<official-title>To amend title XXI of the Social Security Act to extend through fiscal year 2012 funding under the State Children’s Health Insurance Program (SCHIP).</official-title>

<section id="H2C7B1D3B45D04681ACD729B787C3084F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SCHIP Full Funding Extension Act of 2008</short-title></quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="HB13DEAFEDBDF4C1EA577E2D097234426" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Extending SCHIP funding through fiscal year 2012</header> 
<subsection commented="no" display-inline="no-display-inline" id="H8448556DC47F44CC905DF0128069B500"><enum>(a)</enum><header display-inline="yes-display-inline">Through fiscal year 2012</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H11E4F3986AFF4AC88F934E21D303BD3D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 2104 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd</external-xref>), as amended by section 201 of the Medicare, Medicaid, and SCHIP Extension Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/173">Public Law 110–173</external-xref>), is amended—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H14FC7203C35645DC9F15D51000E522C8"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(11), by striking <quote>and 2009</quote> and inserting <quote>, 2009, 2010, 2011, and 2012</quote>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HCEA06BA9C092431F87DA4573A8650074"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c)(4)(B), by striking <quote>through 2009</quote> and inserting <quote>through 2012</quote>.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H32C2A42C7D8B4897A56B31F000F5ADA"><enum>(2)</enum><header display-inline="yes-display-inline">Availability of extended funding</header><text display-inline="yes-display-inline">Funds made available from any allotment made from funds appropriated under subsection (a)(11) or (c)(4)(B) of section 2104 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd</external-xref>) for fiscal year 2009, 2010, 2011, or 2012 shall not be available for child health assistance for items and services furnished after September 30, 2012.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H3D5F1AF570BB4E02866297C878F29530"><enum>(b)</enum><header display-inline="yes-display-inline">Extension of treatment of qualifying States</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H92075F68C6A444059471285900373FC3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 2105(g)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ee">42 U.S.C. 1397ee(g)(1)(A)</external-xref>), as amended by section 201(b) of the Medicare, Medicaid, and SCHIP Extension Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/173">Public Law 110–173</external-xref>), is amended by striking <quote>or 2009</quote> and inserting <quote>2009, 2010, 2011, or 2012</quote>.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H75509229DA1E4E8C88F4DD72F3C3C953"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 201(b) of such Public Law is amended by striking paragraph (2).</text></paragraph></subsection> 
<subsection id="HA6CEDC4E4998459695364B2BAA47614"><enum>(c)</enum><header>Additional allotments To maintain SCHIP programs through fiscal year 2012</header><text>Section 2104 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd</external-xref>) is amended by striking subsection (l) and inserting the following new subsections: </text>

<subsection commented="no" display-inline="no-display-inline" id="H5F36E55AE49D42889FD7EEFBE68EB153"><enum>(l)</enum><header display-inline="yes-display-inline">Additional allotments To maintain SCHIP programs for fiscal year 2009</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H2A7A097CAB1D4A198EFA81DAAEB52200"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriation; allotment authority</header><text display-inline="yes-display-inline">For the purpose of providing additional allotments described in subparagraphs (A) and (B) of paragraph (3), there is appropriated, out of any money in the Treasury not otherwise appropriated, such sums as may be necessary, not to exceed $2,000,000,000 for fiscal year 2009.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC494A91D1CAC4B02A6C5EF92FEDD91C"><enum>(2)</enum><header display-inline="yes-display-inline">Shortfall states described</header><text display-inline="yes-display-inline">For purposes of paragraph (3), a shortfall State described in this paragraph is a State with a State child health plan approved under this title for which the Secretary estimates, on the basis of the most recent data available to the Secretary, that the Federal share amount of the projected expenditures under such plan for such State for fiscal year 2009 will exceed the sum of—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H20179F740FB64B1C9412C371C4BD8836"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of the State’s allotments for each of fiscal years 2007 and 2008 that will not be expended by the end of fiscal year 2008;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7B23622BDBAD4C9FA10025C5A9AECB45"><enum>(B)</enum><text display-inline="yes-display-inline">the amount, if any, that is to be redistributed to the State during fiscal year 2009 in accordance with subsection (i); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEA8599F06C27411DA5BC4DF5E1F7CB00"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of the State’s allotment for fiscal year 2009.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H693FB6E4F2154CA4A56645BB2DC89E24"><enum>(3)</enum><header display-inline="yes-display-inline">Allotments</header><text display-inline="yes-display-inline">In addition to the allotments provided under subsections (b) and (c), subject to paragraph (4), of the amount available for the additional allotments under paragraph (1) for fiscal year 2009, the Secretary shall allot—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H287A97D3ADAB4265B103727000CC1C38"><enum>(A)</enum><text display-inline="yes-display-inline">to each shortfall State described in paragraph (2) not described in subparagraph (B), such amount as the Secretary determines will eliminate the estimated shortfall described in such paragraph for the State; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEA74D6E8865741D4926BC9A9A72FC17"><enum>(B)</enum><text display-inline="yes-display-inline">to each commonwealth or territory described in subsection (c)(3), an amount equal to the percentage specified in subsection (c)(2) for the commonwealth or territory multiplied by 1.05 percent of the sum of the amounts determined for each shortfall State under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H87642037B98C4C10BA00F27328D8E1A4"><enum>(4)</enum><header display-inline="yes-display-inline">Proration rule</header><text display-inline="yes-display-inline">If the amounts available for additional allotments under paragraph (1) are less than the total of the amounts determined under subparagraphs (A) and (B) of paragraph (3), the amounts computed under such subparagraphs shall be reduced proportionally.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H702A8490C148445D8060C161ACA503DA"><enum>(5)</enum><header display-inline="yes-display-inline">Retrospective adjustment</header><text display-inline="yes-display-inline">The Secretary may adjust the estimates and determinations made to carry out this subsection as necessary on the basis of the amounts reported by States not later than November 30, 2008, on CMS Form 64 or CMS Form 21, as the case may be, and as approved by the Secretary.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H4E9E8451C7024AE2BD856C48FFCB9914"><enum>(6)</enum><header display-inline="yes-display-inline">One-year availability; no redistribution of unexpended additional allotments</header><text display-inline="yes-display-inline">Notwithstanding subsections (e) and (f), amounts allotted to a State pursuant to this subsection for fiscal year 2009, subject to paragraph (5), shall only remain available for expenditure by the State through September 30, 2009. Any amounts of such allotments that remain unexpended as of such date shall not be subject to redistribution under subsection (f).</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1549283117484769A1508F8C6D552537"><enum>(m)</enum><header display-inline="yes-display-inline">Additional allotments To maintain SCHIP programs for fiscal year 2010</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H70FA490AEEB848DDA494F7E1E75C91A2"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriation; allotment authority</header><text display-inline="yes-display-inline">For the purpose of providing additional allotments described in subparagraphs (A) and (B) of paragraph (3), there is appropriated, out of any money in the Treasury not otherwise appropriated, such sums as may be necessary, not to exceed $3,000,000,000 for fiscal year 2010.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD609341E48EE40DFACFB151F38CF96AD"><enum>(2)</enum><header display-inline="yes-display-inline">Shortfall states described</header><text display-inline="yes-display-inline">For purposes of paragraph (3), a shortfall State described in this paragraph is a State with a State child health plan approved under this title for which the Secretary estimates, on the basis of the most recent data available to the Secretary, that the Federal share amount of the projected expenditures under such plan for such State for fiscal year 2010 will exceed the sum of—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0019EDDB8B844F87B4875C635B72B3AD"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of the State’s allotments for each of fiscal years 2008 and 2009 that will not be expended by the end of fiscal year 2009;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H93E26835DD5E4DDFAA211186B6329359"><enum>(B)</enum><text display-inline="yes-display-inline">the amount, if any, that is to be redistributed to the State during fiscal year 2010 in accordance with subsection (f); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H739A3AB8818B4FB8A9AE451EAEADDF03"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of the State's allotment for fiscal year 2010.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H536F625FE63E494AB394802C03F1B41"><enum>(3)</enum><header display-inline="yes-display-inline">Allotments</header><text display-inline="yes-display-inline">In addition to the allotments provided under subsections (b) and (c), subject to paragraph (4), of the amount available for the additional allotments under paragraph (1) for fiscal year 2010, the Secretary shall allot—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB7752C9C2980472AB301F51CAA7885C0"><enum>(A)</enum><text display-inline="yes-display-inline">to each shortfall State described in paragraph (2) not described in subparagraph (B) such amount as the Secretary determines will eliminate the estimated shortfall described in such paragraph for the State; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H508CA96C048C44449228AFC025DDE0A"><enum>(B)</enum><text display-inline="yes-display-inline">to each commonwealth or territory described in subsection (c)(3), an amount equal to the percentage specified in subsection (c)(2) for the commonwealth or territory multiplied by 1.05 percent of the sum of the amounts determined for each shortfall State under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC0A7FF21E77448ACB30033849DBB891D"><enum>(4)</enum><header display-inline="yes-display-inline">Proration rule</header><text display-inline="yes-display-inline">If the amounts available for additional allotments under paragraph (1) are less than the total of the amounts determined under subparagraphs (A) and (B) of paragraph (3), the amounts computed under such subparagraphs shall be reduced proportionally.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H17016858AB5D482A994CED98D139B9D2"><enum>(5)</enum><header display-inline="yes-display-inline">Retrospective adjustment</header><text display-inline="yes-display-inline">The Secretary may adjust the estimates and determinations made to carry out this subsection as necessary on the basis of the amounts reported by States not later than November 30, 2010, on CMS Form 64 or CMS Form 21, as the case may be, and as approved by the Secretary.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7AA6AFF78A704910BC7FAD74E2516059"><enum>(6)</enum><header display-inline="yes-display-inline">Availability; no redistribution of unexpended additional allotments</header><text display-inline="yes-display-inline">Notwithstanding subsections (e) and (f), amounts allotted to a State pursuant to this subsection for fiscal year 2010, subject to paragraph (5), shall only remain available for expenditure by the State through September 30, 2010. <subsection id="H023DC82742124380A6C718137888346D"><enum>(n)</enum><header>Application to fiscal years 2011 and 2012</header> 
<paragraph id="HF7E7147F15C54B25A43BEEA5F3BC014"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), subsection (m) shall apply to each of fiscal years 2011 and 2012 in the same manner such subsection applies to fiscal year 2010.</text></paragraph> 
<paragraph id="HBCC06C95A3094249870893966786DE5F"><enum>(2)</enum><header>Application</header><text>In applying subsection (m) under paragraph (1) with respect to—</text> 
<subparagraph id="HFD6AA6E64EE04D0BB43BBE777762E810"><enum>(A)</enum><text>fiscal year 2011—</text> 
<clause id="HCF57A1F7B4E940E3AC8499C757499DB6"><enum>(i)</enum><text>each reference to a year or date in such subsection shall be deemed a reference to the following year or to one year after such date, respectively; and</text></clause> 
<clause id="HECF8CA1EA92449B4AD6C32BF5E6D628"><enum>(ii)</enum><text>the reference to <quote>$3,000,000,000</quote> in paragraph (1) of such subsection shall be deemed a reference to <quote>$4,000,000,000</quote>; and </text></clause></subparagraph> 
<subparagraph id="H3FFDA0D447E14001B3C96D001467ED9C"><enum>(B)</enum><text display-inline="yes-display-inline">fiscal year 2012—</text> 
<clause id="H4F728941128347649F8424A8A9CA8D57"><enum>(i)</enum><text>each reference to a year or date in such subsection shall be deemed a reference to the second following year or to two year after such date, respectively; and</text></clause> 
<clause id="H3A4993C278584B98B9C493A8F16F9E02"><enum>(ii)</enum><text display-inline="yes-display-inline">the reference to <quote>$3,000,000,000</quote> in paragraph (1) of such subsection shall be deemed a reference to <quote>$5,000,000,000</quote>.</text></clause></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section> 
<section id="H033B45F42BAA498B8EDBE56E83FE724E"><enum>3.</enum><header>Option for qualifying States to receive the enhanced portion of the SCHIP matching rate for Medicaid coverage of certain children</header><text display-inline="no-display-inline">Section 2105(g) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ee">42 U.S.C. 1397ee(g)</external-xref>) is amended—</text> 
<paragraph id="H9558A875E50243CF899C75253F3073D4"><enum>(1)</enum><text>in paragraph (1)(A), by inserting <quote>subject to paragraph (4),</quote> after <quote>Notwithstanding any other provision of law,</quote>; and</text></paragraph> 
<paragraph id="HF3033A544ADF4CA291E9A5A97DA8BC98"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="H361BA0E11F864C30A5F1CF33DFE6F00" style="OLC"> 
<paragraph id="HAC62ECFBD18C4E6CABEFF000981D77AA"><enum>(4)</enum><header>Option for certain allotments</header> 
<subparagraph id="H1758E5581CDE40C28300B372A2ABDC83"><enum>(A)</enum><header>Payment of enhanced portion of matching rate for certain expenditures</header><text>In the case of expenditures described in subparagraph (B), a qualifying State (as defined in paragraph (2)) may elect to be paid from the State’s allotment made under section 2104 for any fiscal year (beginning with fiscal year 2009) (insofar as the allotment is available to the State under subsection (e) of such section) an amount each quarter equal to the additional amount that would have been paid to the State under title XIX with respect to such expenditures if the enhanced FMAP (as determined under subsection (b)) had been substituted for the Federal medical assistance percentage (as defined in section 1905(b)).</text></subparagraph> 
<subparagraph id="H1C578B3BDE97464ABDA648AD00E2D0DA"><enum>(B)</enum><header>Expenditures described</header><text>For purposes of subparagraph (A), the expenditures described in this subparagraph are expenditures made after the date of the enactment of this paragraph and during the period in which funds are available to the qualifying State for use under subparagraph (A), for the provision of medical assistance to individuals residing in the State who are eligible for medical assistance under the State plan under title XIX or under a waiver of such plan and who have not attained age 19, and whose family income equals or exceeds 133 percent of the poverty line but does not exceed the Medicaid applicable income level.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
