			 references</header>
			<subsection id="H8CE2B1836B0F45B3AB69B8A6EAC477EE"><enum>(a)</enum><header>Short
			 title</header><text>This Act may be cited as the <quote><short-title>Administrative Law Judges Retirement Act of
			 2008</short-title></quote>.</text>
			</subsection><subsection id="HD41087A2815846C1ABD900CB7694EBBE"><enum>(b)</enum><header>References</header><text>Whenever
			 in this Act an amendment is expressed in terms of an amendment to a section or
			 other provision, the reference shall be considered to be made to a section or
			 other provision of title 5, United States Code.</text>
			</subsection></section><section id="HFD379007B3124B1EB0947EE059309F63"><enum>2.</enum><header>Provisions
			 relating to the Civil Service Retirement System</header>
			<subsection id="H440AEAAFF8C44770BBA5C0EE32529242"><enum>(a)</enum><header>Definition</header><text>Section
			 8331 is amended—</text>
				<paragraph id="H7BDBB7EA5DE646C0846680896C81F8B7"><enum>(1)</enum><text>in paragraph (30),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H2CA698BEE2314B2F00BE4C3F9DDEAFC"><enum>(2)</enum><text>in
			 paragraph (31), by striking the period and inserting a semicolon; and</text>
				</paragraph><paragraph id="H1D9FEBC8997344B691D0B846FFEF7BB9"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H2C8AF6ED3AEA483EB0F91CB6728D9915">
						<paragraph id="H4D0A2B7E29C841AB00511D7185374BAC"><enum>(32)</enum><text><term>administrative
				law judge</term> means an administrative law judge appointed under section 3105
				or a similar prior provision of
				law.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HAEF482CFC2EE45F786DE29BDAC8647E2"><enum>(b)</enum><header>Deductions,
			 contributions, and deposits</header><text>Section 8334 is amended—</text>
				<paragraph id="HC504D607C3D64E6E9E7D78BF79016EDE"><enum>(1)</enum><text>in subsection
			 (a)(1)(A), by striking <quote>or customs and border protection officer,</quote>
			 and inserting <quote>customs and border protection officer, or administrative
			 law judge,</quote>;</text>
				</paragraph><paragraph id="HEAFCE4C062EE4ADEAB40123767612D30"><enum>(2)</enum><text>in subsection
			 (a)(1)(B)—</text>
					<subparagraph id="HD2F7ED9146AF4299857DE633F12FAA7D"><enum>(A)</enum><text>in the first
			 sentence of clause (i), by striking <quote>clause (ii),</quote> and inserting
			 <quote>clause (ii) or (iii),</quote>; and</text>
					</subparagraph><subparagraph id="H0F148AE0982A4C248CED78E357E90408"><enum>(B)</enum><text>by adding after
			 clause (ii) the following:</text>

				multiplying the administrative law judge’s basic pay by the percentage that is
				1 percentage point less than the percentage applicable under subsection
				(c).</text>

			 by adding after the item relating to a nuclear materials courier the

				</paragraph></subsection><subsection id="H561D748060D04CE3976981893758EC52"><enum>(c)</enum><header>Immediate
			 retirement</header>
				<paragraph id="HE9E79267D2B84CEF931438D722FCD0A6"><enum>(1)</enum><header>In
			 general</header><text>Section 8336 is amended by adding at the end the
			 following:</text>
					<quoted-block id="H8FB07D846C9F4B949D27F6554279A300">
						<subsection id="H74E57C7F4754417FB3D9E34373766972"><enum>(q)</enum><text>An employee who is
				separated from the service after completing 10 years of service as an
				administrative law judge and becoming 60 years of age is entitled to an
				annuity. An employee who is separated from the service voluntarily after
				completing 10 years of service as an administrative law judge but before
				becoming 60 years of age is entitled to a reduced
				annuity.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H5DAA3FD70E5B4EFD9CF2E18B5FA1AD46"><enum>(2)</enum><header>Discontinued
			 service or early voluntary retirement</header><text>Section 8336(d) is amended
			 by adding at the end the following: <quote>In the case of an administrative law
			 judge, the preceding provisions of this subsection shall be applied by treating
			 any reference in such provisions to removal or separation for <quote>misconduct
			 or delinquency</quote> or for <quote>misconduct or unacceptable
			 performance</quote> to refer to removal under section 1215, 7521, or
			 7532.</quote>.</text>
				</paragraph></subsection><subsection id="H86953AE78FE346D3B487AA864911491"><enum>(d)</enum><header>Computation of
			 annuity</header><text>Section 8339 is amended—</text>
				<paragraph id="HDECDF5DC1D974F3180DAE66F9DAFA967"><enum>(1)</enum><text>in subsection (f),
			 by striking <quote>(r), and (s)</quote> and inserting <quote>(r), (s), and
			 (v)</quote>;</text>
				</paragraph><paragraph id="HBE2EA81F5576434B9D5D54DBCAB19836"><enum>(2)</enum><text>in subsection (h),
			 by adding at the end the following: <quote>The annuity computed under
			 subsections (f) and (v) for a employee retiring under the second sentence of
			 section 8336(q) is reduced by <fraction>1/12</fraction> of 1 percent for each
			 full month not in excess of 60 months, and <fraction>1/6</fraction> of 1
			 percent for each full month in excess of 60 months, the employee is under 60
			 years of age at the date of separation.</quote>;</text>
				</paragraph><paragraph id="H307A2C25EC334209A2D1CB874DAF6EB"><enum>(3)</enum><text>in
			 subsection (i), by striking <quote>(r), or (s)</quote> and inserting
			 <quote>(r), (s), or (v)</quote>; and</text>
				</paragraph><paragraph id="H0B0C13FFC0BB4A88B07C6200E8BF637C"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HC78548BB743A4FC7B587D89E748052EB">
						<subsection id="H9099BFC193B4483296D7E332C4F61EE"><enum>(v)</enum><text>The annuity of an
				employee retiring under section 8336(q) is computed under subsection (a),
				except, if the employee has had at least 5 years’ service as an administrative
				law judge, the employee’s annuity is computed with respect to—</text>
							<paragraph id="HAD09AD4F9B3846679D3D45ABE63D4431"><enum>(1)</enum><text>such employee’s
				service as an administrative law judge; and</text>
							</paragraph><paragraph id="H6F2AC9A047DF4142AE05276D63D19F50"><enum>(2)</enum><text>such employee’s
				military service not exceeding 5 years;</text>
							</paragraph><continuation-text continuation-text-level="subsection">by
				multiplying 2<fraction>½</fraction> percent of such employee’s average pay by
				the years of that
				service.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE143BE80B9EC49DF83EC25D27D9049A8"><enum>(e)</enum><header>Technical and
			 conforming amendments</header><paragraph commented="no" display-inline="yes-display-inline" id="HF9C13FA954754B0AACFD3B2C8582546E"><enum>(1)</enum><text>Sections 8337(a) and
			 8339(g) are amended by striking <quote>or (s)</quote> each place it appears and
			 inserting <quote>(s), or (v)</quote>.</text>
				</paragraph><paragraph id="H35245C8A3DB24F589EB59651C813E50" indent="up1"><enum>(2)</enum><text>Subsections (j), (k)(1), (l), and (m)
			 of section 8339, subsections (b)(1) and (d) of section 8341, section 8343a(c),
			 and section 8344(a)(A) are amended by striking <quote>and (s)</quote> each
			 place it appears and inserting <quote>(s), and (v)</quote>.</text>
				</paragraph><paragraph id="H9D7F6AA387AC490A95A16F918D0B76F" indent="up1"><enum>(3)</enum><text>Subsections (j)(3) (in the third
			 sentence before the sentence containing subparagraph (A)), (j)(5)(C)(iii), and
			 (k)(2)(C) of section 8339 are amended by striking <quote>and (r)</quote> and
			 inserting <quote>(r), and (v)</quote>.</text>
				</paragraph><paragraph id="H784EAD1A515348B8B696709F8BB919EE" indent="up1"><enum>(4)</enum><text>Section 8335(a) is amended by
			 striking <quote>8331(29)(A)</quote> and inserting
			 <quote>8331(30)(A)</quote>.</text>
				</paragraph></subsection></section><section id="HA77E7CDA28F44926A93F6FDB71687600"><enum>3.</enum><header>Provisions
			 relating to the Federal Employees’ Retirement System</header>
			<subsection id="HB9268CB5AA32479DA44105ED10C6D709"><enum>(a)</enum><header>Definition</header><text>Section
			 8401 is amended—</text>
				<paragraph id="H90F9F36D5FD7465D9CFF63A0E276F7E5"><enum>(1)</enum><text>in paragraph (35),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H133850A5D1254B1ABB5CB52293970039"><enum>(2)</enum><text>in paragraph (36),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="HA8F75EEEE41F4B1C9861943D39F4FAED"><enum>(3)</enum><text>by adding at the
			 end the following:</text>

				</paragraph></subsection><subsection commented="no" id="HCD7D4C842E214FCAB2634626001B0937"><enum>(b)</enum><header>Early
			 retirement</header><text>Section 8414(b) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H8780F231277A4B8F007DA2E1501555AD" style="USC">
					<paragraph commented="no" id="HECF29C73B91E4B1282B5F73069D5F99C" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of an administrative law judge,
				the preceding provisions of this subsection shall be applied by treating any
				reference in such provisions to removal or separation for <quote>misconduct or
				delinquency</quote> or for <quote>misconduct or unacceptable
				performance</quote> to refer to removal under section 1215, 7521, or
				7532.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6BD5B23362D54D3990F4E6B086703D7"><enum>(c)</enum><header>Computation of
			 annuity</header><text>Section 8415 is amended—</text>
				<paragraph id="HBAD06B7E28FB4DD5B70053EA1C00EBFD"><enum>(1)</enum><text>in subsection
			 (h)(2), by striking <quote>or customs and border protection officer</quote> and
			 inserting <quote>customs and border protection officer, or administrative law
			 judge.</quote>; and</text>
				</paragraph><paragraph id="H28D6868FC9DF4207BF5021009E40D9AF"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H5F518E24C4C446EFAD674C279F3914EB">
						<subsection id="H8F45C7A1C1554CDB8BEE39056EF25790"><enum>(n)</enum><text>The annuity of an
				administrative law judge, or a former administrative law judge, retiring under
				this subchapter is computed under subsection (a), except that if the individual
				has had at least 5 years of service as an administrative law judge, so much of
				the annuity as is computed with respect to such type of service, not exceeding
				a total of 20 years, shall be computed by multiplying
				1<fraction>7/10</fraction> percent of such employee’s average pay by the years
				of that
				service.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H03D0D9E6250B4E4E84E4D924B3151C1D"><enum>(d)</enum><header>Deductions from
			 pay</header><text>Section 8422(a)(3) is amended by adding after the item
			 relating to a customs and border protection officer the following:</text>

			</subsection><subsection id="H6BBD4A09848C4920B809B6CD1C4E3874"><enum>(e)</enum><header>Government
			 contributions</header><text>Section 8423 is amended—</text>
				<paragraph id="H53F466A8768B40D5A13B0257C04041E3"><enum>(1)</enum><text>in subsection
			 (a)(1)(B)(i), by striking <quote>and employees under sections 302 and 303 of
			 the Central Intelligence Agency Retirement Act, multiplied by</quote> and
			 inserting <quote>employees under sections 302 and 303 of the Central
			 Intelligence Agency Retirement Act, and administrative law judges, multiplied
			 by</quote>;</text>
				</paragraph><paragraph id="HC6255B0214AA4B679B28B05220FB4541"><enum>(2)</enum><text>by amending
			 paragraph (2) of subsection (a) to read as follows:</text>
					<quoted-block id="H365ECE2075E84C4EAA16846DD2E834B9">
						<paragraph id="HF00B9DA481F548429D05EF97E32BFC" indent="up1"><enum>(2)</enum><text>In determining any normal-cost
				percentage to be applied under this subsection—</text>
							<subparagraph id="H61C9FB0B7C7E460FBA56DE05BCB4AAD"><enum>(A)</enum><text>amounts provided for under section
				8422 shall be taken into account; and</text>
							</subparagraph><subparagraph id="H81CEEDF93054486A893571E55769EE62"><enum>(B)</enum><text>amounts provided by or for
				administrative law judges under subchapter III of chapter 83 (including
				sections 8334 and 8348, and whether provided before, on, or after the effective
				date of this subparagraph) shall, to the extent they exceed the normal cost of
				the benefits which are (i) provided for under subchapter III of chapter 83, and
				(ii) attributable to service performed as an administrative law judge (within
				the meaning of such subchapter), be taken into account as if they had been
				provided by or for administrative law judges under this
				chapter.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HAAB3BB9432F149A08642C3CB5D009E32"><enum>(3)</enum><text>in subsection
			 (a)(3)(A), by inserting <quote>administrative law judges,</quote> after
			 <quote>military reserve technicians,</quote> each place it appears.</text>
				</paragraph></subsection></section><section id="H8FCB2ABDEBE946EF993E695067E40564"><enum>4.</enum><header>Effective
			 date</header>
			<subsection id="H190103AD87034131BCDA47C2DEFF6E7E"><enum>(a)</enum><header>In
			 general</header><text>This Act and the amendments made by this Act—</text>
				<paragraph id="H11E959AE4F4D4F8ABAA9C803D1A35C07"><enum>(1)</enum><text>shall take effect
			 on the date of the enactment of this Act; and</text>
				</paragraph><paragraph id="H5A2D81BE859F4CC9AE4E455179CE7EEC"><enum>(2)</enum><text>except as provided
			 in subsection (b), shall apply only with respect to administrative law judges
			 first appointed on or after the effective date of this Act.</text>
				</paragraph></subsection><subsection id="H8A8F714CBB7C421997F466C920FFC53"><enum>(b)</enum><header>Exception</header>
				<paragraph id="HFCD83109578D4EF59946ABAA8FA27D1"><enum>(1)</enum><header>Election for
			 incumbents</header><text>The amendments made by this Act shall apply with
			 respect to any individual serving as an administrative law judge on the
			 effective date of this Act if appropriate written application is submitted to
			 the Office of Personnel Management within 12 months after such effective
			 date.</text>
				</paragraph><paragraph id="H2D4E47461649426D8E96FFB755B195F9"><enum>(2)</enum><header>Treatment of
			 prior service</header>
					<subparagraph id="HF8279C94B13E4DCDA2B2BB12AEA8B85F"><enum>(A)</enum><header>Deposit
			 requirement</header><text>An individual who makes an election under paragraph
			 (1) shall, with respect to any administrative law judge service performed by
			 such individual prior to the date as of which deductions from such individual’s
			 pay begin to be made in accordance with the amendments made by this Act, be
			 required to pay into the Civil Service Retirement and Disability Fund an amount
			 equal to the difference between—</text>
						<clause id="HFB544CC24BB04C2D921D8412D4B5F6FC"><enum>(i)</enum><text>the
			 unrefunded individual contributions that were made for such prior service;
			 and</text>
						</clause><clause id="HF59F4886BE1A46599CB765618F062865"><enum>(ii)</enum><text>the
			 individual contributions that would have been required if the rate (or rates)
			 in effect for such prior service had been equal to the rate (or rates) actually
			 in effect for such prior service, increased by 1 percentage point.</text>
						</clause></subparagraph><subparagraph id="H6E81A9C797494A208028A65200C26959"><enum>(B)</enum><header>Effect of not
			 making deposit</header><text>If or to the extent that any amounts under
			 subparagraph (A) are not paid by an individual making an election under
			 paragraph (1), any annuity based on the service of such individual—</text>
						<clause id="H3BAFA8772C564647003E418009B56DA0"><enum>(i)</enum><text>shall be computed
			 in accordance with the amendments made by this Act; but</text>
						</clause><clause id="H55A708ABE94D403C007722B5821617F5"><enum>(ii)</enum><text>shall be reduced
			 in a manner similar to that set forth in <external-xref legal-doc="usc" parsable-cite="usc/5/8334">section 8334(d)(2)(B)</external-xref> of title 5,
			 United States Code.</text>
						</clause></subparagraph></paragraph><paragraph id="HEE83CF94FDB04830BBF723BAE7150616"><enum>(3)</enum><header>Survivor
			 annuitants</header><text>In the case of an individual described in paragraph
			 (1) who dies before the end of the 12-month period beginning on the effective
			 date of this Act, any application or deposit under this subsection may, for
			 purposes of any survivor annuity based on the service of such individual, also
			 be made by a survivor of such individual.</text>
				</paragraph></subsection><subsection id="H9D37A05C20DF46F5811300DD0008A258"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term
			 <term>administrative law judge</term> means an administrative law judge
			 appointed under <external-xref legal-doc="usc" parsable-cite="usc/5/3105">section 3105</external-xref> of title 5, United States Code, or a similar prior
			 provision of law.</text>
			</subsection><subsection id="H8E4C1809AEEC4080BE4C1C807B6E54DA"><enum>(d)</enum><header>Regulations</header><text>The
			 Office of Personnel Management may prescribe any regulations necessary to carry
			 out this section.</text>
