		  <quote>one-strike</quote> eviction from public and federally assisted
		  housing.</official-title>

		<section id="H4345345FBB3B41DC8EC1AF1208054EDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>No One Strike Eviction Act of
			 2008</short-title></quote>.</text>
		</section><section id="H3AFAF4BE1A29499180FCA723A0796D4E"><enum>2.</enum><header>Reform of
			 <quote>one strike</quote> mandatory eviction</header>
			<subsection id="H441A9469C7BC4AB1870004AD01462E06"><enum>(a)</enum><header>United States
			 Housing Act of 1937</header><text>Section 6(k) of the United States Housing Act
			 of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437d">42 U.S.C. 1437d(k)</external-xref>) is amended—</text>
				<paragraph id="H436C0220D4D546449548CE30253338FE"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) through (6) as subparagraphs (A) through (F) and realigning such
			 subparagraphs (as so redesignated) so as to be indented 4 ems from the left
			 margin;</text>
				</paragraph><paragraph id="H0AFEC38170984CE1BEE86922A841F76"><enum>(2)</enum><text>by
			 striking <quote>(k) The Secretary shall</quote> and inserting the
			 following:</text>
					<quoted-block id="HFF9AE71CD58544F6BF7C49798FB8C785" style="OLC">
						<subsection id="HB12528CF976B4D8A9B04AF1FCCC0DB"><enum>(k)</enum><header>Review of eviction
				and denials of tenancy</header>
							<paragraph id="HFB506729E62B42E9BCB784FDF4F8EFF0"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (3), the Secretary
				shall</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H19A75BF81832409187554BB8E00359C8"><enum>(3)</enum><text>by striking
			 <quote>For any grievance concerning</quote> and inserting the following:</text>
					<quoted-block id="HD2F748B4289F4C268CEBC9F344EF4BF" style="OLC">
						<paragraph id="H59B285FD41964AA5BCEFBB22237FC4D8"><enum>(2)</enum><header>Expedited
				procedures</header><text>Subject to paragraph (3), for any grievance
				concerning</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H20B58D0415424004BA951C7794F8D292"><enum>(4)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block id="H40228E665C5149C7A3E772FCF9A9B1A3" style="OLC">
						<paragraph id="H6B3EA95937ED403799EBAF3C656245BD"><enum>(3)</enum><header>Mitigating
				circumstances and innocent owner</header>
							<subparagraph id="H5CF8A9D069EB4BEDA69DA85DC32DA6C8"><enum>(A)</enum><header>Mitigating
				circumstances</header><text>In determining whether to evict a tenant, terminate
				a tenancy, or deny an application for tenancy due to a criminal conviction of
				the person that is the subject of a grievance, and in any judicial review of
				such determination, the public housing agency or other reviewing body shall
				consider all mitigating circumstances and the impact of the eviction,
				termination, or denial upon the family and dependents of that person.</text>
							</subparagraph><subparagraph id="H81855539A16E4FF2852E5D9BDE3D132C"><enum>(B)</enum><header>Innocent
				tenants</header><text>A tenant shall not be subject to eviction, denied a
				tenancy, or have a tenancy terminated based solely upon the familial
				relationship of the tenant to a person who has been convicted of a criminal
				offense.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HDBDB9F8FD1A34FAF96C34032E941A4E2"><enum>(b)</enum><header>Quality Housing
			 and Work Responsibility Act of 1998</header>
				<paragraph id="H6C168B596D7249B8AF20B2D9E778F17D"><enum>(1)</enum><header>Ineligibility</header><text>Section
			 576 of the Quality Housing and Work Responsibility Act of 1998 (42 U.S.C.
			 13661) is amended—</text>
					<subparagraph id="HF2B00061FD5D400297AAE7F63B1F2CE9"><enum>(A)</enum><text>in subsection
			 (b)—</text>
						<clause id="H76C0456E76CD4BDBAC2D8569FC5105D"><enum>(i)</enum><text>in
			 paragraph (1), by striking <quote>any household with a member</quote> and
			 inserting <quote>any person</quote>; and</text>
						</clause><clause id="H06EFEB67F3C8491B81A4865344CC100"><enum>(ii)</enum><text>in
			 paragraph (2)—</text>
							<subclause id="H13ACACC97F7D452B9154177E22A1D9B0"><enum>(I)</enum><text>by striking
			 <quote>any household</quote> and inserting <quote>any person</quote>;
			 and</text>
							</subclause><subclause id="H91E8FA67F4FE43499792ACC3F4D389D7"><enum>(II)</enum><text>by striking
			 <quote>household member</quote> each place such term appears and inserting
			 <quote>person</quote>;</text>
							</subclause></clause></subparagraph><subparagraph id="H028793EFA9194F1B86881C1C1263CF3"><enum>(B)</enum><text>in subsection
			 (c)—</text>
						<clause id="H533189FA5D3249A3A7A19B55D4243043"><enum>(i)</enum><text>in
			 the matter preceding paragraph (1)—</text>
							<subclause id="H3448C1EC9236476B921BC513D2EBF8A"><enum>(I)</enum><text>by
			 striking <quote>or any member of the applicant’s household</quote>; and</text>
							</subclause><subclause id="H363E1308A7CE451A8668E58592544B87"><enum>(II)</enum><text>by striking
			 <quote>applicant household</quote> and inserting <quote>applicant</quote>;
			 and</text>
							</subclause></clause><clause id="HE3E6F086ECC14024AD4439875D1517EB"><enum>(ii)</enum><text>in
			 paragraph (2)—</text>
							<subclause id="H99E0F52CDD4F4053BCD39EDE6CA9A91D"><enum>(I)</enum><text>by striking
			 <quote>or individuals in the applicant’s household</quote>; and</text>
							</subclause><subclause id="H46A05C012F684A7486008E432DC97763"><enum>(II)</enum><text>by striking
			 <quote>have not</quote> and inserting <quote>has not</quote>;</text>
							</subclause></clause></subparagraph><subparagraph id="H8A5DF2168736400EA2F5E0C6300018B"><enum>(C)</enum><text>by redesignating
			 subsection (d) as subsection (e); and</text>
					</subparagraph><subparagraph id="H4EC40146C7E240AB9B00C0D774ACEC07"><enum>(D)</enum><text>by inserting after
			 subsection (d) the following new subsection:</text>
						<quoted-block id="HFB18D0347FEE453295341DFD6B27F2F8" style="OLC">
							<subsection id="H9096F5B65B254CFF9E47288C00B9BB1E"><enum>(d)</enum><header>Review of denial
				of application</header>
								<paragraph id="HA3464DC9435244C387F43F19B8BC7DC1"><enum>(1)</enum><header>Review of
				denial</header><text>The denial of an application under this section shall be
				subject to review in accordance with the provisions of section 6(k) of the
				United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437d">42 U.S.C. 1437d(k)</external-xref>).</text>
								</paragraph><paragraph id="H95E010BBA59A403F9C30AAB9C77F59BF"><enum>(2)</enum><header>Innocent
				applicants</header><text>Nothing in this section shall allow for the denial of
				an application based solely on the familial relationship of an applicant to a
				person who has a criminal conviction or is otherwise in violation of this
				section.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H6CD762B8BA1C45489F751500CB473662"><enum>(2)</enum><header>Termination of
			 tenancy and assistance for illegal drug users and alcohol abusers in federally
			 assisted housing</header><text>Section 577 of the Quality Housing and Work
			 Responsibility Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/42/13662">42 U.S.C. 13662</external-xref>) is amended—</text>
					<subparagraph id="HA73BD304E28F4E76846FD4D47BA5FF67"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>household with a member</quote> and inserting
			 <quote>person</quote>;</text>
					</subparagraph><subparagraph id="H08370C95F87C4C35871B4166B0A49F2"><enum>(B)</enum><text>in subsection
			 (b)—</text>
						<clause id="HE11B5B86DABF450E92EA87C4B8A0EAAB"><enum>(i)</enum><text>by
			 striking <quote>household based</quote> and inserting <quote>person
			 based</quote>;</text>
						</clause><clause id="HF885924F04A4455283D21741177F472B"><enum>(ii)</enum><text>by
			 striking <quote>by a household member</quote> and inserting <quote>by that
			 person</quote>; and</text>
						</clause><clause id="H144C4C00AA5045EC87328696EA6279C6"><enum>(iii)</enum><text>by
			 striking <quote>such household member</quote> and inserting <quote>such
			 person</quote>; and</text>
						</clause></subparagraph><subparagraph id="HBB785CD29D574DF1BD1CFC19C741BDAC"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H97FACA1E1508491E9F00CBD58232FD04" style="OLC">
							<subsection id="HDEF502DB58714151B20150C01783801B"><enum>(c)</enum><header>Review of
				termination of tenancy</header><text>The decision to terminate the tenancy or
				assistance of any person under this section shall be subject to review in
				accordance with the provisions of section 6(k) of the United States Housing Act
				of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437d">42 U.S.C. 1437d(k)</external-xref>).</text>
							</subsection><subsection id="H16D558BECBC643F8B2DE4D6E23E01408"><enum>(d)</enum><header>Innocent
				tenants</header><text>Nothing in this section shall allow for the termination
				of a tenancy or assistance to any person based solely on the familial
				relationship of the tenant to a person who is in violation of this
				section.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HF4D045FAB8B544A9855D0059EC01A8E2"><enum>(c)</enum><header>Requirement of
			 intent or knowledge of crime before eviction from or denial of public and
			 publicly assisted housing</header><text display-inline="yes-display-inline">The
			 United States Housing Act of 1937 is amended—</text>
				<paragraph id="H8D5DAA4F24774F1CAEFD7B1E7F2EDDD3"><enum>(1)</enum><text display-inline="yes-display-inline">in each of sections 6(l)(6) and 8(o)(7)(D)
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437d">42 U.S.C. 1437d(l)(6)</external-xref> and 1437f(o)(7)(D)), by inserting after the first
			 semicolon the following: <quote>except that such criminal or drug-related
			 activity, engaged in by a member of a tenant’s household or any guest or other
			 person under the tenant’s control, shall not be cause for termination of
			 tenancy of the tenant if the tenant did not know and should not have known of
			 the activity, or if the tenant, member of the tenant’s household, or any guest
			 or other person under the tenant’s control was the victim of criminal activity;
			 and</quote>; and</text>
				</paragraph><paragraph id="H777FA70E078643C58952D404B45937D"><enum>(2)</enum><text display-inline="yes-display-inline">in section 8(d)(1)(B)(iii) (42 U.S.C.
			 1437f(d)(1)(B)(iii)), by inserting after the first colon the following:
			 <quote>such criminal or drug-related activity, engaged in by a member of a
			 tenant’s household or any guest or other person under the tenant’s control,
			 shall not be cause for termination of tenancy of the tenant if the tenant did
			 not know and should not have known of the activity, or if the tenant, member of
			 the tenant’s household, or any guest or other person under the tenant’s control
			 was the victim of criminal activity; and except that</quote>.</text>
				</paragraph></subsection></section></legis-body>
