		<section id="H03696923DBC04691B389CD2E1B43DD43" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Savings for the Uninsured on Rx
			 Expenses (SURE) Act of 2008</short-title></quote>.</text>
		</section><section id="H12D5C49E4B8E419084489F8284358E04"><enum>2.</enum><header>Drug discount
			 card program</header>
			<subsection id="H76F1991DF73542DDBD36C0E93EB7D36"><enum>(a)</enum><header>Establishment</header>
				<paragraph id="H1D2E043104924254B235B9E413508637"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall establish a program under this section to
			 endorse prescription drug discount card programs that meet the requirements of
			 this section in order to provide access to prescription drug discounts through
			 prescription drug card sponsors for eligible individuals throughout the United
			 States. The program is modeled on the medicare prescription drug discount card
			 program under section 1860D–31 of the Social Security Act, but without any
			 transitional assistance program as described in subsection (g) of such
			 section.</text>
				</paragraph><paragraph id="H8F3C9C7D039D4B18ABED67695FDA4E8"><enum>(2)</enum><header>Deadline</header><text>The
			 Secretary shall implement the program under this section so that discount cards
			 are first available by not later than 6 months after the date of the enactment
			 of this Act.</text>
				</paragraph><paragraph id="H75F44FE117A94667B37E1C4EE3DA1089"><enum>(3)</enum><header>Voluntary nature
			 of program</header><text display-inline="yes-display-inline">Nothing in this
			 section shall be construed as requiring an eligible individual to enroll in an
			 endorsed discount card program under this section.</text>
				</paragraph><paragraph commented="no" id="H2EA426AEC18C463BA3F8A20F22FD579"><enum>(4)</enum><header>Administration</header><text>The
			 Secretary shall provide for the establishment and administration of the program
			 under this section through an office in the Department of Health and Human
			 Services that is separate from the Centers for Medicare &amp; Medicaid
			 Services. The Secretary may promulgate regulations to carry out this
			 section.</text>
				</paragraph></subsection><subsection id="H3EC79D98496C4DB4868378CCF7C25FDC"><enum>(b)</enum><header>Definitions</header>
				<paragraph id="H3F1DF84FCB2E4BE7BB00B677A0265843"><enum>(1)</enum><header>Eligible
			 individual</header><text>For purposes of this section, the term <term>eligible
			 individual</term> means any individual who—</text>
					<subparagraph id="HB59D3C72A8904B9FA97FB1151EF5F2F"><enum>(A)</enum><text>is a citizen or
			 national of the United States or is an alien lawfully admitted to the United
			 States for permanent residence or otherwise permanently residing in the United
			 States under color of law;</text>
					</subparagraph><subparagraph id="H2F3D7EA9B7BF4FF2A3CEB6FD6BFBC419"><enum>(B)</enum><text display-inline="yes-display-inline">is not eligible for outpatient prescription
			 drug coverage; and</text>
					</subparagraph><subparagraph id="H1C901803D0D149A8BB006DC97415BD09"><enum>(C)</enum><text>is not eligible to
			 enroll for prescription drug coverage under part D of title XVIII of the Social
			 Security Act.</text>
					</subparagraph></paragraph><paragraph id="H5A8D1F31BE1B4E35872B390085D028FB"><enum>(2)</enum><header>Outpatient
			 prescription drug coverage</header><text>For purposes of paragraph (1)(B), the
			 term <term>outpatient prescription drug coverage</term> means coverage of
			 prescription drugs on an outpatient basis under health insurance, a group
			 health plan, or other form of health benefits coverage (such as under the
			 Federal employees health benefits program, under the medicaid program or the
			 State children’s health insurance program (SCHIP), under a program of the
			 Indian Health Service (IHS), under a program of the Department of Veterans
			 Affairs or the Department of Defense). Such term does not include coverage
			 under a high deductible plan or benefits under a health savings account or
			 flexible spending account.</text>
				</paragraph><paragraph id="H3D06BA645AA345BDBED74E12283CCEB"><enum>(3)</enum><header>Covered discount
			 card drug</header><text>For purposes of this section, the term <term>covered
			 discount card drug</term> means at least those drugs that are covered part D
			 drugs under section 1860D–2(e) of the Social Security Act.</text>
				</paragraph></subsection><subsection id="H0E29D9C454E749AC93345368C000191D"><enum>(c)</enum><header>Enrollment and
			 enrollment fees</header><text>The provisions of subsection (c) of section
			 1860D–31 of the Social Security Act shall apply under this section in the same
			 manner as they apply under such section, except that—</text>
				<paragraph id="HE7AA9AB1B6DF48928E846681ECCDA3ED"><enum>(1)</enum><text>the enrollment
			 forms shall be such enrollment forms as may be established for purposes of
			 carrying out this section;</text>
				</paragraph><paragraph id="H7045C6F69B7D464B90908585902F4146"><enum>(2)</enum><text>notwithstanding
			 paragraph (1)(C)(ii) of such subsection, there shall be an annual open
			 enrollment process for eligible individuals;</text>
				</paragraph><paragraph id="H427D15137DC4459090F7023F20C8B3A5"><enum>(3)</enum><text>notwithstanding
			 paragraph (2) of such subsection, the annual enrollment fee shall not be
			 prorated for any year and shall continue for each year in which the program is
			 in operation under this section;</text>
				</paragraph><paragraph id="HC9DFC03894A84E0D8E9424998BCAAF"><enum>(4)</enum><text>there shall be no
			 special provisions for transitional assistance for eligible individuals;
			 and</text>
				</paragraph><paragraph id="H6B88D16969184B9C8692DE306CD05C49"><enum>(5)</enum><text>the limitation on
			 enrollment before January 1, 2006, under paragraph (1)(A)(ii) of such
			 subsection shall not apply.</text>
				</paragraph></subsection><subsection id="H35A94E47E8344472003DB9FA9096BDD6"><enum>(d)</enum><header>Provision of
			 information on enrollment</header><text display-inline="yes-display-inline">The
			 provisions of subsection (d) of such section shall apply under this section in
			 the same manner as they apply under such section, except that—</text>
				<paragraph id="HC686432FBD0C419593F857611C6D7500"><enum>(1)</enum><text>the information
			 disseminated shall include information concerning the use of health savings
			 accounts to cover the costs of prescription drugs for which discounts are
			 provided under this section;</text>
				</paragraph><paragraph id="HFDF604B88C0F47B8A5F2A8DD00C739C3"><enum>(2)</enum><text>there shall be a
			 toll-free number, other than the medicare toll-free number, used to carry out
			 paragraph (1)(D) of such subsection;</text>
				</paragraph><paragraph id="H6529E31915614B8183423600DF3C3F9F"><enum>(3)</enum><text>any special
			 provisions relating to transitional assistance for eligible individuals shall
			 not apply; and</text>
				</paragraph><paragraph id="HD9C5215CCC4649EA8732760108367EBE"><enum>(4)</enum><text>the information
			 disseminated does not need to include information on medicare options.</text>
				</paragraph></subsection><subsection id="H4D39D4DEF0F44A34828CADB9B22DBC86"><enum>(e)</enum><header>Discount card
			 and eligibility features; qualification of sponsors; endorsement of programs;
			 disclosure and oversight</header>
				<paragraph id="H8E0EFA2D09CD4960B3CE5100867DD0C6"><enum>(1)</enum><header>Application of
			 certain provisions</header><text>The provisions of subsections (e) (other than
			 paragraph (1)(D)), (f), (h) (other than paragraph (9)), and (i) of such section
			 shall apply under this section in the same manner as they apply under such
			 section, except that no provision relating to transitional assistance for
			 eligible individuals shall apply.</text>
				</paragraph><paragraph id="H46340FA7EF2948D29800B26487E2A99C"><enum>(2)</enum><header>Requirement for
			 marketing plans</header><text>The Secretary shall require that sponsors of
			 prescription drug discount card programs demonstrate that they have a marketing
			 plan to reach out effectively to eligible individuals.</text>
				</paragraph><paragraph id="H040AE5844F184724B55D37ADF41C52"><enum>(3)</enum><header>Additional
			 information</header><text>In addition to the use of information described in
			 subsection (f)(3)(B) of such section for verification of eligibility, the
			 Secretary shall also use—</text>
					<subparagraph id="HCF7C7AD601644679AB327470713B1C1B"><enum>(A)</enum><text>information on
			 medicare eligibility; and</text>
					</subparagraph><subparagraph id="H29054AE1DDDB4907B296F3AAA9134390"><enum>(B)</enum><text>eligibility
			 information made available to the Secretary under arrangements between the
			 Secretary and the Secretaries of Veterans Affairs and Defense in connection
			 with programs of the Departments of Veterans Affairs and Defense.</text>
					</subparagraph></paragraph></subsection><subsection id="H52F8F89810664467BB89BE58C6D43B4B"><enum>(f)</enum><header>Miscellaneous
			 provisions</header><text>There shall be no judicial review of a determination
			 not to endorse a prescription drug discount card program or not to enter into a
			 contract with a prescription drug card sponsor under this section.</text>
