		<section id="H84A168447BE84A408B747710A4F1CB6F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Payments System Protection Act of
			 2008</short-title></quote>.</text>
		</section><section id="H2037A722C667406084B899F051E5C82D"><enum>2.</enum><header>Prohibition</header>
			<subsection id="H006918FBCBF64DE2BCB74448CC2F105F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of the
			 Treasury and the Board of Governors of the Federal Reserve System, whether
			 acting jointly or separately, may not propose, prescribe, or implement any
			 regulation under subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code,
			 or otherwise give effect to such subchapter or any such regulation, including
			 the proposed regulations published in the Federal Register on October 4, 2007,
			 except to the extent as any such regulation pertains to unlawful Internet
			 sports gambling or except as provided in section 3.</text>
			</subsection><subsection id="HAD292BDB74E74BA9A8AB6FCA8FA31F77"><enum>(b)</enum><header>Interim final
			 regulations on unlawful Internet sports gambling</header><text>Before the end
			 of the 60-day period beginning on the date of the enactment of this Act, the
			 Secretary and the Board of Governors of the Federal Reserve System, in
			 consultation with the Attorney General, shall jointly prescribe interim final
			 regulations as required by subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United
			 States Code, to the extent that such regulations pertain to unlawful Internet
			 sports gambling.</text>
			</subsection><subsection id="H5327C362808D4FF091513FC3B6B972D9"><enum>(c)</enum><header>Unlawful internet
			 sports gambling defined</header>
				<paragraph id="H6FBB68624BBC4D4CB5E038B82BF89ED"><enum>(1)</enum><header>In
			 general</header><text>For purposes of this Act, the term <quote>unlawful
			 Internet sports gambling</quote> means bets or wagers placed over the Internet
			 on a lottery, sweepstakes, or other betting, gambling, or wagering scheme
			 based, directly or indirectly (through the use of geographical references or
			 otherwise), on 1 or more competitive games in which amateur or professional
			 athletes participate, or are intended to participate, or on 1 or more
			 performances of such athletes in such games.</text>
				</paragraph><paragraph id="HB8561D62591343A49B24809C7C9C0835"><enum>(2)</enum><header>Exception</header><text>For
			 purposes of paragraph (1), the term <quote>competitive games in which amateur
			 or professional athletes participate</quote> does not include events described
			 in <external-xref legal-doc="usc" parsable-cite="usc/28/3704">section 3704</external-xref> of title 28, United States Code (parimutuel animal racing or
			 jai-alai games).</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H8521960BCE4642C883489852D068CFA"><enum>(d)</enum><header>Treasury list of
			 unlawful internet sports gambling businesses</header><text>No regulations under
			 subsection (a) to implement the requirements of <external-xref legal-doc="usc" parsable-cite="usc/31/5364">section 5364</external-xref> of title 31,
			 United States Code, shall be effective unless such regulations—</text>
				<paragraph id="H9C18E992E20D4C75A50016B1D6D4D164"><enum>(1)</enum><text>require the Secretary of
			 the Treasury to compile and maintain a list of unlawful Internet sports
			 gambling businesses; and</text>
				</paragraph><paragraph id="H927A18D9A2194B28A8E0C5D6F6E2B8D6"><enum>(2)</enum><text>do not require any person
			 to block or refuse to honor any transaction, or prohibit the acceptance of any
			 product or service of such person, other than in connection with a business on
			 the list maintained by the Secretary.</text>
				</paragraph></subsection></section><section id="HAD774FAB23E649E0BD7D571700AE9C91"><enum>3.</enum><header>Rulemaking to implement
			 subchapter on prohibition on funding of unlawful internet gambling and define
			 unlawful internet gambling</header>
			<subsection id="H7C1833DF9FBC4C3EB87786F28CDD8482"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding
			 section 2, the Secretary of the Treasury and the Board of Governors of the
			 Federal Reserve System, in consultation with the Attorney General, shall
			 jointly develop and implement regulations (which the Secretary and the Board
			 jointly determine to be appropriate), on the record after opportunity for
			 agency hearing involving an administrative law judge or similar official, under
			 subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code, that shall include
			 a definition of the term <quote>unlawful Internet gambling</quote> for purposes
			 of such subchapter and such regulations, after conducting a full economic
			 impact study of the proposed regulations under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United
			 States Code (commonly referred to as the <quote>Regulatory Flexibility
			 Act</quote>).</text>
			</subsection><subsection display-inline="no-display-inline" id="H09C121A1748749E3A1768F516BB6A778"><enum>(b)</enum><header>Treasury list of
			 unlawful internet gambling businesses</header><text>No regulations under
			 subsection (a) to implement the requirements of <external-xref legal-doc="usc" parsable-cite="usc/31/5364">section 5364</external-xref> of title 31,
			 United States Code, shall be effective unless such regulations—</text>
				<paragraph id="H4C03522A3F3047D4B7785F329F000098"><enum>(1)</enum><text>require the Secretary of
			 the Treasury to compile and maintain a list of unlawful Internet gambling
			 businesses; and</text>
				</paragraph><paragraph id="H69B2C87BA9344A97BAB36D6F628206C"><enum>(2)</enum><text>do not require any person
			 to block or refuse to honor any transaction, or prohibit the acceptance of any
			 product or service of such person, other than in connection with a business on
			 the list maintained by the Secretary.</text>
				</paragraph></subsection><subsection id="HF1A33B030332476FABFEFC4B4E15FE83"><enum>(c)</enum><header>Coordination with
			 prohibition</header><text>Upon the effective date of final regulations under
			 subsection (a), section 2 shall cease to apply.</text>
