<official-title>To direct the Secretary of the Interior to promptly commence an oil and gas leasing program for public lands within the Coastal Plain of Alaska, and for other purposes.</official-title>

<section id="H5E7CD475F29E470897F2091800003F20" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Furthering Renewable Energy and Exploration Act</short-title></quote> or the <quote><short-title>FREE Act</short-title></quote> .</text> </section> 
<section id="H66AA7960E8464B71924E895492A1FF7B" display-inline="no-display-inline"><enum>2.</enum><header>Opening of Coastal Plain of Alaska to oil and gas leasing</header> 
<subsection id="HBBEDF49D1E8942D88EA7005218D38D80" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 1002(i) of the Alaska National Interest Lands Conservation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/16/3142">16 U.S.C. 3142(i)</external-xref>), the Secretary of the Interior shall promptly commence an oil and gas leasing program, pursuant to the mineral leasing laws, for public lands within the Coastal Plain of Alaska. Such leasing program, including subsequent development and production under leases issued under such program, is deemed to be a compatible use for purposes of the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>).</text></subsection> 
<subsection id="H54371B74A44F404ABE32FA4B1B085352"><enum>(b)</enum><header>Coastal Plain of Alaska</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>Coastal Plain of Alaska</quote> means that area described in appendix I to part 37 of title 50, Code of Federal Regulations.</text></subsection> 
<subsection id="H4FC2B312D850499BA1F2516DDF31725"><enum>(c)</enum><header>Conforming amendments</header> 
<paragraph id="HB52206C12BB4440A835DE0CB21C57723" display-inline="no-display-inline"><enum>(1)</enum><text>Section 1003 of the Alaska National Interest Lands Conservation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/16/3143">16 U.S.C. 3143</external-xref>) is repealed.</text></paragraph> 
<paragraph id="HF5CD50E6DF7F45A2A8008F37274B00A6"><enum>(2)</enum><text>The table of contents in section 1 of such Act is amended by striking the item relating to section 1003.</text></paragraph></subsection></section> 
<section id="H1E7BECDA04DB4C4EBEF1AEFF294F8B"><enum>3.</enum><header>Treatment of revenues</header> 
<subsection id="H59C8D44B0789403CA7D4BA236C008F14"><enum>(a)</enum><header>Establishment of account</header><text display-inline="yes-display-inline">There is established in the Treasury a separate account which shall be known as the Energy Independence Trust Fund (in this section referred to as the <quote>Fund</quote>).</text></subsection> 
<subsection id="HFC065B78F1B1415CBB5E8661C77C8E11"><enum>(b)</enum><header>Deposits</header><text>There shall be deposited into the Fund—</text> 
<paragraph id="H075A5FECCA724D278380890083289679"><enum>(1)</enum><text>an amount equal to the amount of rental payments and royalties received by the United States each fiscal year under leases issued under section 2; and</text></paragraph> 
<paragraph id="HABE8FEBAB0C8459694885E00B34854C6"><enum>(2)</enum><text display-inline="yes-display-inline">an amount equal to the amount of Federal income tax received by the United States each fiscal year attributable to sales of oil and gas produced under leases under section 2.</text></paragraph></subsection> 
<subsection id="HB36FBF300A6349DE9BEF319EA14C00D6"><enum>(c)</enum><header>Use</header><text>Of the amounts deposited into the Fund each fiscal year—</text> 
<paragraph id="HFB6C63916ED4457E8200CC30C76BBF95"><enum>(1)</enum><text>50 percent shall be paid to the State of Alaska; and</text></paragraph> 
<paragraph id="HB4A3A7FA8FDB4A77B61D6F95FBE28C79"><enum>(2)</enum><text>the remainder shall be available to the Secretary of Agriculture, of which—</text> 
<subparagraph id="HF71FDF92603C4530B048503F3053838C"><enum>(A)</enum><text display-inline="yes-display-inline">50 percent shall be used to provide business and industry loan guarantees under section 310B(a)(1) of the Consolidated Farm and Rural Development Act in the then succeeding fiscal year; and</text></subparagraph> 
<subparagraph id="H3D2C7F911A29454A87B517D5FCDD95B8"><enum>(B)</enum><text display-inline="yes-display-inline">50 percent shall be used for the Biomass Research and Development Initiative established under section 9008(e) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8108">7 U.S.C. 8108(e)</external-xref>) in the then succeeding fiscal year.</text></subparagraph></paragraph></subsection></section>
