		<section id="HCA51E30F4CE14E11822029DA93B3EF50" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Incumbent Worker Development Act of
			 2008</short-title></quote>.</text>
		</section><section id="HF32928D79CB84AEBB9FAEE5B58F1E2C4"><enum>2.</enum><header>Grants for
			 incumbent worker training</header>
			<subsection id="H935FDFAA060B48EFB591D7008700876C"><enum>(a)</enum><header>Grant
			 authority</header><text>Subject to the availability of appropriations, the
			 Secretary of Labor shall establish a program to make grants to States to assist
			 employers in providing incumbent worker training.</text>
			</subsection><subsection id="H098719DC7727416B9310F015DBF2B2A9"><enum>(b)</enum><header>Matching
			 requirement</header><text display-inline="yes-display-inline">The Federal share
			 of the costs of an activity carried out with a grant under this section may not
			 exceed 50 percent of cost of the activity.</text>
			</subsection><subsection commented="no" id="HF7DF1478BD344011AFA6F3A8F1392B44"><enum>(c)</enum><header>Limitations on
			 Use of Grant</header><text display-inline="yes-display-inline">No grant under
			 this section may be used—</text>
				<paragraph commented="no" id="H86C9530E76924BDAADDFB575A2308787"><enum>(1)</enum><text>to pay wages or
			 compensate for lost revenue, if any, in connection with providing incumbent
			 worker training; or</text>
				</paragraph><paragraph id="H80C6AD0DA7AF416A868975F1EA2E4DEC"><enum>(2)</enum><text display-inline="yes-display-inline">for training provided to an employee by the
			 employer (or by another entity on behalf of the employer), if—</text>
					<subparagraph id="H0B3B3C89EC234E3D9D3F95E1C42FE000"><enum>(A)</enum><text>the purpose of
			 such training is to prepare the employee to assume the responsibilities
			 associated with the job that the employee holds with the employer; and</text>
					</subparagraph><subparagraph id="H1FC86D2515C542D5A3B2E95528BE2221"><enum>(B)</enum><text display-inline="yes-display-inline">the training occurs during a period—</text>
						<clause id="HFDC366C2ED7F4738A6B4BFF5A9859FBB"><enum>(i)</enum><text>that
			 begins on the most recent date on which the employer hired the employee;
			 and</text>
						</clause><clause id="H6734319868BB4FC7BED78835BB87B069"><enum>(ii)</enum><text>that the
			 Secretary determines is appropriate.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HDAD4BD5C705740B5B9486C50D802A9A2"><enum>(d)</enum><header>Incumbent worker
			 training defined</header><text display-inline="yes-display-inline">For purposes
			 of this section, the term <term>incumbent worker training</term> means training
			 offered to an employee by the employer of the employee (or by another entity on
			 behalf of the employer) to enhance the knowledge and skills of the employee for
			 the purpose of improving the employee’s job performance.</text>
