<subsection id="H777B84CA58E648C29BF2D7E7AF9D780"><enum>(a)</enum><header>Allocation of funds</header><text display-inline="yes-display-inline">Section 203(f) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133(f)</external-xref>) is amended to read as follows:</text>

<subsection id="H39A6930E01AA4D00B47742CEDFA55"><enum>(f)</enum><header>Allocation of funds</header> 
<paragraph id="HEBDCC426550D4F3A90DEB82F2004CEC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall award financial assistance under this section on a competitive basis and in accordance with the criteria in subsection (g).</text></paragraph> 
<paragraph id="HA6DA42B693BA49529EF871C8A2B40071"><enum>(2)</enum><header>Minimum and maximum amounts</header><text>In providing financial assistance under this section, the President shall ensure that the amount of financial assistance made available to a State (including amounts made available to local governments of the State) for a fiscal year—</text> 
<subparagraph id="H29AC5638A5B243F4A1BE4E8DE74B8AD"><enum>(A)</enum><text>is not less than the lesser of—</text> 
<clause id="H9EE831C594E54CC3A9C855A965006EBA"><enum>(i)</enum><text>$575,000; or</text></clause> 
<clause id="H87D62A6D6FDA4507A57899F443DE0000"><enum>(ii)</enum><text>the amount that is equal to one percent of the total funds appropriated to carry out this section for the fiscal year; and</text></clause></subparagraph> 
<subparagraph id="H92438BEC648E4D818465E6E83287F68"><enum>(B)</enum><text>does not exceed the amount that is equal to 15 percent of the total funds appropriated to carry out this section for the fiscal year.</text> </subparagraph></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H8DCE9EE0D4C0492D96DD6EB830B603A5"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 203(m) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133(m)</external-xref>) is amended to read as follows:</text>

<section id="HC8565A2603584EDEBF00BF60D800156F" display-inline="no-display-inline" section-type="subsequent-section"><enum>102.</enum><header>Integrated public alert and warning system modernization</header> 
<subsection id="HD5480D693733455EBBDA201131A4916B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5132">42 U.S.C. 5132</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HE6ACEBB2D28D4F60993E8CD7961FBDAD"><enum>(e)</enum><header>Integrated public alert and warning system modernization</header> 
<paragraph id="HDB5EB739A6434F328636CEFF932FF641"><enum>(1)</enum><header>In general</header><text>To provide timely and effective disaster warnings under this section, the President, acting through the Administrator of the Federal Emergency Management Agency, shall—</text> 
<subparagraph id="H31DA2EB48678439ABA8DABAD7703794"><enum>(A)</enum><text display-inline="yes-display-inline">modernize the integrated public alert and warning system of the United States (in this section referred to as the <quote>public alert and warning system</quote>) to ensure that the President under all conditions can alert and warn governmental authorities and the civilian population in areas endangered by disasters; and</text></subparagraph> 
<subparagraph id="HBA370D5B09B64FADA6F15283E0430648"><enum>(B)</enum><text>implement the public alert and warning system.</text></subparagraph></paragraph> 
<paragraph id="H8CE702911644472DBC00BE4E29DDD8"><enum>(2)</enum><header>Implementation requirements</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Administrator shall, consistent with the recommendations in the final report of the Integrated Public Alert and Warning System Advisory Committee—</text> 
<subparagraph id="HC0B01A36D5A541ADA6833583CAF6EAD9"><enum>(A)</enum><text>establish or adopt, as appropriate, common alerting and warning protocols, standards, terminology, and operating procedures for the public alert and warning system;</text></subparagraph> 
<subparagraph id="HC9363C60E96F43B58C3721AAC43F4F31"><enum>(B)</enum><text>include in the public alert and warning system the capability to adapt the distribution and content of communications on the basis of geographic location, risks, or personal user preferences, as appropriate;</text></subparagraph> 
<subparagraph id="H3F2E5D15235C414EBE832678CAFA2C36"><enum>(C)</enum><text>include in the public alert and warning system the capability to alert and warn individuals with disabilities and individuals with limited English proficiency; and</text></subparagraph> 
<subparagraph id="H220E0D2DFE8640DD9CD3F9494E5B20F9"><enum>(D)</enum><text>ensure the conduct of training, tests, and exercises for the public alert and warning system.</text></subparagraph></paragraph> 
<paragraph id="H1FE16BEDEB834FD08026EEEC521D811B"><enum>(3)</enum><header>System requirements</header><text>The public alert and warning system shall—</text> 
<subparagraph id="HAC58E72A4BEE4126950000C5DC5812E8"><enum>(A)</enum><text>incorporate multiple communications technologies;</text></subparagraph> 
<subparagraph id="H1776F8D1A7AC46FA819885BFD1B61904"><enum>(B)</enum><text>be designed to adapt to, and incorporate, future technologies for communicating directly with the public;</text></subparagraph> 
<subparagraph id="H9B96CD52B6034124BA09F8C93A472D"><enum>(C)</enum><text>be designed to provide alerts to the largest portion of the affected population feasible, including nonresident visitors and tourists, and improve the ability of remote areas to receive alerts;</text></subparagraph> 
<subparagraph id="H87764EBA365C414FAF77D1B6ADE03D1"><enum>(D)</enum><text>promote local and regional public and private partnerships to enhance community preparedness and response; and</text></subparagraph> 
<subparagraph id="HB2A81735986443F7A52E8F45E12C68CB"><enum>(E)</enum><text>provide redundant alert mechanisms where practicable so as to reach the greatest number of people regardless of whether they have access to, or utilize, any specific medium of communication or any particular device.</text></subparagraph></paragraph> 
<paragraph id="H308A2AE578164943ACCF7FBC923D9539"><enum>(4)</enum><header>Pilot programs</header> 
<subparagraph id="HD1E54F2E154446D39874707C71BFBC4E"><enum>(A)</enum><header>In general</header><text>The Administrator may conduct pilot programs for the purpose of demonstrating the feasibility of using a variety of methods for achieving the system requirements specified in paragraph (3).</text></subparagraph> 
<subparagraph id="H57B7EA928C1D43AEAA9D5F70ED3F4891"><enum>(B)</enum><header>Report</header><text>Not later than 6 months after the date of enactment of this subsection, and annually thereafter for the duration of the pilot programs, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report containing—</text> 
<clause id="H78472CE0F3C84A5F8600FFDF615757B7"><enum>(i)</enum><text>a description and assessment of the effectiveness of the pilot programs;</text></clause> 
<clause id="H0958D027404A4011B8F7F9BBA6E21B66"><enum>(ii)</enum><text>any recommendations of the Administrator for additional authority to continue the pilot programs or make any of the programs permanent; and</text></clause> 
<clause id="H34F7E5B9DCBA4D9EA7761B9B0065DED"><enum>(iii)</enum><text>any other findings and conclusions of the Administrator with respect to the pilot programs.</text></clause></subparagraph></paragraph> 
<paragraph id="H9A49EE9CF1744E3F9D9B9E664600077F"><enum>(5)</enum><header>Implementation plan</header><text display-inline="yes-display-inline">Not later than 6 months after the date of submission of the final report of the Integrated Public Alert and Warning System Advisory Committee, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a detailed plan for implementing this subsection. The plan shall include a timeline for implementation, a spending plan, and recommendations for any additional authority that may be necessary to fully implement this subsection.</text></paragraph> 
<paragraph id="H454C03A080B0497891D35C9C121028DB"><enum>(6)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $37,000,000 for fiscal year 2009 and such sums as may be necessary for each fiscal year thereafter.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1676E869BFAB4F6A969F9D07BB84E3E3"><enum>(b)</enum><header>Integrated public alert and warning system modernization advisory committee</header> 
<paragraph id="HB24439E34E5A49D8B2129590FEBAE2E3"><enum>(1)</enum><header>Establishment</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency shall establish an advisory committee to be known as the Integrated Public Alert and Warning System Advisory Committee (in this subsection referred to as the <quote>Advisory Committee</quote>).</text></paragraph> 
<paragraph id="H7F19916AC8874384ADAEE8031BE6779"><enum>(2)</enum><header>Membership</header><text display-inline="yes-display-inline">The Advisory Committee shall be composed of the following members, to be appointed by the Administrator as soon as practicable after the date of enactment of this Act—</text> 
<subparagraph id="H092049E276714016AF12B08915B037F"><enum>(A)</enum><text display-inline="yes-display-inline">The Chairman of the Federal Communications Commission (or the Chairman’s designee).</text></subparagraph> 
<subparagraph id="HD72024A9E31A4FD8A00094AA93AB55D"><enum>(B)</enum><text>The Administrator of the National Oceanic and Atmospheric Administration of the Department of Commerce (or the Administrator’s designee).</text></subparagraph> 
<subparagraph id="HECAB8C84C6D149E98BF4B457D83519E5"><enum>(C)</enum><text>The Assistant Secretary for Communications and Information of the Department of Commerce (or the Assistant Secretary’s designee).</text></subparagraph> 
<subparagraph id="H871D4BA2A154416FBD8289FBDB332566"><enum>(D)</enum><text>Representatives of State and local governments, representatives of emergency management agencies, and representatives of emergency response providers, selected from among individuals nominated by national organizations representing governments and personnel.</text></subparagraph> 
<subparagraph id="HDAC4AA5C114C40E4B0F21C40847710F1"><enum>(E)</enum><text>Representatives from federally recognized Indian tribes and national Indian organizations.</text></subparagraph> 
<subparagraph id="H8963380411B448199DAA272674AAE435"><enum>(F)</enum><text>Individuals who have the requisite technical knowledge and expertise to serve on the Advisory Committee, including representatives of—</text> 
<clause id="HB15B0484B5C24EB090E7EDC4EC91ABD"><enum>(i)</enum><text>communications service providers;</text></clause> 
<clause id="HD39C6D2D97D941C19BF99757B18D7C4"><enum>(ii)</enum><text>vendors, developers, and manufacturers of systems, facilities, equipment, and capabilities for the provision of communications services;</text></clause> 
<clause id="H8E5064C33ECF4CB9B2A9D178F15FCAA"><enum>(iii)</enum><text>third-party service bureaus;</text></clause> 
<clause id="HDFA66D689BE84D33B6C6484880093166"><enum>(iv)</enum><text>the broadcasting industry;</text></clause> 
<clause id="H10CE4C41E0EF43C5B891316FA8F6AFA8"><enum>(v)</enum><text>the national organization representing the licensees and permittees of noncommercial broadcast television stations;</text></clause> 
<clause id="H204A37E6524A4C87976CE67692704EEB"><enum>(vi)</enum><text>the cellular industry;</text></clause> 
<clause id="HBE94ED4779944087BF0093575D8E0059"><enum>(vii)</enum><text>the cable industry;</text></clause> 
<clause id="H3F972176A6BB41F4AA43099FF80059D0"><enum>(viii)</enum><text>the satellite industry; and</text></clause> 
<clause id="HD1055C8431B248ED96BFE6CAADBF8BAF"><enum>(ix)</enum><text>national organizations representing individuals with special needs, including individuals with disabilities and the elderly.</text></clause> </subparagraph> 
<subparagraph id="HB14D93B9E3174B5DAA3760377E1CCF00"><enum>(G)</enum><text>Qualified representatives of such other stakeholders and interested and affected parties as the Administrator considers appropriate.</text></subparagraph></paragraph> 
<paragraph id="HC36ED0EC6E6E4CB6B43957D7FCAB011"><enum>(3)</enum><header>Chairperson</header><text>The Administrator (or the Administrator’s designee) shall serve as the Chairperson of the Advisory Committee.</text></paragraph> 
<paragraph id="H23B63C8A25E34FC982984FD54F4178"><enum>(4)</enum><header>Meetings</header> 
<subparagraph id="HBAE5DDF7CB5142F59545522946BB10E9"><enum>(A)</enum><header>Initial meeting</header><text>The initial meeting of the Advisory Committee shall take place not later than 60 days after the date of enactment of this Act.</text></subparagraph> 
<subparagraph id="H21B4F46CD1014B539DEE0B8D875ECC6"><enum>(B)</enum><header>Other meetings</header><text>After the initial meeting, the Advisory Committee shall meet at the call of the Chairperson.</text></subparagraph> 
<subparagraph id="HCA3E32B1853F4523BF07B20302D87156"><enum>(C)</enum><header>Notice; open meetings</header><text>Meetings held by the Advisory Committee shall be duly noticed at least 14 days in advance and shall be open to the public.</text></subparagraph></paragraph> 
<paragraph id="H6D9F78D0C29D442CBF56F2E3CDB475A6"><enum>(5)</enum><header>Rules</header> 
<subparagraph id="H06D40E55EA5542D8909C63D2F5B8F82F"><enum>(A)</enum><header>Quorum</header><text>One-third of the members of the Advisory Committee shall constitute a quorum for conducting business of the Advisory Committee.</text></subparagraph> 
<subparagraph id="H1ACCEE851E424810BA141B34155B5E31"><enum>(B)</enum><header>Subcommittees</header><text>To assist the Advisory Committee in carrying out its functions, the Chairperson may establish appropriate subcommittees composed of members of the Advisory Committee and other subject matter experts as the Chairperson considers necessary.</text></subparagraph> 
<subparagraph id="HF0F7D55815B0463488CE7B596D5B859E"><enum>(C)</enum><header>Additional rules</header><text>The Advisory Committee may adopt such other rules as are necessary to carry out its duties.</text></subparagraph></paragraph> 
<paragraph id="HC1D19AF3120D48508E6BEC378420E1D9"><enum>(6)</enum><header>Recommendations</header><text>The Advisory Committee shall develop and submit in its final report recommendations for an integrated public alert and warning system, including—</text> 
<subparagraph id="HBF89146004494CE19B721F4CBCE63BB"><enum>(A)</enum><text>recommendations for common alerting and warning protocols, standards, terminology, and operating procedures for the public alert and warning system;</text></subparagraph> 
<subparagraph id="HC17B98219EF04D2CA6731710A73FFB01"><enum>(B)</enum><text>recommendations to provide for a public alert and warning system that—</text> 
<clause id="H22DF8D98EE0544999F32BBA76F3FAA73"><enum>(i)</enum><text>has the capability to adapt the distribution and content of communications on the basis of geographic location, risks, or personal user preferences, as appropriate;</text></clause> 
<clause id="H218E193EC48E4587AAE5722217125F6"><enum>(ii)</enum><text>has the capability to alert and warn individuals with disabilities and individuals with limited English proficiency;</text></clause> 
<clause id="H96CA6D5EADFA47E0BBEF9C79D28212D"><enum>(iii)</enum><text>incorporates multiple communications technologies;</text></clause> 
<clause id="H169F526B34084F95BE17F0C667B1451B"><enum>(iv)</enum><text>is designed to adapt to, and incorporate, future technologies for communicating directly with the public;</text></clause> 
<clause id="H04370D7246C24D7197A632B3A43F1189"><enum>(v)</enum><text display-inline="yes-display-inline">is designed to provide alerts to the largest portion of the affected population feasible, including nonresident visitors and tourists, and improve the ability of remote areas to receive alerts;</text></clause> 
<clause id="HA8B997B0329447ABB991ADE9F79F13E0"><enum>(vi)</enum><text>promotes local and regional public and private partnerships to enhance community preparedness and response; and</text></clause> 
<clause id="H084B7547131F4581B500A99D8031A1B0"><enum>(vii)</enum><text>provides redundant alert mechanisms where practicable so as to reach the greatest number of people regardless of whether they have access to, or utilize, any specific medium of communication or any particular device. </text></clause></subparagraph> </paragraph> 
<paragraph id="H6F561272AD8F48AFA7BDD7669D88364E"><enum>(7)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, the Advisory Committee shall submit to the Administrator, the Committee on Transportation and Infrastructure of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs of the Senate a report containing the recommendations of the Advisory Committee.</text></paragraph> 
<paragraph id="H88C523FD1A834AB1A5FA8F20A7F2D2EC"><enum>(8)</enum><header>Federal Advisory Committee Act</header><text>Neither the Federal Advisory Committee Act (5 U.S.C. App.) nor any rule, order, or regulation promulgated under that Act shall apply to the Advisory Committee.</text></paragraph> 
<paragraph id="H3AD7998641D840F1B1A1224F63DC9271"><enum>(9)</enum><header>Termination</header><text>The Advisory Committee shall terminate not later than 60 days following the submission of its final report.</text></paragraph></subsection> 
<subsection id="HA0593DB4B65F48BDB62F16D5D946D94"><enum>(c)</enum><header>Technical correction</header><text display-inline="yes-display-inline">Section 202(c) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5132">42 U.S.C. 5132(c)</external-xref>) is amended by striking <quote>section 611(c)</quote> and inserting <quote>section 611(d)</quote>.</text></subsection> 
<subsection id="HDD6C1F8AC44F4FF7AD294E4FFF57FB"><enum>(d)</enum><header>Limitation on statutory construction</header><text display-inline="yes-display-inline">Nothing in this section (including the amendment made by this section) shall be construed to affect the authority of the Department of Commerce or the Federal Communications Commission.</text></subsection></section> 
<section id="H76786113D0B34B1DBF8EE5D6D4C0A74E"><enum>103.</enum><header>Health benefits for temporary employees</header><text display-inline="no-display-inline">Section 306 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5149">42 U.S.C. 5149</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H95AEDAED65C14833BC6C9EBE1B744576" commented="no"><enum>(1)</enum><header>In general</header><text>Notwithstanding any provision of title 5, United States Code, or related regulations limiting or prohibiting the provision of health benefits for temporary or intermittent employees, personnel appointed under subsection (b)(1) shall be eligible to enroll in the Federal Employees Health Benefits plan or any successor health benefits plan approved and administered by the Office of Personnel Management under terms and conditions set by the agency appointing the temporary personnel.</text></paragraph> 
<paragraph id="H4178EC8140A14B5EAB1331D94D7CD7AF" commented="no"><enum>(2)</enum><header>Annual report</header><text>Not later than one year after the date of enactment of this subsection, and annually thereafter, the President shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the implementation of this subsection. </text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H11032398F03740ABBDA62E853805A2A2" section-type="subsequent-section" display-inline="no-display-inline"><enum>104.</enum><header>Disposal of excess property to assist other disaster victims</header> 
<subsection id="HA5D4B58E25334F828CE584C109B16C6"><enum>(a)</enum><header>Disposal of excess materials, supplies, and equipment</header><text display-inline="yes-display-inline">Title III of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5141">42 U.S.C. 5141 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H3EEAB8129A1B4235BFAFB178003BCBC9" display-inline="no-display-inline"> 
<section id="H0485E58DBFAC46C1AD0576296D84B709"><enum>327.</enum><header>Disposal of excess materials, supplies, and equipment</header> 
<subsection id="H3C82B06E7B004ACCB802AB80D1C99A7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if the President determines that materials, supplies, or equipment acquired by the President pursuant to title IV or V for response or recovery efforts in connection with a major disaster or emergency are in excess of the amount needed for those efforts, the President may transfer the excess materials, supplies, or equipment, by sale, at a price that is fair and equitable, directly to a State, local government, or relief or disaster assistance organization for the purpose of—</text> 
<paragraph id="H530946CFC25E4EAB8BC129FA972E6171"><enum>(1)</enum><text>assisting disaster victims in other major disasters and emergencies; and</text></paragraph> 
<paragraph id="H6ABFB4AEB3CF405E91FEA6C2B1EA69B7"><enum>(2)</enum><text>assisting victims in incidents caused by a hazard that do not result in a declaration of a major disaster or emergency if—</text> 
<subparagraph id="H395CA5E7A9AA4D4B9F936DC291EF1AD"><enum>(A)</enum><text>the Governor of the affected State certifies that—</text> 
<clause id="HACDBF2E79DD74734A692AE4300D9B31D"><enum>(i)</enum><text>there is an urgent need for the materials, supplies, or equipment; and</text></clause> 
<clause id="HA0CE93F31A8B4D9EB6387E2048A844BE"><enum>(ii)</enum><text>the State is unable to provide the materials, supplies, or equipment in a timely manner; and</text></clause></subparagraph> 
<subparagraph id="H928AC49F9AB64A3AB0FEFCCCA2971965"><enum>(B)</enum><text>the President determines that the materials, supplies, or equipment are not readily available from commercial sources, except that this subparagraph shall not apply in the case of a transfer of perishable supplies.</text></subparagraph></paragraph></subsection> 
<subsection id="H77424BD4B5A04FC3A16EA4A3A9C72CCE"><enum>(b)</enum><header>Deposit of proceeds</header><text>Notwithstanding any other provision of law, any proceeds received under subsection (a) shall be deposited in the appropriate Disaster Relief Fund account.</text></subsection> 
<subsection id="HEFDB1DD7813F4AF49DE5972B5E42BC58"><enum>(c)</enum><header>Hazard defined</header><text>In this section, the term <term>hazard</term> has the meaning given that term by section 602.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF3E5602F190640F5A1C8A2D35F4528D6" display-inline="no-display-inline" commented="no"><enum>(b)</enum><header>Disposal of temporary housing units</header> 
<paragraph id="HC5CAB89F3FCA45A7002F73E863C08099" commented="no"><enum>(1)</enum><header>Disposal</header><text display-inline="yes-display-inline">Section 408(d)(2)(B)(ii) of the Robert T. <paragraph id="H1C9F17BC28F0402C943FD8DC70A9B9CE" commented="no"><enum>(2)</enum><header>Limitation</header><text>Section 408(d)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(d)(2)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H23A4F641310947C2B7F6B9F8CAAB563" commented="no"><enum>(3)</enum><header>Special rule</header><text>In the case of an unused temporary housing unit described in section 689k of the Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/295">Public Law 109–295</external-xref>; 120 Stat. 1456), the President may dispose of the unit in accordance with the requirements of that section or in accordance with section 408(d)(2)(B)(ii) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(d)(2)(B)(ii)</external-xref>), as amended by this section.</text></paragraph></subsection></section> 
<section id="H867EBF4EED1146079748BA277C66BEB1"><enum>105.</enum><header>National Urban Search and Rescue Response System</header> 
<subsection id="HFAA07743594E40549B4E8EE599E548F4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5141">42 U.S.C. 5141 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H1D1665D44B994F5B9E528800261844A9"><enum>328.</enum><header>National Urban Search and Rescue Response System</header> 
<subsection id="H94790FDE2E314677881E772C00F2CE91"><enum>(a)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="H7C2C88A743CF45668C32EB00F6C5F25"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text> </paragraph> 
<paragraph id="H1E8DFAD55AF8412AA82DBF22A8C3C790"><enum>(2)</enum><header>Agency</header><text>The term <term>Agency</term> means the Federal Emergency Management Agency.</text> </paragraph> 
<paragraph id="H11443F62B8124DFA8C6DD864513C86A8"><enum>(3)</enum><header>Hazard</header><text>The term <term>hazard</term> has the meaning given that term by section 602.</text></paragraph> 
<paragraph id="H717AD31A9C4F4A1495F957D3E0D6C569"><enum>(4)</enum><header>Non-employee System member</header><text display-inline="yes-display-inline">The term ‘non-employee System member’ means a System member not employed by a sponsoring agency or participating agency.</text> </paragraph> 
<paragraph id="HC22F95D2E9F04C99AD254FE82DD9E63D"><enum>(5)</enum><header>Participating agency</header><text display-inline="yes-display-inline">The term <term>participating agency</term> means a State or local government, nonprofit organization, or private organization that has executed an agreement with a sponsoring agency to participate in the System.</text> </paragraph> 
<paragraph id="H78757F3FBD6F4F1992EF22BC08001C8D"><enum>(6)</enum><header>Sponsoring agency</header><text>The term <term>sponsoring agency</term> means a State or local government that is the sponsor of a task force designated by the Administrator to participate in the System.</text> </paragraph> 
<paragraph id="H3D3106E13CFF449FAA0050B300087562"><enum>(7)</enum><header>System</header><text display-inline="yes-display-inline">The term <term>System</term> means the National Urban Search and Rescue Response System to be administered under this section.</text> </paragraph> 
<paragraph id="H4630B618C6F148AEA0364D018B097219"><enum>(8)</enum><header>System member</header><text>The term <term>System member</term> means an individual who is not a full-time employee of the Federal Government, who serves on a task force or on a System management or other technical team.</text> </paragraph> 
<paragraph id="HD956196C3F6744A68B82A059C0AF00B4"><enum>(9)</enum><header>Task force</header><text>The term <term>task force</term> means an urban search and rescue team designated by the Administrator to participate in the System.</text> </paragraph></subsection> 
<subsection id="HD5B63B94BF994B6093FB69D3F1F5E141"><enum>(b)</enum><header>General authority</header><text>Subject to the requirements of this section, the Administrator shall continue to administer the emergency response system known as the <quote>National Urban Search and Rescue Response System</quote>.</text> </subsection> 
<subsection id="HF7BB4BCE11644EBC9E1DEF62FD55C343"><enum>(c)</enum><header>Functions</header><text>In administering the System, the Administrator shall provide for a national network of standardized search and rescue resources to assist States and local governments in responding to hazards.</text> </subsection> 
<subsection id="H7E5332B20BC8440487A31FD4C54FBC9"><enum>(d)</enum><header>Task forces</header> 
<paragraph id="H00B16937C75A4F7E85B6027FEF60305C"><enum>(1)</enum><header>Designation</header><text>The Administrator shall designate task forces to participate in the System. The Administrator shall determine the criteria for such participation.</text> </paragraph> 
<paragraph id="HFC1E72722B9E44FA9EC345188B8E0083"><enum>(2)</enum><header>Sponsoring agencies</header><text>Each task force shall have a sponsoring agency. The Administrator shall enter into an agreement with the sponsoring agency of each task force with respect to the participation of the task force in the System.</text> </paragraph> 
<paragraph id="H969DEF7AB99646E8B08375C05B043B79"><enum>(3)</enum><header>Composition</header> 
<subparagraph id="H0AA398D4958847B7BBCB0003C39B5243"><enum>(A)</enum><header>Participating agencies</header><text>A task force may include, at the discretion of the sponsoring agency of the task force, one or more participating agencies. The sponsoring agency of a task force shall enter into an agreement with each participating agency of the task force with respect to the participation of the participating agency on the task force.</text> </subparagraph> 
<subparagraph id="H9124E4F9DCC74FE8BBCE8E1BF6A06982"><enum>(B)</enum><header>Other individuals</header><text display-inline="yes-display-inline">A task force may also include, at the discretion of the sponsoring agency of the task force, other individuals not otherwise associated with the sponsoring agency or a participating agency of the task force. The sponsoring agency of a task force may enter into a separate agreement with each such individual with respect to the participation of the individual on the task force.</text> </subparagraph></paragraph></subsection> 
<subsection id="H43B0958BEAF44E4994D3C68B5100A299"><enum>(e)</enum><header>Management and technical teams</header><text>The Administrator shall maintain such management teams and other technical teams as the Administrator determines are necessary to administer the System.</text> </subsection> 
<subsection id="HE766EE8A6EEE48D8B9C4D1ED66244460"><enum>(f)</enum><header>Appointment of system members into Federal service</header> 
<paragraph id="H7D8376B95DCA4F4FA0A46B1ED6539980"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may appoint a System member into Federal service for a period of service to provide for the participation of the System member in exercises, preincident staging, major disaster and emergency response activities, and training events sponsored or sanctioned by the Administrator.</text> </paragraph> 
<paragraph id="HF1BD12B9AC624393A088791BCD5487A"><enum>(2)</enum><header>Nonapplicability of certain civil service laws</header><text>The Administrator may make appointments under paragraph (1) without regard to the provisions of title 5, United States Code, governing appointments in the competitive service.</text> </paragraph> 
<paragraph id="HD0C37422B72343F0B7DC32D3F2281D93"><enum>(3)</enum><header>Relationship to other authorities</header><text>The authority of the Administrator to make appointments under this subsection shall not affect any other authority of the Administrator under this Act.</text> </paragraph> 
<paragraph id="H04D758F40CED4490B876295BAD146D1B"><enum>(4)</enum><header>Limitation</header><text display-inline="yes-display-inline">A System member who is appointed into Federal service under paragraph (1) shall not be deemed an employee of the United States for purposes other than those specifically set forth in this section.</text> </paragraph></subsection> 
<subsection commented="no" id="H4094E989686945899522B647C9865F9D"><enum>(g)</enum><header>Compensation</header> 
<paragraph commented="no" id="H57BE128591D341839129A1A6C2FB0431"><enum>(1)</enum><header>Pay of System members</header><text display-inline="yes-display-inline">Subject to such terms and conditions as the Administrator may impose by regulation, the Administrator shall make payments to the sponsoring agency of a task force—</text> 
<subparagraph id="H6B4892CD1C514F54A0538D44B418C4C7"><enum>(A)</enum><text>to reimburse each employer of a System member on the task force for compensation paid by the employer to the System member for any period during which the System member is appointed into Federal service under subsection (f)(1); and</text> </subparagraph> 
<subparagraph id="H4CFCF53B9B5349E9AC7E7006CED9011B" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">to make payments directly to a non-employee System member on the task force for any period during which the non-employee System member is appointed into Federal service under subsection (f)(1).</text> </subparagraph></paragraph> 
<paragraph commented="no" id="HFE673D73D64646EBAA8C8C00FDE423F8"><enum>(2)</enum><header>Reimbursement for employees filling positions of System members</header> 
<subparagraph id="H01DADDA063BC465BB8781CC4D7136C6E"><enum>(A)</enum><header>In general</header><text>Subject to such terms and conditions as the Administrator may impose by regulation, the Administrator shall make payments to the sponsoring agency of a task force to reimburse each employer of a System member on the task force for compensation paid by the employer to an employee filling a position normally filled by the System member for any period during which the System member is appointed into Federal service under subsection (f)(1).</text> </subparagraph> 
<subparagraph id="HDA0F615E58B04464BF1FE8A71BCDD2D"><enum>(B)</enum><header>Limitation</header><text>Costs incurred by an employer shall be eligible for reimbursement under subparagraph (A) only to the extent that the costs are in excess of the costs that would have been incurred by the employer had the System member not been appointed into Federal service under subsection (f)(1).</text> </subparagraph></paragraph> 
<paragraph commented="no" id="HF5455126396640A687D43BCFC01B68DB"><enum>(3)</enum><header>Method of payment</header><text display-inline="yes-display-inline">A System member shall not be entitled to pay directly from the Agency for a period during which the System member is appointed into Federal service under subsection (f)(1).</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="HF4B3DCD20DD64F6F869EBD171631B068"><enum>(h)</enum><header>Personal injury, illness, disability, or death</header> 
<paragraph id="H1E881BA2C39845B19C9DA500F500DC00"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A System member who is appointed into Federal service under subsection (f)(1) and who suffers personal injury, illness, disability, or death as a result of a personal injury sustained while acting in the scope of such appointment shall, for the purposes of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, be treated as though the member were an employee (as defined by section 8101 of that title) who had sustained the injury in the performance of duty.</text> </paragraph> 
<paragraph id="H1C54857426EC4DFCB7671786168B923D"><enum>(2)</enum><header>Election of benefits</header> 
<subparagraph id="H3F2FE8B1E56F4B239F255D4F02B50027"><enum>(A)</enum><header>In general</header><text>If a System member (or, in the case of the death of the System member, the System member’s dependent) is entitled—</text> 
<clause id="H294215C705204D2BA5D45C5C30945F8E"><enum>(i)</enum><text>under paragraph (1) to receive benefits under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, by reason of personal injury, illness, disability, or death, and</text> </clause> 
<clause id="HD9C1B7BFD5CB468D89532B6D052E6263"><enum>(ii)</enum><text>to receive benefits from a State or local government by reason of the same personal injury, illness, disability, or death,</text> </clause><continuation-text continuation-text-level="subparagraph">the System member or dependent shall elect to receive either the benefits referred to in clause (i) or (ii).</continuation-text></subparagraph> 
<subparagraph id="HEFCDE57DD1DC43138698D1E777CE7E97"><enum>(B)</enum><header>Deadline</header><text>A System member or dependent shall make an election of benefits under subparagraph (A) not later than one year after the date of the personal injury, illness, disability, or death that is the reason for the benefits or until such later date as the Secretary of Labor may allow for reasonable cause shown.</text> </subparagraph> 
<subparagraph id="H10047ECE8D53463BADD9A1AB88A701C"><enum>(C)</enum><header>Effect of election</header><text>An election of benefits made under this paragraph is irrevocable unless otherwise provided by law.</text> </subparagraph></paragraph> 
<paragraph id="H78291A9D402B471691EDDF44E7004FD1"><enum>(3)</enum><header>Reimbursement for State or local benefits</header><text display-inline="yes-display-inline">Subject to such terms and conditions as the Administrator may impose by regulation, in the event that a System member or dependent elects benefits from a State or local government under paragraph (2)(A), the Administrator shall reimburse the State or local government for the value of those benefits.</text> </paragraph></subsection> 
<subsection id="H6AF5DCE4B1EF4DD1891800F055231C7D"><enum>(i)</enum><header>Liability</header><text display-inline="yes-display-inline">A System member appointed into Federal service under subsection (f)(1), while acting within the scope of the appointment, is deemed an employee of the Government under <external-xref legal-doc="usc" parsable-cite="usc/28/1346">section 1346(b)</external-xref> of title 28, United States Code, and chapter 171 of that title, relating to tort claims procedure.</text> </subsection> 
<subsection id="HE0AE6F93BD0948DC8649925EE538B39"><enum>(j)</enum><header>Employment and reemployment rights</header><text display-inline="yes-display-inline">With respect to a System member who is not a regular full-time employee of a sponsoring agency or participating agency, the following terms and conditions apply:</text> 
<paragraph id="H63C713D8861A4C73BA985D2F2D00CD32"><enum>(1)</enum><text>Service as a System member shall be deemed <quote>service in the uniformed services</quote> for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38, United States Code, relating to employment and reemployment rights of individuals who have performed service in the uniformed services (regardless of whether the individual receives compensation for such participation). All rights and obligations of such persons and procedures for assistance, enforcement, and investigation shall be as provided for in such chapter.</text> </paragraph> 
<paragraph id="H2C6AB55E922141D28FA3B9C98B555449"><enum>(2)</enum><text>Preclusion of giving notice of service by necessity of appointment under this section shall be deemed preclusion by <quote>military necessity</quote> for purposes of <external-xref legal-doc="usc" parsable-cite="usc/38/4312">section 4312(b)</external-xref> of title 38, United States Code, pertaining to giving notice of absence from a position of employment. A determination of such necessity shall be made by the Administrator and shall not be subject to judicial review.</text> </paragraph></subsection> 
<subsection id="H11752ACC50EE4B9000E284DD4CAE5D4"><enum>(k)</enum><header>Licenses and permits</header><text display-inline="yes-display-inline">If a System member holds a valid license, certificate, or other permit issued by any State or other governmental jurisdiction evidencing the member’s qualifications in any professional, mechanical, or other skill or type of assistance required by the System, the System member shall be deemed to be performing a Federal activity when rendering aid involving such skill or assistance during a period of appointment into Federal service under subsection (f)(1).</text> </subsection> 
<subsection id="HEF382C964CB748C5950997A16B36ACB3"><enum>(l)</enum><header>Advisory committee</header> 
<paragraph id="HD1128902FBEB427A9EB523FD81B210ED"><enum>(1)</enum><header>In general</header><text>The Administrator shall establish and maintain an advisory committee to provide expert recommendations to the Administrator in order to assist the Administrator in administering the System.</text> </paragraph> 
<paragraph id="H9E7E13C8FDC1404E8580F6E4A02F9BAF"><enum>(2)</enum><header>Composition</header><text>The advisory committee shall be composed of members from geographically diverse areas, and shall include—</text> 
<subparagraph id="H57DAA0C2A52B4D2EA0830106C56294C9"><enum>(A)</enum><text>the chief officer or senior executive from at least 3 sponsoring agencies;</text> </subparagraph> 
<subparagraph id="H5CE4530A7390450180F0EC16EDA0AE41"><enum>(B)</enum><text>the senior emergency manager from at least 2 States that include sponsoring agencies; and</text> </subparagraph> 
<subparagraph id="H85A6DDFDBA7A4E2AABDED5264199CAC1"><enum>(C)</enum><text>at least one representative recommended by the leaders of the task forces.</text> </subparagraph></paragraph> 
<paragraph id="HAEEBD2A51B2A4C7EAF66182BC632D139"><enum>(3)</enum><header>Inapplicability of termination requirement</header><text>Section 14(a)(2) of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the advisory committee under this subsection.</text> </paragraph></subsection> 
<subsection id="HB000DFDA2B9F44EAB99D6D53226113B1"><enum>(m)</enum><header>Preparedness cooperative agreements</header> 
<paragraph id="H83E27BB24D0442AD8343E6DDC04D6F08"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations for such purpose, the Administrator shall enter into an annual preparedness cooperative agreement with each sponsoring agency. Amounts made available to a sponsoring agency under such a preparedness cooperative agreement shall be for the following purposes:</text> 
<subparagraph id="HB71464AA48464EF08500AD8FA258BD64"><enum>(A)</enum><text>Training and exercises, including training and exercises with other Federal, State, and local government response entities.</text> </subparagraph> 
<subparagraph id="HD0E9E9570BED4E0D00C738005987A5C4"><enum>(B)</enum><text>Acquisition and maintenance of equipment, including interoperable communications and personal protective equipment.</text> </subparagraph> 
<subparagraph id="H8E19C57A74A84851B50075C5D3A6F618"><enum>(C)</enum><text>Medical monitoring required for responder safety and health in anticipation of and following a major disaster, emergency, or other hazard, as determined by the Administrator.</text> </subparagraph></paragraph> 
<paragraph id="H52811537B9EA42B987FDA09358A8902B"><enum>(2)</enum><header>Availability of appropriations</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1552">section 1552(b)</external-xref> of title 31, United States Code, amounts made available for cooperative agreements under this subsection that are not expended shall be deposited in an Agency account and shall remain available for such agreements without fiscal year limitation.</text> </paragraph></subsection> 
<subsection id="HD0FB00FA7AA44C6C8C9E438B81858DEB"><enum>(n)</enum><header>Response cooperative agreements</header><text>The Administrator shall enter into a response cooperative agreement with each sponsoring agency, as appropriate, under which the Administrator agrees to reimburse the sponsoring agency for costs incurred by the sponsoring agency in responding to a major disaster or emergency.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HE3E62F3B51FC4FF79936F49101495FDC"><enum>(o)</enum><header>Obligations</header><text display-inline="yes-display-inline">The Administrator may incur all necessary obligations consistent with this section in order to ensure the effectiveness of the System.</text> </subsection> 
<subsection id="H56B94F120CCE424E00BAC8C0937752CC"><enum>(p)</enum><header>Authorization of appropriations</header> 
<paragraph id="HAA81CC0F6E3849188E31FE12AC003D23"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $52,000,000 for each of fiscal years 2009, 2010, and 2011. Such sums shall be in addition to amounts made available from the Disaster Relief Fund for response cooperative agreements entered into under subsection (n).</text> </paragraph> 
<paragraph id="HC90168EE38494948BF76F9B0A00000B9"><enum>(2)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">The Administrator may use not to exceed 6 percent of the funds appropriated for a fiscal year pursuant to paragraph (1) for salaries, expenses, and other administrative costs incurred by the Administrator in carrying out this section.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HF697BCA4EEF546A28F81123E605B9139"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H21F91BAB8F684A0DA100C30406DCC900"><enum>(1)</enum><header>Applicability of title 5, United States Code</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8101">Section 8101(1)</external-xref> of title 5, United States Code, is amended—</text> 
<subparagraph id="HB409BE50D4A94C79963D70D281BCBD1F"><enum>(A)</enum><text>in subparagraph (D) by striking “and” at the end;</text></subparagraph> 
<subparagraph id="H5EA73025C07341BFBD4015866E0041C9"><enum>(B)</enum><text>by moving subparagraph (F) to appear after subparagraph (E);</text></subparagraph>

<paragraph id="H0603DE263DD040EE0064BCA6C002EA3"><enum>(2)</enum><header>Inclusion as part of uniformed services for purposes of USERRA</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/4303">Section 4303</external-xref> of title 38, United States Code, is amended—</text> 
<subparagraph id="H866BA6DAA463474787ACF95BA300F5F8"><enum>(A)</enum><text>in paragraph (13) by inserting <quote>, a period for which a System member of the National Urban Search and Rescue Response System is absent from a position of employment due to an appointment into Federal service under section 328 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act</quote> before <quote>, and a period</quote>; and</text> </subparagraph> 
<subparagraph id="H379D064ABF804A5DBB4D9BEBA6D31C83"><enum>(B)</enum><text>in paragraph (16) by inserting after <quote>Public Health Service,</quote> the following: <quote>System members of the National Urban Search and Rescue Response System during a period of appointment into Federal service under section 328 of the Robert T. <section id="HAEF36C156E194D69A9F847D167733D05" section-type="subsequent-section" display-inline="no-display-inline"><enum>106.</enum><header>Disaster Relief Fund</header><text display-inline="no-display-inline">Title III of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5141">42 U.S.C. 5141 et seq.</external-xref>) is further amended by adding at the end the following:</text> 
<quoted-block id="H40134CD4C07749DB9722D06A477642E"> 
<section id="H521BD634A38B4062B1A02EC2B630F403"><enum>329.</enum><header>Disaster Relief Fund</header> 
<subsection id="HE0E3F628532E42C0BA00FACAAB00BD4D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is in the Treasury a fund known as the Disaster Relief Fund.</text></subsection> 
<subsection id="H05AA25F7E54E4D3591ACEA8924FBB450"><enum>(b)</enum><header>Deposits and credits</header><text>The Fund shall consist of amounts appropriated and credited to the Fund pursuant to this Act.</text> </subsection> 
<subsection id="H9E6BD77044A74D3893A703835402E05"><enum>(c)</enum><header>Eligible uses of fund</header><text>Amounts in the Fund shall be available to the President, as provided in advance in appropriations Acts—</text> 
<paragraph id="H29BAC4EE2D3A41A887D9894896E02CB1"><enum>(1)</enum><text>to provide assistance in response to a major disaster or emergency pursuant to titles IV and V; and</text></paragraph> 
<paragraph id="HE683EB90F373408490211406A851A51C"><enum>(2)</enum><text>for programs and activities of the Federal Emergency Management Agency that support the provision of such assistance, including programs and activities that are not readily attributable to a single major disaster or emergency.</text></paragraph></subsection> 
<subsection id="HEBCC9C6128A94E4DBA4878D0D2DC7FD8"><enum>(d)</enum><header>Support programs</header><text>The programs and activities referred to in subsection (c)(2) include the programs and activities authorized by sections 302, 303, and 306(b).</text></subsection> 
<subsection id="H90BAF1667409428CACA571AD88FC84B3"><enum>(e)</enum><header>Limitation</header><text>Amounts made available from the Fund for programs and activities referred to in subsection (c)(2) may not exceed $300,000,000 in any fiscal year.</text></subsection> 
<subsection id="HDCF75F53513C4F59AEB4EBA1225776C5"><enum>(f)</enum><header>Annual report</header><text>On or before the date on which the President submits the budget of the United States to the Congress under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31, United States Code, the President shall submit each year to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the uses of the Fund in the previous fiscal year.</text></subsection> 
<subsection id="H88DE3FFD284C4B6182F5C8FADF14D50"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Fund such sums as may be necessary. </text></subsection> 
<subsection id="HDD559DEEB9A646809E85238C8EDBFE34"><enum>(h)</enum><header>Availability of amounts</header><text>Amounts in the Fund shall remain available until expended.</text> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></section></title> 
<title id="H882063F74E4F4B2896C62BF364212C33"><enum>II</enum><header>Major disaster and emergency assistance programs</header> 
<section id="H25668AF422894D91A6B2AAA0A5AFE689"><enum>201.</enum><header><?xm-replace_text ?>Additional mitigation assistance</header> <text display-inline="no-display-inline">Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HEA987C097966452EA654EC29E5EC8E17" display-inline="no-display-inline"> 
<subsection id="HF650C60869CB4532A58B4FCA89841BB9"><enum>(d)</enum><header>Additional mitigation assistance</header> 
<paragraph id="H13D0B441D9264BD4A9E6B314AE7B4645"><enum>(1)</enum><header>In general</header><text>If, at the time of a declaration of a major disaster, the affected State has in effect and is actively enforcing throughout the State an approved State building code, the President may increase the maximum total of contributions under this section for the major disaster, as specified in subsection (a), by an amount equal to 4 percent of the estimated aggregate amount of grants to be made (less any associated administrative costs) under this Act with respect to the major disaster.</text></paragraph> 
<paragraph id="H66A1273DA4B94FFA8CFB0679808C64CB"><enum>(2)</enum><header>Submission</header><text>To be eligible for an increased Federal share under paragraph (1), a State, at least once every 6 years, shall submit its State building code to the President for approval.</text></paragraph> 
<paragraph id="H18C18BDD0257431E9361F4E24118D71"><enum>(3)</enum><header>Approval</header><text>The President shall approve a State building code submitted under paragraph (2) if the President determines that the building code—</text> 
<subparagraph id="HA88FC604F21D437799C56FEAD47F6465"><enum>(A)</enum><text>is consistent with the most recent version of a nationally recognized model building code;</text></subparagraph> 
<subparagraph id="HC452DE5808F44AA0B12C0029ED5FC05F"><enum>(B)</enum><text>has been adopted by the State within 6 years of the most recent version of the nationally recognized model building code; and </text></subparagraph> 
<subparagraph id="HBCF1D1A5F6C5404396B4A57BDF9CD2DA"><enum>(C)</enum><text>uses the nationally recognized model building code as a minimum standard.</text> </subparagraph></paragraph> 
<paragraph id="H1D58106D91BD46DF979B04BC6357004F"><enum>(4)</enum><header>Definitions</header><text>In this subsection, the following definitions apply:</text> 
<subparagraph id="HB480F1A334D34AF1927633DF81003FBF"><enum>(A)</enum><header>Actively enforcing</header><text>The term <quote>actively enforcing</quote> means effective jurisdictional execution of all phases of a State building code in the process of examination and approval of construction plans, specifications, and technical data and the inspection of new construction or renovation. </text></subparagraph> 
<subparagraph id="HF9B279DFF1B84F5398FA00193198324E"><enum>(B)</enum><header>Nationally recognized model building code</header><text display-inline="yes-display-inline">The term <quote>nationally recognized model building code</quote> means a building code for residential and commercial construction and construction materials that—</text> 
<clause id="H85289AB8A08946D6B2887089EC000697"><enum>(i)</enum><text>has been developed and published by a code organization in an open consensus type forum with input from national experts; and</text></clause> 
<clause id="H34DC8998B9044DA3865402B5A12BD7A0"><enum>(ii)</enum><text>is based on national structural design standards that establish minimum acceptable criteria for the design, construction, and maintenance of residential and commercial buildings for the purpose of protecting the health, safety, and general welfare of the building’s users against natural disasters.</text></clause></subparagraph> 
<subparagraph id="HBFEDC9352C7644589BDC25684F60D7CB"><enum>(C)</enum><header>State building code</header><text display-inline="yes-display-inline">The term <quote>State building code</quote> means requirements and associated standards for residential and commercial construction and construction materials that are implemented on a statewide basis by ordinance, resolution, law, housing or building code, or zoning ordinance. At a minimum, such requirements and associated standards shall apply—</text> 
<clause id="H0A64EFBE98F542AB8EBF53130CC4450"><enum>(i)</enum><text>to construction-related activities of residential building contractors applicable to single-family and 2-family residential structures; and</text></clause> 
<clause id="HF7AA39F930DB425DA34189EBF7500637"><enum>(ii)</enum><text>to construction-related activities of engineers, architects, designers, and commercial building contractors applicable to the structural safety, design, and construction of commercial, industrial, and multifamily structures.</text> </clause></subparagraph> </paragraph> 
<paragraph id="H427AFCBF80B2405BBE9B71B5CA10D8B9"><enum>(5)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this subsection, the President, acting through the Administrator of the Federal Emergency Management Agency, shall issue such regulations as may be necessary to carry out this subsection.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC6FE763EB8C24B4AACAE5B65811856CB"><enum>202.</enum><header>Temporary mortgage and rental payments</header><text display-inline="no-display-inline">Section 408(c) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(c)</external-xref>) is amended by adding at the end the following: </text> 
<quoted-block style="OLC" id="HB74860CF9D014B228D6FBCD3AED47E6E" display-inline="no-display-inline"> 
<paragraph id="HC36D113F284A488683DD5B527FFBC779"><enum>(5)</enum><header>Temporary mortgage and rental payments</header><text display-inline="yes-display-inline">The President may provide assistance on a temporary basis in the form of mortgage or rental payments to or on behalf of individuals and families who, as a result of financial hardship caused by a major disaster, are at imminent risk of dispossession or eviction from a residence by reason of foreclosure of any mortgage or lien, cancellation of any contract for sale, or termination of any lease, entered into prior to such disaster. Such assistance shall be provided for the duration of the period of financial hardship, but not to exceed 18 months of assistance or the maximum amount of assistance that is authorized to be provided pursuant to subsection (h).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8C6FEF3785A34C0E9EA9B6DFE6AECF7B" section-type="subsequent-section" display-inline="no-display-inline"><enum>203.</enum><header>Clarification of grant authority</header> 
<subsection id="H8E34A2A0F56548E1B81661E1D4A2A2B"><enum>(a)</enum><header>Section 418</header><text display-inline="yes-display-inline">Section 418 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5185">42 U.S.C. 5185</external-xref>) is amended—</text> 
<paragraph id="HB0B4233539494FC691F49507D368DEB"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before <quote>The President</quote>;</text> </paragraph>

<subsection id="HCAA4BE6D6E5A4B7BB0EF8638ED72F6B9" display-inline="no-display-inline"><enum>(b)</enum><header>Section 419</header><text>Section 419 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5186">42 U.S.C. 5186</external-xref>) is amended—</text> 
<paragraph id="H544F9D0DB8AF4C7C9398AAB926246B90"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before <quote>The President</quote>;</text></paragraph>

<section id="H0E7A4EF1DC304E7D8EF3CE77FE2ED836"><enum>204.</enum><header>Household pets and service animals</header> 
<subsection id="H02A3FECEB6A24CDC92A86F022083A53D"><enum>(a)</enum><header>Emergency assistance</header><text display-inline="yes-display-inline">Section 502(a) of Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5192">42 U.S.C. 5192(a)</external-xref>) is amended—</text> 
<paragraph id="H689D9DCBF1AD40E79999DA5503E27EF"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (7);</text></paragraph> 
<paragraph id="H425542C4984241C2A340007D46F200E7"><enum>(2)</enum><text>by striking the period at the end of paragraph (8) and inserting <quote>; and</quote>; and</text></paragraph>

<subparagraph id="HB24BE04FF866492EBFA70009B091C1C6"><enum>(B)</enum><text>to such pets and animals.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2203CF64CF7F44C687BAA66BA7A8AB00"><enum>(b)</enum><header>Technical corrections</header><text>Section 403(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b(a)(3)</external-xref>) is amended—</text>

<section id="H4214193B0A914D3C9EB75ED2DD3357C9" display-inline="no-display-inline" section-type="subsequent-section"><enum>205.</enum><header>Storage, sale, transfer, and disposal of housing units</header> 
<subsection id="HB9A7E4EBA0D54A4A81B15D264685FDE"><enum>(a)</enum><header>In general</header><text>Not later than 3 months after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency shall complete an assessment of the number of temporary housing units purchased by the Agency that the Administrator finds necessary to stock to respond to major disasters and emergencies under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) occurring after the date of enactment of this Act.</text> </subsection> 
<subsection id="H8933A5E22DB5420AA92566CB83379783"><enum>(b)</enum><header>Plan</header> 
<paragraph id="HB2ECF48C4888486591252B7B81E92C65"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of enactment of this Act, the Administrator shall establish a plan for—</text> 
<subparagraph id="H902FD80C17A047C19000D4A1B83F119E"><enum>(A)</enum><text>permanently storing the temporary housing units that the Administrator finds necessary to stock under subsection (a);</text> </subparagraph> 
<subparagraph id="H804E786D9AE64F72A44BF31F8BFE9FF3"><enum>(B)</enum><text>selling, transferring, or otherwise disposing of the temporary housing units that the Administrator finds are in excess of the number that the Administrator finds necessary to stock under subsection (a) and are in usable condition; and</text> </subparagraph> 
<subparagraph id="H32715BF9296345B69C63B51EDD81CC9B"><enum>(C)</enum><text>disposing of the temporary housing units that the Administrator finds are not in usable condition.</text> </subparagraph></paragraph> 
<paragraph id="H24AEC716B2B5476D8B86AF00BC9B005D"><enum>(2)</enum><header>Exception</header> 
<subparagraph id="HB99B8C694313422181DD307FB7CCBCC7"><enum>(A)</enum><header>In general</header><text>If the Administrator submits to Congress a written certification that the Administrator is unable to determine the safe level of exposure to formaldehyde for purposes of travel trailers, the Administrator may exclude from the plan established under paragraph (1) any travel trailer that the Administrator determines may contain formaldehyde.</text> </subparagraph> 
<subparagraph id="HB466DDE33F494AC6A14C962E77004C1E"><enum>(B)</enum><header>Duration</header><text>The authority to exclude travel trailers under this paragraph shall terminate on the date on which the Environmental Protection Agency or other appropriate department or agency promulgates regulations regarding exposure levels for formaldehyde that are applicable to travel trailers.</text> </subparagraph></paragraph> 
<paragraph id="H5908247441D2466B8F3E043F00705495"><enum>(3)</enum><header>Applicability of disposal requirements</header><text display-inline="yes-display-inline">The plan established under paragraph (1) shall be subject to—</text> 
<subparagraph id="H0E0B95D8BA8441F98C0081A2DEBF3800"><enum>(A)</enum><text>the requirements of section 408(d)(2) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(d)(2)</external-xref>), as amended by this Act;</text></subparagraph> 
<subparagraph id="H4ACC43BCB9A749A9B01573A487B812F0"><enum>(B)</enum><text>the special rule contained in section 103(b)(3) of this Act; and</text></subparagraph> 
<subparagraph id="H2B0E646571E244CF8F18A3A90918FBE3"><enum>(C)</enum><text>any other applicable provision of law.</text> </subparagraph></paragraph></subsection> 
<subsection id="H107709504ED24CC6952EF0DAB413D7E1"><enum>(c)</enum><header>Implementation</header><text>Not later than 9 months after the date of enactment of this Act, the Administrator shall implement the plan described in subsection (b).</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H49643893CFBA4180933B192996F8BADC"><enum>(d)</enum><header>Report</header><text>Not later than one year after the date of enactment of this Act, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the status of the distribution, sale, transfer, or other disposal of the unused temporary housing units purchased by the Agency.</text> </subsection></section></title> 
<title id="H0BA40BFEB0C74D8284C3D93F24BF9842"><enum>III</enum><header>Other matters</header> 
<section id="HE19CCFB188CD4634B05015F4C6004EF8"><enum>301.</enum><header>Community preparedness</header><text display-inline="no-display-inline">Subtitle A of title VI of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5196">42 U.S.C. 5196 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H630D4D21B0364EA2ADCA22D296CC3993" display-inline="no-display-inline"> 
<section id="H34A6A4BA6445415ABC52E88D197FAD"><enum>617.</enum><header>Community preparedness</header> 
<subsection id="H2AA8DCD1F80847208CE000C7E0CA4D8B"><enum>(a)</enum><header>Citizen Corps</header><text display-inline="yes-display-inline">The Administrator shall continue to administer the citizen preparedness program known as the <quote>Citizen Corps</quote>.</text></subsection> 
<subsection id="H6F3AEAED3238426D9542B8AFA79BAD8"><enum>(b)</enum><header>Activities</header><text>In carrying out the program, the Administrator may—</text> 
<paragraph id="H44B1134EEB0D459A92A4C6B9FFDC084F"><enum>(1)</enum><text>collaborate with community leaders to coordinate and leverage efforts to strengthen community involvement in preparedness, planning, mitigation, response, and recovery for hazards;</text></paragraph> 
<paragraph id="H1F8C7ACB344448FEBDDF5C00C5EDF300"><enum>(2)</enum><text>educate and train citizens in emergency preparedness and mitigation; and</text></paragraph> 
<paragraph id="H6C0CFDBF6AF349979F84E469014AE87"><enum>(3)</enum><text>train citizens in basic response skills, including fire safety, light search and rescue, and medical operations in preparation for hazards.</text></paragraph></subsection> 
<subsection id="HAF945C582C934869B09DEC289BACF9F"><enum>(c)</enum><header>Community emergency response team program</header><text>In carrying out the program, the Administrator shall continue to administer the Community Emergency Response Team Program.</text></subsection> 
<subsection id="H1B7C0BA012894547A57F498293D36C95"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section—</text> 
<paragraph id="H3956D67FC63746FCA39EC8FE114EF312"><enum>(1)</enum><text>$30,000,000 for fiscal year 2009;</text></paragraph> 
<paragraph id="H12FE13BB4E3A476CB721F2D561368BE4"><enum>(2)</enum><text>$35,000,000 for fiscal year 2010; and</text></paragraph> 
<paragraph id="H7734C832D81B4251A9004D09DE54D72E"><enum>(3)</enum><text>$40,000,000 for fiscal year 2011.</text></paragraph> </subsection> 
<subsection id="H5CB2A699645248BBB3D22E347EA5DAB"><enum>(e)</enum><header>Allocation of funds</header><text>Of the amounts appropriated to carry out this section for a fiscal year, not to exceed $2,000,000 may be used to carry out the Community Emergency Response Team Program.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H93372DC52C0A4F15B95D13BDBAA2FF7" section-type="subsequent-section" display-inline="no-display-inline"><enum>302.</enum><header>Emergency management assistance compact grants</header> 
<subsection id="HACBD7CBD19984CB1B196F72B8347EA58"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle A of title VI of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5196">42 U.S.C. 5196 et seq.</external-xref>) is further amended by adding at the end the following: </text>

<section id="H9EDD2F328822411DB486A5D1449221AD"><enum>618.</enum><header>Emergency management assistance compact grants</header><text display-inline="yes-display-inline"> </text> 
<subsection id="HB2B0D3195E8F4840B515D05100E5CA7C"><enum>(a)</enum><header>In general</header><text>The Administrator may make grants to provide for implementation of the Emergency Management Assistance Compact consented to by Congress in the joint resolution entitled <quote>Joint resolution granting the consent of Congress to the Emergency Management Assistance Compact</quote> (<external-xref legal-doc="public-law" parsable-cite="pl/104/321">Public Law 104–321</external-xref>; 110 Stat. 3877).</text></subsection> 
<subsection id="H5F10E8F2FA5F4B8EB417F0F3882FFC8F"><enum>(b) </enum><header>Eligible grant recipients</header><text>States and the Administrator of the Emergency Management Assistance Compact shall be eligible to receive grants under subsection (a).</text></subsection> 
<subsection id="HD9232E9F38184F37B304B5B43132F426"><enum>(c)</enum><header>Use of funds</header><text>A grant received under this section shall be used—</text> 
<paragraph id="H9168915EED6641B500473EA1953FBEE9"><enum>(1)</enum><text>to carry out recommendations identified in the Emergency Management Assistance Compact after-action reports for the 2004 and 2005 hurricane seasons;</text></paragraph> 
<paragraph id="H27DF4BC7E3FE43A39CF35C75E0F53973"><enum>(2)</enum><text>to administer compact operations on behalf of States, as such term is defined in the compact, that have enacted the compact;</text></paragraph> 
<paragraph id="HB52D8EF847CB47C3B513688B4373F24B"><enum>(3)</enum><text>to continue coordination with the Agency and appropriate Federal agencies;</text></paragraph> 
<paragraph id="H1DA44DE5000A411899907643005910FB"><enum>(4)</enum><text display-inline="yes-display-inline">to continue coordination with States and local governments and their respective national organizations; and</text></paragraph> 
<paragraph id="HD538933EDE5B4E04B369295DB080E972"><enum>(5)</enum><text>to assist State and local governments, emergency response providers, and organizations representing such providers with credentialing the providers and the typing of emergency response resources.</text></paragraph></subsection> 
<subsection id="H8942887B9B434DF583D55C66088C774D"><enum>(d)</enum><header>Coordination</header><text>The Administrator shall consult with the Administrator of the Emergency Management Assistance Compact to ensure effective coordination of efforts in responding to requests for assistance.</text></subsection> 
<subsection id="HD464F25AF35F4761B7077EA5FF6109FD"><enum>(e)</enum><header>Authorization of Appropriations</header><text>There is authorized to be appropriated to carry out this section $4,000,000 for each of fiscal years 2009, 2010, and 2011. Such sums shall remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H27A4CED0019343FA9FF35E908243397B"><enum>(b)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 661 of the Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/6/761">6 U.S.C. 761</external-xref>) is repealed.</text></subsection></section> 
<section id="H379EF0E0A9DB4C0AA516C97C31893B71" display-inline="no-display-inline" section-type="subsequent-section"><enum>303.</enum><header>Authority to accept and use gifts</header><text display-inline="no-display-inline">The first sentence of section 701(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5201">42 U.S.C. 5201(b)</external-xref>) is amended by inserting <quote>, through any means including grants,</quote> before <quote>bequests</quote>.</text></section> 
<section id="HA40A1F3D06704889995DD2BDCC30B82C" display-inline="no-display-inline" section-type="subsequent-section"><enum>304.</enum><header>Individual assistance factors</header><text display-inline="no-display-inline"> In order to provide more objective criteria for evaluating the need for assistance to individuals and to speed a declaration of a major disaster or emergency under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>), not later than one year after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency, in cooperation with representatives of State and local emergency management agencies, shall review, update, and revise through rulemaking the factors considered under <external-xref legal-doc="regulation" parsable-cite="cfr/44/206.48">section 206.48</external-xref> of title 44, Code of Federal Regulations, to measure the severity, magnitude, and impact of a disaster.</text></section> 
<section id="HAF2C2B10EC224F029FA0008D179C941"><enum>305.</enum><header>Technical corrections to references</header> <text display-inline="no-display-inline">The Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) is amended—</text> 
<paragraph id="H8B99412FD50E4E9C85A2EC048D7F9E"><enum>(1)</enum><text display-inline="yes-display-inline">in section 602(a) by striking paragraph (7) and inserting the following:</text>
