		<official-title display="yes">To restore Second Amendment rights in the
		  District of Columbia.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H8FA471CF6390409FAC4D94EECEF32806" style="OLC">
		<section display-inline="no-display-inline" id="H06CBE551C6C9405DBC18416293138019" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Second Amendment Enforcement
			 Act</short-title></quote>.</text>
		</section><section id="HC934176EFBFA4A76B63B87B1808EAF7B"><enum>2.</enum><header>Congressional
			 findings</header><text display-inline="no-display-inline">Congress finds the
			 following:</text>
			<paragraph id="H71BB063F0CA7487E93D0EC5EDA3C5800"><enum>(1)</enum><text>The Second
			 Amendment to the United States Constitution provides that the right of the
			 people to keep and bear arms shall not be infringed.</text>
			</paragraph><paragraph id="H23471426BBF54D66A79B88B1559FCD25"><enum>(2)</enum><text>As the Congress
			 and the Supreme Court of the United States have recognized, the Second
			 Amendment to the United States Constitution protects the rights of individuals,
			 including those who are not members of a militia or engaged in military service
			 or training, to keep and bear arms.</text>
			</paragraph><paragraph id="H16D7480E96714C7A9641F8159497E465"><enum>(3)</enum><text>The law-abiding
			 citizens of the District of Columbia are deprived by local laws of handguns,
			 rifles, and shotguns that are commonly kept by law-abiding persons throughout
			 the United States for sporting use and for lawful defense of their persons,
			 homes, businesses, and families.</text>
			</paragraph><paragraph id="H7B8BED552DAF48DBB4D058AADCDC9850"><enum>(4)</enum><text>The District of
			 Columbia has the highest per capita murder rate in the Nation, which may be
			 attributed in part to local laws prohibiting possession of firearms by
			 law-abiding persons who would otherwise be able to defend themselves and their
			 loved ones in their own homes and businesses.</text>
			</paragraph><paragraph id="HB1E23F1EE486424F9B9124D79FB7D0B9"><enum>(5)</enum><text>The Federal
			 <act-name parsable-cite="GCA68">Gun Control Act of 1968</act-name>, as amended
			 by the Firearms Owners’ Protection Act of 1986, and the Brady Handgun Violence
			 Prevention Act of 1993, provide comprehensive Federal regulations applicable in
			 the District of Columbia as elsewhere. In addition, existing District of
			 Columbia criminal laws punish possession and illegal use of firearms by violent
			 criminals and felons. Consequently, there is no need for local laws which only
			 affect and disarm law-abiding citizens.</text>
			</paragraph><paragraph id="H0BFBDAB519374599AF42C400FBF1C945"><enum>(6)</enum><text display-inline="yes-display-inline">Officials of the District of Columbia have
			 indicated their intention to continue to unduly restrict lawful firearm
			 possession and use by citizens of the District.</text>
			</paragraph><paragraph id="H7A2DF2DC0DB94D54B2A9006661E0A3A6"><enum>(7)</enum><text>Legislation is
			 required to correct the District of Columbia’s law in order to restore the
			 fundamental rights of its citizens under the Second Amendment to the United
			 States Constitution and thereby enhance public safety.</text>
			</paragraph></section><section id="H5C52FBFCA9C4405CB5656F52C1168785"><enum>3.</enum><header>Reform D.C.
			 council’s authority to restrict firearms</header><text display-inline="no-display-inline">Section 4 of the Act entitled <quote>An Act
			 to prohibit the killing of wild birds and wild animals in the District of
			 Columbia</quote>, approved June 30, 1906 (34 Stat. 809; sec. 1–303.43, D.C.
			 Official Code) is amended by adding at the end the following: <quote>Nothing in
			 this section or any other provision of law shall authorize, or shall be
			 construed to permit, the Council, the Mayor, or any governmental or regulatory
			 authority of the District of Columbia to prohibit, constructively prohibit, or
			 unduly burden the ability of persons not prohibited from possessing firearms
			 under Federal law from acquiring, possessing in their homes or businesses, or
			 using for sporting, self-protection or other lawful purposes, any firearm
			 neither prohibited by Federal law nor subject to the
			 <act-name parsable-cite="NFA">National Firearms Act</act-name>. The District of
			 Columbia shall not have authority to enact laws or regulations that discourage
			 or eliminate the private ownership or use of firearms. Nothing in the previous
			 two sentences shall be construed to prohibit the District of Columbia from
			 regulating or prohibiting the carrying of firearms by a person, either
			 concealed or openly, other than at the person's dwelling place, place of
			 business, or on other land possessed by the person.</quote>.</text>
		</section><section id="H9A7D280DBD2741F780D88475870615B"><enum>4.</enum><header>Repeal D.C.
			 semiautomatic ban</header>
			<subsection id="H57EC18792B9745BC00F1D5F100DC2CB4"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Section 101(10) of
			 the Firearms Control Regulations Act of 1975 (sec. 7–2501.01(10), D.C. Official
			 Code) is amended to read as follows:</text>
				<quoted-block id="HD7A7721944E9470C94EBFEC100FDF3A9">
					<paragraph id="H7EF8F06B3B8540AD83A1E1C0009CF91C"><enum>(10)</enum><text><quote>Machine
				gun</quote> means any firearm which shoots, is designed to shoot, or readily
				restored to shoot automatically, more than 1 shot without manual reloading by a
				single function of the trigger, and includes the frame or receiver of any such
				weapon, any part designed and intended solely and exclusively, or combination
				of parts designed and intended, for use in converting a weapon into a machine
				gun, and any combination of parts from which a machine gun can be assembled if
				such parts are in the possession or under the control of a
				person.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3EA9764FDABC43398FD535288368B1C"><enum>(b)</enum><header>Conforming
			 Amendment to Provisions Setting Forth Criminal Penalties</header><text display-inline="yes-display-inline">Section 1(c) of the Act of July 8, 1932 (47
			 Stat. 651; sec. 22—4501(c), D.C. Official Code) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HBE0B43DC57C74B24B600C4CD2D2065B4" style="OLC">
					<subsection id="HC8981B99AA1D4324A5DE2D69E51244DC"><enum>(c)</enum><text><quote>Machine
				gun</quote>, as used in this Act, has the meaning given such term in section
				101(10) of the Firearms Control Regulations Act of
				1975.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HCEE53F64EF9E47809F5300DDC4874C31"><enum>5.</enum><header>Repeal
			 registration requirement</header>
			<subsection id="HA48983B6FC19457196D4883004003DF8"><enum>(a)</enum><header>Repeal of
			 requirement</header>
				<paragraph id="H31E03FA1439F4A27A4F21EB93519ECB3"><enum>(1)</enum><header>In
			 general</header><text>Section 201(a) of the Firearms Control Regulations Act of
			 1975 (sec. 7–2502.01(a), D.C. Official Code) is amended by striking <quote>any
			 firearm, unless</quote> and all that follows through paragraph (3) and
			 inserting the following: <quote>any firearm described in subsection
			 (c).</quote>.</text>
				</paragraph><paragraph id="H18B215A4CCC64171007935E352178B33"><enum>(2)</enum><header>Description of
			 firearms remaining illegal</header><text>Section 201 of such Act (sec.
			 7–2502.01, D.C. Official Code) is amended by adding at the end the following
			 new subsection:</text>
					<quoted-block id="HF4511A2C6B8A4135A07CFE7C1FC09735">
						<subsection id="H17DEE1C5631A416A969787B8BE2157B6"><enum>(c)</enum><text>A firearm
				described in this subsection is any of the following:</text>
							<paragraph id="HDA82831DA8A844DD87327B65213B13FD"><enum>(1)</enum><text>A sawed-off
				shotgun.</text>
							</paragraph><paragraph id="H899F317A83A64E1A8F5DD22359A0DA79"><enum>(2)</enum><text>A machine
				gun.</text>
							</paragraph><paragraph id="H79C421DEDBF4483C84343912687DBC8C"><enum>(3)</enum><text>A short-barreled
				rifle.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5DDC55E5B6D14CB49B1CF1FDB4009200"><enum>(3)</enum><header>Conforming
			 amendment</header><text>The heading of section 201 of such Act (sec. 7—2502.01,
			 D.C. Official Code) is amended by striking <quote>Registration
			 requirements</quote> and inserting <quote>Firearm Possession</quote>.</text>
				</paragraph></subsection><subsection id="H9A3359BDB0A0404F84F5CA8CE03072F3"><enum>(b)</enum><header>Conforming
			 Amendments to Firearms Control Regulations Act</header><text>The Firearms
			 Control Regulations Act of 1975 is amended as follows:</text>
				<paragraph id="H8B7B518A9E404BA7B125DE4B1FB2BAE9"><enum>(1)</enum><text display-inline="yes-display-inline">Sections 202 through 211 (secs. 7–2502.02
			 through 7–2502.11, D.C. Official Code) are repealed.</text>
				</paragraph><paragraph id="HA6880EAEBDEF4832A1CED2A6E743662C"><enum>(2)</enum><text>Section 101 (sec.
			 7—2501.01, D.C. Official Code) is amended by striking paragraph (13).</text>
				</paragraph><paragraph id="H50158434A5324211AD812BF4856F56F5"><enum>(3)</enum><text>Section 401 (sec.
			 7—2504.01, D.C. Official Code) is amended—</text>
					<subparagraph id="HD1726B14CBAC4DBA913CEF759350DA6D"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>the District;</quote> and all that follows and inserting the
			 following: <quote>the District, except that a person may engage in hand
			 loading, reloading, or custom loading of ammunition for firearms lawfully
			 possessed under this Act.</quote>; and</text>
					</subparagraph><subparagraph id="H728A8AAF6DED4CBE97C5F6987F957EF"><enum>(B)</enum><text>in subsection (b),
			 by striking <quote>which are unregisterable under section 202</quote> and
			 inserting <quote>which are prohibited under section 201</quote>.</text>
					</subparagraph></paragraph><paragraph id="HF42F8B03F9414023A7942C00007E344B"><enum>(4)</enum><text>Section 402 (sec.
			 7—2504.02, D.C. Official Code) is amended—</text>
					<subparagraph id="H9F63254F0F6A4E24A224DB497EB6ADF"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>Any person eligible to register a firearm</quote> and all
			 that follows through <quote>such business,</quote> and inserting the following:
			 <quote>Any person not otherwise prohibited from possessing or receiving a
			 firearm under Federal or District law, or from being licensed under section 923
			 of title 18, United States Code,</quote>; and</text>
					</subparagraph><subparagraph id="H54ED43324D9F4907A353DCD237EE62BB"><enum>(B)</enum><text>in subsection (b),
			 by amending paragraph (1) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H1599D1EEC09140A7AB607BC050BECECA" style="OLC">
							<paragraph id="H0315C5F29D3F43C0987EDF298E916E3"><enum>(1)</enum><text>The applicant’s
				name;</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H5694303E570A489199FAAA25D4039EE4"><enum>(5)</enum><text>Section 403(b)
			 (sec. 7—2504.03(b), D.C. Official Code) is amended by striking
			 <quote>registration certificate</quote> and inserting <quote>dealer’s
			 license</quote>.</text>
				</paragraph><paragraph id="H20F40185647F4AEDB8874D7D4F1D96DF"><enum>(6)</enum><text>Section 404(a)(3)
			 (sec. 7—2504.04(a)(3)), D.C. Official Code) is amended—</text>
					<subparagraph id="H8614C6C21AAF427F8DFE28C6DA00E7B0"><enum>(A)</enum><text>in subparagraph
			 (B)(i), by striking <quote>registration certificate number (if any) of the
			 firearm,</quote>;</text>
					</subparagraph><subparagraph id="HA34D661FE7D746C792DB0700C925953"><enum>(B)</enum><text>in subparagraph
			 (B)(iv), by striking <quote>holding the registration certificate</quote> and
			 inserting <quote>from whom it was received for repair</quote>;</text>
					</subparagraph><subparagraph id="H9FD46A85F62E4FE0B73F89524B01E0D8"><enum>(C)</enum><text>in subparagraph
			 (C)(i), by striking <quote>and registration certificate number (if any) of the
			 firearm</quote>;</text>
					</subparagraph><subparagraph id="HB7D76D51E27045C49FEF006286D6DFB4"><enum>(D)</enum><text>in subparagraph
			 (C)(ii), by striking <quote>registration certificate number or</quote>;
			 and</text>
					</subparagraph><subparagraph id="H0DC7C17F6E9148568F7DBDAED4033D6"><enum>(E)</enum><text>by striking
			 subparagraphs (D) and (E).</text>
					</subparagraph></paragraph><paragraph id="H673E3FDE9D74459BA1A39F1D8043BE39"><enum>(7)</enum><text>Section 406(c)
			 (sec. 7—2504.06(c), D.C. Official Code) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H58FA9AD1BE1B47B08F1FEBFF0000FCD6" style="OLC">
						<subsection id="H9663CCEE1369472F8FF82C6058615E6"><enum>(c)</enum><text>Within 45 days of a
				decision becoming effective which is unfavorable to a licensee or to an
				applicant for a dealer’s license, the licensee or application shall—</text>
							<paragraph id="HF26CEF3748014276B1B4F8A420CF57A7"><enum>(1)</enum><text>lawfully remove
				from the District all destructive devices in his inventory, or peaceably
				surrender to the Chief all destructive devices in his inventory in the manner
				provided in section 705; and</text>
							</paragraph><paragraph id="H74A762DA4A3F4DAFB2509328A63FA73B"><enum>(2)</enum><text>lawfully dispose,
				to himself or to another, any firearms and ammunition in his
				inventory.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5AAB5C4B3FCA449294870023EBE12184"><enum>(8)</enum><text>Section 407(b)
			 (sec. 7—2504.07(b), D.C. Official Code) is amended by striking <quote>would not
			 be eligible</quote> and all that follows and inserting <quote>is prohibited
			 from possessing or receiving a firearm under Federal or District
			 law.</quote>.</text>
				</paragraph><paragraph id="H304668D69F824D648EC0CF4D60568845"><enum>(9)</enum><text>Section 502 (sec.
			 7—2505.02, D.C. Official Code) is amended—</text>
					<subparagraph id="HDD41BC18691644068520FBE28F3DB4E"><enum>(A)</enum><text>by amending
			 subsection (a) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H6843EB568A9947A000927024755E91D4" style="OLC">
							<subsection id="H1080F010C8FA4766BDD5002B6266B478"><enum>(a)</enum><text>Any person or
				organization not prohibited from possessing or receiving a firearm under
				Federal or District law may sell or otherwise transfer ammunition or any
				firearm, except those which are prohibited under section 201, to a licensed
				dealer.</text>
							</subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H2DBD1FCEF44A47DB9902C237E7008CD5"><enum>(B)</enum><text>by amending
			 subsection (c) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H8C8AAA675F3A441800F17F9DFD6D0859" style="OLC">
							<subsection id="HF2C2C42EC43A4A48805B00DDBD351335"><enum>(c)</enum><text>Any licensed
				dealer may sell or otherwise transfer a firearm to any person or organization
				not otherwise prohibited from possessing or receiving such firearm under
				Federal or District
				law.</text>
							</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H4853BA15EA06430D00D5DCDDC901981F"><enum>(C)</enum><text>in subsection (d),
			 by striking paragraphs (2) and (3); and</text>
					</subparagraph><subparagraph id="H4FB1ACB1244940F8B2AA34E8D5009C58"><enum>(D)</enum><text>by striking
			 subsection (e).</text>
					</subparagraph></paragraph><paragraph id="H1F76887E2CE04E4BBA8FBDE9818D436"><enum>(10)</enum><text>Section 704 (sec.
			 7—2507.04, D.C. Official Code) is amended—</text>
					<subparagraph id="H2D17AA711ADB4DB1A9C42894A28E5DD1"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>any registration certificate or</quote> and inserting
			 <quote>a</quote>; and</text>
					</subparagraph><subparagraph id="HFF439C5591A74D5DB6ADEF3D501FE1C7"><enum>(B)</enum><text>in subsection (b),
			 by striking <quote>registration certificate,</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H7AD71D837B2D4C898116C3B890F7D26D"><enum>(c)</enum><header>Other Conforming
			 Amendments</header><text>Section 2(4) of the Illegal Firearm Sale and
			 Distribution Strict Liability Act of 1992 (sec. 7—2531.01(2)(4), D.C. Official
			 Code) is amended—</text>
				<paragraph id="H965E26A08B2446838757C99B00AEAB06"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>or ignoring proof of the purchaser’s residence in the
			 District of Columbia</quote>; and</text>
				</paragraph><paragraph id="HDDAC51AD2C9946B299C49968A3B2003D"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>registration and</quote>.</text>
				</paragraph></subsection></section><section id="HFD452CA729AD4CBEB0D7F571C9599BD"><enum>6.</enum><header>Repeal handgun
			 ammunition ban</header><text display-inline="no-display-inline">Section 601(3)
			 of the Firearms Control Regulations Act of 1975 (sec. 7–2506.01(3), D.C.
			 Official Code) is amended by striking <quote>is the holder of the valid
			 registration certificate for</quote> and inserting <quote>owns</quote>.</text>
		</section><section id="HC8B513E4EF9042890015E6F4696541C"><enum>7.</enum><header>Restore right of
			 self defense in the home</header><text display-inline="no-display-inline">Section 702 of the Firearms Control
			 Regulations Act of 1975 (sec. 7–2507.02, D.C. Official Code) is
			 repealed.</text>
		</section><section id="H7E71FC624BA949479B6627FA4538AC00"><enum>8.</enum><header>Remove criminal
			 penalties for possession of unregistered firearms</header>
			<subsection id="H7F3EC7BBAC5C46C6BB417387D96000E7"><enum>(a)</enum><header>In
			 general</header><text>Section 706 of the Firearms Control Regulations Act of
			 1975 (sec. 7–2507.06, D.C. Official Code) is amended—</text>
				<paragraph id="HE9CD079F9E9F4A40906700FF62B6B46"><enum>(1)</enum><text>by
			 striking <quote>that:</quote> and all that follows through <quote>(1) A</quote>
			 and inserting <quote>that a</quote>; and</text>
				</paragraph><paragraph id="H4A35E7BA6640463BA5B01114932541CB"><enum>(2)</enum><text>by striking
			 paragraph (2).</text>
				</paragraph></subsection><subsection id="H410A8AC28AF7414BB674FD8559E515F"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply with
			 respect to violations occurring after the 60-day period which begins on the
			 date of the enactment of this Act.</text>
			</subsection></section><section id="H87AA72BE84284539B5C72CEB4925C0A0"><enum>9.</enum><header>Remove criminal
			 penalties for carrying a firearm in one’s dwelling or other premises</header>
			<subsection id="HBAFBBD982B0E41EF9BF392E44BCA39A1"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Section 4(a) of the
			 Act of July 8, 1932 (47 Stat. 651; sec. 22—4504(a), D.C. Official Code) is
			 amended—</text>
				<paragraph id="H1645D3955040481AAF00897751F05459"><enum>(1)</enum><text>in the matter
			 before paragraph (1), by striking <quote>a pistol,</quote> and inserting the
			 following: <quote>except in his dwelling house or place of business or on other
			 land possessed by that person, whether loaded or unloaded, a firearm,</quote>;
			 and</text>
				</paragraph><paragraph id="H8DA9B1B3CF5D4FA08606EA7576592600"><enum>(2)</enum><text>by striking
			 <quote>except that:</quote> and all that follows through <quote>(2) If the
			 violation</quote> and inserting <quote>except that if the
			 violation</quote>.</text>
				</paragraph></subsection><subsection id="H1C4053AA7CB44FB8A63300623322AFB0"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>Section 5 of such Act (47 Stat. 651; sec. 22—4505, D.C.
			 Official Code) is amended—</text>
				<paragraph id="H192B70F4BD514B4CAA59528193910815"><enum>(1)</enum><text>by striking
			 <quote>pistol</quote> each place it appears and inserting
			 <quote>firearm</quote>; and</text>
				</paragraph><paragraph id="H663C01447ACD464FB64984ABD7CE44B3"><enum>(2)</enum><text>by striking
			 <quote>pistols</quote> each place it appears and inserting
			 <quote>firearms</quote>.</text>
				</paragraph></subsection></section><section id="H610EE867BAEA4D7190C6D09ECB7E1230"><enum>10.</enum><header>Authorizing
			 Purchases of Firearms by District Residents</header><text display-inline="no-display-inline">Section 922 of title 18, United States Code,
			 is amended in paragraph (b)(3) by inserting after “other than a State in which
			 the licensee’s place of business is located” the following: <quote>, or to the
			 sale or delivery of a handgun to a resident of the District of Columbia by a
			 licensee whose place of business is located in Maryland or
			 Virginia,</quote>.</text>
