<official-title>To provide additional funds for affordable housing for low-income seniors, disabled persons, and others who lost their homes as a result of Hurricanes Katrina and Rita.</official-title>

<section id="H7F1A38410AF242C292FDE7F99D2C6621" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gulf Coast Multifamily and Assisted Housing Recovery Act</short-title></quote>.</text></section> 
<section id="H6003C10F91284727A139E44445FE85DD"><enum>2.</enum><header>Additional support for housing low-income elderly persons</header><text display-inline="no-display-inline">Section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H17E6CDD20AD34D3C91E70147A25100DF" style="OLC"> 
<subsection id="H2C6CEAFCD7F34AF8894B67815E75B1CC"><enum>(n)</enum><header>Additional support for low-income elderly persons displaced by Hurricanes Katrina and Rita</header> 
<paragraph id="H96775E681AC144F4912626E7B7FB05B7"><enum>(1)</enum><header>In general</header><text>In addition to any amounts authorized under subsection (m), for fiscal year 2009 there is authorized to be appropriated $125,000,000 to the Secretary to provide assistance pursuant to this section to private nonprofit organizations and consumer cooperatives to expand the supply of supportive housing for low-income elderly persons—</text> 
<subparagraph id="H83F95734C15F46E5A9DBC6D9B89FB04C"><enum>(A)</enum><text>who on August 28, 2005, for Hurricane Katrina and September 24, 2005, for Hurricane Rita, were residents in a designated disaster area;</text></subparagraph> 
<subparagraph id="HE3165DBF408F46829E01B9C0189B4641"><enum>(B)</enum><text>whose primary residence—</text> 
<clause id="HD910545C87FC4B18B46B46AD4C43F401"><enum>(i)</enum><text>was significantly damaged by Hurricane Katrina or Hurricane Rita or by flooding resulting from Hurricane Katrina or Hurricane Rita; or</text></clause> 
<clause id="HB61261149E9B485F99EE2F4316F311D3"><enum>(ii)</enum><text>is uninhabitable as a result of damage or flooding resulting from Hurricane Katrina or Hurricane Rita, including uninhabitability resulting from lack of electricity, water, or other services due to such damage or flooding; and</text></clause></subparagraph> 
<subparagraph id="H6EB20D3339D04C8F96DB426C6E04E52"><enum>(C)</enum><text>who cannot, in the discretion of the Secretary, afford to rebuild such residence.</text></subparagraph></paragraph> 
<paragraph id="HA23200CD21E14D95B196FC32D45CE85F"><enum>(2)</enum><header>Allocation of funds</header><text>Of the amounts authorized to be appropriated under paragraph (1), the Secretary shall allocate—</text> 
<subparagraph id="HC07B29EB361A47E7BD4641952E232285"><enum>(A)</enum><text>$55,000,000 to the State of Louisiana;</text></subparagraph> 
<subparagraph id="H180EDE9CF0114E8BBFEEE3E3A316009E"><enum>(B)</enum><text>$50,000,000 to the State of Mississippi; and</text></subparagraph> 
<subparagraph id="HA0F9F63AF537499396D26C8ED419DECB"><enum>(C)</enum><text>$20,000,000 to the State of Alabama.</text></subparagraph></paragraph> 
<paragraph id="H78E648C29D8147A6B0B366BD2D154890"><enum>(3)</enum><header>Definition</header><text>As used in this subsection, the term <term>designated disaster area</term> means any area in the States of Alabama, Mississippi, and Louisiana that was the subject of a disaster declaration by the President under title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) in response to Hurricanes Katrina and Rita of 2005.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HE509A3D8FDD34CCC899DB2BF099C05EE"><enum>3.</enum><header>Additional support for low-income persons with disabilities</header><text display-inline="no-display-inline">Section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H495803454380450E8D51FCFD744B9C97"><enum>(o)</enum><header>Additional support for low-income persons with disabilities displaced by Hurricanes Katrina and Rita</header> 
<paragraph id="HDAE756AECF564CB7AEB0965E8C52571D"><enum>(1)</enum><header>In general</header><text>In addition to any amounts authorized under subsection (m), for fiscal year 2009 there is authorized to be appropriated $75,000,000 to the Secretary to provide assistance pursuant to this section to private, nonprofit organizations to expand the supply of supportive housing for persons with disabilities—</text> 
<subparagraph id="H10D761CB9F114F738B59C22BAFD6D9D6"><enum>(A)</enum><text>who on August 28, 2005, for Hurricane Katrina and September 24, 2005, for Hurricane Rita, were residents in a designated disaster area;</text></subparagraph> 
<subparagraph id="HAD0DCA3C26EC4072A977DD0048AF5175"><enum>(B)</enum><text>whose primary residence—</text> 
<clause id="HCBB08A78AE1346CBBE01DEF3D87BFB2E"><enum>(i)</enum><text>was significantly damaged by Hurricane Katrina or Hurricane Rita or by flooding resulting from Hurricane Katrina or Hurricane Rita; or</text></clause> 
<clause id="H9B408EC014AA49A3AA35C200A687D7FB"><enum>(ii)</enum><text>is uninhabitable as a result of damage or flooding resulting from Hurricane Katrina or Hurricane Rita, including uninhabitability resulting from lack of electricity, water, or other services due to such damage or flooding; and</text></clause></subparagraph> 
<subparagraph id="HA8BEE5B7B5524B9DB6CB793DE1A7B9CA"><enum>(C)</enum><text>who cannot, in the discretion of the Secretary, afford to rebuild such residence.</text></subparagraph></paragraph> 
<paragraph id="HEB3E4449731A4CD88F477F2BAB9D8886"><enum>(2)</enum><header>Allocation of funds</header><text>Of the amounts authorized to be appropriated under paragraph (1), the Secretary shall allocate—</text> 
<subparagraph id="H28433C1B84394F54B232606E354CEA31"><enum>(A)</enum><text>$35,000,000 to the State of Louisiana;</text></subparagraph> 
<subparagraph id="HDD0AE092CA6A41ABBFBEBA5D51E028A0"><enum>(B)</enum><text>$25,000,000 to the State of Mississippi; and</text></subparagraph> 
<subparagraph id="H6F851479C75D416194C0DB41F2EA8D00"><enum>(C)</enum><text>$15,000,000 to the State of Alabama.</text></subparagraph></paragraph> 
<paragraph id="H9EDBF801F5CD47119623E3E111F62312"><enum>(3)</enum><header>Definition</header><text>As used in this subsection, the term <term>designated disaster area</term> means any area in the States of Alabama, Mississippi, and Louisiana that was the subject of a disaster declaration by the President under title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) in response to Hurricanes Katrina and Rita of 2005.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HF2A2918880BD46938C857F63FE13C2F1"><enum>4.</enum><header>Targeted housing support for low-income elderly persons in New Orleans and St. Bernard Parish</header><text display-inline="no-display-inline">There is authorized to be appropriated for the redevelopment (rebuilding or replacement) of housing authorized under section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>) which was damaged or destroyed as a result of Hurricane Katrina of 2005—</text> 
<paragraph id="HB9B91217B7FA4ED5804E935D492979FC"><enum>(1)</enum><text display-inline="yes-display-inline">$2,500,000 to the City of New Orleans; and</text></paragraph> 
<paragraph id="H19AA13AA4703496DAB76EA176E3542F0"><enum>(2)</enum><text display-inline="yes-display-inline">$1,500,000 to the Parish of St. Bernard.</text></paragraph></section> 
<section id="HE4C5FAB75FD8418895007CB4972E2EF1"><enum>5.</enum><header>Use of budget-based rent increases for section 202 and 811 projects in a designated disaster area</header> 
<subsection id="H389E6CB179854551B695F4EA8114ED0"><enum>(a)</enum><header>Section 202</header><text display-inline="yes-display-inline">Section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>), as amended by section 2 of this Act, is further amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H606A8B1851FA42E48C62ED59B2CF00FF" style="OLC"> 
<subsection id="HBA37EEC198F04DEF924515C3E383D026"><enum>(o)</enum><header>Approval of rent increases</header> 
<paragraph id="HD72B1701728B4352A3C95499003D3096"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall annually adjust the rent levels on a budget-based basis of eligible projects to support the increased cost of operating or rehabilitating such projects.</text></paragraph> 
<paragraph id="HAD28EBA823AB4E50BA9D760069E75172"><enum>(2)</enum><header>Conditions</header><text>Rent adjustments pursuant to this section shall—</text> 
<subparagraph id="HBE37BABE34AA49519216162B5BC890A0"><enum>(A)</enum><text>be subject to adjustment by the Secretary based on differences between estimated and actual costs of operating or rehabilitating such projects; and</text></subparagraph> 
<subparagraph id="HD1B610F7C79D4175BB3B215B9D00305B"><enum>(B)</enum><text>not exceed the rent for comparable unassisted units in the area.</text></subparagraph></paragraph> 
<paragraph id="H9BA9164336AE43B39000908292D397A9"><enum>(3)</enum><header>Definitions</header><text>As used in this section—</text> 
<subparagraph id="H021B6E7710BC4B29BC3F55E372E78CA6"><enum>(A)</enum><text>the term <term>eligible project</term> means a project that is—</text> 
<clause id="H4A71AF6FDFF742E18E9BB5FA37653BC1"><enum>(i)</enum><text>assisted under subsection (c)(2); and</text></clause> 
<clause id="H7EBCCEF44FDE4F7600D3BFD3FEA2A954"><enum>(ii)</enum><text>located in a designated disaster area; and</text></clause></subparagraph> 
<subparagraph id="H993233452B2645519F81B26F8E42B838"><enum>(B)</enum><text>the term <term>designated disaster area</term> means any area in the States of Alabama, Mississippi, and Louisiana that was the subject of a disaster declaration by the President under title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) in response to Hurricanes Katrina and Rita of 2005.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H65C6D5E4B0A641B19BC244516215DF9D"><enum>(b)</enum><header>Section 811</header><text>Section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>), as amended by section 3 of this Act, is further amended by adding at the end the following:</text>

<subsection id="H83570E902F844379BFFB2098EEC4F133"><enum>(p)</enum><header>Approval of rent increases</header> 
<paragraph id="H9C647E98A2B24D1682A65C4D471908E5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall annually adjust the rent levels on a budget-based basis of eligible projects to support the increased cost of operating or rehabilitating such projects.</text></paragraph>

<subparagraph id="H7E7133C6846D435EBA2BD5ABC8C3BC07"><enum>(B)</enum><text>not exceed the rent for comparable unassisted units in the area.</text></subparagraph></paragraph> 
<paragraph id="H019733401C294D1885A3853BB622316D"><enum>(3)</enum><header>Definitions</header><text>As used in this section—</text> 
<subparagraph id="H363D767C52FE44C195ED1579E3721FE7"><enum>(A)</enum><text>the term <term>eligible project</term> means a project that is—</text> 
<clause id="H2BF3A7DED2624CA39CF1240000D86BC4"><enum>(i)</enum><text>assisted under subsection (d)(2); and</text></clause> 
<clause id="H5C18A68875FC454A9E5D1C2981C6DA3"><enum>(ii)</enum><text>located in a designated disaster area; and</text></clause></subparagraph> 
<subparagraph id="H3D514B19E53140D1A4530483B9EE6600"><enum>(B)</enum><text>the term <term>designated disaster area</term> means any area in the States of Alabama, Mississippi, and Louisiana that was the subject of a disaster declaration by the President under title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) in response to Hurricanes Katrina and Rita of 2005.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H6031D72C1E85474893CF7E00622F9386"><enum>6.</enum><header>Preservation and provision of project-based housing for affordable housing units damaged or destroyed by Hurricanes Katrina or Rita</header> 
<subsection id="H332CC64A27F24C0F8D5678001DEBDD77"><enum>(a)</enum><header>Report on terminated project-based contracts in designated disaster area</header><text>Not later than 45 days after the date of enactment of this Act, the Secretary of Housing and Urban Development shall provide a report to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives detailing—</text> 
<paragraph id="H1124ABC18F4846AEBBCE0000C919C3E"><enum>(1)</enum><text>information on the number of project-based assistance contracts and units which were terminated in the designated disaster area after September 30, 2005;</text></paragraph> 
<paragraph id="H8373A18EDEAE43A59E9D7EC0D1938EB4"><enum>(2)</enum><text>information on the specific developer, project name, location, number of units, and project description for each project-based assistance contract which was terminated in the designated disaster area after September 2005; and</text></paragraph> 
<paragraph id="H1F7016AD99A84DB89D5C9761CC8BAF64"><enum>(3)</enum><text>such additional information as the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives shall reasonably require.</text></paragraph></subsection> 
<subsection id="H31A3AD2D540A4864B400CF3782CCF728"><enum>(b)</enum><header>Tolling of contract term</header> 
<paragraph id="HD073C4F9651D4C29974EE0D849DEC69C"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, a project-based assistance payments contract for a covered assisted multifamily housing project shall not expire or be terminated because of the damage or destruction of dwelling units in the project as a result of Hurricane Katrina or Hurricane Rita.</text></paragraph> 
<paragraph id="HAF8ED18EDF3C4461AD9432C5BBBC6386"><enum>(2)</enum><header>Expiration date</header><text>The expiration date of the contract for a covered assisted multifamily housing project described under paragraph (1) shall be deemed to be the later of—</text> 
<subparagraph id="H63C360B9C6B248B7A19CB8E4E52F437F"><enum>(A)</enum><text>the date specified in the contract; or</text></subparagraph> 
<subparagraph id="H3BCF1F9D74E34335AD4EFEEB2BA900D4"><enum>(B)</enum><text>the date that is not less than 3 months after the dwelling units in such project, or in a replacement project, are first made habitable.</text></subparagraph></paragraph></subsection> 
<subsection id="H138F07BDF23843E4AF004C00DF5CDA98"><enum>(c)</enum><header>Owner proposals for reuse or resiting of affordable units</header><text>Pursuant to section 215 of title II of division K of <external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref> (121 Stat. 2433), the Secretary of Housing and Urban Development shall, not later than October 1, 2009, promptly review and approve—</text> 
<paragraph id="H883F6178AD62432D8CA1F0E17027F519"><enum>(1)</enum><text>any feasible proposal made by the owner of a covered assisted multifamily housing project submitted to the Secretary that provides for the rehabilitation of such project and the resumption of use of the project-based assistance under the contract for such project; or</text></paragraph> 
<paragraph id="H578FF750856140F8944344669C9EA82C"><enum>(2)</enum><text>the transfer, subject to the conditions established under section 215(b) of title II of division K of <external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>, of the contract for such covered assisted multifamily housing project, or in the case of a covered assisted multifamily housing project with an interest reduction payments contract, of the remaining budget authority under the contract, to a receiving project or projects.</text></paragraph></subsection> 
<subsection id="H82DF6B7C31804643BBF075FB4C57AAA8"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="HA0697E5BE0054DFDADEE37444E698C98"><enum>(1)</enum><text>the term <term>covered assisted multifamily housing project</term> means housing that—</text> 
<subparagraph id="H07C1A1D693744DBAA6B4D1FBFE9FBA6"><enum>(A)</enum><text>meets one of the conditions established in section 215(c)(2) of title II of division K of <external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>;</text></subparagraph> 
<subparagraph id="HC8BD72E1FCC145198CDA5848BAA430E0"><enum>(B)</enum><text>was damaged or destroyed by Hurricane Katrina or Hurricane Rita of 2005; and</text></subparagraph> 
<subparagraph id="H3E278A896C9641E9B3B0139E5BB217F6"><enum>(C)</enum><text>is located in an area in the States of Alabama, Mississippi, and Louisiana that was the subject of a disaster declaration by the President under title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) in response to Hurricane Katrina or Hurricane Rita of 2005;</text></subparagraph></paragraph> 
<paragraph id="H3F6340797B574464A97715588DC4005F"><enum>(2)</enum><text>the term <term>designated disaster area</term> means any area in the States of Alabama, Mississippi, and Louisiana that was the subject of a disaster declaration by the President under title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) in response to Hurricanes Katrina and Rita of 2005;</text></paragraph> 
<paragraph id="H58137BD55DF644AD9B39D9C53B25F094"><enum>(3)</enum><text>the term <term>project-based assistance</term> has the same meaning as in section 215(c)(3) of title II of division K of <external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>; and</text></paragraph> 
<paragraph id="H299BCD896755471EBC86A2D900A6972"><enum>(4)</enum><text>the term <term>receiving project or projects</term> has the same meaning as in section 215(c)(4) of title II of division K of <external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>.</text></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H88BF41C6D27C440BB8F86E069359D300"><enum>7.</enum><header>Housing disaster plan</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Housing and Urban Development shall—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H4D8E9BCA346E488F80872ED786F4F792"><enum>(1)</enum><text>develop a written disaster response plan for federally assisted properties, including for properties that receive assistance pursuant to—</text> 
<subparagraph id="H11C0BD4EBA26477DB42E7B95EFCB1587"><enum>(A)</enum><text>section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>); and</text></subparagraph> 
<subparagraph id="H7048CE928EF244CBBE8993401374F108"><enum>(B)</enum><text>section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>); and</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2ED09703032A498EAAA1CE44585968EB"><enum>(2)</enum><text>submit such plan to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives.</text></paragraph></section>
