of funds</header><text>Amounts received by an eligible entity under
				paragraph (1) may not be used for the maintenance, operating costs, or
				construction of any facility to house the historical records or historical
				documents relating to any President covered under paragraph (1).</text>
						</paragraph><paragraph id="HF940E58827AC40D70093551916EBD858"><enum>(5)</enum><header>Application</header>
							<subparagraph id="HD23A38B1BA4546889236D8D4DD1CD3FA"><enum>(A)</enum><header>In
				general</header><text>An eligible entity seeking a grant under this subsection
				shall submit to the Commission an application at such time, in such manner, and
				containing or accompanied by such information as the Commission may require,
				including a description of the activities for which a grant under this
				subsection is sought.</text>
							</subparagraph><subparagraph id="H1676E62127C1463A843007002BC1004B"><enum>(B)</enum><header>Approval of
				application</header><text>The Commission shall not approve a grant application
				submitted under subparagraph (A) unless an eligible entity establishes that
				such entity—</text>
								<clause id="H43EC62445CE84F1BB5AFE4C369D602F9"><enum>(i)</enum><text>possesses, with
				respect to any President covered under paragraph (1), historical works and
				collections of historical sources that the Commission considers appropriate for
				preserving, publishing, or otherwise recording at the public expense;</text>
								</clause><clause id="H9AF8564822F64A7495C07CA1C11B6FD5"><enum>(ii)</enum><text>has appropriate
				facilities and space for preservation of, and public access to, the historical
				works and collections of historical sources;</text>
								</clause><clause id="H70E2C6F28CFA4165A02BFFDB3D06C56D"><enum>(iii)</enum><text>shall ensure
				preservation of, and public access to, such historical works and collections of
				historical sources at no charge to the public;</text>
								</clause><clause id="HC7EB1D4CF78F4A78B5BBF2112CA23E00"><enum>(iv)</enum><text>has educational
				programs that make the use of such documents part of the mission of such
				entity;</text>
								</clause><clause id="H39D24A19D2F34441B85FDC5964A7AF70"><enum>(v)</enum><text>has raised funds
				from non-Federal sources in support of the efforts of the entity to promote the
				historical preservation of, and public access to, such historical works and
				collections of historical sources in an amount equal to the amount of the grant
				the entity seeks under this subsection;</text>
								</clause><clause id="H00F094551C034B6D90E747D8121693E2"><enum>(vi)</enum><text>shall coordinate
				with any relevant Federal program or activity, including programs and
				activities relating to Presidential archival depositories;</text>
								</clause><clause id="H2039F7584C89476BA5A37C2955C85693"><enum>(vii)</enum><text>shall coordinate
				with any relevant non-Federal program or activity, including programs and
				activities conducted by State and local governments and private educational
				historical entities; and</text>
								</clause><clause id="HAE837F01257845A78E516275C2F72DC5"><enum>(viii)</enum><text>has a workable
				plan for preserving and providing public access to such historical works and
				collections of historical
				sources.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
