		<section id="H9075A192578649F6903C6605D952475F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Northern Plains National Heritage Area
			 Act</short-title></quote>.</text>
		</section><section id="HDD0B43C755F940F2B595C4E246FEC07"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H0B73857F491442E29211425D380000C6"><enum>(1)</enum><header>Heritage
			 Area</header><text>The term <term>Heritage Area</term> means the Northern
			 Plains National Heritage Area established by section 3(a).</text>
			</paragraph><paragraph id="HC00EA9D64BA748E4AB7C00ADEED7FDDC"><enum>(2)</enum><header>Local
			 coordinating entity</header><text>The term <term>local coordinating
			 entity</term> means the Northern Plains Heritage Foundation, the local
			 coordinating entity for the Heritage Area designated by section 4(a).</text>
			</paragraph><paragraph id="H5BF74771048847EC8FED7C0034A11216"><enum>(3)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the management
			 plan for the Heritage Area required under section 5.</text>
			</paragraph><paragraph id="H4374B62086054BD88FCEF9833BF4A310"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="H67B463EB3E4F48169BB76E8D9534FCF"><enum>(5)</enum><header>State</header><text>The
			 term <term>State</term> means the State of North Dakota.</text>
			</paragraph></section><section id="H642D4EB9BAE344F2BF633B5E9CA057E"><enum>3.</enum><header>Establishment</header>
			<subsection id="H3CCFEBE7CC5A46D69E456319EA18F49"><enum>(a)</enum><header>In
			 general</header><text>There is established the Northern Plains National
			 Heritage Area in the State of North Dakota.</text>
			</subsection><subsection id="HC9F0025FF7564B88ADA0D746E700ED16"><enum>(b)</enum><header>Boundaries</header><text>The
			 Heritage Area shall consist of—</text>
				<paragraph id="H27B752FEEE1B47CA86D239607A66DE"><enum>(1)</enum><text>a
			 core area of resources in Burleigh, McLean, Mercer, Morton, and Oliver Counties
			 in the State; and</text>
				</paragraph><paragraph id="H717E55D8025543C3A1795F3E537BF600"><enum>(2)</enum><text>any sites,
			 buildings, and districts within the core area recommended by the management
			 plan for inclusion in the Heritage Area.</text>
				</paragraph></subsection><subsection id="H3D2F5F8D52AA40A18800EFD1B259ABCB"><enum>(c)</enum><header>Map</header><text>A
			 map of the Heritage Area shall be—</text>
				<paragraph id="H32684A76CB3D41BBB3AE430085E700CB"><enum>(1)</enum><text>included in the
			 management plan; and</text>
				</paragraph><paragraph id="H43A3CA9B926F4D48A060CD13B13DDBDB"><enum>(2)</enum><text>on file and
			 available for public inspection in the appropriate offices of the local
			 coordinating entity and the National Park Service.</text>
				</paragraph></subsection></section><section id="H8FCE9928116B4C91920800A6A2AC5DEC"><enum>4.</enum><header>Local
			 coordinating entity</header>
			<subsection id="H46BAE409C55147108C24A70678E5FAD"><enum>(a)</enum><header>In
			 general</header><text>The local coordinating entity for the Heritage Area shall
			 be the Northern Plains Heritage Foundation, a nonprofit corporation established
			 under the laws of the State.</text>
			</subsection><subsection id="H50D674C3A8864804876B698B3F5179F3"><enum>(b)</enum><header>Duties</header><text>To
			 further the purposes of the Heritage Area, the Northern Plains Heritage
			 Foundation, as the local coordinating entity, shall—</text>
				<paragraph id="H6D045CB304DF42EB9F5D98006F1B9334"><enum>(1)</enum><text>prepare a
			 management plan for the Heritage Area, and submit the management plan to the
			 Secretary, in accordance with this Act;</text>
				</paragraph><paragraph id="HEF8965012BAF487C93F6E78C7329B7F3"><enum>(2)</enum><text>submit an annual
			 report to the Secretary for each fiscal year for which the local coordinating
			 entity receives Federal funds under this Act, specifying—</text>
					<subparagraph id="H80CD252B40664E3995EBAEE8C1561F6"><enum>(A)</enum><text>the specific
			 performance goals and accomplishments of the local coordinating entity;</text>
					</subparagraph><subparagraph id="H4592585F89624AF4AE63E648577647BC"><enum>(B)</enum><text>the expenses and
			 income of the local coordinating entity;</text>
					</subparagraph><subparagraph id="H40E9B2CD714B41F6908E298BAC91157E"><enum>(C)</enum><text>the amounts and
			 sources of matching funds;</text>
					</subparagraph><subparagraph id="H95B4ABDAD8164083AACF3131BBDD134B"><enum>(D)</enum><text>the amounts
			 leveraged with Federal funds and sources of the leveraged funds; and</text>
					</subparagraph><subparagraph id="HBE16C4E42B7E4855A7B7A0CACF64F49"><enum>(E)</enum><text>grants made to any
			 other entities during the fiscal year;</text>
					</subparagraph></paragraph><paragraph id="H7A21F023C38E4BF7A6C61700ED3B97D"><enum>(3)</enum><text>make available for
			 audit for each fiscal year for which the local coordinating entity receives
			 Federal funds under this Act, all information pertaining to the expenditure of
			 the funds and any matching funds; and</text>
				</paragraph><paragraph id="H322B13C97BEE454585A8C8400F32DAE"><enum>(4)</enum><text>encourage economic
			 viability and sustainability that is consistent with the purposes of the
			 Heritage Area.</text>
				</paragraph></subsection><subsection id="H82F58BCDD1D1497B8563A082DF7CE63"><enum>(c)</enum><header>Authorities</header><text>For
			 the purposes of preparing and implementing the approved management plan for the
			 Heritage Area, the local coordinating entity may use Federal funds made
			 available under this Act to—</text>
				<paragraph id="H82F97A270F90408B85DF355309C5BB16"><enum>(1)</enum><text>make grants to
			 political jurisdictions, nonprofit organizations, and other parties within the
			 Heritage Area;</text>
				</paragraph><paragraph id="H869E8EFCDBE04BD791FD11107EFA4477"><enum>(2)</enum><text>enter into
			 cooperative agreements with or provide technical assistance to political
			 jurisdictions, nonprofit organizations, Federal agencies, and other interested
			 parties;</text>
				</paragraph><paragraph id="H6199C6E814924C2AB6D6E22C945C1BAF"><enum>(3)</enum><text>hire and
			 compensate staff, including individuals with expertise in—</text>
					<subparagraph id="HE6ED92EE2BE8470D815698155EED00D"><enum>(A)</enum><text>natural,
			 historical, cultural, educational, scenic, and recreational resource
			 conservation;</text>
					</subparagraph><subparagraph id="H179B62A404BE447EA75130C4DFD65951"><enum>(B)</enum><text>economic and
			 community development; and</text>
					</subparagraph><subparagraph id="HF8F7CECF6CE64C2AA9EFA66D1B86F492"><enum>(C)</enum><text>heritage
			 planning;</text>
					</subparagraph></paragraph><paragraph id="HECBA39A5B058421F8D9DDE7785F3CB12"><enum>(4)</enum><text>obtain funds or
			 services from any source, including other Federal programs;</text>
				</paragraph><paragraph id="HB5ADB3D2B13449FF8F7EDA4800470045"><enum>(5)</enum><text>contract for goods
			 or services; and</text>
				</paragraph><paragraph id="HC7F22D27D2A54D02B6D02E836841264F"><enum>(6)</enum><text>support activities
			 of partners and any other activities that further the purposes of the Heritage
			 Area and are consistent with the approved management plan.</text>
				</paragraph></subsection><subsection id="H7559FAED85B34318BDCE65872BE495AE"><enum>(d)</enum><header>Prohibition on
			 acquisition of real property</header><text>The local coordinating entity may
			 not use Federal funds authorized to be appropriated under this Act to acquire
			 any interest in real property.</text>
			</subsection><subsection id="H53167A92BAE443ACBE8731E207AD1FF3"><enum>(e)</enum><header>Other
			 sources</header><text>Nothing in this Act precludes the local coordinating
			 entity from using Federal funds from other sources for authorized
			 purposes.</text>
			</subsection></section><section id="HFACB1AF55C354C6DBC23CC8DDFEB0030"><enum>5.</enum><header>Management
			 plan</header>
			<subsection id="H62FCFAC5DF904F53A1201D61E8B1BF6"><enum>(a)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the local coordinating entity shall submit to the Secretary for
			 approval a proposed management plan for the Heritage Area.</text>
			</subsection><subsection id="H6811ECC0DC064061B0398417077E40EC"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">The management plan for the Heritage Area
			 shall—</text>
				<paragraph id="H94FB184CC0A44E24A91934D6CC4C34BF"><enum>(1)</enum><text>describe
			 comprehensive policies, goals, strategies, and recommendations for telling the
			 story of the heritage of the area covered by the Heritage Area and encouraging
			 long-term resource protection, enhancement, interpretation, funding,
			 management, and development of the Heritage Area;</text>
				</paragraph><paragraph id="H4F082BD795D1410BB76FB8B447DC49F5"><enum>(2)</enum><text>include a
			 description of actions and commitments that Federal, State, tribal, and local
			 governments, private organizations, and citizens will take to protect, enhance,
			 interpret, fund, manage, and develop the natural, historical, cultural,
			 educational, scenic, and recreational resources of the Heritage Area;</text>
				</paragraph><paragraph id="HF03FEF1AF0044023BC809752FE40F86"><enum>(3)</enum><text>specify existing
			 and potential sources of funding or economic development strategies to protect,
			 enhance, interpret, fund, manage, and develop the Heritage Area;</text>
				</paragraph><paragraph id="H4522BD0F00FD46BC8459E4A0AF862400"><enum>(4)</enum><text>include an
			 inventory of the natural, historical, cultural, educational, scenic, and
			 recreational resources of the Heritage Area relating to the national importance
			 and themes of the Heritage Area that should be protected, enhanced,
			 interpreted, managed, funded, and developed;</text>
				</paragraph><paragraph id="H5AF565A004C54C20875DD8F4BD71B300"><enum>(5)</enum><text>recommend policies
			 and strategies for resource management, including the development of
			 intergovernmental and interagency agreements to protect, enhance, interpret,
			 fund, manage, and develop the natural, historical, cultural, educational,
			 scenic, and recreational resources of the Heritage Area;</text>
				</paragraph><paragraph id="H9E74BE16A660432DB5B41C5744D5384E"><enum>(6)</enum><text>describe a program
			 for implementation for the management plan, including—</text>
					<subparagraph id="H313F7CA2FCF24D0FB428DB12FAB83243"><enum>(A)</enum><text>performance
			 goals;</text>
					</subparagraph><subparagraph id="H90BF271983184C3FB440A26D46007D53"><enum>(B)</enum><text>plans for resource
			 protection, enhancement, interpretation, funding, management, and development;
			 and</text>
					</subparagraph><subparagraph id="HCDD83966FFC94F16A808ADBE2C68CED"><enum>(C)</enum><text>specific
			 commitments for implementation that have been made by the local coordinating
			 entity or any Federal, State, tribal, or local government agency, organization,
			 business, or individual;</text>
					</subparagraph></paragraph><paragraph id="HA8246BB6B381435598D030CCDACC7BBD"><enum>(7)</enum><text>include an
			 analysis of, and recommendations for, means by which Federal, State, tribal,
			 and local programs may best be coordinated (including the role of the National
			 Park Service and other Federal agencies associated with the Heritage Area) to
			 further the purposes of this Act; and</text>
				</paragraph><paragraph id="HFABF2DFF6C0542368EDD11DF7877065"><enum>(8)</enum><text>include a business
			 plan that—</text>
					<subparagraph id="H396FB5EB9BAD4C73BFD330888495F6D7"><enum>(A)</enum><text>describes the
			 role, operation, financing, and functions of the local coordinating entity and
			 of each of the major activities described in the management plan; and</text>
					</subparagraph><subparagraph id="H8E180BEA0E944060B8603B14BCCF3E59"><enum>(B)</enum><text>provides adequate
			 assurances that the local coordinating entity has the partnerships and
			 financial and other resources necessary to implement the management plan for
			 the Heritage Area.</text>
					</subparagraph></paragraph></subsection><subsection id="H90C51466B24A4E248D8182188FD3C99"><enum>(c)</enum><header>Deadline</header>
				<paragraph id="H19A41E88DBE64FD7B5AA06511E8C1EB9"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date on which funds are
			 first made available to develop the management plan after designation of the
			 Heritage Area, the local coordinating entity shall submit the management plan
			 to the Secretary for approval.</text>
				</paragraph><paragraph id="HBD42E0D1F8F245C0A100FDAC010663E4"><enum>(2)</enum><header>Termination of
			 funding</header><text>If the management plan is not submitted to the Secretary
			 in accordance with paragraph (1), the local coordinating entity shall not
			 qualify for any additional financial assistance under this Act until such time
			 as the management plan is submitted to and approved by the Secretary.</text>
				</paragraph></subsection><subsection id="HB8831895837144F1889D1485406C9226"><enum>(d)</enum><header>Approval of
			 management plan</header>
				<paragraph id="HC9EFA2AF5B714FB1AA0536287E1DCB91"><enum>(1)</enum><header>Review</header><text>Not
			 later than 180 days after receiving the plan, the Secretary shall review and
			 approve or disapprove the management plan for the Heritage Area on the basis of
			 the criteria established under paragraph (2).</text>
				</paragraph><paragraph id="HDA23E8DE726A4D9483EDE74BAF52F47D"><enum>(2)</enum><header>Criteria for
			 approval</header><text>In determining whether to approve a management plan for
			 the Heritage Area, the Secretary shall consider whether—</text>
					<subparagraph id="H49D3BD5ABADA481DB212D72D33FC65CD"><enum>(A)</enum><text>the local
			 coordinating entity represents the diverse interests of the Heritage Area,
			 including Federal, State, tribal, and local governments, natural, and historic
			 resource protection organizations, educational institutions, businesses,
			 recreational organizations, community residents, and private property
			 owners;</text>
					</subparagraph><subparagraph id="HF78E51932A3042ED91D8CBDA005584E2"><enum>(B)</enum><text>the local
			 coordinating entity—</text>
						<clause id="H5650BF1D6A6740848CB2E5E86467DBAD"><enum>(i)</enum><text>has
			 afforded adequate opportunity for public and Federal, State, tribal, and local
			 governmental involvement (including through workshops and hearings) in the
			 preparation of the management plan; and</text>
						</clause><clause id="H19C885DEAAD440639415B7C6E4D3608"><enum>(ii)</enum><text>provides for at
			 least semiannual public meetings to ensure adequate implementation of the
			 management plan;</text>
						</clause></subparagraph><subparagraph id="H215CF512148A4FB58E8D2F53A5DDA21"><enum>(C)</enum><text>the resource
			 protection, enhancement, interpretation, funding, management, and development
			 strategies described in the management plan, if implemented, would adequately
			 protect, enhance, interpret, fund, manage, and develop the natural, historic,
			 cultural, educational, scenic, and recreational resources of the Heritage
			 Area;</text>
					</subparagraph><subparagraph id="H929750C5F3024C909C25273CBE49F23"><enum>(D)</enum><text>the management plan
			 would not adversely affect any activities authorized on Federal land under
			 public land laws or land use plans;</text>
					</subparagraph><subparagraph id="HC974A5F2D3A843DB88F5AD5BF558496C"><enum>(E)</enum><text>the local
			 coordinating entity has demonstrated the financial capability, in partnership
			 with others, to carry out the plan;</text>
					</subparagraph><subparagraph id="H3DD2E462EBF94D02A053F87E815E02FB"><enum>(F)</enum><text>the Secretary has
			 received adequate assurances from the appropriate State, tribal, and local
			 officials whose support is needed to ensure the effective implementation of the
			 State, tribal, and local elements of the management plan; and</text>
					</subparagraph><subparagraph id="H5F3F334F298D452600A2D9B3AFF809EB"><enum>(G)</enum><text>the management
			 plan demonstrates partnerships among the local coordinating entity, Federal,
			 State, tribal, and local governments, regional planning organizations,
			 nonprofit organizations, or private sector parties for implementation of the
			 management plan.</text>
					</subparagraph></paragraph><paragraph id="HC3A5341142F54DE993B4874178F25422"><enum>(3)</enum><header>Disapproval</header>
					<subparagraph id="H4393B47BD4114CD6A4C838B22FCA9B3F"><enum>(A)</enum><header>In
			 general</header><text>If the Secretary disapproves the management plan, the
			 Secretary—</text>
						<clause id="HC2D73725D7C84D2EBC60A96F442E072D"><enum>(i)</enum><text>shall advise the
			 local coordinating entity in writing of the reasons for the disapproval;
			 and</text>
						</clause><clause id="H902826EA61C94DF1ACB0CBA59DA5C8D"><enum>(ii)</enum><text>may
			 make recommendations to the local coordinating entity for revisions to the
			 management plan.</text>
						</clause></subparagraph><subparagraph id="H90762CF04AFA45F0AD5D61AB8842C9EF"><enum>(B)</enum><header>Deadline</header><text>Not
			 later than 180 days after receiving a revised management plan, the Secretary
			 shall approve or disapprove the revised management plan.</text>
					</subparagraph></paragraph><paragraph id="HAB4E346F86584FCC00DD1119A8F6A461"><enum>(4)</enum><header>Amendments</header>
					<subparagraph id="H1415967D1CBD47D8805377D555557C99"><enum>(A)</enum><header>In
			 general</header><text>An amendment to the management plan that substantially
			 alters the purposes of the Heritage Area shall be reviewed by the Secretary and
			 approved or disapproved in the same manner as the original management
			 plan.</text>
					</subparagraph><subparagraph id="H2AD834519EBF4C9692339808A699CE28"><enum>(B)</enum><header>Implementation</header><text>The
			 local coordinating entity shall not use Federal funds authorized to be
			 appropriated by this Act to implement an amendment to the management plan until
			 the Secretary approves the amendment.</text>
					</subparagraph></paragraph><paragraph id="H8767DEFDBFCC4FCFAD0300D9B3064B09"><enum>(5)</enum><header>Authorities</header><text>The
			 Secretary may—</text>
					<subparagraph id="HC73D53DF757B4FA6A714662CA588EDF6"><enum>(A)</enum><text>provide technical
			 assistance under this Act for the development and implementation of the
			 management plan; and</text>
					</subparagraph><subparagraph id="HD9839613648240EDB5F0C5093C8C0058"><enum>(B)</enum><text>enter into
			 cooperative agreements with interested parties to carry out this Act.</text>
					</subparagraph></paragraph></subsection></section><section id="H01BFF6FC8C84430C93F79E8E8DB33401"><enum>6.</enum><header>Relationship to
			 other Federal agencies</header>
			<subsection id="H5897B80190BE4AA6850027F77CB2C743"><enum>(a)</enum><header>In
			 general</header><text>Nothing in this Act affects the authority of a Federal
			 agency to provide technical or financial assistance under any other law.</text>
			</subsection><subsection id="HBC1056A9A0344E4E98D1B9D1A6C85172"><enum>(b)</enum><header>Technical and
			 financial assistance</header>
				<paragraph id="HEB3AF42C360047BE90C3862D81551700"><enum>(1)</enum><header>In
			 general</header><text>On the request of the local coordinating entity, the
			 Secretary may provide financial assistance and, on a reimbursable or
			 nonreimbursable basis, technical assistance to the local coordinating entity to
			 develop and implement the management plan.</text>
				</paragraph><paragraph id="H440ADDF7922E427FA745E3BA4026CD63"><enum>(2)</enum><header>Cooperative
			 agreements</header><text>The Secretary may enter into cooperative agreements
			 with the local coordinating entity and other public or private entities to
			 provide technical or financial assistance under paragraph (1).</text>
				</paragraph><paragraph id="H2EB3B22A9CC94B3485436B5018968E86"><enum>(3)</enum><header>Priority</header><text>In
			 assisting the Heritage Area, the Secretary shall give priority to actions that
			 assist in—</text>
					<subparagraph id="H6A386D0F16EA410F826400FDBE36F83D"><enum>(A)</enum><text>conserving the
			 significant natural, historic, cultural, and scenic resources of the Heritage
			 Area; and</text>
					</subparagraph><subparagraph id="H777B2DFA96C24976A3A576F6821C51E1"><enum>(B)</enum><text>providing
			 educational, interpretive, and recreational opportunities consistent with the
			 purposes of the Heritage Area.</text>
					</subparagraph></paragraph></subsection><subsection id="HC53A0FAD007F4BBBA8A5B725BC3324C2"><enum>(c)</enum><header>Consultation and
			 coordination</header><text>To the maximum extent practicable, the head of any
			 Federal agency planning to conduct activities that may have an impact on the
			 Heritage Area is encouraged to consult and coordinate the activities with the
			 Secretary and the local coordinating entity.</text>
			</subsection><subsection id="H690BD26A33C64522A9F0D2C9A565ED86"><enum>(d)</enum><header>Other Federal
			 agencies</header><text>Nothing in this Act—</text>
				<paragraph id="H8ABE8F68AAA34825BE1E20FBBC00E3C6"><enum>(1)</enum><text>modifies or alters
			 any laws (including regulations) authorizing a Federal agency to manage Federal
			 land under the jurisdiction of the Federal agency;</text>
				</paragraph><paragraph id="H13C8186C1D0F4BC19D85539F5529C4C9"><enum>(2)</enum><text>limits the
			 discretion of a Federal land manager to implement an approved land use plan
			 within the boundaries of the Heritage Area; or</text>
				</paragraph><paragraph id="HEBB9024C4888425DA2625D61E96300BB"><enum>(3)</enum><text>modifies, alters,
			 or amends any authorized use of Federal land under the jurisdiction of a
			 Federal agency.</text>
				</paragraph></subsection></section><section id="H66DA44179CBE43E3B681E3F954071222"><enum>7.</enum><header>Private property
			 and regulatory protections</header><text display-inline="no-display-inline">Nothing in this Act—</text>
			<paragraph id="H1227379FB80F4488ADFF09657DA5E05C"><enum>(1)</enum><text>abridges the
			 rights of any owner of public or private property, including the right to
			 refrain from participating in any plan, project, program, or activity conducted
			 within the Heritage Area;</text>
			</paragraph><paragraph id="HC1BBE1B3ABE6413B97BA5524D968DD6D"><enum>(2)</enum><text>requires any
			 property owner to—</text>
				<subparagraph id="H91AD3D8DDA2E49D781AA1B3EB1943F3F"><enum>(A)</enum><text>permit public
			 access (including access by Federal, State, or local agencies) to the property
			 of the property owner; or</text>
				</subparagraph><subparagraph id="HEB4EE69B0B9E46E1ACF2A066B518292"><enum>(B)</enum><text>modify public
			 access to, or use of, the property of the property owner under any other
			 Federal, State, or local law;</text>
				</subparagraph></paragraph><paragraph id="HD64283B7C6D8444DB9312FD7AD549D84"><enum>(3)</enum><text>alters any duly
			 adopted land use regulation, approved land use plan, or other regulatory
			 authority of any Federal, State, tribal, or local agency;</text>
			</paragraph><paragraph id="H45072E163DAC45C1859C770044A700F4"><enum>(4)</enum><text>conveys any land
			 use or other regulatory authority to the local coordinating entity;</text>
			</paragraph><paragraph id="HFB5E688D339E496986CDC364163C93FD"><enum>(5)</enum><text>authorizes or
			 implies the reservation or appropriation of water or water rights;</text>
			</paragraph><paragraph id="H8393192CC3AA40ADA570F75797A57125"><enum>(6)</enum><text>diminishes the
			 authority of the State to manage fish and wildlife, including the regulation of
			 fishing and hunting within the Heritage Area; or</text>
			</paragraph><paragraph id="H485A336E4F8F4943A8CACE0746EEE0"><enum>(7)</enum><text>creates any
			 liability, or affects any liability under any other law, of any private
			 property owner with respect to any person injured on the private
			 property.</text>
			</paragraph></section><section id="H34DF97D87C4942E18CC500F25F0833A0"><enum>8.</enum><header>Evaluation;
			 report</header>
			<subsection id="H7BB7741C2F2D4BC69B9EC3207C64DD05"><enum>(a)</enum><header>In
			 general</header><text>Not later than 3 years before the date on which authority
			 for Federal funding terminates for the Heritage Area under section 10, the
			 Secretary shall—</text>
				<paragraph id="HCD726DDA904F4265A3F16B50D9D6BFE7"><enum>(1)</enum><text>conduct an
			 evaluation of the accomplishments of the Heritage Area; and</text>
				</paragraph><paragraph id="H533F83ABB98145CFB9C2609E5D951915"><enum>(2)</enum><text>prepare a report
			 in accordance with subsection (c).</text>
				</paragraph></subsection><subsection id="H4C97484432054FE694ED00B0C460D358"><enum>(b)</enum><header>Evaluation</header><text>An
			 evaluation conducted under subsection (a)(1) shall—</text>
				<paragraph id="HE295A8331BC748280008007D8F6BCB4D"><enum>(1)</enum><text>assess the
			 progress of the local coordinating entity with respect to—</text>
					<subparagraph id="H4F1766B1B87A41FA90E6DB6000F73CE8"><enum>(A)</enum><text>accomplishing the
			 purposes of this Act for the Heritage Area; and</text>
					</subparagraph><subparagraph id="H73CE48B2A77B4C28B7FB087D93C800BC"><enum>(B)</enum><text>achieving the
			 goals and objectives of the approved management plan for the Heritage
			 Area;</text>
					</subparagraph></paragraph><paragraph id="H8E16EFE267C6408585DF02B6444C25C8"><enum>(2)</enum><text>analyze the
			 Federal, State, local, and private investments in the Heritage Area to
			 determine the leverage and impact of the investments; and</text>
				</paragraph><paragraph id="H797CAA5F061843B2A3CF9D324C48C936"><enum>(3)</enum><text>review the
			 management structure, partnership relationships, and funding of the Heritage
			 Area for purposes of identifying the critical components for sustainability of
			 the Heritage Area.</text>
				</paragraph></subsection><subsection id="H286DBAD1CCA847C1B1775E4703003045"><enum>(c)</enum><header>Report</header>
				<paragraph id="HC0C8AA48438344FFB5CC006CC19EADF7"><enum>(1)</enum><header>In
			 general</header><text>Based on the evaluation conducted under subsection
			 (a)(1), the Secretary shall prepare a report that includes recommendations for
			 the future role of the National Park Service, if any, with respect to the
			 Heritage Area.</text>
				</paragraph><paragraph id="H6F69357F04034086BA4100E6902F19B3"><enum>(2)</enum><header>Required
			 analysis</header><text>If the report prepared under paragraph (1) recommends
			 that Federal funding for the Heritage Area be reauthorized, the report shall
			 include an analysis of—</text>
					<subparagraph id="H71CC497ED5184778AA4EC72B15546300"><enum>(A)</enum><text>ways in which
			 Federal funding for the Heritage Area may be reduced or eliminated; and</text>
					</subparagraph><subparagraph id="HA96EF5C07FB74DAD98BE05D39569D3F"><enum>(B)</enum><text>the appropriate
			 time period necessary to achieve the recommended reduction or
			 elimination.</text>
					</subparagraph></paragraph><paragraph id="H59633B56EFD3435B8B49E24D1F166274"><enum>(3)</enum><header>Submission to
			 Congress</header><text>On completion of the report, the Secretary shall submit
			 the report to—</text>
					<subparagraph id="H4440D9C1324F48F5BCBD00A9A1322FDB"><enum>(A)</enum><text>the Committee on
			 Energy and Natural Resources of the Senate; and</text>
					</subparagraph><subparagraph id="HFBE95F4C3A0F4FA0B6AE5433EBA5F0EE"><enum>(B)</enum><text>the Committee on
			 Natural Resources of the House of Representatives.</text>
					</subparagraph></paragraph></subsection></section><section id="H67D4D06D26AF4D08AA6800AC037208C3"><enum>9.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H11FFA7B176FF4552BD39BD5F72EDCEEC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There is authorized
			 to be appropriated to carry out this Act $10,000,000, of which not more than
			 $1,000,000 may be made available for any fiscal year.</text>
			</subsection><subsection id="HBDE7C05126D045B0A529D3BB971B0E6"><enum>(b)</enum><header>Cost-sharing
			 requirement</header>
				<paragraph id="HF2C26268E7904716B5A711E47D117563"><enum>(1)</enum><header>In
			 general</header><text>The Federal share of the total cost of any activity under
			 this Act shall be not more than 50 percent.</text>
				</paragraph><paragraph id="H65A0569F40AC44A9ABE1DB2C25DEDB2B"><enum>(2)</enum><header>Form</header><text>The
			 non-Federal contribution may be in the form of in-kind contributions of goods
			 or services fairly valued.</text>
				</paragraph></subsection></section><section id="H37C8205537C94FF9977E223EDC201FA3"><enum>10.</enum><header>Termination of
			 authority</header><text display-inline="no-display-inline">The authority of the
			 Secretary to provide assistance under this Act terminates on the date that is
			 15 years after the date of enactment of this Act.</text>
