			 victims of hate crimes</header>
			<section id="H4116B8C33EB04ADE95FC97186B7085CA"><enum>101.</enum><header>Unemployment
			 compensation</header>
				<subsection id="H71B44B9538104A46A099FDFA35F4AD2F"><enum>(a)</enum><header>Unemployment
			 compensation</header><text display-inline="yes-display-inline">Subsection (a)
			 of <external-xref legal-doc="usc" parsable-cite="usc/26/3304">section 3304</external-xref> of the Internal Revenue Code of 1986 is amended by striking
			 <quote>and</quote> at the end of paragraph (18), by striking the period at the
			 end of paragraph (19) and inserting <quote>; and</quote>, and by inserting
			 after paragraph (19) the following new paragraph:</text>
					<quoted-block id="H0236E438A8B049AF9B85C2FC000805DB" style="OLC">
						<paragraph id="H7DC4C1FD3CCE4F8CA2B2838ED9728DFE"><enum>(20)</enum><text>compensation
				shall be payable in the case of an individual separated from employment due to
				circumstances directly resulting from the individual’s experience as a victim
				of a hate
				crime.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subsection><subsection id="H37C451CBFF40492781DB23275BE1A470"><enum>(b)</enum><header>Special rules
			 relating to hate crimes</header><text>Section 3304 of the Internal Revenue Code
			 of 1986 is amended by adding at the end the following new subsection:</text>
					<quoted-block id="H9DF6934C8A6E43B5B778CE757C8DEA9" style="OLC">
						<subsection id="HB9EDEBFE6C2C4E57853EC914C449F216"><enum>(g)</enum><header>Special rules
				relating to hate crimes</header>
							<paragraph id="HBA0865CD602541B1997CA6185CE74098"><enum>(1)</enum><text>For purposes of
				determining, under subsection (a)(20), whether an individual’s separation from
				employment shall be treated as directly resulting from the individual’s
				experience as a victim of a hate crime, it shall be sufficient if the
				separation from employment resulted from—</text>
								<subparagraph id="HAB0ECAC920C74D91AFCB8F573914791D"><enum>(A)</enum><text>the individual’s
				relocation to another geographic area in order to avoid future hate crimes
				against the individual or the individual’s family;</text>
								</subparagraph><subparagraph id="HB948E05D266F4279B7B0AF23D85E1B6E"><enum>(B)</enum><text>the individual’s
				need to recover from physical injury or emotional distress resulting from the
				individual’s experience as a victim of a hate crime; or</text>
								</subparagraph><subparagraph id="H64C1AF33C08F47F48FF7629E2E9812A1"><enum>(C)</enum><text display-inline="yes-display-inline">the employer’s denial of the individual’s
				request for the temporary leave from employment authorized by section 102 of
				the Family and Medical Leave Act of 1993 to address the hate crime and its
				consequences.</text>
								</subparagraph></paragraph><paragraph id="HD82CB9A2A4B544FCAC00315388679D35"><enum>(2)</enum><text>For purposes of
				this section, the term <term>hate crime</term> means a criminal offense in
				which the prosecutor has determined that the defendant intentionally selected a
				victim, or in the case of a property crime, the property that is the object of
				the crime, because of the actual or perceived race, color, religion, national
				origin, ethnicity, gender, disability, or sexual orientation of any
				person.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HE7235AFB84BB46418DB3E17C97C6A5D2"><enum>102.</enum><header>Insurance
			 protection for victims of hate crimes</header>
				<subsection id="HBC3EE00FDA934C3EBA95B7BCBDA5ED5D"><enum>(a)</enum><header>Discrimination
			 prohibited</header><text display-inline="yes-display-inline">An insurer may not
			 take into account whether a person is or has been a victim of a hate crime when
			 making a determination with respect to—</text>
					<paragraph id="HE332AB3B633947AFB44F17BD80E54DE6"><enum>(1)</enum><text>the eligibility
			 (including continued eligibility) of such person to enroll (or continue
			 enrollment) under the terms of the plan, coverage, or policy of insurance
			 involved;</text>
					</paragraph><paragraph id="HC68D9DDB834B4C60B4AFDE8058DD1F3"><enum>(2)</enum><text>the rate or premium
			 of a plan or policy of insurance involved; and</text>
					</paragraph><paragraph id="HB4A1F97567FC4D349801B1905243CE8"><enum>(3)</enum><text>the amount of
			 coverage provided (or a determination of coverage for a claim made) under the
			 plan, coverage, or policy of insurance involved.</text>
					</paragraph></subsection><subsection id="H2D39E563717D47D4BDF9C1D9D43EA09"><enum>(b)</enum><header>Definitions</header>
					<paragraph display-inline="no-display-inline" id="H3B5A7460E43B4992A309FE0006B0972D"><enum>(1)</enum><header>Hate
			 crime</header><text display-inline="yes-display-inline">For purposes of this
			 section, the term <term>hate crime</term> means a criminal offense in which the
			 prosecutor has determined that the defendant intentionally selected a victim,
			 or in the case of a property crime, the property that is the object of the
			 crime, because of the actual or perceived race, color, religion, national
			 origin, ethnicity, gender, disability, or sexual orientation of any
			 person.</text>
					</paragraph><paragraph id="H00D257E355B644998BC4B854638EB431"><enum>(2)</enum><header>Insurer</header><text>For
			 purposes of this section, the term <term>insurer</term> includes a group health
			 plan (as defined in section 2971(a) of the Public Health Service Health Act (42
			 U.S.C. 300gg–91(a)), a health insurance issuer (as defined in section
			 2791(b)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91(b)(2)</external-xref>) offering
			 group insurance coverage in connection with a group health plan, and individual
			 health insurance coverage (as defined in section 2971(b)(5) of the Public
			 Health Service Health Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91(b)(5)</external-xref>).</text>
					</paragraph></subsection><subsection id="H4554AB588C984BCD871D998DF0682CD2"><enum>(c)</enum><header>Effect on other
			 laws</header><text display-inline="yes-display-inline">Nothing in this section
			 shall be construed to preempt any law, rule, or regulation of a State or
			 political subdivision of a State.</text>
				</subsection></section><section id="H0C2D13EC10B64DEDA95F001831D88B7"><enum>103.</enum><header>Entitlement to
			 leave for victims of hate crimes</header>
				<subsection id="HDC43A35529D74D22BFDA200004ECCA36"><enum>(a)</enum><header>Entitlement to
			 leave for victims of hate crimes</header>
					<paragraph id="H99B7116FA5FC4B0895EDABC06C3C8801"><enum>(1)</enum><header>Authority for
			 Leave</header><text>Section 102(a)(1) of the Family and Medical Leave Act of
			 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) is amended by adding at the end the
			 following:</text>
						<quoted-block id="H453A2E7A0D2C4D7F8974DEF64F2B00D4" style="OLC">
							<subparagraph id="HABC611F62F124FD091F3E324F0AB3399"><enum>(F)</enum><text>In order to care
				for the spouse or a son, daughter, or parent of the employee, if such spouse,
				son, daughter, or parent is addressing a hate crime and its
				consequences.</text>
							</subparagraph><subparagraph id="H6B28B31CA5874314ADEA43C36C9574CE"><enum>(G)</enum><text>Because the
				employee is addressing a hate crime and its consequences, the employee is
				unable to perform the functions of the position of such
				employee.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H025DFBE14BAA486AAAE2460056A491C0"><enum>(2)</enum><header>Definition</header><text>Section
			 101 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>) is amended by
			 adding at the end the following:</text>
						<quoted-block id="H30D7C89D374A40DBA1288CE0D746B900" style="OLC">
							<paragraph id="HE35D27541C0C4C8EB60479F9BAA0B1F5"><enum>(20)</enum><header>hate
				crime</header><text display-inline="yes-display-inline">The term <term>hate
				crime</term> means a criminal offense in which the prosecutor has determined
				that the defendant intentionally selected a victim, or in the case of a
				property crime, the property that is the object of the crime, because of the
				actual or perceived race, color, religion, national origin, ethnicity, gender,
				disability, or sexual orientation of any person.</text>
							</paragraph><paragraph id="H254D033D79224B5EA5292355D98F0004"><enum>(21)</enum><header>addressing a
				hate crime and its consequences</header><text>The term <term>addressing a hate
				crime and its consequences</term> means—</text>
								<subparagraph id="H98F487185FCA4F4DADEAC0AF48B60010"><enum>(A)</enum><text>seeking medical
				attention for or recovering from injuries caused by being a victim of a hate
				crime;</text>
								</subparagraph><subparagraph id="H55F584F38230448500447DE7BFC8BC2"><enum>(B)</enum><text>seeking legal
				assistance or remedies, including communicating with the police or an attorney,
				or participating in any legal proceeding related to being a victim of a hate
				crime;</text>
								</subparagraph><subparagraph id="HD959CDB9191B475E80F8F09EDC58E872"><enum>(C)</enum><text>attending support
				groups for victims of hate crimes; and</text>
								</subparagraph><subparagraph id="H356FC0C385CB48268D1142518426C1E2"><enum>(D)</enum><text>obtaining
				psychological counseling related to the experience of being a victim of a hate
				crime.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H585B554733484176B94FB0E67667AC1D"><enum>(3)</enum><header>Intermittent or
			 Reduced Leave</header><text>Section 102(b) of the Family and Medical Leave Act
			 of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)</external-xref>) is amended by adding at the end the
			 following:</text>
						<quoted-block id="HD3012C5781C14C18873D3EAC838CC476" style="OLC">
							<paragraph id="HF074FA2488E644BAA75DC2716B588CC2"><enum>(3)</enum><header>Hate
				Crimes</header><text display-inline="yes-display-inline">Leave under
				subparagraph (F) or (G) of subsection (a)(1) may be taken by an employee
				intermittently or on a reduced leave schedule. The taking of leave
				intermittently or on a reduced leave schedule pursuant to this paragraph shall
				not result in a reduction in the total amount of leave to which the employee is
				entitled under subsection (a) beyond the amount of leave actually
				taken.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H87EF957587EB4F99A1588D33005F8439"><enum>(4)</enum><header>Paid
			 Leave</header><text>Section 102(d)(2)(A) of the Family and Medical Leave Act of
			 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)(2)(A)</external-xref>) is amended by striking <quote>(C), or
			 (E)</quote> and inserting <quote>(C), (E), (F), or (G)</quote>.</text>
					</paragraph><paragraph id="HB73074B2C4644EDB8BF68E6FE589486C"><enum>(5)</enum><header>Certification</header><text display-inline="yes-display-inline">Section 103 of the Family and Medical Leave
			 Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by adding at the end the
			 following:</text>
						<quoted-block id="H2C272C217E02428099D49DD0619E2CC6" style="OLC">
							<subsection id="HFE77A36B68C049E7A154789111F45F61"><enum>(g)</enum><header>hate
				crimes</header>
								<paragraph id="HC1B0CFEF5BCD4B4C9BA560DC4DEF2727"><enum>(1)</enum><header>In
				general</header><text>An employer may require that a request for leave under
				subparagraph (F) or (G) of section 102(a)(1) be supported by documentation of
				the hate crime.</text>
								</paragraph><paragraph id="H8ECB83D09C384B37A52101AACEC504E8"><enum>(2)</enum><header>Confidentiality</header><text>An
				employer shall keep any information relating to a hate crime experienced by the
				employee or the spouse, son, daughter, or parent of the employee confidential,
				including an employee’s statement, any corroborating evidence, and the fact
				that the employee has requested leave for the purpose of addressing a hate
				crime and its consequences, except to the extent—</text>
									<subparagraph id="HE5EA34A8B8574470B88DF09B4544ED32"><enum>(A)</enum><text>consented to by
				the employee where disclosure is necessary to protect the employee’s safety or
				the safety of coworkers; or</text>
									</subparagraph><subparagraph id="H96CF6E915BFB420500CC89BFFD3AE5D"><enum>(B)</enum><text>requested by the
				employee to document a hate crime to a court or
				agency.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H904A6A01150344DDAA802B401E0218D9"><enum>(b)</enum><header>Entitlement to
			 leave for Federal employees as victims of hate crimes</header>
					<paragraph id="HE4B7AE0B3D8543029300AF9F001FD68"><enum>(1)</enum><header>Authority for
			 Leave</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/6382">Section 6382(a)(1)</external-xref> of title 5, United States Code, is
			 amended by adding at the end the following:</text>
						<quoted-block id="H40DA225E5B354F709044A5861F24602D" style="OLC">
							<subparagraph id="H2339545C1A524ADE84C684ACB4A95E36" indent="up1"><enum>(E)</enum><text>In order to care for the spouse, or a
				son, daughter, or parent of the employee, if such spouse, son, daughter, or
				parent is addressing a hate crime and its consequences.</text>
							</subparagraph><subparagraph id="HDA280CBFD66944068D9566C0446069FF" indent="up1"><enum>(F)</enum><text>Because the employee is addressing a
				hate crime and its consequences, the employee is unable to perform the
				functions of the position of such
				employee.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HF9A8DFB553CF4E2688C6775B2EF7EC37"><enum>(2)</enum><header>Definitions</header><text>Section
			 6381 of title 5, United States Code is amended by striking <quote>and</quote>
			 at the end of paragraph (5), by striking the period at the end of paragraph (6)
			 and inserting a semicolon, and by adding at the end the following:</text>
						<quoted-block id="H6187A0A3B2B34FF5B5CA4C1300EBA3AE" style="OLC">
							<paragraph id="H638AA5D818D04DBF99BDE27163F09292"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>hate crime</term> means a
				criminal offense in which the prosecutor has determined that the defendant
				intentionally selected a victim, or in the case of a property crime, the
				property that is the object of the crime, because of the actual or perceived
				race, color, religion, national origin, ethnicity, gender, disability, or
				sexual orientation of any person; and</text>
							</paragraph><paragraph id="H833C4E874FE1498BAA21E4E112F750B8"><enum>(8)</enum><text>the term
				<term>addressing a hate crime and its consequences</term> means—</text>
								<subparagraph id="H9F80AC0F20F3434EA5161EBFC56C6D98"><enum>(A)</enum><text>seeking medical
				attention for or recovering from injuries caused by being a victim of a hate
				crime;</text>
								</subparagraph><subparagraph id="H47E98B99F8F54CBAABCCA26E516944A6"><enum>(B)</enum><text>seeking legal
				assistance or remedies, including communicating with the police or an attorney,
				or participating in any legal proceeding related to being a victim of a hate
				crime;</text>
								</subparagraph><subparagraph id="H56E580A07D3D4A5B80FF20DD545E4317"><enum>(C)</enum><text>attending support
				groups for victims of hate crimes; and</text>
								</subparagraph><subparagraph id="HA09160603CF74CD9BA8108D835F3F2E8"><enum>(D)</enum><text>obtaining
				psychological counseling related to the experience of being a victim of a hate
				crime.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H56E7995ED82C4F3F8FEE4008F0F000C1"><enum>(3)</enum><header>Intermittent or
			 Reduced Leave</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/6382">Section 6382(b)</external-xref> of title 5, United States Code, is
			 amended by adding at the end the following:</text>
						<quoted-block id="HC2B9520BCE1446758CB27C4592311B7E" style="OLC">
							<paragraph id="HCC5D096779CE40C3A8FB01FA5557F6D5"><enum>(3)</enum><text>Leave under
				subparagraph (E) or (F) of subsection (a)(1) may be taken by an employee
				intermittently or on a reduced leave schedule. The taking of leave
				intermittently or on a reduced leave schedule pursuant to this paragraph shall
				not result in a reduction in the total amount of leave to which the employee is
				entitled under subsection (a) beyond the amount of leave actually
				taken.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H82A30A6E241744D6B7B2CDE06E00FB1B"><enum>(4)</enum><header>Other
			 Leave</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/6382">Section 6382(d)</external-xref> of title 5, United States Code, is amended
			 by striking <quote>(C) or (D)</quote> and inserting <quote>(C), (D), (E), or
			 (F)</quote>.</text>
					</paragraph><paragraph id="H78A6B2AE8CF44D5597ED4F46FE985B39"><enum>(5)</enum><header>Certification</header><text>Section
			 6383 of title 5, United States Code, is amended by redesignating subsection (e)
			 as subsection (f) and by inserting after subsection (d) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HC99ACCF8AC0C46FD934051D7BD46188D" style="OLC">
							<subsection id="HF7D4FA5F67934DF7B060488800F475E8"><enum>(e)</enum>
								<paragraph id="HB322751C625C47AAB47655C694C624B5"><enum>(1)</enum><text>An employing
				agency may require that a request for leave under subparagraph (E) or (F) of
				section 6382(a)(1) be supported by documentation of the hate crime.</text>
								</paragraph><paragraph id="H4D6C9EF1B6AD4C4EB7B1B690776D2231"><enum>(2)</enum><text display-inline="yes-display-inline">An employing agency shall keep any
				information related to a hate crime experienced by an employee or the spouse,
				son, daughter, or parent of the employee confidential, including an employee’s
				statement, any corroborating evidence, and the fact that an employee has
				requested leave for the purpose of addressing a hate crime and its
				consequences, except to the extent—</text>
									<subparagraph id="HB4A1278D4CA34FBDA89C56F38C8F9E1F"><enum>(A)</enum><text>consented to by
				the employee where disclosure is necessary to protect the employee’s safety or
				the safety of coworkers; or</text>
									</subparagraph><subparagraph id="H713B28B2E22F424ABCDD319000D58E00"><enum>(B)</enum><text>requested by the
				employee to provide documentation to a court or
				agency.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="HDEB042D356B24F5EAA6CD82103F4E1B"><enum>(c)</enum><header>Existing leave
			 usable for victims of a hate crime</header>
					<paragraph id="H5EB6604CE01F4E4182A2ACD61358C56"><enum>(1)</enum><header>Use of Existing
			 Leave</header><text>Where an employee would be otherwise entitled to take paid
			 or unpaid leave (including family, medical, sick, annual, personal, or similar
			 leave) from employment pursuant to Federal or State law, an existing benefits
			 program or plan, or a collective bargaining agreement, such employee shall be
			 permitted to use such leave for the purpose of addressing a hate crime and its
			 consequences, or for the purpose of caring for the spouse, or a son, daughter,
			 or parent of the employee, if such spouse, son, daughter, or parent is
			 addressing a hate crime and its consequences.</text>
					</paragraph><paragraph id="H7B81AC98F98E4CBFB260E3E655B8476D"><enum>(2)</enum><header>Definitions</header><text>As
			 used in this subsection:</text>
						<subparagraph id="H62B4A4A6087D4036840917B3DAA637"><enum>(A)</enum><header>Hate
			 crime</header><text display-inline="yes-display-inline">The term <term>hate
			 crime</term> has the meaning given such term by section 101(20) of the Family
			 and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(20)</external-xref>), as amended by section
			 103(a) of this Act.</text>
						</subparagraph><subparagraph id="H4AE17607714549598388B59FD9FDD5C6"><enum>(B)</enum><header>Addressing a
			 hate crime and its consequences</header><text>The term <term>addressing a hate
			 crime and its consequences</term> has the meaning given such phrase by section
			 101(21) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(21)</external-xref>), as
			 amended by section 103(a) of this Act.</text>
						</subparagraph><subparagraph id="H91E98C73B7A34F24B98DEFED2580B9E4"><enum>(C)</enum><header>Employer</header><text>The
			 term <term>employer</term> includes any person acting directly or indirectly in
			 the interest of an employer in relation to any employee, who is subject to the
			 Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601 et seq.</external-xref>) or to any State
			 law or benefits program or plan addressing paid or unpaid leave from employment
			 (including family, medical, sick, annual, personal, or similar leave). The term
			 does not include any labor organization (other than when acting as an employer)
			 or anyone acting in the capacity of an officer or agent of such labor
			 organization.</text>
						</subparagraph><subparagraph id="HEBD0F6806A3741BDB6E4AE7262AD17E8"><enum>(D)</enum><header>Employee</header><text>The
			 term <term>employee</term> has the meaning given such term in section 3(e) of
			 the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>).</text>
						</subparagraph></paragraph><paragraph id="HC3BA76810E0748DB8086F59CFBF42BE"><enum>(3)</enum><header>Certification</header><text>An
			 employer may require that a request for leave described in paragraph (1) be
			 supported by documentation of a hate crime.</text>
					</paragraph><paragraph id="H96649191181942CB9EAFB007EB4DAF"><enum>(4)</enum><header>Confidentiality</header><text>An
			 employer shall keep any information relating to a hate crime experienced by an
			 employee or the spouse, son, daughter, or parent of the employee confidential,
			 including an employee’s statement, any documentation or corroborating evidence,
			 or the fact that the employee has requested leave for the purpose of addressing
			 hate crimes and its consequences, except to the extent—</text>
						<subparagraph id="HB78FF4E90B384681827825E14BCC6FF5"><enum>(A)</enum><text>consented to by
			 the employee in order to protect the employee’s safety or the safety of
			 coworkers; or</text>
						</subparagraph><subparagraph id="H50E0E41593674C949300EE572C02CC50"><enum>(B)</enum><text>requested by the
			 employee to document hate crimes to a court or agency.</text>
						</subparagraph></paragraph><paragraph id="H6AB44805D1E147B7890046E3CFBD739F"><enum>(5)</enum><header>Enforcement</header>
						<subparagraph id="H9597F2EB8CFB4A4ABBB7BB2DD995AFDC"><enum>(A)</enum><header>Public
			 enforcement</header><text>The Secretary of Labor shall have the powers set
			 forth in subsections (b), (c), (d), and (e) of section 107 of the Family and
			 Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2617">29 U.S.C. 2617</external-xref>) for the purpose of public
			 enforcement of any alleged violation of this subsection against any
			 employer.</text>
						</subparagraph><subparagraph id="H2F0956C6FDCF451C9C5C45D5FE6C74BE"><enum>(B)</enum><header>Private
			 enforcement</header><text>The remedies and procedures set forth in subsection
			 (a) of section 107 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2617">29 U.S.C. 2617</external-xref>)
			 shall be the remedies and procedures pursuant to which an employee may initiate
			 a legal action against an employer for alleged violations of this
			 subsection.</text>
						</subparagraph><subparagraph id="H49280E80CB8941C3863598760040EA28"><enum>(C)</enum><header>Employer
			 liability under other laws</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
			 to limit the liability pursuant to any other State or Federal law or legal
			 remedy of an employer to an employee for harm suffered relating to the
			 employee’s experience as a victim of a hate crime.</text>
						</subparagraph></paragraph></subsection></section><section id="HBD6B804F77C045039F754F9D00C54871"><enum>104.</enum><header>Temporary
			 housing assistance</header>
				<subsection id="HEC41BDBAFBF640DCB2E777D2DB08613D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Housing and Urban Development (hereafter in this section referred to as the
			 <quote>Secretary</quote>) may award grants to qualified organizations (as
			 determined by the Secretary) under this section to carry out programs to
			 provide assistance—</text>
					<paragraph id="H6A2FA6C5C1CD49368ED9B9B9A0F79C6D"><enum>(1)</enum><text>to
			 individuals—</text>
						<subparagraph id="H9BB2D308F4B54ECC97454EC4C418F863"><enum>(A)</enum><text>who are victims of
			 a hate crime;</text>
						</subparagraph><subparagraph id="H77A2103486D24DD3A84BF7407FF9F090"><enum>(B)</enum><text>homeless or in
			 need of transitional housing or other housing assistance as a result of being a
			 victim of a hate crime; and</text>
						</subparagraph><subparagraph id="H140148F2D8EF429D9264A492AE8072F6"><enum>(C)</enum><text>for whom emergency
			 shelter services are unavailable or insufficient; and</text>
						</subparagraph></paragraph><paragraph id="HEEF99A5B15124E16A8515905A1FC674C"><enum>(2)</enum><text>dependants of
			 individuals described in paragraph (1).</text>
					</paragraph></subsection><subsection id="H3436200629B44850BA8E9E779DA54296"><enum>(b)</enum><header>Assistance
			 described</header><text>Assistance provided under this section may
			 include—</text>
					<paragraph id="H039D7256782C43EDB4CC44B800FBC5CC"><enum>(1)</enum><text>short-term housing
			 assistance, including rent, utilities payments assistance, and assistance with
			 related expenses, such as payment of security deposits and other costs
			 incidental to relocation to transitional housing; and</text>
					</paragraph><paragraph id="H12A4D81D091B4BC09E615979B12DE44"><enum>(2)</enum><text>support services
			 designed to enable an individual or dependents of such individual to locate and
			 secure permanent housing, and to integrate the individual or dependents of such
			 individual into a community, such as transportation, counseling, child care
			 services, case management, employment counseling, and other assistance.</text>
					</paragraph></subsection><subsection id="H04AE74D260E4485B9054CDEF6695B370"><enum>(c)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this section for any fiscal year, a
			 qualified organization shall submit an application to the Secretary in such
			 form and containing such information as the Secretary may require.</text>
				</subsection><subsection id="HD58B7D796A53458EA648F9B1D0DA8BA5"><enum>(d)</enum><header>Reports</header>
					<paragraph id="H385B6EA68FF94D1EB184D3EBC0D4FDB6"><enum>(1)</enum><header>Report to
			 Secretary</header><text>An entity that receives a grant under this section
			 shall annually prepare and submit to the Secretary a report describing the
			 number of individuals and dependents assisted, and the types of housing
			 assistance and support services provided, under this section. Each report shall
			 include information on the purpose and amount of housing assistance provided to
			 each individual or dependent assisted under this section, and the type of
			 support services provided to each individual or dependent assisted under this
			 section.</text>
					</paragraph><paragraph id="H26AED46255704CA8942EE26170C54FB4"><enum>(2)</enum><header>Report to
			 Congress</header><text>The Secretary shall annually prepare and submit to
			 Congress a report that contains a compilation of the information contained in
			 reports submitted under paragraph (1).</text>
					</paragraph></subsection><subsection id="H82C328B9D72B4BE5B4B108F9B9ECF74"><enum>(e)</enum><header>Supplement not
			 supplant</header><text display-inline="yes-display-inline">Funds made available
			 under this section shall supplement, and not supplant, other Federal, State, or
			 local funds available to an entity to carry out activities described in this
			 section.</text>
				</subsection><subsection id="H6AB8D733F65A45A7BEB1F6114C8539EA"><enum>(f)</enum><header>Definition of
			 hate crime</header><text display-inline="yes-display-inline">For purposes of
			 this section, the term <term>hate crime</term> means a criminal offense in
			 which the prosecutor has determined that the defendant intentionally selected a
			 victim, or in the case of a property crime, the property that is the object of
			 the crime, because of the actual or perceived race, color, religion, national
			 origin, ethnicity, gender, disability, or sexual orientation of any
			 person.</text>
				</subsection><subsection id="H77399C6E8F3947D2B6E3B06CC21E1F"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $10,000,000 for each of fiscal years 2010 through 2015.</text>
				</subsection></section><section id="H3C9E2B7121DE49DBAAF524D93219600"><enum>105.</enum><header>Counseling grant
			 program</header>
				<subsection id="H924D70CFDBC247B9A9FA788BD2057C17"><enum>(a)</enum><header>Authorization
			 and establishment of grant program</header><text display-inline="yes-display-inline">The Attorney General may award grants to
			 qualified organizations (as determined by the Attorney General) to assist in
			 the establishment, maintenance, and expansion of programs and projects to
			 provide counseling and related assistance to victims of hate crimes and their
			 dependents.</text>
				</subsection><subsection id="HB917B89C7D6E4F9FAD08E1FCFA5804FA"><enum>(b)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this section for any fiscal year, a
			 qualified organization shall submit an application to the Attorney General in
			 such form and containing such information as the Attorney General may
			 require.</text>
				</subsection><subsection id="H099C2203CB33462AA429AF1EA4D08C59"><enum>(c)</enum><header>Use of grant
			 funds</header><text>The grant funds provided under this section shall be used
			 to carry out programs and projects that provide counseling and related
			 assistance to victims of hate crimes and their dependents.</text>
				</subsection><subsection id="H7D32876CA28C4F4200B4085CEC6EE108"><enum>(d)</enum><header>Supplement not
			 supplant</header><text display-inline="yes-display-inline">Funds made available
			 under this section shall supplement, and not supplant, other Federal, State, or
			 local funds available to an entity to carry out activities described in this
			 section.</text>
				</subsection><subsection id="H5D2352BF50B7485BB127E730C79EB6DA"><enum>(e)</enum><header>Definitions</header><text>For
			 the purposes of this section—</text>
					<paragraph id="H7ADE996021C3430BAE9E1D8196A2F6C1"><enum>(1)</enum><text>the term
			 <term>counseling</term> includes emergency, short-term, long-term, individual,
			 and group counseling services; and</text>
					</paragraph><paragraph id="HA2156644C0E74DBD88799DBBCAE644CC"><enum>(2)</enum><text>the term
			 <term>related assistance</term> includes—</text>
						<subparagraph id="HFABD9C51912946F8943559B831340734"><enum>(A)</enum><text>assistance with
			 respect to obtaining financial assistance under Federal and State
			 programs;</text>
						</subparagraph><subparagraph id="H867FC0804B6B45BDB32C443943A4A362"><enum>(B)</enum><text>referrals for
			 appropriate health care services;</text>
						</subparagraph><subparagraph id="H45804A3FF3014EB9B2BEF0C1F8E006B"><enum>(C)</enum><text>legal assistance to
			 provide victims with information and assistance through the civil and criminal
			 courts; and</text>
						</subparagraph><subparagraph id="H740B88D56B1B43318BC736C6A7007E7E"><enum>(D)</enum><text>other supportive
			 services, as determined to be appropriate by the Attorney General.</text>
						</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HB694CAE9836845F1BE22EA17FC24798D"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $10,000,000 for each of fiscal years 2010 through 2015.</text>
				</subsection></section></title><title id="H9CC201E70D6147BBA5B0F4466E8F6D54"><enum>II</enum><header>Resources</header>
			<section display-inline="no-display-inline" id="H76D2E95CD78F41C0000085037BDC976D"><enum>201.</enum><header>National
			 clearinghouse and resource center</header>
				<subsection id="HFD18BDDE7B804CE6A6930084A222E28C"><enum>(a)</enum><header>Establishment of
			 national clearinghouse</header><text display-inline="yes-display-inline">The
			 Attorney General may award a grant to a private nonprofit organization to
			 establish and operate a national clearinghouse and resource center to collect,
			 prepare, and analyze information and statistics and analyses of the information
			 and statistics relating to the incidence and prevention of hate crimes.</text>
				</subsection><subsection id="H593BAE3594A845A49094DBC97B3265B7"><enum>(b)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this section a private nonprofit
			 organization shall submit to the Attorney General an application at such time,
			 in such manner, and containing such information as the Attorney General may
			 require.</text>
				</subsection><subsection id="HD4762704A646456BA3D0933767E547C4"><enum>(c)</enum><header>Report</header><text>An
			 organization that receives a grant under this section shall annually prepare
			 and submit to the Attorney General a report on the information and statistics
			 collected and analyzed by the national clearinghouse and resource
			 center.</text>
				</subsection><subsection id="HF34C4AC220034034A4F77E2CBADF4CC"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $10,000,000 for each of fiscal years 2010 through 2015.</text>
				</subsection></section><section id="H23E9C87600D74128A3A548E7CD4E0037"><enum>202.</enum><header>National hate
			 crime hotline and Internet website grant</header>
				<subsection id="H61955F0E64274D28BA7DBB3B064B70E2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Attorney General
			 may award one or more grants to a qualified organization (as determined by the
			 Attorney General)—</text>
					<paragraph id="H423F9104B9CE453D00B5CF00F7004BCC"><enum>(1)</enum><text>to provide for the
			 establishment and operation of a national, toll-free telephone hotline to
			 provide information and assistance to victims of hate crimes (hereafter
			 referred to as the <quote>national hate crime hotline</quote>); and</text>
					</paragraph><paragraph id="H9325B5138CB64FBE83F82360AB0944B5"><enum>(2)</enum><text>to provide for the
			 establishment and operation of an Internet website to provide information and
			 assistance to victims of hate crimes (hereafter referred to as the <quote>hate
			 crime information and assistance website</quote>).</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H3F924B4660B2453FAD002F6329929772"><enum>(b)</enum><header>Use of
			 funds</header>
					<paragraph id="H1F29272A8BAB499700476D5913A62784"><enum>(1)</enum><header>National Hate
			 Crime Hotline</header><text display-inline="yes-display-inline">An entity that
			 receives a grant under this section for activities described in subsection
			 (a)(1) shall use the funds made available through the grant to—</text>
						<subparagraph id="H96CA537FCBB54A1AAB1500C227941867"><enum>(A)</enum><text>contract with a
			 carrier for the use of a toll-free telephone line;</text>
						</subparagraph><subparagraph id="HC8500EF8779C461DB576076549D01FEC"><enum>(B)</enum><text>employ, train,
			 (including technology training), and supervise personnel to answer incoming
			 calls and provide counseling and referral services to callers on a
			 24-hour-a-day basis;</text>
						</subparagraph><subparagraph id="H847083E0BE384712A3BE1E02AA4909C1"><enum>(C)</enum><text display-inline="yes-display-inline">assemble and maintain a current database of
			 information relating to services for victims of hate crimes to which callers
			 throughout the United States may be referred; and</text>
						</subparagraph><subparagraph id="H37C9613BA1FE404BA563AFC37464CFAE"><enum>(D)</enum><text>publicize the
			 national hate crime hotline to potential users throughout the United
			 States.</text>
						</subparagraph></paragraph><paragraph id="HDBB580C2C8C7414B89C968D7ADBEFA5D"><enum>(2)</enum><header>Website</header><text display-inline="yes-display-inline">An entity that receives a grant under this
			 section for activities described in subsection (a)(2) shall use funds made
			 available through the grant to—</text>
						<subparagraph id="HF8CE93FD203344FBB897322F85E1EBA"><enum>(A)</enum><text>establish and
			 operate a hate crime information and assistance website; and</text>
						</subparagraph><subparagraph commented="no" id="H0256DA91CC4E45C683CAFB9C66D2CC48"><enum>(B)</enum><text>provide
			 information related to the services available to victims of hate crimes,
			 including health care and mental health, legal, and other relevant
			 services.</text>
						</subparagraph></paragraph></subsection><subsection id="H4157F03985BD47699E657DA1E2513861"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An application submitted to the Attorney
			 General under this subsection shall—</text>
					<paragraph commented="no" id="HA51137ECB8B9428C91136903C74269EE"><enum>(1)</enum><text>contain such
			 agreements, assurances, and information, be in such form, and be submitted in
			 such manner as the Attorney General requires;</text>
					</paragraph><paragraph commented="no" id="HBA7C0168096246AA8223E9BCC6BEFBB"><enum>(2)</enum><text>in the case of an
			 application for a grant to carry out activities described in subsection (a)(1),
			 include a complete description of the applicant’s plan for the operation of a
			 national hate crime hotline, including descriptions of—</text>
						<subparagraph commented="no" id="H03EF38A4A7ED4A5BAD099157AD0028DD"><enum>(A)</enum><text>the training
			 program for national hate crime hotline personnel;</text>
						</subparagraph><subparagraph commented="no" id="HA953446584B3416E0046257B8D235C03"><enum>(B)</enum><text>the hiring
			 criteria for national hate crime hotline personnel;</text>
						</subparagraph><subparagraph commented="no" id="H15E16DD05FD94D78A2BE74E643F33446"><enum>(C)</enum><text>a plan for
			 publicizing the availability of the national hate crime hotline;</text>
						</subparagraph><subparagraph commented="no" id="HAC209FE13EE14E5DA35D15A4B1E5EBB"><enum>(D)</enum><text>a plan for
			 providing service to non-English speaking callers; and</text>
						</subparagraph><subparagraph commented="no" id="H5487F609F75C4D3080009E86DA33652B"><enum>(E)</enum><text>a plan for
			 facilitating access to the national hate crime hotline by hearing impaired
			 individuals; and</text>
						</subparagraph></paragraph><paragraph commented="no" id="H4537E9F18699492185A9B35C49191500"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of an application for a grant
			 to carry out activities described in subsection (a)(2), include a complete
			 description of the applicant’s plan for the operation of a hate crime
			 information and assistance website, including—</text>
						<subparagraph commented="no" id="H99B536A823DE4281AABEBB0740152499"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the applicant’s plan for
			 the development, operation, maintenance, and updating of information on and
			 resources of the hate crime information and assistance website;</text>
						</subparagraph><subparagraph commented="no" id="H1C6B70E27ADA45B685B5AD31D00AF9E"><enum>(B)</enum><text display-inline="yes-display-inline">an assurance that the applicant will
			 implement a security system to ensure the confidentiality of the hate crime
			 information and assistance website, and a description of such security system;
			 and</text>
						</subparagraph><subparagraph commented="no" id="H6F1A9C8231CC42149DDEF2CCD371F15"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the applicant’s plan to
			 continue operation and maintenance of the hate crime information and assistance
			 website after Federal funding under this section is no longer available.</text>
						</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H2FCE8B8D94D74CB5A8C0CE719FF971E5"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $10,000,000 for each of fiscal years 2010 through 2015.</text>
				</subsection></section><section id="HCF26190F8BF944AEA010FC9E90F93867"><enum>203.</enum><header>Federal
			 employee programs relating to hate crimes</header>
				<subsection id="H079E3D4716FC433299003F21D9AC0073"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The head of each
			 agency of the Federal Government shall, in a manner consistent with guidelines
			 prescribed under subsection (b) of this section and applicable provisions of
			 law, establish appropriate prevention, treatment, and rehabilitation programs
			 and services relating to hate crimes for employees of such agency.</text>
				</subsection><subsection id="H3F4CC2CA59C84D4F85CC807BDEDED082"><enum>(b)</enum><header>Functions</header><text display-inline="yes-display-inline">The functions of an agency head under this
			 section shall—</text>
					<paragraph id="H1BD5E3B2ABE44162939C6948ACA394AA"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to the judicial branch, be
			 carried out by the Director of the Administrative Office of the United States
			 Courts;</text>
					</paragraph><paragraph id="H9BAD62BAC75A4292B593E8AE1F47F0DF"><enum>(2)</enum><text>with respect to
			 the House of Representatives, be carried out by the Committee on House
			 Administration of the House of Representatives; and</text>
					</paragraph><paragraph id="H29111DE68DC84C64BA001EBAE35920BA"><enum>(3)</enum><text>with respect to
			 the Senate, be carried out by the Committee on Rules and Administration of the
			 Senate.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H9FF839A867A5424A94F150B0D4505DA2"><enum>(c)</enum><header>Guidelines</header><text display-inline="yes-display-inline">The President shall designate one agency
			 which shall—</text>
					<paragraph id="H0A3E3106780842B49990C7C0A5CE66FF"><enum>(1)</enum><text>prescribe
			 guidelines to be used by each agency of the Federal Government for programs and
			 services under this section;</text>
					</paragraph><paragraph id="HE4724068B6574BD59904D02D5A09D2"><enum>(2)</enum><text>on
			 request of any agency, furnish information or technical advice on the design or
			 operation of any program or service under this section; and</text>
					</paragraph><paragraph id="H09C852AB54CF40E5A7DD3E5311FBC900"><enum>(3)</enum><text>submit to the
			 President and the Congress, before January 1, 2010, and at least every 2 years
			 thereafter, a written report on the operation of this section, including, with
			 respect to the period covered by the report—</text>
						<subparagraph id="H90A0B4A567684AC2A9A87104AB987B7E"><enum>(A)</enum><text>a brief
			 description of each of the various programs;</text>
						</subparagraph><subparagraph id="HB382449C0A8A4E95B4B570FE9900D417"><enum>(B)</enum><text>the extent of
			 employee participation in, and the costs to the Federal Government associated
			 with, each of the various programs and services; and</text>
						</subparagraph><subparagraph id="H3C34E3B7F5DB43B7BFC6E3EEA729FD2"><enum>(C)</enum><text>any other matter
			 which may be appropriate to carry out the purposes of this section.</text>
						</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H88F146612F5C4B3EAF00AFA37D302B83"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purpose of this section—</text>
					<paragraph id="HB80752F2795642F38043002ECE005537"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>employee</term> means an
			 employee as defined by <external-xref legal-doc="usc" parsable-cite="usc/5/8101">section 8101</external-xref> of title 5, United States Code;</text>
					</paragraph><paragraph id="H303CD70653CE4D7DB300CDEFAE8CE51"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>agency</term> means—</text>
						<subparagraph id="HA668DD18CA9B4153A1C2008D5747E252"><enum>(A)</enum><text>an Executive
			 agency;</text>
						</subparagraph><subparagraph id="H9DF4D383BC734902B7DE8506EBC1A897"><enum>(B)</enum><text>an entity of the
			 legislative branch; and</text>
						</subparagraph><subparagraph id="H2085CCFBF9304C71A11952E04955285F"><enum>(C)</enum><text>the judicial
			 branch; and</text>
						</subparagraph></paragraph><paragraph id="H630DB76D78D34AED8349E7C6A8038897"><enum>(3)</enum><text>the term
			 <term>entity of the legislative branch</term> means the House of
			 Representatives, the Senate, the Architect of the Capitol (including the
			 Botanic Garden), the Capitol Police, the Congressional Budget Office, the
			 Government Printing Office, and the Library of Congress.</text>
					</paragraph></subsection></section></title><title id="HA4610D26CE084872B691573CAA802183"><enum>III</enum><header>Education and
			 Prevention services</header>
			<section id="H175D9AFF3CB74D2A9F3D05CD7BD7D863"><enum>301.</enum><header>Elementary and
			 secondary hate crime educational grants</header>
				<subsection id="H949A662C2D774F36A6BFE0F783B8C000"><enum>(a)</enum><header>Grant
			 authorization</header><text>The Secretary of Education (hereafter in this
			 section referred to as the <quote>Secretary</quote>) is authorized to award
			 grants to local educational agencies to improve and provide programs relating
			 to hate crimes for elementary and secondary students and teachers.</text>
				</subsection><subsection id="H5E41EA9D4A26453BB7614E5098A1D1B"><enum>(b)</enum><header>Use of
			 funds</header><text>Grants under this section may be used to improve and
			 provide programs for elementary and secondary students and teachers,
			 including—</text>
					<paragraph id="H294A0CEF6D934291AEF0883E5F7F6124"><enum>(1)</enum><text>the provision of
			 education and training programs to prevent and reduce the incidence of hate
			 crimes;</text>
					</paragraph><paragraph id="HAAF39F2A1FD24C90A92CC9E8DDCFFB00"><enum>(2)</enum><text>the development
			 and acquisition of equipment and instructional materials to meet the needs of,
			 or otherwise be part of, hate crime programs; and</text>
					</paragraph><paragraph id="H7DBE74719E8C42DB80DB166501C3760"><enum>(3)</enum><text>professional
			 training and development for teachers and administrators on the causes and
			 effects of hate crimes.</text>
					</paragraph></subsection><subsection id="HB8B443EB30FD4DFA80E3658D59C54D78"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
			 this section for any fiscal year, a local educational agency shall submit an
			 application to the Secretary in such form and containing such information as
			 the Secretary may require.</text>
				</subsection><subsection id="HDB9654027F774E2F876B1D0072483EA3"><enum>(d)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 enactment of this Act, and annually thereafter, the Secretary shall submit to
			 Congress a report containing a detailed statement regarding grants and awards,
			 activities of grant recipients, and an evaluation of programs established under
			 this section.</text>
				</subsection><subsection id="HF3CF35D0066B4492847FA3001697D816"><enum>(e)</enum><header>Definition of
			 local educational agency</header><text display-inline="yes-display-inline">For
			 the purposes of this section the term <term>local educational agency</term> has
			 the meaning given such term in section 9101 of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
				</subsection><subsection id="HBE87E1DB04624EA5A8C423C21EA93580"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $10,000,000 for each of fiscal years 2010 through 2015.</text>
				</subsection></section><section id="HF4E112047DF24B5ABD6051281CF93BA2"><enum>302.</enum><header>College and
			 University hate crime educational grants</header>
				<subsection id="H358A843B5AB3400E8BF178007DEB6882"><enum>(a)</enum><header>Grant
			 authorization</header><text>The Secretary of Education (hereafter in this
			 section referred to as the <quote>Secretary</quote>) is authorized to award
			 grants to institutions of higher education to improve and provide programs
			 relating to hate crimes for students and faculty of such institutions.</text>
				</subsection><subsection id="H82CCF44C180941D8B4E92E6F8747C2A"><enum>(b)</enum><header>Use of
			 funds</header><text>Grants under this section may be used to improve and
			 provide programs in institutions of higher education, including—</text>
					<paragraph id="H0A8A0388552741D18C648F6E527B2B5F"><enum>(1)</enum><text>the development of
			 education and training programs designed to prevent and reduce the incidence of
			 hate crimes;</text>
					</paragraph><paragraph id="H0DA081CF556A4DBAB1183966CBB9BDAE"><enum>(2)</enum><text>the development
			 and acquisition of equipment and instructional materials to meet the needs of,
			 or otherwise be part of, hate crime programs; and</text>
					</paragraph><paragraph id="HA2118D3C10954027B3E1EDFC6853A6BD"><enum>(3)</enum><text>professional
			 training and development for faculty and administrators on the causes and
			 effects of hate crimes.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="HDC3C14874E5747468D27D7C3C97DC172"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
			 this section for any fiscal year, an institution of higher education shall
			 submit an application to the Secretary in such form and containing such
			 information as the Secretary may require.</text>
				</subsection><subsection id="H769E79CCA5744661A970F0C70638FB42"><enum>(d)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 enactment of this Act, and annually thereafter, the Secretary shall submit to
			 Congress a report containing a detailed statement regarding grants and awards,
			 activities of grant recipients, and an evaluation of programs established under
			 this section.</text>
				</subsection><subsection id="H68AD5F3B93F44C87838CA41B9F3E4588"><enum>(e)</enum><header>Definition of
			 institution of higher education</header><text>For the purposes of this section
			 the term <term>institution of higher education</term> has the meaning given the
			 term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>), but
			 does not include any institution described in section 102(a)(1)(C) of such
			 Act.</text>
				</subsection><subsection id="H408AA02706004F3E898E8D007E2CB437"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $10,000,000 for each of fiscal years 2010 through 2015.</text>
