		<official-title>To amend the Omnibus Crime Control and Safe Streets Act
		  of 1968 to require States who wish to receive funds under the Act to increase
		  the penalty applied to a defendant convicted of a violent crime who placed a
		  video of the commission of that crime on the Internet.</official-title>

		<section id="H1A7D67B29D454E94AC546DD748000FD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Web
			 Video Violence Act</quote>.</text>
		</section><section id="H9CE424488727443BB1E750A53E59AC18"><enum>2.</enum><header>Conditioning
			 funding on State certification of increased penalties for violent criminals who
			 place video of crime on Internet</header>
			<subsection id="H92F6615D91AE4D339F7314B909A261D6"><enum>(a)</enum><header>Certification of
			 increased penalty</header><text display-inline="yes-display-inline">Section 502
			 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3752">42 U.S.C. 3752</external-xref>) is
			 amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HC9E5AC7AE8604DF0A4F411E5879ED5D" style="OLC">
					<paragraph id="H80909B1E26ED489D8F1C25C5645CD5DE"><enum>(6)</enum><text>At the option of
				the State, a certification that the laws or official policies of the State
				require that when a criminal defendant is being sentenced, a graduated sanction
				(in the case of a juvenile defendant) or an increased penalty (in the case of
				an adult defendant) is applied—</text>
						<subparagraph id="HF1358B5501BF454EAB00B68E90A720B3"><enum>(A)</enum><text>if the defendant
				is convicted of a violent crime against the person of another; and</text>
						</subparagraph><subparagraph id="H22A3B3E296EE46CBABA0D3F254AD33CE"><enum>(B)</enum><text>if the defendant
				is found to have placed, or directed another to have placed, a video or image
				of the commission of such crime on the
				Internet.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H11ADC95E006445AABACA417BD546FC89"><enum>(b)</enum><header>Reduction in
			 grant funding for non-certifying States</header><text display-inline="yes-display-inline">Section 505(a) of the Omnibus Crime Control
			 and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3755">42 U.S.C. 3755(a)</external-xref>) is amended by adding at the
			 end the following new paragraph—</text>
				<quoted-block id="H5228B0B4E1834AEB989E7F5400418D7F">
					<paragraph id="HC23C8AEF7DA14D7984EC429FE6E67E1E"><enum>(3)</enum><header>Special rule for
				non-certifying States</header><text>If a State opts not to certify that it has
				increased penalties for certain violent criminals as specified under section
				502(6), the Attorney General shall reduce the total amount of funding that
				would otherwise be allocated to that State—</text>
						<subparagraph id="H52864F6E96C0420EAD629BA82E7D8A5"><enum>(A)</enum><text>by 10 percent in
				the first fiscal year in which the certification is lacking; and</text>
						</subparagraph><subparagraph id="HFE50948938DD4D03BEAD29C5B3E1EEC4"><enum>(B)</enum><text>by an additional 5
				percent for each subsequent fiscal year in which the certification is
				lacking.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H238DE4C611F34B56A93259823096CF50"><enum>3.</enum><header>Effective
			 Date</header><text display-inline="no-display-inline">The amendments made by
			 section 2 shall apply to fiscal years beginning with the next fiscal year that
			 begins 1 year after the date of enactment of this Act.</text>
