		<section id="H3E2E7272422546DCB462FB7300094B21" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Energy
			 for Schools Act</quote>.</text>
		</section><section id="HF2EE7F1E44D24A578DACF302D7F0F5E1"><enum>2.</enum><header>Grants to State
			 educational agencies</header>
			<subsection id="HE0CE1F42418B43D3A8C00152AD7E1CA"><enum>(a)</enum><header>Grants to State
			 educational agencies</header><text display-inline="yes-display-inline">From the
			 amounts appropriated under section 8, the Secretary of Education shall award
			 grants to State educational agencies for the purpose of awarding subgrants to
			 local educational agencies to assist public schools with the increased costs of
			 fuel for school buses and energy for public school buildings in accordance with
			 sections 5 and 6.</text>
			</subsection><subsection id="H44A9635AAF524255B6008BEAE0C527CA"><enum>(b)</enum><header>Grant
			 Application</header><text>To receive a grant under subsection (a), a State
			 educational agency shall submit an application to the Secretary in such form,
			 manner, and containing such information as the Secretary may require.</text>
			</subsection></section><section id="HA1C9E8EB4EEC4AE500D7B4B2B42C0204"><enum>3.</enum><header>Subgrants to
			 Local Educational agencies</header>
			<subsection id="HEFE51EF07233485FB1112DC8A4B52013"><enum>(a)</enum><header>Subgrants to
			 local educational agencies</header>
				<paragraph id="H1D85BDB020B74BAE004DC093E473F81E"><enum>(1)</enum><header>In
			 general</header><text>A State educational agency that receives a grant under
			 section 2 shall award subgrants to local educational agencies to assist public
			 schools with the increased costs of fuel for school buses and energy for public
			 school buildings in accordance with sections 5 and 6.</text>
				</paragraph><paragraph id="HF1149FBBDB814F239EFD6DB693CD10FA"><enum>(2)</enum><header>Administrative
			 Costs</header><text>A State educational agency that receives a grant under
			 section 2 shall use not more than 5 percent of such grant for the
			 administrative costs of carrying out the subgrant program.</text>
				</paragraph></subsection><subsection id="HDCE0D03234F747E1A318CF28DBD22259"><enum>(b)</enum><header>Subgrant
			 Application</header><text display-inline="yes-display-inline">To receive a
			 subgrant under subsection (a), a local educational agency shall submit an
			 application to the State educational agency serving such local educational
			 agency in such form, manner, and containing such information as such State
			 educational agency may require.</text>
			</subsection></section><section id="H3CBBBB26699E473FA4505361FB6B74B2"><enum>4.</enum><header>Grants to Local
			 educational agencies</header>
			<subsection id="H0F12F22A90284710853F9F68EB092CC4"><enum>(a)</enum><header>Grants to local
			 educational agencies</header><text display-inline="yes-display-inline">From the
			 amounts appropriated under section 8, the Secretary shall award grants to local
			 educational agencies that did not receive a subgrant under section 3 to assist
			 public schools with the increased costs of fuel for school buses and energy for
			 public school buildings in accordance with sections 5 and 6.</text>
			</subsection><subsection id="H6107361687B84D048E1B473F3E15E850"><enum>(b)</enum><header>Application</header><text>To
			 receive a grant under subsection (a), a local educational agency shall submit
			 an application to the Secretary in such form, manner, and containing such
			 information as the Secretary may require.</text>
			</subsection></section><section id="H1A8FC9ADE941494E96D9F2366DE0C0F6"><enum>5.</enum><header>Uses of
			 funds</header><text display-inline="no-display-inline">A local educational
			 agency that receives a subgrant under section 3 or a grant under section 4,
			 shall use such funds to assist public schools within the jurisdiction of such
			 local educational agency—</text>
			<paragraph id="H21B1BE550B3E4DA0859BB500C6B8EDA8"><enum>(1)</enum><text>to pay for the
			 increase in the cost of fuel for school buses that serve such public schools;
			 and</text>
			</paragraph><paragraph id="H1A219158C8C445ABA32D25ECAC03191"><enum>(2)</enum><text>to
			 pay for the increase in the cost of energy to heat, to cool, or to provide
			 electricity to the buildings of such public schools.</text>
			</paragraph></section><section id="HDEC35D4A31C94DD2B4DF31E500268D18"><enum>6.</enum><header>Distribution of
			 funds</header><text display-inline="no-display-inline">To the extent
			 practicable, a local educational agency that receives a subgrant under section
			 3 or a grant under section 4 shall distribute the funds allotted to cover the
			 increase in the cost of fuel for school buses to the public schools within the
			 jurisdiction of such local educational agency proportionally, based on such
			 local educational agency’s estimate of the total miles traveled by school buses
			 that serve such public schools.</text>
		</section><section id="H329256AEC7C04FA09F74690048F43403"><enum>7.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary is authorized to prescribed
			 regulations necessary to implement this Act.</text>
		</section><section id="H726C712E75F44D989EF83FDCC8BE4FA1"><enum>8.</enum><header>Authorization of
			 Appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act.</text>
		</section><section id="HAFCF78E720B1465A95967DC797B63C94"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph display-inline="no-display-inline" id="H4A780613923F49BBB62B74D95EE11DAE"><enum>(1)</enum><header>In
			 general</header><text>The terms <quote>local educational agency</quote> and
			 <quote>State educational agency</quote> have the meanings given the terms in
			 section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7801).</text>
			</paragraph><paragraph id="H2E31656DCE794671A29BC0DF88D75E58"><enum>(2)</enum><header>Increase in the
			 cost of fuel for school buses</header><text>The phrase <quote>increase in the
			 cost of fuel for school buses</quote> means the amount of increase in the cost
			 of fuel for school buses from the date one calendar year prior to the date of
			 the enactment of this Act to the date of the enactment of this Act.</text>
			</paragraph><paragraph id="HCA725DE97386409D9F3BBF82976C615D"><enum>(3)</enum><header>Increase in the
			 cost of energy</header><text display-inline="yes-display-inline">The phrase
			 <quote>increase in the cost of energy</quote> means the amount of increase in
			 energy prices from the date one calendar year prior to the date of the
			 enactment of this Act to the date of the enactment of this Act.</text>
			</paragraph><paragraph id="H5BD1265A63BB4232926082C3451D00F2"><enum>(4)</enum><header>Public
			 school</header><text display-inline="yes-display-inline">The term <quote>public
			 school</quote> has the meaning given the term in section 5145 of the Elementary
			 and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7217d">20 U.S.C. 7217d</external-xref>).</text>
			</paragraph><paragraph id="HFED89D7E9A1B46368B895FA12290CA38"><enum>(5)</enum><header>School
			 bus</header><text>The term <quote>school bus</quote> means a bus or any other
			 vehicle used to transport students to and from their homes to school, or to and
			 from school-related activities and events.</text>
			</paragraph><paragraph id="H9EE18D15E72442F3AABCC937671959D1"><enum>(6)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means Secretary of Education.</text>
