<official-title>To provide for a program for circulating quarter dollar coins that are emblematic of prominent civil rights leaders and important events that have advanced civil rights in America.</official-title>

<section id="H6466349B83D54420A3AA00DD2D0086D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civil Rights Quarter Dollar Coin Act of 2008</short-title></quote>.</text></section> 
<title id="H029193D7E24B4D350072D4A3F97FD500"><enum>I</enum><header>Civil rights quarter dollars</header> 
<section id="HB71F36458C6F4FC9A0697DCA046E0037"><enum>101.</enum><header>Issuance of redesigned quarter dollars emblematic of prominent civil rights leaders and civil rights efforts in America</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/5112">Section 5112</external-xref> of title 31, United States Code, is amended—</text> 
<paragraph id="HA7955202688041C18B542F28FC355573"><enum>(1)</enum><text>by redesignating subsection (r) (as added by section 622 of the Financial Services and General Government Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>) as subsection (s); and </text></paragraph> 
<paragraph id="H15C4F953FE3647EEA205053C603FB208"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block id="HD836CECAF1E54D4F99E83768FD75AC97" style="OLC"> 
<subsection id="HCEA4550B57CD4EADB3151C2700389B30"><enum>(t)</enum><header>Redesign and issuance of quarter dollars emblematic of prominent civil rights leaders and civil rights efforts in America</header> 
<paragraph id="H24A33B89CA12473F972315AFE5F9C7DE"><enum>(1)</enum><header>Redesign beginning upon completion of prior program</header> 
<subparagraph id="H7852DC6858664EE6A35CDCF1DABBC3D"><enum>(A)</enum><header>In general</header><text>Notwithstanding the fourth sentence of subsection (d)(1) and subsection (d)(2), quarter dollars issued after the end of the program established under subsection (s) shall have designs on the reverse selected in accordance with this subsection which are emblematic of prominent civil rights leaders and important events that have advanced civil rights in America.</text></subparagraph> 
<subparagraph id="HCE8D6A3CAD9F4A5E97D4C900FFE93CED"><enum>(B)</enum><header>Flexibility with regard to placement of inscriptions</header><text>Notwithstanding subsection (d)(1), the Secretary may select a design for quarter dollars referred to in subparagraph (A) in which—</text> 
<clause id="HD5198D106C694009002934B2B5C00E2"><enum>(i)</enum><text>the inscription described in the second sentence of subsection (d)(1) appears on the reverse side of any such quarter dollars; and</text></clause> 
<clause id="H4ECA5F31831049F590EF56DA27F726E"><enum>(ii)</enum><text>any inscription described in the third sentence of subsection (d)(1) or the designation of the value of the coin appears on the obverse side of any such quarter dollars.</text></clause></subparagraph></paragraph> 
<paragraph id="H9BD1099A52514AE09DDF4C753E286E72"><enum>(2)</enum><header>Selection of civil rights leaders and events and design</header><text>The designs selected for the reverse of the coins described under this subsection—</text> 
<subparagraph id="H57F11649871E437A9B2678C2B78221F6"><enum>(A)</enum><header>Civil rights leaders and events</header> 
<clause id="H42F82F8482624037BBB583246493FDE9"><enum>(i)</enum><header>In general</header><text>The selection of prominent civil rights leaders and events that have advanced civil rights in America to be honored with a coin under this subsection shall be chosen by the Secretary after consultation with the Congressional Black Caucus, the Congressional Hispanic Caucus, and the Congressional Asian Pacific American Caucus.</text></clause> 
<clause id="HCB3FFB96D9F449D49D25C6794B46D332"><enum>(ii)</enum><text>Coins may depict individuals and events such as—</text> 
<subclause id="HBA31DA6A6812433089130081ADB1ED00"><enum>(I)</enum><text>Martin Luther King, Jr.;</text></subclause> 
<subclause id="H94EC79B4B5934E10A067DDDEDB54E893"><enum>(II)</enum><text>Harriet Tubman and the Underground Railroad;</text></subclause> 
<subclause id="HFBF9D12F286A46B9B0B9CB5F439B1EB9"><enum>(III)</enum><text>The Little Rock Nine;</text></subclause> 
<subclause id="H5C64CE5DBA7A44188FA158AD5F4E2B8"><enum>(IV)</enum><text>Rosa Parks;</text></subclause> 
<subclause id="H6E767A6C842C474AB22E9B00DA71AFCD"><enum>(V)</enum><text>César Chávez;</text></subclause> 
<subclause id="H8DD7339A790A413198513309C9088EE3"><enum>(VI)</enum><text display-inline="yes-display-inline">Antonia Pantoja;</text></subclause> 
<subclause id="HA42B2591B93442E68DDE189BDEEBD142"><enum>(VII)</enum><text display-inline="yes-display-inline">Dionisio (Dennis) Chávez; </text></subclause> 
<subclause id="HE1ACF1025C52466C9E755BD91D83064B"><enum>(VIII)</enum><text>Patsy Mink;</text></subclause> 
<subclause id="HF3DE6109909D481A88A2587FFE94B8E2"><enum>(IX)</enum><text display-inline="yes-display-inline">Philip Vera Cruz; and</text></subclause> 
<subclause id="H21C2F7FD18EA414BB8386B7634447738"><enum>(X)</enum><text>Thurgood Marshall.</text></subclause></clause> 
<clause id="HDDA353D5222E4A4EA8FA142200357C4B"><enum>(iii)</enum><text>No portrait of a living individual shall be selected for a coin under this subsection.</text></clause> 
<clause id="H57E500AD531E4A8A974C77D9D31EB08E"><enum>(iv)</enum><text>40 civil rights leaders and events shall be selected to be commemorated with coins under this subsection.</text></clause> 
<clause id="H7BD5B0667DC041D79DC1C3CBB84D57E0"><enum>(v)</enum><text display-inline="yes-display-inline">The selection process under clause (i) for—</text> 
<subclause id="HD0758BC36AFA4C7A92D580503616EEF3"><enum>(I)</enum><text display-inline="yes-display-inline">the first 32 coin designs shall be completed before the end of the 2-year period beginning on the date of the enactment of the Civil Rights Quarter Dollar Coin Act of 2008; and</text></subclause> 
<subclause id="H955237B3658A4BD3A3F007AADC8D91C8"><enum>(II)</enum><text display-inline="yes-display-inline">the remaining coin designs shall be completed before the end of the 2-year period beginning on the date the first coin is issued that bears the first design selected under this subsection.</text></subclause></clause></subparagraph> 
<subparagraph id="HF8F6717D75AB45D2AB948C5DE5452C62"><enum>(B)</enum><header>Design</header><text>Each of the designs required under this subsection for quarter dollars shall be—</text> 
<clause id="HAC6915AD64EA4B9FA58915571D90F32C"><enum>(i)</enum><text>selected by the Secretary after consultation with—</text> 
<subclause id="H31F1C97A96F84233A1DAC05CBD624C00"><enum>(I)</enum><text>the Congressional Black Caucus, the Congressional Hispanic Caucus, and the Congressional Asian Pacific American Caucus;</text></subclause> 
<subclause id="H080BEF8A04A641248CE9E751E2BBF44"><enum>(II)</enum><text>the Secretary of the Interior; and</text></subclause> 
<subclause id="HA06EA0BBB0CF42AF8E5359BDED872037"><enum>(III)</enum><text> the Commission of Fine Arts;</text></subclause></clause> 
<clause id="H21A2A66F8C1145FCB317F4358C2574D4"><enum>(ii)</enum><text>reviewed by the Citizens Coinage Advisory Committee; and</text></clause> 
<clause id="HB1C27DBA412140A09B36DFF4DB568275"><enum>(iii)</enum><text>in the case of a design depicting the contribution of an individual civil rights leader, shall not depict the individual in a size such that the coin could be considered to be a <quote>2-headed</quote> coin.</text></clause></subparagraph></paragraph> 
<paragraph id="HEF0854065E92493A956D2E820368F3C8"><enum>(3)</enum><header>Issuance of coins</header> 
<subparagraph id="H18155E19CE9F445E8E2267AF540501D6"><enum>(A)</enum><header>Rate of issuance</header><text>The quarter dollar coins bearing designs of civil rights leaders and events under this subsection shall be issued at the rate of 5 new designs during each year of the period of issuance under this subsection.</text></subparagraph> 
<subparagraph id="HD5FCCBADB0004FB0B03E5D9364EAA6EB"><enum>(B)</enum><header>Number of each of 5 coin designs in each year</header><text>Of the quarter dollar coins issued during each year of the period of issuance, the Secretary of the Treasury shall prescribe, on the basis of such factors as the Secretary determines to be appropriate, the number of quarter dollars which shall be issued with each of the designs selected for such year.</text></subparagraph> 
<subparagraph id="HF48E649510E64493A400B7F3A4A00224"><enum>(C)</enum><header>Duration</header><text>Subject to paragraph (2), the program established under this subsection shall continue in effect until a each of the selected civil rights leaders and events have been honored with a coin.</text></subparagraph></paragraph> 
<paragraph id="HE48AC88FA6234D6F8FAE864476B4FB10"><enum>(4)</enum><header>Treatment as numismatic items</header><text>For purposes of sections 5134 and 5136, all coins minted under this subsection shall be considered to be numismatic items.</text></paragraph> 
<paragraph id="HB89F3A301F5A4E8B8600528156FEFE90"><enum>(5)</enum><header>Issuance</header> 
<subparagraph id="H4E521A09F694437AA24BF59098E5D953"><enum>(A)</enum><header>Quality of coins</header><text>The Secretary may mint and issue such number of quarter dollars of each design selected under paragraph (3) in uncirculated and proof qualities as the Secretary determines to be appropriate.</text></subparagraph> 
<subparagraph id="HCFF8FF87B92B41F7A558B72BD94B84E4"><enum>(B)</enum><header>Silver coins</header><text>Notwithstanding subsection (b), the Secretary may mint and issue such number of quarter dollars of each design selected under paragraph (3) as the Secretary determines to be appropriate, with a content of 90 percent silver and 10 percent copper.</text></subparagraph></paragraph> 
<paragraph id="HF1E7969140934B81A9BB70776E85980"><enum>(6)</enum><header>Designs after end of program</header><text>Upon the completion of the coin program under this subsection, the design on—</text> 
<subparagraph id="H12AFB48DDE0D4244932F749E88092B4E"><enum>(A)</enum><text>the obverse of the quarter dollar shall revert to the same design containing an image of President Washington in effect for the quarter dollar before the institution of the 50-State quarter dollar program; and</text></subparagraph> 
<subparagraph id="H222FC8381F294C32B342A2CC595E14F"><enum>(B)</enum><text>notwithstanding the fourth sentence of subsection (d)(1), the reverse of the quarter dollar shall contain an image of General Washington crossing the Delaware River prior to the Battle of Trenton.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> 
<title id="H5A434ABC6AFA4BD988FB3D49D46609F5"><enum>II</enum><header>Bullion investment products</header> 
<section id="HBBCDA1183B084300B7BB229DB3D53093"><enum>201.</enum><header>Silver bullion coin</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/5112">Section 5112</external-xref> of title 31, United States Code, is amended by inserting after subsection (t) (as added by title I of this Act) the following new subsection:</text> 
<quoted-block id="H54AA819EFDED4ABE001631DC750077FD" style="OLC"> 
<subsection id="H76E3D0A076BF49C388CA319D78E1228"><enum>(u)</enum><header>Silver Bullion Investment Product</header> 
<paragraph id="HD92D57C87DF74782A0B7808EB2004885"><enum>(1)</enum><header>In general</header><text>The Secretary shall strike and make available for sale such number of bullion coins as the Secretary determines to be appropriate that are exact duplicates of the quarter dollars issued under subsection (t), each of which shall—</text> 
<subparagraph id="H10288198D1A2483B912C13F07C3D6E5B"><enum>(A)</enum><text>have a diameter of 3.0 inches and weigh 5.0 ounces;</text></subparagraph> 
<subparagraph id="HCC0FF6934CB74E9593B31757EC009381"><enum>(B)</enum><text>contain .999 fine silver;</text></subparagraph> 
<subparagraph id="H1828870E469249E8BE2100C1BCD076B1"><enum>(C)</enum><text>have incused into the edge the fineness and weight of the bullion coin;</text></subparagraph> 
<subparagraph id="H9C2E319424274BF396000083B964D116"><enum>(D)</enum><text>bear an inscription of the denomination of such coin, which shall be <quote>Quarter Dollar</quote>; and</text></subparagraph> 
<subparagraph id="H41675E59CC34416A88C7D260313F73BF"><enum>(E)</enum><text>not be minted or issued by the United States Mint as so-called <quote>fractional</quote> bullion coins or in any size other than the size described in paragraph (A).</text></subparagraph></paragraph> 
<paragraph id="H68FB7F84AFAA468F8400A3D6B629AF00"><enum>(2)</enum><header>Availability for sale</header><text>Bullion coins minted under paragraph (1)—</text> 
<subparagraph id="HF5E78FDF9ABC4ED89D26D63E0678237"><enum>(A)</enum><text>shall become available for sale no sooner than the first day of the calendar year in which the circulating quarter dollar of which such bullion coin is a duplicate is issued; and</text></subparagraph> 
<subparagraph id="H29D6DA36B7D64994A629E7E627D2D25C"><enum>(B)</enum><text>may only be available for sale during the year in which such circulating quarter dollar is issued.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title>
