<section id="H36831F94562C445E95FA6D6F96F77737" section-type="section-one"><enum>1.</enum><header>Aggregation of base acres and reconstitution of farms to ensure eligibility for direct payments, counter-cyclical payments, or average crop revenue election payments</header><text display-inline="no-display-inline">Section 1101(d) of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/8711">7 U.S.C. 8711(d)</external-xref>) is amended—</text> 
<paragraph id="H3FF568A322604EF9A2594800F34FC112"><enum>(1)</enum><text>by striking paragraph (2);</text> </paragraph> 
<paragraph id="H95703D53D52042BB8D419568F436393F"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text> </paragraph> 
<paragraph id="HB75F3BD9F7A64983AFB5C51B0298E66F"><enum>(3)</enum><text>by inserting after paragraph (1) the following new paragraphs:</text>

<paragraph id="HDC1DF7F4270541BC91610550C54510F7"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply—</text> 
<subparagraph id="HFDA84D7F8CD04484B8C7541EA42900E8"><enum>(A)</enum><text display-inline="yes-display-inline">to a farm owned by a socially disadvantaged farmer or rancher (as defined in section 355(e) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2003">7 U.S.C. 2003(e)</external-xref>));</text> </subparagraph> 
<subparagraph id="H54CA5B6402FF4A89B9126B8BA09EE846"><enum>(B)</enum><text>to a farm owned by a limited resource farmer or rancher, as defined by the Secretary; or</text> </subparagraph> 
<subparagraph id="H6000A5627AB642D8BFC2004E6D3F1EFD"><enum>(C)</enum><text>when the aggregate total base acres of all farms of a producer are greater than 10 acres, including farms—</text> 
<clause id="H3F4AC3CED3204E6892DECF7913CA68AD"><enum>(i)</enum><text>owned by a producer; and</text> </clause> 
<clause id="H16B81985851C4487A1952BFCD29857EB"><enum>(ii)</enum><text>operated by a producer with the concurrence of the owners of the farm, including farms operated under a crop-share lease arrangement.</text> </clause></subparagraph></paragraph> 
<paragraph id="H8AE4F2BBBC0046339466352CCA59085"><enum>(3)</enum><header>Reconstitutions</header><text display-inline="yes-display-inline">In addition to other actions the Secretary determines appropriate, the Secretary shall permit a producer to reconstitute any farms of the producer covered under paragraph (2)(C) to exceed the 10 base acre minimum described in paragraph (1) through consolidation of the base acreage of the farms.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>

<subsection id="HE3123C91C11A451FB974F7E156B427B"><enum>(a)</enum><header>Special rule for 2008 and 2009 crop years</header><text display-inline="yes-display-inline">Section 1101(d) of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/8711">7 U.S.C. 8711(d)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H050D632E7C2F43839EFEBF9F77001E66"><enum>(4)</enum><header>Suspension</header><text display-inline="yes-display-inline">Paragraphs (1), (2), and (3) shall not apply during the 2008 and 2009 crop years.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HC0238F6217DC4F66BF01C3674C895FF"><enum>(b)</enum><header>Offsetting reduction</header><text display-inline="yes-display-inline">Section 515(k)(1) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1515">7 U.S.C. 1515(k)(1)</external-xref>) is amended by striking <quote>not more than $15,000,000 for each of fiscal years 2008 through 2011</quote> and inserting <quote>not more than $15,000,000 for fiscal year 2008, not more than $9,000,000 for fiscal year 2009, and not more than $8,000,000 for each of fiscal years 2010 and 2011</quote>.</text> </subsection></section>
