<official-title>To amend title 31, United States Code, to provide Federal aid and economic stimulus through a one-time revenue grant to the States and their local governments.</official-title>

<section section-type="section-one" id="HC32D05B6A8DC4FACA32134001C08DCD3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State and Local Economic Stimulus Act</short-title></quote>.</text></section> 
<section id="H74CD5636740F44FDB231F806A876F7C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H060109E0EBB348D486E300FA00361B4B"><enum>(1)</enum><text display-inline="yes-display-inline">State and local governments are a vital part of our economy and American life. States, cities, counties, school districts, and other localities and jurisdictions provide health care, education, public safety, and innumerable social services to hundreds of millions of Americans.</text></paragraph> 
<paragraph id="H2E62295D6065496EABD9307B1A3C8ED"><enum>(2)</enum><text display-inline="yes-display-inline">From September 2007 to June 2008, America’s unemployment rate increased from 4.7 percent to 5.5 percent, and hundreds of thousands of additional Americans went without jobs.</text></paragraph> 
<paragraph id="HA0076461596743C5B6040001CEF8FE86"><enum>(3)</enum><text display-inline="yes-display-inline">America’s economic downturn is causing painful budget problems for State and local governments. The economic slowdown has lowered State and local tax revenues while the need for public service is expanding. As a result, most States and many localities are suffering budget deficits.</text></paragraph> 
<paragraph id="H2BF3BA1632AA4F0BAB18028840B0D44"><enum>(4)</enum><text display-inline="yes-display-inline">Given that 49 of 50 States, and many local governments, are legally required to balance their budgets, the only way these governments can reduce deficits is to cut public services or raise taxes.</text></paragraph> 
<paragraph id="H288A2D91187E4515A58159C4E351451B"><enum>(5)</enum><text>In 2003, in response to the prior economic downturn, Congress enacted a $20,000,000,000 fiscal relief package for States, including authorizing $10,000,000,000 for flexible anti-recession grants to stimulate the ailing economy and protect vital public services. </text> </paragraph></section> 
<section id="H26F53F9DDB22446486CDE4AE00D728A2"><enum>3.</enum><header>One-time revenue grant to States and local governments</header> 
<subsection id="HDFF295217E034F2D0025E6FCCFA40522"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/67">Chapter 67</external-xref> of title 31, United States Code, is amended by adding at the end the following new section:</text>

<section id="H1B4382E9F4DA45BD8BEC2FC692F77160"><enum>6721.</enum><header>One-time revenue grant to States and local governments</header> 
<subsection id="H9D5EC9DFEE2F44AD8BC2E666E2F55DFA"><enum>(a)</enum><header>Appropriation</header><text>There is appropriated to carry out this section $40,000,000,000 for fiscal year 2009.</text></subsection> 
<subsection id="HAFC297A91CF34FE5001E1D28C2DCEA26"><enum>(b)</enum><header>Allotments</header><text>From the amount appropriated under subsection (a) for fiscal year 2009, the Secretary of the Treasury shall, as soon as practicable after the date of the enactment of this section, allot to each of the States as follows:</text> 
<paragraph id="H8AF04F240D114C8AA1BC13F492ABBA00"><enum>(1)</enum><header>Based on population</header> 
<subparagraph id="H515C8E594EED4068B79C6C5E7BC0086E"><enum>(A)</enum><header>State level</header><text>$10,000,000,000 shall be allotted among States on the basis of the relative population of each such State, determined based on data from the 2000 decennial census of the United States.</text></subparagraph> 
<subparagraph id="H6B5EE71AFCFA41539B9368D549FCAAB1"><enum>(B)</enum><header>Local government level</header><text display-inline="yes-display-inline">$10,000,000,000 shall be allotted among such States as determined under subparagraph (A) for distribution to the various units of general local government within such States on the basis of the relative population of each such unit within each such State that is unemployed, determined based on the data referred to in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H4A6556BE2AC94261853D5F7E70DCFB44"><enum>(2)</enum><header>Based on change in unemployment rate</header> 
<subparagraph id="H82FCD79E0A0D441A8182EDEB81CB3BB7"><enum>(A)</enum><header>Tier 1</header> 
<clause id="H5982083D9DBD4193A925AF916067E840"><enum>(i)</enum><header>State level</header><text display-inline="yes-display-inline">$7,500,000,000 shall be allotted among States that have experienced a tier 1 unemployment rate on the basis of the relative number of unemployed individuals for the period beginning on September 1, 2007, and ending on June 30, 2008, in each such State, determined based on unemployment levels for 2007 and 2008 from the Bureau of Labor Statistics’ Local Area Unemployment Statistics.</text></clause> 
<clause id="HB7F80185484D43E9AE58875F3FB58E05"><enum>(ii)</enum><header>Local government level</header><text display-inline="yes-display-inline">$7,500,000,000 shall be allotted among States that have experienced a tier 1 unemployment rate as determined under clause (i) for distribution to the various units of general local government within such States on the basis of the relative number of unemployed individuals for the period beginning on September 1, 2007, and ending on June 30, 2008, in each such unit within each such State, determined based on the civilian labor force unemployment rate, seasonally adjusted, for September 2007 to June 2008 from the Bureau of Labor Statistics’ Local Area Unemployment Statistics.</text></clause></subparagraph> 
<subparagraph id="H90771C0858EB49E4A34000500020B16E"><enum>(B)</enum><header>Tier 2</header> 
<clause id="H9070339DE3C5425597B9701655C1DDB2"><enum>(i)</enum><header>State level</header><text display-inline="yes-display-inline">$2,500,000,000 shall be allotted among States that have experienced a tier 2 unemployment rate on the basis of the relative number of unemployed individuals for the period beginning on September 1, 2007, and ending on June 30, 2008, in each such State, determined based on unemployment levels for 2007 and 2008 from the Bureau of Labor Statistics’ Local Area Unemployment Statistics.</text></clause> 
<clause id="H82FAF8EE813C45D38E948B8BE700DD20"><enum>(ii)</enum><header>Local government level</header><text display-inline="yes-display-inline">$2,500,000,000 shall be allotted among States that have experienced a tier 2 unemployment rate as determined under clause (i) for distribution to the various units of general local government within such States on the basis of the relative number of unemployed individuals for the period beginning on September 1, 2007, and ending on June 30, 2008, in each such unit within each such State, determined based on the civilian labor force unemployment rate, seasonally adjusted, for September 2007 to June 2008 from the Bureau of Labor Statistics’ Local Area Unemployment Statistics.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H26B4051ED236417980C799D8A283CC58"><enum>(c)</enum><header>Use of payments</header> 
<paragraph id="H9A9E1BB768604BD800B4811C3104B561"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), a State or unit of local government shall use the funds provided under a payment made under this section for a fiscal year to—</text> 
<subparagraph id="HDBD499425BA44EAAB4004806EF08EBC"><enum>(A)</enum><text>provide essential government services;</text></subparagraph> 
<subparagraph id="H928F916CDC574367853BFF6D2B36F5E"><enum>(B)</enum><text display-inline="yes-display-inline">cover the costs to the State or unit of local government, respectively, of complying with any Federal intergovernmental mandate (as defined in section 421(5) of the Congressional Budget Act of 1974) to the extent that the mandate applies to the State or unit of local government, respectively, and the Federal Government has not provided funds to cover the costs; or</text></subparagraph> 
<subparagraph id="H84A1997CE66647CA82913B313900D408"><enum>(C)</enum><text display-inline="yes-display-inline">compensate for a decline in Federal funding to the State or unit of local government, respectively.</text></subparagraph></paragraph> 
<paragraph id="H97D32129AC484247A2B5C31FC08EACCF"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">A State or unit of local government—</text> 
<subparagraph id="H29DF04B64A234560A0706CA610B054DD"><enum>(A)</enum><text> may use funds provided as a payment under this section only for types of expenditures permitted under the most recently approved budget for the State;</text></subparagraph> 
<subparagraph id="HE00E8CD5CC8D4C2E88FB381F00E400B6"><enum>(B)</enum><text> may not use the additional Federal funds paid to the State or unit of local government as a result of this section for purposes of increasing any reserve or rainy day fund maintained by the State; and</text></subparagraph> 
<subparagraph id="H9B2DF11EA0E84F4293AD043004EEE53"><enum>(C)</enum><text>shall expend the additional Federal funds paid to the State or unit of local government as a result of this section within 1 year after the date on which the State receives such funds.</text></subparagraph></paragraph> 
<paragraph id="HEE78F5B15FEB47A900B243A84415A026"><enum>(3)</enum><header>Certification</header><text display-inline="yes-display-inline">In order to receive a payment under this section for a fiscal year, a State or unit of local government shall certify to the Secretary of the Treasury with a certification that the proposed use of such funds by the State or unit of local government’s, respectively, is consistent with this subsection.</text></paragraph></subsection> 
<subsection id="HFD8395835A49435FA0B4E759927FA042"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="H7DB78473FA3E450EB9E16200E1994427"><enum>(1)</enum><header>State</header><text>The term <term>State</term> means any of the several States, the District of Columbia, and the Commonwealth of Puerto Rico.</text></paragraph> 
<paragraph id="H76AC8A1E37F9472D881C8712308B0126"><enum>(2)</enum><header>Unit of general local government</header> 
<subparagraph id="H2987BBEBE8AA4E04B59178E3C0C80525"><enum>(A)</enum><header>In general</header><text>The term <term>unit of general local government</term> means—</text> 
<clause id="H11BEA00CFFD94814B3DC5F8BA9A9EEF7"><enum>(i)</enum><text>a county, parish, township, city, or political subdivision of a county, parish, township, or city, that is a unit of general local government as determined by the Secretary of Commerce for general statistical purposes; and</text></clause> 
<clause id="HBEDB38DF6D8D4CF2AEFA7D32205E7DB7"><enum>(ii)</enum><text>the District of Columbia, and the recognized governing body of an Indian tribe or Alaskan native village that carries out substantial governmental duties and powers.</text></clause></subparagraph> 
<subparagraph id="HBC387C336A334BBE84793B47EFD3223"><enum>(B)</enum><header>Treatment of subsumed areas</header><text>For purposes of determining a unit of general local government under this section, the rules under section 6720(c) of this title shall apply.</text></subparagraph></paragraph> 
<paragraph id="H36F256C9490C4A4F8370BDE3009E8893"><enum>(3)</enum><header>Unemployment</header><text>With respect to any State or unit of general local government—</text> 
<subparagraph id="H8566CAE44BF344B6B5DBD2F359C624B2"><enum>(A)</enum><header>Tier 1 unemployment rate</header><text>The term <term>tier 1 unemployment rate</term> means an unemployment rate for June 2008 that is 0.7 or more percentage points greater than such rate for September 2007.</text> </subparagraph> 
<subparagraph id="HF762DBE446754C66AC9700CCB172DA53"><enum>(B)</enum><header>Tier 2 unemployment rate</header><text>The term <term>tier 2 unemployment rate</term> means an unemployment rate for June 2008 that is less than 0.7 percent points greater than such rate for September 2007.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H064C56BC6BEF410BA093B300944FED2"><enum>(b)</enum><header>Conforming Amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/67">chapter 67</external-xref> of title 31, United States Code, is amended by adding at the end the following new item:</text>
