<section id="H7CC20DD4583C4BB0A2D8AF68874CE26" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Military Family Financial Benefits Act of 2007</short-title></quote>.</text></section>
<section id="H1C514CE9E2754FCEAD6570546DD243A5" section-type="subsequent-section"><enum>2.</enum><header>Modification of eligible recipients of death gratuity with respect to members of the Armed Forces</header><text display-inline="no-display-inline">Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/10/1477">section 1477(a)</external-xref> of title 10, United States Code, is amended to read as follows:</text>

<paragraph id="H740AECAA78914F12BDF726B552F24825"><enum>(2)</enum><text>His children (as prescribed by subsection (b)) or such guardians or caretakers of his children (as so prescribed) as he shall specify, in such proportions as he shall specify.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HCFBD0CD60B374CF7832C245B08343E00"><enum>3.</enum><header>Annuities for guardians or caretakers of dependent children under survivor benefit plan</header>
<subsection id="H7C913FD587BF48D5B032796C7D9D4CCC"><enum>(a)</enum><header>Election</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/1448">Section 1448(b)</external-xref> of title 10, United States Code, is amended—</text>
<paragraph id="H9775630BA5F343F79F005CB77CF69B9E"><enum>(1)</enum><text>in the subsection caption, by striking <quote><header-in-text level="subsection" style="OLC">and Former Spouse</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">, Former Spouse, and Guardian or Caretaker</header-in-text></quote>; and</text></paragraph>
<paragraph id="HB35FA9F7CD4B47E6ABDC2F5781C5ADBA"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H027783522B944E6096EE6D00C6FBABA8"><enum>(6)</enum><header>Guardian or caretaker coverage</header>
<subparagraph id="H8BF7D6B165CC48FEAE262E41B6D5A774"><enum>(A)</enum><header>General rule</header><text>A person who is not married and has one or more dependent children upon becoming eligible to participate in the Plan may elect to provide an annuity under the Plan to a natural person (other than a natural person with an insurable interest in the person under paragraph (1) or a former spouse) who acts as a guardian or caretaker to such child or children. In the case of a person providing a reserve-component annuity, such an election shall include a designation under subsection (e).</text></subparagraph>
<subparagraph id="H618BD165E09348D3AA4C1580C332ECB0"><enum>(B)</enum><header>Termination of coverage</header><text>Subparagraphs (B) through (E) of paragraph (1) shall apply to an election under subparagraph (A) of this paragraph in the same manner as such subparagraphs apply to an election under subparagraph (A) of paragraph (1).</text></subparagraph>
<subparagraph id="HA45DFAF22F244EFB00DBC56FEAC1D4AB"><enum>(C)</enum><header>Election of new beneficiary upon death of previous beneficiary</header><text>Subparagraph (G) of paragraph (1) shall apply to an election under subparagraph (A) of this paragraph in the same manner as such subparagraph (G) applies to an election under subparagraph (A) of paragraph (1), except that any new beneficiary elected under such subparagraph (G) by reason of this subparagraph shall be a guardian or caretaker of the dependent child or children of the person making such election.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H32B99EBA81554C099F029172B437CAFB"><enum>(b)</enum><header>Payment of annuity</header><text>Section 1450 of such title is amended—</text>
<paragraph id="HC67F892CBF254544A09F5776FFFD9181"><enum>(1)</enum><text>in subsection (a), by adding at the end the following new paragraph:</text>

<paragraph id="H069FAFDE49F04BF090CAD5E0CC881526"><enum>(5)</enum><header>Guardian or caretaker coverage</header><text>The natural person acting as a guardian or caretaker of the dependent child or children of the person designated under section 1448(b)(6) of this title, unless the election to provide an annuity to the natural person has been changed as provided in subsection (f).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H3ECF3498C2EB470087AB6976CF93517F"><enum>(2)</enum><text>in the subsection caption of subsection (f), by striking <quote><header-in-text level="subsection" style="OLC">or Former Spouse</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">, Former Spouse, or Guardian or Caretaker</header-in-text></quote>.</text></paragraph></subsection>
<subsection id="H1EEE062D27C344AAB3750078E0665D48"><enum>(c)</enum><header>Amount of annuity</header><text>Section 1451(b) of such title is amended—</text>
<paragraph id="H35F1F829478B4FE5911F2E5E0255F7A9"><enum>(1)</enum><text>in the subsection caption, by inserting <quote><header-in-text level="subsection" style="OLC">or Guardian or Caretaker</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Insurable interest</header-in-text></quote>; and</text></paragraph>
<paragraph id="HBA556576BA2C48649F782065C8F8C557"><enum>(2)</enum><text>by inserting <quote>or 1450(a)(5)</quote> after <quote>1450(a)(4)</quote> each place it appears in paragraphs (1) and (2).</text></paragraph></subsection>
<subsection id="HE3CCCCD765D041DC87D74655136079F5"><enum>(d)</enum><header>Reduction in retired pay</header><text>Section 1452(c) of such title is amended—</text>
<paragraph id="H7FD0C22B0DD24235A79EDECF024B5279"><enum>(1)</enum><text>in the subsection caption, by inserting <quote><header-in-text level="subsection" style="OLC">or Guardian or Caretaker</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Insurable interest</header-in-text></quote>; and</text></paragraph>
<paragraph id="H1DA2A21B1DFA493AAAEFF94D2898C591"><enum>(2)</enum><text>by inserting <quote>or 1450(a)(5)</quote> after <quote>1450(a)(4)</quote> each place it appears in paragraphs (1) and (3).</text></paragraph></subsection></section>
<section id="H2C5088883AC4457FA051AAB82DB5AF51"><enum>4.</enum><header>Improvements of pre-deployment counseling and services for members of the Armed Forces</header>
<subsection id="HD4F955A9D0C24C02A5FC34FD832BC14"><enum>(a)</enum><header>Panel</header><text>The Secretary of Defense shall appoint, from among individuals in the private sector qualified for such purpose, a panel of individuals to—</text>
<paragraph id="H0B0551AF9BBE48E3B45C44C066D250F4"><enum>(1)</enum><text>review the pre-deployment counseling and services provided by the military departments to unmarried members of the Armed Forces with dependent children;</text></paragraph>
<paragraph id="HD44E1B95B831495DB4BCF69DC43C95C5"><enum>(2)</enum><text>identify best practices among such counseling and services; and</text></paragraph>
<paragraph id="H7C010A663BA341D0A194AB40B3BE4387"><enum>(3)</enum><text>recommend such improvements in such counseling and services (including improvements in such best practices) as the panel considers appropriate.</text></paragraph></subsection>
<subsection id="HC02A0834BA6F4156AB88DD3FEFCFA969"><enum>(b)</enum><header>Required actions</header><text>In carrying out its duties under subsection (a), the panel appointed under that subsection shall—</text>
<paragraph id="HF1114923D2E949FCA8005FAE2106104C"><enum>(1)</enum><text>identify best practices in the pre-deployment counseling and services provided by the military departments to unmarried members of the Armed Forces with dependent children, including best practices with respect to counseling and services on—</text>
<subparagraph id="HC257D3E236A448DDB1F0A0FFE1301310"><enum>(A)</enum><text>death benefits available to survivors of members of the Armed Forces;</text></subparagraph>
<subparagraph id="H046412BF7BD3459DA2DBD0858CFB751C"><enum>(B)</enum><text>dependency and indemnity compensation benefits available under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/13">chapter 13</external-xref> of title 38, United States Code;</text></subparagraph>
<subparagraph id="HCBDF87D99C71452DB17B1FFE8894E954"><enum>(C)</enum><text>Servicemembers' Group Life Insurance under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/19">chapter 19</external-xref> of title 38, United States Code;</text></subparagraph>
<subparagraph id="HAF8CF7FE0F214F798D566D25F2080094"><enum>(D)</enum><text>traumatic injury protection under <external-xref legal-doc="usc" parsable-cite="usc/38/1980A">section 1980A</external-xref> of title 38, United States Code;</text></subparagraph>
<subparagraph id="H08C1D0FA4B7841368EE1C383D966BD0"><enum>(E)</enum><text>the Survivor Benefit Plan under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/73">chapter 73</external-xref> of title 10, United States Code;</text></subparagraph>
<subparagraph id="H587C1363A57F4987ACF416968D62231C"><enum>(F)</enum><text>benefits payable under the Social Security Act; and</text></subparagraph>
<subparagraph id="H176C244082734B67A394E655F84BC98B"><enum>(G)</enum><text>the preparation, maintenance, and administration of family care plans, including elements of such plans relating to death benefits, wills and powers of attorney, trusts, maintenance and safeguarding during deployment, and acknowledgment of specific guardian and caretaker duties (including beneficiary designation), and administrative requirements (including command endorsement) relating to such plans;</text></subparagraph></paragraph>
<paragraph id="H0C09192EBC4E42C793A49E7BDD94E99D"><enum>(2)</enum><text>identify best practices in the pre-deployment counseling and services provided by the military departments to unmarried members of the Armed Forces without dependent children, and married members of the Armed Forces (whether with or without dependent children), including best practices with respect to counseling and services on each of the matters set forth in subparagraphs (A) through (F) of paragraph (1);</text></paragraph>
<paragraph id="H19C17213DCA946D09C3690CC8660641"><enum>(3)</enum><text>identify best practices among the military departments in the deployment and availability of counseling and services for such members at so-called <quote>Pre-Deployment Centers</quote>, including best practices with respect to—</text>
<subparagraph id="H4DEEA57DE13F46568585D7B673185562"><enum>(A)</enum><text>the availability of counseling on legal matters;</text></subparagraph>
<subparagraph id="H9199FB368A514484BDA9405171C80000"><enum>(B)</enum><text>the availability of counseling on financial matters;</text></subparagraph>
<subparagraph id="HD7E43763CF9C4E6797AE53776E2E1529"><enum>(C)</enum><text>the involvement of family support groups in such counseling;</text></subparagraph>
<subparagraph id="HE67F091D9D1B4265B011CCFAA37C44E"><enum>(D)</enum><text>the availability of screening necessary for current or future determinations regarding post-traumatic stress disorder (PTSD);</text></subparagraph>
<subparagraph id="HE81C77CD070840C1BF7787AE9D7B008F"><enum>(E)</enum><text>the availability of counseling for suicide prevention; and</text></subparagraph>
<subparagraph id="H32E7A1A683914AF59704791310627BA8"><enum>(F)</enum><text>the provision and scope of training for pre-deployment counselors;</text></subparagraph></paragraph>
<paragraph id="HA96C79499EA141568FD385004D89F5D3"><enum>(4)</enum><text>identify, from among the best practices identified under paragraphs (1), (2), and (3), best practices to be adopted across the military departments in order to ensure the uniform availability to such members of meaningful and effective pre-deployment counseling and services; and</text></paragraph>
<paragraph id="H0613DAC0312648FD93C665BF8CAA01E"><enum>(5)</enum><text>make such recommendations in any practices identified under paragraph (4) as the panel considers appropriate to enhance the counseling and services identified under that paragraph.</text></paragraph></subsection>
<subsection id="H88AAB46A84864191BE122B0876025B98"><enum>(c)</enum><header>Report</header><text>Not later than 120 days after the date of the enactment of this Act, the panel appointed under subsection (a) shall submit to the Secretary and the congressional defense committees a report on its actions under this section. The report shall set forth in comprehensive detail the best practices identified under subsection (b)(4) and any recommendations for improvements in such best practices made under subsection (b)(5).</text></subsection>
<subsection id="HDE01A060E44A480D8FC8F8D8BA5DAE32"><enum>(d)</enum><header>Implementation</header><text>Not later than 120 days after the date of the receipt of the report required by subsection (c), the Secretary shall ensure the implementation by the military departments of the best practices identified under subsection (b)(4), together with any improvements recommended under subsection (b)(5).</text></subsection>
<subsection id="H577E9E6D01A84065834F164FCBA6DD94"><enum>(e)</enum><header>Congressional defense committees defined</header><text>In this section, the term <term>congressional defense committees</term> means—</text>
<paragraph id="H993B9AD72F5840279FB00B3D53908FF"><enum>(1)</enum><text>the Committees on Armed Services and Appropriations of the Senate; and</text></paragraph>
<paragraph id="H26C67128E8D3408FA2D201ACCA16598C"><enum>(2)</enum><text>the Committees on Armed Services and Appropriations of the House of Representatives.</text></paragraph></subsection></section>
