		  the interchange fee imposed on the sale of motor vehicle fuel, and for other

		<section id="H9E73490BA5014DE287BEF382F1ECC76" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Gas Pump Fair Payment Act of
			 2008</short-title></quote>.</text>
		</section><section id="H79AED31D77B54FA0973C0106B8C1B0D1"><enum>2.</enum><header>Limit
			 imposed</header>
			<subsection id="H0C347C9B46644D87A3F203B0D4F180F9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 2 of the
			 Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1631">15 U.S.C. 1631 et seq.</external-xref>) is amended by inserting after
			 section 127A the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HB35DBD6EE434437388283654A01BA7E3" style="USC">
					<section id="H6C4892829E9B475584B362F2E005571B"><enum>127B.</enum><header>Limit on
				certain interchange fees.</header>
						<subsection id="HBE3BA5CB70E540F4A2485EA1A264C9FF"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following
				definitions shall apply:</text>
							<paragraph commented="no" id="H698A355DC6E847C98E99DD7D0644AD72"><enum>(1)</enum><header>Charge
				card</header><text display-inline="yes-display-inline">The term charge card has
				the same meaning as in section 127(c)(4)(E).</text>
							</paragraph><paragraph id="H6D35A7BECEF449259B9149469D99E862"><enum>(2)</enum><header>Debit
				card</header><text display-inline="yes-display-inline">The term <quote>debit
				card</quote> means any card or other device issued by a financial institution
				(as defined in section 903(8)) to a consumer for use in initiating electronic
				fund transfers (as defined in section 903(6)) from the account of the consumer
				at such financial institution for the purpose of transferring money between
				accounts or obtaining money, property, labor, or services.</text>
							</paragraph><paragraph id="H34CA81AF957F43E294DCC6414D44A4C8"><enum>(3)</enum><header>Electronic
				payment system network</header><text display-inline="yes-display-inline">The
				term <quote>electronic payment system network</quote> means a network that
				provides, through licensed members, processors, or agents—</text>
								<subparagraph id="H1EEA7608D87F4A4C89D2647F2B28267D"><enum>(A)</enum><text>for the issuance
				of payment cards (by credit card issuers in the case of a credit card, charge
				card issuers in the case of a charge card, or financial institutions (as
				defined in section 903(8)) in the case of debit cards) bearing any logo of the
				network;</text>
								</subparagraph><subparagraph id="HE42AC20257EB421FB05092E23A49521"><enum>(B)</enum><text>the proprietary
				services and infrastructure that route information and data to facilitate
				transaction authorization, clearance, and settlement that merchants must access
				in order to accept payment cards bearing any logo of the network as payment for
				goods and services; and</text>
								</subparagraph><subparagraph id="H94355BD05EDF448E89B32714FEA455B6"><enum>(C)</enum><text display-inline="yes-display-inline">for the screening and acceptance of
				merchants into the network in order to allow such merchants to accept payment
				cards bearing any logo of the network as payment for goods and services.</text>
								</subparagraph></paragraph><paragraph id="HE30E319C26024AE1924EB400BF1407A1"><enum>(4)</enum><header>Licensed
				member</header><text>The term <quote>licenced member</quote>, in connection
				with any electronic payment system network, includes—</text>
								<subparagraph id="HCA5A241CD74349C98E39C65F38F8F349"><enum>(A)</enum><text>any creditor or
				charge card issuer that is authorized to issue credit cards or charge cards
				bearing any logo of the network;</text>
								</subparagraph><subparagraph id="HED69C54DEDF84BB9B564AF957008EA21"><enum>(B)</enum><text display-inline="yes-display-inline">any financial institution (as defined in
				section 903(8)) that is authorized to issue debit cards to consumers who
				maintain accounts at such institution; and</text>
								</subparagraph><subparagraph id="H8AE6EE4CCA42466DACF24DF6AA4CBD9"><enum>(C)</enum><text>any person,
				including any financial institution, on occasion referred to as an
				<quote>acquirer</quote> that is authorized—</text>
									<clause id="H72DCA97F96184DBC8EE6646E79A9282"><enum>(i)</enum><text>to
				screen and accept merchants into any program under which any payment card
				bearing any logo of such network may be accepted by the merchant for payment
				for goods or services;</text>
									</clause><clause id="H9F0C0B18F5D94B579F0070BEE002D5F"><enum>(ii)</enum><text>to
				process transactions on behalf of any such merchant for payment; and</text>
									</clause><clause id="HAA00725317194DBFA0BEBD28B4C07"><enum>(iii)</enum><text>to
				complete financial settlement of any such transaction on behalf of such
				merchant.</text>
									</clause></subparagraph></paragraph><paragraph id="H2297D9F0C49044EA931D946CBCF00472"><enum>(5)</enum><header>Merchant</header><text display-inline="yes-display-inline">The term <quote>merchant</quote> means any
				person in the business of selling or providing any good or service for
				consideration.</text>
							</paragraph><paragraph id="H258E85F5F7A9441F8387FF6521460351"><enum>(6)</enum><header>Payment
				card</header><text>The term <quote>payment card</quote> means a credit card , a
				charge card, or a debit card.</text>
							</paragraph></subsection><subsection id="H049A1963832B48EDBC47015CE571C55"><enum>(b)</enum><header>Excess charges
				prohibited in sales of motor vehicle fuel</header><text>An electronic payment
				system network may not, directly or through any agent, processor, or licensed
				member of the network, require or permit any merchant to pay any interchange,
				processing, or other fee in connection with any payment card transaction
				involving the purchase by a consumer of any motor vehicle fuel in any amount in
				excess of the amount that is equal to 1 percent of the cost of each gallon of
				such fuel.</text>
						</subsection><subsection id="HA8053439A2D64F719D04DFA379F49559"><enum>(c)</enum><header>Enforcement</header><text>Subsections
				(a), (b), and (h) of section 130 shall be applied for purposes of this section
				by substituting the term <quote>an electronic payment system network, or any
				agent, processor, or licensed member of any such network</quote> for
				<quote>creditor</quote> each place such term appears in such
				subsections.</text>
						</subsection><subsection id="HB8CA3D9AFFE6442182C6CFC556D13403"><enum>(d)</enum><header>Sunset</header><text display-inline="yes-display-inline">This section shall not apply to the sale of
				any motor vehicle fuel after the end of the 6-month period beginning on the
				date of the enactment of the Gas Pump Fair Payment Act of
				2008.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H60F589EA03364D0DB0ABD3B3A900E891"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for chapter 2 of the Truth in Lending Act is amended by inserting
			 after the item relating to section 127A the following new item:</text>
